title</MarginalNote><Label>1</Label><Text>This Act may be cited as the <XRefExternal reference-type="act" link="N-16.6">National Security and Intelligence Committee of Parliamentarians Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2017-06-22" lims:fid="363651" lims:id="363651" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2017-10-06" lims:lastAmendedDate="2019-07-12" lims:fid="363652" lims:id="363652"><MarginalNote lims:inforce-start-date="2017-10-06" lims:fid="363653" lims:id="363653">Definitions</MarginalNote><Label>2</Label><Text>The following definitions apply in this Act.</Text><Definition lims:inforce-start-date="2017-10-06" lims:fid="363654" lims:id="363654"><Text><DefinedTermEn>appropriate Minister</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2017-10-06" lims:fid="363655" lims:id="363655"><Label>(a)</Label><Text>with respect to a department named in Schedule I to the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>, the Minister presiding over the department;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-10-06" lims:fid="363656" lims:id="363656"><Label>(b)</Label><Text>with respect to a division or branch of the federal public administration set out in column I of Schedule I.1 to the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>, the Minister set out in column II of that Schedule;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-10-06" lims:fid="363657" lims:id="363657"><Label>(c)</Label><Text>with respect to a corporation named in Schedule II to the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>, the Minister designated as the appropriate Minister by order of the Governor in Council made under that Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-10-06" lims:fid="363658" lims:id="363658"><Label>(c.1)</Label><Text>with respect to a <DefinitionRef>parent Crown corporation</DefinitionRef> as defined in subsection 83(1) of the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>, the <DefinitionRef>appropriate Minister</DefinitionRef> as defined in that subsection; or</Text></Paragraph><Paragraph lims:inforce-start-date="2017-10-06" lims:fid="363659" lims:id="363659"><Label>(d)</Label><Text>with respect to the Canadian Forces, the Minister of National Defence. (<DefinedTermFr>ministre compétent</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2017-10-06" lims:fid="363660" lims:id="363660"><Text><DefinedTermEn>Committee</DefinedTermEn> means the National Security and Intelligence Committee of Parliamentarians established by section <XRefInternal>4</XRefInternal>. (<DefinedTermFr>Comité</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="363661" lims:id="1193076"><Text><DefinedTermEn>department</DefinedTermEn> means, except in subsection 25(2), a department named in Schedule I to the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>, a division or branch of the federal public administration — other than a review body or the office of the Intelligence Commissioner — set out in column I of Schedule I.1 to that Act, a corporation named in Schedule II to that Act, a <DefinitionRef>parent Crown corporation</DefinitionRef> as defined in subsection 83(1) of that Act or the Canadian Forces. (<DefinedTermFr>ministère</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-10-06" lims:fid="363662" lims:id="363662"><Text><DefinedTermEn>review body</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="363663" lims:id="1193077"><Label>(a)</Label><Text>the Civilian Review and Complaints Commission for the Royal Canadian Mounted Police established by subsection 45.29(1) of the <XRefExternal reference-type="act" link="R-10">Royal Canadian Mounted Police Act</XRefExternal>; or</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="363664" lims:id="1193078"><Label>(b)</Label><Text>the National Security and Intelligence Minister</TitleText></Heading><Section lims:inforce-start-date="2017-10-06" lims:lastAmendedDate="2017-10-06" lims:fid="363668" lims:id="363668"><MarginalNote lims:inforce-start-date="2017-10-06" lims:fid="363669" lims:id="363669">Power of Governor in Council</MarginalNote><Label>3</Label><Text>The Governor in Council may designate a member of the Queen’s Privy Council for Canada to be the Minister for the purposes of this Act.</Text></Section><Heading lims:inforce-start-date="2017-06-22" lims:fid="363670" lims:id="363670" level="1"><TitleText>Committee and Members</TitleText></Heading><Section lims:inforce-start-date="2017-10-06" lims:lastAmendedDate="2017-10-06" lims:fid="363671" lims:id="363671"><MarginalNote lims:inforce-start-date="2017-10-06" lims:fid="363672" lims:id="363672">Committee established</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2017-10-06" lims:fid="363673" lims:id="363673"><Label>(1)</Label><Text>The National Security and Intelligence Committee of Parliamentarians is established, consisting of a Chair and up to 10 other members, each of whom must be a member of either House of Parliament other than a minister of the Crown, a minister of state or a parliamentary secretary.</Text></Subsection><Subsection lims:inforce-start-date="2017-10-06" lims:fid="363674" lims:id="363674"><MarginalNote lims:inforce-start-date="2017-10-06" lims:fid="363675" lims:id="363675">Members</MarginalNote><Label>(2)</Label><Text>The Committee is to consist of not more than three members who are members of the Senate and not more than eight members who are members of the House of Commons. Not more than five Committee members who are members of the House of Commons may be members of the government party.</Text></Subsection><Subsection lims:inforce-start-date="2017-10-06" lims:fid="363676" lims:id="363676"><MarginalNote lims:inforce-start-date="2017-10-06" lims:fid="363677" lims:id="363677">Not a committee of Parliament</MarginalNote><Label>(3)</Label><Text>The Committee is not a committee of either House of Parliament or of both Houses.</Text></Subsection></Section><Section lims:inforce-start-date="2017-10-06" lims:lastAmendedDate="2022-07-26" lims:fid="363678" lims:id="363678"><MarginalNote lims:inforce-start-date="2017-10-06" lims:fid="363679" lims:id="363679">Appointment of members</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2017-10-06" lims:fid="363680" lims:id="363680"><Label>(1)</Label><Text>The members of the Committee are to be appointed by the Governor in Council, on the recommendation of the Prime Minister, to hold office during pleasure until the dissolution of Parliament following their appointment.</Text></Subsection><Subsection lims:inforce-start-date="2017-10-06" lims:fid="363681" lims:id="363681"><MarginalNote lims:inforce-start-date="2017-10-06" lims:fid="363682" lims:id="363682">Nomination deadline</MarginalNote><Label>(1.1)</Label><Text>After a general election, the members of the Committee are to be appointed within 60 days after the day on which Parliament is summoned to sit.</Text></Subsection><Subsection lims:inforce-start-date="2022-07-26" lims:enacted-date="2022-06-23" lims:fid="363683" lims:id="1373056"><MarginalNote lims:inforce-start-date="2022-07-26" lims:enacted-date="2022-06-23" lims:fid="1373057" lims:id="1373057">Consultation</MarginalNote><Label>(2)</Label><Text>A member of the Senate may be appointed to the Committee only after the Prime Minister has consulted with the Leader of the Government in the Senate or Government Representative in the Senate, the Leader of the Opposition in the Senate and the Leader or Facilitator of every other recognized party or parliamentary group in the Senate.</Text></Subsection><Subsection lims:inforce-start-date="2017-10-06" lims:fid="363685" lims:id="363685"><MarginalNote lims:inforce-start-date="2017-10-06" lims:fid="363686" lims:id="363686">Members of other parties</MarginalNote><Label>(3)</Label><Text>A member of the House of Commons who belongs to a party that is not the government party and that has a recognized membership of 12 or more persons in that House may be appointed to the Committee only after the Prime Minister has consulted with the leader of that party.</Text></Subsection><Subsection lims:inforce-start-date="2017-10-06" lims:fid="363687" lims:id="363687"><MarginalNote lims:inforce-start-date="2017-10-06" lims:fid="363688" lims:id="363688">Ceasing to be member</MarginalNote><Label>(4)</Label><Text>A member of the Committee ceases to be a member on being appointed a minister of the Crown, a minister of state or a parliamentary secretary or on ceasing to be a member of the Senate or the House of Commons.</Text></Subsection><Subsection lims:inforce-start-date="2017-10-06" lims:fid="363689" lims:id="363689"><MarginalNote lims:inforce-start-date="2017-10-06" lims:fid="363690" lims:id="363690">Resignation</MarginalNote><Label>(5)</Label><Text>A member may resign by notifying the Prime Minister in writing of their intention to resign and the member ceases to be a member on the day on which the Prime Minister receives the notification or on the date specified in the notification, whichever is lims:id="363691"><MarginalNote lims:inforce-start-date="2017-10-06" lims:fid="363692" lims:id="363692">Designation of Chair</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2017-10-06" lims:fid="363693" lims:id="363693"><Label>(1)</Label><Text>The Governor in Council is to designate the Chair of the Committee from among the members of the Committee, on the recommendation of the Prime Minister.</Text></Subsection><Subsection lims:inforce-start-date="2017-10-06" lims:fid="363694" lims:id="363694"><MarginalNote lims:inforce-start-date="2017-10-06" lims:fid="363695" lims:id="363695">Absence or incapacity</MarginalNote><Label>(2)</Label><Text>If the Chair is absent or incapacitated or the office of Chair is vacant, the Committee may designate one of its other members to act as Chair, but the member must not be so designated for more than 90 days without the Governor in Council’s approval.</Text></Subsection></Section><Section lims:inforce-start-date="2017-10-06" lims:lastAmendedDate="2017-10-06" lims:fid="363696" lims:id="363696"><MarginalNote lims:inforce-start-date="2017-10-06" lims:fid="363697" lims:id="363697">Expenses</MarginalNote><Label>7</Label><Text>Each member of the Committee is entitled to be paid, in accordance with Treasury Board directives, reasonable travel and living expenses incurred by the member in the exercise of their powers or the performance of their duties or functions.</Text></Section><Heading lims:inforce-start-date="2017-06-22" lims:fid="363698" lims:id="363698" level="1"><TitleText>Mandate of Committee</TitleText></Heading><Section lims:inforce-start-date="2017-10-06" lims:lastAmendedDate="2017-10-06" lims:fid="363699" lims:id="363699"><MarginalNote lims:inforce-start-date="2017-10-06" lims:fid="363700" lims:id="363700">Review of national security matters</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2017-10-06" lims:fid="363701" lims:id="363701"><Label>(1)</Label><Text>The mandate of the Committee is to review</Text><Paragraph lims:inforce-start-date="2017-10-06" lims:fid="363702" lims:id="363702"><Label>(a)</Label><Text>the legislative, regulatory, policy, administrative and financial framework for national security and intelligence;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-10-06" lims:fid="363703" lims:id="363703"><Label>(b)</Label><Text>any activity carried out by a department that relates to national security or intelligence, unless the activity is an ongoing operation and the appropriate Minister determines that the review would be injurious to national security; and</Text></Paragraph><Paragraph lims:inforce-start-date="2017-10-06" lims:fid="363704" lims:id="363704"><Label>(c)</Label><Text>any matter relating to national security or intelligence that a minister of the Crown refers to the Committee.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2017-10-06" lims:fid="363705" lims:id="363705"><MarginalNote lims:inforce-start-date="2017-10-06" lims:fid="363706" lims:id="363706">Review injurious to national security</MarginalNote><Label>(2)</Label><Text>If the appropriate Minister determines that a review would be injurious to national security, he or she must inform the Committee of his or her determination and the reasons for it.</Text></Subsection><Subsection lims:inforce-start-date="2017-10-06" lims:fid="363707" lims:id="363707"><MarginalNote lims:inforce-start-date="2017-10-06" lims:fid="363708" lims:id="363708">Review no longer injurious</MarginalNote><Label>(3)</Label><Text>If the appropriate Minister determines that the review would no longer be injurious to national security or if the appropriate Minister is informed that the activity is no longer ongoing, he or she must inform the Committee that the review may be conducted.</Text></Subsection></Section><Section lims:inforce-start-date="2017-10-06" lims:lastAmendedDate="2017-10-06" lims:fid="363709" lims:id="363709"><MarginalNote lims:inforce-start-date="2017-10-06" lims:fid="363710" lims:id="363710">Cooperation</MarginalNote><Label>9</Label><Text>The Committee and each review body are to take all reasonable steps to cooperate with each other to avoid any unnecessary duplication of work by the Committee and that review body in relation to the fulfilment of their respective mandates.</Text></Section><Heading lims:inforce-start-date="2017-06-22" lims:fid="363711" lims:id="363711" level="1"><TitleText>Security and Confidentiality</TitleText></Heading><Section lims:inforce-start-date="2017-10-06" lims:lastAmendedDate="2017-10-06" lims:fid="363712" lims:id="363712"><MarginalNote lims:inforce-start-date="2017-10-06" lims:fid="363713" lims:id="363713">Compliance with security requirements</MarginalNote><Label>10</Label><Text>Each member of the Committee must</Text><Paragraph lims:inforce-start-date="2017-10-06" lims:fid="363714" lims:id="363714"><Label>(a)</Label><Text>obtain and maintain the necessary security clearance from the Government of Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-10-06" lims:fid="363715" lims:id="363715"><Label>(b)</Label><Text>take the oath or solemn affirmation set out in the schedule; and</Text></Paragraph><Paragraph lims:inforce-start-date="2017-10-06" lims:fid="363716" lims:id="363716"><Label>(c)</Label><Text>comply with the procedures and practices set out in the regulations.</Text></Paragraph></Section><Section lims:inforce-start-date="2017-10-06" lims:lastAmendedDate="2017-10-06" lims:fid="363717" lims:id="363717"><MarginalNote lims:inforce-start-date="2017-10-06" lims:fid="363718" lims:id="363718">Disclosure prohibited</MarginalNote><Label>11</Label><Subsection lims:inforce-start-date="2017-10-06" lims:fid="363719" lims:id="363719"><Label>(1)</Label><Text>Subject to subsection (2), a member or former member of the Committee, the executive director or a former executive director of the Secretariat or a person who is or was engaged by the Secretariat must not knowingly disclose any information that they obtained, or to which they had access, in the course of exercising their powers or performing their duties or functions under this Act and that a department is taking measures to protect.</Text></Subsection><Subsection lims:inforce-start-date="2017-10-06" lims:fid="363720" lims:id="363720"><MarginalNote lims:inforce-start-date="2017-10-06" lims:fid="363721" lims:id="363721">Exceptions</MarginalNote><Label>(2)</Label><Text>A person referred to in subsection (1) may disclose information referred to in that subsection for the purpose of exercising their powers or performing their duties or functions under this Act or as required by any other law.</Text></Subsection></Section><Section lims:inforce-start-date="2017-10-06" lims:lastAmendedDate="2024-08-19" lims:fid="363722" lims:id="363722"><MarginalNote lims:inforce-start-date="2017-10-06" lims:fid="363723" lims:id="363723">Parliamentary privilege</MarginalNote><Label>12</Label><Subsection lims:inforce-start-date="2024-08-19" lims:enacted-date="2024-06-20" lims:fid="363724" lims:id="1486870"><Label>(1)</Label><Text>Despite any other law, no member or former member of the Committee may claim immunity based on parliamentary privilege in a proceeding against them in relation to a contravention of subsection <XRefInternal>11</XRefInternal>(1) or of a provision of the <XRefExternal reference-type="act" link="O-5">Foreign Interference and Security of Information Act</XRefExternal> or in relation to any other proceeding arising from any disclosure of information that is prohibited under that subsection.</Text></Subsection><Subsection lims:inforce-start-date="2017-10-06" lims:fid="363725" lims:id="363725"><MarginalNote lims:inforce-start-date="2017-10-06" lims:fid="363726" lims:id="363726">Evidence</MarginalNote><Label>(2)</Label><Text>A statement made by a member or former member of the Committee before either House of Parliament or a committee of the Senate, of the House of Commons or of both Houses of Parliament is admissible in evidence against them in a proceeding referred to level="1"><TitleText>Access to Information</TitleText></Heading><Section lims:inforce-start-date="2017-10-06" lims:lastAmendedDate="2019-07-12" lims:fid="363728" lims:id="363728"><MarginalNote lims:inforce-start-date="2017-10-06" lims:fid="363729" lims:id="363729">Right of access</MarginalNote><Label>13</Label><Subsection lims:inforce-start-date="2017-10-06" lims:fid="363730" lims:id="363730"><Label>(1)</Label><Text>Despite any other Act of Parliament but subject to sections 14 and 16, the Committee is entitled to have access to any information that is under the control of a department and that is related to the fulfilment of the Committee’s mandate.</Text></Subsection><Subsection lims:inforce-start-date="2017-10-06" lims:fid="363731" lims:id="363731"><MarginalNote lims:inforce-start-date="2017-10-06" lims:fid="363732" lims:id="363732">Protected information</MarginalNote><Label>(2)</Label><Text>The information includes information that is protected by litigation privilege or by solicitor-client privilege or the professional secrecy of advocates and notaries.</Text></Subsection><Subsection lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1193062" lims:id="1193062"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1193063" lims:id="1193063">For greater Minister a report of the reviews it conducted during the preceding year.
