or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366842" lims:id="366842"><Label>(b)</Label><Text>located on public lands that are under the administration of a federal minister. (<DefinedTermFr>entreprise fédérale en cause</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2014-04-01" lims:fid="366843" lims:id="366843"><Text><DefinedTermEn>former Act</DefinedTermEn> means the <XRefExternal reference-type="act" link="N-27.05">Northwest Territories Act</XRefExternal>, chapter N-27 of the Revised Statutes of Canada, 1985. (<DefinedTermFr>ancienne loi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-04-01" lims:fid="366844" lims:id="366844"><Text><DefinedTermEn>gas</DefinedTermEn> means natural gas — including coal-bed methane — and all substances other than oil that are produced in association with natural gas. (<DefinedTermFr>gaz</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-04-01" lims:fid="366845" lims:id="366845"><Text><DefinedTermEn>Gwich’in Agreement</DefinedTermEn> means the Agreement as defined in section 2 of the <XRefExternal reference-type="act" link="G-11.8">Gwich’in Land Claim Settlement Act</XRefExternal>. (<DefinedTermFr>accord gwichin</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-04-01" lims:fid="366846" lims:id="366846"><Text><DefinedTermEn>Inuvialuit Final Agreement</DefinedTermEn> means the Agreement as defined in section 2 of the <XRefExternal reference-type="act" link="W-6.7">Western Arctic (Inuvialuit) Claims Settlement Act</XRefExternal>. (<DefinedTermFr>Convention définitive des Inuvialuits</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-04-01" lims:fid="366847" lims:id="366847"><Text><DefinedTermEn>line of delimitation</DefinedTermEn> means the Line of Delimitation that is described in Schedule 18 to the Agreement. (<DefinedTermFr>ligne de démarcation</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-04-01" lims:fid="366848" lims:id="366848"><Text><DefinedTermEn>minerals</DefinedTermEn> means precious or base metals or other non-living naturally occurring substances — including coal, but not including oil, gas or water — that are, or were before their production, part of the land, whether solid, liquid or gaseous. (<DefinedTermFr>ressources minérales</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="366849" lims:id="1192040"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Northern Affairs. (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-04-01" lims:fid="366850" lims:id="366850"><Text><DefinedTermEn>Northwest Territories</DefinedTermEn> means that part of Canada that is north of the 60th parallel of north latitude, west of the boundary described in Schedule I to the <XRefExternal reference-type="act" link="N-28.6">Nunavut Act</XRefExternal> and not within Yukon. (<DefinedTermFr>Territoires du Nord-Ouest</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-04-01" lims:fid="366851" lims:id="366851"><Text><DefinedTermEn>oil</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366852" lims:id="366852"><Label>(a)</Label><Text>crude petroleum — regardless of gravity — that is produced at a well-head in liquid form; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366853" lims:id="366853"><Label>(b)</Label><Text>any other hydrocarbons — except coal and gas — including hydrocarbons that may be extracted or recovered from surface or subsurface deposits, including deposits of oil sand, bitumen, bituminous sand or oil shale and other types of deposits. (<DefinedTermFr>pétrole</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2014-04-01" lims:fid="366854" lims:id="366854"><Text><DefinedTermEn>onshore</DefinedTermEn> means that part of Canada that is north of the 60th parallel of north latitude, west of the boundary described in Schedule I to the <XRefExternal reference-type="act" link="N-28.6">Nunavut Act</XRefExternal> and not within Yukon that consists of the following lands:</Text><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366855" lims:id="366855"><Label>(a)</Label><Text>lands, including lands under water, that lie landward of the low-water line — or in respect of Inuvialuit lands as defined in section 2 of the Inuvialuit Final Agreement, landward of the mean or ordinary high-water mark — of the sea coast of the mainland or of the sea coast of any naturally occurring permanent island;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366856" lims:id="366856"><Label>(b)</Label><Text>lands under water that are within small enclosed bays along the sea coast of the mainland or the sea coast of any naturally occurring permanent island; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366857" lims:id="366857"><Label>(c)</Label><Text>lands, including lands under water, that lie landward of the line of delimitation and seaward of the low-water line — or in respect of lands that are contiguous with the sea coast of Inuvialuit lands as defined in section 2 of the Inuvialuit Final Agreement, seaward of the mean or ordinary high-water mark — of the sea coast of the mainland.</Text></Paragraph><ContinuedDefinition lims:inforce-start-date="2014-04-01" lims:fid="366858" lims:id="366858"><Text>It does not include lands that lie seaward of the line of delimitation, other than those lands — including lands under water — that lie landward of the low-water line of the sea coast of those naturally occurring permanent islands and those lands under water that are within small enclosed bays along the sea coast of those islands. (<DefinedTermFr>région intracôtière</DefinedTermFr>)</Text></ContinuedDefinition></Definition><Definition lims:inforce-start-date="2014-04-01" lims:fid="366859" lims:id="366859"><Text><DefinedTermEn>public lands</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366860" lims:id="366860"><Label>(a)</Label><Text>lands — including minerals, oil, gas, timber or wood and buildings, structures, improvements or other fixtures — that are situated in the onshore and that belong to Her Majesty in right of Canada; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366861" lims:id="366861"><Label>(b)</Label><Text>interests — in lands that are situated in the onshore — that belong to Her Majesty in right of Canada. (<DefinedTermFr>terres domaniales</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2014-04-01" lims:fid="366862" lims:id="366862"><Text><DefinedTermEn>Sahtu Agreement</DefinedTermEn> means the Agreement as defined in section 2 of the <XRefExternal reference-type="act" link="S-1.5">Sahtu Dene and Metis Land Claim Settlement Act</XRefExternal>. (<DefinedTermFr>accord du Sahtu</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-04-01" lims:fid="366863" lims:id="366863"><Text><DefinedTermEn>self-government agreement</DefinedTermEn> means an agreement between Her Majesty in right of Canada and an Aboriginal people of the Northwest Territories that is implemented by an Act of Parliament and that recognizes</Text><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366864" lims:id="366864"><Label>(a)</Label><Text>the legal status and capacity of a governing body to represent that Aboriginal people; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366865" lims:id="366865"><Label>(b)</Label><Text>the authority of that governing body to enact laws. (<DefinedTermFr>accord sur l’autonomie gouvernementale</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2014-04-01" lims:fid="366866" lims:id="366866"><Text><DefinedTermEn>settlement agreement</DefinedTermEn> means an agreement that is listed in Schedule 1 to the Agreement. (<DefinedTermFr>entente de règlement</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-04-01" lims:fid="366867" lims:id="366867"><Text><DefinedTermEn>settlement lands</DefinedTermEn> means lands in the Northwest Territories whose title is vested in an Aboriginal organization under a settlement agreement. (<DefinedTermFr>terres visées par un règlement</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-04-01" lims:fid="366868" lims:id="366868"><Text><DefinedTermEn>small enclosed bay</DefinedTermEn> means any coastal indentation that meets the following conditions:</Text><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366869" lims:id="366869"><Label>(a)</Label><Text>the distance of a straight line across the entrance of the indentation at the low-water line measures four kilometres or less; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366870" lims:id="366870"><Label>(b)</Label><Text>the area of the indentation, including any islands or parts of islands lying within the indentation, is greater than that of a semicircle whose diameter is the distance of the straight line referred to in paragraph (a). (<DefinedTermFr>petite baie fermée</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2014-04-01" lims:fid="366871" lims:id="366871"><Text><DefinedTermEn>Tlicho Agreement</DefinedTermEn> means the Agreement as defined in section 2 of the <XRefExternal reference-type="act" link="T-11.3">Tlicho Land Claims and Self-Government Act</XRefExternal>. (<DefinedTermFr>accord tlicho</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-04-01" lims:fid="366872" lims:id="366872"><Text><DefinedTermEn>waters</DefinedTermEn> means any inland waters — whether in a liquid or frozen state — that are on or below the surface of lands that are situated in the onshore. (<DefinedTermFr>eaux</DefinedTermFr>)</Text></Definition><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1192042" lims:id="1192042" lims:enactId="1157056" type="original">2014, c. 2, s. 2 “2”</HistoricalNoteSubItem><HistoricalNoteSubItem lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1192043" lims:id="1192043" lims:enactId="1157056">2019, c. 29, s. 374</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2014-04-01" lims:lastAmendedDate="2014-04-01" lims:fid="366873" lims:id="366873"><MarginalNote lims:inforce-start-date="2014-04-01" lims:fid="366874" lims:id="366874">Consultation</MarginalNote><Label>3</Label><Text>Wherever in this Act a reference is made, in relation to any matter, to a duty to consult, that duty must be exercised</Text><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366875" lims:id="366875"><Label>(a)</Label><Text>by providing the person to be consulted with the following:</Text><Subparagraph lims:inforce-start-date="2014-04-01" lims:fid="366876" lims:id="366876"><Label>(i)</Label><Text>notice of the matter in sufficient form and detail to allow the person to prepare their views on the matter,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-04-01" lims:fid="366877" lims:id="366877"><Label>(ii)</Label><Text>a reasonable period for the person to prepare those views, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-04-01" lims:fid="366878" lims:id="366878"><Label>(iii)</Label><Text>an opportunity to present those views to the person having that duty; 2017, c. 33, s. 258</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2014-04-01" lims:lastAmendedDate="2014-04-01" lims:fid="366897" lims:id="366897"><MarginalNote lims:inforce-start-date="2014-04-01" lims:fid="366898" lims:id="366898">Oaths</MarginalNote><Label>6</Label><Text>Before assuming office, the Commissioner and the Deputy Commissioner must take and subscribe the oath of office and the oath of allegiance prescribed by the Governor in Council.</Text></Section><Section lims:inforce-start-date="2014-04-01" lims:lastAmendedDate="2014-04-01" lims:fid="366899" lims:id="366899"><MarginalNote lims:inforce-start-date="2014-04-01" lims:fid="366900" lims:id="366900">Salaries</MarginalNote><Label>7</Label><Text>The salary of the Commissioner and of the Deputy Commissioner are to be fixed by the Governor in Council and paid out of the Consolidated Revenue Fund of Canada.</Text></Section><Section lims:inforce-start-date="2014-04-01" lims:lastAmendedDate="2014-04-01" lims:fid="366901" lims:id="366901"><MarginalNote lims:inforce-start-date="2014-04-01" lims:fid="366902" lims:id="366902">Executive Council</MarginalNote><Label>8</Label><Text>An Executive Council of the Northwest Territories is established, the members of which are to be appointed by the Commissioner.</Text></Section><Section lims:inforce-start-date="2014-04-01" lims:lastAmendedDate="2014-04-01" lims:fid="366903" lims:id="366903"><MarginalNote lims:inforce-start-date="2014-04-01" lims:fid="366904" lims:id="366904">Seat of government</MarginalNote><Label>9</Label><Text>The seat of the Government of the Northwest Territories is at Yellowknife or at another place in the Northwest Territories that is designated by the Legislature.</Text></Section><Heading lims:inforce-start-date="2014-04-01" lims:fid="366905" lims:id="366905" level="1"><TitleText>Legislative Power</TitleText></Heading><Heading lims:inforce-start-date="2014-04-01" lims:fid="366906" lims:id="366906" level="2"><TitleText>Legislative Assembly of the Northwest Territories</TitleText></Heading><Section lims:inforce-start-date="2014-04-01" lims:lastAmendedDate="2014-04-01" lims:fid="366907" lims:id="366907"><MarginalNote lims:inforce-start-date="2014-04-01" lims:fid="366908" lims:id="366908">Continuance</MarginalNote><Label>10</Label><Text>The Council of the Northwest Territories established under the former Act is continued as the Legislative Assembly of the Northwest Territories. Each member of the Legislative Assembly is elected to represent an electoral district in the Northwest Territories.</Text></Section><Section lims:inforce-start-date="2014-04-01" lims:lastAmendedDate="2014-04-01" lims:fid="366909" lims:id="366909"><MarginalNote lims:inforce-start-date="2014-04-01" lims:fid="366910" lims:id="366910">Duration</MarginalNote><Label>11</Label><Subsection lims:inforce-start-date="2014-04-01" lims:fid="366911" lims:id="366911"><Label>(1)</Label><Text>No Legislative Assembly is to continue for longer than five years after the day on which the writs are returned for a general election, but the Commissioner may dissolve it before then.</Text></Subsection><Subsection lims:inforce-start-date="2014-04-01" lims:fid="366912" lims:id="366912"><MarginalNote lims:inforce-start-date="2014-04-01" lims:fid="366913" lims:id="366913">Writs</MarginalNote><Label>(2)</Label><Text>Writs for the election of members of the Legislative Assembly are to be issued on the Commissioner’s disqualification of persons from sitting or voting as members of the Legislative Assembly and the privileges, indemnities and expenses of those members;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366936" lims:id="366936"><Label>(c)</Label><Text>the Executive Council;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" maintenance and organization of territorial courts — of both civil and criminal jurisdiction — and procedure in civil matters in those courts;</Text></Paragraph><Paragraph administration and control of the Commissioner — including the disposition under subsection 52(3) of those rights, the deposit of waste in those waters and what constitutes waste;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366948" lims:id="366948"><Label>(o)</Label><Text>education, but any law respecting education must provide that</Text><Subparagraph lims:inforce-start-date="2014-04-01" lims:fid="366949" lims:id="366949"><Label>(i)</Label><Text>a majority of the ratepayers of any part of the Northwest Territories may establish any school in that part that they think fit and make the necessary assessment and collection of rates for it, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-04-01" lims:fid="366950" lims:id="366950"><Label>(ii)</Label><Text>the minority of the ratepayers of that part of the Northwest Territories — whether Protestant or Roman Catholic — may establish separate schools in that part and, if they do so, are liable to assessments of only the rates that they impose on themselves in respect of those schools;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366951" lims:id="366951"><Label>(p)</Label><Text>immigration;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366952" lims:id="366952"><Label>(q)</Label><Text>those public lands that are under the administration and control of the Commissioner, including their disposition under subsection 51(1);</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366953" lims:id="366953"><Label>(r)</Label><Text>intoxicants, including what constitutes an intoxicant;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366954" lims:id="366954"><Label>(s)</Label><Text>hospitals and charities;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366955" lims:id="366955"><Label>(t)</Label><Text>agriculture;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366956" lims:id="366956"><Label>(u)</Label><Text>the entering into of intergovernmental agreements by the Commissioner or any other official of the Government of the Northwest Territories;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366957" lims:id="366957"><Label>(v)</Label><Text>the expenditure of money for territorial purposes;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366958" lims:id="366958"><Label>(w)</Label><Text>the adoption and use of an official seal;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366959" lims:id="366959"><Label>(x)</Label><Text>generally, all matters of a merely local or private nature;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366960" lims:id="366960"><Label>(y)</Label><Text>the imposition of fines, penalties, imprisonment or other punishments in respect of a contravention of a provision of a law of the Legislature; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366961" lims:id="366961"><Label>(z)</Label><Text>any other subject that may be designated by order of the Governor in Council.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-04-01" lims:fid="366962" lims:id="366962"><MarginalNote lims:inforce-start-date="2014-04-01" lims:fid="366963" lims:id="366963">Laws — intoxicants</MarginalNote><Label>(2)</Label><Text>The Legislature may make laws relating to the importation of intoxicants into the Northwest Territories from another part of Canada or elsewhere and defining what constitutes an intoxicant for the purposes of those laws.</Text></Subsection></Section><Section lims:inforce-start-date="2014-04-01" lims:lastAmendedDate="2014-04-01" lims:fid="366964" lims:id="366964"><MarginalNote lims:inforce-start-date="2014-04-01" lims:fid="366965" lims:id="366965">Laws — natural resources</MarginalNote><Label>19</Label><Subsection lims:inforce-start-date="2014-04-01" lims:fid="366966" lims:id="366966"><Label>(1)</Label><Text>The Legislature may make laws in relation to the following subjects in respect of the onshore:</Text><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366967" lims:id="366967"><Label>(a)</Label><Text>exploration for non-renewable natural resources;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366968" lims:id="366968"><Label>(b)</Label><Text>the development, conservation and management of non-renewable natural resources and forestry resources, including the rate of primary production from those resources;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366969" lims:id="366969"><Label>(c)</Label><Text>oil and gas pipelines that are situated entirely in the onshore;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366970" lims:id="366970"><Label>(d)</Label><Text>the development, conservation and management of sites and facilities for the production of electrical energy; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366971" lims:id="366971"><Label>(e)</Label><Text>the export, from the onshore to another part of Canada, of the primary production from non-renewable natural resources and forestry resources and of the electrical energy that is produced in the onshore.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-04-01" lims:fid="366972" lims:id="366972"><MarginalNote lims:inforce-start-date="2014-04-01" lims:fid="366973" lims:id="366973">Limitation — no discrimination</MarginalNote><Label>(2)</Label><Text>A law that is made under paragraph (1)(e) is not to authorize or provide for discrimination in prices or in supplies that are exported.</Text></Subsection><Subsection lims:inforce-start-date="2014-04-01" lims:fid="366974" lims:id="366974"><MarginalNote lims:inforce-start-date="2014-04-01" lims:fid="366975" lims:id="366975">Laws — taxation</MarginalNote><Label>(3)</Label><Text>The Legislature may make laws in relation to the raising of money by any mode of taxation in respect of resources referred to in paragraph (1)(b) and the primary production from those resources and in respect of sites and facilities referred to in paragraph (1)(d) and the production of electrical energy from those sites and facilities. The Legislature may make those laws even if the production is exported.</Text></Subsection><Subsection lims:inforce-start-date="2014-04-01" lims:fid="366976" lims:id="366976"><MarginalNote lims:inforce-start-date="2014-04-01" lims:fid="366977" lims:id="366977">Limitation — no differentiation</MarginalNote><Label>(4)</Label><Text>A law that is made under subsection (3) is not to authorize or provide for taxation that differentiates between production that is exported and that which is not.</Text></Subsection><Subsection lims:inforce-start-date="2014-04-01" lims:fid="366978" lims:fid="366980" lims:id="366980"><Label>(a)</Label><Text>production from a non-renewable natural resource if</Text><Subparagraph lims:inforce-start-date="2014-04-01" lims:fid="366981" lims:id="366981"><Label>(i)</Label><Text>it is in the form in which the resource exists on its recovery or severance from its natural state, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-04-01" lims:fid="366982" lims:id="366982"><Label>(ii)</Label><Text>it results from processing or refining the resource and is not</Text><Clause lims:inforce-start-date="2014-04-01" lims:fid="366983" lims:id="366983"><Label>(A)</Label><Text>a manufactured product, or</Text></Clause><Clause lims:inforce-start-date="2014-04-01" lims:fid="366984" lims:id="366984"><Label>(B)</Label><Text>a product that results from refining crude oil, refining upgraded heavy crude oil, refining gases or liquids derived from coal or refining a synthetic equivalent of crude oil; and</Text></Clause></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366985" lims:id="366985"><Label>(b)</Label><Text>production from a forestry resource if the product consists of sawlogs, poles, lumber, wood chips, sawdust or any other primary wood product — or of wood pulp — and is not manufactured from wood.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-04-01" lims:fid="366986" lims:id="366986"><MarginalNote lims:inforce-start-date="2014-04-01" lims:fid="366987" lims:id="366987">No derogation</MarginalNote><Label>(6)</Label><Text>Nothing in subsections (1) to (5) derogates from any powers that the Legislature has under this Act.</Text></Subsection></Section><Section lims:inforce-start-date="2014-04-01" lims:lastAmendedDate="2014-04-01" lims:fid="366988" lims:id="366988"><MarginalNote lims:inforce-start-date="2014-04-01" lims:fid="366989" lims:id="366989">Laws — access to lands and waters</MarginalNote><Label>20</Label><Text>The Legislature may make laws in relation to access to the public lands that are under the administration of a federal minister and to the waters overlying those lands, including the compensation that is to be paid in respect of that access.</Text></Section><Section Tlicho lands</MarginalNote><Label>21</Label><Text>Laws of the Legislature that are made in relation to public highways apply to roads identified in the Tlicho Agreement — as if they were on public lands — if the Tlicho Agreement provides that those laws apply to those roads.</Text></Section><Section lims:inforce-start-date="2014-04-01" lims:lastAmendedDate="2019-08-28" lims:fid="366992" lims:id="366992"><MarginalNote lims:inforce-start-date="2014-04-01" lims:fid="366993" lims:id="366993">Unitization of straddling resources</MarginalNote><Label>22</Label><Subsection lims:inforce-start-date="2014-04-01" lims:fid="366994" lims:id="366994"><Label>(1)</Label><Text>Despite sections 18 and 19, the Legislature must not amend a law of the Legislature without the consent of the Governor in Council if the law as amended would</Text><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366995" lims:id="366995"><Label>(a)</Label><Text>affect the unitization of those straddling resources that are referred to in the Agreement for Coordination and Cooperation in the Management and Administration of Petroleum Resources in the Inuvialuit Settlement Region that was made on June 25, 2013, as amended from time to time; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="366996" lims:id="366996"><Label>(b)</Label><Text>limit how that agreement applies to or is implemented by the Government of the Northwest Territories.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-08-28" lims:enacted-date="2019-06-21" lims:fid="366997" lims:id="1199263"><MarginalNote lims:inforce-start-date="2019-08-28" lims:enacted-date="2019-06-21" lims:fid="1199264" lims:id="1199264">Canadian Energy Regulator</MarginalNote><Label>(2)</Label><Text>Despite sections 18 and 19, during the period of 20 years beginning on the day on which section 1 comes into force, the Legislature must not amend a law of the Legislature without the consent of the Governor in Council if the law as amended would affect the regulatory functions of the Canadian Energy Regulator in that part of the Inuvialuit Settlement Region — as defined in section 2 of the Inuvialuit Final Agreement — that is situated in the onshore.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2019-08-28" lims:id="367001"><Label>(a)</Label><Text>approve the issuance, renewal or amendment of a licence permitting the use of waters or the deposit of waste in waters;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="367002" lims:id="367002"><Label>(b)</Label><Text>consent to a declaration by a water board that an amendment to such a licence — as a result of which the use, flow or quality of waters would be altered — is required on an emergency basis;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="367003" lims:id="367003"><Label>(c)</Label><Text>approve the form of any security posted in respect of such a licence;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="367004" lims:id="367004"><Label>(d)</Label><Text>hold and apply the security;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="367005" lims:id="367005"><Label>(e)</Label><Text>exercise powers that are substantially the same as those set out in section 39 of the <XRefExternal reference-type="act" link="N-27.3">Northwest Territories Waters Act</XRefExternal>, as it read immediately before the coming into force of section 1;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="367006" lims:id="367006"><Label>(f)</Label><Text>issue policy directions to a water board that may issue, renew or amend such a licence; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="367007" lims:id="367007"><Label>(g)</Label><Text>designate inspectors and grant them powers that are substantially the same as those set out in section 37 or 44.02 of the <XRefExternal reference-type="act" link="N-27.3">Northwest Territories Waters Act</XRefExternal>, as they read immediately before the coming into force of section 1.</Text></Paragraph></Section><Section lims:inforce-start-date="2014-04-01" lims:lastAmendedDate="2014-04-01" lims:fid="367008" lims:id="367008"><MarginalNote lims:inforce-start-date="2014-04-01" lims:fid="367009" lims:id="367009">Composition of water board</MarginalNote><Label>24</Label><Text>For every five members who are appointed to a water board that may — under a law of the Legislature — issue, renew or amend a licence permitting the use of waters or the deposit of waste in waters, one must be nominated by a federal minister.</Text></Section><Section lims:inforce-start-date="2014-04-01" lims:lastAmendedDate="2014-04-01" lims:fid="367010" lims:id="367010"><MarginalNote lims:inforce-start-date="2014-04-01" lims:fid="367011" lims:id="367011">Restrictions on powers</MarginalNote><Label>25</Label><Subsection lims:inforce-start-date="2014-04-01" lims:fid="367012" lims:id="367012"><Label>(1)</Label><Text>Nothing in subsection 18(1) or section 19 must be construed as giving the Legislature greater powers than are given to legislatures of provinces under sections 92, 92A and 95 of the <XRefExternal reference-type="act" link="const">Constitution Act, lims:id="367016">Agreement implementation Acts</MarginalNote><Label>26</Label><Text>Despite subsection 25(1), the Legislature may, in exercising its powers under sections 18 and 19 for the purpose of implementing an Aboriginal land claim agreement or a self-government agreement, make laws that are in relation to the matters coming within class 24 of section 91 of the <XRefExternal reference-type="act" link="const">Constitution Act, 1867</XRefExternal>.</Text></Section><Section lims:inforce-start-date="2014-04-01" lims:lastAmendedDate="2014-04-01" lims:fid="367017" lims:id="367084"><Label>(b)</Label><Text>the transactions of the Government of the Northwest Territories that have come to the notice of the Auditor General in the course of the audit are within the outside the Northwest Territories may be enforced at the place at which it is pronounced or made — or elsewhere, either in or outside the Northwest Territories, as the judge may direct — and the proper officers of the Northwest Territories have and may exercise all powers and authority necessary for its enforcement at the place where it is directed to be enforced, even if that place is not in lims:inforce-start-date="2014-04-01" lims:fid="367169" lims:id="367169"><Label>(1)</Label><Text>The Governor in Council may, on the Minister’s recommendation, take from the Commissioner the administration and control of public lands and rights in respect of waters if, subject to subsection (2), the Governor in Council considers it necessary to do so for the purposes of</Text><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="367170" lims:id="367170"><Label>(a)</Label><Text>the national interest, including</Text><Subparagraph lims:inforce-start-date="2014-04-01" lims:fid="367171" lims:id="367171"><Label>(i)</Label><Text>national defence or security,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-04-01" lims:fid="367172" lims:id="367172"><Label>(ii)</Label><Text>establishing — or changing the boundaries of — a national park as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="P-0.4">Parks Canada Agency Act</XRefExternal>, a national historic site as defined in that subsection or another area that is protected under an Act of Parliament, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-04-01" lims:fid="367173" lims:id="367173"><Label>(iii)</Label><Text>the creation of the infrastructure required for initiatives in respect of transportation or energy;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="367174" lims:id="367174"><Label>(b)</Label><Text>the fulfilment of an obligation in respect of an Aboriginal or treaty right that is referred to in section 35 of the <XRefExternal reference-type="act" link="const">Constitution Act, 1982</XRefExternal>; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="367175" lims:id="367175"><Label>(c)</Label><Text>the settlement of an Aboriginal land claim or the implementation of an Aboriginal land claim agreement or other treaty, a settlement agreement or a self-government agreement.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-04-01" lims:fid="367176" lims:id="367176"><MarginalNote lims:inforce-start-date="2014-04-01" lims:fid="367177" lims:id="367177">Consultation</MarginalNote><Label>(2)</Label><Text>The Minister must — before recommending the taking of the administration and control other than for a purpose related to national defence or security — consult the member of the Executive Council who is responsible for those public lands or those rights in respect of waters and any affected Aboriginal party on the boundaries of the lands that, and the location of the waters the rights in respect of which, are subject to the taking.</Text></Subsection></Section><Section lims:inforce-start-date="2014-04-01" lims:lastAmendedDate="2014-04-01" lims:fid="367178" lims:id="367178"><MarginalNote lims:inforce-start-date="2014-04-01" lims:fid="367179" lims:id="367179">Prohibition order — public lands</MarginalNote><Label>56</Label><Text>The Governor in Council may, by order and on the Minister’s recommendation, prohibit the issuance under a law of the Legislature of interests in — or the authorization under a law of the Legislature of the conduct of activities on — the public lands that are specified in the order if the Governor in Council considers that the prohibition is required</Text><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="367180" lims:id="367180"><Label>(a)</Label><Text>before the taking of the administration and control of those lands under paragraph 55(1)(a) or (b); or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="367181" lims:id="367181"><Label>(b)</Label><Text>for the purposes of the settlement of an Aboriginal land claim or the implementation of an Aboriginal land claim agreement or other treaty, a settlement agreement or a self-government lims:inforce-start-date="2014-04-01" lims:fid="367183" lims:id="367183">Prohibition order — waters</MarginalNote><Label>57</Label><Text>The Governor in Council may, by order and on the Minister’s recommendation, prohibit any use of waters that is specified in the order — or the deposit of waste directly or indirectly into those waters — if the Governor in Council considers</Text><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="367184" lims:id="367184"><Label>(a)</Label><Text>that the use or deposit would be incompatible with or would interfere with a particular undertaking that is in the national interest; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="367185" lims:id="367185"><Label>(b)</Label><Text>that the prohibition is required for the purposes of the settlement of an Aboriginal land claim or the implementation of an Aboriginal land claim agreement or other treaty, a settlement agreement or a self-government agreement.</Text></Paragraph></Section><Section lims:inforce-start-date="2014-04-01" lims:lastAmendedDate="2014-04-01" lims:fid="367186" lims:id="367186"><MarginalNote lims:inforce-start-date="2014-04-01" lims:fid="367187" lims:id="367187">Consultation — prohibition orders</MarginalNote><Label>58</Label><Text>The Minister must — before recommending that the Governor in Council make a prohibition order under section 56 or 57 — consult the member of the Executive Council who is responsible for those public lands or those waters and any affected Aboriginal party on</Text><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="367188" lims:id="367188"><Label>(a)</Label><Text>the boundaries of the lands — and the interests or activities — that are the subject of the order to be made under section 56; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="367189" lims:id="367189"><Label>(b)</Label><Text>the location of the waters that are the subject of the order to be made under section 57.</Text></Paragraph></Section><Heading lims:inforce-start-date="2014-04-01" lims:fid="367190" lims:id="367190" level="2"><TitleText>Compensation</TitleText></Heading><Section lims:inforce-start-date="2017-12-12" lims:lastAmendedDate="2017-12-12" lims:fid="367191" lims:id="367191"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="367192" lims:id="367192">No expenditure or compensation</MarginalNote><Label>59</Label><Subsection lims:inforce-start-date="2017-12-12" lims:fid="367193" lims:id="367193"><Label>(1)</Label><Text>Subject to subsection (2), the following are to be done without expenditures by or compensation to the Government of the Northwest Territories:</Text><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="367194" lims:id="367194"><Label>(a)</Label><Text>a relinquishment under section 53;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="367195" lims:id="367195"><Label>(b)</Label><Text>a taking under section 55; and</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="367196" lims:id="367196"><Label>(c)</Label><Text>the making of a prohibition order under section 56 or 57.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="367197" lims:id="367197"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="367198" lims:id="367198">Exception — improvements to public lands</MarginalNote><Label>(2)</Label><Text>If the Commissioner relinquishes to the Governor in Council, or the Governor in Council takes, the administration and control of public lands, the Government of Canada must compensate the Government of the Northwest Territories for any improvements that it has made to those lands.</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="367199" lims:id="367199"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="367200" lims:id="367200">Negotiation</MarginalNote><Label>(3)</Label><Text>As soon as practicable after the relinquishment or the taking, the Government of Canada and the Government of the Northwest Territories are to attempt to reach an agreement on the amount of compensation.</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="367201" lims:id="367201"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="367202" lims:id="367202">Appraisal expert</MarginalNote><Label>(4)</Label><Text>If the Government of Canada and the Government of the Northwest Territories are unable to reach an agreement, they are to refer the matter to an agreed upon person with expertise in determining the value of improvements to land.</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="367203" lims:id="367203"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="367204" lims:id="367204">Amount of compensation</MarginalNote><Label>(5)</Label><Text>That person must determine that value on a basis similar to the determination of the fair actual value of the improvements — at the time the Governor in Council takes or has relinquished to it the administration and control of the lands — calculated in accordance with the method for calculating the fair actual value of improvements to land set out in a law of general application of the Legislature relating to the assessment of taxes on real property. agreement entered into under section 5 or 11 of the <XRefExternal reference-type="act" link="C-11">Canada Water Act</XRefExternal>, the Minister may, on behalf of the Government of Canada, enter into an agreement with a provincial government providing for the management of any waters that</Text><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="367210" lims:id="367210"><Label>(a)</Label><Text>are</Text><Subparagraph lims:inforce-start-date="2014-04-01" lims:fid="367211" lims:id="367211"><Label>(i)</Label><Text>partially on lands situated in the Northwest Territories that are under the administration of a federal minister, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-04-01" lims:fid="367212" lims:id="367212"><Label>(ii)</Label><Text>partially on lands that are not under the administration of a federal minister; or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="367213" lims:id="367213"><Label>(b)</Label><Text>flow between</Text><Subparagraph lims:inforce-start-date="2014-04-01" lims:fid="367214" lims:id="367214"><Label>(i)</Label><Text>lands situated in the Northwest Territories that are under the administration of a federal minister, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-04-01" lims:fid="367215" lims:id="367215"><Label>(ii)</Label><Text>lands that are not under the administration of a federal Inuvialuit Final Agreement, an interest referred to in section 18.5 of the Gwich’in Agreement, section 19.5 of the Sahtu Agreement or section 18.6 of the Tlicho Agreement or a similar right or lims:id="367249"><Text><DefinedTermEn>existing interest</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="367250" lims:id="367250"><Label>(a)</Label><Text>a right or interest that exists — immediately before the coming into force of section 1 — under an Act of Parliament that is repealed or rendered inapplicable to such a right or interest by an Act of Parliament that implements the Agreement;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="367251" lims:id="367251"><Label>(b)</Label><Text>a right or interest that exists — immediately before that coming into force — under an access order, a permit, licence or other authorization, a lease or an agreement for lease or sale that is issued, granted or otherwise obtained under an Act of Parliament that is repealed or rendered inapplicable to such a right or interest by an Act of Parliament that implements the Agreement;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="367252" lims:id="367252"><Label>(c)</Label><Text>a right or interest that exists immediately before that coming into force under a licence — as defined that is in relation to a federal area as defined in section 51 of the <XRefExternal reference-type="act" link="M-0.2">Mackenzie Valley Resource Management Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="367253" lims:id="367253"><Label>(d)</Label><Text>a right or interest that is a renewal, replacement or successor of a right or interest referred to in paragraph (a), (b) or (c) if a right to that renewal, replacement or successor exists immediately before that coming into force; or</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="367254" lims:id="367254"><Label>(e)</Label><Text>a licence that</Text><Subparagraph lims:inforce-start-date="2017-12-12" lims:fid="367255" lims:id="367255"><Label>(i)</Label><Text>is valid immediately before the coming into force of section 1 and the giving of which was subject to the <XRefExternal reference-type="act" link="F-8.4">Federal Real Property and Federal Immovables Act</XRefExternal>, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-12-12" lims:fid="367256" lims:id="367256"><Label>(ii)</Label><Text>is a renewal, replacement or successor of such a licence if a right to that renewal, replacement or successor exists immediately before that coming into interest only if those conditions are applicable to similar rights or interests that are issued, granted or otherwise obtained under a law of the Legislature.</Text></Subsection><Subsection lims:inforce-start-date="2014-04-01" lims:fid="367265" lims:id="367265"><MarginalNote lims:inforce-start-date="2014-04-01" lims:fid="367266" lims:id="367266">Limitation — limitation, suspension or cancellation</MarginalNote><Label>(3)</Label><Text>A law of the Legislature may, in respect of an existing interest, provide for its limitation, suspension or cancellation only if</Text><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="367267" lims:id="367267"><Label>(a)</Label><Text>the circumstances for its limitation, suspension or cancellation are identical to those that would have applied immediately before the coming into force of section 1; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="367268" lims:id="367268"><Label>(b)</Label><Text>subject to subsection (4), its limitation, suspension or cancellation is for a failure to comply with a condition in respect of the exercise of the existing interest and the law applies to all similar rights or interests.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-04-01" lims:fid="367269" lims:id="367269"><MarginalNote lims:inforce-start-date="2014-04-01" lims:fid="367270" lims:id="367270">Limitation — paragraph (3)(b)</MarginalNote><Label>(4)</Label><Text>A law of the Legislature must not provide for the limitation, suspension or cancellation of an existing interest described in paragraph (c) of the definition <DefinedTermEn>existing interest</DefinedTermEn> in section 68 — continues in full force and effect until the earliest of the following takes place:</Text><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="367275" lims:id="367275"><Label>(a)</Label><Text>it expires or is surrendered,</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="367276" lims:id="367276"><Label>(b)</Label><Text>with the agreement of the holder, it is cancelled and replaced by a right or interest issued or granted by the Government of the Northwest Territories,</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="367277" lims:id="367277"><Label>(c)</Label><Text>in the case of an encumbering right, it is — with the agreement of the holder and the relevant Aboriginal organization — cancelled under a settlement agreement,</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="367278" lims:id="367278"><Label>(d)</Label><Text>it is limited, suspended or cancelled under a law of the Legislature referred to in subsection (3), the Minister in an instrument evidencing an existing interest must be read as a reference to the Government of the Northwest Territories.</Text></Section><Section lims:inforce-start-date="2014-04-01" proceedings</MarginalNote><Label>71</Label><Text>Every proceeding — other than a civil or criminal one that is before a court — with respect to a right or interest that is referred to in paragraph (a), (b), (c) or (e) of the definition <DefinedTermEn>existing interest</DefinedTermEn> in section 68 that is in progress immediately before the coming into force of section 1 must be taken up and continued under and in conformity with the laws of the Legislature without any further formality.</Text></Section><Section lims:inforce-start-date="2014-04-01" lims:lastAmendedDate="2014-04-01" the Legislature that specifically provides that it applies to matters governed by section 45, 46, 47, 57, 58 or 59 of the <XRefExternal reference-type="act" link="N-27.05">Northwest Territories Act</XRefExternal>, the <XRefExternal reference-type="act" link="O-7">Canada Oil and Gas Operations Act</XRefExternal>, the <XRefExternal reference-type="act" link="T-7">Territorial Lands Act</XRefExternal>, the <XRefExternal reference-type="act" link="C-8.5">Canada Petroleum Resources Act</XRefExternal>, the <XRefExternal reference-type="act" link="F-8.4">Federal Real Property and Federal Immovables Act</XRefExternal>, the <XRefExternal reference-type="act" link="N-27.3">Northwest Territories Waters Act</XRefExternal> or the <XRefExternal reference-type="act" link="N-27.1">Northwest Territories Surface Rights Board Act</XRefExternal> — as they read immediately before the coming into force of section 1 — is considered for all purposes to have been validly made if it is made before that coming into force and would have been valid if made after that coming into force. However, it has no force and effect before that coming into force.</Text></Section><Section lims:inforce-start-date="2017-12-12" lims:lastAmendedDate="2017-12-12" lims:fid="367286" lims:id="367286"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="367287" lims:id="367287">Indemnification by Government of the Northwest Territories</MarginalNote><Label>73</Label><Subsection lims:inforce-start-date="2017-12-12" lims:fid="367288" lims:id="367288"><Label>(1)</Label><Text>The Government of the Northwest Territories must indemnify the Government of Canada, or any of its employees or agents, against all costs, charges and expenses, including amounts paid to settle an action or to satisfy a judgment, that are reasonably incurred in respect of any claim, action or other proceeding brought against the Government of Canada, or any of its employees or agents, arising out of any act or omission of the Government of the Northwest Territories, or any of its employees or agents, occurring</Text><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="367289" lims:id="367289"><Label>(a)</Label><Text>after the coming into force of section 1, in respect of</Text><Subparagraph lims:inforce-start-date="2017-12-12" lims:fid="367290" lims:id="367290"><Label>(i)</Label><Text>public lands that are under the administration and control of the Commissioner other than those that are under his or her administration and control immediately before that coming into force,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-12-12" lims:fid="367291" lims:id="367291"><Label>(ii)</Label><Text>rights in respect of waters that are under the administration and control of the Commissioner, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-12-12" lims:fid="367292" lims:id="367292"><Label>(iii)</Label><Text>existing interests;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="367293" lims:id="367293"><Label>(b)</Label><Text>in respect of security that is assigned to the Government of the Northwest Territories under the Agreement;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="367294" lims:id="367294"><Label>(c)</Label><Text>in respect of records that are copied, loaned or transferred under the Agreement unless the act or omission is made under the Agreement;
