<DefinedTermEn>Commissioner</DefinedTermEn> means the Intelligence Commissioner appointed under subsection <XRefInternal>4</XRefInternal>(1).</Text></Section><Heading lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-12" lims:fid="1170189" lims:id="1170189"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170190" lims:id="1170190">Order in council</MarginalNote><Label>3</Label><Text>The Governor in Council may, by order, designate a federal minister as the Minister responsible for this Act.</Text></Section><Heading lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1170191" lims:id="1170191" level="1"><TitleText>Commissioner</TitleText></Heading><Section lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-12" lims:fid="1170192" lims:id="1170192"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170193" lims:id="1170193">Appointment</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170194" lims:id="1170194"><Label>(1)</Label><Text>The Governor in Council, on the recommendation of the Prime Minister, is to appoint a retired judge of a superior court as the Intelligence Commissioner, to hold office during good behaviour for a term of not more than five years.</Text></Subsection><Subsection lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170195" lims:id="1170195"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170196" lims:id="1170196">Reappointment</MarginalNote><Label>(2)</Label><Text>A person appointed to be Commissioner is eligible to be reappointed for one additional term of not more than five years.</Text></Subsection><Subsection lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170197" lims:id="1170197"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170198" lims:id="1170198">Part-time</MarginalNote><Label>(3)</Label><Text>The Commissioner is to perform his or her duties and functions on a part-time basis.</Text></Subsection><Subsection lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170199" lims:id="1170199"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170200" lims:id="1170200">Remuneration</MarginalNote><Label>(4)</Label><Text>The Commissioner is to be paid the remuneration that may be fixed by the Governor in Council.</Text></Subsection><Subsection lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170201" lims:id="1170201"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170202" lims:id="1170202">Travel and living expenses</MarginalNote><Label>(5)</Label><Text>The Commissioner is entitled to be paid, in accordance with Treasury Board directives, reasonable travel and living expenses incurred in the exercise of his or her powers and the performance of his or her duties and functions under this or any other Act of Parliament, while absent from his or her ordinary place of residence.</Text></Subsection><Subsection lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170203" lims:id="1170203"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170204" lims:id="1170204">Deemed employment</MarginalNote><Label>(6)</Label><Text>The Commissioner is deemed to be an employee for the purposes of the <XRefExternal reference-type="act" link="G-5">Government Employees Compensation Act</XRefExternal> and to be employed in the federal public administration for the purposes of any regulations made under section 9 of the <XRefExternal reference-type="act" link="A-2">Aeronautics Act</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170205" lims:id="1170205"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170206" lims:id="1170206">Acting Commissioner</MarginalNote><Label>(7)</Label><Text>In the event of the Commissioner’s absence or incapacity, or if that office is vacant, the Governor in Council is to appoint a retired judge of a superior court to act as Commissioner and, while acting as Commissioner, that person has all the Commissioner’s powers, duties and functions under this or any other Act of Parliament.</Text></Subsection></Section><Section lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-12" lims:fid="1170207" Commissioner has the rank and all the powers of a deputy head of a department and has control and management of his or her office and all matters connected with it.</Text></Section><Section lims:enacted-date="2019-06-21" lims:fid="1170210" lims:id="1170210">Personnel</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170211" lims:id="1170211"><Label>(1)</Label><Text>The Commissioner has exclusive authority to</Text><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170212" lims:id="1170212"><Label>(a)</Label><Text>appoint or lay off employees, revoke their appointment or terminate their employment; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170213" lims:id="1170213"><Label>(b)</Label><Text>establish standards, procedures and processes governing staffing, including governing the appointment of employees, lay-off of employees, revocation of their appointment or termination of their employment otherwise than for cause.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170214" lims:id="1170214"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170215" lims:id="1170215">Right of employer</MarginalNote><Label>(2)</Label><Text>Nothing in the <XRefExternal reference-type="act" link="P-33.3">Federal Public Sector Labour Relations Act</XRefExternal> is to be construed so as to affect the Commissioner’s right or authority to deal with the matters referred to in subsection (1).</Text></Subsection><Subsection lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170216" lims:id="1170216"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170217" lims:id="1170217">Political activities</MarginalNote><Label>(3)</Label><Text>Part 7 of the <XRefExternal reference-type="act" link="P-33.01">Public Service Employment Act</XRefExternal> applies to the Commissioner and to his or her employees. For the purposes of that Part, the Commissioner is deemed to be a deputy head, and his or her employees are deemed to be employees, as those terms are defined in subsection 2(1) of that Act.</Text></Subsection></Section><Section lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-12" lims:fid="1170218" lims:id="1170218"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170219" lims:id="1170219">Powers of Commissioner</MarginalNote><Label>7</Label><Text>In the exercise of his or her authority under subsection <XRefInternal>6</XRefInternal>(1), the Commissioner may</Text><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170220" lims:id="1170220"><Label>(a)</Label><Text>determine his or her human resources requirements and provide for the allocation and effective utilization of human resources;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170221" lims:id="1170221"><Label>(b)</Label><Text>provide for the classification of positions and employees;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170222" lims:id="1170222"><Label>(c)</Label><Text>after consultation with the President of the Treasury Board, determine and regulate the pay to which employees are entitled for services rendered, the hours of work and leave of the employees and any related matters;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170223" lims:id="1170223"><Label>(d)</Label><Text>after consultation with the President of the Treasury Board, determine and regulate the payments that may be made to employees by way of reimbursement for travel or other expenses and by way of allowances in respect of expenses and conditions arising out of their employment;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170224" lims:id="1170224"><Label>(e)</Label><Text>determine employees’ learning, training and development requirements and fix the terms on which the learning, training and development may be carried out;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170225" lims:id="1170225"><Label>(f)</Label><Text>provide for the awards that may be made to employees for outstanding performance of their duties, for other meritorious achievement in relation to their duties or for inventions or practical suggestions for improvements;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170226" lims:id="1170226"><Label>(g)</Label><Text>establish standards of discipline and set penalties, including termination of employment, suspension, demotion to a position at a lower maximum rate of pay and financial penalties;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170227" lims:id="1170227"><Label>(h)</Label><Text>provide for the termination of employment, or the demotion to a position at a lower maximum rate of pay, for reasons other than breaches of discipline or misconduct;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170228" lims:id="1170228"><Label>(i)</Label><Text>establish policies respecting the exercise of the powers granted by this section; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170229" lims:id="1170229"><Label>(j)</Label><Text>provide for any other matters, including terms and conditions of employment not otherwise specifically provided for in this section, that the Commissioner considers necessary for effective human resources management.</Text></Paragraph></Section><Section lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-12" lims:fid="1170230" lims:id="1170230"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170231" lims:id="1170231">Negotiation of collective agreements</MarginalNote><Label>8</Label><Text>Before entering into collective bargaining with the bargaining agent for a bargaining unit composed of his or her employees, the Commissioner must have his or her negotiating mandate approved by the President of the Treasury Board.</Text></Section><Section lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-12" lims:fid="1170232" lims:id="1170232"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170233" lims:id="1170233">Technical assistance</MarginalNote><Label>9</Label><Text>The Commissioner may engage on a temporary basis the services of persons having technical or specialized knowledge to advise and assist the Commissioner in the exercise of his or her powers and the performance of his or her duties and functions under this or any other Act of Parliament and, with the approval of Treasury Board, may fix and pay the remuneration and expenses of those persons.</Text></Section><Section lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-12" lims:fid="1170234" lims:id="1170234"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170235" lims:id="1170235">Oath or solemn affirmation</MarginalNote><Label>10</Label><Subsection lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170236" lims:id="1170236"><Label>(1)</Label><Text>The Commissioner must, before commencing the duties and functions of office, take the following oath or make the following solemn affirmation:</Text><Oath>I, <Leader leader="dot" length="3pc" />, swear (solemnly affirm) that I will, to the best of my ability, discharge my responsibilities as the Intelligence Commissioner and will not communicate or use without due authority any information obtained in confidence by me in that capacity.</Oath></Subsection><Subsection lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170237" lims:id="1170237"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170238" lims:id="1170238">Security clearance</MarginalNote><Label>(2)</Label><Text>Every employee of the Commissioner and every person whose services are engaged under section 9 must maintain the security clearance required by the Government of Canada.</Text></Subsection><Subsection lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170239" lims:id="1170239"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170240" lims:id="1170240">Security requirements</MarginalNote><Label>(3)</Label><Text>The Commissioner and every person referred to in subsection (2) must follow established procedures or practices, including any requirement found in a Treasury Board policy, guideline or directive, for the secure handling, storage, transportation and transmission of information or documents.</Text></Subsection></Section><Section lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-12" lims:fid="1170241" lims:id="1170241"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170242" lims:id="1170242">Disclosure limited</MarginalNote><Label>11</Label><Text>The Commissioner, a former Commissioner, any current or former employee and any person whose services are or were engaged under section 9 may disclose information that they obtained, or to which they had access, in the course of exercising their powers or performing their duties and functions under this or any other Act of Parliament only for the purpose of exercising those powers or performing those duties and functions or as required by any other law.</Text></Section><Heading lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1170243" lims:id="1170243" level="1"><TitleText>Duties and Functions</TitleText></Heading><Section lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-12" lims:fid="1170244" lims:id="1170244"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170245" lims:id="1170245">Review and approval</MarginalNote><Label>12</Label><Text>The Commissioner is responsible, as set out in sections 13 to 20, for</Text><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170246" lims:id="1170246"><Label>(a)</Label><Text>reviewing the conclusions on the basis of which certain authorizations are issued or amended, and certain determinations are made, under the <XRefExternal reference-type="act" link="C-35.3">Communications Security Establishment Act</XRefExternal> and the <XRefExternal reference-type="act" link="C-23">Canadian Security Intelligence Service Act</XRefExternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170247" lims:id="1170247"><Label>(b)</Label><Text>if those conclusions are reasonable, approving those authorizations, amendments and determinations.</Text></Paragraph></Section><Section lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-12" lims:fid="1170248" lims:id="1170248"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170249" lims:id="1170249">Foreign Intelligence Authorization</MarginalNote><Label>13</Label><Text>The Commissioner must review whether the conclusions — made under subsections 34(1) and (2) of the <XRefExternal reference-type="act" link="C-35.3">Communications Security Establishment Act</XRefExternal> and on the basis of which a Foreign Intelligence Authorization was issued under subsection 26(1) of that Act — are reasonable.</Text></Section><Section lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-12" lims:fid="1170250" lims:id="1170250"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170251" lims:id="1170251">Cybersecurity Authorization</MarginalNote><Label>14</Label><Text>The Commissioner must review whether the conclusions — made under subsections 34(1) and (3) of the <XRefExternal reference-type="act" link="C-35.3">Communications Security Establishment Act</XRefExternal> and on the basis of which a Cybersecurity Authorization was issued under subsection 27(1) or (2) of that Act — are reasonable.</Text></Section><Section lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-12" lims:fid="1170252" lims:id="1170252"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170253" lims:id="1170253">Amended Authorization</MarginalNote><Label>15</Label><Text>The Commissioner must review whether the conclusions — made under paragraph 39(2)(a) of the <XRefExternal reference-type="act" link="C-35.3">Communications Security Establishment Act</XRefExternal> and on the basis of which an authorization referred to in section <XRefInternal>13</XRefInternal> is amended, or made under paragraph 39(2)(b) of that Act and on the basis of which an authorization referred to in section <XRefInternal>14</XRefInternal> is amended — are reasonable.</Text></Section><Section lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-12" lims:fid="1170254" lims:id="1170254"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170255" lims:id="1170255">Classes of Canadian datasets</MarginalNote><Label>16</Label><Text>The Commissioner must review whether the conclusions — made under subsection 11.03(2) of the <XRefExternal reference-type="act" link="C-23">Canadian Security Intelligence Service Act</XRefExternal> and on the basis of which a class of Canadian datasets is determined under subsection 11.03(1) of that Act — are reasonable.</Text></Section><Section lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-12" lims:fid="1170256" lims:id="1170256"><MarginalNote lims:inforce-start-date="2019-07-12" lims:enacted-date="2019-06-21" lims:fid="1170257" lims:id="1170257">Retention of foreign datasets</MarginalNote><Label>17</Label><Text>The Commissioner must review whether the conclusions — made under subsection 11.17(1) of the <XRefExternal reference-type="act" link="C-23">Canadian Security Intelligence Service Act</XRefExternal> and on the basis of which the retention of a foreign dataset was
