between the Government of Canada and the Government of Newfoundland and Labrador on Offshore Revenues signed on February 14, 2005. (<DefinedTermFr>Entente Canada – Terre-Neuve-et- Labrador</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2005-06-29" lims:fid="367694" lims:id="367694"><Text><DefinedTermEn>Canada–Nova Scotia Arrangement</DefinedTermEn> means the Arrangement between the Government of Canada and the Government of Nova Scotia on Offshore Revenues signed on February 14, 2005. (<DefinedTermFr>Entente Canada – Nouvelle-Écosse</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2005-06-29" lims:fid="367695" lims:id="367695"><Text><DefinedTermEn>Minister</DefinedTermEn> means the lims:inforce-start-date="2005-06-29" lims:fid="367698" lims:id="367698">Purpose of the Act</MarginalNote><Label>3</Label><Text>The purpose of this Act is to implement the Canada–Newfoundland and Labrador Arrangement and the Canada–Nova Scotia Arrangement.</Text></Section><Heading lims:inforce-start-date="2005-06-29" lims:fid="367699" lims:id="367699" level="1"><Label>PART 1</Label><TitleText>Additional Fiscal Equalization Offset Payments for Nova Scotia</TitleText></Heading><Section lims:inforce-start-date="2015-06-19" lims:lastAmendedDate="2025-01-31" lims:fid="367700" lims:id="367700"><MarginalNote lims:inforce-start-date="2015-06-19" lims:fid="367701" lims:id="367701">Definitions</MarginalNote><Label>4</Label><Text>The following definitions apply in this Part.</Text><Definition lims:inforce-start-date="2015-06-19" lims:fid="367702" lims:id="367702"><Text><DefinedTermEn>additional fiscal equalization offset payment</DefinedTermEn> means the payment that may be made under section <XRefInternal>6</XRefInternal>, <XRefInternal>7</XRefInternal> or <XRefInternal>12</XRefInternal>. (<DefinedTermFr>paiement de péréquation compensatoire payment</DefinedTermEn><Repealed>[Repealed, 2015, c. 4, s. 110]</Repealed></Text></Definition><Definition lims:inforce-start-date="2015-06-19" lims:fid="367704" lims:id="367704"><Text><DefinedTermEn>fiscal equalization payment</DefinedTermEn> means </Text><Paragraph lims:inforce-start-date="2015-06-19" lims:fid="367705" lims:id="367705"><Label>(a)</Label><Text>for the purposes of section 8, the fiscal equalization payment that would be received by the Province for a fiscal year if the amount of that payment were determined in accord-ance with section 3.2 of the <XRefExternal reference-type="act" link="F-7.8">Federal-Provincial Fiscal Arrangements Act</XRefExternal>, without regard to section 3.4 of that Act; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-19" lims:fid="367706" lims:id="367706"><Label>(b)</Label><Text>for the purposes of sections 10 to 12, the fiscal equalization payment that would be received by the Province for a fiscal year under Part I of the <XRefExternal reference-type="act" link="F-7.8">Federal-Provincial Fiscal Arrangements Act</XRefExternal> if the Province’s total per capita fiscal capacity were the amount determined by the formula</Text><FormulaGroup lims:inforce-start-date="2015-06-19" lims:fid="367707" lims:id="367707"><Formula lims:inforce-start-date="2015-06-19" lims:fid="367708" lims:id="367708"><FormulaText>A + B + (C / F)</FormulaText></Formula><FormulaConnector>where</FormulaConnector><FormulaDefinition lims:inforce-start-date="2015-06-19" lims:fid="367709" lims:id="367709"><FormulaTerm>A,</FormulaTerm><Text>B, C and F have the same meaning as in the definition <DefinedTermEn>total per capita fiscal capacity</DefinedTermEn> in subsection 3.5(1) of that Act. (<DefinedTermFr>paiement de péréquation</DefinedTermFr>)</Text></FormulaDefinition></FormulaGroup></Paragraph></Definition><Definition lims:inforce-start-date="2015-06-19" lims:fid="367710" lims:id="367710"><Text><DefinedTermEn>offshore revenue</DefinedTermEn> in respect of any fiscal year means the aggregate of the following amounts paid to the Province for that fiscal year:</Text><Paragraph lims:inforce-start-date="2025-01-31" lims:enacted-date="2024-10-03" lims:fid="367711" lims:id="1508857"><Label>(a)</Label><Text>amounts paid under paragraph 219(2)(b) of the <XRefExternal reference-type="act" link="C-7.8">Canada–Nova Scotia Offshore Petroleum Resources Accord Implementation and Offshore Renewable Energy Management Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-19" lims:fid="367712" lims:id="367712"><Label>(b)</Label><Text>amounts paid with respect to the portion of tax under subsection 165(2) and sections 218.1, 220.05, 220.06 and 220.08 of the <XRefExternal reference-type="act" link="E-15">Excise Tax Act</XRefExternal> that is attributable to offshore activity in the Nova Scotia offshore area, within the meaning of subsection 123(1) of that Act; and</Text></Paragraph><Paragraph lims:inforce-start-date="2025-01-31" lims:enacted-date="2024-10-03" lims:fid="367713" lims:id="1508858"><Label>(c)</Label><Text>amounts paid with respect to tax that would be payable under Part III of the <XRefExternal reference-type="act" link="I-3.3">Income Tax Act</XRefExternal> (Nova Scotia), R.S.N.S. 1989, c. 217, as amended from time to time, on taxable capital of a corporation employed in the offshore area within the meaning of section 2 of the <XRefExternal reference-type="act" link="C-7.8">Canada–Nova Scotia Offshore Petroleum Resources Accord Implementation and Offshore Renewable Energy Management Act</XRefExternal> if that area were in the land portion of the Province, unless those amounts have been included in paragraph (a). (<DefinedTermFr>recettes extracôtières</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2025-01-31" lims:enacted-date="2024-10-03" lims:fid="367714" lims:id="1508856"><Text><DefinedTermEn>petroleum</DefinedTermEn> has the same meaning as in section 2 of the <XRefExternal reference-type="act" link="C-7.8">Canada–Nova Scotia Offshore Petroleum Resources Accord Implementation and Offshore Renewable Energy Management Act</XRefExternal>. (<DefinedTermFr>hydro­carbures</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-06-19" lims:fid="367715" lims:id="367715"><Text><DefinedTermEn>Province</DefinedTermEn> means the Province of Nova Scotia. (<DefinitionEnOnly>Version anglaise seulement</DefinitionEnOnly>)</Text></Definition><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-06-19" lims:fid="367717" lims:id="367717">2005, c. 30, s. 85 “4”; 2007, c. 29, s. 81; 2015, c. 4, s. 110</HistoricalNoteSubItem><HistoricalNoteSubItem lims:inforce-start-date="2025-01-31" lims:enacted-date="2024-10-03" lims:fid="1508855" lims:id="1508855" lims:id="367718"><MarginalNote lims:inforce-start-date="2005-06-29" lims:fid="367719" lims:id="367719">Payment of $830 million</MarginalNote><Label>5</Label><Text>The Minister shall make a payment to the Province in the amount of $830 million, to allow the Province to reduce its outstanding debt.</Text></Section><Section lims:inforce-start-date="2005-06-29" lims:lastAmendedDate="2005-06-29" lims:fid="367720" lims:id="367720"><MarginalNote lims:inforce-start-date="2005-06-29" lims:fid="367721" lims:id="367721">Additional fiscal equalization offset payment of $30.5 million</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2005-06-29" lims:fid="367722" lims:id="367722"><Label>(1)</Label><Text>For the 2004-2005 fiscal year, the Minister shall make an additional fiscal equalization offset payment to the Province in the amount of $30.5 million.</Text></Subsection><Subsection lims:inforce-start-date="2005-06-29" lims:fid="367723" lims:id="367723"><MarginalNote lims:inforce-start-date="2005-06-29" lims:fid="367724" lims:id="367724">Additional fiscal equalization offset payment of $26.6 million</MarginalNote><Label>(2)</Label><Text>For the 2005-2006 fiscal year, the Minister shall make an additional fiscal equalization offset payment to the Province in the amount of $26.6 million.</Text></Subsection></Section><Section lims:inforce-start-date="2005-06-29" lims:lastAmendedDate="2005-06-29" lims:fid="367725" lims:id="367725"><MarginalNote lims:inforce-start-date="2005-06-29" lims:fid="367726" lims:id="367726">Additional fiscal equalization offset payments for the 2006-2012 period</MarginalNote><Label>7</Label><Text>For each fiscal year between April 1, 2006 and March 31, 2012, the Minister shall make an additional fiscal equalization offset payment to the Province calculated in accordance with section <XRefInternal>8</XRefInternal>.</Text></Section><Section lims:inforce-start-date="2015-06-19" lims:lastAmendedDate="2015-06-19" lims:fid="367727" lims:id="367727"><MarginalNote lims:inforce-start-date="2015-06-19" lims:fid="367728" lims:id="367728">Calculation of payments</MarginalNote><Label>8</Label><Text>The additional fiscal equalization offset payment that shall be made to the Province for a fiscal year corresponds to the amount determined by the Minister in accordance with the formula</Text><FormulaGroup lims:inforce-start-date="2015-06-19" lims:fid="367729" lims:id="367729"><Formula lims:inforce-start-date="2015-06-19" lims:fid="367730" lims:id="367730"><FormulaText>A – B</FormulaText></Formula><FormulaConnector>where</FormulaConnector><FormulaDefinition lims:inforce-start-date="2015-06-19" lims:fid="367731" lims:id="367731"><FormulaTerm>A</FormulaTerm><Text>is the fiscal equalization payment that may be made to the Province for the fiscal year under the equalization formula in effect at that time, calculated as if the Province did not have any offshore revenue or petroleum production; and</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2015-06-19" lims:fid="367732" lims:id="367732"><FormulaTerm>B</FormulaTerm><Text>is the fiscal equalization payment that may be made to the Province for that fiscal year under the equalization formula in effect at that time.</Text></FormulaDefinition></FormulaGroup><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-06-19" lims:fid="367734" lims:id="367734">2005, c. 30, s. 85 “8”; 2015, c. 4, s. 111</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2005-06-29" lims:lastAmendedDate="2005-06-29" lims:fid="367735" lims:id="367735"><MarginalNote lims:inforce-start-date="2005-06-29" lims:fid="367736" lims:id="367736">Restriction</MarginalNote><Label>9</Label><Text>Despite any other provision of this Act, no payment shall be made under sections <XRefInternal>6</XRefInternal> to <XRefInternal>8</XRefInternal> except to the extent that the aggregate of the payments determined under those sections for the fiscal year and the preceding applicable fiscal years exceeds $830 million.</Text></Section><Section lims:inforce-start-date="2005-06-29" lims:lastAmendedDate="2005-06-29" lims:fid="367737" lims:id="367737"><MarginalNote lims:inforce-start-date="2005-06-29" lims:fid="367738" lims:id="367738">Restriction</MarginalNote><Label>10</Label><Text>For any given fiscal year between April 1, 2006 and March 31, 2012, the Province will not receive the additional fiscal equalization offset payment provided for in section <XRefInternal>7</XRefInternal> if it does not receive a fiscal equalization payment for that fiscal year.</Text></Section><Section lims:inforce-start-date="2015-06-19" lims:lastAmendedDate="2015-06-19" lims:fid="367739" lims:id="367739"><Label>11</Label><Text><Repealed>[Repealed, 2015, c. 4, s. 112]</Repealed></Text></Section><Section lims:inforce-start-date="2005-06-29" lims:lastAmendedDate="2021-06-29" lims:fid="367740" lims:id="367740"><MarginalNote lims:inforce-start-date="2005-06-29" lims:fid="367741" lims:id="367741">Additional fiscal equalization offset payments for the 2012-2020 period</MarginalNote><Label>12</Label><Subsection lims:inforce-start-date="2005-06-29" lims:fid="367742" lims:id="367742"><Label>(1)</Label><Text>For any fiscal year between April 1, 2012 and March 31, 2020, the Minister shall make additional fiscal equalization offset payments to the Province, determined in accordance with the formula set out in section <XRefInternal>8</XRefInternal> if</Text><Paragraph lims:inforce-start-date="2005-06-29" lims:fid="367743" lims:id="367743"><Label>(a)</Label><Text>the Province qualified for a fiscal equalization payment in the 2010-2011 or 2011-2012 fiscal year;</Text></Paragraph><Paragraph lims:inforce-start-date="2005-06-29" lims:fid="367744" lims:id="367744"><Label>(b)</Label><Text>the Province’s per capita net debt as of March 31, 2012 was not lower than that of at least four other provinces; and</Text></Paragraph><Paragraph lims:inforce-start-date="2005-06-29" lims:fid="367745" lims:id="367745"><Label>(c)</Label><Text>the Province receives a fiscal equalization payment for that fiscal year.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2005-06-29" lims:fid="367746" lims:id="367746"><MarginalNote lims:inforce-start-date="2005-06-29" lims:fid="367747" lims:id="367747">Determination of per capita net debt</MarginalNote><Label>(2)</Label><Text>For the purpose of paragraph (1)(b), “per capita net debt” for a province as of March 31, 2012 means the amount determined by the Minister in accordance with the regulations.</Text></Subsection><Subsection lims:inforce-start-date="2021-06-29" lims:enacted-date="2021-06-29" lims:fid="1311747" lims:id="1311747"><MarginalNote lims:inforce-start-date="2021-06-29" lims:enacted-date="2021-06-29" lims:fid="1311748" lims:id="1311748">Additional fiscal equalization offset payment for 2020–2021</MarginalNote><Label>(3)</Label><Text>For the 2020-2021 fiscal year, the Minister shall make an additional fiscal equalization offset payment to the Province in the amount of $85,626,000.</Text></Subsection><Subsection lims:inforce-start-date="2021-06-29" lims:enacted-date="2021-06-29" lims:fid="1311749" lims:id="1311749"><MarginalNote lims:inforce-start-date="2021-06-29" lims:enacted-date="2021-06-29" lims:fid="1311750" lims:id="1311750">Extension of Canada–Nova Scotia Arrangement for 2021–2023</MarginalNote><Label>(4)</Label><Text>For any fiscal year between April 1, 2021 and March 31, 2023, the Minister shall make additional fiscal equalization offset payments to the Province, determined in accordance with the formula set out in section 8, if the Province receives a fiscal equalization payment for that fiscal year.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2021-06-29" lims:enacted-date="2021-06-29" lims:fid="1311754" lims:id="1311754" lims:enactId="1307398" type="original">2005, c. 30, s. 85 201</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2005-06-29" lims:lastAmendedDate="2005-06-29" lims:fid="367748" lims:id="367748"><MarginalNote lims:inforce-start-date="2005-06-29" lims:fid="367749" lims:id="367749">Restriction</MarginalNote><Label>13</Label><Text>For greater certainty, if the Province does not meet the conditions set out in paragraphs <XRefInternal>12</XRefInternal>(1)(a) and (b), it will not receive the additional fiscal equalization offset payment provided for in section 12 for any of the fiscal years between April 1, 2012 and March 31, 2020.</Text></Section><Section lims:inforce-start-date="2005-06-29" lims:lastAmendedDate="2005-06-29" lims:fid="367750" lims:id="367750"><MarginalNote lims:inforce-start-date="2005-06-29" lims:fid="367751" lims:id="367751">Transitional payments for the 2012-2020 period</MarginalNote><Label>14</Label><Subsection lims:inforce-start-date="2005-06-29" lims:fid="367752" lims:id="367752"><Label>(1)</Label><Text>If for any fiscal year between April 1, 2012 and March 31, 2020 the Province does not receive an additional fiscal equalization offset payment but it received an additional fiscal equalization offset payment for the previous fiscal year, the Minister shall, for that fiscal year, pay to the Province a transitional payment equal to two thirds of the additional fiscal equalization offset payment it received for the previous fiscal year.</Text></Subsection><Subsection lims:inforce-start-date="2005-06-29" lims:fid="367753" lims:id="367753"><MarginalNote lims:inforce-start-date="2005-06-29" lims:fid="367754" lims:id="367754">Transitional payments for the 2012-2020 period</MarginalNote><Label>(2)</Label><Text>If for any fiscal year between April 1, 2012 and March 31, 2020 the Province does not receive an additional fiscal equalization offset payment and did not receive an additional fiscal equalization offset payment for the previous fiscal year, but received an additional fiscal equalization offset payment for the fiscal year two years before that fiscal year, the Minister shall, for that fiscal year, pay to the Province a transitional payment equal to one third of the additional fiscal equalization offset payment it received for the fiscal year two years before that fiscal year.</Text></Subsection></Section><Section lims:inforce-start-date="2005-06-29" lims:lastAmendedDate="2005-06-29" lims:fid="367755" lims:id="367755"><MarginalNote lims:inforce-start-date="2005-06-29" lims:fid="367756" lims:id="367756">Review of the Canada–Nova Scotia Arrangement</MarginalNote><Label>15</Label><Text>On or before March 31, 2019, the Minister, on behalf of the Government of Canada, and the minister designated by the Province for the purpose will review the Canada–Nova Scotia Arrangement in accordance with clause 8 of that Arrangement.</Text></Section><Section lims:inforce-start-date="2005-06-29" lims:lastAmendedDate="2005-06-29" lims:fid="367757" lims:id="367757"><MarginalNote lims:inforce-start-date="2005-06-29" lims:fid="367758" lims:id="367758">Discussions</MarginalNote><Label>16</Label><Text>The Government of Canada shall enter into discussions with the Province if requested to do so by the Province under the terms of clause 9 of the Canada–Nova Scotia Arrangement.</Text></Section><Section lims:inforce-start-date="2005-06-29" lims:lastAmendedDate="2005-06-29" lims:fid="367759" lims:id="367759"><MarginalNote lims:inforce-start-date="2005-06-29" lims:fid="367760" lims:id="367760">Determination</MarginalNote><Label>17</Label><Text>A determination, for any fiscal year, of the additional fiscal equalization offset payment for the Province and for any other calculation that is necessary for the purposes of this Part shall be made by the Minister at the same time as the final computation of the amount, if any, of the fiscal equalization payment that is payable to the Province is made for that fiscal year under Part I of the <XRefExternal reference-type="act" link="F-7.8">Federal-Provincial Fiscal lims:inforce-start-date="2015-06-19" lims:fid="367766" lims:id="367766"><Text><DefinedTermEn>fiscal equalization payment</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2015-06-19" lims:fid="367767" lims:id="367767"><Label>(a)</Label><Text>for the purposes of section 22, the fiscal equalization payment that would be received by the Province for a fiscal year if the amount of that payment were determined in accord- ance with section 3.2 of the <XRefExternal reference-type="act" link="F-7.8">Federal-Provincial Fiscal Arrangements Act</XRefExternal>, without regard to section 3.4 of that Act; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-19" lims:fid="367768" lims:id="367768"><Label>(b)</Label><Text>for the purposes of sections 24 to 26, the fiscal equalization payment that would be received by the Province for a fiscal year under Part I of the <XRefExternal reference-type="act" link="F-7.8">Federal-Provincial Fiscal Arrangements Act</XRefExternal> if the Province’s total per capita fiscal capacity were the amount determined by the formula</Text><FormulaGroup lims:inforce-start-date="2015-06-19" lims:fid="367769" lims:id="367769"><Formula lims:inforce-start-date="2015-06-19" lims:fid="367770" lims:id="367770"><FormulaText>A + B + (C / F)</FormulaText></Formula><FormulaConnector>where</FormulaConnector><FormulaDefinition lims:inforce-start-date="2015-06-19" lims:fid="367771" lims:id="367771"><FormulaTerm>A,</FormulaTerm><Text>B, C and F have the same meaning as in the definition <DefinedTermEn>total per capita fiscal capacity</DefinedTermEn> in subsection 3.5(1) of that Act. (<DefinedTermFr>paiement de péréquation</DefinedTermFr>)</Text></FormulaDefinition></FormulaGroup></Paragraph></Definition><Definition lims:inforce-start-date="2015-06-19" lims:fid="367772" lims:id="367772"><Text><DefinedTermEn>offshore revenue</DefinedTermEn>, in respect of any fiscal year, means the aggregate of the following amounts paid to the Province for that fiscal year: </Text><Paragraph lims:inforce-start-date="2025-06-02" lims:enacted-date="2024-10-03" lims:fid="367773" lims:id="1529232"><Label>(a)</Label><Text>amounts paid under paragraph 214(2)(b) of the <XRefExternal reference-type="act" link="C-7.5">Canada–Newfoundland and Labrador Atlantic Accord Implementation and Offshore Renewable Energy Management Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-19" lims:fid="367774" lims:id="367774"><Label>(b)</Label><Text>amounts paid with respect to the portion of tax under subsection 165(2) and sections 218.1, 220.05, 220.06 and 220.08 of the <XRefExternal reference-type="act" link="E-15">Excise Tax Act</XRefExternal> that is attributable to offshore activity in the Newfoundland offshore area, within the meaning of subsection 123(1) of that Act; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-19" lims:fid="367775" lims:id="367775"><Label>(c)</Label><Text>the royalties paid under the Hibernia Development Project Royalty Agreement signed on September 1, 1990, as amended from time to time. (<DefinedTermFr>recettes extracôtières</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2025-06-02" lims:enacted-date="2024-10-03" lims:fid="367776" lims:id="1529233"><Text><DefinedTermEn>petroleum</DefinedTermEn> has the same meaning as in section 2 of the <XRefExternal reference-type="act" link="C-7.5">Canada–Newfoundland and Labrador Atlantic Accord Implementation and Offshore Renewable Energy Management Act</XRefExternal>. (<DefinedTermFr>hydro­carbures</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-06-19" lims:fid="367777" lims:id="367777"><Text><DefinedTermEn>Province</DefinedTermEn> means the Province of Newfoundland and Labrador. (<DefinitionEnOnly>Version anglaise million</MarginalNote><Label>20</Label><Subsection lims:inforce-start-date="2005-06-29" lims:fid="367784" lims:id="367784"><Label>(1)</Label><Text>For the 2004-2005 fiscal year, the Minister shall make an additional fiscal equalization offset payment to the Province in the amount of $133.6 million.</Text></Subsection><Subsection lims:inforce-start-date="2005-06-29" lims:fid="367785" lims:id="367785"><MarginalNote lims:inforce-start-date="2005-06-29" lims:fid="367786" lims:id="367786">Additional fiscal equalization offset payment of $188.7 million</MarginalNote><Label>(2)</Label><Text>For the 2005-2006 fiscal year, the Minister shall make an additional fiscal equalization offset payment to the Province in the amount of $188.7 between April 1, 2006 and March 31, 2012, the Minister shall make an additional fiscal equalization offset payment to the Province calculated in accordance with section 22.</Text></Section><Section lims:id="367790">Calculation of payments</MarginalNote><Label>22</Label><Text>The additional fiscal equalization offset payment that shall be made to the Province for a fiscal year corresponds to the amount determined by the Minister in accordance with the formula</Text><FormulaGroup lims:inforce-start-date="2015-06-19" lims:fid="367791" lims:id="367791"><Formula lims:inforce-start-date="2015-06-19" lims:fid="367792" lims:id="367792"><FormulaText>A – B</FormulaText></Formula><FormulaConnector>where</FormulaConnector><FormulaDefinition lims:inforce-start-date="2015-06-19" lims:fid="367793" lims:id="367793"><FormulaTerm>A</FormulaTerm><Text>is the fiscal equalization payment that may be made to the Province for the fiscal year under the equalization formula in effect at that time, calculated as if the Province did not have any offshore revenue or petroleum production; and</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2015-06-19" lims:fid="367794" lims:id="367794"><FormulaTerm>B</FormulaTerm><Text>is the fiscal equalization payment to the Province for that fiscal year under the equalization formula in effect at that time.</Text></FormulaDefinition></FormulaGroup><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-06-19" lims:fid="367796" lims:id="367796">2005, c. 30, s. 85 “22”; 2015, c. 4, s. 114</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2005-06-29" lims:lastAmendedDate="2005-06-29" lims:fid="367797" lims:id="367797"><MarginalNote lims:inforce-start-date="2005-06-29" lims:fid="367798" lims:id="367798">Restriction</MarginalNote><Label>23</Label><Text>Despite any other provision of this Act, no payment shall be made under sections 20 to 22 by the Minister to the Province except to the extent that the aggregate of the payments determined under those sections for the fiscal year and the preceding applicable fiscal years exceeds $2 billion.</Text></Section><Section lims:inforce-start-date="2005-06-29" lims:lastAmendedDate="2005-06-29" lims:fid="367799" lims:id="367799"><MarginalNote lims:inforce-start-date="2005-06-29" lims:fid="367800" lims:id="367800">Restriction</MarginalNote><Label>24</Label><Text>For any given fiscal year between April 1, 2006 and March 31, 2012, the Province will not receive the additional fiscal equalization offset payment provided for in section 21 if it does not receive a fiscal equalization payment for that fiscal year.</Text></Section><Section lims:inforce-start-date="2015-06-19" lims:lastAmendedDate="2015-06-19" lims:fid="367801" lims:id="367801"><Label>25</Label><Text><Repealed>[Repealed, 2015, c. 4, s. 115]</Repealed></Text></Section><Section lims:inforce-start-date="2005-06-29" lims:lastAmendedDate="2005-06-29" lims:fid="367802" lims:id="367802"><MarginalNote lims:inforce-start-date="2005-06-29" lims:fid="367803" lims:id="367803">Additional fiscal equalization offset payments for the 2012-2020 period</MarginalNote><Label>26</Label><Subsection lims:inforce-start-date="2005-06-29" lims:fid="367804" lims:id="367804"><Label>(1)</Label><Text>For any fiscal year between April 1, 2012 and March 31, 2020, the Minister shall make additional fiscal equalization offset payments to the Province, determined in accordance with the formula set out in section 22, if</Text><Paragraph lims:inforce-start-date="2005-06-29" lims:fid="367805" lims:id="367805"><Label>(a)</Label><Text>the Province qualified for a fiscal equalization payment in either of the 2010-2011 or 2011-2012 fiscal years;</Text></Paragraph><Paragraph lims:inforce-start-date="2005-06-29" lims:fid="367806" lims:id="367806"><Label>(b)</Label><Text>the Province’s per capita debt servicing charges as of March 31, 2012 were not lower than those of at least four other provinces; and</Text></Paragraph><Paragraph lims:inforce-start-date="2005-06-29" lims:fid="367807" lims:id="367807"><Label>(c)</Label><Text>the Province receives a fiscal equalization payment for that fiscal year.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2005-06-29" lims:fid="367808" lims:id="367808"><MarginalNote lims:inforce-start-date="2005-06-29" lims:fid="367809" lims:id="367809">Determination of per capita debt servicing charge</MarginalNote><Label>(2)</Label><Text>For the purpose of paragraph (1)(b), “per capita debt servicing charges” as of March 31, 2012, means the amount determined by the Minister in accordance with the formula</Text><FormulaGroup lims:inforce-start-date="2005-06-29" lims:fid="367810" lims:id="367810"><Formula lims:inforce-start-date="2005-06-29" lims:fid="367811" lims:id="367811"><FormulaText>(A - B - C + D) / E</FormulaText></Formula><FormulaConnector>where</FormulaConnector><FormulaDefinition lims:inforce-start-date="2005-06-29" lims:fid="367812" lims:id="367812"><FormulaTerm>A</FormulaTerm><Text>is the total of a province’s debt servicing charges for the 2011-2012 fiscal year, based on figures published in the fully consolidated audited financial statements presented on a full accrual basis of accounting in the province’s Public Accounts for the 2011-2012 fiscal year, with any necessary adjustments, as required, to include all of the debt charges related to unfunded pension liabilities, post-employment benefits and debt charges of government organizations and entities whose inclusion would be consistent with the accounting principles of full consolidation;</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2005-06-29" lims:fid="367813" lims:id="367813"><FormulaTerm>B</FormulaTerm><Text>is the portion of A, if any, related to borrowings made by a province on behalf of self-supporting government business enterprises that are not dependent on transfers, grants or other direct funding from the province to fund their day-to-day operations or debt repayments;</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2005-06-29" lims:fid="367814" lims:id="367814"><FormulaTerm>C</FormulaTerm><Text>is the portion of A, if any, related to borrowings made by a province on behalf of municipalities that are not in default on their interest payment obligations to the province;</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2005-06-29" lims:fid="367815" lims:id="367815"><FormulaTerm>D</FormulaTerm><Text>is the total of a province’s debt servicing charges for the 2011-2012 fiscal year related to borrowings made by the province on behalf of municipalities that are in default on their interest payment obligations to the province, if these are not already included in A; and</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2005-06-29" lims:fid="367816" lims:id="367816"><FormulaTerm>E</FormulaTerm><Text>is the total population of a province on July 1, 2011 based on the latest Statistics Canada official estimates available as soon as all provinces have released their Public Accounts for the 2011-2012 fiscal year.</Text></FormulaDefinition></FormulaGroup></Subsection></Section><Section lims:inforce-start-date="2005-06-29" lims:lastAmendedDate="2005-06-29" lims:fid="367817" lims:id="367817"><MarginalNote lims:inforce-start-date="2005-06-29" lims:fid="367818" lims:id="367818">Restriction</MarginalNote><Label>27</Label><Text>For greater certainty, if the Province does not meet the conditions set out in paragraphs 26(1)(a) and (b), it will not receive the additional fiscal equalization offset payment provided for in section 26 for any of the fiscal years between April 1, 2012 and March 31, 2020.</Text></Section><Section lims:inforce-start-date="2005-06-29" lims:lastAmendedDate="2005-06-29" lims:fid="367819" lims:id="367819"><MarginalNote lims:inforce-start-date="2005-06-29" lims:fid="367820" lims:id="367820">Transitional payments for the 2012-2020 period</MarginalNote><Label>28</Label><Subsection lims:inforce-start-date="2005-06-29" lims:fid="367821" lims:id="367821"><Label>(1)</Label><Text>If for any fiscal year between April 1, 2012 and March 31, 2020 the Province does not receive an additional fiscal equalization offset payment but it received an additional fiscal equalization offset payment for the previous fiscal year, the Minister shall, for that fiscal year, pay to the Province a transitional payment equal to two thirds of the additional fiscal equalization offset payment it received for the previous fiscal year.</Text></Subsection><Subsection lims:inforce-start-date="2005-06-29" lims:fid="367822" lims:id="367822"><MarginalNote lims:inforce-start-date="2005-06-29" lims:fid="367823" lims:id="367823">Transitional payments for 2012-2020 period</MarginalNote><Label>(2)</Label><Text>If for any fiscal year between April 1, 2012 and March 31, 2020 the Province does not receive an additional fiscal equalization offset payment and did not receive an additional fiscal equalization offset payment for the previous fiscal year, but received an additional fiscal equalization offset payment for the fiscal year two years before that fiscal year, the Minister shall, for that fiscal year, pay to the Province a transitional payment equal to one third of the additional fiscal equalization offset payment it received for the fiscal year two years before that fiscal year.</Text></Subsection></Section><Section lims:inforce-start-date="2005-06-29" lims:lastAmendedDate="2005-06-29" lims:fid="367824" lims:id="367824"><MarginalNote lims:inforce-start-date="2005-06-29" lims:fid="367825" lims:id="367825">Review of the Canada–Newfoundland and Labrador Arrangement</MarginalNote><Label>29</Label><Text>On or before March 31, 2019, the Minister, on behalf of the Government of Canada, and the minister designated by the Province for the purpose will review the Canada–Newfoundland and Labrador Arrangement, in accordance with clause 8 of that Arrangement.</Text></Section><Section lims:inforce-start-date="2005-06-29" lims:lastAmendedDate="2005-06-29" lims:fid="367826" lims:id="367826"><MarginalNote lims:inforce-start-date="2005-06-29" lims:fid="367827" lims:id="367827">Discussions</MarginalNote><Label>30</Label><Text>The Government of Canada shall enter into discussions with the Province if requested to do so by the Province under the terms of clause 9 of the Canada–Newfoundland and Labrador Arrangement.</Text></Section><Section lims:inforce-start-date="2005-06-29" lims:lastAmendedDate="2005-06-29" lims:fid="367828" lims:id="367828"><MarginalNote lims:inforce-start-date="2005-06-29" lims:fid="367829" lims:id="367829">Determination</MarginalNote><Label>31</Label><Text>A determination, for any fiscal year, of the additional fiscal equalization offset payment for the Province and for any other calculation that is necessary to be made for the purposes of this Part shall be made by the Minister at the same time as the final computation of the amount, if any, of the fiscal equalization payment that is payable to the Province is made for that fiscal year under Part I of the <XRefExternal reference-type="act" link="F-7.8">Federal-Provincial Fiscal Arrangements Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2005-06-29" lims:fid="367830" lims:id="367830" level="1"><Label>PART 3</Label><TitleText>General Provisions</TitleText></Heading><Section lims:inforce-start-date="2005-06-29" lims:lastAmendedDate="2005-06-29" lims:fid="367831" lims:id="367831"><MarginalNote lims:inforce-start-date="2005-06-29" lims:fid="367832" lims:id="367832">Appropriation</MarginalNote><Label>32</Label><Text>The amounts authorized to be paid under this Act shall be paid out of the Consolidated Revenue Fund by the Minister at the time and in the manner, subject to section 33, that the Minister considers appropriate.</Text></Section><Section lims:inforce-start-date="2005-06-29" lims:lastAmendedDate="2005-06-29" lims:fid="367833" lims:id="367833"><MarginalNote lims:inforce-start-date="2005-06-29" lims:fid="367834" lims:id="367834">Regulations</MarginalNote><Label>33</Label><Subsection lims:inforce-start-date="2005-06-29" lims:fid="367835" lims:id="367835"><Label>(1)</Label><Text>The Governor in Council may make regulations, on the recommendation of the Minister,</Text><Paragraph lims:inforce-start-date="2005-06-29" lims:fid="367836" lims:id="367836"><Label>(a)</Label><Text>prescribing the time and manner of making any payments under this Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2005-06-29" lims:fid="367837" lims:id="367837"><Label>(b)</Label><Text>respecting the determination of the amount referred to in subsection 12(2);</Text></Paragraph><Paragraph lims:inforce-start-date="2005-06-29" lims:fid="367838" lims:id="367838"><Label>(c)</Label><Text>respecting the determination of any matter that under this Act is to be determined by the Minister; and</Text></Paragraph><Paragraph lims:inforce-start-date="2005-06-29" lims:fid="367839" lims:id="367839"><Label>(d)</Label><Text>prescribing anything that is required or authorized to be prescribed by this Act.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2005-06-29" lims:fid="367840" lims:id="367840"><MarginalNote lims:inforce-start-date="2005-06-29" lims:fid="367841" lims:id="367841">Approval of the minister designated by the Province</MarginalNote><Label>(2)</Label><Text>The Minister may recommend the making of a regulation under paragraph (1)(b) only after receipt by the Minister of the approval of the proposed
