link="M-0.8">Marine Transportation Security Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2008-06-18" lims:fid="352597" lims:id="352597" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2007-07-01" lims:lastAmendedDate="2007-07-01" lims:fid="352598" lims:id="352598"><MarginalNote lims:inforce-start-date="2007-07-01" lims:fid="352599" lims:id="352599">Definitions</MarginalNote><Label>2</Label><Subsection lims:inforce-start-date="2007-07-01" lims:fid="352600" lims:id="352600"><Label>(1)</Label><Text>In this Act,</Text><Definition lims:inforce-start-date="2007-07-01" lims:fid="352601" lims:id="352601"><Text><DefinedTermEn>authorized screening</DefinedTermEn> means anything authorized or required to be done under any regulation, security measure or security rule for the control, observation, inspection and search of persons or goods to prevent the unauthorized possession or carriage of weapons, explosives and incendiaries on board vessels and at marine facilities; (<DefinedTermFr>contrôle</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2007-07-01" lims:fid="352602" lims:id="352602"><Text> <DefinedTermEn>Canadian ship</DefinedTermEn> means a vessel registered under the <XRefExternal reference-type="act" link="C-10.15">Canada Shipping Act, 2001</XRefExternal>  or registered in Canada before August 1, 1936 under the <XRefExternal reference-type="act">Merchant Shipping Act, 1894</XRefExternal>  of the Parliament of the United Kingdom, 57-58 Victoria, chapter 60, and all Acts adding to or amending that Act; (<DefinedTermFr>navire canadien</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2007-07-01" lims:fid="352603" lims:id="352603"><Text><DefinedTermEn>goods</DefinedTermEn> means anything that may be taken or placed on board a vessel, including personal belongings, baggage and cargo; (<DefinedTermFr>bien</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2007-07-01" lims:fid="352604" lims:id="352604"><Text><DefinedTermEn>marine facility</DefinedTermEn> includes</Text><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="352605" lims:id="352605"><Label>(a)</Label><Text>an area of land, water, ice or other supporting surface used, designed, prepared, equipped or set apart for use, either in whole or in part, for the arrival, departure, movement or servicing of vessels,</Text></Paragraph><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="352606" lims:id="352606"><Label>(b)</Label><Text>buildings, installations and equipment on the area, associated with it or used or set apart for handling or storing goods that have been or are destined to be transported on a vessel,</Text></Paragraph><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="352607" lims:id="352607"><Label>(c)</Label><Text>equipment and facilities used to provide services relating to marine transportation, and</Text></Paragraph><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="352608" lims:id="352608"><Label>(d)</Label><Text>marine installations and structures, as defined in section 2 of the <XRefExternal reference-type="act">Canadian Laws Offshore Application Act</XRefExternal>; (<DefinedTermFr>installation maritime</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2007-07-01" lims:fid="352609" lims:id="352609"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Transport; (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2007-07-01" lims:fid="352610" lims:id="352610"><Text><DefinedTermEn>operator</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="352611" lims:id="352611"><Label>(a)</Label><Text>when used in respect of a vessel,</Text><Subparagraph lims:inforce-start-date="2007-07-01" lims:fid="352612" lims:id="352612"><Label>(i)</Label><Text>the actual owner of the vessel, if it is not registered, or the registered owner, if it is registered,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2007-07-01" lims:fid="352613" lims:id="352613"><Label>(ii)</Label><Text>a person having a beneficial interest in the vessel, including an interest arising under contract and any other equitable interest, other than an interest by way of a mortgage,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2007-07-01" lims:fid="352614" lims:id="352614"><Label>(iii)</Label><Text>a lessee or charterer of the vessel who is responsible for its navigation, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2007-07-01" lims:fid="352615" lims:id="352615"><Label>(iv)</Label><Text>a master or other person who has command or charge of the vessel, other than a pilot, and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="352616" lims:id="352616"><Label>(b)</Label><Text>when used in respect of a marine facility, a person who has the charge, management and control of the facility, whether on that person’s own account or as an agent of another person; (<DefinedTermFr>exploitant</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2007-07-01" lims:fid="352617" lims:id="352617"><Text><DefinedTermEn>proposed security rule</DefinedTermEn> means a rule submitted for the approval of the Minister under section 10; (<DefinedTermFr>règle de sûreté proposée</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2007-07-01" lims:fid="352618" lims:id="352618"><Text><DefinedTermEn>restricted area</DefinedTermEn> means an area established under any regulation, security measure or security rule to which access is restricted to authorized persons; (<DefinedTermFr>zone réglementée</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2007-07-01" lims:fid="352619" lims:id="352619"><Text><DefinedTermEn>screening officer</DefinedTermEn> means a person designated by the Minister under section 19.1 as a screening officer for the purposes of this Act; (<DefinedTermFr>agent de contrôle</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2007-07-01" lims:fid="352620" lims:id="352620"><Text><DefinedTermEn>security inspector</DefinedTermEn> means a person designated by the Minister under section 22 as a security inspector for the purposes of this Act; (<DefinedTermFr>inspecteur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2007-07-01" lims:fid="352621" lims:id="352621"><Text><DefinedTermEn>security measure</DefinedTermEn> means a measure formulated by the Minister under section 7; (<DefinedTermFr>mesure de sûreté</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2007-07-01" lims:fid="352622" lims:id="352622"><Text><DefinedTermEn>security rule</DefinedTermEn> means a rule approved by the Minister under section 10; (<DefinedTermFr>règle de sûreté</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2007-07-01" lims:fid="352623" lims:id="352623"><Text> <DefinedTermEn>Tribunal</DefinedTermEn> means the Transportation Appeal Tribunal of Canada established by subsection 2(1) of the <XRefExternal reference-type="act" link="T-18.5">Transportation Appeal Tribunal of Canada Act</XRefExternal> ; (<DefinedTermFr>Tribunal</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2007-07-01" lims:fid="352624" lims:id="352624"><Text><DefinedTermEn>vessel</DefinedTermEn> includes a dredge, floating elevator, floating home, floating oil rig, seaplane, raft, log or lumber boom, air cushion vehicle and any type of ship, boat or craft used or capable of being used for marine navigation, regardless of how it is propelled. (<DefinedTermFr>bâtiment</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2007-07-01" lims:fid="352625" lims:id="352625"><MarginalNote lims:inforce-start-date="2007-07-01" lims:fid="352626" lims:id="352626">References to the Minister</MarginalNote><Label>(2)</Label><Text>Where a provision of this Act authorizes or requires the Minister to do anything, the Minister may authorize it to be done by a person appointed to serve in the Department of Transport in an appropriate capacity and references to the Minister in the level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="352630" lims:id="352630"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352631" lims:id="352631">Binding on Her Majesty</MarginalNote><Label>3</Label><Text>This Act is binding on Her Majesty in right of Canada or a province.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="352632" lims:id="352632"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352633" lims:id="352633">Application to vessels and marine facilities</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352634" lims:id="352634"><Label>(1)</Label><Text>Subject to subsections (2) and (3), this Act applies in respect of</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352635" lims:id="352635"><Label>(a)</Label><Text>vessels and marine facilities in Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352636" lims:id="352636"><Label>(b)</Label><Text>Canadian ships outside Canada; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352637" lims:id="352637"><Label>(c)</Label><Text>marine installations and structures, as provided in sections 5 and 6 of the <XRefExternal reference-type="act">Canadian Laws Offshore Application Act</XRefExternal>.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352638" lims:id="352638"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352639" lims:id="352639">Limitation</MarginalNote><Label>(2)</Label><Text>This Act does not apply so as to require or authorize any person outside Canada to contravene the law of a foreign country or any Canadian ship outside Canada to be operated in contravention of that law.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352640" lims:id="352640"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352641" lims:id="352641">Limitation - military vessels, etc.</MarginalNote><Label>(3)</Label><Text>This Act does not apply in respect of</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352642" lims:id="352642"><Label>(a)</Label><Text>vessels and marine facilities operated under the authority of the Minister of National Defence; or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352643" lims:id="352643"><Label>(b)</Label><Text>military vessels of a foreign country to the extent that the Minister of National Defence may exempt them from the application of this Act.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2008-06-18" lims:fid="352644" lims:id="352644" level="1"><TitleText>Regulations</TitleText></Heading><Section lims:inforce-start-date="2005-06-30" lims:lastAmendedDate="2005-06-30" lims:fid="352645" lims:id="352645"><MarginalNote lims:inforce-start-date="2005-06-30" lims:fid="352646" lims:id="352646">Regulations respecting security</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2005-06-30" lims:fid="352647" lims:id="352647"><Label>(1)</Label><Text>The Governor in Council may make regulations respecting the security of marine transportation, including regulations</Text><Paragraph lims:inforce-start-date="2005-06-30" lims:fid="352648" lims:id="352648"><Label>(a)</Label><Text>for preventing unlawful interference with marine transportation and ensuring that appropriate action is taken where that interference occurs or could occur;</Text></Paragraph><Paragraph lims:inforce-start-date="2005-06-30" lims:fid="352649" lims:id="352649"><Label>(b)</Label><Text>requiring or authorizing screening for the purpose of protecting persons, goods, vessels and marine facilities;</Text></Paragraph><Paragraph lims:inforce-start-date="2005-06-30" lims:fid="352650" lims:id="352650"><Label>(c)</Label><Text>respecting the establishment of restricted areas;</Text></Paragraph><Paragraph lims:inforce-start-date="2005-06-30" lims:fid="352651" lims:id="352651"><Label>(d)</Label><Text>respecting the keeping and preservation of records and documents relating to the security of marine operations, including copies of the regulations, security measures and security rules;</Text></Paragraph><Paragraph lims:inforce-start-date="2005-06-30" lims:fid="352652" lims:id="352652"><Label>(e)</Label><Text>for requiring the records and documents to be filed with the Minister or provided on request; and</Text></Paragraph><Paragraph lims:inforce-start-date="2005-06-30" lims:fid="352653" lims:id="352653"><Label>(f)</Label><Text>respecting the protection, preservation and return of any evidence that has been seized under this Act without a warrant or any vessel that has been detained under this Act.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2005-06-30" lims:fid="352654" lims:id="352654"><MarginalNote lims:inforce-start-date="2005-06-30" lims:fid="352655" lims:id="352655">Offences relating to the regulations</MarginalNote><Label>(2)</Label><Text>Every person who contravenes a regulation made under subsection (1) is guilty of an offence punishable on summary conviction and liable</Text><Paragraph lims:inforce-start-date="2005-06-30" lims:fid="352656" lims:id="352656"><Label>(a)</Label><Text>in the case of an individual, to a fine not exceeding $5,000 or to imprisonment for a term not exceeding six months or to both; or</Text></Paragraph><Paragraph lims:inforce-start-date="2005-06-30" lims:fid="352657" lims:id="352657"><Label>(b)</Label><Text>in the case of a corporation, to a fine not exceeding $100,000.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:id="352662"><Label>(a)</Label><Text>the form and manner of giving notice under this Act; and</Text></Paragraph><Paragraph lims:inforce-start-date="2005-06-30" lims:fid="352663" lims:id="352663"><Label>(b)</Label><Text>the service of documents required or authorized to be served under this Act, including the manner of serving them, the proof of their service and the Measures</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="352667" lims:id="352667"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352668" lims:id="352668">Minister may formulate security measures</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352669" lims:id="352669"><Label>(1)</Label><Text>The Minister may formulate measures respecting the security of marine transportation, including measures containing provisions that may be included in the regulations.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352670" lims:id="352670"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352671" lims:id="352671">Operators to carry out security measures</MarginalNote><Label>(2)</Label><Text>The Minister may, by notice in writing, require or authorize the operator of a vessel or marine facility to carry out the security measures, and the measures may apply instead of or in addition to any provision of the regulations.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="352672" lims:id="352672"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352673" lims:id="352673">Minister may carry out security measures</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352674" lims:id="352674"><Label>(1)</Label><Text>The Minister may carry out security measures on any vessel or at any marine facility where the Minister considers that the security of persons or goods is not adequately protected or is not protected in accordance with this Act, the regulations and any applicable security measures and security rules.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352675" lims:id="352675"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352676" lims:id="352676">Liability for costs</MarginalNote><Label>(2)</Label><Text>The operators of the vessel or marine facility are jointly and severally liable to Her Majesty in right of Canada for the costs incurred by the Minister in carrying out the security measures.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="352677" lims:id="352677"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352678" lims:id="352678">Offences relating to security measures</MarginalNote><Label>9</Label><Text>Every operator who does not carry out security measures that the operator is required to carry out, and every person who wilfully obstructs a person who is carrying out security measures, is guilty of an offence and liable</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352679" lims:id="352679"><Label>(a)</Label><Text>on conviction on indictment</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="352680" lims:id="352680"><Label>(i)</Label><Text>in the case of an individual, to a fine not exceeding $10,000 or to imprisonment for a term not exceeding one year or to both, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="352681" lims:id="352681"><Label>(ii)</Label><Text>in the case of a corporation, to a fine not exceeding $200,000; or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352682" lims:id="352682"><Label>(b)</Label><Text>on summary conviction</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="352683" lims:id="352683"><Label>(i)</Label><Text>in the case of an individual, to a fine not exceeding $5,000 or to imprisonment for a term not exceeding six months or to both, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="352684" lims:id="352684"><Label>(ii)</Label><Text>in the case of a corporation, to a fine not exceeding $100,000.</Text></Subparagraph></Paragraph></Section><Heading lims:inforce-start-date="2008-06-18" lims:fid="352685" lims:id="352685" level="1"><TitleText>Security Rules</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="352686" lims:id="352686"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352687" lims:id="352687">Purpose of section</MarginalNote><Label>10</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352688" lims:id="352688"><Label>(1)</Label><Text>The purpose of this section is to allow operators of vessels and marine facilities to formulate and operate under security rules as an alternative to security measures required or authorized by the Minister, but this section does not limit the authority of the Minister to require or authorize security measures.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352689" lims:id="352689"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352690" lims:id="352690">Formulation of rules</MarginalNote><Label>(2)</Label><Text>The operator of a vessel or marine facility may formulate rules respecting any matter relating to the security of the vessel or facility and the operator may submit the rules to the Minister for approval.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352691" lims:id="352691"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352692" lims:id="352692">Minister may request rules</MarginalNote><Label>(3)</Label><Text>The Minister may, by notice in writing, request the operator of a vessel or marine facility</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352693" lims:id="352693"><Label>(a)</Label><Text>to formulate rules respecting any matter specified in the notice relating to the security of the vessel or facility; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352694" lims:id="352694"><Label>(b)</Label><Text>to submit the rules to the Minister within any period specified in the notice.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352695" lims:id="352695"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352696" lims:id="352696">Consultation</MarginalNote><Label>(4)</Label><Text>Before submitting the rules, the operator shall consult persons who are likely to be directly affected by the rules, including any persons specified in the notice by the Minister.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352697" lims:id="352697"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352698" lims:id="352698">Results of consultation</MarginalNote><Label>(5)</Label><Text>When submitting the rules, the operator shall also submit a statement identifying the persons consulted and describing any disagreement they may have expressed about the rules.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352699" lims:id="352699"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352700" lims:id="352700">Approval of rules</MarginalNote><Label>(6)</Label><Text>Within one hundred and twenty days after the rules have been submitted, the Minister shall decide whether to approve them and shall notify the operator of the decision in writing and, if the Minister approves the rules,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352701" lims:id="352701"><Label>(a)</Label><Text>the Minister may make the approval subject to any conditions the Minister considers appropriate;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352702" lims:id="352702"><Label>(b)</Label><Text>the operator shall notify the persons who were consulted that the rules have been approved; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352703" lims:id="352703"><Label>(c)</Label><Text>the operator shall carry out the rules and any conditions of their approval until the approval is revoked.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352704" lims:id="352704"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352705" lims:id="352705">Rules not approved</MarginalNote><Label>(7)</Label><Text>If the Minister decides not to approve the rules, the Minister shall give the operator reasons for the decision and the Minister may request the operator to revise and resubmit the rules within any period that the Minister may specify.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352706" lims:id="352706"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352707" lims:id="352707">Amendments to security rules</MarginalNote><Label>(8)</Label><Text>Amendments to security rules may be submitted and approved in the same way as are the security rules they amend and, when approved, have the same effect.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352708" lims:id="352708"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352709" lims:id="352709">Revocation of approval</MarginalNote><Label>(9)</Label><Text>The Minister may revoke the approval of security rules, either at the request of the operator or Minister has reasonable grounds to believe that a vessel is a threat to the security of any person or thing, including any goods, vessel or marine facility, the Minister may direct the lims:fid="352753" lims:id="352753">Inadequate security measures</MarginalNote><Label>(2)</Label><Text>The Minister may direct that a vessel registered outside Canada remain outside Canada, proceed out of Canada or not enter or dock at a marine facility if the Minister has reasonable grounds to believe that the vessel or any persons or goods on board it have not been subjected to screening or other measures equivalent to the authorized screening or other measures that would apply under this Act if the vessel were registered in Canada.</Text></Subsection><Subsection for the purpose may grant a stay of the decision until the review is completed, unless he or she is of the opinion that granting a stay would constitute a threat to marine transportation Minister for reconsideration under paragraph 19.5(4)(a) or 19.6(3)(a), the decision of the Minister under subsection 19.2(1) or (3) to suspend or cancel a designation remains in effect until the reconsideration is concluded. However, the member who made the determination or the appeal panel, after considering any representations made by the parties, may grant a stay of a decision under subsection 19.2(1) to suspend or cancel a designation until the reconsideration is concluded, if the member or panel is satisfied that granting a stay would not constitute a threat to marine transportation security.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2005-06-30" lims:fid="352838" lims:id="352838">2001, c. 29, s. 57</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2005-06-30" lims:lastAmendedDate="2005-06-30" lims:fid="352839" lims:id="352839"><MarginalNote lims:inforce-start-date="2005-06-30" lims:fid="352840" lims:id="352840">Reconsideration</MarginalNote><Label>19.8</Label><Subsection lims:inforce-start-date="2005-06-30" lims:fid="352841" lims:id="352841"><Label>(1)</Label><Text>In the case of a decision made under subsection 19.2(3), if the appeal panel has, on an appeal under section 19.6, dismissed the appeal or if the Minister has, after reconsidering the matter pursuant to paragraph 19.5(4)(a) or 19.6(3)(a), confirmed the suspension, the person affected by the decision may, in writing, request the Minister to reconsider whether the exercise by the person of the functions of a screening officer continues to constitute, or is likely to continue to constitute, an immediate threat to marine transportation security.</Text></Subsection><Subsection lims:inforce-start-date="2005-06-30" lims:fid="352842" lims:id="352842"><MarginalNote lims:inforce-start-date="2005-06-30" lims:fid="352843" lims:id="352843">Procedure applicable</MarginalNote><Label>(2)</Label><Text>On the receipt of a request by a person under subsection (1), the Minister shall without delay conduct the reconsideration and inform the person of his or her decision regarding the request. lims:inforce-start-date="2002-12-31" lims:fid="352848" lims:id="352848"><Label>(1)</Label><Text>A screening officer may require a person or any goods to undergo authorized screening before the person or goods come on board a vessel or enter a restricted area and, where so required,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352849" lims:id="352849"><Label>(a)</Label><Text>the person shall not board the vessel or enter the restricted area unless the person has undergone the authorized screening; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352850" lims:id="352850"><Label>(b)</Label><Text>no person shall bring the goods on board the vessel or into the restricted area unless the goods have undergone the authorized screening.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352851" lims:id="352851"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352852" lims:id="352852">Screening after boarding or in restricted areas</MarginalNote><Label>(2)</Label><Text>A screening officer may require a person on board a vessel or in a restricted area to undergo authorized screening and, if the person refuses,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352853" lims:id="352853"><Label>(a)</Label><Text>the officer may order the person to leave the vessel or restricted area and to remove from it any goods that the person took or had placed there; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352854" lims:id="352854"><Label>(b)</Label><Text>the person shall leave the vessel or restricted area and remove or permit the removal of the goods immediately or, in the case of a vessel that is not docked, at the first reasonable opportunity.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352855" lims:id="352855"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352856" lims:id="352856">Unaccompanied goods</MarginalNote><Label>(3)</Label><Text>A screening officer may carry out authorized screening of any goods that are received at a marine facility for transport on a vessel and are not accompanied by a person who may give permission for the screening and the officer may use any force that is reasonably necessary to gain access to the goods.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352857" lims:id="352857"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352858" lims:id="352858">False or misleading information</MarginalNote><Label>(4)</Label><Text>Every person who knowingly makes any false or misleading statement to a screening officer, or knowingly provides false or misleading information to a screening officer, is guilty of an offence punishable on summary conviction and liable to a fine not exceeding $5,000 or to imprisonment for a term not exceeding six months or to both.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352859" lims:id="352859"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352860" lims:id="352860">Circumventing authorized screening</MarginalNote><Label>(5)</Label><Text>Every person who contravenes subsection (2) or who wilfully circumvents authorized screening in any manner is guilty of an offence and liable</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352861" lims:id="352861"><Label>(a)</Label><Text>on conviction on indictment, to a fine not exceeding $10,000 or to imprisonment for a term not exceeding one year or to both; or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352862" lims:id="352862"><Label>(b)</Label><Text>on summary conviction, to a fine not exceeding $5,000 or to imprisonment for a term not exceeding six months or to both.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="352863" lims:id="352863"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352864" lims:id="352864">Operators to post notices</MarginalNote><Label>21</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352865" lims:id="352865"><Label>(1)</Label><Text>When authorized screening is required or authorized on a vessel or at a marine facility, the operator of the vessel or facility shall post notices stating that</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352866" lims:id="352866"><Label>(a)</Label><Text>authorized screening is being carried out;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352867" lims:id="352867"><Label>(b)</Label><Text>no person is obliged to undergo authorized screening of their person if they choose not to board a vessel or enter a restricted area; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352868" lims:id="352868"><Label>(c)</Label><Text>no person is obliged to permit authorized screening of their goods if they choose not to have the goods placed on board the vessel or in the restricted area.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352869" lims:id="352869"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352870" lims:id="352870">Placement and languages of notices</MarginalNote><Label>(2)</Label><Text>The notices must be posted in prominent places where authorized screening is carried out and they must be written in both of the official languages of Canada and may, in addition, be written in any other language.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352871" lims:id="352871"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352872" lims:id="352872">Offence</MarginalNote><Label>(3)</Label><Text>Every person who contravenes this section is guilty of an offence punishable on summary conviction and liable</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352873" lims:id="352873"><Label>(a)</Label><Text>in the case of an individual, to a fine not exceeding $1,000; or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352874" lims:id="352874"><Label>(b)</Label><Text>in the case of a corporation, to a fine not exceeding $10,000.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2008-06-18" lims:fid="352875" lims:id="352875" level="1"><TitleText>Enforcement</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="352876" lims:id="352876"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352877" lims:id="352877">Designation of security inspectors</MarginalNote><Label>22</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352878" lims:id="352878"><Label>(1)</Label><Text>The Minister may designate persons or classes of persons whom the Minister considers qualified to act as security inspectors for the purposes of this Act or any of its provisions.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352879" lims:id="352879"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352880" lims:id="352880">Certificate of designation</MarginalNote><Label>(2)</Label><Text>The Minister shall furnish every security inspector with a certificate of designation as a security inspector and, on entering any place or inspecting anything, a security inspector shall show the certificate to the person apparently in charge of the place or thing if the person requests proof of the security inspector’s designation.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="352881" lims:id="352881"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352882" lims:id="352882">Inspection of vessels and marine facilities</MarginalNote><Label>23</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352883" lims:id="352883"><Label>(1)</Label><Text>For the purpose of ensuring compliance with this Act and any regulation, security measure or security rule, a security inspector may at any reasonable time, but subject to subsection (3), board and inspect any vessel or enter and inspect any marine facility if the inspector is designated to inspect the vessel or facility.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352884" lims:id="352884"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352885" lims:id="352885">Powers of inspector</MarginalNote><Label>(2)</Label><Text>When conducting the inspection, the security inspector may</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352886" lims:id="352886"><Label>(a)</Label><Text>require the attendance of and question any person who the inspector considers will be able to assist in the inspection;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352887" lims:id="352887"><Label>(b)</Label><Text>require any person to produce for inspection and copying any document that the inspector believes, on reasonable grounds, contains any information relevant to the administration of this Act or the regulation, security measure or security rule;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352888" lims:id="352888"><Label>(c)</Label><Text>seize anything found in the course of the inspection that the inspector believes, on reasonable grounds, will afford evidence with respect to an offence under this Act; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352889" lims:id="352889"><Label>(d)</Label><Text>detain any vessel that the inspector believes, on reasonable grounds, is a threat to the security of any person, goods, vessel or marine facility, until the inspector is satisfied that the vessel is no longer such a threat.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352890" lims:id="352890"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352891" lims:id="352891">Warrant required to enter dwelling-place</MarginalNote><Label>(3)</Label><Text>A security inspector may not enter a dwelling-place except under the authority of a warrant or with the consent of the occupant or person apparently in charge of it.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352892" lims:id="352892"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352893" lims:id="352893">Authority to issue warrant</MarginalNote><Label>(4)</Label><Text>Where on <Language xml:lang="la">ex parte</Language> application a justice, as defined in section 2 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, is satisfied by information on oath that</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352894" lims:id="352894"><Label>(a)</Label><Text>the conditions for entry described in subsection (1) exist in relation to a dwelling-place,</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352895" lims:id="352895"><Label>(b)</Label><Text>entry is necessary for any purpose relating to the administration or enforcement of this Act, and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352896" lims:id="352896"><Label>(c)</Label><Text>entry has been refused or there are reasonable grounds for believing that entry will be refused,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="352897" lims:id="352897"><Text>the justice may at any time sign and issue a warrant authorizing the security inspector named in the warrant to enter the dwelling-place subject to any conditions that may be specified in the warrant.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352898" lims:id="352898"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352899" lims:id="352899">Use of force</MarginalNote><Label>(5)</Label><Text>The security inspector who executes the warrant shall not use force unless the inspector is accompanied by a peace officer and the use of force has been specifically authorized in the warrant.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="352900" lims:id="352900"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352901" lims:id="352901">Search and seizure</MarginalNote><Label>24</Label><Text>For greater certainty, sections 487 to 492 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> apply in relation to this Act, but a security inspector may exercise the powers of search and seizure provided in section 487 without a warrant if the conditions for obtaining a warrant exist but the circumstances are such that the delay necessary to obtain a warrant would result in danger to human life or safety.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="352902" lims:id="352902"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352903" lims:id="352903">Assistance to inspectors</MarginalNote><Label>25</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352904" lims:id="352904"><Label>(1)</Label><Text>The operator of any vessel or marine facility boarded or entered by a security inspector who is carrying out functions under this Act, and every person found there, shall give the inspector all reasonable assistance in that person’s power to enable the inspector to carry out those functions.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352905" lims:id="352905"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352906" lims:id="352906">Obstruction of inspectors</MarginalNote><Label>(2)</Label><Text>When a security inspector is carrying out functions under this Act, no person shall fail to comply with any reasonable request of the inspector or otherwise wilfully obstruct the inspector.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352907" lims:id="352907"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352908" lims:id="352908">Other prohibitions</MarginalNote><Label>(3)</Label><Text>No person shall</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352909" lims:id="352909"><Label>(a)</Label><Text>knowingly make any false or misleading statement or knowingly provide false or misleading information to a security inspector or other person carrying out functions under this Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352910" lims:id="352910"><Label>(b)</Label><Text>wilfully destroy any record or document required to be kept under this Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352911" lims:id="352911"><Label>(c)</Label><Text>make a false entry in a record required to be kept under this Act with intent to mislead, or wilfully omit to make any entry in such a record;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352912" lims:id="352912"><Label>(d)</Label><Text>remove, alter or interfere in any way with anything seized by a security inspector, except with the inspector’s permission; or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="352913" lims:id="352913"><Label>(e)</Label><Text>wilfully operate a vessel that has been detained under this Act, unless authorized to do so under this Act.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="352914" lims:id="352914"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="352915" lims:id="352915">Offence</MarginalNote><Label>(4)</Label><Text>Every person who contravenes this section is guilty of an offence and liable</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:inforce-start-date="2002-12-31" lims:fid="352924" lims:id="352924">Continuing offence</MarginalNote><Label>26</Label><Text>Where an offence is committed or continued on more than one day, the the Minister is of the opinion that it is not in the public interest to do so, five years after the last day on which any of the following events occurs, the Minister is to remove every notation of violation or default, and every suspension or cancellation of the designation of or refusal to designate or to renew the designation of a person as a screening officer on prescribed grounds, from any records that the Minister may keep respecting the person:</Text><Paragraph lims:inforce-start-date="2005-06-30" lims:fid="353089" lims:id="353089"><Label>(a)</Label><Text>payment by the person of every penalty that the person is liable to pay after a notice of violation, a notice of default, a determination of a member of the Tribunal on review or a decision of an appeal panel of the Tribunal; or</Text></Paragraph><Paragraph lims:inforce-start-date="2005-06-30" lims:fid="353090" lims:id="353090"><Label>(b)</Label><Text>the suspension or cancellation of the designation of, or the refusal to designate or to renew the designation of, the person as a screening officer under section 19.2.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2005-06-30" lims:fid="353091" lims:id="353091"><MarginalNote lims:inforce-start-date="2005-06-30" lims:fid="353092" lims:id="353092">Duty to notify</MarginalNote><Label>(2)</Label><Text>When the Minister is of the opinion that removal of a notation is not in the public interest, the Minister shall give notice of that fact to the person.</Text></Subsection><Subsection lims:inforce-start-date="2005-06-30" lims:fid="353093" lims:id="353093"><MarginalNote lims:inforce-start-date="2005-06-30" lims:fid="353094" lims:id="353094">Contents of notice</MarginalNote><Label>(3)</Label><Text>A notice under subsection (2) shall provide all relevant information concerning the grounds on which the Minister has refused to remove the notation and shall include the address at which, and the date, being thirty days after the notice is served, on or before which, a request for a review may be filed.</Text></Subsection><Subsection lims:inforce-start-date="2005-06-30" lims:fid="353095" lims:id="353095"><MarginalNote lims:inforce-start-date="2005-06-30" lims:fid="353096" lims:id="353096">Review</MarginalNote><Label>(4)</Label><Text>Subsections 37(1) to (3) apply in respect of a refusal to remove a notation, with any modifications that the circumstances require.</Text></Subsection><Subsection lims:inforce-start-date="2005-06-30" lims:fid="353097" lims:id="353097"><MarginalNote lims:inforce-start-date="2005-06-30" lims:fid="353098" lims:id="353098">Determination</MarginalNote><Label>(5)</Label><Text>The member of the Tribunal assigned to conduct the review may confirm the Minister’s decision or refer the matter back to the Minister for reconsideration.</Text></Subsection><Subsection lims:inforce-start-date="2005-06-30" lims:fid="353099" lims:id="353099"><MarginalNote lims:inforce-start-date="2005-06-30" lims:fid="353100" lims:id="353100">Right of appeal</MarginalNote><Label>(6)</Label><Text>The person may, within thirty days after a determination is made under
