related heritage areas are protected and presented for this and future generations and in order to further the achievement of the national interest as it relates to those parks, sites and heritage areas and related programs;</Text></Provision><Provision lims:inforce-start-date="2012-06-29" lims:fid="388853" lims:id="388853" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas the Government of Canada wishes to establish an Agency that, through the exercise of its responsibilities in relation to those parks, sites and heritage areas and related programs, will reflect Canada’s values and identity and contribute to enhancing pride in Canada;</Text></Provision><Provision lims:inforce-start-date="2012-06-29" lims:fid="388854" lims:id="388854" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas the Government of Canada wishes to establish an Agency to provide quality services to visitors and the Canadian public through alternative human resource and administrative regimes and financial authorities;</Text></Provision><Provision lims:inforce-start-date="2012-06-29" lims:fid="388855" lims:id="388855" format-ref="indent-0-0" language-align="no" list-item="no"><Text>And Whereas it is in the national interest</Text></Provision><Provision lims:inforce-start-date="2012-06-29" lims:fid="388856" lims:id="388856" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(a)</Label><Text>to protect the nationally significant examples of Canada’s natural and cultural heritage in national parks, national historic sites, national marine conservation areas and related heritage areas in view of their special role in the lives of Canadians and the fabric of the nation,</Text></Provision><Provision lims:inforce-start-date="2012-06-29" lims:fid="388857" lims:id="388857" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(b)</Label><Text>to present that heritage through interpretive and educational programs for public understanding, appreciation and enjoyment, both for international visitors and the Canadian public, thereby enhancing pride, encouraging stewardship and giving expression to our identity as Canadians,</Text></Provision><Provision lims:inforce-start-date="2012-06-29" lims:fid="388858" lims:id="388858" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(c)</Label><Text>to carry out Canada’s international obligations and agreements to protect, conserve and present that heritage and to contribute towards the protection and presentation of the global heritage and biodiversity,</Text></Provision><Provision lims:inforce-start-date="2012-06-29" lims:fid="388859" lims:id="388859" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(d)</Label><Text>to include representative examples of Canada’s land and marine natural regions in the systems of national parks and national marine conservation areas,</Text></Provision><Provision lims:inforce-start-date="2012-06-29" lims:fid="388860" lims:id="388860" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(e)</Label><Text>to commemorate places, people and events of national historic significance, including Canada’s rich and ongoing aboriginal traditions,</Text></Provision><Provision lims:inforce-start-date="2012-06-29" lims:fid="388861" lims:id="388861" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(f)</Label><Text>to ensure the commemorative integrity of national historic sites,</Text></Provision><Provision lims:inforce-start-date="2012-06-29" lims:fid="388862" lims:id="388862" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(g)</Label><Text>to maintain or restore the ecological integrity of national parks,</Text></Provision><Provision lims:inforce-start-date="2012-06-29" lims:fid="388863" lims:id="388863" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(h)</Label><Text>to ensure the ecologically sustainable use of national marine conservation areas,</Text></Provision><Provision lims:inforce-start-date="2012-06-29" lims:fid="388864" lims:id="388864" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(i)</Label><Text>to protect heritage railway stations and the heritage character of federal heritage buildings,</Text></Provision><Provision lims:inforce-start-date="2012-06-29" lims:fid="388865" lims:id="388865" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(j)</Label><Text>to provide leadership and support to the Canadian Heritage Rivers System,</Text></Provision><Provision list-item="no"><Label>(l)</Label><Text>to maintain ecological and commemorative integrity as a prerequisite to the use of national parks and national historic sites, and</Text></Provision><Provision both the maintenance of ecological and commemorative integrity and a quality experience in such heritage and natural areas for this and future generations;</Text></Provision></Preamble><Enacts reference-type="act" link="P-0.4">Parks Canada Agency Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2012-06-29" lims:fid="388876" lims:id="388876" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2015-05-15" lims:lastAmendedDate="2015-05-15" lims:fid="388877" lims:id="388877"><MarginalNote lims:inforce-start-date="2015-05-15" lims:fid="388878" lims:id="388878">Definitions</MarginalNote><Label>2</Label><Subsection lims:inforce-start-date="2015-05-15" lims:fid="388879" lims:id="388879"><Label>(1)</Label><Text>The definitions in this section apply in this Act.</Text><Definition lims:inforce-start-date="2015-05-15" lims:fid="388880" lims:id="388880"><Text><DefinedTermEn>Agency</DefinedTermEn> means the Parks Canada Agency established by section 3. (<DefinedTermFr>Agence</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-05-15" lims:fid="388881" lims:id="388881"><Text><DefinedTermEn>Chief Executive Officer</DefinedTermEn> means the Chief Executive Officer appointed under section 10. (<DefinedTermFr>directeur général</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-05-15" lims:fid="388882" lims:id="388882"><Text><DefinedTermEn>employee</DefinedTermEn> means an employee appointed under subsection 13(1). (<DefinedTermFr>employé</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-05-15" lims:fid="388883" lims:id="388883"><Text><DefinedTermEn>heritage protection programs</DefinedTermEn> includes programs that relate to</Text><Paragraph lims:inforce-start-date="2015-05-15" lims:fid="388884" lims:id="388884"><Label>(a)</Label><Text>heritage railway stations, heritage lighthouses and federal heritage buildings;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-05-15" lims:fid="388885" lims:id="388885"><Label>(b)</Label><Text>Canadian heritage rivers and federal archaeology; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-05-15" lims:fid="388886" lims:id="388886"><Label>(c)</Label><Text>any other matters within the jurisdiction of the Minister that relate to areas of Canadian natural or historical significance that the Minister may, with the approval of the Governor in Council, specify for the purposes of this definition. (<DefinedTermFr>programmes de lims:id="388887"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of the Environment. (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-05-15" lims:fid="388888" lims:id="388888"><Text><DefinedTermEn>national historic site</DefinedTermEn> means a place designated under subsection (2) or a national historic site of Canada to which the <XRefExternal reference-type="act" link="N-14.01">Canada National Parks Act</XRefExternal> applies. (<DefinedTermFr>lieu historique national</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-05-15" lims:fid="388889" lims:id="388889"><Text><DefinedTermEn>national marine conservation area</DefinedTermEn> means a marine conservation area or reserve as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="C-7.3">Canada National Marine Conservation Areas Act</XRefExternal>. (<DefinedTermFr>aire marine nationale de conservation</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-05-15" lims:fid="388890" lims:id="388890"><Text><DefinedTermEn>national park</DefinedTermEn> means a park or park reserve as defined in section 2 of the <XRefExternal reference-type="act" link="N-14.01">Canada National Parks Act</XRefExternal>. (<DefinedTermFr>parc national</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-05-15" lims:fid="388891" lims:id="388891"><Text><DefinedTermEn>other protected heritage areas</DefinedTermEn> includes</Text><Paragraph lims:inforce-start-date="2015-05-15" lims:fid="388892" lims:id="388892"><Label>(a)</Label><Text>historic canals;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-05-15" lims:fid="388893" lims:id="388893"><Label>(b)</Label><Text>historic museums that may be established by the Minister under the <XRefExternal reference-type="act" link="H-4">Historic Sites and Monuments Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-05-15" lims:fid="388894" lims:id="388894"><Label>(b.1)</Label><Text>the Saguenay-St. Lawrence Marine Park established by section 5 of the <XRefExternal reference-type="act" link="S-1.3">Saguenay-St. Lawrence Marine Park Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-05-15" lims:fid="388895" lims:id="388895"><Label>(b.2)</Label><Text>the Rouge National Urban Park; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-05-15" lims:fid="388896" lims:id="388896"><Label>(c)</Label><Text>any other areas within the jurisdiction of the Minister that are of Canadian natural or historical significance and that the Minister may, with the approval of the Governor in Council, specify for the purposes of this definition. (<DefinedTermFr>autres lieux lims:inforce-start-date="2002-12-31" lims:fid="388903" lims:id="388903">Establishment</MarginalNote><Label>3</Label><Text>There is hereby established a body corporate to be called the Parks Canada Agency, that may exercise powers and perform duties and functions only as an agent of Her Majesty in right of Canada.</Text></Section><Section lims:inforce-start-date="2015-05-15" lims:lastAmendedDate="2015-05-15" lims:fid="388904" lims:id="388904"><MarginalNote lims:inforce-start-date="2015-05-15" lims:fid="388905" lims:id="388905">Minister responsible</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2015-05-15" lims:fid="388906" lims:id="388906"><Label>(1)</Label><Text>The Minister is responsible for the Agency and the powers, duties and functions of the Minister, in that capacity, extend to and include all matters over which Parliament has jurisdiction, not by law assigned to any other department, board or agency of the Government of Canada, relating to</Text><Paragraph lims:inforce-start-date="2015-05-15" lims:fid="388907" lims:id="388907"><Label>(a)</Label><Text>areas of natural or historical significance to the nation, including national parks, national marine conservation areas, national historic sites, historic canals, historic museums established under the <XRefExternal reference-type="act" link="H-4">Historic Sites and Monuments Act</XRefExternal>, Saguenay-St. Lawrence Marine Park and Rouge National Urban Park;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-05-15" lims:fid="388908" lims:id="388908"><Label>(b)</Label><Text>heritage railway stations, heritage lighthouses, federal heritage buildings, historic places in Canada, federal archaeology and Canadian heritage rivers; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-05-15" lims:fid="388909" lims:id="388909"><Label>(c)</Label><Text>the design and implementation of programs that relate primarily to built heritage.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-05-15" lims:fid="388910" lims:id="388910"><MarginalNote lims:inforce-start-date="2015-05-15" lims:fid="388911" lims:id="388911">Ministerial direction</MarginalNote><Label>(2)</Label><Text>The Minister has the overall direction of the Agency, which shall comply with any general or special direction given by the Minister with reference to the carrying out of its responsibilities.</Text></Subsection><Subsection lims:inforce-start-date="2015-05-15" lims:fid="388912" lims:id="388912"><MarginalNote lims:inforce-start-date="2015-05-15" lims:fid="388913" lims:id="388913">Exception</MarginalNote><Label>(3)</Label><Text>Notwithstanding subsection (2), no direction may lims:fid="388916" lims:id="388916"><MarginalNote lims:inforce-start-date="2005-02-24" lims:fid="388917" lims:id="388917">Exercise of powers conferred on Minister</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2005-02-24" lims:fid="388918" lims:id="388918"><Label>(1)</Label><Text>Subject to any direction given by the Minister, the Agency may exercise the powers and shall perform the duties and functions that relate to national parks, national historic sites, national marine conservation areas, other protected heritage areas and heritage protection programs that are conferred on, or delegated, assigned or transferred to, the Minister under any Act or regulation.</Text></Subsection><Subsection lims:inforce-start-date="2005-02-24" lims:fid="388919" lims:id="388919"><MarginalNote lims:inforce-start-date="2005-02-24" lims:fid="388920" lims:id="388920">Officers and employees</MarginalNote><Label>(2)</Label><Text>An officer or employee of the Agency may exercise any power and perform any duty or function referred to in subsection (1) if the officer or employee is appointed to serve in the Agency in a capacity appropriate to the exercise of the power or the performance of the duty or function, and in so doing, shall comply with any general or special direction given by the Minister.</Text></Subsection><Subsection lims:inforce-start-date="2005-02-24" lims:fid="388921" lims:id="388921"><MarginalNote lims:inforce-start-date="2005-02-24" lims:fid="388922" lims:id="388922">Exception</MarginalNote><Label>(3)</Label><Text>Subsection (1) does not include</Text><Paragraph lims:inforce-start-date="2005-02-24" lims:fid="388923" lims:id="388923"><Label>(a)</Label><Text>any power, duty or function of the Minister under this Act, other than those referred to in subsection 4(1);</Text></Paragraph><Paragraph lims:id="388930"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="388931" lims:id="388931">Responsibilities — subject-matter</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="388932" lims:id="388932"><Label>(1)</Label><Text>The Agency is responsible for the implementation of policies of the Government of Canada that relate to national parks, national historic sites, national marine conservation areas, other protected heritage areas and heritage protection programs.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="388933" lims:id="388933"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="388934" lims:id="388934">System plans</MarginalNote><Label>(2)</Label><Text>The Agency shall ensure that there are long-term plans in place for establishing systems of national parks, national historic sites and national marine conservation areas.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="388935" lims:id="388935"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="388936" lims:id="388936">New protected heritage areas</MarginalNote><Label>(3)</Label><Text>The Agency is responsible for negotiating, and recommending to the Minister, the establishment of new national parks, national marine conservation areas and other protected heritage areas and the acquisition of national historic sites.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="388937" lims:id="388937"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="388938" lims:id="388938">Responsibilities — Acts</MarginalNote><Label>(4)</Label><Text>The Agency is responsible for the administration and enforcement of the Acts listed in Part 1 of the schedule and any regulations made under those Acts and the regulations listed in Part 2 of the lims:id="388943"><Label>(1)</Label><Text>If considerations of geography make it impractical for the body or minister responsible for administering and enforcing an Act listed in Part 3 of the schedule — or any regulation made under that Act — or any regulation listed in Part 4 of the schedule to do so in a part of Canada, the Agency may enter into an agreement with that body or minister under which the Agency may assist that body or minister in the administration and enforcement of the Act or regulation in that part of Canada.</Text></Subsection><Subsection lims:inforce-start-date="2012-06-29" lims:id="1145602"><Label>(d)</Label><Text>license, assign or otherwise make available any patent, copyright, industrial design, trademark, trade secret or other like property right held, controlled or administered by the Agency;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="388965" lims:id="388965"><Label>(e)</Label><Text>publish, sell or otherwise disseminate studies, reports and other documents of the Agency; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="388966" lims:id="388966"><Label>(f)</Label><Text>do anything that is in Council shall appoint an officer, to be called the Chief Executive Officer, to hold office during pleasure for a term of not more than five years, which term may be renewed for one or more further lims:id="388981">Remuneration</MarginalNote><Label>(2)</Label><Text>The Chief Executive Officer shall be paid the remuneration that may be fixed by the Governor in lims:inforce-start-date="2002-12-31" lims:fid="388983" lims:id="388983">Absence or incapacity</MarginalNote><Label>11</Label><Text>In the event of the absence or incapacity of the Chief Executive Officer or a vacancy in that office, the Minister may appoint any person to exercise the powers and perform the duties and functions of the Chief Executive Officer, but no person may be so appointed lims:fid="388988" lims:id="388988">Rank of deputy head</MarginalNote><Label>(2)</Label><Text>The Chief Executive Officer has the rank and all the powers of a deputy head of a department.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="388989" lims:id="388989"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="388990" lims:id="388990">Guiding principles and operational policies</MarginalNote><Label>(3)</Label><Text>The Chief Executive Officer is responsible for preparing, for the Minister’s approval, guiding principles and operational policies for matters within the Agency’s responsibilities.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="388991" lims:id="388991"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="388992" lims:id="388992">Delegation</MarginalNote><Label>(4)</Label><Text>The Chief Executive Officer may delegate to any person any power, duty or function conferred on the Chief Executive Officer under this Act or any other Act or regulation.</Text></Subsection></Section><Heading lims:inforce-start-date="2012-06-29" lims:fid="388993" lims:id="388993" level="1"><TitleText>Human Resources</TitleText></Heading><Section lims:inforce-start-date="2017-06-19" lims:lastAmendedDate="2017-06-19" lims:fid="388994" lims:id="388994"><MarginalNote lims:inforce-start-date="2017-06-19" lims:fid="388995" lims:id="388995">Personnel</MarginalNote><Label>13</Label><Subsection lims:inforce-start-date="2017-06-19" lims:fid="388996" lims:id="388996"><Label>(1)</Label><Text>The Chief Executive Officer has exclusive authority to</Text><Paragraph lims:inforce-start-date="2017-06-19" lims:fid="388997" lims:id="388997"><Label>(a)</Label><Text>appoint, lay-off or terminate the employment of the employees of the Agency; and</Text></Paragraph><Paragraph lims:inforce-start-date="2017-06-19" lims:fid="388998" lims:id="388998"><Label>(b)</Label><Text>establish standards, procedures and processes governing staffing, including the appointment, lay-off or termination of employment otherwise than for cause, of employees.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2017-06-19" lims:fid="388999" lims:id="388999"><MarginalNote lims:inforce-start-date="2017-06-19" lims:fid="389000" lims:id="389000">Right of employer</MarginalNote><Label>(2)</Label><Text>Nothing in the <XRefExternal reference-type="act" link="P-33.3">Federal Public Sector Labour Relations Act</XRefExternal> shall be construed to affect the right or authority of the Chief Executive Officer to deal with the matters referred to in paragraph (1)(b).</Text></Subsection><Subsection and classify the positions in the Agency;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-06-19" lims:fid="389004" lims:id="389004"><Label>(b)</Label><Text>set the terms and conditions of employment, including termination of employment for cause, for employees and assign duties to them; and</Text></Paragraph><Paragraph lims:inforce-start-date="2017-06-19" lims:fid="389005" lims:id="389005"><Label>(c)</Label><Text>provide for any other matters that the Chief Executive Officer considers necessary for effective human resources management in the subsection (1) shall be made available to the public.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="389027" respect of any right or obligation acquired or incurred by the Agency, whether in its own name or in the name of Her Majesty in right of Canada, may be brought or taken by or against the Agency in the revenues</MarginalNote><Label>(2)</Label><Text>Notwithstanding subsection 29.1(1) of the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>, the Agency may, for the purposes referred to in subsection 19(1), spend amounts equal to revenues resulting from the conduct of its operations in that or subsequent fiscal years, including</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="389045" lims:id="389045"><Label>(a)</Label><Text>proceeds from the sale, exchange, loan or other disposition or the licensing of any personal property or moveables acquired, held or administered by the Agency;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="389046" lims:id="389046"><Label>(b)</Label><Text>proceeds from any of the following transactions in respect of federal real property and federal immovables under the administration of the Minister for the purposes of the Agency:</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="389047" lims:id="389047"><Label>(i)</Label><Text>the lease or giving of a licence,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="389048" lims:id="389048"><Label>(ii)</Label><Text>the transfer to Her Majesty in any right other than Canada of administration and control, otherwise than in perpetuity, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="389049" lims:id="389049"><Label>(iii)</Label><Text>a disposition of any right or interest, other than a disposition referred to in paragraph 21(2)(a);</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="389050" lims:id="389050"><Label>(c)</Label><Text>proceeds from, including fees paid under any Act of Parliament in respect of, the provision by the Agency of a service, of the use of a facility or of a product, right or privilege;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="389051" lims:id="389051"><Label>(d)</Label><Text>proceeds from any money recovered under section 29; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="389052" lims:id="389052"><Label>(e)</Label><Text>any refund of expenditures made in previous fiscal lims:inforce-start-date="2017-06-19" lims:fid="389057" lims:id="389057"><Label>(1)</Label><Text>There is hereby established an account in the accounts of Canada to be called the New Parks and Historic Sites Account.</Text></Subsection><Subsection lims:inforce-start-date="2017-06-19" lims:fid="389058" lims:id="389058"><MarginalNote lims:inforce-start-date="2017-06-19" lims:fid="389059" lims:id="389059">Amounts credited to Account</MarginalNote><Label>(2)</Label><Text>There shall be credited to the New Parks and Historic Sites Account money appropriated by Parliament from time to time by way of an appropriation Act or any other Act of Parliament for the purposes specified in subsection (3), and any revenues of the Agency resulting, including proceeds, from</Text><Paragraph lims:inforce-start-date="2017-06-19" lims:fid="389060" lims:id="389060"><Label>(a)</Label><Text>any of the following transactions in respect of federal real property and federal immovables under the administration of the Minister for the purposes of the Agency:</Text><Subparagraph lims:inforce-start-date="2017-06-19" lims:fid="389061" lims:id="389061"><Label>(i)</Label><Text>the sale or any other disposition in perpetuity of any right or interest,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-06-19" lims:fid="389062" lims:id="389062"><Label>(ii)</Label><Text>the transfer of administration to another minister or to an agent corporation, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-06-19" lims:fid="389063" lims:id="389063"><Label>(iii)</Label><Text>the transfer of administration and control in perpetuity to Her Majesty other than in right of Canada; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2017-06-19" lims:fid="389064" lims:id="389064"><Label>(b)</Label><Text>a gift, bequest or other form of donation made for the purposes of the Agency or for any purpose specified in subsection (3).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2017-06-19" lims:fid="389065" lims:id="389065"><MarginalNote lims:inforce-start-date="2017-06-19" lims:fid="389066" lims:id="389066">Payments out of New Parks and Historic Sites Account</MarginalNote><Label>(3)</Label><Text>Despite any other Act of Parliament, amounts may be paid out of the New Parks and Historic Sites Account for the following purposes:</Text><Paragraph lims:inforce-start-date="2017-06-19" lims:fid="389067" lims:id="389067"><Label>(a)</Label><Text>to acquire any historic place, or lands for historic museums, or any interest therein, for the purpose of paragraph 3(d) of the <XRefExternal reference-type="act" link="H-4">Historic Sites and Monuments Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-06-19" lims:fid="389068" lims:id="389068"><Label>(b)</Label><Text>to acquire any real property or immovables for the purpose of establishing, enlarging or designating, as the case may be, any national park, national historic site, national marine conservation area or other protected heritage area;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-06-19" lims:fid="389069" lims:id="389069"><Label>(c)</Label><Text>to develop or maintain any national park, national historic site, national marine conservation area or other protected heritage area that is being established, enlarged or designated, and to make any related contribution or other payment;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-06-19" lims:fid="389070" lims:id="389070"><Label>(d)</Label><Text>to implement a decision by the Minister to recommend the establishment of a national park, national historic site, national marine conservation area or other protected heritage area, or to commemorate a historic place under section 3 of the <XRefExternal reference-type="act" link="H-4">Historic Sites and Monuments Act</XRefExternal>, and to make any related contribution or other payment; and</Text></Paragraph><Paragraph lims:inforce-start-date="2017-06-19" lims:fid="389071" lims:id="389071"><Label>(e)</Label><Text>to repay advances made under subsection 22(2).</Text></Paragraph></Subsection><Subsection the purpose of providing advances, from time to time, to the New Parks and Historic Sites Account.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="389078" lims:id="389078"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="389079" lims:id="389079">Advances to the Account</MarginalNote><Label>(2)</Label><Text>The Minister of Finance may, on the request of the Minister, authorize the making of advances to the New Parks and Historic Sites Account from the money appropriated under subsection (1) in accordance with any terms and conditions that have been approved by the Treasury Board.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="389080" lims:id="389080"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="389081" lims:id="389081">Credits to the Account</MarginalNote><Label>(3)</Label><Text>An advance made as authorized under subsection (2) must be credited to the New Parks and Historic Sites Account.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="389082" lims:id="389082"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="389083" lims:id="389083">Repayment of advances</MarginalNote><Label>(4)</Label><Text>The repayment of the principal amount of any advance made as authorized under subsection (2) shall, in accordance with any direction made by the Treasury Board, be charged to the New Parks and Historic Sites Account and credited to the balance outstanding of money appropriated under subsection (1), and the payment of any amount on account of interest payable on the advance may be made from money appropriated under an Act of Parliament as authorized under subsection 19(1).</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="389084" lims:id="389084"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="389085" lims:id="389085">Amount may be changed</MarginalNote><Label>(5)</Label><Text>The amount of advances authorized under subsection (1) may be amended, from time to time, by an item in an appropriation lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="389087" lims:id="389087"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="389088" lims:id="389088">Fees for services and use of facilities</MarginalNote><Label>23</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="389089" lims:id="389089"><Label>(1)</Label><Text>The Minister may, subject to any regulations that the Treasury Board may make for the purposes of this section, fix the fees or the manner of calculating the fees to be paid for a service or the use of a facility provided by the Agency.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="389090" lims:id="389090"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="389091" lims:id="389091">Amount not to exceed cost</MarginalNote><Label>(2)</Label><Text>Fees for a service or the use of a facility that are fixed under subsection (1) may not exceed the cost to Her Majesty in right of Canada of providing the service or the use of the facility.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="389092" a fee under section 23 or 24, the Minister must consult with any persons and organizations that the Minister considers to be interested in the matter.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="389097" lims:id="389097"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="389098" lims:id="389098">Publication</MarginalNote><Label>(2)</Label><Text>The Minister must publish any fee fixed under section 23 or 24 in the <XRefExternal reference-type="other" link="gazette">Canada Gazette</XRefExternal> within thirty days after fixing it.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="389099" lims:id="389099"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="389100" lims:id="389100">Reference to Scrutiny Committee</MarginalNote><Label>(3)</Label><Text>A fee fixed under section 23 or 24 stands permanently referred to the Committee referred to in section 19 of the <XRefExternal reference-type="act" link="S-22">Statutory Instruments Act</XRefExternal> to be reviewed and scrutinized as if it were a statutory instrument.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="389101" lims:id="389101"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="389102" lims:id="389102">Regulations</MarginalNote><Label>26</Label><Text>The Treasury Board may make regulations for the purposes of sections 23 and 24.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="389103" lims:id="389103"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="389104" lims:id="389104">Collection of fees</MarginalNote><Label>27</Label><Text>The Agency may enter into an agreement with any person respecting the collection of fees fixed under this Act or any other Act under which the Agency provides services, facilities, products, rights or privileges and, notwithstanding subsections 17(1) and (4) of the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>, authorizing that person to withhold amounts from those fees.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="389105" lims:id="389105"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="389106" lims:id="389106">Remission of fees</MarginalNote><Label>28</Label><Text>The Minister may remit or refund all or part of a fee fixed under section 23 or 24 or under any other Act under which the Agency provides services, facilities, products, rights or privileges, and the interest on it.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="389107" lims:id="389107"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="389108" lims:id="389108">Recovery of fees and costs</MarginalNote><Label>29</Label><Text>The Agency may recover, as a debt due to Her Majesty, any fee or charge fixed under this or any other Act, any costs incurred by the Agency, and any interest on those fees, charges or costs, that relate to providing a service, facility, product, right or privilege by the Agency under this or any other Act.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="389109" lims:id="389109"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="389110" lims:id="389110">Delegation</MarginalNote><Label>30</Label><Text>The Minister may delegate to the Agency any power, duty or function conferred on the Minister under sections 23 to 25 and 28.</Text></Section><Heading lims:inforce-start-date="2012-06-29" lims:fid="389111" lims:id="389111" level="1"><TitleText>Reports and Plans</TitleText></Heading><Section lims:inforce-start-date="2012-06-29" lims:lastAmendedDate="2012-06-29" lims:fid="389112" lims:id="389112"><MarginalNote lims:inforce-start-date="2012-06-29" lims:fid="389113" lims:id="389113">Report — heritage areas and programs</MarginalNote><Label>31</Label><Text>At least every five years, the Chief Executive Officer shall provide the Minister with a report, to be tabled in each House of Parliament, on the state of national parks, national historic sites, national marine conservation areas and other protected heritage areas and heritage protection programs, and on the Agency’s performance in carrying out its responsibilities under section 6.</Text><HistoricalNote><HistoricalNoteSubItem lims:id="389117">Management plans</MarginalNote><Label>32.</Label><Subsection lims:inforce-start-date="2015-05-15" lims:fid="389118" lims:id="389118"><Label>(1)</Label><Text>In addition to the duties in relation to management plans under the <XRefExternal reference-type="act" link="N-14.01">Canada National Parks Act</XRefExternal> and the <XRefExternal reference-type="act" link="C-7.3">Canada National Marine Conservation Areas Act</XRefExternal>, the Chief Executive Officer shall, within five years after the establishment of a national historic site or other protected heritage area, other than the Rouge National Urban Park, or within five years after the coming into force of this section, whichever is later, provide the Minister with a management plan for that national historic site or other protected heritage area in respect of any matter that the Minister deems appropriate, including, but not limited to, commemorative and ecological integrity, resource protection or visitor use, and that plan shall be tabled in each House of Parliament.</Text></Subsection><Subsection lims:inforce-start-date="2015-05-15" lims:fid="389119" lims:id="389119"><MarginalNote lims:inforce-start-date="2015-05-15" lims:fid="389120" lims:id="389120">Review of management plans by Minister</MarginalNote><Label>(2)</Label><Text>The Minister shall review the management plan for each national historic site or other protected heritage area at least every 10 years and shall cause any amendments to the plan to be tabled in each House of Act</MarginalNote><Label>37</Label><Text>The provisions made by any appropriation Act for the fiscal year in which this section comes into force or a subsequent fiscal year, based on the Estimates for that year, to defray the charges and expenses of the public service of Canada within the Parks Canada Sector of the Department of Canadian Heritage in relation to any matter for which the Agency is responsible by virtue of this Act are deemed to be an amount appropriated for defraying the charges and expenses of the Agency in the amount that the Treasury Board may, on the recommendation of the Minister, determine.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="389137" lims:id="389137"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="389138" lims:id="389138">Definitions</MarginalNote><Label>38</Label><Text>The definitions in this section apply in sections 39 to 45.</Text><Definition lims:inforce-start-date="2002-12-31" lims:fid="389139" lims:id="389139"><Text><DefinedTermEn>designated position</DefinedTermEn> has the same meaning as in subsection 2(1) of the <XRefExternal transfer of any work, undertaking or business from the Department of Canadian Heritage to the Agency. (<DefinedTermFr>employé</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="389141" lims:id="389141"><Text><DefinedTermEn>grievance</DefinedTermEn> has the same meaning as in subsection 2(1) of the <XRefExternal reference-type="act" link="P-35">Public Service Staff Relations Act</XRefExternal>. (<DefinedTermFr>grief</DefinedTermFr>)</Text></Definition></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="389142" lims:id="389142"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="389143" lims:id="389143">Pending competitions and appointments</MarginalNote><Label>39</Label><Text>A competition being conducted or an appointment being or about to be made under the <XRefExternal reference-type="act" link="P-33">Public Service Employment Act</XRefExternal> in respect of a position within the Department of Canadian Heritage the duties and functions of which are assigned to a position within the Agency, may continue to be conducted or made as if the Agency were a department for the purposes of that Act.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="389144" lims:id="389144"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="389145" lims:id="389145">Pending appeals</MarginalNote><Label>40</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="389146" lims:id="389146"><Label>(1)</Label><Text>An appeal made under section 21 of the <XRefExternal reference-type="act" link="P-33">Public Service Employment Act</XRefExternal> by any person against an appointment to a position within the Department of Canadian Heritage the duties and functions of which are assigned to a position within the Agency, and not finally disposed of on the assignment, must be dealt with and disposed of in accordance with that Act as if the Agency were a department for the purposes of that Act and the person continued to be an employee for the purposes of that Act.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="389147" lims:id="389147"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="389148" lims:id="389148">Other recourse</MarginalNote><Label>(2)</Label><Text>Any recourse commenced by an employee under the <XRefExternal reference-type="act" link="P-33">Public Service Employment Act</XRefExternal> that has not been finally dealt with on the appointment of the employee to the Agency must be dealt with and disposed of in accordance with that Act as if the Agency were a department for the purposes of that Act and the person continued to be an employee for the purposes of that Act.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="389149" lims:id="389149"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="389150" lims:id="389150">Employees on probation</MarginalNote><Label>41</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="389151" lims:id="389151"><Label>(1)</Label><Text>Every employee who was considered to be on probation under section 28 of the <XRefExternal reference-type="act" link="P-33">Public Service Employment Act</XRefExternal> immediately before being appointed to the Agency continues on probation with the Agency until the end of any period established by the Public Service Commission by regulation for that employee or a class of persons of which that employee is a member.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="389152" lims:id="389152"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="389153" lims:id="389153">Rejection</MarginalNote><Label>(2)</Label><Text>Subsection 28(2) of the <XRefExternal reference-type="act" link="P-33">Public Service Employment Act</XRefExternal> applies to an employee of the Agency who is on probation but the reference to deputy head in that subsection is to be read as a reference to the Chief Executive Officer.</Text></Subsection></Section><Section Department of Canadian Heritage, that employee is, on appointment to the Agency, deemed to occupy a designated position in the Agency.</Text></Section><Section lims:inforce-start-date="2002-12-31" grievances</MarginalNote><Label>43</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="389158" lims:id="389158"><Label>(1)</Label><Text>Any grievance commenced by an employee under the <XRefExternal reference-type="act" link="P-35">Public Service Staff Relations Act</XRefExternal> that has not been finally dealt with on the appointment of the employee to the Agency, must be dealt with and disposed of in accordance with that Act as if the employee’s employment in the Department of Canadian Heritage had not been terminated.</Text></Subsection><Subsection
