S-27, s. 5; R.S., 1985, c. 22 (1st Supp.), s. 3, c. 35 (4th Supp.), s. 13; 1992, c. 54, s. 83</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="443888" lims:id="443888"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="443889" lims:id="443889">Ministerial powers</MarginalNote><Label>6</Label><Text>With specific or general authority from the Governor in Council, the Minister may</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="443890" lims:id="443890"><Label>(a)</Label><Text>sell, exchange, lease, lend or otherwise dispose of or deal with accepted surplus Crown assets either gratuitously or for consideration and on such terms and subject to such conditions as the Minister may consider desirable;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="443891" lims:id="443891"><Label>(b)</Label><Text>hold, manage, operate, finish, assemble, store, transport, repair, maintain and service accepted surplus Crown assets;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="443892" lims:id="443892"><Label>(c)</Label><Text>restore to its original condition any property that has been made available to Her Majesty and settle any claim in connection therewith;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="443893" lims:id="443893"><Label>(c.1)</Label><Text><Repealed>[Repealed, 1992, c. 54, s. 84]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="443894" lims:id="443894"><Label>(d)</Label><Text>convert accepted surplus Crown assets to basic materials;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="443895" lims:id="443895"><Label>(e)</Label><Text>transfer accepted surplus Crown assets from one department to another;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="443896" lims:id="443896"><Label>(f)</Label><Text>make such orders and issue such directions as the Minister may deem necessary or expedient to provide for the safety and preservation of accepted surplus Crown assets;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="443897" lims:id="443897"><Label>(g)</Label><Text>direct any person to furnish, within such time as the Minister may specify, such information with regard to accepted surplus Crown assets as the Minister may specify;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="443898" lims:id="443898"><Label>(h)</Label><Text>engage or make use of the services of any person in carrying out any of the purposes of this Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="443899" lims:id="443899"><Label>(i)</Label><Text>delete from a notice given under section 4 any assets identified therein; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="443900" lims:id="443900"><Label>(j)</Label><Text>do any other thing the Governor in Council may consider to be incidental to, or necessary or expedient for, carrying out the objects of this Act.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="443902" lims:id="443902">R.S., 1985, c. S-27, s. 6; R.S., 1985, c. 22 (1st Supp.), s. 4; 1992, c. 54, s. 84</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="443903" lims:id="443903" level="1"><TitleText>Crown Assets Disposal Corporation</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="443904" lims:id="443904"><Label>7. to 12</Label><Text><Repealed>[Repealed, R.S., 1985, c. 22 (1st Supp.), s. 5]</Repealed></Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="443905" lims:id="443905"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="443906" lims:id="443906">Proceeds of sale by Minister</MarginalNote><Label>13</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="443907" lims:id="443907"><Label>(1)</Label><Text>Subject to subsection (3) and subsections 99(2) to (5) of the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>, where the Minister sells any accepted surplus Crown assets of a federal body, the Minister shall remit to that body an amount equal to the net proceeds of the sale not later than the last day of the month following the month in which the proceeds were received.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="443908" lims:id="443908"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="443909" lims:id="443909">Idem</MarginalNote><Label>(2)</Label><Text>Subject to subsection (3), where the Minister sells any accepted surplus Crown assets of a department, other than property forfeited pursuant to an Act of Parliament, an amount equal to the net proceeds of the sale may, subject to such terms and conditions as the Treasury Board may prescribe, be paid out of the Consolidated Revenue Fund for the purposes of that department.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="443910" lims:id="443910"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="443911" lims:id="443911">Administrative expenses</MarginalNote><Label>(3)</Label><Text>The Minister may retain out of the net proceeds of a sale referred to in subsection (1) or (2) such percentage of the net proceeds of sales of accepted surplus Crown assets in the period in which the sale is made as the Treasury Board may fix for the purpose of meeting the administrative or other expenses incurred with respect to those sales.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="443913" lims:id="443913">R.S., 1985, c.
