with the requirements set out in paragraphs 14(a) and (b) and the hazardous product meets the requirements set out in the regulations made under subsection work place in Canada if the hazardous product or the container in which the hazardous product is packaged has affixed to, printed on or attached to it information about the hazardous product that is false, misleading or likely to create an erroneous impression, with respect to the information that is required to be included in a label or safety data sheet for that hazardous product in order for the supplier to comply with the requirements set out in paragraphs 13(1)(a) to (b) or 14(a) and (b), as the case may be.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-11" lims:fid="254318" lims:id="254318"><MarginalNote lims:inforce-start-date="2015-02-11" lims:fid="254319" lims:id="254319">Safety data sheet  —  sale</MarginalNote><Label>(2)</Label><Text>No supplier shall sell a hazardous product that is intended for use, handling or storage in a work place in Canada if the safety data sheet for the hazardous product that is in their possession in order to comply with the requirement set out in paragraph 13(1)(a), or that they provide or cause to be provided in order to comply with the requirement set out in paragraph 13(1)(a.1), is false, misleading or likely to create an erroneous impression, with respect to the information that is required to be included in a label or safety data sheet for that hazardous product in order for the supplier to meet the intended for use, handling or storage in a work place in Canada if the safety data sheet for the hazardous product that the supplier obtains or prepares in order to comply with the requirement set out in paragraph 14(a) is false, misleading or likely to create an erroneous impression, with respect to the information that is required to be included in a label or safety data sheet for that hazardous product in order for the supplier to comply with the requirements set out in paragraphs 14(a) and (b).</Text></Subsection><Subsection lims:inforce-start-date="2015-02-11" lims:fid="254322" lims:id="254322"><MarginalNote lims:inforce-start-date="2015-02-11" lims:fid="254323" lims:id="254323">Course of sale</MarginalNote><Label>(4)</Label><Text>No supplier who sells a hazardous product that is intended for use, handling or storage in a work place in Canada shall, in the course of selling the hazardous product, communicate by any means any information about the hazardous product that is false, misleading or likely to create an erroneous impression, with respect to the information that is required to be included in a label or safety data sheet for that hazardous product in order for the supplier to comply with the requirements set out in paragraphs 13(1)(a) to (b).</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-02-11" lims:fid="254325" and Maintaining Documents</TitleText></Heading><Section lims:inforce-start-date="2015-02-11" lims:lastAmendedDate="2015-02-11" lims:fid="254327" lims:id="254327"><MarginalNote lims:inforce-start-date="2015-02-11" lims:fid="254328" lims:id="254328">Requirements</MarginalNote><Label>14.3</Label><Subsection lims:inforce-start-date="2015-02-11" lims:fid="254329" lims:id="254329"><Label>(1)</Label><Text>Every supplier who sells or imports a hazardous product that is intended for use, handling or storage in a work place in Canada shall prepare and maintain</Text><Paragraph lims:inforce-start-date="2015-02-11" lims:fid="254330" lims:id="254330"><Label>(a)</Label><Text>a document containing a true copy of a label that represents the label that is affixed to, printed on or attached to the hazardous product or the container in which the hazardous product is packaged in order to meet the requirement set out in paragraph 13(1)(b) or 14(b), as the case may be, when they sell or import the hazardous product;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-11" lims:fid="254331" lims:id="254331"><Label>(b)</Label><Text>a document containing a true copy of a safety data sheet for the hazardous product that represents the safety data sheet that is in their possession in order to meet the requirement set out in paragraph 13(1)(a) or that they obtain or prepare in order to meet the requirement set out in paragraph 14(a), as the case may be, when they sell or import the hazardous product;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-11" lims:fid="254332" lims:id="254332"><Label>(c)</Label><Text>if the supplier obtained the hazardous product from another person, a document that indicates the person’s name and address, the quantity of the hazardous product obtained by the supplier and the month and year in which they obtained it;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-11" lims:fid="254333" lims:id="254333"><Label>(d)</Label><Text>a document that indicates, for any sales of the hazardous product that result in a transfer of ownership or possession, the locations at which those sales took place, the period during which they took place, and, for each month in that period, the quantity sold during the month; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-11" lims:fid="254334" lims:id="254334"><Label>(e)</Label><Text>the prescribed documents.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-02-11" lims:fid="254335" lims:id="254335"><MarginalNote lims:inforce-start-date="2015-02-11" lims:fid="254336" lims:id="254336">Period for keeping documents</MarginalNote><Label>(2)</Label><Text>The supplier shall keep the documents for six years after the end of the year to which they relate or for any other period that may be prescribed.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-11" lims:fid="254337" lims:id="254337"><MarginalNote lims:inforce-start-date="2015-02-11" lims:fid="254338" lims:id="254338">Keeping and providing documents</MarginalNote><Label>(3)</Label><Text>The supplier shall keep the documents at the supplier’s place of business in Canada or at any prescribed place and shall, on written request, within the time and in the manner specified in the request, provide them to the Minister or an inspector.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-11" lims:fid="254339" lims:id="254339"><MarginalNote lims:inforce-start-date="2015-02-11" lims:fid="254340" lims:id="254340">Exemption  — outside Canada</MarginalNote><Label>(4)</Label><Text>The Minister may, subject to any terms and conditions that he or she may specify, exempt a supplier from the requirement to keep documents in Canada if the the preparation and maintenance of documents, including by specifying the documents to be prepared and maintained, where they are to be kept and for how long;</Text></Paragraph><Paragraph lims:id="254355"><Label>(i)</Label><Text>the sale or importation of any hazardous product or class of hazardous products either generally or in the quantities or concentrations, in the circumstances, at the places, premises or facilities, for the purposes or in the containers that are specified in those regulations, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-12-12" lims:fid="254356" lims:id="254356"><Label>(ii)</Label><Text>any class of suppliers;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2016-12-12" lims:fid="254357" lims:id="254357"><Label>(g) and (h)</Label><Text><Repealed>[Repealed, 2014, c. 20, s. 115]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-12" lims:fid="254358" lims:id="254358"><Label>(i)</Label><Text>defining the expression <DefinedTermEn>work place</DefinedTermEn> for the purposes of this Part;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-12" lims:fid="254359" lims:id="254359"><Label>(j)</Label><Text>requiring any supplier who sells or imports a hazardous product that is intended for use, handling or storage in a work place in Canada to provide, as soon as feasible, any information that is included in the safety data sheet that is in the supplier’s possession for the hazardous product to any prescribed safety professional or health professional who requests that information for a prescribed purpose;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-12" lims:fid="254360" lims:id="254360"><Label>(k)</Label><Text>requiring a prescribed safety professional or health professional  —  to whom a supplier who sells or imports a hazardous product that is intended for use, handling or storage in a work place in Canada has provided information about the hazardous product that the supplier is exempt from disclosing under any Act of Parliament  —  to keep confidential, except for the purpose for which it is provided, any of that information that the supplier specifies as being confidential, if that information was provided at the request of the safety professional or health professional for a prescribed purpose;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-12" lims:fid="254361" lims:id="254361"><Label>(l)</Label><Text>subject to the <XRefExternal reference-type="act" link="H-2.7">Hazardous Materials Information Review Act</XRefExternal>, requiring any supplier who sells or imports a hazardous product that is intended for use, handling or storage in a work place in Canada to identify, as soon as feasible, on request of any person within a class of persons specified in the regulations made under this subsection, the source for any toxicological data used in the preparation of any safety data sheet that the supplier has provided or caused to be provided in order to meet the requirement set out in paragraph 13(1)(a.1) or has obtained or prepared in order to meet the requirement set out in paragraph 14(a), as the case may be;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-12" lims:fid="254362" lims:id="254362"><Label>(l.1)</Label><Text>respecting the implementation, in relation to hazardous products, of international agreements that affect those products;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-12" lims:fid="254363" lims:id="254363"><Label>(m)</Label><Text>prescribing any other matter or thing that by this Part is to be or may be prescribed; and</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-12" lims:fid="254364" lims:id="254364"><Label>(n)</Label><Text>generally for carrying out the purposes and provisions of this Part.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2016-12-12" lims:fid="254365" lims:id="254365"><MarginalNote lims:inforce-start-date="2016-12-12" lims:fid="254366" lims:id="254366">Regulations</MarginalNote><Label>(2)</Label><Text>The Governor in Council may make regulations respecting the sale or importation of any hazardous product referred to in subsection 14.1(1) or (2).</Text></Subsection><Subsection lims:inforce-start-date="2016-12-12" lims:fid="254367" lims:id="254367"><MarginalNote lims:inforce-start-date="2016-12-12" lims:fid="254368" However, if the individual is employed by a provincial government, or a public body established under an Act of the legislature of a province, the Minister may make the designation only after obtaining the approval of that government or public body.</Text></Subsection><Subsection lims:inforce-start-date="2016-12-12" lims:fid="254459" lims:id="254459"><MarginalNote lims:inforce-start-date="2016-12-12" lims:fid="254460" lims:id="254460">Certificate to be produced</MarginalNote><Label>(2)</Label><Text>The Minister shall furnish every inspector with a certificate of designation and, on entering any place in accordance with subsection 22(1), an inspector shall, on request, produce the certificate to the person in charge of that place.</Text></Subsection><Subsection lims:inforce-start-date="2016-12-12" lims:fid="254461" lims:id="254461"><MarginalNote lims:inforce-start-date="2016-12-12" lims:fid="254462" lims:id="254462">Objectives, guidelines and codes of practice</MarginalNote><Label>(3)</Label><Text>The Minister may establish objectives, guidelines and codes of practice respecting the exercise of an inspector’s or analyst’s powers, and the performance of an inspector’s or analyst’s duties or functions, under this Act.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-12-12" lims:fid="254464" lims:id="254464">R.S., 1985, c. H-3, s. 21; R.S., 1985, c. 24 (3rd Supp.), s. 1; 2014, c. 20, s. 122; 2016, c. 9, s. 14</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2016-12-12" lims:fid="254465" lims:id="254465" level="2"><TitleText>Inspection and Analysis</TitleText></Heading><Section lims:inforce-start-date="2015-02-11" lims:lastAmendedDate="2015-02-11" lims:fid="254466" lims:id="254466"><MarginalNote lims:inforce-start-date="2015-02-11" lims:fid="254467" lims:id="254467">Powers of inspectors</MarginalNote><Label>22</Label><Subsection lims:inforce-start-date="2015-02-11" lims:fid="254468" lims:id="254468"><Label>(1)</Label><Text>Subject to subsection 22.1(1), an inspector may, for a purpose related to verifying compliance or preventing non-compliance with the provisions of this Act or of the regulations, at any reasonable time enter any place, including a conveyance, in which the inspector has reasonable grounds to believe that an activity regulated under this Act is conducted or a thing to which this Act applies is located, and may, for that purpose,</Text><Paragraph lims:inforce-start-date="2015-02-11" lims:fid="254469" lims:id="254469"><Label>(a)</Label><Text>examine or test any product, mixture, material or substance found in the place that the inspector has reasonable grounds to believe is a hazardous product and take samples of it, and examine any other thing that the inspector believes on reasonable grounds is used or is capable of being used for the manufacture, preparation, preservation, packaging, sale, importation or storage of a hazardous product;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-11" lims:fid="254470" lims:id="254470"><Label>(b)</Label><Text>open and examine any receptacle or package that is found in the place;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-11" lims:fid="254471" lims:id="254471"><Label>(c)</Label><Text>examine a document that is found in the place, make a copy of it or take an extract from it;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-11" lims:fid="254472" lims:id="254472"><Label>(d)</Label><Text>use or cause to be used a computer or other device that is at the place to examine a document that is contained in or available to a computer system or reproduce it or cause it to be reproduced in the form of a printout or other intelligible output and remove the output for examination or copying;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-11" lims:fid="254473" lims:id="254473"><Label>(e)</Label><Text>use or cause to be used any copying equipment that is at the place and remove the copies for examination;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-11" lims:fid="254474" lims:id="254474"><Label>(f)</Label><Text>take photographs and make recordings and sketches;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-11" lims:fid="254475" lims:id="254475"><Label>(g)</Label><Text>order the owner or person having possession, care or control of any product, mixture, material or substance found in the place that the inspector has reasonable grounds to believe is a hazardous product to move it or, for any time that may be necessary, not to move it or to restrict its movement;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-11" lims:fid="254476" lims:id="254476"><Label>(h)</Label><Text>order the owner or person having possession, care or control of the conveyance to move it or, for any time that may be necessary, not to move it or to restrict its movement;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-11" lims:fid="254477" lims:id="254477"><Label>(i)</Label><Text>order the owner or person in charge of the place to establish their identity to the inspector’s satisfaction; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-11" lims:fid="254478" lims:id="254478"><Label>(j)</Label><Text>remove anything from the place for the purpose of examination, conducting tests or taking samples.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-02-11" lims:fid="254479" lims:id="254479"><MarginalNote lims:inforce-start-date="2015-02-11" lims:fid="254480" lims:id="254480">Conveyance</MarginalNote><Label>(1.1)</Label><Text>For the purpose of entering a conveyance, an inspector may order the owner or person having possession, care or control of the conveyance to stop it or move it to a place where the inspector can enter it.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-11" lims:fid="254481" lims:id="254481"><MarginalNote lims:inforce-start-date="2015-02-11" lims:fid="254482" lims:id="254482">Disposition of samples</MarginalNote><Label>(1.2)</Label><Text>A sample taken under this section may be disposed of in any manner that an inspector considers appropriate.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-11" lims:fid="254483" lims:id="254483"><MarginalNote lims:inforce-start-date="2015-02-11" lims:fid="254484" lims:id="254484">Individual accompanying inspector</MarginalNote><Label>(1.3)</Label><Text>An inspector may be accompanied by any individual that they believe is necessary to help them exercise their powers or perform their duties or functions under this section.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-11" lims:fid="254485" lims:id="254485"><MarginalNote lims:inforce-start-date="2015-02-11" lims:fid="254486" lims:id="254486">Entering private property</MarginalNote><Label>(1.4)</Label><Text>An inspector who is exercising powers or performing duties or functions under this section and any individual accompanying them may enter private property  —  other than a dwelling-house  —  and pass through it in order to gain entry to a place referred to in subsection (1).</Text></Subsection><Subsection lims:inforce-start-date="2015-02-11" lims:fid="254487" lims:id="254487"><MarginalNote lims:inforce-start-date="2015-02-11" lims:fid="254488" lims:id="254488">Assistance to inspectors</MarginalNote><Label>(2)</Label><Text>The owner or person in charge of the place and every person found in it shall give the inspector all reasonable assistance and provide the inspector with any information that the inspector may require for the purpose of exercising the inspector’s powers or performing the inspector’s duties or functions under this section.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-02-11" lims:fid="254490" lims:id="254490">R.S., 1985, c. and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-11" lims:fid="254548" lims:id="254548"><Label>(d)</Label><Text>the evidence on which the applicant intends to rely to establish that</Text><Subparagraph lims:inforce-start-date="2015-02-11" lims:fid="254549" lims:id="254549"><Label>(i)</Label><Text>the applicant was the owner or the person having possession, care or control of the thing at the time of its seizure, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-11" lims:fid="254550" lims:id="254550"><Label>(ii)</Label><Text>the thing was not used in the contravention of any provision of this Act or of the regulations and it is not something in relation to which a provision of this Act or of the regulations was contravened.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-02-11" lims:fid="254551" lims:id="254551"><MarginalNote lims:inforce-start-date="2015-02-11" lims:fid="254552" lims:id="254552">Order of restoration</MarginalNote><Label>(3)</Label><Text>Subject to section 26, the provincial court judge shall order that the thing seized be restored without delay to the applicant if, on the hearing of an application made under subsection (1), the judge is satisfied that</Text><Paragraph lims:inforce-start-date="2015-02-11" lims:fid="254553" lims:id="254553"><Label>(a)</Label><Text>the applicant was the owner or the person having possession, care or control of the thing at the time of its seizure;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-11" lims:fid="254554" lims:id="254554"><Label>(a.1)</Label><Text>the thing was not used in the contravention of any provision of this Act or of the regulations and it is not something in relation to which a provision of this Act or of the regulations was contravened; The thing forfeited may be disposed of, as the Minister directs, at the expense of its owner, the person who was entitled to possession of it at the time of its seizure or the person who has been lims:inforce-start-date="2016-12-12" lims:fid="254570" lims:id="254570"><Label>(1)</Label><Text>An inspector who has reasonable grounds to believe that an imported hazardous product does not meet the requirements of the regulations or was imported in contravention of a provision of this Act or of the regulations may decide whether to give the owner or importer, or the person having possession, care or control of the product, the opportunity to take a measure in respect of it.</Text></Subsection><Subsection lims:inforce-start-date="2016-12-12" lims:fid="254571" lims:id="254571"><MarginalNote lims:inforce-start-date="2016-12-12" lims:fid="254572" lims:id="254572">Factors</MarginalNote><Label>(2)</Label><Text>In making a decision under subsection (1), the inspector shall consider, among other factors</Text><Paragraph lims:inforce-start-date="2016-12-12" lims:fid="254573" lims:id="254573"><Label>(a)</Label><Text>whether the hazardous product endangers human health or safety; and</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-12" lims:fid="254574" lims:id="254574"><Label>(b)</Label><Text>any other prescribed factors.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2016-12-12" lims:fid="254575" lims:id="254575"><MarginalNote lims:inforce-start-date="2016-12-12" lims:fid="254576" lims:id="254576">Duty of inspector</MarginalNote><Label>(3)</Label><Text>If the inspector decides under subsection (1) not to give the owner or importer, or the person having possession, care or control of the hazardous product the opportunity to take a measure in respect of it, the inspector shall exercise, in respect of the product, any of the powers conferred by the provisions of this Act, other than this section, or of the regulations.</Text></Subsection><Subsection lims:inforce-start-date="2016-12-12" lims:fid="254577" lims:id="254577"><MarginalNote lims:inforce-start-date="2016-12-12" lims:fid="254578" lims:id="254578">Measures that may be taken and notice</MarginalNote><Label>(4)</Label><Text>However, if the inspector decides under subsection (1) to give the owner or importer, or the person having possession, care or control of the hazardous product the opportunity to take a measure in respect of it, the inspector, or any other inspector who is informed of the decision, shall decide whether the owner or importer, or the person having possession, care or control of it may remove it from Canada at their expense, consent to its forfeiture or take either of these measures, and shall notify or cause to be notified the owner or importer, or the person having possession, care or control of the product that they may take that measure within the period specified by the inspector or other inspector, as the case may be.</Text></Subsection><Subsection lims:inforce-start-date="2016-12-12" lims:fid="254579" lims:id="254579"><MarginalNote lims:inforce-start-date="2016-12-12" lims:fid="254580" lims:id="254580">Forfeiture</MarginalNote><Label>(5)</Label><Text>If a person is notified under subsection (4) that they may consent to the forfeiture of the hazardous product and the person consents to its forfeiture, the product is forfeited to Her Majesty in right of Canada and may be disposed of, as the Minister may direct, at the person’s expense.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-12-12" lims:fid="254582" lims:id="254582">2016, c. 9, s. Minister may order a supplier to take any measure that the Minister considers necessary to remedy a non-compliance, or to prevent non-compliance, with the provisions of this Act or of the regulations, if the Minister believes on reasonable grounds that any provision of this Act or of the regulations has been contravened in relation to the hazardous product.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-11" lims:fid="254587" lims:id="254587"><MarginalNote lims:inforce-start-date="2015-02-11" lims:fid="254588" lims:id="254588">Measures</MarginalNote><Label>(2)</Label><Text>The measures referred to in subsection (1) include measures related to the label or safety data sheet for the hazardous product or to stopping the sale or importation of the hazardous product or causing it to be stopped.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-11" lims:fid="254589" lims:id="254589"><MarginalNote lims:inforce-start-date="2015-02-11" lims:fid="254590" lims:id="254590">Notice</MarginalNote><Label>(3)</Label><Text>The order shall be provided in the form of a written notice that sets out the reasons for the measure and the time within which and manner in which the measure is to be carried out.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-11" review</MarginalNote><Label>26.3</Label><Subsection lims:inforce-start-date="2015-02-11" lims:fid="254602" lims:id="254602"><Label>(1)</Label><Text>Subject to any other provision of this section, an order made under section 26.1 shall be reviewed by a review officer other than the individual who made the order, on the written request of the person who was ordered under it to take a measure, but only on grounds that involve questions of fact alone or questions of mixed law and fact.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-11" lims:fid="254603" lims:id="254603"><MarginalNote lims:inforce-start-date="2015-02-11" lims:fid="254604" lims:id="254604">Contents of and time for making request</MarginalNote><Label>(2)</Label><Text>The written request shall state the grounds for review and set out the evidence, including evidence that was not considered by the individual who made the order, that supports those grounds and the decision that is sought. It shall be delivered to the Minister within seven days after the day on which the order is provided under subsection 26.1(3).</Text></Subsection><Subsection lims:inforce-start-date="2015-02-11" lims:fid="254605" lims:id="254605"><MarginalNote lims:inforce-start-date="2015-02-11" lims:fid="254606" lims:id="254606">No authority to review</MarginalNote><Label>(3)</Label><Text>The review is not to be done if the request does not comply with subsection (2) or is frivolous, vexatious or not made in good faith.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-11" lims:fid="254607" lims:id="254607"><MarginalNote lims:inforce-start-date="2015-02-11" lims:fid="254608" lims:id="254608">Reasons for refusal</MarginalNote><Label>(4)</Label><Text>The person who made the request shall, without delay, be notified in writing of the reasons for not doing the review.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-11" lims:fid="254609" lims:id="254609"><MarginalNote lims:inforce-start-date="2015-02-11" lims:fid="254610" lims:id="254610">Review initiated by review officer</MarginalNote><Label>(5)</Label><Text>A review officer  —  other than the individual who made the order  —  may review an order made under section 26.1, whether or not a request is made under subsection (1).</Text></Subsection><Subsection lims:inforce-start-date="2015-02-11" lims:fid="254611" lims:id="254611"><MarginalNote lims:inforce-start-date="2015-02-11" lims:fid="254612" lims:id="254612">Order in effect</MarginalNote><Label>(6)</Label><Text>An order made under section 26.1 continues to apply during a review unless the review officer decides otherwise.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-11" lims:fid="254613" lims:id="254613"><MarginalNote lims:inforce-start-date="2015-02-11" lims:fid="254614" lims:id="254614">Completion of review</MarginalNote><Label>(7)</Label><Text>A review officer shall complete the review no later than 30 days after the day on which the request is delivered to the Minister.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-11" lims:fid="254615" lims:id="254615"><MarginalNote lims:inforce-start-date="2015-02-11" lims:fid="254616" lims:id="254616">Extension of period for review</MarginalNote><Label>(8)</Label><Text>The review officer may extend the review period by no more than 30 days if they are of the opinion that more time is required to complete the review. or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-11" lims:fid="254677" lims:id="254677"><Label>(b)</Label><Text>on summary conviction, for a first offence, to a fine of not more than $500,000 or to imprisonment for a term of not more than 18 months or to both and, for a subsequent offence, to a fine of not more than $1,000,000 or to imprisonment for a term of not more than two years or to both.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-02-11" lims:fid="254678" lims:id="254678"><MarginalNote lims:inforce-start-date="2015-02-11" lims:fid="254679" lims:id="254679">Parties to offence</MarginalNote><Label>(2)</Label><Text>If a person other than an individual commits an offence under subsection (1) or (1.2), an officer, director, or agent or mandatary, of the person who directed, authorized, assented to, acquiesced in or participated in the commission of the offence is a party to and guilty of the offence and is liable on conviction to the punishment provided for the offence, whether or not the person has been prosecuted or convicted.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-11" lims:fid="254680" lims:id="254680"><MarginalNote lims:inforce-start-date="2015-02-11" lims:fid="254681" lims:id="254681">Limitation period</MarginalNote><Label>(3)</Label><Text>Proceedings by way of summary conviction in respect of an offence under paragraph (1)(b) or (1.2)(b) may be instituted at any time within two years after the day on which the subject matter of the proceedings arises.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-11" lims:fid="254682" lims:id="254682"><MarginalNote lims:inforce-start-date="2015-02-11" lims:fid="254683" lims:id="254683">Sentencing considerations</MarginalNote><Label>(4)</Label><Text>A court that imposes a sentence shall take into account, in addition to any other principles that it is required to consider, the harm or risk of harm caused by the commission of the offence.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-11" lims:fid="254684" lims:id="254684"><MarginalNote lims:inforce-start-date="2015-02-11" lims:fid="254685" lims:id="254685">Proof of offence</MarginalNote><Label>(5)</Label><Text>In a prosecution for an offence under subsection (1) or (1.2), it is sufficient proof of the offence to establish that it was committed by an employee, or agent or mandatary, of the accused, even if the employee, or agent or mandatary, is not identified or prosecuted for the offence, unless the accused establishes that the offence was committed without the knowledge or consent of the accused and that the accused exercised due diligence to prevent its commission.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-02-11" lims:fid="254687" lims:id="254687">R.S., 1985, c. 24 (3rd Supp.), s. 1;
