1992, c. 1, s. 143(E)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="401262" lims:id="401262"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="401263" lims:id="401263">Pension plan review</MarginalNote><Label>3</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="401264" lims:id="401264"><Label>(1)</Label><Text>The Minister shall cause the Chief Actuary to conduct actuarial reviews, in accordance with this section, of the pension plans established under the following Acts:</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="401265" lims:id="401265"><Label>(a)</Label><Text>the <XRefExternal reference-type="act" link="C-17">Canadian Forces Superannuation Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="401266" lims:id="401266"><Label>(b)</Label><Text>the <XRefExternal reference-type="act" link="M-5">Members of Parliament Retiring Allowances Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="401267" lims:id="401267"><Label>(c)</Label><Text>the <XRefExternal reference-type="act" link="P-36">Public Service Superannuation Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="401268" lims:id="401268"><Label>(d)</Label><Text>the <XRefExternal reference-type="act" link="R-11">Royal Canadian Mounted Police Superannuation Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="401269" lims:id="401269"><Label>(e)</Label><Text>the <XRefExternal reference-type="act" link="J-1">Judges Act</XRefExternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="401270" lims:id="401270"><Label>(f)</Label><Text>the <XRefExternal reference-type="act" link="O-9">Old Age Security Act</XRefExternal>.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="401271" lims:id="401271"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="401272" lims:id="401272"><XRefExternal reference-type="act" link="S-24">Supplementary Retirement Benefits Act</XRefExternal></MarginalNote><Label>(2)</Label><Text>Each pension plan referred to in paragraphs (1)(a) to (e) shall be deemed to include the related benefits payable under the <XRefExternal reference-type="act" link="S-24">Supplementary Retirement Benefits Act</XRefExternal> and the related assets of the Supplementary Retirement Benefits Account.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="401273" lims:id="401273"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="401274" lims:id="401274">Review dates</MarginalNote><Label>(3)</Label><Text>The review dates as of which the actuarial reviews under subsection (1) must be conducted are</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="401275" lims:id="401275"><Label>(a)</Label><Text>in respect of each of the pension plans referred to in paragraphs (1)(a) to (e), a date not later than four years after the last review date and, thereafter, dates not more than three years apart;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="401276" lims:id="401276"><Label>(b)</Label><Text>in respect of the pension plan established under Part I of the <XRefExternal reference-type="act" link="O-9">Old Age Security Act</XRefExternal>, a date not later than December 31, 1988 and, thereafter, dates not more than three years apart; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="401277" lims:id="401277"><Label>(c)</Label><Text>in respect of the pension plans established under Parts II and III of the <XRefExternal reference-type="act" link="O-9">Old Age Security Act</XRefExternal>, a date fixed by the Governor in Council and, thereafter, dates not more than three years apart.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="401278" lims:id="401278"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="401279" lims:id="401279">Meaning of <DefinitionRef>last review date</DefinitionRef></MarginalNote><Label>(4)</Label><Text>In paragraph (3)(a), the <DefinedTermEn>last review date</DefinedTermEn> shall be deemed to be</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="401280" lims:id="401280"><Label>(a)</Label><Text>in relation to the <XRefExternal reference-type="act" link="C-17">Canadian Forces Superannuation Act</XRefExternal>, December 31, 1983;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="401281" lims:id="401281"><Label>(b)</Label><Text>in relation to the <XRefExternal reference-type="act" link="M-5">Members of Parliament Retiring Allowances Act</XRefExternal>, March 31, 1982;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="401282" lims:id="401282"><Label>(c)</Label><Text>in relation to the <XRefExternal reference-type="act" link="P-36">Public Service Superannuation Act</XRefExternal>, December 31, 1983;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="401283" lims:id="401283"><Label>(d)</Label><Text>in relation to the <XRefExternal reference-type="act" link="R-11">Royal Canadian Mounted Police Superannuation Act</XRefExternal>, December 31, 1985; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="401284" lims:id="401284"><Label>(e)</Label><Text>in relation to the <XRefExternal reference-type="act" link="J-1">Judges Act</XRefExternal>, December 31, 1983.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="401285" lims:id="401285"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="401286" lims:id="401286">Where plan is amended</MarginalNote><Label>4</Label><Text>Where an amendment is made to a pension plan referred to in subsection 3(1) and the amendment affects the cost of benefits or creates an initial unfunded liability, the Minister shall cause the Chief Actuary to conduct an actuarial review of the plan as of the effective date of the amendment.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="401287" lims:id="401287"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="401288" lims:id="401288">Cost certificate</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="401289" lims:id="401289"><Label>(1)</Label><Text>The Chief Actuary shall, within eighteen months after the review date of a pension plan reviewed in accordance with section 3, file with the Minister a cost certificate in respect of the plan.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="401290" lims:id="401290"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="401291" lims:id="401291">Contents of cost certificate</MarginalNote><Label>(2)</Label><Text>A cost certificate filed pursuant to subsection (1) in respect of a plan referred to in paragraphs 3(1)(a) to (e) shall set out</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="401292" lims:id="401292"><Label>(a)</Label><Text>the estimated cost of benefits under the pension plan (expressed as a percentage of pensionable payroll, showing separately the employer contributions and the employee contributions) in respect of service</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="401293" lims:id="401293"><Label>(i)</Label><Text>for the three plan years following the review date, where that date falls on the last day of a plan year, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="401294" lims:id="401294"><Label>(ii)</Label><Text>for the plan year in which the review date falls and the two subsequent plan years, where that date falls on any other day of a plan year;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="401295" lims:id="401295"><Label>(b)</Label><Text>the actuarial method for computing the cost of benefits, including, where applicable, the rule for allocating the cost between the employer and the employees in respect of service for the next two plan years following the applicable plan year referred to in paragraph (a); and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="401296" lims:id="401296"><Label>(c)</Label><Text>the amounts of any new initial unfunded liability and any new experience deficiency or surplus on the review date and any special payment to be made in respect thereto.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="401297" lims:id="401297"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="401298" lims:id="401298">Idem</MarginalNote><Label>(3)</Label><Text>A cost certificate filed pursuant to subsection (1) in respect of a plan referred to in paragraph 3(1)(f) shall show the estimated annual cost of monthly pensions, monthly guaranteed income supplements, allowances, and other benefits, if any, for each of the ten years following the review, and for each fifth year thereafter for a period not less than thirty years from the date of such a review.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="401300" lims:id="401300">R.S., 1985, c. 13 (2nd Supp.), s. 5; 2000, c. 12, s. 271</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="401301" lims:id="401301"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="401302" lims:id="401302">Valuation report</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="401303" lims:id="401303"><Label>(1)</Label><Text>The Chief Actuary shall, in respect of a review required pursuant to paragraphs 3(1)(a) to (e), file with the Minister a valuation report based on the review of the plan, within the time limit referred to in subsection 5(1).</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="401304" lims:id="401304"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="401305" lims:id="401305">Contents of valuation report</MarginalNote><Label>(2)</Label><Text>A valuation report filed pursuant to this section shall be prepared in a manner consistent with the guides and Recommendations for the preparation of an actuarial report in connection with a pension plan, published by the Canadian Institute of Actuaries, and shall include such additional information as the Minister may from time to time require.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="401306" lims:id="401306"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="401307" lims:id="401307">Change in actuarial methods or assumptions</MarginalNote><Label>7</Label><Text>Where, in the review of a pension plan, actuarial assumptions or methods are used that differ from those used for the immediately preceding review in respect of which a cost certificate was filed pursuant to section 5 and such different assumptions or methods result</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="401308" lims:id="401308"><Label>(a)</Label><Text>in a decrease in the going concern unfunded actuarial liability but do not result in an excess of going concern assets over the going concern actuarial liabilities, the outstanding special payments shall be recalculated by multiplying each of the amounts thereof by a factor having, as numerator, the going concern unfunded actuarial liability and, as denominator, the sum of the present values of the previously determined special payments where the present values are calculated on the basis of the actuarial assumptions used at the current review; or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="401309" lims:id="401309"><Label>(b)</Label><Text>in an excess of the going concern assets over the going concern actuarial liabilities, the valuation report referred to in section 6 shall include a statement as to the method, if any, proposed for the disposition of such excess.</Text></Paragraph></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="401310" lims:id="401310"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="401311" lims:id="401311">Assets report</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="401312" lims:id="401312"><Label>(1)</Label><Text>The Minister shall cause a certification of the assets of a pension plan established under the <XRefExternal reference-type="act" link="C-17">Canadian Forces Superannuation Act</XRefExternal>, the <XRefExternal reference-type="act" link="M-5">Members of Parliament Retiring Allowances Act</XRefExternal>, the <XRefExternal reference-type="act" link="P-36">Public Service Superannuation Act</XRefExternal>, the <XRefExternal reference-type="act" link="R-11">Royal Canadian Mounted Police Superannuation Act</XRefExternal> and the <XRefExternal reference-type="act" link="S-24">Supplementary Retirement Benefits Act</XRefExternal> to be made and a report thereof to be filed with the Minister at the same time as a cost certificate is filed pursuant to subsection 5(1).</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="401313" lims:id="401313"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="401314" lims:id="401314">Assets report by Comptroller General</MarginalNote><Label>(2)</Label><Text>The certification and the assets report referred to in subsection (1) shall be made by the Comptroller General of Canada.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="401315" lims:id="401315"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="401316" lims:id="401316">Reports laid before Parliament</MarginalNote><Label>9</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="401317" lims:id="401317"><Label>(1)</Label><Text>The Minister shall lay before Parliament any cost certificate, valuation report or assets report filed with the Minister pursuant to this Act, within thirty sitting days of their being filed if Parliament is then sitting, or if Parliament is not then sitting, on any of the first thirty days thereafter that Parliament is sitting.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="401318" lims:id="401318"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="401319" lims:id="401319">Dissolution of Parliament</MarginalNote><Label>(2)</Label><Text>If, at the time any cost certificate, valuation report or assets report is received by the Minister, Parliament is dissolved, the Minister shall forthwith cause a copy of the certificate or report to be published in the <XRefExternal reference-type="other" link="gazette">Canada Gazette</XRefExternal>.</Text></Subsection></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="401320" lims:id="401320" level="1"><TitleText>Related and Consequential Amendments</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="401321" lims:id="401321"><Label>10 to 13</Label><Text>[Amendments]</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="401322" lims:id="401322" level="1"><TitleText>Commencement</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="401323" lims:id="401323"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="401324" lims:id="401324">Coming into force</MarginalNote><Label><FootnoteRef idref="P-31.4_en_1">*</FootnoteRef>14</Label><Text>This Act shall come into force on a day to be fixed by proclamation.</Text><Footnote id="P-31.4_en_1" placement="section" status="editorial" xml:space="default"><Label>*</Label><Text>[Note: Act in force December 1, 1986, <Emphasis style="italic">see</Emphasis> SI/86-213.]</Text></Footnote></Section></Body></Statute>
