S-19, s. 2; 2017, c. 31, s. 1</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2017-12-12" lims:fid="440843" lims:id="440843" level="1"><TitleText>Statistics Canada</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="440844" lims:id="440844"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="440845" lims:id="440845">Statistics bureau</MarginalNote><Label>3</Label><Text>There shall continue to be a statistics bureau under the Minister, to be known as Statistics Canada, the duties of which are</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="440846" lims:id="440846"><Label>(a)</Label><Text>to collect, compile, analyse, abstract and publish statistical information relating to the commercial, industrial, financial, social, economic and general activities and condition of the people;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="440847" lims:id="440847"><Label>(b)</Label><Text>to collaborate with departments of government in the collection, compilation and publication of statistical information, including statistics derived from the activities of those departments;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="440848" lims:id="440848"><Label>(c)</Label><Text>to take the census of population of Canada and the census of agriculture of Canada as provided in this Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="440849" lims:id="440849"><Label>(d)</Label><Text>to promote the avoidance of duplication in the information collected by departments of government; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="440850" lims:id="440850"><Label>(e)</Label><Text>generally, to promote and develop integrated social and economic statistics pertaining to the whole of Canada and to each of the provinces thereof and to coordinate plans for the integration of those statistics.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="440852" lims:id="440852">1970-71-72, c. 15, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2017-12-12" lims:lastAmendedDate="2017-12-12" lims:fid="440853" lims:id="440853"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="440854" lims:id="440854">Chief Statistician</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2017-12-12" lims:fid="440855" lims:id="440855"><Label>(1)</Label><Text>The Governor in Council shall appoint the Chief Statistician of Canada to be the deputy head of Statistics Canada.</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="440856" lims:id="440856"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="440857" lims:id="440857">Tenure</MarginalNote><Label>(2)</Label><Text>The Chief Statistician holds office for a term of not more than five years during good behaviour, but may be removed for cause by the Governor in Council.</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="440858" lims:id="440858"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="440859" lims:id="440859">Reappointment</MarginalNote><Label>(3)</Label><Text>The Chief Statistician is eligible to be reappointed for an additional term of not more than five years.</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="440860" lims:id="440860"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="440861" lims:id="440861">Interim appointment</MarginalNote><Label>(4)</Label><Text>In the event of the absence or incapacity of the Chief Statistician, or if that office is vacant, the Governor in Council may appoint any qualified person to hold that office in the interim for a term not exceeding six months, and that person shall, while holding office, be paid the salary or other remuneration and expenses that may be fixed by the Governor in Council.</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="440862" lims:id="440862"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="440863" lims:id="440863">Duties</MarginalNote><Label>(5)</Label><Text>The Chief Statistician shall, in addition to any other duties imposed on him or her under any other provision of this Act,</Text><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="440864" lims:id="440864"><Label>(a)</Label><Text>decide, based strictly on professional statistical standards that he or she considers appropriate, the methods and procedures for carrying out statistical programs regarding</Text><Subparagraph lims:inforce-start-date="2017-12-12" lims:fid="440865" lims:id="440865"><Label>(i)</Label><Text>the collection, compilation, analysis, abstraction and publication of statistical information that is produced or is to be produced by Statistics Canada,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-12-12" lims:fid="440866" lims:id="440866"><Label>(ii)</Label><Text>the content of statistical releases and publications issued by Statistics Canada, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-12-12" lims:fid="440867" lims:id="440867"><Label>(iii)</Label><Text>the timing and methods of dissemination of statistics compiled by Statistics Canada;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="440868" lims:id="440868"><Label>(b)</Label><Text>advise on matters pertaining to statistical programs of the departments and agencies of the Government of Canada, and confer with those departments and agencies to that end; and</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="440869" lims:id="440869"><Label>(c)</Label><Text>control the operations and staff of Statistics Canada.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="440870" lims:id="440870"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="440871" lims:id="440871">Report to Minister</MarginalNote><Label>(6)</Label><Text>In each fiscal year the Chief Statistician shall make a report to the Minister on the activities of Statistics Canada in the preceding fiscal year, and that report shall be included as a separate part of the Minister’s annual report to Parliament.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2017-12-12" lims:fid="440873" lims:id="440873">R.S., 1985, c. S-19, s. 4; 2017, c. 31, s. 2</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2017-12-12" lims:lastAmendedDate="2017-12-12" lims:fid="440874" lims:id="440874"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="440875" lims:id="440875">Directives on methods, procedures and operations</MarginalNote><Label>4.1</Label><Subsection lims:inforce-start-date="2017-12-12" lims:fid="440876" lims:id="440876"><Label>(1)</Label><Text>Directives on any methods, procedures and operations may only be issued to the Chief Statistician by the Governor in Council, by order, on the recommendation of the Minister.</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="440877" lims:id="440877"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="440878" lims:id="440878">Tabling</MarginalNote><Label>(2)</Label><Text>Within 15 days after the day on which an order is made, the Minister shall cause a copy of the order to be tabled in each House of Parliament.</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="440879" lims:id="440879"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="440880" lims:id="440880">House not sitting</MarginalNote><Label>(3)</Label><Text>If the House is not sitting, in order to comply with subsection (2), the order shall be sent to the Clerk of the House within 15 days after the day on which the order is made.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2017-12-12" lims:fid="440882" lims:id="440882">2017, c. 31, s. 2</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2017-12-12" lims:lastAmendedDate="2017-12-12" lims:fid="440883" lims:id="440883"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="440884" lims:id="440884">Directives on statistical programs</MarginalNote><Label>4.2</Label><Subsection lims:inforce-start-date="2017-12-12" lims:fid="440885" lims:id="440885"><Label>(1)</Label><Text>The Minister may issue directives to the Chief Statistician on the statistical programs that aim to collect, compile, analyse, abstract and publish statistics on all or any of the matters referred to in section 22.</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="440886" lims:id="440886"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="440887" lims:id="440887">Publication of directives</MarginalNote><Label>(2)</Label><Text>The Chief Statistician may require that any directive issued to him or her under subsection (1) be made in writing and made public before the Chief Statistician acts on it.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2017-12-12" lims:fid="440889" lims:id="440889">2017, c. 31, s. 2</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2017-12-12" lims:lastAmendedDate="2017-12-12" lims:fid="440890" lims:id="440890"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="440891" lims:id="440891">Temporary employees</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2017-12-12" lims:fid="440892" lims:id="440892"><Label>(1)</Label><Text>The Chief Statistician may employ, in the manner authorized by law, any commissioners, enumerators, agents or other persons that are necessary to collect for Statistics Canada the statistics and information that the Minister considers useful and in the public interest relating to the commercial, industrial, financial, social, economic and other activities that the Minister may determine. The duties of the commissioners, enumerators, agents or other persons shall be those duties prescribed by the Chief Statistician.</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="440893" lims:id="440893"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="440894" lims:id="440894">Public servants</MarginalNote><Label>(2)</Label><Text>The Minister may, for such periods as the Minister may determine, use the services of any employee of the federal public administration in the exercise or performance of any duty, power or function of Statistics Canada or an officer of Statistics Canada under this Act or any other Act, and any person whose services are so used shall, for the purposes of this Act, be deemed to be a person employed under this Act.</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="440895" lims:id="440895"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="440896" lims:id="440896">Contracted services</MarginalNote><Label>(3)</Label><Text>Any persons retained under contract to perform special services for the Chief Statistician under this Act and the employees and agents of those persons are, for the purposes of this Act, deemed to be persons employed under this Act while performing those services.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2017-12-12" lims:fid="440898" lims:id="440898">R.S., 1985, c. S-19, s. 5; 2003, c. 22, s. 224(E); 2017, c. 31, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2017-12-12" lims:lastAmendedDate="2017-12-12" lims:fid="440899" lims:id="440899"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="440900" lims:id="440900">Oath of office</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2017-12-12" lims:fid="440901" lims:id="440901"><Label>(1)</Label><Text>The Chief Statistician and every person employed or deemed to be employed pursuant to this Act shall, before entering on his duties, take and subscribe the following oath or solemn affirmation:</Text><Provision lims:inforce-start-date="2017-12-12" lims:fid="440902" lims:id="440902" format-ref="indent-0-0" language-align="no" pointsize="9" list-item="no"><Text>I, <Leader leader="dot" length="3.5pc" />, do solemnly swear (or affirm) that I will faithfully and honestly fulfil my duties as an employee of Statistics Canada in conformity with the requirements of the <XRefExternal reference-type="act" link="S-19">Statistics Act</XRefExternal>, and of all rules and instructions thereunder and that I will not without due authority in that behalf disclose or make known any matter or thing that comes to my knowledge by reason of my employment.</Text></Provision></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="440903" lims:id="440903"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="440904" lims:id="440904">Attestation</MarginalNote><Label>(2)</Label><Text>The oath or solemn affirmation set out in subsection (1) shall be taken before the person, and returned and recorded in the manner, that the Chief Statistician may direct.</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="440905" lims:id="440905"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="440906" lims:id="440906">Incorporated contractors</MarginalNote><Label>(3)</Label><Text>If a person retained under contract to perform special services for the Chief Statistician under this Act is a corporation, its chief executive officer and any of its other officers, employees and agents that are used to perform the special services shall, before fulfilling any of the duties required under the contract, take and subscribe the following oath or solemn affirmation:</Text><Provision lims:inforce-start-date="2017-12-12" lims:fid="440907" lims:id="440907" format-ref="indent-0-0" language-align="no" pointsize="9" list-item="no"><Text>I, <Leader leader="dot" length="3.5pc" />, do solemnly swear (or affirm) that I will faithfully and honestly fulfil my duties as an employee of (<Emphasis style="italic">name of the corporation</Emphasis>) in respect of my employment in carrying out (<Emphasis style="italic">identify here contract with Chief Statistician</Emphasis>) in conformity with the requirements of the <XRefExternal reference-type="act" link="S-19">Statistics Act</XRefExternal>, and of all rules and instructions under that Act and that I will not without due authority disclose or make known any matter or thing that comes to my knowledge by reason of this employment.</Text></Provision></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="440908" lims:id="440908"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="440909" lims:id="440909">Attestation</MarginalNote><Label>(4)</Label><Text>The oath or solemn affirmation set out in subsection (3) shall be taken before the person, and returned and recorded in the manner, that the Chief Statistician may direct.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2017-12-12" lims:fid="440911" lims:id="440911">R.S., 1985, c. S-19, s. 6; 2017, c. 31, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2017-12-12" lims:lastAmendedDate="2017-12-12" lims:fid="440912" lims:id="440912"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="440913" lims:id="440913">Rules, instructions and requests for information</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2017-12-12" lims:fid="440914" lims:id="440914"><Label>(1)</Label><Text>The Chief Statistician may prescribe the rules, instructions and, subject to subsection 21(1), requests for information that he or she considers necessary for conducting the work and business of Statistics Canada, the collecting, compiling and publishing of statistics and other information and the taking of any census authorized by this Act.</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="440915" lims:id="440915"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="440916" lims:id="440916">Clarification</MarginalNote><Label>(2)</Label><Text>For greater certainty, any rule, instruction or request for information prescribed under subsection (1) is not a regulation for the purposes of the <XRefExternal reference-type="act" link="S-22">Statutory Instruments Act</XRefExternal>.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2017-12-12" lims:fid="440918" lims:id="440918">R.S., 1985, c. S-19, s. 7; 2017, c. 31, s. 5</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2017-12-12" lims:lastAmendedDate="2017-12-12" lims:fid="440919" lims:id="440919"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="440920" lims:id="440920">Mandatory or voluntary requests for information</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2017-12-12" lims:fid="440921" lims:id="440921"><Label>(1)</Label><Text>The Chief Statistician shall determine whether a request for information is mandatory or voluntary, with the exception of the census of population and census of agriculture, both of which are mandatory.</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="440922" lims:id="440922"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="440923" lims:id="440923">Publication</MarginalNote><Label>(2)</Label><Text>The Chief Statistician shall publish any mandatory request for information before the request is made.</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="440924" lims:id="440924"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="440925" lims:id="440925">Notification of Minister</MarginalNote><Label>(3)</Label><Text>The Chief Statistician shall notify the Minister of any new mandatory request for information at least 30 days before the day on which it is published.</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="440926" lims:id="440926"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="440927" lims:id="440927">Voluntary requests for information — paragraph 31(a) does not apply</MarginalNote><Label>(4)</Label><Text>Paragraph 31(a) does not apply to a person to whom a voluntary request for information is made.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2017-12-12" lims:fid="440929" lims:id="440929">R.S., 1985, c. S-19, s. 8; 2017, c. 31, s. 5</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2017-12-12" lims:fid="440930" lims:id="440930" level="1"><TitleText>Canadian Statistics Advisory Council</TitleText></Heading><Section lims:inforce-start-date="2017-12-12" lims:lastAmendedDate="2017-12-12" lims:fid="440931" lims:id="440931"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="440932" lims:id="440932">Establishment</MarginalNote><Label>8.1</Label><Subsection lims:inforce-start-date="2017-12-12" lims:fid="440933" lims:id="440933"><Label>(1)</Label><Text>An advisory council, to be known as the Canadian Statistics Advisory Council, is established</Text><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="440934" lims:id="440934"><Label>(a)</Label><Text>to advise the Minister and Chief Statistician in a transparent manner on any question that either of them has referred to the Council on the overall quality of the national statistical system, including the relevance, accuracy, accessibility and timeliness of its data; and</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="440935" lims:id="440935"><Label>(b)</Label><Text>to make public an annual report on the state of the national statistical system.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="440936" lims:id="440936"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="440937" lims:id="440937">Membership</MarginalNote><Label>(2)</Label><Text>The Council is composed of, in addition to the Chief Statistician, not more than 10 other members appointed by the Governor in Council to hold office during pleasure, including one Chairperson.</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="440938" lims:id="440938"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="440939" lims:id="440939">Ex officio</MarginalNote><Label>(3)</Label><Text>The Chief Statistician is an <Language xml:lang="la">ex officio</Language> member of the Council.</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="440940" lims:id="440940"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="440941" lims:id="440941">Tenure of Chairperson</MarginalNote><Label>(4)</Label><Text>The Chairperson is appointed to a term of not more than five years and may be reappointed for an additional term of three years.</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="440942" lims:id="440942"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="440943" lims:id="440943">Tenure of other members</MarginalNote><Label>(5)</Label><Text>The other members are appointed to a term of three years and may be reappointed for an additional term of three years.</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="440944" lims:id="440944"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="440945" lims:id="440945">Remuneration and expenses</MarginalNote><Label>(6)</Label><Text>The members appointed under subsection (2) shall be paid the remuneration that is fixed by the Governor in Council and are entitled to be paid any reasonable travel and living expenses that are incurred while absent from their ordinary place of residence in the course of performing their duties under this Act.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2017-12-12" lims:fid="440947" lims:id="440947">2017, c. 31, s. 5</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2017-12-12" lims:fid="440948" lims:id="440948" level="1"><TitleText>Statistics</TitleText></Heading><Section lims:inforce-start-date="2017-12-12" lims:lastAmendedDate="2017-12-12" lims:fid="440949" lims:id="440949"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="440950" lims:id="440950">No discrimination</MarginalNote><Label>9</Label><Subsection lims:inforce-start-date="2017-12-12" lims:fid="440951" lims:id="440951"><Label>(1)</Label><Text>The Governor in Council, the Minister and the Chief Statistician shall not, in the execution of the powers conferred by this Act, discriminate between individuals or companies to the prejudice of those individuals or companies.</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="440952" lims:id="440952"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="440953" lims:id="440953">Use of sampling methods</MarginalNote><Label>(2)</Label><Text>Despite any other provision of this Act, the Chief Statistician may authorize the use of sampling methods for the collection of statistics.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2017-12-12" lims:fid="440955" lims:id="440955">R.S., 1985, c. S-19, s. 9; 2017, c. 31, s. 5</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="440956" lims:id="440956"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="440957" lims:id="440957">Arrangements with provincial governments</MarginalNote><Label>10</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="440958" lims:id="440958"><Label>(1)</Label><Text>The Minister may enter into any arrangement with the government of a province providing for any matter necessary or convenient for the purpose of carrying out or giving effect to this Act, and in particular for all or any of the following matters:</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="440959" lims:id="440959"><Label>(a)</Label><Text>the execution by provincial officers of any power or duty conferred or imposed on any officer pursuant to this Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="440960" lims:id="440960"><Label>(b)</Label><Text>the collection by any provincial department or provincial officer of any statistical or other information required for the purpose of this Act; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="440961" lims:id="440961"><Label>(c)</Label><Text>the supplying of statistical information by any provincial department or provincial officer to the Chief Statistician.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="440962" lims:id="440962"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="440963" lims:id="440963">Provincial officers</MarginalNote><Label>(2)</Label><Text>All provincial officers executing any power or duty conferred or imposed on any officer pursuant to this Act, in pursuance of any arrangement entered into under this section, shall, for the purposes of the execution of that power or duty, be deemed to be employed under this Act.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="440965" lims:id="440965">1970-71-72, c. 15, s. 9</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="440966" lims:id="440966"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="440967" lims:id="440967">Agreements with provincial governments</MarginalNote><Label>11</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="440968" lims:id="440968"><Label>(1)</Label><Text>The Minister may, with the approval of the Governor in Council and subject to this section, enter into an agreement with the government of a province for the exchange with, or transmission to, a statistical agency of the province of</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="440969" lims:id="440969"><Label>(a)</Label><Text>replies to any specific statistical inquiries;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="440970" lims:id="440970"><Label>(b)</Label><Text>replies to any specific classes of information collected under this Act; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="440971" lims:id="440971"><Label>(c)</Label><Text>any tabulations and analyses based on replies referred to in paragraph (a) or (b).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="440972" lims:id="440972"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="440973" lims:id="440973">Type of statistical agency</MarginalNote><Label>(2)</Label><Text>An agreement with a province for the purposes of this section shall apply only in respect of a statistical agency of the province</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="440974" lims:id="440974"><Label>(a)</Label><Text>that has statutory authority to collect the information that is intended to be exchanged or transmitted pursuant to the agreement from a respondent who is subject to statutory penalties for refusing or neglecting to furnish information to the agency or for falsifying information furnished by him to the agency;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="440975" lims:id="440975"><Label>(b)</Label><Text>that is prohibited by law from disclosing any information of a kind that Statistics Canada, its officers and employees would be prohibited from disclosing under section 17, if the information were furnished to Statistics Canada; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="440976" lims:id="440976"><Label>(c)</Label><Text>whose officers and employees are subject to statutory penalties for the disclosing of any information of the kind described in paragraph (b), subject to exceptions authorized by law that are substantially the same as those provided under section 17.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="440977" lims:id="440977"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="440978" lims:id="440978">Non-application of agreement</MarginalNote><Label>(3)</Label><Text>Except in respect of information described in subsection 17(2), no agreement entered into under this section applies to any reply made to or information collected by Statistics Canada or an agency of the government of a province before the date that the agreement was entered into or is to have effect, whichever is the later date.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="440979" lims:id="440979"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="440980" lims:id="440980">Informing respondent</MarginalNote><Label>(4)</Label><Text>Where any information in respect of which an agreement under this section applies is collected by Statistics Canada from a respondent, Statistics Canada shall, when collecting information, advise the respondent of the names of any statistical agencies in respect of which the Minister has an agreement under this section and to which the information received from the respondent may be communicated under that agreement.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="440982" lims:id="440982">1970-71-72, c. 15, s. 10</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="440983" lims:id="440983"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="440984" lims:id="440984">Sharing of information</MarginalNote><Label>12</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="440985" lims:id="440985"><Label>(1)</Label><Text>The Minister may enter into an agreement with any department or municipal or other corporation for the sharing of information collected from a respondent by either Statistics Canada or the department or corporation on behalf of both of them and for the subsequent tabulation or publication based on that information.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="440986" lims:id="440986"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="440987" lims:id="440987">Agreement</MarginalNote><Label>(2)</Label><Text>An agreement under subsection (1) shall provide that</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="440988" lims:id="440988"><Label>(a)</Label><Text>the respondent be informed by notice that the information is being collected on behalf of Statistics Canada and the department or corporation, as the case may be; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="440989" lims:id="440989"><Label>(b)</Label><Text>where the respondent gives notice in writing to the Chief Statistician that the respondent objects to the sharing of the information by Statistics Canada, the information not be shared with the department or corporation unless the department or corporation is authorized by law to require the respondent to provide that information.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="440990" lims:id="440990"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="440991" lims:id="440991">What information may be shared</MarginalNote><Label>(3)</Label><Text>Information shared pursuant to this section may, subject to subsection (2), include replies to original inquiries and supplementary information provided by a respondent to Statistics Canada or the department or corporation.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="440993" lims:id="440993">R.S., 1985, c. S-19, s. 15; 2017, c. 31, s. 7</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="441006" lims:id="441006"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="441007" lims:id="441007">Remuneration</MarginalNote><Label>16</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="441008" lims:id="441008"><Label>(1)</Label><Text>The Minister shall, subject to the approval of the Governor in Council, cause to be prepared one or more tables setting forth the rates of remuneration or allowances for commissioners, enumerators and other persons employed under this Act, which may be a fixed sum, a rate per diem or a scale of fees, together with allowances for expenses.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="441009" lims:id="441009"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="441010" lims:id="441010">Condition of payment</MarginalNote><Label>(2)</Label><Text>Full remuneration or allowance shall not be paid to any person referred to in subsection (1) for any service performed in connection with this Act until the service required of the person has been faithfully and entirely performed.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="441012" lims:id="441012">1970-71-72, c. 15, s. 15</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2017-12-12" lims:fid="441013" lims:id="441013" level="1"><TitleText>Secrecy</TitleText></Heading><Section lims:inforce-start-date="2017-12-12" lims:lastAmendedDate="2017-12-12" lims:fid="441014" lims:id="441014"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="441015" lims:id="441015">Prohibition against divulging information</MarginalNote><Label>17</Label><Subsection lims:inforce-start-date="2017-12-12" lims:fid="441016" lims:id="441016"><Label>(1)</Label><Text>Except for the purpose of communicating information in accordance with any conditions of an agreement made under section 11 or 12 and except for the purposes of a prosecution under this Act but subject to this section,</Text><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="441017" lims:id="441017"><Label>(a)</Label><Text>no person, other than a person employed or deemed to be employed under this Act, and sworn under section 6, shall be permitted to examine any return or identifying information obtained for the purposes of this Act; and</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="441018" lims:id="441018"><Label>(b)</Label><Text>no person who has been sworn under section 6 shall disclose or knowingly cause to be disclosed, by any means, any information obtained under this Act in a manner that it is possible from the disclosure to relate the information obtained to any identifiable individual person, business or organization.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="441019" lims:id="441019"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="441020" lims:id="441020">Exception to prohibition</MarginalNote><Label>(2)</Label><Text>The Chief Statistician may, by order, authorize the following information to be disclosed:</Text><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="441021" lims:id="441021"><Label>(a)</Label><Text>information collected by persons, organizations or departments for their own purposes and communicated to Statistics Canada before or after May 1, 1971, but that information when communicated to Statistics Canada shall be subject to the same secrecy requirements to which it was subject when collected and may only be disclosed by Statistics Canada in the manner and to the extent agreed on by the collector thereof and the Chief Statistician;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="441022" lims:id="441022"><Label>(b)</Label><Text>information relating to a person or organization in respect of which disclosure is consented to in writing by the person or organization concerned;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="441023" lims:id="441023"><Label>(c)</Label><Text>information relating to a business in respect of which disclosure is consented to in writing by the owner for the time being of the business;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="441024" lims:id="441024"><Label>(d)</Label><Text>information available to the public under any statutory or other law;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="441025" lims:id="441025"><Label>(e)</Label><Text>information relating to any hospital, mental institution, library, educational institution, welfare institution or other similar non-commercial institution except particulars arranged in such a manner that it is possible to relate the particulars to any individual patient, inmate or other person in the care of any such institution;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="441026" lims:id="441026"><Label>(f)</Label><Text>information in the form of an index or list of individual establishments, firms or businesses, showing any, some or all of the following in relation to them:</Text><Subparagraph lims:inforce-start-date="2017-12-12" lims:fid="441027" lims:id="441027"><Label>(i)</Label><Text>their names and addresses,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-12-12" lims:fid="441028" lims:id="441028"><Label>(ii)</Label><Text>the telephone numbers at which they may be reached in relation to statistical matters,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-12-12" lims:fid="441029" lims:id="441029"><Label>(iii)</Label><Text>the official language in which they prefer to be addressed in relation to statistical matters,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-12-12" lims:fid="441030" lims:id="441030"><Label>(iv)</Label><Text>the products they produce, manufacture, process, transport, store, purchase or sell, or the services they provide, in the course of their business, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-12-12" lims:fid="441031" lims:id="441031"><Label>(v)</Label><Text>whether they are within specific ranges of numbers of employees or persons engaged by them or constituting their work force; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="441032" lims:id="441032"><Label>(g)</Label><Text>information relating to any carrier or public utility.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="441033" lims:id="441033"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="441034" lims:id="441034">Definitions</MarginalNote><Label>(3)</Label><Text>In this section,</Text><Definition lims:inforce-start-date="2017-12-12" lims:fid="441035" lims:id="441035"><Text><DefinedTermEn>carrier</DefinedTermEn> means any person or association of persons that owns, operates or manages an undertaking that carries or moves persons or commodities by any form of land, sea or air transport; (<DefinedTermFr>transporteur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-12-12" lims:fid="441036" lims:id="441036"><Text><DefinedTermEn>public utility</DefinedTermEn> means any person or association of persons that owns, operates or manages an undertaking</Text><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="441037" lims:id="441037"><Label>(a)</Label><Text>for the supply of petroleum or petroleum products by pipeline,</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="441038" lims:id="441038"><Label>(b)</Label><Text>for the supply, transmission or distribution of gas, electricity, steam or water,</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="441039" lims:id="441039"><Label>(c)</Label><Text>for the collection and disposal of garbage or sewage or for the control of pollution,</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="441040" lims:id="441040"><Label>(d)</Label><Text>for the transmission, emission, reception or conveyance of information by any telecommunication system, or</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="441041" lims:id="441041"><Label>(e)</Label><Text>for the provision of postal services. (<DefinedTermFr>entreprise d’utilité publique</DefinedTermFr>)</Text></Paragraph></Definition></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2017-12-12" lims:fid="441043" lims:id="441043">R.S., 1985, c.
