2017, c. 9, s. 55</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2017-06-19" lims:fid="406809" lims:id="406809" level="1"><TitleText>Designation of Minister</TitleText></Heading><Section lims:inforce-start-date="2014-11-01" lims:lastAmendedDate="2014-11-01" lims:fid="406810" lims:id="406810"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="406811" lims:id="406811">Power of Governor in Council</MarginalNote><Label>3</Label><Text>The Governor in Council may, by order, designate any federal minister, other than a member of the Treasury Board, to be the Minister referred to in this Act.</Text></Section><Heading lims:inforce-start-date="2017-06-19" lims:fid="406812" lims:id="406812" level="1"><TitleText>Federal Public Sector Labour Relations and Employment Board</TitleText></Heading><Heading lims:inforce-start-date="2017-06-19" lims:fid="406813" lims:id="406813" level="2"><TitleText>Continuance and Composition</TitleText></Heading><Section lims:inforce-start-date="2017-06-19" lims:lastAmendedDate="2017-06-19" lims:fid="406814" lims:id="406814"><MarginalNote lims:inforce-start-date="2017-06-19" lims:fid="406815" lims:id="406815">Continuance of Board</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2017-06-19" lims:fid="406816" lims:id="406816"><Label>(1)</Label><Text>The Public Service Labour Relations and Employment Board is continued under the name of the Federal Public Sector Labour Relations and Employment Board.</Text></Subsection><Subsection lims:inforce-start-date="2017-06-19" lims:fid="406817" lims:id="406817"><MarginalNote lims:inforce-start-date="2017-06-19" lims:fid="406818" lims:id="406818">Board’s composition</MarginalNote><Label>(2)</Label><Text>The Board is composed of</Text><Paragraph lims:inforce-start-date="2017-06-19" lims:fid="406819" lims:id="406819"><Label>(a)</Label><Text>a Chairperson, who is to hold office on a full-time basis;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-06-19" lims:fid="406820" lims:id="406820"><Label>(b)</Label><Text>not more than two Vice-chairpersons, who are to hold office on a full-time basis;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-06-19" lims:fid="406821" lims:id="406821"><Label>(c)</Label><Text>not more than 12 other members who are to hold office on a full-time basis; 2017, c. 9, s. 38</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2017-06-19" lims:fid="406825" lims:id="406825" level="2"><TitleText>Appointment of Members</TitleText></Heading><Section lims:inforce-start-date="2017-06-19" lims:lastAmendedDate="2017-06-19" lims:fid="406826" lims:id="406826"><MarginalNote lims:inforce-start-date="2017-06-19" lims:fid="406827" lims:id="406827">Qualifications</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2017-06-19" lims:fid="406828" lims:id="406828"><Label>(1)</Label><Text>To be eligible to hold office as a member, a person must</Text><Paragraph lims:inforce-start-date="2017-06-19" lims:fid="406829" lims:id="406829"><Label>(a)</Label><Text>be a Canadian citizen within the meaning of the <XRefExternal reference-type="act" link="C-29">Citizenship Act</XRefExternal> or a permanent resident as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="I-2.5">Immigration and Refugee Protection Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-06-19" lims:fid="406830" lims:id="406830"><Label>(b)</Label><Text>not hold any other office or employment under the employer;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-06-19" lims:fid="406831" lims:id="406831"><Label>(c)</Label><Text>not be a member of or hold an office or employment under an employee organization, as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="P-33.3">Federal Public Sector Labour Relations Act</XRefExternal>, that is certified as a bargaining agent; and</Text></Paragraph><Paragraph lims:inforce-start-date="2017-06-19" lims:fid="406832" lims:id="406832"><Label>(d)</Label><Text>not accept any office or employment, or carry on any activity, that is inconsistent with the person’s duties or functions.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2017-06-19" lims:fid="406833" lims:id="406833"><MarginalNote lims:inforce-start-date="2017-06-19" lims:fid="406834" lims:id="406834">Exception</MarginalNote><Label>(2)</Label><Text>Despite paragraph (1)(b), a person is not ineligible to hold office as a member by reason only of holding office as a member of any board that may be constituted by the Commissioner in Council of the Northwest Territories or the Legislature of Yukon or the Legislature for Nunavut with powers, duties and functions similar to those of the Board.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2017-06-19" lims:fid="406836" lims:id="406836">2013, c. 40, s. 365 “5”; 2017, c. 9, s. 55</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2017-06-19" lims:lastAmendedDate="2017-06-19" lims:fid="406837" lims:id="406837"><MarginalNote lims:inforce-start-date="2017-06-19" lims:fid="406838" lims:id="406838">Appointments of other members from list</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2017-06-19" lims:fid="406839" lims:id="406839"><Label>(1)</Label><Text>Every member, other than the Chairperson or a Vice-chairperson, must be appointed from among eligible persons whose names are on a list prepared by the Chairperson after consultation with the employer and the bargaining agents.</Text></Subsection><Subsection lims:inforce-start-date="2017-06-19" lims:fid="406840" lims:id="406840"><MarginalNote lims:inforce-start-date="2017-06-19" lims:fid="406841" lims:id="406841">Knowledge of police organizations</MarginalNote><Label>(1.1)</Label><Text>In preparing the list, the Chairperson must take into account the need for the Board to have two members with knowledge of police organizations.</Text></Subsection><Subsection lims:inforce-start-date="2017-06-19" lims:fid="406842" lims:id="406842"><MarginalNote lims:inforce-start-date="2017-06-19" lims:fid="406843" lims:id="406843">Contents</MarginalNote><Label>(2)</Label><Text>The Chairperson must set out on the list</Text><Paragraph lims:inforce-start-date="2017-06-19" lims:fid="406844" lims:id="406844"><Label>(a)</Label><Text>the names of all eligible persons who are recommended by the employer;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-06-19" lims:fid="406845" lims:id="406845"><Label>(b)</Label><Text>the names of all eligible persons who are recommended by the bargaining agents; and</Text></Paragraph><Paragraph lims:inforce-start-date="2017-06-19" lims:fid="406846" lims:id="406846"><Label>(c)</Label><Text>the names of any other eligible persons whom the Chairperson considers suitable for appointment.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2017-06-19" lims:fid="406847" lims:id="406847"><MarginalNote lims:inforce-start-date="2017-06-19" lims:fid="406848" lims:id="406848">Equal numbers</MarginalNote><Label>(3)</Label><Text>The appointment of members, other than the Chairperson and the Vice-chairpersons, is to be made so as to ensure that, to the extent possible, an equal number are appointed from among persons recommended by the employer and from among persons recommended by the bargaining agents.</Text></Subsection><Subsection lims:inforce-start-date="2017-06-19" lims:fid="406849" lims:id="406849"><MarginalNote lims:inforce-start-date="2017-06-19" lims:fid="406850" lims:id="406850">Non-representative Board</MarginalNote><Label>(4)</Label><Text>Despite being recommended by the employer or the bargaining agents, a member does not represent either the employer or the employees and must act impartially in the exercise of their powers and the performance of their duties and functions.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2017-06-19" lims:fid="406852" lims:id="406852">2013, c. 40, s. 365 “6”; 2017, c. 9, s. 39</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2014-11-01" lims:lastAmendedDate="2014-11-01" lims:fid="406853" lims:id="406853"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="406854" lims:id="406854">Residence of full-time members</MarginalNote><Label>7</Label><Text>A full-time member must reside in the National Capital Region as it is described in the schedule to the <XRefExternal reference-type="act" link="N-4">National Capital Act</XRefExternal> or within any distance of it that the Governor in Council may determine.</Text></Section><Section lims:inforce-start-date="2014-11-01" lims:lastAmendedDate="2014-11-01" lims:fid="406855" lims:id="406855"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="406856" lims:id="406856">Appointment of members</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2014-11-01" lims:fid="406857" lims:id="406857"><Label>(1)</Label><Text>Each member is to be appointed by the Governor in Council, on the Minister’s recommendation, to hold office during good behaviour and may be removed by the Governor in Council for cause.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-01" lims:fid="406858" lims:id="406858"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="406859" lims:id="406859">Term of office</MarginalNote><Label>(2)</Label><Text>A full-time member may be appointed for a term of office that is not more than five years and a part-time member may be appointed for a term of office that is not more than three years.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-01" lims:fid="406860" lims:id="406860"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="406861" lims:id="406861">Reappointment</MarginalNote><Label>(3)</Label><Text>A member is eligible for reappointment on the expiry of any term of office.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-01" lims:fid="406862" lims:id="406862"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="406863" lims:id="406863">Completion of duties and functions</MarginalNote><Label>(4)</Label><Text>A person who ceases to be a member for any reason other than removal may, at the request of the Chairperson, within eight weeks after ceasing to be a member, carry out and complete any duties or functions that they would otherwise have had in connection with any matter that came before the Board while they were still a member and in respect of which there was any proceeding in which they participated as a member. For that purpose, the person is deemed to be a part-time member.</Text></Subsection></Section><Section lims:inforce-start-date="2017-06-19" lims:lastAmendedDate="2017-06-19" lims:fid="406864" lims:id="406864"><MarginalNote lims:inforce-start-date="2017-06-19" lims:fid="406865" lims:id="406865">Oath or solemn affirmation</MarginalNote><Label>9</Label><Text>Before beginning their duties or functions, a person who is appointed as a member of the Board must take an oath or make a solemn affirmation in the following form before a commissioner of oaths or other person having authority to administer oaths or solemn affirmations:</Text><Provision lims:inforce-start-date="2017-06-19" lims:fid="406866" lims:id="406866" format-ref="indent-0-0" pointsize="8" list-item="no" language-align="no"><Text>I, <Leader leader="dot" length="3pc" />, do swear (or solemnly affirm) that I will faithfully, truly and impartially, to the best of my judgment, skill and ability, execute and perform the office of member (or Chairperson or Vice-chairperson) of the Federal Public Sector Labour Relations and Employment Board.</Text></Provision><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2017-06-19" lims:fid="406868" lims:id="406868">2013, c. 40, s. 365 “9”; 2017, c. 9, s. 57</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2017-06-19" lims:fid="406869" lims:id="406869" level="2"><TitleText>Remuneration</TitleText></Heading><Section lims:inforce-start-date="2014-11-01" lims:lastAmendedDate="2014-11-01" lims:fid="406870" lims:id="406870"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="406871" lims:id="406871">Remuneration</MarginalNote><Label>10</Label><Text>Every member and former member referred to in subsection <XRefInternal>8</XRefInternal>(4)</Text><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="406872" lims:id="406872"><Label>(a)</Label><Text>is to be paid the remuneration that may be determined by the Governor in Council; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="406873" lims:id="406873"><Label>(b)</Label><Text>is entitled to be paid reasonable travel and other expenses incurred by them in the course of their duties while absent from, in the case of full-time members, their ordinary place of work and, in the case of part-time members, their ordinary place of residence.</Text></Paragraph></Section><Heading lims:inforce-start-date="2017-06-19" lims:fid="406874" lims:id="406874" level="2"><TitleText>Application of Other Acts</TitleText></Heading><Section lims:inforce-start-date="2014-11-01" lims:lastAmendedDate="2014-11-01" lims:fid="406875" lims:id="406875"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="406876" lims:id="406876">Application of <XRefExternal reference-type="act" link="P-36">Public Service Superannuation Act</XRefExternal></MarginalNote><Label>11</Label><Text>A full-time member is deemed to be employed in the public service for the purposes of the <XRefExternal reference-type="act" link="P-36">Public Service Superannuation Act</XRefExternal>.</Text></Section><Section lims:inforce-start-date="2014-11-01" lims:lastAmendedDate="2014-11-01" lims:fid="406877" lims:id="406877"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="406878" lims:id="406878">Application of certain Acts</MarginalNote><Label>12</Label><Text>A member is deemed to be an employee for the purposes of the <XRefExternal reference-type="act" link="G-5">Government Employees Compensation Act</XRefExternal> and to be employed in the federal public administration for the purposes of regulations made under section 9 of the <XRefExternal reference-type="act" link="A-2">Aeronautics Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2017-06-19" lims:fid="406879" lims:id="406879" level="2"><TitleText>Head Office and Meetings</TitleText></Heading><Section lims:inforce-start-date="2014-11-01" lims:lastAmendedDate="2014-11-01" lims:fid="406880" lims:id="406880"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="406881" lims:id="406881">Head office</MarginalNote><Label>13</Label><Text>The Board’s head office is to be in the National Capital Region as it is described in the schedule to the <XRefExternal reference-type="act" link="N-4">National Capital Act</XRefExternal>.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2014-11-01" lims:fid="406883" lims:id="406883">2013, c. 40, s. 365 “13”; 2014, c. 20, s. 471</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2014-11-01" lims:lastAmendedDate="2014-11-01" lims:fid="406884" lims:id="406884"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="406885" lims:id="406885">Services and facilities</MarginalNote><Label>14</Label><Text>In exercising its powers and performing its duties and functions, the Board may use any services and facilities of departments, boards and agencies of the Government of Canada that are appropriate for the Board’s operation.</Text></Section><Section lims:inforce-start-date="2014-11-01" lims:lastAmendedDate="2014-11-01" lims:fid="406886" lims:id="406886"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="406887" lims:id="406887">Meetings</MarginalNote><Label>15</Label><Subsection lims:inforce-start-date="2014-11-01" lims:fid="406888" lims:id="406888"><Label>(1)</Label><Text>Meetings of the Board are to be held at any date, time and place that the Chairperson considers appropriate for the conduct of the Board’s business.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-01" lims:fid="406889" lims:id="406889"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="406890" lims:id="406890">Off-site participation</MarginalNote><Label>(2)</Label><Text>A meeting of the Board may be held by any means of telecommunication that permits all persons who are participating to communicate adequately with each other.
