reference-type="act" link="N-24.5">Northern Canada Power Commission Yukon Assets Disposal Authorization Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2003-01-01" lims:fid="365943" lims:id="365943" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2003-01-01" lims:lastAmendedDate="2019-07-15" lims:fid="365944" lims:id="365944"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="365945" lims:id="365945">Definitions</MarginalNote><Label>2</Label><Text>In this Act,</Text><Definition lims:inforce-start-date="2003-01-01" lims:fid="365946" lims:id="365946"><Text><DefinedTermEn>agreement</DefinedTermEn> means the purchase and sale agreement respecting assets in the Yukon Territory held or used by the Commission and entered into by Her Majesty in right of Canada, as represented by the Minister, the Commission, the Corporation and the Government of the Yukon Territory, as represented by the Commissioner of the Yukon Territory; (<DefinedTermFr>accord</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2003-01-01" lims:fid="365947" lims:id="365947"><Text><DefinedTermEn>Commission</DefinedTermEn> means the Northern Canada Power Commission, a corporation established by the <XRefExternal reference-type="act">Northern Canada Power Commission Act</XRefExternal>; (<DefinedTermFr>Commission</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2003-01-01" lims:fid="365948" lims:id="365948"><Text><DefinedTermEn>Corporation</DefinedTermEn> means the Yukon Power Corporation, a wholly-owned subsidiary of the Yukon Development Corporation, a corporation established by an ordinance of the Yukon Territory; (<DefinedTermFr>Société</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2003-01-01" lims:fid="365949" lims:id="365949"><Text><DefinedTermEn>dispose</DefinedTermEn>, in respect of any territorial lands or other assets, includes to sell or lease the assets and to grant a licence or easement in respect of the assets; (<DefinedTermFr>aliénation</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2003-01-01" lims:fid="365950" lims:id="365950"><Text><DefinedTermEn>Electrical Company</DefinedTermEn> means The Yukon Electrical Company Limited, a corporation incorporated under the laws of the Yukon Territory; (<DefinedTermFr>société d’électricité</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="365951" lims:id="1192036"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Northern Affairs; (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2003-01-01" lims:fid="365952" lims:id="365952"><Text><DefinedTermEn>territorial lands</DefinedTermEn> means lands in the Yukon Territory that are vested in Her Majesty in right of Canada or of which the Government of Canada has power to dispose, whether or not the lands have been withdrawn from disposal under the <XRefExternal reference-type="act" link="T-7">Territorial Lands Act</XRefExternal> pursuant to paragraph 19(a) of that Act. (<DefinedTermFr>terres territoriales</DefinedTermFr>)</Text></Definition><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2003-01-01" lims:fid="365953" lims:id="365953" level="1"><TitleText>Disposal of Assets</TitleText></Heading><Section lims:inforce-start-date="2003-01-01" lims:lastAmendedDate="2003-01-01" lims:fid="365954" lims:id="365954"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="365955" lims:id="365955">Disposal by Minister</MarginalNote><Label>3</Label><Subsection lims:inforce-start-date="2003-01-01" lims:fid="365956" lims:id="365956"><Label>(1)</Label><Text>For the purpose of carrying out the agreement, the Minister may, on such terms and conditions as the Governor in Council may, by order, approve, dispose of to the Corporation any territorial lands that are under the control, management and administration of the Minister.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="365957" lims:id="365957"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="365958" lims:id="365958">Provisions not applicable</MarginalNote><Label>(2)</Label><Text>Sections 4, 7, 9 and 10 of the <XRefExternal reference-type="act" link="T-7">Territorial Lands Act</XRefExternal> and the <XRefExternal reference-type="regulation" link="C.R.C.,_c._1525">Territorial Lands Regulations</XRefExternal> do not apply in respect of any territorial lands disposed of pursuant to this section.</Text></Subsection></Section><Section lims:inforce-start-date="2003-01-01" lims:lastAmendedDate="2003-01-01" lims:fid="365959" lims:id="365959"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="365960" lims:id="365960">Execution of agreement</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2003-01-01" lims:fid="365961" lims:id="365961"><Label>(1)</Label><Text>The Minister may, by order, direct the Commission to execute the agreement and such other documents as are necessary for or incidental to the carrying out of the agreement and the Commission shall comply with the order.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="365962" lims:id="365962"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="365963" lims:id="365963">Disposal by Commission</MarginalNote><Label>(2)</Label><Text>For the purpose of carrying out the agreement, the Minister may, by order, direct the Commission to dispose of, on such terms and conditions as are approved by the Governor in Council, to the Corporation any territorial lands, and any other assets in the Yukon Territory, that are under the control, management and administration of the Commission.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="365964" lims:id="365964"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="365965" lims:id="365965"><XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal> authorization</MarginalNote><Label>(3)</Label><Text>On receiving an order under subsection (2), the Commission is hereby authorized to dispose of assets in accordance with the order and shall comply with the order.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="365966" lims:id="365966"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="365967" lims:id="365967">Provisions not applicable</MarginalNote><Label>(4)</Label><Text>Subsections 108(2) to (5) of the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal> do not apply in respect of any disposal of assets authorized by subsection (3).</Text></Subsection></Section><Section lims:inforce-start-date="2003-01-01" lims:lastAmendedDate="2003-01-01" lims:fid="365968" lims:id="365968"><Label>5</Label><Subsection lims:inforce-start-date="2003-01-01" lims:fid="365969" lims:id="365969"><Label>(1) and (2)</Label><Text><Repealed>[Repealed, 1992, c. 40, s. 50]</Repealed></Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="365970" lims:id="365970"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="365971" lims:id="365971">Exemption from fees</MarginalNote><Label>(3)</Label><Text>Notwithstanding the <XRefExternal reference-type="act" link="Y-4.6">Yukon Waters Act</XRefExternal>, the Minister may, with the approval of the Governor in Council, make an order exempting the Corporation from the requirement to pay fees for the right to use waters or deposit waste pursuant to a licence under that Act.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2003-01-01" lims:fid="365973" lims:id="365973">1987, c. 9, s. 5; 1992, c. 40, s. 50</HistoricalNoteSubItem></HistoricalNote></Subsection></Section><Heading lims:inforce-start-date="2003-01-01" lims:fid="365974" lims:id="365974" level="1"><TitleText>Financial Provisions</TitleText></Heading><Section lims:inforce-start-date="2003-01-01" lims:lastAmendedDate="2003-01-01" lims:fid="365975" lims:id="365975"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="365976" lims:id="365976">Forgiveness of debt</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2003-01-01" lims:fid="365977" lims:id="365977"><Label>(1)</Label><Text>The debts and obligations of the Commission due to Her Majesty in right of Canada in relation to the Commission’s operations in the Yukon Territory and the claims of Her Majesty in right of Canada against the Commission in relation to those operations, the aggregate principal amount of which debts, obligations and claims is one hundred and twenty-eight million, one hundred and twenty-six thousand, eighty-three dollars and fifty cents, and the interest accruing on that amount to the day on which this section comes into force are hereby forgiven and the amount, as recorded in the accounts of Canada on that day, of those debts, obligations and claims is hereby written off as a budgetary expenditure and deleted from those accounts.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="365978" lims:id="365978"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="365979" lims:id="365979">Application of proceeds</MarginalNote><Label>(2)</Label><Text>The proceeds of sale in the amount of ninety-five million dollars referred to in the agreement shall be applied towards the writing off of the debts, obligations and claims referred to in subsection (1).</Text></Subsection></Section><Section lims:inforce-start-date="2003-01-01" lims:lastAmendedDate="2003-01-01" lims:fid="365980" lims:id="365980"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="365981" lims:id="365981">Assignment of promissory note</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2003-01-01" lims:fid="365982" lims:id="365982"><Label>(1)</Label><Text>The Minister may assign or cause to be assigned to the Government of the Yukon Territory, as represented by the Commissioner of the Yukon Territory, the promissory note in the principal amount of nineteen million five hundred thousand dollars given by the Corporation in partial consideration for the assets disposed of to the Corporation pursuant to this Act.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="365983" lims:id="365983"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="365984" lims:id="365984">Promissory note written off</MarginalNote><Label>(2)</Label><Text>Where the promissory note referred to in subsection (1) is assigned pursuant to that subsection, the principal amount of the note as recorded in the accounts of Canada on the day of the assignment is hereby written off as a budgetary expenditure and deleted from those accounts.</Text></Subsection></Section><Section lims:inforce-start-date="2003-01-01" lims:lastAmendedDate="2003-01-01" lims:fid="365985" lims:id="365985"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="365986" lims:id="365986">Regulations not applicable</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2003-01-01" lims:fid="365987" lims:id="365987"><Label>(1)</Label><Text>The regulations made pursuant to subsection 18(1) of the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal> do not apply in respect of any debt, obligation or claim written off by section 6 or 7.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="365988" lims:id="365988"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="365989" lims:id="365989">Report in Public Accounts</MarginalNote><Label>(2)</Label><Text>The debts, obligations and claims forgiven or written off by section 6 or 7 in a fiscal year shall be reported, in such form as the Treasury Board may determine, in the Public Accounts for that year.</Text></Subsection></Section><Heading lims:inforce-start-date="2003-01-01" lims:fid="365990" lims:id="365990" level="1"><TitleText>Pension Rights</TitleText></Heading><Section lims:inforce-start-date="2003-01-01" lims:lastAmendedDate="2003-01-01" lims:fid="365991" lims:id="365991"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="365992" lims:id="365992">Pension rights</MarginalNote><Label>9</Label><Subsection lims:inforce-start-date="2003-01-01" lims:fid="365993" lims:id="365993"><Label>(1)</Label><Text>In the manner and to the extent provided by the regulations made under subsection (3), the <XRefExternal reference-type="act" link="P-36">Public Service Superannuation Act</XRefExternal>, the <XRefExternal reference-type="act" link="S-24">Supplementary Retirement Benefits Act</XRefExternal> and the regulations made under those Acts apply to a person who meets all of the following criteria:</Text><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="365994" lims:id="365994"><Label>(a)</Label><Text>immediately prior to the coming into force of this section, the person was employed by the Commission and was a contributor under the <XRefExternal reference-type="act" link="P-36">Public Service Superannuation Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="365995" lims:id="365995"><Label>(b)</Label><Text>the President of the Treasury Board has not made a payment to the pension plan of the Electrical Company pursuant to section 30 of the <XRefExternal reference-type="act" link="P-36">Public Service Superannuation Act</XRefExternal> in respect of that person;</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="365996" lims:id="365996"><Label>(c)</Label><Text>the person has not received or opted to receive any annuity or other benefit under section 11 or 12 of the <XRefExternal reference-type="act" link="P-36">Public Service Superannuation Act</XRefExternal> in respect of the pensionable service to that person’s credit under that Act immediately prior to the coming into force of this section; and</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="365997" lims:id="365997"><Label>(d)</Label><Text>the person elects, within one year after the coming into force of this section and in such form and manner as the President of the Treasury Board may direct, to have the <XRefExternal reference-type="act" link="P-36">Public Service Superannuation Act</XRefExternal>, the <XRefExternal reference-type="act" link="S-24">Supplementary Retirement Benefits Act</XRefExternal> and the regulations made under those Acts apply to that person in the manner and to the extent provided by the regulations made under subsection (3).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="365998" lims:id="365998"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="365999" lims:id="365999">Election irrevocable</MarginalNote><Label>(2)</Label><Text>An election made pursuant to paragraph (1)(d) is irrevocable.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="366000" lims:id="366000"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="366001" lims:id="366001">Regulations</MarginalNote><Label>(3)</Label><Text>The Governor in Council may, in relation to persons who have made elections pursuant to paragraph (1)(d), make regulations</Text><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="366002" lims:id="366002"><Label>(a)</Label><Text>respecting the manner in which and extent to which provisions, as amended, of the Acts and regulations mentioned in subsection (1) apply;</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="366003" lims:id="366003"><Label>(b)</Label><Text>adapting provisions of those Acts and regulations for the purposes of this section; and</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="366004" lims:id="366004"><Label>(c)</Label><Text>generally for carrying out the purposes and provisions of this section.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="366005" lims:id="366005"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="366006" lims:id="366006">Retroactive application of regulations</MarginalNote><Label>(4)</Label><Text>Regulations made under subsection (3) may, if they so provide, be retroactive and have effect with respect to any period before they are made.</Text></Subsection></Section><Section lims:inforce-start-date="2003-01-01" lims:lastAmendedDate="2003-01-01" lims:fid="366007" lims:id="366007"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="366008" lims:id="366008">Reciprocal transfer agreements</MarginalNote><Label>10</Label><Text>For greater certainty, for the purposes of section 30 of the <XRefExternal reference-type="act" link="P-36">Public Service Superannuation Act</XRefExternal>, the Electrical Company is deemed to be an <DefinedTermEn>approved employer</DefinedTermEn> within the meaning of that section.</Text></Section><Heading lims:inforce-start-date="2003-01-01" lims:fid="366009" lims:id="366009" level="1"><TitleText>Agency Status</TitleText></Heading><Section lims:inforce-start-date="2003-01-01" lims:lastAmendedDate="2003-01-01" lims:fid="366010" lims:id="366010"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="366011" lims:id="366011">Agency status of Yukon Development Corporation</MarginalNote><Label>11</Label><Text>The provision in the ordinance of the Yukon Territory establishing the Yukon Development Corporation that declares the Yukon Development Corporation to be an agent of the Government of Yukon shall not be repealed before the consideration for the assets disposed of to the Yukon Power Corporation pursuant to this Act
