being an inland or minor waters voyage, between places within the following areas, namely, Canada, the United States other than Hawaii, St. Pierre and Miquelon, the West Indies, Mexico, Central America and the northeast coast of South America, in the course of which a ship does not go south of the sixth parallel of north latitude; (<DefinedTermFr>voyage de cabotage</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-10-30" lims:fid="356994" lims:id="356994"><Text>  <DefinedTermEn>inland voyage</DefinedTermEn> means a voyage, not being a minor waters voyage, on the inland waters of Canada together with such part of any lake or river forming part of the inland waters of Canada as lies within the United States or on Lake Michigan; (<DefinedTermFr>voyage en eaux internes</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-10-30" lims:fid="356995" lims:id="356995"><Text><DefinedTermEn>invalid</DefinedTermEn> means physically or mentally incapable of earning; (<DefinedTermFr>invalide</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-10-30" lims:fid="356996" lims:id="356996"><Text><DefinedTermEn>medical aid</DefinedTermEn> means the medical, surgical and dental aid, the hospital and skilled nursing services and the artificial member or members and apparatus and repair mentioned in subsection 46(1); (<DefinedTermFr>assistance médicale</DefinedTermFr>)</Text></Definition><Definition Canada</DefinedTermEn>  means all inland waters of Canada other than Lakes Ontario, Erie, Huron, including Georgian Bay, and Superior and the St. Lawrence River east of a line drawn from Father Point to Point Orient, and includes all bays, inlets and harbours of or on those lakes and Georgian Bay and the sheltered waters on the seacoasts of Canada that the Minister of Transport may waters voyage</DefinedTermEn> means a voyage within the following limits, namely, the minor waters of Canada together with the part of any lake or river forming part of the minor waters of Canada that lims:id="357000"><Text> <DefinedTermEn>seaman</DefinedTermEn> means every person, except pilots, apprenticed pilots and fishers, employed or engaged on</Text><Paragraph lims:inforce-start-date="2013-10-30" lims:fid="357001" lims:id="357001"><Label>(a)</Label><Text>a ship registered in Canada under the <XRefExternal reference-type="act" link="C-10.15">Canada Shipping Act, 2001</XRefExternal> , or</Text></Paragraph><Paragraph lims:inforce-start-date="2013-10-30" lims:fid="357002" lims:id="357002"><Label>(b)</Label><Text>a ship chartered by demise to a person resident in Canada or having their principal place of business in Canada,</Text></Paragraph><ContinuedDefinition lims:inforce-start-date="2013-10-30" lims:fid="357003" lims:id="357003"><Text> when the ship is engaged in trading on a foreign voyage or on a home-trade voyage, and, if so ordered by the Governor in Council, includes a seaman engaged in Canada and employed on a ship that is registered outside Canada and operated by a person resident in Canada or having their principal place of business in Canada when that ship is so engaged; (<DefinedTermFr>marin</DefinedTermFr>)</Text></ContinuedDefinition></Definition><Definition lims:inforce-start-date="2013-10-30" lims:fid="357004" lims:id="357004"><Text> <DefinedTermEn>ship</DefinedTermEn> means a vessel as defined in section 2 of the <XRefExternal reference-type="act" link="C-10.15">Canada Shipping Act, 2001</XRefExternal>. (<DefinedTermFr>navire</DefinedTermFr> )</Text></Definition><Definition lims:inforce-start-date="2013-10-30" lims:fid="357005" lims:id="357005"><Text><DefinedTermEn>survivor</DefinedTermEn> means a person who, at the time of the death of a seaman, was</Text><Paragraph lims:inforce-start-date="2013-10-30" lims:fid="357006" lims:id="357006"><Label>(a)</Label><Text>the seaman’s spouse, if there is no person described in paragraph (b), or</Text></Paragraph><Paragraph lims:inforce-start-date="2013-10-30" lims:fid="357007" lims:id="357007"><Label>(b)</Label><Text>a person who was cohabiting with the seaman in a conjugal relationship for a period of at least one year immediately before the seaman’s death. (<DefinedTermFr>survivant</DefinedTermFr>)</Text></Paragraph></Definition></Subsection><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357008" lims:id="357008"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357009" lims:id="357009">Deemed accident</MarginalNote><Label>(2)</Label><Text>A seaman who suffers a disability arising out of and in the course of his employment as a seaman, otherwise than as a result of an accident, shall be deemed for the purposes of this Act to have suffered the disability as a result of an accident and, except for the purpose of computing compensation, the accident shall be deemed to have taken place on the day the disability first became known to his employer.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem M-11, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2013-10-30" lims:lastAmendedDate="2013-10-30" lims:fid="357021" lims:id="357021"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357022" lims:id="357022">Compensation under law of foreign country</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357023" lims:id="357023"><Label>(1)</Label><Text>Where an accident happens in respect of which a seaman or his dependants are entitled to claim compensation under the law of any foreign country, they are bound to elect whether they will claim compensation under that law or under this Act, and to give notice of that election, and if an election is not made and notice not given it shall be presumed that they have elected not to claim compensation under this Act.</Text></Subsection><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357024" lims:id="357024"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357025" lims:id="357025">Notice of election</MarginalNote><Label>(2)</Label><Text>Notice of an election under subsection (1) shall be given to the Minister within three months after the happening of an accident or, if an accident results in death, within three months after the death or within any longer period that, either before or after the expiry of the three months, the Minister may allow.</Text></Subsection><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357026" lims:id="357026"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357027" lims:id="357027">Waiver of all claims</MarginalNote><Label>(3)</Label><Text>No compensation is payable in respect of any accident mentioned in subsection (1) unless the seaman or their dependants submit to the Minister, in a form approved by the Minister, a waiver of all claims for compensation under the foreign law referred to in that subsection.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2013-10-30" lims:fid="357029" lims:id="357029">R.S., 1985, c. M-11, s. 6</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2013-10-30" lims:fid="357034" lims:id="357034" level="1"><TitleText>Compensation</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="357035" lims:id="357035"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="357036" lims:id="357036">Compensation, how paid</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="357037" lims:id="357037"><Label>(1)</Label><Text>The employer of a seaman injured by reason of an accident arising out of and in the course of his employment shall pay compensation in the manner and to the extent provided by this Act, except where the injury</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="357038" lims:id="357038"><Label>(a)</Label><Text>does not disable the seaman for a period of at least three days from earning full wages at the work at which he was employed; or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="357039" lims:id="357039"><Label>(b)</Label><Text>is attributable solely to the serious and wilful misconduct of the seaman unless the injury results in death or serious disability.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="357040" lims:id="357040"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="357041" lims:id="357041">Payable from date of disability</MarginalNote><Label>(2)</Label><Text>Where compensation for disability is payable, it shall be computed and be payable from the date of the disability.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="357043" lims:id="357043">R.S., c. M-6, s. 24; 2012, c. 31, s. 242</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2013-10-30" lims:lastAmendedDate="2013-10-30" lims:fid="357125" lims:id="357125"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357126" lims:id="357126">When compensation not payable</MarginalNote><Label>25</Label><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357127" lims:id="357127"><Label>(1)</Label><Text>Subject to subsection (4), compensation shall not be payable unless</Text><Paragraph lims:inforce-start-date="2013-10-30" lims:fid="357128" lims:id="357128"><Label>(a)</Label><Text>notice of the accident is given as soon as practicable after it happens and before the seaman has voluntarily left the employment in which he was injured; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-10-30" lims:fid="357129" lims:id="357129"><Label>(b)</Label><Text>the claim for compensation is made within six months after the accident happens or, in case of death, within six months from the time of death.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357130" lims:id="357130"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357131" lims:id="357131">Contents of notice</MarginalNote><Label>(2)</Label><Text>The notice referred to in paragraph (1)(a) shall give the name and address of the seaman and is sufficient if it states in ordinary language the cause of the injury and where the accident happened.</Text></Subsection><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357132" lims:id="357132"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357133" lims:id="357133">Service of notice</MarginalNote><Label>(3)</Label><Text>The notice referred to in paragraph (1)(a) may be served by delivering it at, or sending it by registered mail addressed to, the place of business or the residence of the employer, or where the employer is a body of persons, corporate or unincorporate, by delivering it, or sending it by registered mail, addressed to the employer, at the office of, or if there are more offices than one, at any of the offices of, that body of persons.</Text></Subsection><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357134" lims:id="357134"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357135" lims:id="357135">Failure to give notice</MarginalNote><Label>(4)</Label><Text>Failure to give the prescribed notice or to make the claim referred to in subsection (1), or any defect or inaccuracy in a notice, does not bar the right to compensation if the Minister considers that the employer was not prejudiced by it or it appears that the claim for compensation is a just one and ought to be allowed.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2013-10-30" lims:fid="357137" lims:id="357137">R.S., 1985, c. M-6, s. 25; 2012, c. 31, s. 243</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2013-10-30" lims:fid="357138" lims:id="357138" level="1"><TitleText>Notice of Accident</TitleText></Heading><Section lims:inforce-start-date="2013-10-30" lims:lastAmendedDate="2013-10-30" lims:fid="357139" lims:id="357139"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357140" lims:id="357140">Employer to give notice</MarginalNote><Label>26</Label><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357141" lims:id="357141"><Label>(1)</Label><Text>Subject to subsection (2), every employer shall, within 30 days after the happening of an accident to a seaman in its employment by which the seaman is disabled from performing their duties or that necessitates medical aid, notify the Minister in writing of</Text><Paragraph lims:inforce-start-date="2013-10-30" lims:fid="357142" lims:id="357142"><Label>(a)</Label><Text>the happening of the accident and its nature,</Text></Paragraph><Paragraph lims:inforce-start-date="2013-10-30" lims:fid="357143" lims:id="357143"><Label>(b)</Label><Text>the time of the accident,</Text></Paragraph><Paragraph lims:inforce-start-date="2013-10-30" lims:fid="357144" lims:id="357144"><Label>(c)</Label><Text>the name and address of the seaman,</Text></Paragraph><Paragraph lims:inforce-start-date="2013-10-30" lims:fid="357145" lims:id="357145"><Label>(d)</Label><Text>the place of the accident, and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-10-30" lims:fid="357146" lims:id="357146"><Label>(e)</Label><Text>the medical aid received by the seaman following the accident,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2013-10-30" lims:fid="357147" lims:id="357147"><Text>The employer shall also produce any further information respecting any other accident or claim to compensation that the Minister may require.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357148" lims:id="357148"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357149" lims:id="357149">Minister may relieve employer</MarginalNote><Label>(2)</Label><Text>The Minister may, by order, relieve any employer from the obligation to comply with subsection (1) to the extent provided for in the order.</Text></Subsection><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357150" lims:id="357150"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357151" lims:id="357151">Failure to comply</MarginalNote><Label>(3)</Label><Text>Every person who fails to comply with subsection (1) is guilty of an offence and liable on summary conviction to a fine not exceeding $5,000 or to imprisonment for a term not exceeding 12 months or to both.</Text></Subsection><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357152" lims:id="357152"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357153" lims:id="357153">Due diligence</MarginalNote><Label>(4)</Label><Text>A person is not to be found guilty of an offence under subsection (3) if they establish that they exercised due diligence to prevent the commission of the offence.</Text></Subsection><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357154" lims:id="357154"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357155" lims:id="357155">Minister’s consent</MarginalNote><Label>(5)</Label><Text>No proceedings shall be taken under this section against any person without the Minister’s consent.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2013-10-30" lims:fid="357157" lims:id="357157">R.S., 1985, c. M-6, s. 27; 2012, c. 31, s. 245</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2013-10-30" lims:lastAmendedDate="2013-10-30" lims:fid="357168" lims:id="357168"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357169" lims:id="357169">Minister may refer matter to medical referee</MarginalNote><Label>28</Label><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357170" lims:id="357170"><Label>(1)</Label><Text>If a seaman has, on their employer’s request, submitted themselves for examination, or has been examined by a duly qualified medical practitioner selected by themselves, and a copy of the medical practitioner’s report on the seaman’s condition has been furnished in the former case by the employer to the seaman and in the latter case by the seaman to the employer, the Minister may, on the application of either of them or of his or her own motion, refer the matter to a medical referee.</Text></Subsection><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357171" lims:id="357171"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357172" lims:id="357172">Certificate of medical referee</MarginalNote><Label>(2)</Label><Text>The medical referee to whom a reference is made under subsection (1) or who has examined the seaman by the Minister’s direction under subsection 27(1) shall certify to the Minister as to the condition of the seaman and their fitness for employment, specifying, if necessary, the kind of employment and, if unfit, the cause and degree of the unfitness, and the referee’s certificate, unless the Minister otherwise directs, is conclusive as to the matters certified.</Text></Subsection><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357173" lims:id="357173"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357174" lims:id="357174">Right suspended in case refusal of examination</MarginalNote><Label>(3)</Label><Text>When a seaman does not submit himself for examination when required to do so under subsection 27(1) or on being required to do so does not submit himself for examination to a medical referee under that subsection or under subsection (1) of this section, or in any way obstructs any examination, his right to compensation, or if he is in receipt of a weekly or other periodical payment, his right to it, is suspended until the examination has taken place.</Text></Subsection><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357175" lims:id="357175"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357176" lims:id="357176">Diminution or suspension of compensation</MarginalNote><Label>(4)</Label><Text>The Minister may diminish the compensation to which a seaman is entitled, or suspend payment of it, whenever the seaman persists in dangerous or unsanitary practices imperilling or retarding their cure and whenever they refuse to submit to any medical treatment that the Minister, on the medical referee’s advice, considers necessary for their cure.</Text></Subsection><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357177" lims:id="357177"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357178" lims:id="357178">Reasonable refusal</MarginalNote><Label>(5)</Label><Text>Subsection (4) does not apply in the event of the seaman reasonably refusing to submit to surgical aid.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2013-10-30" lims:fid="357180" lims:id="357180">R.S., 1985, c. level="1"><TitleText>Scale of Compensation</TitleText></Heading><Section lims:inforce-start-date="2013-10-30" lims:lastAmendedDate="2013-10-30" lims:fid="357199" lims:id="357199"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357200" lims:id="357200">Amounts of compensation</MarginalNote><Label>31</Label><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357201" lims:id="357201"><Label>(1)</Label><Text>Where the death of a seaman results from an injury, the following amounts of compensation shall be paid:</Text><Paragraph lims:inforce-start-date="2013-10-30" lims:fid="357202" lims:id="357202"><Label>(a)</Label><Text>the necessary expenses of burial of the seaman not exceeding seven hundred and forty-two dollars;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-10-30" lims:fid="357203" lims:id="357203"><Label>(b)</Label><Text>in addition to the sum mentioned in paragraph (a), a sum not exceeding one hundred and twenty-five dollars for necessary expenses for transportation and things supplied and services rendered in connection therewith necessitated by the transfer of the body of a seaman from the place of death to the place of interment;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-10-30" lims:fid="357204" lims:id="357204"><Label>(c)</Label><Text>if the expenses of burial of a seaman are paid by an employer under section 93 of the <XRefExternal reference-type="act" link="C-10.15">Canada Shipping Act, 2001</XRefExternal> following any accident in respect of which compensation is payable under this Act, the amount of the expenses shall be deducted from the amount payable under paragraphs (a) and (b);</Text></Paragraph><Paragraph lims:inforce-start-date="2013-10-30" lims:fid="357205" lims:id="357205"><Label>(d)</Label><Text>where the survivor is the sole dependant, a monthly payment of $1,451.92;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-10-30" lims:fid="357206" lims:id="357206"><Label>(e)</Label><Text>where the dependants are a survivor and one or more children, a monthly payment of $1,451.92 with an additional monthly payment of $161.18 to be increased on the death of the survivor to $164.93</Text><Subparagraph lims:inforce-start-date="2013-10-30" lims:fid="357207" lims:id="357207"><Label>(i)</Label><Text>for each child under the age of eighteen years, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-10-30" lims:fid="357208" lims:id="357208"><Label>(ii)</Label><Text>with the Minister’s approval, for each child under the age of 21 years who is attending school;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2013-10-30" lims:fid="357209" lims:id="357209"><Label>(f)</Label><Text>where the dependants are children only, a monthly payment of one hundred and fifteen dollars</Text><Subparagraph lims:inforce-start-date="2013-10-30" lims:fid="357210" lims:id="357210"><Label>(i)</Label><Text>to each child under the age of eighteen years, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-10-30" lims:fid="357211" lims:id="357211"><Label>(ii)</Label><Text>with the Minister’s approval, to each child under the age of 21 years who is attending school; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2013-10-30" lims:fid="357212" lims:id="357212"><Label>(g)</Label><Text>if the dependants are persons other than those mentioned in paragraphs (d) to (f), a reasonable sum that is proportionate to the pecuniary loss to those dependants occasioned by the death, to be determined by the Minister.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357213" lims:id="357213"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357214" lims:id="357214">If no survivor</MarginalNote><Label>(2)</Label><Text>If a seaman leaves no survivor or the survivor subsequently dies, and a competent authority has appointed a person to care for the children who are entitled to compensation, the Minister may pay that person the same monthly payments of compensation as if that person were the survivor of the deceased, and in that case the children’s part of the payments shall be in lieu of the monthly payments that they would otherwise have been entitled to receive.</Text></Subsection><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357215" lims:id="357215"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357216" lims:id="357216">Additional sum</MarginalNote><Label>(3)</Label><Text>In addition to any other compensation provided for under this section, the survivor or, where the seaman leaves no survivor, the foster-parent, as described in subsection (2), is entitled to a lump sum of $16,868.50.</Text></Subsection><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357217" lims:id="357217"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357218" lims:id="357218">Duration of payments</MarginalNote><Label>(4)</Label><Text>In the case provided for by paragraph (1)(g), the payments shall continue only so long as, in the Minister’s opinion, it might reasonably have been expected that the seaman, had they lived, would have continued to contribute to the support of the dependants, and, in any case under that paragraph, compensation may be made wholly or partly in a lump sum or by any form of payment that the Minister considers most suitable in the circumstances.</Text></Subsection><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357219" lims:id="357219"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357220" lims:id="357220">Dependant to whom seaman stood in place of parent</MarginalNote><Label>(5)</Label><Text>A dependant to whom the seaman stood in the place of a parent or a dependant who stood in the place of a parent to the seaman is entitled, as the Minister may determine, to share in or receive compensation under paragraph (1)(e), (f) or (g).</Text></Subsection><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357221" lims:id="357221"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357222" lims:id="357222">Disabled child</MarginalNote><Label>(6)</Label><Text>Compensation is payable to a disabled child without regard to their age, and payments to the child shall continue until, in the Minister’s opinion, the child ceases to be disabled.</Text></Subsection><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357223" lims:id="357223"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357224" lims:id="357224">Total and partial dependants</MarginalNote><Label>(7)</Label><Text>Where there are both total and partial dependants, the compensation may be allotted partly to the total and partly to the partial dependants.</Text></Subsection><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357225" lims:id="357225"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357226" lims:id="357226">Payments to other persons</MarginalNote><Label>(8)</Label><Text>If the Minister is of the opinion that it is desirable that a payment in respect of a child should not be made directly to their parent, the Minister may direct that the payment be made to any person or be applied in any manner that he or she considers most advantageous for the child.</Text></Subsection><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357227" lims:id="357227"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357228" lims:id="357228">Maximum compensation</MarginalNote><Label>(9)</Label><Text>Exclusive of the expenses of burial of the seaman and the lump sum of eight hundred and thirty-three dollars referred to in subsection (3), the compensation payable as provided by subsection (1) shall not in any case exceed seventy-five per cent of the average earnings of the seaman mentioned in section 36, and if the compensation payable under subsection (1) would in any case exceed that percentage, it shall be reduced accordingly, and where several persons are entitled to monthly payments the payments shall be reduced proportionately, but the minimum compensation shall be</Text><Paragraph lims:inforce-start-date="2013-10-30" lims:fid="357229" lims:id="357229"><Label>(a)</Label><Text>where the survivor is the sole dependant, a monthly payment of $1,451.92, or if the seaman’s average earnings are less than $1,451.92 per month, the amount of those earnings; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-10-30" lims:fid="357230" lims:id="357230"><Label>(b)</Label><Text>where the dependants are a survivor and one or more children, a monthly payment of $1,613.10 for the survivor and one child irrespective of the amount of the seaman’s earnings, with a further monthly payment of $161.18 for each additional child unless the total monthly compensation exceeds the seaman’s average earnings, in which case the compensation shall be a sum equal to those earnings or $1,613.10, whichever is the greater, the share for each child entitled to compensation being reduced proportionately.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2013-10-30" lims:fid="357232" lims:id="357232">R.S., 1985, c. M-6, s. 31; R.S., 1985, c. 31 (1st Supp.), s. 81; 2000, c. 12, s. 188; 2001, c. 26, s. 308; 2012, c. 31, s. 248</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2013-10-30" lims:lastAmendedDate="2013-10-30" lims:fid="357233" lims:id="357233"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357234" lims:id="357234">Payment of additional compensation</MarginalNote><Label>32</Label><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357235" lims:id="357235"><Label>(1)</Label><Text>In addition to the amounts of compensation payable under section 31 to dependants of a seaman as a result of his death from an accident, there shall be paid,</Text><Paragraph lims:inforce-start-date="2013-10-30" lims:fid="357236" lims:id="357236"><Label>(a)</Label><Text>where the survivor of the seaman is the sole dependant, a monthly payment equal to the amount remaining, if any, after subtracting from $100 the amount of any monthly payment payable to that person pursuant to section 31;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-10-30" lims:fid="357237" lims:id="357237"><Label>(b)</Label><Text>where the dependants are a survivor and one or more children,</Text><Subparagraph lims:inforce-start-date="2013-10-30" lims:fid="357238" lims:id="357238"><Label>(i)</Label><Text>a monthly payment equal to the amount remaining, if any, after subtracting from $100 the amount of any monthly payment payable to that survivor pursuant to section 31, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-10-30" lims:fid="357239" lims:id="357239"><Label>(ii)</Label><Text>an additional monthly payment for each child equal to the amount remaining, if any, after subtracting from $35 the amount of any monthly payment payable pursuant to section 31 for that child, that payment to be increased on the death of the survivor to an amount equal to the amount remaining, if any, after subtracting from $45 the amount of any monthly payment payable pursuant to section 31 to that child; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2013-10-30" lims:fid="357240" lims:id="357240"><Label>(c)</Label><Text>where the dependants are children only, a monthly payment to each child equal to the amount remaining, if any, after subtracting from forty-five dollars the amount of any monthly payment payable pursuant to section 31 to that child.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357241" lims:id="357241"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357242" lims:id="357242">Dependent minors attending school</MarginalNote><Label>(2)</Label><Text>In addition to the amounts of compensation payable under section 31 to or for a seaman’s dependent children as a result of the seaman’s death from an accident incurred before May 1, 1965, there shall be paid, with the Minister’s approval, to or for each dependent child under the age of 21 years who is attending school, the compensation that would have been payable had the accident from which the death of the seaman resulted occurred on or after May 1, 1965.</Text></Subsection><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357243" lims:id="357243"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357244" lims:id="357244">Payment made out of C.R.F.</MarginalNote><Label>(3)</Label><Text>The amounts payable pursuant to this section shall be paid out of the Consolidated Revenue Fund and shall be paid subject to the same terms and conditions as apply to the compensation payable pursuant to the other provisions of this Act.</Text></Subsection><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357245" lims:id="357245"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357246" lims:id="357246">“Section 31”</MarginalNote><Label>(4)</Label><Text>In this section, the expression “section 31” means that section as it read at the date of the accident to the seaman in respect of whose resulting death compensation is payable.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2013-10-30" lims:fid="357248" lims:id="357248">R.S., 1985, c. M-11, s. 33</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2013-10-30" lims:lastAmendedDate="2013-10-30" lims:fid="357263" lims:id="357263"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357264" lims:id="357264">Permanent partial disability</MarginalNote><Label>37</Label><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357265" lims:id="357265"><Label>(1)</Label><Text>Where permanent partial disability of a seaman results from an injury, the impairment of earning capacity of the seaman shall be estimated from the nature and degree of the injury, and the compensation shall be a weekly payment during the lifetime of the seaman in the same proportion to the weekly payment payable under section 36 as the impairment of earning capacity is to total earning capacity.</Text></Subsection><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357266" lims:id="357266"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357267" lims:id="357267">Difference in earnings before and after accident</MarginalNote><Label>(2)</Label><Text>If the Minister considers it more equitable to do so, he or she may award compensation for permanent partial disability, having regard to the difference between the seaman’s average weekly earnings before the accident and the average amount that they are earning or are able to earn in a suitable employment or business after the accident, and the compensation may be a weekly payment of 75% of the difference, and regard shall be had to the seaman’s fitness to continue the employment in the course of which they were injured or to adapt themselves to some other suitable occupation.</Text></Subsection><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357268" lims:id="357268"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357269" lims:id="357269">Rating schedule</MarginalNote><Label>(3)</Label><Text>The Minister may compile a rating schedule of percentages of impairment of earning capacity for specified injuries or mutilations that may be used as a guide in determining the compensation payable in permanent partial disability cases.</Text></Subsection><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357270" lims:id="357270"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357271" lims:id="357271">Fixed amount</MarginalNote><Label>(4)</Label><Text>Despite subsections (1) and (2), if the impairment of the seaman’s earning capacity does not exceed 10% of their earning capacity, instead of a weekly payment payable under those subsections, the Minister may, unless he or she is of the opinion that it would not be to the seaman’s advantage to do so, fix an amount to be paid to the seaman as full compensation and pay the seaman the amount either in one sum or in periodic payments as the Minister may direct.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2013-10-30" lims:fid="357273" lims:id="357273">R.S., 1985, c. M-11, s. 37; R.S., c. 19(2nd Supp.), s. 5; SOR/74-384; SOR/76-462; SOR/79-892; SOR/81-315; SOR/82-382; SOR/84-911</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2013-10-30" lims:lastAmendedDate="2013-10-30" lims:fid="357286" lims:id="357286"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357287" lims:id="357287">Computation of average earnings</MarginalNote><Label>41</Label><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357288" lims:id="357288"><Label>(1)</Label><Text>Average earnings shall be computed in such a manner as is best calculated to give the rate per week or month at which a seaman was remunerated but not so as in any case to exceed the rate of twenty-seven thousand two hundred and fifty dollars per annum.</Text></Subsection><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357289" lims:id="357289"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357290" lims:id="357290">In case of shortness of employment</MarginalNote><Label>(2)</Label><Text>Where, owing to the shortness of the time during which a seaman was in the employment of his employer or the casual nature of his employment or the terms thereof, it is impracticable to compute the rate of remuneration as of the date of an accident, regard may be had to the average weekly or monthly amount that, during the twelve months previous to the accident, was being earned by a person in the same grade employed at the same work by the same employer, or if there is no person so employed, then by a person in the same grade employed in the same class of employment on a ship of the same class.</Text></Subsection><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357291" lims:id="357291"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357292" lims:id="357292">Definition of <DefinedTermEn>employment by the same employer</DefinedTermEn></MarginalNote><Label>(3)</Label><Text>For the purpose of this section, the expression <DefinedTermEn>employment by the same employer</DefinedTermEn> means employment by the same employer in the grade in which the seaman was employed at the time of the accident, uninterrupted by absence from work due to illness or any other unavoidable cause.</Text></Subsection><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357293" lims:id="357293"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357294" lims:id="357294">Special expenses not counted</MarginalNote><Label>(4)</Label><Text>Where an employer was accustomed to pay a seaman a sum to cover any special expense entailed on him by the nature of his employment, that sum shall not be reckoned as part of his earnings.</Text></Subsection><Subsection lims:inforce-start-date="2013-10-30" lims:fid="357295" lims:id="357295"><MarginalNote lims:inforce-start-date="2013-10-30" lims:fid="357296" lims:id="357296">Earnings at time of accident considered</MarginalNote><Label>(5)</Label><Text>If in any case it seems more equitable to do so, the Minister may award compensation, having regard to a seaman’s earnings at the time of an accident.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2013-10-30" lims:fid="357298" lims:id="357298">R.S., 1985, c.
