Canadians;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="382960" lims:id="382960" format-ref="indent-0-0" language-align="no" list-item="no"><Text>WHEREAS Parliament wishes to reaffirm Canada’s role as a world leader in oceans and marine resource management;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="382961" lims:id="382961" format-ref="indent-0-0" language-align="no" list-item="no"><Text>WHEREAS Parliament wishes to affirm in Canadian domestic law Canada’s sovereign rights, jurisdiction and responsibilities in the exclusive economic zone of Canada;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="382962" lims:id="382962" format-ref="indent-0-0" language-align="no" list-item="no"><Text>WHEREAS Canada promotes the understanding of oceans, ocean processes, marine resources and marine ecosystems to foster the sustainable development of the oceans and their resources;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="382963" lims:id="382963" format-ref="indent-0-0" language-align="no" list-item="no"><Text>WHEREAS Canada holds that conservation, based on an ecosystem approach, is of fundamental importance to maintaining biological diversity and productivity in the marine environment;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="382964" lims:id="382964" format-ref="indent-0-0" language-align="no" list-item="no"><Text>WHEREAS Canada promotes the wide application of the precautionary approach to the conservation, management and exploitation of marine resources in order to protect these resources and preserve the marine environment;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="382965" lims:id="382965" format-ref="indent-0-0" language-align="no" list-item="no"><Text>WHEREAS Canada recognizes that the oceans and their resources offer significant opportunities for economic diversification and the generation of wealth for the benefit of all Canadians, and in particular for coastal communities;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="382966" lims:id="382966" format-ref="indent-0-0" language-align="no" list-item="no"><Text>WHEREAS Canada promotes the integrated management of oceans and marine resources;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="382967" lims:id="382967" format-ref="indent-0-0" language-align="no" list-item="no"><Text>AND WHEREAS the Minister of Fisheries and Oceans, in collaboration with other ministers, boards and agencies of the Government of Canada, with provincial and territorial governments and with affected aboriginal organizations, coastal communities and other persons and bodies, including those bodies established under land claims agreements, is encouraging the development and implementation of a national strategy for the management of estuarine, coastal and marine ecosystems;</Text></Provision></Preamble><Enacts lims:inforce-start-date="2002-12-31" lims:fid="382968" lims:id="382968"><Provision lims:inforce-start-date="2002-12-31" lims:fid="382969" lims:id="382969" format-ref="indent-0-0" language-align="no" list-item="no"><Text>NOW, THEREFORE, Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:</Text></Provision></Enacts></Introduction><Body lims:inforce-start-date="2002-12-31" lims:fid="382970" lims:id="382970"><Heading lims:inforce-start-date="2002-12-31" lims:fid="382971" lims:id="382971" level="1"><TitleText>Short Title</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="382972" lims:id="382972"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="382973" lims:id="382973">Short title</MarginalNote><Label>1</Label><Text>This Act may be cited as the <XRefExternal reference-type="act" link="O-2.4">Oceans Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2024-11-27" lims:enacted-date="2024-11-27" lims:fid="382974" lims:id="1497727" level="1"><TitleText>Definitions</TitleText></Heading><Section lims:inforce-start-date="2014-04-01" lims:lastAmendedDate="2014-04-01" lims:fid="382975" lims:id="382975"><MarginalNote lims:inforce-start-date="2014-04-01" lims:fid="382976" lims:id="382976">Definitions</MarginalNote><Label>2</Label><Text>In this Act,</Text><Definition lims:inforce-start-date="2014-04-01" lims:fid="382977" lims:id="382977"><Text><DefinedTermEn>artificial island</DefinedTermEn> means any man-made extension of the seabed or a seabed feature, whether or not the extension breaks the surface of the superjacent waters; (<DefinedTermFr>île artificielle</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-04-01" lims:fid="382978" lims:id="382978"><Text><DefinedTermEn>Department</DefinedTermEn> means the Department of Fisheries and Oceans; (<DefinedTermFr>ministère</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-04-01" lims:fid="382979" lims:id="382979"><Text><DefinedTermEn>federal laws</DefinedTermEn> includes Acts of Parliament, regulations as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="I-21">Interpretation Act</XRefExternal> and any other rules of law within the jurisdiction of Parliament, but does not include laws of the Legislature of Yukon, of the Northwest Territories or for Nunavut; (<DefinedTermFr>droit</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-04-01" lims:fid="382980" lims:id="382980"><Text><DefinedTermEn>law</DefinedTermEn>, in respect of a province, includes a law or rule of law from time to time in force in the province, other than federal laws, and the provisions of any instrument having effect under any such law; (<DefinedTermFr>droit</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-04-01" lims:fid="382981" lims:id="382981"><Text><DefinedTermEn>marine installation or structure</DefinedTermEn> includes</Text><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="382982" lims:id="382982"><Label>(a)</Label><Text>any ship and any anchor, anchor cable or rig pad used in connection therewith,</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="382983" lims:id="382983"><Label>(b)</Label><Text>any offshore drilling unit, production platform, subsea installation, pumping station, living accommodation, storage structure, loading or landing platform, dredge, floating crane, pipelaying or other barge or pipeline and any anchor, anchor cable or rig pad used in connection therewith, and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="382984" lims:id="382984"><Label>(c)</Label><Text>any other work or province.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="382994" lims:id="382994" level="1"><Label>PART I</Label><TitleText>Canada’s Maritime Zones</TitleText></Heading><Heading lims:inforce-start-date="2002-12-31" lims:fid="382995" lims:id="382995" level="2"><TitleText>Territorial Sea and Contiguous Zone</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="382996" lims:id="382996"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="382997" lims:id="382997">Territorial sea of Canada</MarginalNote><Label>4</Label><Text>The territorial sea of Canada consists of a belt of sea that has as its inner limit the baselines described in section 5 and as its outer limit</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="382998" lims:id="382998"><Label>(a)</Label><Text>subject to paragraph (b), the line every point of which is at a distance of 12 nautical miles from the nearest point of the baselines; or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="382999" lims:id="382999"><Label>(b)</Label><Text>in respect of the portions of the territorial sea of Canada for which geographical coordinates of points have been prescribed pursuant to subparagraph 25(a)(ii), lines determined from the geographical coordinates of points so prescribed.</Text></Paragraph></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="383000" lims:id="383000"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383001" lims:id="383001">Determination of the baselines</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383002" lims:id="383002"><Label>(1)</Label><Text>Subject to subsections (2) and (3), the baseline is the low-water line along the coast or on a low-tide elevation that is situated wholly or partly at a distance not exceeding the breadth of the territorial sea of Canada from the mainland or an island.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383003" lims:id="383003"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383004" lims:id="383004">Geographical coordinates of points</MarginalNote><Label>(2)</Label><Text>In respect of any area for which geographical coordinates of points have been prescribed pursuant to subparagraph 25(a)(i) and subject to any exceptions in the regulations for</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383005" lims:id="383005"><Label>(a)</Label><Text>the use of the low-water line along the coast between given points, and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383006" lims:id="383006"><Label>(b)</Label><Text>the use of the low-water lines of low-tide elevations that are situated wholly or partly at a distance not exceeding the breadth of the territorial sea of Canada from the mainland or an island,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="383007" lims:id="383007"><Text>the baselines are straight lines interpreted as geodesics joining the consecutive geographical coordinates of points so prescribed.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383008" lims:id="383008"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383009" lims:id="383009">Baselines where historic title</MarginalNote><Label>(3)</Label><Text>In respect of any area not referred to in subsection (2), the baselines are the outer limits of any area, other than the territorial sea of Canada, over which Canada has a historic or other title of sovereignty.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383010" lims:id="383010"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383011" lims:id="383011">Low-tide elevations</MarginalNote><Label>(4)</Label><Text>For the purposes of this section, a low-tide elevation is a naturally formed area of land that is surrounded by and above water at low tide but submerged at high tide.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="383012" lims:id="383012"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383013" lims:id="383013">Internal waters of Canada</MarginalNote><Label>6</Label><Text>The internal waters of Canada consist of the waters on the landward side of the baselines of the territorial sea of Canada.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="383014" lims:id="383014"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383015" lims:id="383015">Part of Canada</MarginalNote><Label>7</Label><Text>For greater certainty, the internal waters of Canada and the territorial sea of Canada form part of Canada.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="383016" lims:id="383016"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383017" lims:id="383017">Rights of Her Majesty</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383018" lims:id="383018"><Label>(1)</Label><Text>For greater certainty, in any area of the sea not within a province, the seabed and subsoil below the internal waters of Canada and the territorial sea of Canada are vested in Her Majesty in right of Canada.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383019" lims:id="383019"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383020" lims:id="383020">Saving</MarginalNote><Label>(2)</Label><Text>Nothing in this section abrogates or derogates from any legal right or interest held before February 4, 1991.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="383021" lims:id="383021"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383022" lims:id="383022">Application of provincial law</MarginalNote><Label>9</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383023" lims:id="383023"><Label>(1)</Label><Text>Subject to this section and to any other Act of Parliament, the laws of a province apply in any area of the sea</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383024" lims:id="383024"><Label>(a)</Label><Text>that forms part of the internal waters of Canada or the territorial sea of Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383025" lims:id="383025"><Label>(b)</Label><Text>that is not within any province; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383026" lims:id="383026"><Label>(c)</Label><Text>that is prescribed by the regulations.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383027" lims:id="383027"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383028" lims:id="383028">Limitation</MarginalNote><Label>(2)</Label><Text>Subject to any regulations made pursuant to paragraph 26(1)(d), subsection (1) does not apply in respect of any provision of a law of a province that</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383029" lims:id="383029"><Label>(a)</Label><Text>imposes a tax or royalty; or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383030" lims:id="383030"><Label>(b)</Label><Text>relates to mineral or other non-living natural resources.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383031" lims:id="383031"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383032" lims:id="383032">Interpretation</MarginalNote><Label>(3)</Label><Text>For the purposes of this section, the laws of a province shall be applied as if the area of the sea in which those laws apply under this section were within the territory of that province.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383033" lims:id="383033"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383034" lims:id="383034">Sums due to province</MarginalNote><Label>(4)</Label><Text>Any sum due under a law of a province that applies in an area of the sea under this section belongs to Her Majesty in right of the province.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383035" lims:id="383035"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383036" lims:id="383036">Limitation</MarginalNote><Label>(5)</Label><Text>For greater certainty, this section shall not be interpreted as providing a basis for any claim, by or on behalf of a province, in respect of any interest in or legislative jurisdiction over any area of the sea in which a law of a province applies under this section or the living or non-living resources of that area, or as limiting the application of any federal laws.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="383037" lims:id="383037"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383038" lims:id="383038">Contiguous zone of Canada</MarginalNote><Label>10</Label><Text>The contiguous zone of Canada consists of an area of the sea that has as its inner limit the outer limit of the territorial sea of Canada and as its outer limit the line every point of which is at a distance of 24 nautical miles from the nearest point of the baselines of the territorial sea of Canada, but does not include an area of the sea that forms part of the territorial sea of another state or in which another state has sovereign rights.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="383039" lims:id="383039"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383040" lims:id="383040">Prevention in contiguous zone of infringement of federal laws</MarginalNote><Label>11</Label><Text>A person who is responsible for the enforcement of a federal law that is a customs, fiscal, immigration or sanitary law and who has reasonable grounds to believe that a person in the contiguous zone of Canada would, if that person were to enter Canada, commit an offence under that law may, subject to Canada’s international obligations, prevent the entry of that person into Canada or the commission of the offence and, for greater certainty, section 25 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> applies in respect of the exercise by a person of any powers under this section.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="383041" lims:id="383041"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383042" lims:id="383042">Enforcement in contiguous zone of federal laws</MarginalNote><Label>12</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383043" lims:id="383043"><Label>(1)</Label><Text>Where there are reasonable grounds to believe that a person has committed an offence in Canada in respect of a federal law that is a customs, fiscal, immigration or sanitary law, every power of arrest, entry, search or seizure or other power that could be exercised in Canada in respect of that offence may also be exercised in the contiguous zone of Canada.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383044" lims:id="383044"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383045" lims:id="383045">Limitation</MarginalNote><Label>(2)</Label><Text>A power of arrest referred to in subsection (1) shall not be exercised in the contiguous zone of Canada on board any ship registered outside Canada without the consent of the Attorney General of Canada.</Text></Subsection></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="383046" lims:id="383046" level="2"><TitleText>Exclusive Economic Zone</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="383047" lims:id="383047"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383048" lims:id="383048">Exclusive economic zone of Canada</MarginalNote><Label>13</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383049" lims:id="383049"><Label>(1)</Label><Text>The exclusive economic zone of Canada consists of an area of the sea beyond and adjacent to the territorial sea of Canada that has as its inner limit the outer limit of the territorial sea of Canada and as its outer limit</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383050" lims:id="383050"><Label>(a)</Label><Text>subject to paragraph (b), the line every point of which is at a distance of 200 nautical miles from the nearest point of the baselines of the territorial sea of Canada; or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383051" lims:id="383051"><Label>(b)</Label><Text>in respect of a portion of the exclusive economic zone of Canada for which geographical coordinates of points have been prescribed pursuant to subparagraph 25(a)(iii), lines determined from the geographical coordinates of points so prescribed.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383052" lims:id="383052"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383053" lims:id="383053">Determination of the outer limit of the exclusive economic zone of Canada</MarginalNote><Label>(2)</Label><Text>For greater certainty, paragraph (1)(a) applies regardless of whether regulations are made pursuant to subparagraph 25(a)(iv) prescribing geographical coordinates of points from which the outer limit of the exclusive economic zone of Canada may be and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="383060" lims:id="383060"><Label>(iii)</Label><Text>the protection and preservation of the marine environment; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383061" lims:id="383061"><Label>(c)</Label><Text>other rights and duties in the exclusive economic zone lims:id="383072"><Label>(1)</Label><Text>The continental shelf of Canada is the seabed and subsoil of the submarine areas, including those of the exclusive economic zone of Canada, that extend beyond the territorial sea of Canada throughout the natural prolongation of the land territory of Canada</Text><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="383073" lims:id="383073"><Label>(a)</Label><Text>subject to paragraphs (b) and (c), to the outer edge of the continental margin, determined in the manner under international law that results in the maximum extent of the continental shelf of Canada, the continental margin being the submerged prolongation of the land mass of Canada consisting of the seabed and subsoil of the shelf, the slope and the rise, but not including the deep ocean floor with its oceanic ridges or its subsoil;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="383074" lims:id="383074"><Label>(b)</Label><Text>to a distance of 200 nautical miles from the baselines of the territorial sea of Canada where the outer edge of the continental margin does not extend up to that distance; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="383075" lims:id="383075"><Label>(c)</Label><Text>in respect of a portion of the continental shelf of Canada for which geographical coordinates of points have been prescribed pursuant to subparagraph 25(a)(iii), to lines determined from the geographical coordinates of points so any marine installation or structure or artificial island referred to in paragraph (a) or (b) as is determined by or pursuant to the regulations.</Text></Paragraph></Subsection><Subsection lims:id="383094">Interpretation</MarginalNote><Label>(2)</Label><Text>For the purposes of subsection (1), federal laws shall be applied</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383095" lims:id="383095"><Label>(a)</Label><Text>as if the places referred to in that subsection formed part of the territory of Canada;</Text></Paragraph><Paragraph this section and to any other Act of Parliament, the laws of a province apply to the same extent as federal laws apply pursuant to section 20 in any area of the sea</Text><Paragraph lims:id="383105">Limitation</MarginalNote><Label>(2)</Label><Text>Subject to any regulations made pursuant to paragraph 26(1)(d), subsection (1) does not apply in respect of any provision of a law of a province that</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383106" lims:id="383106"><Label>(a)</Label><Text>imposes a tax or royalty; or</Text></Paragraph><Paragraph lims:id="383109">Interpretation</MarginalNote><Label>(3)</Label><Text>For the purposes of this section, the laws of a province shall be applied as if the area of the sea in which those laws apply lims:inforce-start-date="2002-12-31" lims:fid="383111" lims:id="383111">Sums due to province</MarginalNote><Label>(4)</Label><Text>Any sum due under a law of a province that applies in an area of the basis for any claim, by or on behalf of a province, in respect of any interest in or legislative jurisdiction over any area of the sea in which a law of a province applies under this section or the lims:inforce-start-date="2002-12-31" lims:fid="383120" lims:id="383120"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383121" lims:id="383121">Jurisdiction extended — provincial laws</MarginalNote><Label>(2)</Label><Text>Subject to any regulations made pursuant to paragraph 26(1)(h), a court that would have jurisdiction in respect of any matter had the matter arisen in a province has jurisdiction in respect of any such matter involving a law of the province that applies pursuant to this Act to the extent that the matter arises in whole or in part in any area of the respect of a portion of the exclusive economic zone of Canada or the continental shelf of Canada prescribed in the regulations, an outer limit line may be determined, where, in the opinion of the Governor in Council, a portion of the exclusive economic zone of Canada or the continental shelf of Canada determined in accordance with paragraph 13(1)(a) or 17(1)(a) or (b) would conflict with the territorial sea of another state or other area of the sea in which another state has sovereign rights or would be unreasonably close to the coast of another state or is otherwise inappropriate, 9(1) or 21(1) applicable, on the terms and conditions, if any, specified in the regulations, in respect of any laws of a province that impose a tax or royalty or relate to mineral or other non-living natural resources;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383162" lims:id="383162"><Label>(e)</Label><Text>excluding any law of a province from the application of subsection 9(1) or 21(1);</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383163" lims:id="383163"><Label>(f)</Label><Text>determining or prescribing the method of determining the safety zone referred to in paragraph 20(1)(c);</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383164" lims:id="383164"><Label>(g)</Label><Text>prescribing an area of the sea and a province for the purposes of subsection 9(1), 21(1) or 22(1);</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383165" lims:id="383165"><Label>(h)</Label><Text>restricting the application of subsection 22(1), (2) or (3) to courts of a district or territorial division of a province;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383166" lims:id="383166"><Label>(i)</Label><Text>prescribing, in respect of any area of the sea and for the purpose of subsection 22(1), the manner of determining the province that has the coast nearest to that area;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383167" lims:id="383167"><Label>(j)</Label><Text>excluding any federal laws or laws of a province or any of their provisions from the application of subsection 20(1) or 21(1), as the case may be, in respect of any area in or above the continental shelf of Canada or in respect of any specified activity in any such area; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383168" lims:id="383168"><Label>(k)</Label><Text>making federal laws or laws of a province or any of their provisions applicable, in such circumstances as are specified in the regulations,</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="383169" lims:id="383169"><Label>(i)</Label><Text>in the exclusive economic zone of Canada or in a portion of that zone,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="383170" lims:id="383170"><Label>(ii)</Label><Text>in or above the continental shelf of Canada or a portion of that shelf, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="383171" lims:id="383171"><Label>(iii)</Label><Text>in any area beyond the continental shelf of Canada, where that application is made pursuant to an international agreement or arrangement entered into by Canada.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383172" lims:id="383172"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383173" lims:id="383173">Restriction</MarginalNote><Label>(2)</Label><Text>A regulation made pursuant to subsection (1) in relation to a law of a province may be restricted to a specific area or place or to a specific provision of the law.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383174" lims:id="383174"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383175" lims:id="383175">Interpretation</MarginalNote><Label>(3)</Label><Text>For the purposes of paragraphs (1)(j) and (k), federal laws and the laws of a province shall be applied</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383176" lims:id="383176"><Label>(a)</Label><Text>as if the places referred to in any regulations made pursuant to either of those paragraphs formed part on the principles of</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383191" lims:id="383191"><Label>(a)</Label><Text>sustainable development, that is, development that meets the needs of the present without compromising the ability of future generations to meet their own needs;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383192" lims:id="383192"><Label>(b)</Label><Text>the integrated management of activities in estuaries, coastal waters and marine waters that form part of Canada or in which Canada has sovereign rights under international law; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383193" lims:id="383193"><Label>(c)</Label><Text>the precautionary approach, that is, erring on the side of caution.</Text></Paragraph></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="383194" lims:id="383194"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383195" lims:id="383195">Integrated management plans</MarginalNote><Label>31</Label><Text>The Minister, in collaboration with other ministers, boards and agencies of the Government of Canada, with provincial and territorial governments and with affected aboriginal organizations, coastal communities and other persons and bodies, including those bodies established under land claims agreements, shall lead and facilitate the development and implementation of plans for the integrated management of all activities or measures in or affecting estuaries, coastal waters and marine waters that form part of Canada or in which Canada has sovereign rights under international law.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="383196" lims:id="383196"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383197" lims:id="383197">Implementation of integrated management plans</MarginalNote><Label>32</Label><Text>For the purpose of the implementation of integrated management plans, the Minister</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383198" lims:id="383198"><Label>(a)</Label><Text>shall develop and implement policies and programs with respect to matters assigned by law to the Minister;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383199" lims:id="383199"><Label>(b)</Label><Text>shall coordinate with other ministers, boards and agencies of the Government of Canada the implementation of policies and programs of the Government with respect to all activities or measures in or affecting coastal waters and marine waters;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383200" lims:id="383200"><Label>(c)</Label><Text>may, on his or her own or jointly with another person or body or with another minister, board or agency of the Government of Canada, and taking into consideration the views of other ministers, boards and agencies of the Government of Canada, provincial and territorial governments and affected aboriginal organizations, coastal communities and other persons and bodies, including those bodies established under land claims agreements,</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="383201" lims:id="383201"><Label>(i)</Label><Text>establish advisory or management bodies and appoint or designate, as appropriate, members of those bodies, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="383202" lims:id="383202"><Label>(ii)</Label><Text>recognize established advisory or management bodies; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383203" lims:id="383203"><Label>(d)</Label><Text>may, in consultation with other ministers, boards and agencies of the Government of Canada, with provincial and territorial governments and with affected aboriginal organizations, coastal communities and other persons and bodies, including those bodies established under land claims agreements, establish marine environmental quality guidelines, objectives and criteria respecting estuaries, coastal waters and marine waters.</Text></Paragraph></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="383204" lims:id="383204"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383205" lims:id="383205">Cooperation and agreements</MarginalNote><Label>33</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383206" lims:id="383206"><Label>(1)</Label><Text>In exercising the powers and performing the duties and functions assigned to the Minister by this Act, the Minister</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383207" lims:id="383207"><Label>(a)</Label><Text>shall cooperate with other ministers, boards and agencies of the Government of Canada, with provincial and territorial governments and with affected aboriginal organizations, coastal communities and other persons and bodies, including those bodies established under land claims agreements;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383208" lims:id="383208"><Label>(b)</Label><Text>may enter into agreements with any person or body or with another minister, board or agency of the Government of Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383209" lims:id="383209"><Label>(c)</Label><Text>shall gather, compile, analyse, coordinate and disseminate information;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383210" lims:id="383210"><Label>(d)</Label><Text>may make grants and contributions on terms and conditions approved by the Treasury Board; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383211" lims:id="383211"><Label>(e)</Label><Text>may make recoverable expenditures on behalf of and at the request of any other minister, board or agency of the Government of Canada or of a province or any person or body.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383212" lims:id="383212"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383213" lims:id="383213">Consultation</MarginalNote><Label>(2)</Label><Text>In exercising the powers and performing the duties and functions mentioned in this Part, the Minister may consult with other ministers, boards and agencies of the Government of Canada, with provincial and territorial governments and with affected aboriginal organizations, coastal communities and other persons and bodies, including those bodies established under land claims agreements.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="383214" lims:id="383214"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383215" lims:id="383215">Logistics support, etc.</MarginalNote><Label>34</Label><Text>The Minister may coordinate logistics support and provide related assistance for the purposes of advancing scientific knowledge of estuarine, coastal and marine ecosystems.</Text></Section><Heading lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137047" lims:id="1137047" level="2"><TitleText>Designation of Marine Protected Areas</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2019-05-27" lims:fid="383216" lims:id="383216"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383217" lims:id="383217">Marine protected areas</MarginalNote><Label>35</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383218" lims:id="383218"><Label>(1)</Label><Text lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1135420" lims:id="1137048">A marine protected area is an area of the sea that forms part of the internal waters of Canada, the territorial sea of Canada or the exclusive economic zone of Canada and has been designated under this section or section 35.1 for special protection for one or more of the following reasons:</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383219" lims:id="383219"><Label>(a)</Label><Text>the conservation and protection of commercial and non-commercial fishery resources, including marine mammals, and their habitats;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383220" lims:id="383220"><Label>(b)</Label><Text>the conservation and protection of endangered or threatened marine species, and their habitats;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383221" lims:id="383221"><Label>(c)</Label><Text>the conservation and protection of unique habitats;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="383222" lims:id="1137049"><Label>(d)</Label><Text>the conservation and protection of marine areas of high biodiversity or biological productivity;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="383223" lims:id="1137050"><Label>(e)</Label><Text>the conservation and protection of any other marine resource or habitat as is necessary to fulfil the mandate of the Minister; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137051" lims:id="1137051"><Label>(f)</Label><Text>the conservation and protection of marine areas for the purpose of maintaining ecological integrity.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137052" lims:id="1137052"><MarginalNote lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137053" lims:id="1137053">Definition of <DefinitionRef>ecological integrity</DefinitionRef></MarginalNote><Label>(1.1)</Label><Text>For the purpose of paragraph (1)(f), <DefinedTermEn>ecological integrity</DefinedTermEn> means a condition in which</Text><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137054" lims:id="1137054"><Label>(a)</Label><Text>the structure, composition and function of ecosystems are undisturbed by any human activity;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137055" lims:id="1137055"><Label>(b)</Label><Text>natural ecological processes are intact and self-sustaining;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137056" lims:id="1137056"><Label>(c)</Label><Text>ecosystems evolve naturally; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137057" lims:id="1137057"><Label>(d)</Label><Text>an ecosystem’s capacity for self-renewal and its biodiversity are maintained.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="383224" lims:id="1137058"><MarginalNote lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137059" lims:id="1137059">Network of marine protected areas</MarginalNote><Label>(2)</Label><Text>For the purposes of integrated management plans referred to in sections 31 and 32, the Minister shall lead and coordinate the development and implementation of a national network of marine protected areas on behalf of the Government of Canada.</Text></Subsection><Subsection lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137060" lims:id="1137060"><MarginalNote lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137061" lims:id="1137061">Performance of duties and functions</MarginalNote><Label>(2.1)</Label><Text>In performing his or her duties and functions under subsection (2), the Minister shall ensure that:</Text><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137062" lims:id="1137062"><Label>(a)</Label><Text>clearly identified objectives are set with regard to each marine protected area; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137063" lims:id="1137063"><Label>(b)</Label><Text>the network of marine protected areas covers diverse habitat types, biogeographic regions and environmental conditions.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383226" lims:id="383226"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383227" lims:id="383227">Regulations</MarginalNote><Label>(3)</Label><Text>The Governor in Council, on the recommendation of the Minister, may make regulations</Text><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="383228" lims:id="1137064"><Label>(a)</Label><Text>designating marine protected areas;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="383229" lims:id="1137065"><Label>(b)</Label><Text>delineating zones within marine protected areas;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137066" lims:id="1137066"><Label>(c)</Label><Text>prohibiting classes of activities within marine protected areas; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137067" lims:id="1137067"><Label>(d)</Label><Text>respecting any other matter consistent with the purpose of the designation.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:id="1137076"><Text><DefinedTermEn>ongoing</DefinedTermEn> means, with respect to an activity in the area of the sea that is designated by an order made under subsection (2) as a marine protected area, that the activity </Text><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137077" lims:id="1137077"><Label>(a)</Label><Text>was lawfully carried out in the year immediately before the day on which the order comes into force and does not require an authorization, including a permit or licence, under any applicable federal laws or laws of a province;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137078" lims:id="1137078"><Label>(b)</Label><Text>was lawfully carried out in the year immediately before the day on which the order comes into force and was authorized, including by a permit or licence, under any applicable federal laws or laws of a province; or</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137079" lims:id="1137079"><Label>(c)</Label><Text>was not carried out before the day on order</MarginalNote><Label>(2)</Label><Text>The Minister may, by order, designate a marine protected area in any area of the sea that is not designated as a marine protected area under paragraph 35(3)(a), in a manner that is not inconsistent with a land claims agreement that has been given effect and has been ratified or approved by an Act of Parliament and, in that order, the Minister</Text><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137082" lims:id="1137082"><Label>(a)</Label><Text>shall list the classes of activities that are ongoing activities in the marine protected area;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137083" lims:id="1137083"><Label>(b)</Label><Text>shall prohibit, in the marine protected area, any activity that is not part of a class of activities set out in paragraph (a) and that disturbs, damages, destroys or removes from that marine protected area any unique geological or archeological features or any living marine organism or any part of its habitat or is likely to do so;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137084" lims:id="1137084"><Label>(c)</Label><Text>may prohibit, in the marine protected area, any activity that is part of a class of activities set out in paragraph (a) and that is governed by an Act of Parliament under which the Minister is responsible for the management, conservation or protection of fisheries resources; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137085" lims:id="1137085"><Label>(d)</Label><Text>may exempt from the prohibition in paragraph (b) or (c), subject to any conditions that the Minister considers appropriate, any activity referred to in those paragraphs in the marine protected area by a foreign national, an entity incorporated or formed by or under the laws of a country other than Canada, a foreign ship or a foreign state.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137086" lims:id="1137086"><MarginalNote lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137087" lims:id="1137087">Exceptions</MarginalNote><Label>(3)</Label><Text>The prohibitions set out in an order made under subsection (2) do not apply to the following activities:</Text><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137088" lims:id="1137088"><Label>(a)</Label><Text>activities that are carried out in response to an emergency situation or that are carried out by or on behalf of Her Majesty for the purpose of public safety, national defence, national security or law enforcement; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137089" lims:id="1137089"><Label>(b)</Label><Text>marine scientific research activities that are consistent with the purpose of the designation of the marine protected area and that are authorized under federal laws or laws of a province, if required to be so authorized.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137090" lims:id="1137090"><MarginalNote lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137091" lims:id="1137091">Publication of report</MarginalNote><Label>(4)</Label><Text>If an order is made under subsection (2), the Minister shall publish, in any manner that the Minister considers appropriate, a report</Text><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137092" lims:id="1137092"><Label>(a)</Label><Text>indicating the area of the sea designated in the order;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137093" lims:id="1137093"><Label>(b)</Label><Text>summarizing the consultations undertaken prior to making the order; lims:fid="383252" lims:id="383252">Certificate of designation</MarginalNote><Label>(3)</Label><Text>Every enforcement officer must be provided with a certificate of designation as an enforcement officer in a form approved by the Minister and, on entering any place under this Act, the officer shall, if so requested, show the certificate to the occupant or person in charge of the place.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383253" lims:id="383253"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383254" lims:id="383254">Powers of peace officers</MarginalNote><Label>(4)</Label><Text>For the purposes of this Act and the regulations, enforcement officers have all the powers of a peace officer, but the Minister may specify limits on those powers when designating any person or class of persons.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383255" lims:id="383255"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383256" lims:id="383256">Exemptions for law enforcement activities</MarginalNote><Label>(5)</Label><Text>For the purpose of investigations and other law enforcement activities under this Act, the Minister may, on any terms and conditions the Minister considers necessary, exempt enforcement officers who are carrying out duties or functions under this Act, and persons acting under their direction and control, from the application of any provision of this Act or the regulations.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383257" lims:id="383257"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383258" lims:id="383258">Obstruction</MarginalNote><Label>(6)</Label><Text>When an enforcement officer is carrying out duties or functions under this Act or the regulations, no person shall</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383259" lims:id="383259"><Label>(a)</Label><Text>knowingly make any false or misleading statement either orally or in writing to the enforcement officer; or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383260" lims:id="383260"><Label>(b)</Label><Text>otherwise wilfully obstruct the enforcement conveyance, in which the enforcement officer has reasonable grounds to believe, that there is any thing to which this Act or the regulations apply or any book, record, electronic data or other document relating to the application of this Act or the regulations, and the enforcement officer may, for that purpose,</Text><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="383264" lims:id="1137126"><Label>(a)</Label><Text>open or cause to be opened any container that the enforcement officer has reasonable grounds to believe contains that thing, book, record, electronic data or other document;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="383265" lims:id="1137127"><Label>(b)</Label><Text>examine the thing and take samples free of charge;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="383266" lims:id="1137128"><Label>(c)</Label><Text>require any person to produce the book, record, electronic data or other document for examination or copying, in whole or in part;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="383267" lims:id="1137129"><Label>(d)</Label><Text>use or cause to be used any computer system or data processing system at the place being inspected to examine any data contained in, or available to, the system;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137130" lims:id="1137130"><Label>(e)</Label><Text>reproduce any record or cause it to be reproduced from the data in the form of a printout or other intelligible output and remove the printout or other output for examination or copying; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137131" lims:id="1137131"><Label>(f)</Label><Text>use or cause to be used any copying equipment at the place being inspected to make copies of any book, record, electronic data or other document.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137132" lims:id="1137132"><MarginalNote lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137133" lims:id="1137133">Disposition of samples</MarginalNote><Label>(1.1)</Label><Text>An enforcement officer may dispose of a sample taken under paragraph (1)(b) in any manner that the officer considers appropriate.</Text></Subsection><Subsection lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137134" lims:id="1137134"><MarginalNote lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137135" lims:id="1137135">Seizure</MarginalNote><Label>(1.2)</Label><Text>For the purposes of subsection (1), the enforcement officer may seize any thing that the enforcement officer has reasonable grounds to believe</Text><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137136" lims:id="1137136"><Label>(a)</Label><Text>was used in the contravention of this Act or the regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137137" lims:id="1137137"><Label>(b)</Label><Text>is something in relation to which this Act or the regulations have been contravened; or</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137138" lims:id="1137138"><Label>(c)</Label><Text>was obtained by the contravention of this Act or the regulations.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137139" lims:id="1137139"><MarginalNote lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137140" lims:id="1137140">Assistance</MarginalNote><Label>(1.3)</Label><Text>The owner or the person in charge of the place, and every person found in the place, shall</Text><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137141" lims:id="1137141"><Label>(a)</Label><Text>give the enforcement officer all assistance that is reasonably required to enable the officer to exercise their powers or to perform their duties or functions under this section; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137142" lims:id="1137142"><Label>(b)</Label><Text>provide the enforcement officer with any information or any book, record, electronic data or other document, and access to any data, that are reasonably required for that purpose.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="383268" lims:id="1137143"><MarginalNote lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137144" lims:id="1137144">Conveyance</MarginalNote><Label>(2)</Label><Text>For the purposes of carrying out the inspection, the enforcement officer may stop a conveyance or direct that it be moved to any place, including in Canadian waters or the exclusive economic zone of Canada, where the inspection can be carried out.</Text></Subsection><Subsection lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137145" lims:id="1137145"><MarginalNote lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137146" lims:id="1137146">Passage through private property</MarginalNote><Label>(2.1)</Label><Text>An enforcement officer and any person accompanying them may enter and pass through private property, other than a dwelling-place, in order to gain entry to a place referred to in subsection (1). For greater certainty, neither person is liable for doing so.</Text></Subsection><Subsection lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137147" lims:id="1137147"><MarginalNote lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137148" lims:id="1137148">Passage through private property by authorized person</MarginalNote><Label>(2.2)</Label><Text>A person acting under the direction and control of an enforcement officer may, for the purposes of exercising the officer’s powers or performing the officer’s duties and functions under this section, enter and pass through private property, other than a dwelling-place, in order to gain entry to a marine protected area. For greater certainty, the person is not liable for doing so.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383270" lims:id="383270"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383271" lims:id="383271">Dwelling-place</MarginalNote><Label>(3)</Label><Text>The enforcement officer may not enter a dwelling-place except with the consent of the occupant or person in charge of the dwelling-place or under the authority of a warrant.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383272" lims:id="383272"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383273" lims:id="383273">Warrant</MarginalNote><Label>(4)</Label><Text>Where on <Language xml:lang="la">ex parte</Language> application a justice, as defined in section 2 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, is satisfied by information on oath that</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383274" lims:id="383274"><Label>(a)</Label><Text>the conditions for entry described in subsection (1) exist in relation to a dwelling-place,</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383275" lims:id="383275"><Label>(b)</Label><Text>entry to the dwelling-place is necessary in relation to the administration of this Act or the regulations, and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383276" lims:id="383276"><Label>(c)</Label><Text>entry to the dwelling-place has been refused or there are reasonable grounds for believing that entry will be refused,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" officer may make a detention order in relation to a ship if they have reasonable grounds to believe that the ship or a person on board the ship has committed an offence under this Act in Canadian waters or the exclusive economic zone of Canada and that the ship was used in connection with the commission of the offence.</Text></Subsection><Subsection lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137161" lims:id="1137161"><MarginalNote lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137162" lims:id="1137162">Order in writing</MarginalNote><Label>(2)</Label><Text>The detention order shall be in writing and addressed to all persons, at any port in Canada where the ship to which the order relates is or will be located, who are empowered to give a clearance in respect of the ship.</Text></Subsection><Subsection lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137163" lims:id="1137163"><MarginalNote lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137164" lims:id="1137164">Service of order</MarginalNote><Label>(3)</Label><Text>Notice of the detention order shall be served by delivering a copy of the notice personally to the master or another officer, the authorized representative, the owner or the operator of the ship, or if service cannot reasonably be effected personally, by posting a copy of the notice on any conspicuous part of the ship.</Text></Subsection><Subsection lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137165" lims:id="1137165"><MarginalNote lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137166" lims:id="1137166">Duty after service of order</MarginalNote><Label>(4)</Label><Text>Once notice of the detention order is served on any person referred to in subsection (3), the ship shall not move, other than in accordance with any conditions specified in the order, until the order has been rescinded.</Text></Subsection><Subsection lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137167" lims:id="1137167"><MarginalNote lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137168" lims:id="1137168">No clearance after receiving order</MarginalNote><Label>(5)</Label><Text>Subject to subsection (6), a person who has received the detention order shall not give clearance to the ship to which the order relates.</Text></Subsection><Subsection lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137169" lims:id="1137169"><MarginalNote lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137170" lims:id="1137170">When clearance may be given</MarginalNote><Label>(6)</Label><Text>A person who has received the detention order may give clearance to the ship to which the order relates if</Text><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137171" lims:id="1137171"><Label>(a)</Label><Text>neither the ship nor any person is charged with the offence that gave rise to the making of the order within 30 days after the day on which the order is made;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137172" lims:id="1137172"><Label>(b)</Label><Text>within 30 days after the day on which the order is made, the ship or a person is charged with the offence and every accused has appeared in Canada to answer to the charge;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137173" lims:id="1137173"><Label>(c)</Label><Text>Her Majesty in right of Canada is given security, in a form determined by the Minister, for payment of the maximum fine that may be imposed as a result of a conviction of every accused and costs that might be incurred in proceedings in connection with the charge or charges, or payment of any lesser amount that is approved by the Minister;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137174" lims:id="1137174"><Label>(d)</Label><Text>all proceedings in respect of the offence that gave rise to the making of the order are discontinued; or</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137175" lims:fid="1137181" lims:id="1137181"><Label>(1)</Label><Text>If an enforcement officer has reasonable grounds to believe that a person is committing an offence under this Act — or is about to commit an offence under this Act — the enforcement officer may issue a compliance order directing any person described in subsection (3) to take, at their own expense, any of the measures referred to in subsection (4) that the enforcement officer believes are reasonable in the circumstances, and consistent with the protection and preservation of the marine environment and with public safety, in order to cease the commission of the offence or to refrain from committing it.</Text></Subsection><Subsection lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137182" lims:id="1137182"><MarginalNote lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137183" lims:id="1137183">Order to ship</MarginalNote><Label>(2)</Label><Text>For the purposes of subsection (1), an order is deemed to have been given to the ship and is binding on it, if</Text><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137184" lims:id="1137184"><Label>(a)</Label><Text>the order is given to the master or another officer, the authorized representative, the owner or the operator of the ship; or</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137185" lims:id="1137185"><Label>(b)</Label><Text>in the case of an order that cannot be given to any person referred to in paragraph (a) despite reasonable efforts having been made to do so, the order is posted on any conspicuous part of the applies to any person who causes or contributes to, or is likely to cause or contribute to, the offence.</Text></Subsection><Subsection lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137188" lims:id="1137188"><MarginalNote lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137189" lims:id="1137189">Specific measures</MarginalNote><Label>(4)</Label><Text>The compliance order may require that the person to whom it is directed take one or more of the following measures:</Text><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137190" lims:id="1137190"><Label>(a)</Label><Text>do anything to comply with this Act or the regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137191" lims:id="1137191"><Label>(b)</Label><Text>refrain from doing anything in contravention of this Act or the regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137192" lims:id="1137192"><Label>(c)</Label><Text>cease any activity for a specified period or until the enforcement officer is satisfied that the activity is in compliance with this Act and the regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137193" lims:id="1137193"><Label>(d)</Label><Text>move any conveyance to a location by the route and in the manner that the enforcement officer specifies;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137194" lims:id="1137194"><Label>(e)</Label><Text>unload or reload the contents of any conveyance; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137195" lims:id="1137195"><Label>(f)</Label><Text>take any other reasonable measure that the enforcement officer considers necessary to facilitate compliance with the order — or to restore the components of the marine environment damaged by the offence or to protect the components of the marine environment that would be put at risk if the offence were committed — including</Text><Subparagraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137196" lims:id="1137196"><Label>(i)</Label><Text>maintaining records on any relevant matter,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137197" lims:id="1137197"><Label>(ii)</Label><Text>reporting periodically to the enforcement officer, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137198" lims:id="1137198"><Label>(iii)</Label><Text>submitting to the enforcement officer any information, proposal or plan specified by the enforcement officer that sets out any action to be taken by the person with respect to the subject-matter of the order.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137199" lims:id="1137199"><MarginalNote lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137200" lims:id="1137200">Contents of compliance order</MarginalNote><Label>(5)</Label><Text>Subject to section 39.23, the compliance order shall be made in writing and shall set out</Text><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137201" lims:id="1137201"><Label>(a)</Label><Text>the name of the person or persons to whom it is directed;</Text></Paragraph><Paragraph lims:enacted-date="2019-05-27" lims:fid="1137204" lims:id="1137204"><Label>(d)</Label><Text>the measures to be taken; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137205" lims:id="1137205"><Label>(e)</Label><Text>the time or the day when each measure is to begin or the period during which it is to be carried lims:fid="1137340" lims:id="1137340"><Label>(1)</Label><Text>A person who commits or continues an offence on more than one day is liable to be convicted for a separate offence for each day on which involving more than one animal, plant, other organism or object, the fine to be imposed in respect of that offence may be, despite section 39.6, the total of the fines that would have been imposed if each of the animals, plants, organisms or objects had been the subject of a separate information.</Text></Subsection><Subsection lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" fine</MarginalNote><Label>(3)</Label><Text>If a person is convicted of an offence and the court is satisfied that, as a result of the commission of the offence, the person acquired any property, benefit or advantage, the court shall order them to pay an additional fine in an amount equal to the court’s estimation of the value of that property, benefit or advantage. sufficient proof of the offence to establish that the act or omission that constitutes the offence was committed by the master of the ship or any other person on board the ship, whether or not the person on board has been identified or has been prosecuted for the offence.</Text></Subsection><Subsection lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137373" lims:id="1137373"><MarginalNote lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137374" lims:id="1137374">Direction binding ship</MarginalNote><Label>(6)</Label><Text>For the purpose of prosecuting a ship for contravening a direction made under section 39.2, any direction made under that section that is given to the master or another officer, the authorized representative, the owner or the operator of the ship is deemed to have been given to the ship and is binding on it.</Text></Subsection><Subsection principles</MarginalNote><Label>39.68</Label><Subsection lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137381" lims:id="1137381"><Label>(1)</Label><Text>In addition to the principles and factors that the court is otherwise required to consider, including those set out in sections 718.1 to 718.21 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, the court shall consider the following principles when sentencing a person who is convicted of an offence under this Act:</Text><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137382" lims:id="1137382"><Label>(a)</Label><Text>the amount of the fine should be increased to account for every aggravating factor associated with the offence, including the aggravating factors set out in subsection (2); and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137383" lims:id="1137383"><Label>(b)</Label><Text>the amount of the fine should reflect the gravity of each aggravating factor associated with the offence.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137384" lims:id="1137384"><MarginalNote lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137385" lims:id="1137385">Aggravating factors</MarginalNote><Label>(2)</Label><Text>The aggravating factors to be considered by the court in respect of a person convicted of an offence are the following:</Text><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137386" lims:id="1137386"><Label>(a)</Label><Text>the offence caused damage or a risk of damage to any marine resource, habitat or ecosystem;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137387" lims:id="1137387"><Label>(b)</Label><Text>the offence caused damage or a risk of damage to any unique, rare, particularly important or vulnerable marine resource, habitat or ecosystem;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137388" lims:id="1137388"><Label>(c)</Label><Text>the damage caused by the offence is extensive, persistent or irreparable;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137389" lims:id="1137389"><Label>(d)</Label><Text>the person committed the offence intentionally or recklessly;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137390" lims:id="1137390"><Label>(e)</Label><Text>the person failed to take reasonable steps to prevent the commission of the offence despite having the financial means to do so;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137391" lims:id="1137391"><Label>(f)</Label><Text>by committing the offence or failing to take action to prevent its commission, the person increased revenue or decreased costs or intended to increase revenue or decrease costs;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137392" lims:id="1137392"><Label>(g)</Label><Text>the person committed the offence despite having been warned by the Minister or an enforcement officer of the circumstances that subsequently became the subject of the offence;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137393" lims:id="1137393"><Label>(h)</Label><Text>the person has a history of non-compliance with an Act of Parliament or an Act of a provincial legislature that relates to environmental or wildlife protection or conservation; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137394" lims:id="1137394"><Label>(i)</Label><Text>after committing the offence, the person</Text><Subparagraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137395" lims:id="1137395"><Label>(i)</Label><Text>attempted to conceal its commission,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137396" lims:id="1137396"><Label>(ii)</Label><Text>failed to take prompt action to prevent, mitigate or remediate its effects, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137397" lims:id="1137397"><Label>(iii)</Label><Text>failed to take prompt action to reduce the risk of committing similar offences in the future.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137398" lims:id="1137398"><MarginalNote lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137399" lims:id="1137399">Absence of aggravating factor</MarginalNote><Label>(3)</Label><Text>The absence of an aggravating factor set out in subsection (2) is not a mitigating factor.</Text></Subsection><Subsection lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137400" lims:id="1137400"><MarginalNote lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137401" lims:id="1137401">Definition of <DefinitionRef>damage</DefinitionRef></MarginalNote><Label>(4)</Label><Text>For the purposes of paragraphs (2)(a) to (c), <DefinedTermEn>damage</DefinedTermEn> includes loss of use value and non-use value.</Text></Subsection><Subsection lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137402" lims:id="1137402"><MarginalNote lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137403" lims:id="1137403">Reasons</MarginalNote><Label>(5)</Label><Text>If the court decides not to increase the amount of the fine despite being satisfied of the existence of one or more of the aggravating factors set out in subsection (2), the court shall provide reasons for that decision.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:id="383318"><Label>(1)</Label><Text>Where a person is convicted of an offence, the convicting court may, in addition to any punishment imposed, order that any seized thing by means of or in relation to which the offence was committed, or any proceeds of its disposition, be forfeited to Her Majesty in right of Canada.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383319" lims:id="383319"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383320" lims:id="383320">Return where no forfeiture ordered</MarginalNote><Label>(2)</Label><Text>Where the convicting court does not order the forfeiture, the seized thing, or the proceeds of its disposition, must be returned to its lawful owner or the person lawfully entitled to disposition, may be retained until the fine is paid, or the thing may be sold in satisfaction of the fine and the proceeds applied, in whole or in part, in payment of the fine.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2019-05-27" lims:fid="383323" lims:id="383323"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383324" lims:id="383324">Orders of court</MarginalNote><Label>39.9</Label><Subsection lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137416" lims:id="1137416"><Label>(1)</Label><Text>Where a person is convicted of an offence, the court may, in addition to any punishment imposed and having regard to the nature of the offence and the circumstances surrounding its commission, make an order containing one or more of the following prohibitions, directions or requirements:</Text><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137417" lims:id="1137417"><Label>(a)</Label><Text>prohibiting the person from doing any act or engaging in any activity that could, in the opinion of the court, result in the continuation or repetition of the offence;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137418" lims:id="1137418"><Label>(b)</Label><Text>directing the person to take any action that the court considers appropriate to remedy or avoid any harm to estuarine, coastal or ocean waters, or their resources that resulted or may result from the commission of the offence;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137419" lims:id="1137419"><Label>(c)</Label><Text>directing the person to publish, in any manner that the court considers appropriate, the facts relating to the commission of the offence;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137420" lims:id="1137420"><Label>(d)</Label><Text>directing the person to pay the Minister or the government of a province compensation, in whole or in part, for the cost of any remedial or preventive action taken by or on behalf of the Minister or that government as a result of the commission of the offence;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137421" lims:id="1137421"><Label>(e)</Label><Text>directing the person to perform community service in accordance with any reasonable conditions that may be specified in the order;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137422" lims:id="1137422"><Label>(f)</Label><Text>directing the person to submit to the Minister, on application to the court by the Minister within three years after the conviction, any information respecting the activities of the person that the court considers appropriate in the circumstances;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137423" lims:id="1137423"><Label>(g)</Label><Text>requiring the person to comply with any other conditions that the court considers appropriate for securing the person’s good conduct and for preventing the person from repeating the offence or committing other offences;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137424" lims:id="1137424"><Label>(h)</Label><Text>directing the person to post a bond or pay into court an amount of money that the court considers appropriate for the purpose of ensuring compliance with any prohibition, direction or requirement under this section;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137425" lims:id="1137425"><Label>(i)</Label><Text>directing the person to pay, in the manner specified by the court, an amount for monitoring the environmental effects of any activity or marine installation or structure on any marine resource, habitat or ecosystem in any marine protected area;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-05-27" lims:enacted-date="2019-05-27" lims:fid="1137426" lims:id="1137426"><Label>(j)</Label><Text>directing the person to pay to Her Majesty in right of Canada an amount of money that the court considers appropriate for the purpose of promoting the conservation, protection or restoration of any marine protected manner specified by the court, an amount to enable research to be conducted with respect to the conservation, protection or restoration of any marine protected area;</Text></Paragraph><Paragraph lims:enacted-date="2019-05-27" lims:fid="1137457" lims:id="1137457"><Label>(d)</Label><Text>include a statement that if the accused pays the fine within the period set out in the ticket, a conviction lims:id="1137458"><Label>(e)</Label><Text>include a statement that if the accused wishes to plead not guilty or for any other reason fails to pay the fine within the period set out in the ticket, the completes the ticket shall give written notice to the accused that, if the accused pays the fine prescribed by the regulations within the period set out in the ticket, the thing, or any proceeds of research related to hydrography, oceanography and other marine sciences, including the study of fish and their supporting habitat and ecosystems;</Text></Paragraph><Paragraph lims:id="383404"><Label>(h)</Label><Text>prepare in collaboration with the Minister of Foreign Affairs, publish and authorize the distribution or sale of charts delineating, consistently with the nature and scale of the charts, all or part of the territorial sea of Canada, the contiguous zone of Canada, the exclusive economic zone of Canada and the fishing zones of Canada and adjacent waters;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383405" lims:id="383405"><Label>(i)</Label><Text>participate in ocean technology development; purpose of understanding oceans and their living resources and ecosystems.</Text></Paragraph></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="383407" lims:id="383407"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383408" lims:id="383408">Powers</MarginalNote><Label>43</Label><Text>Subject to section 4 of the <XRefExternal reference-type="act" link="F-15">Department of Fisheries and Oceans Act</XRefExternal> respecting the powers, duties and functions of the Minister in relation to matters mentioned in that section over which Parliament has jurisdiction, the Minister</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383409" lims:id="383409"><Label>(a)</Label><Text>is responsible for coordinating, promoting and recommending national policies and programs with respect to fisheries science, hydrography, oceanography and other marine sciences;</Text></Paragraph><Paragraph economic studies for the purpose of understanding oceans and their living resources and ecosystems, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="383412" lims:id="383412"><Label>(ii)</Label><Text>for that purpose maintain and operate ships, research institutes, laboratories and other facilities for research, surveying and monitoring for the purpose of understanding oceans and their living resources and ecosystems; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383413" lims:id="383413"><Label>(c)</Label><Text>may provide marine scientific advice, services and support to the Government of Canada and, on behalf of the Government, to the governments of the provinces, to other states, to international organizations and to other persons.</Text></Paragraph></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="383414" lims:id="383414"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383415" lims:id="383415">Marine scientific research by foreign ships</MarginalNote><Label>44</Label><Text>The Minister may</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383416" lims:id="383416"><Label>(a)</Label><Text>request the Minister of Foreign Affairs to attach to a consent of the Minister of Foreign Affairs under paragraph 3(2)(c) of the <XRefExternal reference-type="act" link="C-33.3">Coasting Trade Act</XRefExternal> a condition that the foreign ship or non-duty paid ship supply the Minister with the results of the marine scientific research conducted by that ship in waters that form part of Canada or in which Canada has sovereign rights under international law; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383417" lims:id="383417"><Label>(b)</Label><Text>establish guidelines, not inconsistent with Canada’s international obligations, for use by foreign ships and non-duty paid ships in conducting marine scientific research in waters that form part of Canada or in which Canada has sovereign rights under international preparing charts on behalf of the Minister; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="383421" lims:id="383421"><Label>(b)</Label><Text>providing hydrographic advice, services and support to the Government of Canada and, on behalf of the Government, to the governments of the provinces, to other states, to international organizations and to other persons.</Text></Paragraph></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="383422" lims:id="383422"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383423" lims:id="383423">Entry on lands</MarginalNote><Label>46</Label><Text>A hydrographer may, for the purpose of conducting a hydrographic survey on behalf of the Minister, enter on or pass over the lands of any person, but shall take all reasonable precautions to avoid causing any damage in doing so.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="383424" lims:id="383424" level="2"><TitleText>Fees</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="383425" lims:id="383425"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383426" lims:id="383426">Fees for services or use of facilities</MarginalNote><Label>47</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383427" lims:id="383427"><Label>(1)</Label><Text>The Minister may, subject to any regulations that the Treasury Board may make for the purposes of this section, fix the fees to be paid for a service or the use of a facility provided under this Act by the Minister, the Department or any board or agency of the Government of Canada for which the Minister has responsibility.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383428" lims:id="383428"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383429" lims:id="383429">Amount not to exceed cost</MarginalNote><Label>(2)</Label><Text>Fees for a service or the use of a facility that are fixed under subsection (1) may not exceed the cost to Her Majesty in right of Canada of providing the service or the use of the facility.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="383430" lims:id="383430"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383431" lims:id="383431">Fees for products, rights and privileges</MarginalNote><Label>48</Label><Text>The Minister may, subject to any regulations that the Treasury Board may make for the purposes of this section, fix fees in respect of products, rights and privileges provided under this Act by the Minister, the Department or any board or agency of the Government of Canada for which the Minister has responsibility.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="383432" lims:id="383432"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383433" lims:id="383433">Fees in respect of regulatory processes, etc.</MarginalNote><Label>49</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383434" lims:id="383434"><Label>(1)</Label><Text>The Minister may, subject to any regulations that the Treasury Board may make for the purposes of this section, fix fees in respect of regulatory processes or approvals provided under this Act by the Minister, the Department or any board or agency of the Government of Canada for which the Minister has responsibility.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383435" lims:id="383435"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383436" lims:id="383436">Amount</MarginalNote><Label>(2)</Label><Text>Fees that are fixed under subsection (1) shall in the aggregate not exceed an amount sufficient to compensate Her Majesty in right of Canada for any reasonable outlays incurred by Her Majesty for the purpose of providing the regulatory processes or approvals.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="383437" lims:id="383437"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383438" lims:id="383438">Consultation</MarginalNote><Label>50</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383439" lims:id="383439"><Label>(1)</Label><Text>Before fixing a fee under this Act, the Minister shall consult with such persons or bodies as the Minister considers to be interested in the matter.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383440" lims:id="383440"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383441" lims:id="383441">Publication</MarginalNote><Label>(2)</Label><Text>The Minister shall, within 30 days after fixing a fee under this Act, publish the fee in the <XRefExternal reference-type="other" link="gazette">Canada Gazette</XRefExternal> and by such appropriate electronic or other means that the Treasury Board may authorize by regulation.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383442" lims:id="383442"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383443" lims:id="383443">Reference to Scrutiny Committee</MarginalNote><Label>(3)</Label><Text>Any fee fixed under this Act shall stand referred to the Committee referred to in section 19 of the <XRefExternal reference-type="act" link="S-22">Statutory Instruments Act</XRefExternal> to be reviewed and scrutinized as if it were a statutory instrument.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="383444" lims:id="383444"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383445" lims:id="383445">Power to make regulations</MarginalNote><Label>51</Label><Text>The Treasury Board may make regulations for the purposes of section 47, 48, 49 or 50.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="383446" lims:id="383446"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383447" lims:id="383447">Review</MarginalNote><Label>52</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383448" lims:id="383448"><Label>(1)</Label><Text>The administration of this Act shall, within three years after the coming into force of this section, be reviewed by the Standing Committee on Fisheries and Oceans.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="383449" lims:id="383449"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="383450" lims:id="383450">Report to Parliament</MarginalNote><Label>(2)</Label><Text>The Committee shall undertake a comprehensive review of the provisions and operation of this Act, including the consequences of its implementation, and shall, within a year after the review is undertaken or within such further time as the House of Commons may authorize, submit a report to Parliament thereon including a statement of any changes to this Act or its administration that the Committee would
