lims:inforce-start-date="2015-06-23" lims:fid="396723" lims:id="396723" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2015-06-23" lims:lastAmendedDate="2015-06-23" lims:fid="396724" lims:id="396724"><MarginalNote lims:inforce-start-date="2015-06-23" lims:fid="396725" lims:id="396725">Definition of <DefinedTermEn>judge</DefinedTermEn></MarginalNote><Label>2</Label><Text>In this Act, <DefinedTermEn>judge</DefinedTermEn> means the Chief Justice of the Federal Court or a judge of that Court designated by the Chief Justice.</Text></Section><Heading lims:inforce-start-date="2015-06-23" lims:fid="396726" lims:id="396726" level="1"><TitleText>Designation of Minister</TitleText></Heading><Section lims:inforce-start-date="2015-06-23" lims:lastAmendedDate="2015-06-23" lims:fid="396727" lims:id="396727"><MarginalNote lims:inforce-start-date="2015-06-23" lims:fid="396728" lims:id="396728">Minister</MarginalNote><Label>3</Label><Text>The Governor in Council may, by order, designate a minister of the Crown to be the Minister referred to in this Act.</Text></Section><Heading lims:inforce-start-date="2015-06-23" lims:fid="396729" lims:id="396729" level="1"><TitleText>Appeals</TitleText></Heading><Section lims:inforce-start-date="2015-06-23" lims:lastAmendedDate="2024-08-19" lims:fid="396730" lims:id="396730"><MarginalNote lims:inforce-start-date="2015-06-23" lims:fid="396731" lims:id="396731">Cancellations under <XRefExternal reference-type="regulation" link="SI-81-86">Canadian Passport Order</XRefExternal> — terrorism or national security</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2015-06-23" lims:fid="396732" lims:id="396732"><Label>(1)</Label><Text>If a passport has been cancelled as a result of a decision of the Minister under the <XRefExternal reference-type="regulation" link="SI-81-86">Canadian Passport Order</XRefExternal> that the passport is to be cancelled on the grounds that the cancellation is necessary to prevent the commission of a terrorism offence, as defined in section 2 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, or for the national security of Canada or a foreign country or state, the person to whom the passport was issued may appeal that decision to a judge within 30 days after the day on which the person receives notice of the Minister’s decision in respect of an application that was made under that Order to have the cancellation reconsidered.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-23" lims:fid="396733" lims:id="396733"><MarginalNote lims:inforce-start-date="2015-06-23" lims:fid="396734" lims:id="396734">Extension</MarginalNote><Label>(2)</Label><Text>Despite subsection (1), the person may appeal the Minister’s decision that the passport is to be cancelled within any further time that a judge may, before or after the end of those 30 days, fix or allow.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-23" lims:fid="396735" lims:id="396735"><MarginalNote lims:inforce-start-date="2015-06-23" lims:fid="396736" lims:id="396736">Determination and disposition</MarginalNote><Label>(3)</Label><Text>If an appeal is made, the judge must, without delay, determine whether cancelling the passport is reasonable on the basis of the information available to him or her and may, if he or she finds that cancelling it is unreasonable, quash the Minister’s decision that the passport is to be cancelled.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-23" lims:fid="396737" lims:id="396737"><MarginalNote lims:inforce-start-date="2015-06-23" lims:fid="396738" lims:id="396738">Procedure</MarginalNote><Label>(4)</Label><Text>The following rules apply to appeals under this lims:id="396742"><Label>(d)</Label><Text>the judge must provide the appellant and the Minister with an opportunity to be heard;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-23" lims:fid="396743" lims:id="396743"><Label>(e)</Label><Text>the judge may receive into evidence anything that, in the judge’s opinion, is reliable and appropriate, even if it is inadmissible in a court of law, and may base his or her decision on that evidence;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-08-19" lims:enacted-date="2024-06-20" lims:fid="396744" lims:id="1486959"><Label>(f)</Label><Text><Repealed>[Repealed, 2024, c. 16, s. 96]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-23" lims:fid="396745" lims:id="396745"><Label>(g)</Label><Text>if the judge determines that evidence or other information provided by the Minister is not relevant or if the Minister withdraws the evidence or other information, the judge must not base his or her decision on that evidence or other information and must return it to the Minister; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-23" lims:fid="396746" lims:id="396746"><Label>(h)</Label><Text>the judge must ensure the confidentiality of all evidence and other information that the Minister apply to any appeal of a decision made under section <XRefInternal>4</XRefInternal> and to any further appeal, with any necessary modifications.</Text></Section><Heading lims:inforce-start-date="2015-06-23" lims:fid="396749" lims:id="396749" level="1"><TitleText>Judicial Review</TitleText></Heading><Section lims:inforce-start-date="2015-06-23" lims:lastAmendedDate="2024-08-19" lims:fid="396750" lims:id="396750"><MarginalNote lims:inforce-start-date="2015-06-23" lims:fid="396751" lims:id="396751">Refusals or revocations under <XRefExternal reference-type="regulation" link="SI-81-86">Canadian Passport Order</XRefExternal> — terrorism or national security</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2015-06-23" lims:fid="396752" lims:id="396752"><Label>(1)</Label><Text>The rules set out in subsection (2) apply to judicial review proceedings in respect of the following decisions:</Text><Paragraph lims:inforce-start-date="2015-06-23" lims:fid="396753" lims:id="396753"><Label>(a)</Label><Text>a decision of the Minister under the <XRefExternal reference-type="regulation" link="SI-81-86">Canadian Passport Order</XRefExternal> that a passport is not to be issued or is to be revoked on the grounds that the refusal to issue or the revocation is necessary to prevent the commission of a terrorism offence, as defined in section 2 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, or for the national security of Canada or a foreign country or state; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-23" lims:fid="396754" lims:id="396754"><Label>(b)</Label><Text>a decision of the Minister under that Order that passport services are not to be delivered to a person on a ground referred to in paragraph (a) if</Text><Subparagraph lims:inforce-start-date="2015-06-23" lims:fid="396755" lims:id="396755"><Label>(i)</Label><Text>the Minister’s decision is made after he or she decides, on the same ground, that a passport is not to be issued to the person or is to be revoked, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-23" lims:fid="396756" lims:id="396756"><Label>(ii)</Label><Text>the Minister’s decision is made after the passport issued to the person has expired, but, based on facts that occurred before the expiry date, he or she could have decided that the passport is to be revoked on the same ground had it not expired.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-06-23" lims:fid="396757" lims:id="396757"><MarginalNote lims:inforce-start-date="2015-06-23" lims:fid="396758" lims:id="396758">Rules</MarginalNote><Label>(2)</Label><Text>The following rules apply for the purposes of this section:</Text><Paragraph lims:inforce-start-date="2024-08-19" c. 16, s. 97]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-23" lims:fid="396762" lims:id="396762"><Label>(d)</Label><Text>the judge must provide the applicant and the Minister with an opportunity to be heard;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-08-19" lims:enacted-date="2024-06-20" lims:fid="396763" lims:id="1486968"><Label>(e)</Label><Text><Repealed>[Repealed, 2024, c. 16, s. 97]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-23" lims:fid="396764" lims:id="396764"><Label>(f)</Label><Text>if the judge determines that evidence or other information provided by the Minister is not relevant or if the Minister withdraws the evidence or other information, the judge must not base his or her decision on that evidence or other information and must return it to the Minister; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-23"
