Code</XRefExternal>; (<DefinedTermFr>juge de paix</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-10-17" lims:fid="445116" lims:id="445116"><Text><DefinedTermEn>management order</DefinedTermEn> means an order made under subsection 7(1); (<DefinedTermFr>ordonnance de prise en charge</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-10-17" lims:fid="445117" lims:id="445117"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of link="C-38.8">Controlled Drugs and Substances Act</XRefExternal> or by subsection 2(1) of the <XRefExternal reference-type="act" link="C-24.5">Cannabis Act</XRefExternal>; (<DefinedTermFr>biens lims:id="445120"><Text><DefinedTermEn>Proceeds Account</DefinedTermEn> means the Seized Property Proceeds Account established by subsection 13(1); (<DefinedTermFr>compte des biens disposition</DefinedTermEn> means, in the case of forfeited property other than money, the proceeds of sale on the disposition of the property, and in the case of forfeited property that is money, the amount of the forfeited money; (<DefinedTermFr>produit de la disposition</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-10-17" lims:fid="445123" lims:id="445123"><Text><DefinedTermEn>restrained property</DefinedTermEn> means any property that is the subject of a restraint order made under section 83.13, 462.33 or 490.8 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, section 14 of the <XRefExternal reference-type="act" link="C-38.8">Controlled Drugs and Substances Act</XRefExternal> or section 91 of the <XRefExternal reference-type="act" link="C-24.5">Cannabis Act</XRefExternal>; (<DefinedTermFr>biens bloqués</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-10-17" lims:fid="445124" lims:id="445124"><Text><DefinedTermEn>seized property</DefinedTermEn> means any property seized under the authority of any Act of Parliament or pursuant to any warrant or any rule of lims:lastAmendedDate="2019-06-21" lims:fid="445130" lims:id="445130"><MarginalNote lims:inforce-start-date="2018-10-17" lims:fid="445131" lims:id="445131">Purposes of Act</MarginalNote><Label>3</Label><Text>The purposes of this Act are</Text><Paragraph lims:inforce-start-date="2018-10-17" lims:fid="445132" lims:id="445132"><Label>(a)</Label><Text>to authorize the Minister to provide consultative and other services to law enforcement agencies in relation to the seizure or restraint of property in connection with designated offences, or property that is or may be proceeds of crime or offence-related property;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1174423" lims:id="1174423"><Label>(a.1)</Label><Text>to authorize the Minister to provide consultative and other services to any person employed in the federal public administration or by a provincial or municipal authority in relation to the seizure, restraint, custody, management, forfeiture or disposal of property</Text><Subparagraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1174424" lims:id="1174424"><Label>(i)</Label><Text>by means of or in respect of which an offence or violation is committed,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1174425" lims:id="1174425"><Label>(ii)</Label><Text>that is used in any manner in connection with the commission of an offence or violation, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1174426" lims:id="1174426"><Label>(iii)</Label><Text>that is intended for use for the purpose of committing an offence or violation;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="445133" lims:id="1174427"><Label>(b)</Label><Text>to authorize the Minister to manage property</Text><Subparagraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1174428" lims:id="1174428"><Label>(i)</Label><Text>seized or restrained under any Act of Parliament or of the legislature of a province by a person employed in the federal public administration or by a provincial or municipal authority,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1174429" lims:id="1174429"><Label>(ii)</Label><Text>forfeited under any Act of Parliament or of the legislature of a province, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1174430" lims:id="1174430"><Label>(iii)</Label><Text>paid under subsection 18(2) of the <XRefExternal reference-type="act" link="P-24.501">Proceeds of Crime (Money Laundering) and Terrorist Financing Act</XRefExternal>;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="445139" lims:id="1174431"><Label>(c)</Label><Text>to authorize the Minister to dispose of property referred to in paragraph (b) when it is forfeited to Her Majesty and, with the consent of the government of the province, when it is forfeited to Her Majesty in right of a province;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="445140" lims:id="1174432"><Label>(d)</Label><Text>where property referred to in paragraph (c) is forfeited to Her Majesty and disposed of, or where a fine is imposed pursuant to subsection 462.37(3) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, to provide authority for the sharing, in certain circumstances, of the proceeds of disposition therefrom or the fine, as the case may be, with jurisdictions the law enforcement agencies of which participated in the investigations of the offences that led to the forfeiture or the imposition of the fine; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1174433" lims:id="1174433"><Label>(e)</Label><Text>if property referred to in paragraph (c) is forfeited to Her Majesty in right of a province and disposed of by the Minister with the consent of the government of the province, to provide authority for the sharing of the proceeds of lims:fid="445145" lims:id="445145">Minister to be responsible for management of property</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2018-10-17" lims:fid="445146" lims:id="445146"><Label>(1)</Label><Text>On taking possession or control thereof, the Minister shall be responsible for the custody and management of all property that is</Text><Paragraph lims:inforce-start-date="2023-09-20" lims:enacted-date="2023-06-22" lims:fid="445147" lims:id="1420723"><Label>(a)</Label><Text>seized under a warrant issued under section 83.13, 462.32, 462.321 or 487 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, section 11 of the <XRefExternal reference-type="act" link="C-38.8">Controlled Drugs and Substances Act</XRefExternal> or section 87 of the <XRefExternal reference-type="act" link="C-24.5">Cannabis Act</XRefExternal> on the application of the Attorney General and that the Minister is appointed to manage under subsection 83.13(3), 462.331(2) or 490.81(2) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, subsection 15.1(2) of the <XRefExternal reference-type="act" link="C-38.8">Controlled Drugs and Substances Act</XRefExternal> or subsection 93(2) of the <XRefExternal reference-type="act" link="C-24.5">Cannabis Act</XRefExternal>, as the case may be;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-10-17" lims:fid="445148" lims:id="445148"><Label>(b)</Label><Text>subject to a restraint order made under section 83.13, 462.33 or 490.8 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, section 14 of the <XRefExternal reference-type="act" link="C-38.8">Controlled Drugs and Substances Act</XRefExternal> or section 91 of the <XRefExternal reference-type="act" link="C-24.5">Cannabis Act</XRefExternal> on the application of the Attorney General and that the Minister is appointed to manage under subsection 83.13(3), 462.331(2) or 490.81(2) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, subsection 15.1(2) of the <XRefExternal reference-type="act" link="C-38.8">Controlled Drugs and Substances Act</XRefExternal> or subsection 93(2) of the <XRefExternal reference-type="act" link="C-24.5">Cannabis Act</XRefExternal>, as the case may be;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1174435" lims:id="1174435"><Label>(b.01)</Label><Text>seized or restrained under any Act of Parliament or of the legislature of a province if the Minister agrees to be responsible for the custody and management of the property;</Text></Paragraph><Paragraph lims:inforce-start-date="2025-04-01" lims:enacted-date="2024-06-20" lims:fid="445149" lims:id="1526846"><Label>(b.1)</Label><Text>forfeited under subsection 14(5) or 39.03(5), seized under subsection 18(1) or 39.06(1) or paid under subsection 18(2) of the <XRefExternal reference-type="act" link="P-24.501">Proceeds of Crime (Money Laundering) and Terrorist Financing Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="445150" lims:id="1174436"><Label>(b.2)</Label><Text>forfeited under subparagraph 715.34(1)(e)(i) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2025-04-01" lims:enacted-date="2024-06-20" lims:fid="1174437" lims:id="1526847"><Label>(b.3)</Label><Text>if the Minister agrees to be responsible for its custody and management, forfeited under any Act of Parliament, other than under subsection 14(5) or 39.03(5) of the <XRefExternal reference-type="act" link="P-24.501">Proceeds of Crime (Money Laundering) and Terrorist Financing Act</XRefExternal> or subparagraph 715.34(1)(e)(i) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> or forfeited under any Act of the legislature of a province; or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-10-17" lims:fid="445151" lims:id="445151"><Label>(c)</Label><Text>subject to a management order.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-10-17" lims:fid="445152" lims:id="445152"><MarginalNote lims:inforce-start-date="2018-10-17" lims:fid="445153" lims:id="445153">Responsibility continues after forfeiture</MarginalNote><Label>(2)</Label><Text>Where property referred to in subsection (1) that is in the possession or under the control of the Minister is forfeited to Her Majesty, the Minister shall continue to be responsible for the custody and management thereof until the property is disposed of.</Text></Subsection><Subsection lims:inforce-start-date="2018-10-17" lims:fid="445154" lims:id="445154"><MarginalNote lims:inforce-start-date="2018-10-17" lims:fid="445155" lims:id="445155">Additional responsibility</MarginalNote><Label>(3)</Label><Text>In addition to being responsible for the custody and management of property referred to in subsections (1) and (2), the Minister shall be responsible, until the property is disposed of, for the custody and management of all proceeds of crime, offence-related property and property that was the subject of an application under section 83.14 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, that were forfeited to Her Majesty as a result of proceedings conducted by the Attorney General and that were not in the possession or under the control of the Minister prior to their forfeiture.</Text></Subsection><Subsection lims:inforce-start-date="2018-10-17" lims:fid="445156" lims:id="445156"><MarginalNote lims:inforce-start-date="2018-10-17" lims:fid="445157" lims:id="445157">Application of other Acts</MarginalNote><Label>(4)</Label><Text>Nothing in this section precludes the operation of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, the <XRefExternal reference-type="act" link="C-38.8">Controlled Drugs and Substances Act</XRefExternal>, the <XRefExternal reference-type="act" link="C-24.5">Cannabis Act</XRefExternal> or any other Act of Parliament in respect of any property that is in the possession or under the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, subsection 15.1(1) of the <XRefExternal reference-type="act" link="C-38.8">Controlled Drugs and Substances Act</XRefExternal>, subsection 93(1) of the <XRefExternal reference-type="act" link="C-24.5">Cannabis Act</XRefExternal> or subsection 7(1) of this Act shall, as soon as practicable after the order is issued, transfer the control of the property to the Minister, except for any property or any part of the property that is needed as evidence or is necessary for the purposes of an investigation.</Text></Subsection><Subsection lims:inforce-start-date="2018-10-17" lims:fid="445163" lims:id="445163"><MarginalNote lims:inforce-start-date="2018-10-17" lims:fid="445164" lims:id="445164">Minister to report location</MarginalNote><Label>(2)</Label><Text>Where the Minister takes control of property pursuant to subsection (1) and detains the property in a location other than the location referred to in the report required to be filed pursuant to paragraph 462.32(4)(b) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, the Minister shall prepare a report in the prescribed form identifying the location of the property and cause the report to be filed in the prescribed manner with the clerk of the court that issued the link="C-38.8">Controlled Drugs and Substances Act</XRefExternal> or <DefinitionRef>cannabis</DefinitionRef> as defined in subsection 2(1) of the <XRefExternal reference-type="act" lims:fid="445178" lims:id="445178"><Label>(1)</Label><Text>Where an application for a management order is made, the judge or justice hearing the application shall make an order allowing the Minister to take possession and control of, and to manage or otherwise deal with, the seized property referred to in the order if the judge or justice is of the opinion that the seized property may be required for the purposes of any provision respecting forfeiture in any Act of Parliament.</Text></Subsection><Subsection lims:inforce-start-date="2018-06-21" lims:fid="445179" lims:id="445179"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="445180" lims:id="445180">Power to manage</MarginalNote><Label>(2)</Label><Text>The power of the Minister in respect of any seized property that is the subject of a management order includes</Text><Paragraph lims:inforce-start-date="2018-06-21" lims:fid="445181" lims:id="445181"><Label>(a)</Label><Text>the power to make an interlocutory sale of perishable or rapidly depreciating property;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-21" lims:fid="445182" lims:id="445182"><Label>(b)</Label><Text>the power to destroy, in accordance with subsections (2.1) to (2.4), property that has little or no value; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-21" lims:fid="445183" lims:id="445183"><Label>(c)</Label><Text>the power to have property, other than real property or a conveyance, forfeited to Her Majesty in accordance with subsection (2.5).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-06-21" lims:fid="445184" lims:id="445184"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="445185" lims:id="445185">Application for destruction order</MarginalNote><Label>(2.1)</Label><Text>Before the Minister destroys property that has little or no value, he or she shall apply to a court for a destruction order.</Text></Subsection><Subsection lims:inforce-start-date="2018-06-21" lims:fid="445186" lims:id="445186"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="445187" lims:id="445187">Notice</MarginalNote><Label>(2.2)</Label><Text>Before making a destruction order, a court shall require notice in accordance with subsection (2.3) to be given to and may hear any person who, in the court’s opinion, appears to have a valid interest in the property.</Text></Subsection><Subsection lims:inforce-start-date="2018-06-21" lims:fid="445188" lims:id="445188"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="445189" lims:id="445189">Manner of giving notice</MarginalNote><Label>(2.3)</Label><Text>A notice shall</Text><Paragraph lims:inforce-start-date="2018-06-21" lims:fid="445190" lims:id="445190"><Label>(a)</Label><Text>be given in the manner that the court directs or that may be specified in the rules of the court; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-21" lims:fid="445191" lims:id="445191"><Label>(b)</Label><Text>specify the effective period of the notice that the court considers reasonable or that may be set out in the rules of the court.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-06-21" lims:fid="445192" lims:id="445192"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="445193" lims:id="445193">Destruction order</MarginalNote><Label>(2.4)</Label><Text>A court shall order that the property be destroyed if it is satisfied that the property has little or no financial or other value.</Text></Subsection><Subsection lims:inforce-start-date="2018-06-21" lims:fid="445194" lims:id="445194"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="445195" lims:id="445195">Forfeiture order</MarginalNote><Label>(2.5)</Label><Text>On application by the Minister, a court shall order that the property, other than real property or a conveyance, be forfeited to Her Majesty and disposed of or otherwise dealt with in accordance with the law if</Text><Paragraph lims:inforce-start-date="2018-06-21" lims:fid="445196" lims:id="445196"><Label>(a)</Label><Text>a notice is given or published in the manner that the court directs or that may be specified in the rules of the court;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-21" lims:fid="445197" lims:id="445197"><Label>(b)</Label><Text>the notice specifies a period of 60 days during which a person may make an application to the court asserting their interest in the property; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-21" lims:fid="445198" lims:id="445198"><Label>(c)</Label><Text>during that period, no one makes such an application.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-06-21" lims:fid="445199" lims:id="445199"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="445200" lims:id="445200">When management order ceases to have effect</MarginalNote><Label>(3)</Label><Text>A management order ceases to have effect when the property that is the subject of the management order is returned in accordance with the law, destroyed or forfeited to Her Majesty.</Text></Subsection><Subsection lims:inforce-start-date="2018-06-21" lims:fid="445201" lims:id="445201"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="445202" lims:id="445202">For greater certainty</MarginalNote><Label>(4)</Label><Text>For greater certainty, if property that is the subject of a management order is sold, the management order applies to the net proceeds of the lims:id="445207"><Label>(1)</Label><Text>A management order may be subject to such conditions as the judge or justice making the order thinks fit.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="445208" lims:id="445208"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="445209" lims:id="445209">Application to vary conditions</MarginalNote><Label>(2)</Label><Text>The Minister may at any time apply to a judge or justice to cancel or vary any condition to which a management order is subject.</Text></Subsection></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="445210" lims:id="445210" level="1"><TitleText>Powers of Minister</TitleText></Heading><Section lims:inforce-start-date="2018-10-17" lims:lastAmendedDate="2019-06-21" lims:fid="445211" lims:id="445211"><MarginalNote lims:inforce-start-date="2018-10-17" lims:fid="445212" lims:id="445212">Ministerial powers</MarginalNote><Label>9</Label><Text>In carrying out the purposes of this Act, the Minister may</Text><Paragraph lims:inforce-start-date="2018-10-17" lims:fid="445213" lims:id="445213"><Label>(a)</Label><Text>provide consultative and other services to law enforcement agencies in relation to the seizure or restraint of any property in connection with designated offences, or any property that is or may be proceeds of crime or offence-related property;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1174439" lims:id="1174439"><Label>(a.1)</Label><Text>provide consultative and other services to any person employed in the federal public administration or by a provincial or municipal authority in relation to the seizure, restraint, custody, management, forfeiture or disposal of property</Text><Subparagraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1174440" lims:id="1174440"><Label>(i)</Label><Text>by means of or in respect of which an offence or violation is committed,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1174441" lims:id="1174441"><Label>(ii)</Label><Text>that is used in any manner in connection with the commission of an offence or violation, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1174442" lims:id="1174442"><Label>(iii)</Label><Text>that is intended for use for the purpose of committing an offence or violation;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-10-17" lims:fid="445214" lims:id="445214"><Label>(b)</Label><Text>subject to the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, the <XRefExternal reference-type="act" link="C-38.8">Controlled Drugs and Substances Act</XRefExternal>, the <XRefExternal reference-type="act" link="C-24.5">Cannabis Act</XRefExternal> and any other Act of Parliament, manage any property referred to in any of subsections 4(1) to (3) in the manner that the Minister considers appropriate including, without restricting the generality of the foregoing, by advancing money at a commercial rate of interest to</Text><Subparagraph lims:inforce-start-date="2018-10-17" lims:fid="445215" lims:id="445215"><Label>(i)</Label><Text>maintain the ongoing operation of the property,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-10-17" lims:fid="445216" lims:id="445216"><Label>(ii)</Label><Text>satisfy the terms of any order concerning environmental, industrial, labour or property standards to which the property is subject, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-10-17" lims:fid="445217" lims:id="445217"><Label>(iii)</Label><Text>make improvements to the property to preserve the property and its economic worth;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-10-17" lims:fid="445218" lims:id="445218"><Label>(c)</Label><Text>notwithstanding any other Act of Parliament, but subject to the regulations and to the provisions of the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal> relating to public money, dispose of any property referred to in any of subsections 4(1) to (3) that is forfeited to Her Majesty;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1174443" lims:id="1174443"><Label>(c.1)</Label><Text>if property is forfeited to Her Majesty in right of a province, dispose of the property on behalf of Her Majesty in right of the province with the consent of the government of that province, and share the proceeds of disposition in accordance with directions given by that government;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-10-17" lims:fid="445219" lims:id="445219"><Label>(d)</Label><Text>notwithstanding subsection 734.4(2) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> and sections 125 and 126 of the <XRefExternal reference-type="act" link="E-14">Excise Act</XRefExternal>, where property referred to in any of subsections 4(1) to (3) is forfeited to Her Majesty, share the proceeds of disposition therefrom in accordance with this Act, the regulations and any agreement entered into pursuant to section 11;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-10-17" lims:fid="445220" lims:id="445220"><Label>(e)</Label><Text>notwithstanding subsection 734.4(2) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> and sections 125 and 126 of the <XRefExternal reference-type="act" link="E-14">Excise Act</XRefExternal>, if a fine, or any portion of a fine, imposed under subsection 462.37(3) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> in relation to proceedings commenced at the instance of the Government of Canada is paid or recovered or if a penalty is paid under subsection 18(2) of the <XRefExternal reference-type="act" link="P-24.501">Proceeds of Crime (Money Laundering) and Terrorist Financing Act</XRefExternal>, share the amount of the fine or penalty in accordance with this Act, the regulations and any agreement entered into under section 11;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-10-17" lims:fid="445221" lims:id="445221"><Label>(f)</Label><Text>at the request of the Attorney General, receive from foreign governments all moneys that are to be transferred to Canada pursuant to any agreement entered into pursuant to section 11 and share those moneys in accordance with the regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-10-17" lims:fid="445222" lims:id="445222"><Label>(g)</Label><Text>contract for the services of any person; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-10-17" lims:fid="445223" lims:id="445223"><Label>(h)</Label><Text>do any other thing that the Governor in Council may consider to lims:id="445229"><Label>(1)</Label><Text>Where a law enforcement agency in Canada has participated in the investigation of an offence that leads to</Text><Paragraph lims:inforce-start-date="2018-10-17" lims:fid="445230" lims:id="445230"><Label>(a)</Label><Text>the forfeiture to Her Majesty of property under section 83.14, subsection 462.37(1), (2) or (2.01) or 462.38(2), subparagraph 462.43(c)(iii) or subsection 490.1(1) or 490.2(2) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, subsection 16(1) or 17(2) of the <XRefExternal reference-type="act" link="C-38.8">Controlled Drugs and Substances Act</XRefExternal> or subsection 94(1) or 95(2) of the <XRefExternal reference-type="act" link="C-24.5">Cannabis Act</XRefExternal>,</Text></Paragraph><Paragraph lims:inforce-start-date="2018-10-17" lims:fid="445231" lims:id="445231"><Label>(b)</Label><Text>the forfeiture to Her Majesty pursuant to subsection 490(9) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> of any property that is or was the subject of a management order, or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-10-17" lims:fid="445232" lims:id="445232"><Label>(c)</Label><Text>the imposition of a fine pursuant to subsection 462.37(3) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> in relation to proceedings commenced at the instance of the Government of Canada,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2018-10-17" lims:fid="445233" lims:id="445233"><Text>the Minister shall, in accordance with the regulations, share the proceeds of disposition of that forfeited property, or any amount paid or recovered on account of the fine, as the case may be.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2018-10-17" lims:fid="445234" Terrorist Financing Act</XRefExternal></MarginalNote><Label>(2)</Label><Text>If the participation of a law enforcement agency in Canada has led to the forfeiture to Her Majesty of property under the  <XRefExternal reference-type="act" link="P-24.501">Proceeds of Crime (Money Laundering) and Terrorist Financing Act</XRefExternal> or the payment of a penalty under subsection 18(2) of that Act, the Minister shall, in accordance with the regulations, share the proceeds of disposition of that forfeited property or the penalty, as the case may or (2.01) or 462.38(2), subparagraph 462.43(c)(iii) or subsection 490.1(1) or 490.2(2) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, subsection 16(1) or 17(2) of the <XRefExternal reference-type="act" link="C-38.8">Controlled Drugs and Substances Act</XRefExternal> or subsection 94(1) or 95(2) of the <XRefExternal reference-type="act" link="C-24.5">Cannabis Act</XRefExternal>, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-10-17" lims:fid="445242" lims:id="445242"><Label>(ii)</Label><Text>property that is or was the subject of a management order and that was forfeited under subsection 490(9) of the  <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal></Text></Subparagraph><ContinuedParagraph lims:inforce-start-date="2018-10-17" lims:fid="445243" lims:id="445243"><Text>and the proceeds arising from the disposition of property by that foreign state, and</Text></ContinuedParagraph></Paragraph><Paragraph lims:inforce-start-date="2018-10-17" lims:fid="445244" lims:id="445244"><Label>(b)</Label><Text>amounts paid or recovered on account of fines imposed under subsection 462.37(3) of the  <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> in relation to proceedings commenced at the instance of the Government of Canada, penalties paid under subsection 18(2) of the  <XRefExternal reference-type="act" link="P-24.501">Proceeds of Crime (Money Laundering) and Terrorist Financing Act</XRefExternal> and amounts paid or recovered on account of fines imposed in lieu of forfeiture under the laws of that foreign state,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2018-10-17" lims:fid="445245" lims:id="445245"><Text>if law enforcement agencies of that foreign state, or of Canada, as the case may be, have participated in the investigation of the offence or offences that led to the forfeiture of the property or the imposition of the fine or if the law enforcement agencies' participation led to the forfeiture of the property or the payment of the penalty under the  <XRefExternal recovered on account of fines imposed under subsection 462.37(3) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> in relation to proceedings commenced at the instance foregoing, regulations respecting the amounts to be shared, or the manner of determining those amounts, and the times at which and the manner in which those amounts shall be lims:id="445311"><Label>(e)</Label><Text>prescribing anything that by this Act is to be prescribed; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="445312"
