lims:fid="338498" lims:id="338498"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Employment and Social Development; (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-12" lims:fid="338499" lims:id="338499"><Text><DefinedTermEn>qualified employee</DefinedTermEn> means an employee who has been determined by the Commission pursuant to this Act to be qualified to receive labour adjustment benefits; (<DefinedTermFr>employé person’s attaining sixty-five years of age, a person is deemed to have attained that age at the beginning of the calendar month following the calendar month in which he actually attains that L-1, s. 2; 1996, c. 11, ss. 95, 99, c. 23, s. 177; 2005, c. 34, s. 80; 2012, c. 19, s. 273; 2013, c. 40, ss. 236, 238</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="338507" lims:id="338507" level="1"><TitleText>Designation of Industries</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="338508" lims:id="338508"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338509" lims:id="338509">Designation of industries</MarginalNote><Label>3</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338510" lims:id="338510"><Label>(1)</Label><Text>For the purposes of this Act, the Governor in Council may, by order, designate any industry either generally or with respect to any region of Canada.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338511" lims:id="338511"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338512" lims:id="338512">Criteria for general designation</MarginalNote><Label>(2)</Label><Text>An industry may be designated generally pursuant to subsection (1) if the Governor in Council is satisfied that</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338513" lims:id="338513"><Label>(a)</Label><Text>the industry in Canada generally is undergoing significant economic adjustment of a non-cyclical nature by reason of import competition or by reason of industrial restructuring implemented pursuant to a policy or program of the Government of Canada to encourage such restructuring; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338514" lims:id="338514"><Label>(b)</Label><Text>the economic adjustment referred to in paragraph (a) is resulting in a significant loss of employment in the industry in Canada generally.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338515" lims:id="338515"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338516" lims:id="338516">Criteria for regional designation</MarginalNote><Label>(3)</Label><Text>An industry may be designated with respect to any region of Canada pursuant to subsection (1) if the Governor in Council is satisfied that</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338517" lims:id="338517"><Label>(a)</Label><Text>the industry in that region is undergoing significant economic adjustment of a non-cyclical nature; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338518" lims:id="338518"><Label>(b)</Label><Text>the economic adjustment referred to in paragraph (a) is resulting in a severe economic disruption in that region and in a significant loss of employment in the industry in that region.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="338520" lims:id="338520">1980-81-82-83, c. 89, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="338521" lims:id="338521"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338522" lims:id="338522">Term of general designation</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338523" lims:id="338523"><Label>(1)</Label><Text>An order made under subsection 3(1) that designates an industry generally is in force for such period, not exceeding three years from the date the order is made, as is specified in the order unless, before the expiration of the period so specified, the Governor in Council makes a continuation order continuing the order in force for such period, not exceeding three years, as is specified in the continuation order.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338524" lims:id="338524"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338525" lims:id="338525">No further extension</MarginalNote><Label>(2)</Label><Text>Not more than one continuation order may be made under subsection (1) in respect of any one order made under subsection 3(1).</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338526" lims:id="338526"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338527" lims:id="338527">Term of regional designation</MarginalNote><Label>(3)</Label><Text>An order made under subsection 3(1) that designates an industry with respect to a region in Canada is in force for one year from the date the order is made unless, before the expiration of that one year, the Governor in Council makes a continuation order continuing the order in force for such period, not exceeding six months, as is specified in the continuation order.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338528" lims:id="338528"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338529" lims:id="338529">Further extension</MarginalNote><Label>(4)</Label><Text>Where the Governor in Council has made a continuation order under subsection (3) continuing an order in force, he may, before the expiration of the period for which the order is so continued, make one further continuation order continuing the order in force for such further period, not exceeding six months, as is specified in the further continuation order.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338530" lims:id="338530"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338531" lims:id="338531">Entitlement continued</MarginalNote><Label>(5)</Label><Text>The revocation or expiration of an order made under this section or section 3 does not affect the entitlement, after the revocation or expiration, of any person laid off while the order was in force to make an application under section 11 or 13 in relation to the order or to receive labour adjustment benefits by virtue of the order.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="338533" lims:id="338533">1980-81-82-83, c. 89, s. 3, c. 169, s. 2</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="338534" lims:id="338534"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338535" lims:id="338535">Retroactive application</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338536" lims:id="338536"><Label>(1)</Label><Text>Subject to subsection (2), the Governor in Council may, in any order made under section 3 or 4, declare</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338537" lims:id="338537"><Label>(a)</Label><Text>that the designation of the industry in the order is retroactive in effect and applies as of such day, before the date of the order, as is specified in the order; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338538" lims:id="338538"><Label>(b)</Label><Text>that this Act applies in respect of lay-offs from a Canadian establishment in the industry designated in the order occurring on or after the day specified pursuant to paragraph (a).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338539" lims:id="338539"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338540" lims:id="338540">Limitation</MarginalNote><Label>(2)</Label><Text>The Governor in Council may not specify pursuant to paragraph (1)(a) a day that is earlier than May 1, 1978.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="338542" lims:id="338542">1980-81-82-83, c. 89, s. 4, c. 169, s. 3(F)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="338543" lims:id="338543" level="1"><TitleText>Labour Adjustment Review Board</TitleText></Heading><Section lims:inforce-start-date="2005-04-01" lims:lastAmendedDate="2005-04-01" lims:fid="338544" lims:id="338544"><MarginalNote lims:inforce-start-date="2005-04-01" lims:fid="338545" lims:id="338545">Board established</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2005-04-01" lims:fid="338546" lims:id="338546"><Label>(1)</Label><Text>There is hereby established a board, to be known as the Labour Adjustment Review Board, consisting of not more than five members.</Text></Subsection><Subsection lims:inforce-start-date="2005-04-01" lims:fid="338547" lims:id="338547"><MarginalNote lims:inforce-start-date="2005-04-01" lims:fid="338548" lims:id="338548">Appointment and tenure of members</MarginalNote><Label>(2)</Label><Text>Each member of the Board shall be appointed by the Minister to hold office during pleasure.</Text></Subsection><Subsection lims:inforce-start-date="2005-04-01" lims:fid="338549" lims:id="338549"><MarginalNote lims:inforce-start-date="2005-04-01" lims:fid="338550" lims:id="338550">Representatives</MarginalNote><Label>(3)</Label><Text>One member of the Board shall be appointed after consultation with such organizations representative of employees as the Minister deems appropriate and shall be a representative of employees and another member of the Board shall be appointed after consultation with such organizations representative of employers as the Minister deems appropriate and shall be a representative of employers.</Text></Subsection><Subsection lims:inforce-start-date="2005-04-01" lims:fid="338551" lims:id="338551"><MarginalNote lims:inforce-start-date="2005-04-01" lims:fid="338552" lims:id="338552">Temporary substitute members</MarginalNote><Label>(4)</Label><Text>If any member of the Board is absent or unable to act, the Minister may appoint a person to act as a member for the time being, but no person so appointed has authority to act as a member for a period exceeding ninety days without the approval of the Minister.</Text></Subsection><Subsection lims:inforce-start-date="2005-04-01" lims:fid="338553" lims:id="338553"><MarginalNote lims:inforce-start-date="2005-04-01" lims:fid="338554" lims:id="338554">Idem</MarginalNote><Label>(5)</Label><Text>A member appointed pursuant to subsection (4) holds office during pleasure and may exercise all the powers and carry out all the duties and functions of a member of the Board.</Text></Subsection><Subsection lims:inforce-start-date="2005-04-01" lims:fid="338555" lims:id="338555"><MarginalNote lims:inforce-start-date="2005-04-01" lims:fid="338556" lims:id="338556">Remuneration and expenses</MarginalNote><Label>(6)</Label><Text>The members of the Board who are not employed in the federal public administration are entitled to be paid for their services in connection with the work of the Board such remuneration and expenses as are authorized by the Governor in Council.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2005-04-01" lims:fid="338558" lims:id="338558">R.S., 1985, c. lims:inforce-start-date="2002-12-31" lims:fid="338561" lims:id="338561"><Label>(1)</Label><Text>The Minister shall designate one member of the Board to be Chairman of the Board and another member to be Vice-Chairman of the Board.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338562" lims:id="338562"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338563" lims:id="338563">Absence or incapacity of Chairman</MarginalNote><Label>(2)</Label><Text>If the Chairman of the Board is absent or unable to act or if that office is vacant, the Vice-Chairman of the Board may exercise all the powers and carry out all the duties and functions of the Chairman.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338564" lims:id="338564"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338565" lims:id="338565">Chief executive officer</MarginalNote><Label>(3)</Label><Text>The Chairman of the Board is the chief executive officer of the Board and has supervision over and direction of the work and staff of the Board and shall preside at meetings of the lims:id="338570"><Label>(1)</Label><Text>The head office of the Board shall be at such place in Canada as the Governor in Council may, by order, designate.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338571" lims:id="338571"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338572" lims:id="338572">Sittings</MarginalNote><Label>(2)</Label><Text>The Board may sit at such time and at such place in Canada as it considers necessary or desirable for the proper conduct of its business.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338573" lims:id="338573"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338574" lims:id="338574">Rules</MarginalNote><Label>(3)</Label><Text>The Board may make rules respecting</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338575" lims:id="338575"><Label>(a)</Label><Text>the sittings of the Board;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338576" lims:id="338576"><Label>(b)</Label><Text>the manner of dealing with matters and business before the Board; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338577" lims:id="338577"><Label>(c)</Label><Text>the exercise of the powers and performance of the duties and functions of the Board generally.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338578" lims:id="338578"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338579" lims:id="338579">Staff</MarginalNote><Label>(4)</Label><Text>The Minister may, on request of the Board, provide the Board with such professional, technical, secretarial, clerical and other assistance as is necessary for the proper conduct of the business of the lims:fid="338593" lims:id="338593">Application for certification</MarginalNote><Label>11</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338594" lims:id="338594"><Label>(1)</Label><Text>Any employee who has been laid off may apply, directly or through an employer, trade union or any person, to the Board for certification that he is eligible to apply to the Commission for labour adjustment benefits.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338595" lims:id="338595"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338596" lims:id="338596">Form and content of application</MarginalNote><Label>(2)</Label><Text>An application under subsection (1) shall be submitted in such form and manner as the Board may direct and shall set out the name of the employee in respect of whom the application is being made and such other information as the Board may require.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338597" lims:id="338597"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338598" lims:id="338598">Investigation</MarginalNote><Label>(3)</Label><Text>On receipt of an application under subsection (1), the Board shall carry out such investigation as it considers necessary for the purpose of determining the eligibility of the employee named in the application to apply to the Commission for labour adjustment benefits and for that purpose the Board shall determine the date the employee was laid off.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338599" lims:id="338599"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338600" lims:id="338600">Decision on application</MarginalNote><Label>(4)</Label><Text>On completion of its investigation under subsection (3), the Board shall determine whether or not the employee is eligible to apply to the Commission for labour adjustment benefits and shall notify the applicant in writing of its decision.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338601" lims:id="338601"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338602" lims:id="338602">Certification</MarginalNote><Label>(5)</Label><Text>Where the Board determines pursuant to subsection (4) that an employee is eligible to apply to the Commission for labour adjustment benefits, it shall so certify in writing to the Commission.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338603" lims:id="338603"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338604" lims:id="338604">Content of certification</MarginalNote><Label>(6)</Label><Text>Certification under subsection (5) shall be submitted in such form and manner as the Commission may direct and shall set out the name of the employee certified, his effective date of lay-off and such other information respecting the lay-off of the employee as the Commission may lims:inforce-start-date="2002-12-31" lims:fid="338608" lims:id="338608">Requirements for certification</MarginalNote><Label>12</Label><Text>The Board may certify that an employee named in an application under section 11 is eligible to apply to the Commission for labour adjustment benefits if</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338609" lims:id="338609"><Label>(a)</Label><Text>he was laid off;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338610" lims:id="338610"><Label>(b)</Label><Text>the Canadian establishment from which he was laid off was, at the time of his lay-off, part of a designated industry;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338611" lims:id="338611"><Label>(c)</Label><Text>the number of employees at the Canadian establishment referred to in paragraph (b) was reduced as a result of lay-offs, in any twelve month period including the employee’s effective date of lay-off, by at least ten per cent or fifty employees, whichever is the lesser; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338612" lims:id="338612"><Label>(d)</Label><Text>his lay-off resulted from the economic adjustment referred to in subsection 3(2) or (3), as the case may lims:id="338622">Attendance</MarginalNote><Label>(3)</Label><Text>For the purposes of this section, the Commission may require an applicant to attend at a suitable time and place in order to make an application in person or to provide information required under subsection (2).</Text></Subsection><Subsection lims:inforce-start-date="2013-12-12" lims:fid="338623" lims:id="338623"><MarginalNote lims:inforce-start-date="2013-12-12" lims:fid="338624" lims:id="338624">Investigation</MarginalNote><Label>(4)</Label><Text>On receipt of an application under subsection (1), the Commission shall application</MarginalNote><Label>(5)</Label><Text>Subject to subsection (6), on completion of its investigation under subsection (4), the Commission shall determine whether or not the applicant is qualified to receive labour adjustment benefits and shall notify him in writing of its decision.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-12" lims:fid="338627" lims:id="338627"><MarginalNote lims:inforce-start-date="2013-12-12" lims:fid="338628" lims:id="338628">Reference to Social Security Tribunal</MarginalNote><Label>(6)</Label><Text>The Commission may at any time within 14 days after receiving an application under subsection (1) refer the application or a question arising from it to the General Division of the Social Security Tribunal for a decision on it.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-12" lims:fid="338629" lims:id="338629"><MarginalNote lims:inforce-start-date="2013-12-12" lims:fid="338630" lims:id="338630">Proceedings before Social Security Tribunal</MarginalNote><Label>(7)</Label><Text>If an application or question is referred to the General Division of the Social Security Tribunal under subsection (6), the Tribunal must conduct its proceedings in respect of that application or question in accordance with the procedure for appeals under the <XRefExternal reference-type="act" link="H-5.7">Department of Employment and Social Development Act</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-12" lims:fid="338631" lims:id="338631"><MarginalNote lims:inforce-start-date="2013-12-12" lims:fid="338632" lims:id="338632">Failure to comply with requirements</MarginalNote><Label>(8)</Label><Text>Notwithstanding any other provision of this Act, an applicant who fails to comply with a requirement under subsection (2) or (3) that has not been waived under subsection (9) is not qualified to receive labour adjustment benefits as long as such failure to comply continues.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-12" lims:fid="338633" lims:id="338633"><MarginalNote lims:inforce-start-date="2013-12-12" lims:fid="338634" lims:id="338634">Waiver or variation of requirement</MarginalNote><Label>(9)</Label><Text>The Commission may waive or vary any requirement under subsection (2) or (3) if in its opinion the circumstances warrant such waiver or variation for the benefit of the applicant in a particular case or class or group of cases.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem L-1, s. 13; 1996, c. 23, s. 187; 2012, c. 19, s. 274; 2013, c. 40, s. 236</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="338637" lims:id="338637" level="1"><TitleText>Qualification for Benefits</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="338638" lims:id="338638"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338639" lims:id="338639">Qualifications for benefits</MarginalNote><Label>14</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338640" lims:id="338640"><Label>(1)</Label><Text>The Commission may determine that an employee who has been certified under section 11 is qualified to receive labour adjustment benefits if</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338641" lims:id="338641"><Label>(a)</Label><Text>the employee is a Canadian citizen resident in Canada or a permanent resident within the meaning of subsection 2(1) of the <XRefExternal reference-type="act" link="I-2.5">Immigration and Refugee Protection Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338642" lims:id="338642"><Label>(b)</Label><Text>he has had at least ten years of employment in the relevant designated industry in the fifteen years immediately preceding his effective date of lay-off;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338643" lims:id="338643"><Label>(c)</Label><Text>he was, on his effective date of lay-off, not less than fifty-four years of age but under sixty-five years of age;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338644" lims:id="338644"><Label>(d)</Label><Text>the employee has claimed and exhausted all benefits under Part I of the <XRefExternal reference-type="act" link="E-5.6">Employment Insurance Act</XRefExternal> to which the employee was entitled subsequent to his or her lay-off;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338645" lims:id="338645"><Label>(e)</Label><Text>he has not attained sixty-five years of age; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338646" lims:id="338646"><Label>(f)</Label><Text>he has no present prospect of employment, whether with or without training or relocation assistance, or has accepted employment with earnings that are less than his average weekly insurable earnings.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338647" lims:id="338647"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338648" lims:id="338648">Idem</MarginalNote><Label>(2)</Label><Text>Notwithstanding subsection (1), where the Commission is of the opinion that an employee certified under section 11 who would be qualified under subsection (1) to receive labour adjustment benefits but for the requirements set out in paragraphs (1)(b) and (c) or either paragraph will suffer severe financial hardship unless he receives those benefits, the Commission may determine that the employee is qualified to receive labour adjustment benefits if</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338649" lims:id="338649"><Label>(a)</Label><Text>he meets the requirements set out in paragraphs (1)(a), (d), (e) and (f);</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338650" lims:id="338650"><Label>(b)</Label><Text>the aggregate of</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="338651" lims:id="338651"><Label>(i)</Label><Text>his age on his effective date of lay-off, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="338652" lims:id="338652"><Label>(ii)</Label><Text>his years of employment in the relevant designated industry preceding his effective date of lay-off</Text></Subparagraph><ContinuedParagraph lims:inforce-start-date="2002-12-31" lims:fid="338653" lims:id="338653"><Text>equals eighty or more; and</Text></ContinuedParagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338654" lims:id="338654"><Label>(c)</Label><Text>he was, on his effective date of lay-off, under sixty-five years of age.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338655" lims:id="338655"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338656" lims:id="338656">Idem</MarginalNote><Label>(3)</Label><Text>Notwithstanding subsection (1), where an employee certified under section 11 would be qualified under subsection (1) to receive labour adjustment benefits but for the requirement set out in paragraph (1)(b), the Commission may determine that the employee is qualified to receive labour adjustment benefits if he shows that he is in substantial compliance with the requirement and that he does not meet such requirement by reason only of illness, disability, lay-off or any other good cause whatever.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338657" lims:id="338657"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338658" lims:id="338658">Definitions</MarginalNote><Label>(4)</Label><Text>In this section,</Text><Definition lims:inforce-start-date="2002-12-31" lims:fid="338659" lims:id="338659"><Text><DefinedTermEn>relevant designated industry</DefinedTermEn>, in respect of an employee, means the designated industry that included, at the time of his lay-off, the Canadian establishment from which the employee was laid off; (<DefinedTermFr>secteur d’activités désigné en question</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="338660" lims:id="338660"><Text><DefinedTermEn>year of employment</DefinedTermEn>, in respect of an employee, means a year in which the employee was paid for at least one thousand hours of employment. (<DefinedTermFr>année d’emploi</DefinedTermFr>)</Text></Definition></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="338662" lims:id="338662">R.S., 1985, c. establishment from which an employee was laid off was, at the time of his lay-off, part of an industry designated generally pursuant to section 3, the Commission shall, in applying paragraph 14(1)(b) or 14(2)(b) in respect of the employee, take into account as employment in that industry any period of employment of that employee preceding his effective date of lay-off in any other industry so designated, whether or not the designation was in force on that date.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="338666" lims:id="338667"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338668" lims:id="338668">Semi-annual review</MarginalNote><Label>16</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338669" lims:id="338669"><Label>(1)</Label><Text>The Commission shall at least once every six months review the circumstances of every qualified employee to determine if he continues to meet the requirement set out in paragraph 14(1)(f) and, if the Commission determines he does not meet that requirement, it shall notify him in writing of its decision.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338670" lims:id="338670"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338671" lims:id="338671">Attendance</MarginalNote><Label>(2)</Label><Text>For the purposes of subsection (1), the Commission may require a qualified employee to attend at a suitable time and place in order to provide such information as the Commission may require to conduct its review.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338672" lims:id="338672"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338673" lims:id="338673">Failure to comply with requirements</MarginalNote><Label>(3)</Label><Text>Notwithstanding any other provision of this Act, a qualified employee who fails to comply with a requirement to attend under subsection (2) that has not been waived under subsection (4) is not qualified to receive labour adjustment benefits as long as the failure to comply continues.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338674" lims:id="338674"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338675" lims:id="338675">Waiver or variation of requirement</MarginalNote><Label>(4)</Label><Text>The Commission may waive or vary any requirement to attend under subsection (2) if in its opinion the circumstances warrant the waiver or variation for the benefit of the qualified employee.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338676" lims:id="338676"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338677" lims:id="338677">Revocation of decision</MarginalNote><Label>(5)</Label><Text>Where the Commission has notified a qualified employee of its decision pursuant to subsection (1) and, on a subsequent review under that subsection, determines that the employee then meets the requirement, the Commission shall revoke its prior decision and notify him in writing of its decision.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="338679" level="1"><TitleText>Labour Adjustment Benefits</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="338681" lims:id="338681"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338682" lims:id="338682">Calculation and payment of benefits</MarginalNote><Label>17</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338683" lims:id="338683"><Label>(1)</Label><Text>Where the Commission determines that an employee who has been certified under section 11 is qualified to receive labour adjustment benefits, the Commission shall, in accordance with this Act, calculate the amount of the benefits on a weekly basis in arrears and pay the benefits to the qualified employee every two weeks in arrears.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338684" lims:id="338684"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338685" lims:id="338685">Commencement of benefits</MarginalNote><Label>(2)</Label><Text>Labour adjustment benefits are payable to a qualified employee commencing on the later of</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338686" lims:id="338686"><Label>(a)</Label><Text>the week immediately following the week the employee’s benefits under Part I of the <XRefExternal reference-type="act" link="E-5.6">Employment Insurance Act</XRefExternal> subsequent to his or her lay-off are exhausted, and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338687" lims:id="338687"><Label>(b)</Label><Text>the week during which he applies to the Commission under section 13 for labour adjustment benefits.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338688" lims:id="338688"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338689" lims:id="338689">Additional benefits</MarginalNote><Label>(3)</Label><Text>Where a qualified employee was certified by the Board pursuant to section 11 after the week his or her benefits under Part I of the <XRefExternal reference-type="act" link="E-5.6">Employment Insurance Act</XRefExternal> subsequent to the lay-off were exhausted, in addition to the labour adjustment benefits otherwise payable to the employee under this Act, labour adjustment benefits are payable from the later of</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338690" lims:id="338690"><Label>(a)</Label><Text>that week, and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338691" lims:id="338691"><Label>(b)</Label><Text>the week during which he applied to the Board for certification</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="338692" lims:id="338692"><Text>to the week during which he was so certified.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338693" lims:id="338693"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338694" lims:id="338694">Lump sum payment</MarginalNote><Label>(4)</Label><Text>Notwithstanding subsection (1), the amount of any labour adjustment benefits payable to a qualified employee for a period prior to the first two week period for which payment is made to him in accordance with that subsection shall be paid in one sum.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem and</Text></ContinuedParagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338734" lims:id="338734"><Label>(b)</Label><Text>one dollar for each dollar that is received by the employee as</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="338735" lims:id="338735"><Label>(i)</Label><Text>benefits under an employer pension plan earned by the employee as a result of any office or employment,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="338736" lims:id="338736"><Label>(ii)</Label><Text>a retirement pension under the <XRefExternal reference-type="act" link="C-8">Canada Pension Plan</XRefExternal> or a provincial pension plan,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="338737" lims:id="338737"><Label>(iii)</Label><Text>benefits under Part I of the <XRefExternal reference-type="act" link="E-5.6">Employment Insurance Act</XRefExternal>,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="338738" lims:id="338738"><Label>(iv)</Label><Text><Repealed>[Repealed, 1996, c. 23, s. 181]</Repealed></Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="338739" lims:id="338739"><Label>(v)</Label><Text>vacation pay, severance pay, salary, wages or other remuneration, including gratuities but excluding any worker compensation benefits or other disability payments, in respect of any office or employment terminated prior to the commencement of such benefit, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="338740" lims:id="338740"><Label>(vi)</Label><Text>income from any business carried on by him, either alone or with others, that is terminated prior to the commencement of such benefit,</Text></Subparagraph><ContinuedParagraph lims:inforce-start-date="2002-12-31" lims:fid="338741" lims:id="338741"><Text>and that is allocated to that week in accordance with the regulations.</Text></ContinuedParagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338742" lims:id="338742"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338743" lims:id="338743">Definitions</MarginalNote><Label>(2)</Label><Text>In subsection (1),</Text><Definition lims:inforce-start-date="2002-12-31" lims:fid="338744" lims:id="338744"><Text><DefinedTermEn>business</DefinedTermEn> includes a profession, calling, trade, manufacture or undertaking of any kind and an adventure or concern in the nature of trade, but does not include an office or employment; (<DefinedTermFr>entreprise</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="338745" lims:id="338745"><Text><DefinedTermEn>employment</DefinedTermEn> means the position of an individual in the service of some other person, including Her Majesty or a foreign state or sovereign; (<DefinedTermFr>emploi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="338746" lims:id="338746"><Text><DefinedTermEn>office</DefinedTermEn> means the position of an individual entitling him to a fixed or ascertainable stipend or remuneration and includes any office the incumbent of which is elected by popular vote or is elected or appointed in a representative capacity and also includes the position of a corporation director. (<DefinedTermFr>charge</DefinedTermFr>)</Text></Definition></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="338748" lims:id="338748">R.S., 1985, c. L-1, s. 21; 1996, c. 23, s. 181</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="338749" lims:id="338749"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338750" lims:id="338750">Deemed benefit</MarginalNote><Label>22</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338751" lims:id="338751"><Label>(1)</Label><Text>Where a qualified employee to whom labour adjustment benefits are payable has, after his effective date of lay-off and before the commencement of those benefits, received a lump sum payment, under or in respect of an employer pension plan, earned by the employee as a result of an office or employment in the Canadian establishment from which he was laid off, the payment is deemed to be a benefit referred to in subparagraph 21(1)(b)(i).</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338752" lims:id="338752"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338753" lims:id="338753">Report of earnings</MarginalNote><Label>(2)</Label><Text>A qualified employee to whom labour adjustment benefits are being paid shall submit to the Commission a report, in such form and manner and at such times as the Commission may direct, setting out the amounts received by the employee in the period to which the report relates as remuneration, income, benefits, pension or allowance described in paragraph 21(1)(a) or (b) and such other information as the Commission may require.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338754" lims:id="338754"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338755" lims:id="338755">Failure to comply</MarginalNote><Label>(3)</Label><Text>Notwithstanding any other provision of this Act, a qualified employee who fails to comply with a requirement under subsection (2) that has not been waived under subsection (4) is not qualified to receive labour adjustment benefits as long as the failure to comply continues.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338756" lims:id="338756"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338757" lims:id="338757">Waiver or variation of requirement</MarginalNote><Label>(4)</Label><Text>The Commission may waive or vary any requirement under subsection (2) if in its opinion the circumstances warrant the waiver or variation for the benefit of a qualified employee in a particular case or class or group of cases.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="338759" lims:id="338759">1980-81-82-83, c. 89, s. 17, c. 169, s. 7</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="338760" lims:id="338760"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338761" lims:id="338761">Benefits not assignable</MarginalNote><Label>23</Label><Text>Labour adjustment benefits are not capable of being assigned, charged, attached, anticipated or given as security and, subject to subsections 22(1) and 26(1), any transaction purporting to assign, charge, attach, anticipate or give as security any of those benefits is void.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="338763" lims:id="338763">R.S., 1985, c. lims:inforce-start-date="2002-12-31" lims:fid="338766" lims:id="338766">False or misleading statements</MarginalNote><Label>24</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338767" lims:id="338767"><Label>(1)</Label><Text>Where the Board becomes aware of facts establishing, in its opinion, that a person, in relation to an application under section 11, has made a statement or representation that he knew to be false or misleading or has participated or acquiesced in the making of such a statement or representation, the Board may revoke the certification of any employee named in the application.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338768" lims:id="338768"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338769" lims:id="338769">Notification of intention</MarginalNote><Label>(2)</Label><Text>Before the Board revokes the certification of an employee pursuant to subsection (1), it shall notify the employee in writing of its intention to do so.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338770" lims:id="338770"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338771" lims:id="338771">Right to make written representations</MarginalNote><Label>(3)</Label><Text>An employee who is notified pursuant to subsection (2) may within thirty days after the date of the notice, or within such further time as the Board may allow, make representations in writing to the Board with respect to the proposed revocation of his certification.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338772" lims:id="338772"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338773" lims:id="338773">Notification of decision</MarginalNote><Label>(4)</Label><Text>Where the Board revokes the certification of an employee pursuant to subsection (1), it shall notify the employee and the Commission in writing of the revocation.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338774" lims:id="338774"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338775" lims:id="338775">Limitation</MarginalNote><Label>(5)</Label><Text>Notwithstanding any other provision of this Act, a qualified employee whose certification is revoked pursuant to subsection (1) is not qualified at any time before or after the revocation to receive labour adjustment benefits by virtue of the revoked certification.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338776" lims:id="338776"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338777" lims:id="338777">Idem</MarginalNote><Label>(6)</Label><Text>No certification shall be revoked pursuant to subsection (1) more than seventy-two months after the date on which the false or misleading lims:id="338779">Recertification not precluded</MarginalNote><Label>(7)</Label><Text>Nothing in this section shall be construed as preventing an employee whose certification is revoked pursuant to benefits have been paid to a person, reconsider</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338785" lims:id="338785"><Label>(a)</Label><Text>any application he made under section 13,</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338786" lims:id="338786"><Label>(b)</Label><Text>any information he provided in the course of a review under subsection 16(1), or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338787" lims:id="338787"><Label>(c)</Label><Text>any report he submitted under subsection 22(2)</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="338788" lims:id="338788"><Text>and, if the Commission decides that the person has received, in consequence of that application, information or report, labour adjustment benefits for which he was not qualified or in excess of the benefits payable to him, the Commission shall calculate the amount of such benefits or excess and shall notify the person in writing of its decision.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338789" lims:id="338789"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338790" lims:id="338790">Reconsideration in respect of amounts payable</MarginalNote><Label>(2)</Label><Text>The Commission may, at any time within thirty-six months after labour adjustment benefits would have been payable to a person, reconsider</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338791" lims:id="338791"><Label>(a)</Label><Text>any application he made under section 13,</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338792" lims:id="338792"><Label>(b)</Label><Text>any information he provided in the course of a review under subsection 16(1), or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="338793" lims:id="338793"><Label>(c)</Label><Text>any report he submitted under subsection 22(2)</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="338794" lims:id="338794"><Text>and, if the Commission decides that the person has not received labour adjustment benefits for which he was qualified or has received less than the benefits payable to him, the Commission shall calculate the amount of such benefits or deficiency and shall notify the person in writing of its decision.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338795" lims:id="338795"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338796" lims:id="338796">Amount repayable</MarginalNote><Label>(3)</Label><Text>If the Commission decides that a person has received labour adjustment benefits for which he was not qualified or in excess of the benefits payable to him, the amount of such benefits or excess as calculated pursuant to subsection (1) is an amount repayable under section 26 and, for the purposes of subsection 26(2), the date of the notice of the decision is the date on which liability arises.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338797" lims:id="338797"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338798" lims:id="338798">Amount payable</MarginalNote><Label>(4)</Label><Text>If the Commission decides that a person has not received labour adjustment benefits for which he was qualified or has received less than the benefits payable to him, the amount of such benefits or deficiency as calculated pursuant to subsection (2) is the amount payable to that person.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338799" lims:id="338799"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338800" lims:id="338800">Extension</MarginalNote><Label>(5)</Label><Text>Where, in the opinion of the Commission, a false or misleading statement or representation has been made in connection with any application, information or report referred to in subsection (1), the Commission may, at any time within seventy-two months after labour adjustment benefits have been paid to a person, reconsider the application, information or report under that subsection.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="338802" the benefits payable to him, he is liable to repay an amount equal to the amount of those benefits or excess, as the case may be, and that amount is a debt due to Her Majesty in right of Canada and is recoverable as such in the Federal Court or any other court of competent jurisdiction or in any other manner provided by the <XRefExternal reference-type="act" link="E-5.6">Employment Insurance Act</XRefExternal> in respect of the recovery of amounts paid as benefits under that Act.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="338806" lims:id="338806"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="338807" lims:id="338807">Limitation</MarginalNote><Label>(2)</Label><Text>No amount due as a debt under subsection (1) may of any premises or place that is designed to be used and is being used as a permanent or temporary private dwelling, where he believes on reasonable grounds any employee was employed and may make such examination and inquiry as may be necessary to determine whether or not the employee is eligible to apply to the Commission for labour adjustment benefits.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-12" lims:fid="338817" lims:id="338817"><MarginalNote lims:inforce-start-date="2013-12-12" lims:fid="338818" lims:id="338818">Powers of employees of Department of Employment and Social Development</MarginalNote><Label>(2)</Label><Text>An employee of the Department of Employment and Social Development authorized pursuant to subsection (5) may at any reasonable time enter any premises or place, other than a private dwelling or any part of any premises or place that is designed to be used and is being used as a permanent or temporary private dwelling, where he or she believes on reasonable grounds any employee was employed and may make such examination and inquiry as may be necessary to determine whether or not the employee is qualified to receive labour adjustment benefits.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-12" lims:fid="338819" lims:id="338819"><MarginalNote lims:inforce-start-date="2013-12-12" lims:fid="338820" lims:id="338820">Information</MarginalNote><Label>(3)</Label><Text>The following persons, namely,</Text><Paragraph lims:inforce-start-date="2013-12-12" lims:fid="338821" lims:id="338821"><Label>(a)</Label><Text>any person who is occupying any premises or place described in subsection (1) or (2), every person found therein and the servants or agents of the occupier,</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-12" lims:fid="338822" lims:id="338822"><Label>(b)</Label><Text>any person who can reasonably be considered to be or have been an employer of an employee, the servants and agents of that person and the trustees in bankruptcy, administrators or liquidators concerned with that person’s estate, and</Text></Paragraph><Paragraph authorize any officer of the Board to exercise the powers conferred by subsection (1) in respect of any particular employee or employees named or described in the authorization and to administer or receive any oath, solemn affirmation or statutory declaration required to be given pursuant to this section in respect thereof, and, on entering any premises or place referred to in that subsection, the officer shall, if so requested, produce the authorization to the person in charge of the premises or place.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-12" lims:fid="338827" lims:id="338827"><MarginalNote lims:inforce-start-date="2013-12-12" lims:fid="338828" lims:id="338828">Authorization by Minister</MarginalNote><Label>(5)</Label><Text>The Minister, on the request of the Commission, may, in writing, authorize any employee of the Department of Employment and Social Development to exercise the powers conferred by subsection (2) in respect of any particular employee
