lims:inforce-start-date="2005-04-04" lims:fid="401513" lims:id="401513"><Label>(1)</Label><Text>There is established a department of the Government of Canada, called the Department of Public Safety and Emergency Preparedness, over which the Minister of Public Safety and Emergency Preparedness, appointed by commission under the Great Seal, presides.</Text></Subsection><Subsection lims:inforce-start-date="2005-04-04" lims:fid="401514" lims:id="401514"><MarginalNote lims:inforce-start-date="2005-04-04" lims:fid="401515" lims:id="401515">Minister</MarginalNote><Label>(2)</Label><Text>The Minister holds office during pleasure and has the management and direction of the Department.</Text></Subsection></Section><Section lims:inforce-start-date="2005-04-04" lims:lastAmendedDate="2005-04-04" lims:fid="401516" lims:id="401516"><MarginalNote lims:inforce-start-date="2005-04-04" lims:fid="401517" lims:id="401517">Deputy head</MarginalNote><Label>3</Label><Text>The Governor in Council may appoint a Deputy Minister of Public Safety and Emergency Preparedness to hold office during pleasure and to be the deputy head of the Department.</Text></Section><Heading lims:inforce-start-date="2005-04-04" lims:fid="401518" lims:id="401518" level="1"><TitleText>Powers, Duties and Functions of the Minister</TitleText></Heading><Section lims:inforce-start-date="2007-08-03" lims:lastAmendedDate="2007-08-03" lims:fid="401519" lims:id="401519"><MarginalNote lims:inforce-start-date="2007-08-03" lims:fid="401520" lims:id="401520">Powers, duties and functions</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2007-08-03" lims:fid="401521" lims:id="401521"><Label>(1)</Label><Text>The powers, duties and functions of the Minister extend to and include all matters over which Parliament has jurisdiction — and that have not been assigned by law to another department, board or agency of the Government of Canada — relating to public safety and emergency preparedness.</Text></Subsection><Subsection lims:inforce-start-date="2007-08-03" lims:fid="401522" lims:id="401522"><MarginalNote lims:inforce-start-date="2007-08-03" lims:fid="401523" lims:id="401523">National leadership</MarginalNote><Label>(2)</Label><Text>The Minister is responsible for exercising leadership at the national level relating to public safety and emergency preparedness.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:id="401527">Portfolio coordination and leadership</MarginalNote><Label>5</Label><Text>The Minister shall coordinate the activities of the entities for which the Minister is responsible, including the Royal Canadian Mounted Police, the Canadian Security Intelligence Service, the Canada Border Services Agency, the Canadian Firearms Centre, the Correctional Service of Canada and the Parole Board of Canada, and establish strategic priorities for those entities relating to public safety and emergency preparedness.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2013-02-28" lims:id="401531">Functions</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2005-04-04" lims:fid="401532" lims:id="401532"><Label>(1)</Label><Text>In exercising his or her powers and in performing his or her duties and functions and with due regard to the powers conferred on the provinces and territories, the Minister may</Text><Paragraph lims:inforce-start-date="2005-04-04" lims:fid="401533" lims:id="401533"><Label>(a)</Label><Text>initiate, recommend, coordinate, implement or promote policies, programs or projects relating to public safety and emergency preparedness;</Text></Paragraph><Paragraph lims:inforce-start-date="2005-04-04" lims:fid="401534" lims:id="401534"><Label>(b)</Label><Text>cooperate with any province, foreign state, international organization or any other entity;</Text></Paragraph><Paragraph lims:inforce-start-date="2005-04-04" lims:fid="401535" lims:id="401535"><Label>(c)</Label><Text>make grants or contributions; and</Text></Paragraph><Paragraph lims:inforce-start-date="2005-04-04" lims:fid="401536" lims:id="401536"><Label>(d)</Label><Text>facilitate the sharing of information, where authorized, to promote public safety objectives.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2005-04-04" lims:fid="401537" lims:id="401537"><MarginalNote lims:inforce-start-date="2005-04-04" lims:fid="401538" lims:id="401538">Committees</MarginalNote><Label>(2)</Label><Text>The Minister may establish advisory and other committees and provide for their membership, duties, functions and operation.</Text></Subsection><Subsection lims:inforce-start-date="2005-04-04" lims:fid="401539" lims:id="401539"><MarginalNote lims:inforce-start-date="2005-04-04" lims:fid="401540" lims:id="401540">Remuneration</MarginalNote><Label>(3)</Label><Text>Members of a committee shall be paid, in connection with their work for the committee, the remuneration that may be fixed by the Governor in Council.</Text></Subsection><Subsection lims:inforce-start-date="2005-04-04" lims:fid="401541" lims:id="401541"><MarginalNote lims:inforce-start-date="2005-04-04" lims:fid="401542" lims:id="401542">Travel, living and other expenses</MarginalNote><Label>(4)</Label><Text>Members of a committee are entitled to be reimbursed, in accordance with Treasury Board directives, the travel, living and other expenses incurred in connection with their work for the committee while absent, in the case of full-time members, from their ordinary place of work or, in the case of part-time members, from their ordinary place of residence.</Text></Subsection></Section><Heading lims:inforce-start-date="2005-04-04" lims:fid="401543" lims:id="401543" level="1"><TitleText>Transitional Provisions</TitleText></Heading><Section lims:inforce-start-date="2005-04-04" lims:lastAmendedDate="2005-04-04" lims:fid="401544" lims:id="401544" type="transitional"><MarginalNote lims:inforce-start-date="2005-04-04" lims:fid="401545" lims:id="401545">Appointments</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2005-04-04" lims:fid="401546" lims:id="401546" type="transitional"><Label>(1)</Label><Text>Any person who holds the office of Solicitor General of Canada or Deputy Solicitor General of Canada on the day on which this section comes into force is deemed to have been appointed under this Act as Minister of Public Safety and Emergency Preparedness or Deputy Minister of Public Safety and Emergency Preparedness respectively from and after that day.</Text></Subsection><Subsection lims:inforce-start-date="2005-04-04" lims:fid="401547" lims:id="401547" type="transitional"><MarginalNote lims:inforce-start-date="2005-04-04" lims:fid="401548" lims:id="401548">Employees</MarginalNote><Label>(2)</Label><Text>Nothing in this Act shall be construed as affecting the status of an employee who, immediately before the coming into force of this section, occupied a position in the Department of the Solicitor General, except that the employee, on the coming into force of this section, occupies that position in the Department of Public Safety and Emergency Preparedness.</Text></Subsection><Subsection lims:inforce-start-date="2005-04-04" lims:fid="401549" lims:id="401549" type="transitional"><MarginalNote lims:inforce-start-date="2005-04-04" lims:fid="401550" lims:id="401550">Meaning of <DefinedTermEn>employee</DefinedTermEn></MarginalNote><Label>(3)</Label><Text>In subsection (2), <DefinedTermEn>employee</DefinedTermEn> has the same meaning as in subsection 2(1) of the <XRefExternal reference-type="act" link="P-33.01">Public Service Employment lims:inforce-start-date="2005-04-04" lims:fid="401552" lims:id="401552">Transfer of powers, duties and functions</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2005-04-04" lims:fid="401553" lims:id="401553" type="transitional"><Label>(1)</Label><Text>Any power, duty or function that, immediately before the coming into force of this section, was vested in or exercisable by the Solicitor General of Canada, the Deputy Solicitor General of Canada or any officer of the Department of the Solicitor General under any Act, order, rule or regulation, or any contract, lease, licence or other document, is, on the coming into force of this section, vested in and exercisable by the Minister of Public Safety and Emergency Preparedness, the Deputy Minister of Public Safety and Emergency Preparedness or the appropriate officer of the Department of Public Safety and Emergency Preparedness, as the case may be, unless the Governor in Council by order designates another Minister, Deputy Minister or officer of the federal public administration to exercise that power, duty or function.</Text></Subsection><Subsection lims:inforce-start-date="2005-04-04" lims:fid="401554" lims:id="401554" type="transitional"><MarginalNote lims:inforce-start-date="2005-04-04" lims:fid="401555" lims:id="401555">Transfer of appropriations</MarginalNote><Label>(2)</Label><Text>Any amount appropriated, for the fiscal year in which this section comes into force, by an appropriation Act based on the Estimates for that year for defraying the charges and expenses of the federal public administration within the Department of the Solicitor General and that, on the day on which this section comes into force, is unexpended, is deemed, on that day, to be an amount appropriated for defraying the charges and expenses of the Department of Public Safety and Emergency
