lims:id="253050"><Label>(1)</Label><Text>In this Act,</Text><Definition lims:inforce-start-date="2015-02-27" lims:fid="253051" lims:id="253051"><Text><DefinedTermEn>analyst</DefinedTermEn> means a person designated as an analyst pursuant to section 32; (<DefinedTermFr>analyste</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="253052" lims:id="253052"><Text><DefinedTermEn>animal</DefinedTermEn> includes an embryo and a fertilized egg or ovum; (<DefinedTermFr>animal</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="253053" lims:id="253053"><Text><DefinedTermEn>animal by-product</DefinedTermEn> includes blood or any of its components, bones, bristles, feathers, flesh, hair, hides, hoofs, horns, offal, skins and wool, and any thing containing any of those things; (<DefinedTermFr>sous-produit animal</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="253054" lims:id="253054"><Text><DefinedTermEn>animal deadyard</DefinedTermEn> means a place where animal carcasses, animal by-products or disabled or diseased animals are brought when they are not to be prepared for human consumption; (<DefinedTermFr>atelier d’équarrissage</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="253055" lims:id="253055"><Text><DefinedTermEn>animal food</DefinedTermEn> means any thing that is capable of being a nutriment for animals and includes any of the constituent elements of an animal ration; (<DefinedTermFr>aliments pour animaux</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="253056" lims:id="253056"><Text><DefinedTermEn>animal product</DefinedTermEn> includes cream, eggs, milk, non-fertilized ova and semen; (<DefinedTermFr>produit animal</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="253057" lims:id="253057"><Text><DefinedTermEn>Assessor</DefinedTermEn> means the Assessor or any Deputy Assessor appointed under Part II of the <XRefExternal reference-type="act" link="P-10">Pesticide Residue Compensation Act</XRefExternal>; (<DefinedTermFr>évaluateur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="253058" lims:id="253058"><Text><DefinedTermEn>conveyance</DefinedTermEn> means any aircraft, carriage, motor vehicle, trailer, railway car, vessel, cargo container or other contrivance used to move persons, animals or things; (<DefinedTermFr>véhicule</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="253059" lims:id="253059"><Text><DefinedTermEn>customs officer</DefinedTermEn> means a person employed in the administration and enforcement of the <XRefExternal reference-type="act" link="C-52.6">Customs Act</XRefExternal> and includes any member of the Royal Canadian Mounted Police; (<DefinedTermFr>agent des douanes</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="253060" lims:id="253060"><Text><DefinedTermEn>disease</DefinedTermEn> includes</Text><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253061" lims:id="253061"><Label>(a)</Label><Text>a reportable disease and any other disease that may affect an animal or that may be transmitted by an animal to a person, and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253062" lims:id="253062"><Label>(b)</Label><Text>the causative agent of any such disease; (<DefinedTermFr>maladie</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="253063" lims:id="253063"><Text><DefinedTermEn>dispose</DefinedTermEn> includes slaughter or otherwise destroy, bury or render; (<DefinitionEnOnly>Version anything on which information that is capable of being understood by a person, or read by a computer or other device, is recorded or marked; (<DefinedTermFr>document</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="253065" lims:id="253065"><Text><DefinedTermEn>hatchery</DefinedTermEn> means, subject to any regulations made under subsection (2), a place where eggs are incubated or chicks are hatched; (<DefinedTermFr>couvoir</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="253066" lims:id="253066"><Text><DefinedTermEn>infected place</DefinedTermEn> means a place that is constituted to be an infected place under section 22 or 23 or under the regulations; (<DefinedTermFr>lieu lims:id="253068"><Text><DefinedTermEn>justice</DefinedTermEn> means a justice as defined in section 2 of the <XRefExternal reference-type="act" link="C-46">Criminal lims:id="253069"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Agriculture and Agri-Food; (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="253070" lims:id="253070"><Text><DefinedTermEn>officer</DefinedTermEn> means a person designated as an officer pursuant to section 32, but does not include an analyst; (<DefinedTermFr>agent d’exécution</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="253071" lims:id="253071"><Text><DefinedTermEn>peace monetary penalty imposed under the <XRefExternal reference-type="act" link="A-8.8">Agriculture and Agri-Food Administrative Monetary Penalties Act</XRefExternal> for a violation; (<DefinedTermFr>sanction</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="253073" lims:id="253073"><Text><DefinedTermEn>place</DefinedTermEn> includes a conveyance; (<DefinedTermFr>lieu</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="253074" lims:id="253074"><Text><DefinedTermEn>prescribed</DefinedTermEn> means prescribed by regulation; (<DefinitionEnOnly>Version anglaise seulement</DefinitionEnOnly>)</Text></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="253075" lims:id="253075"><Text><DefinedTermEn>rendering plant</DefinedTermEn> means a place</Text><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253076" lims:id="253076"><Label>(a)</Label><Text>where animal by-products are prepared or treated for use in, or converted into, fertilizers, animal food, fats or oils, other than fats or oils used for human consumption,</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253077" lims:id="253077"><Label>(b)</Label><Text>where a substance resulting from a process mentioned in paragraph (a) is stored, packed or marked, or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253078" lims:id="253078"><Label>(c)</Label><Text>from which a substance resulting from a process mentioned in paragraph (a) is lims:id="1110027"><Text><DefinedTermEn>Tribunal</DefinedTermEn> means the Review Tribunal continued by subsection 27(1) of the <XRefExternal reference-type="act" link="A-8.8">Agriculture and Agri-Food Administrative Monetary Penalties Act</XRefExternal>; (<DefinedTermFr>Commission</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="253082" lims:id="253082"><Text><DefinedTermEn>vector</DefinedTermEn> means an animal that has the potential to transmit a disease, directly or indirectly, from one animal or its excreta to another animal; (<DefinedTermFr>vecteur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="253083" lims:id="253083"><Text><DefinedTermEn>veterinary biologic</DefinedTermEn> means a thing that is manufactured, sold or represented for use in restoring, correcting or modifying organic functions in animals or for use in the diagnosis, treatment, mitigation or prevention of a disease, disorder or abnormal physical state — or its symptoms — in animals and that is</Text><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253084" lims:id="253084"><Label>(a)</Label><Text>a helminth, protozoa or micro-organism,</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253085" lims:id="253085"><Label>(b)</Label><Text>a substance or mixture of substances derived from animals, helminths, protozoa, micro-organisms or plants, or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253086" lims:id="253086"><Label>(c)</Label><Text>a substance of synthetic origin; (<DefinedTermFr>produit biologique vétérinaire</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="253087" lims:id="253087"><Text><DefinedTermEn>veterinary inspector</DefinedTermEn> means a veterinarian designated as an inspector pursuant to section 32; (<DefinedTermFr>vétérinaire-inspecteur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="253088" lims:id="253088"><Text><DefinedTermEn>violation</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253089" lims:id="253089"><Label>(a)</Label><Text>any contravention of any provision of this Act or of a regulation made under this Act, or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253090" lims:id="253090"><Label>(b)</Label><Text>any refusal or neglect to perform any duty imposed by or under this Act,</Text></Paragraph><ContinuedDefinition lims:inforce-start-date="2015-02-27" lims:fid="253091" lims:id="253091"><Text>that may be proceeded with in accordance with the <XRefExternal reference-type="act" link="A-8.8">Agriculture and regulations</MarginalNote><Label>(2)</Label><Text>The Minister may make regulations excluding places from the definition <DefinedTermEn>hatchery</DefinedTermEn> and prescribing reportable diseases and toxic substances.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:fid="253094" lims:id="253094"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="253095" lims:id="253095">Incorporation by reference</MarginalNote><Label>(3)</Label><Text>Toxic substances may be prescribed</Text><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253096" lims:id="253096"><Label>(a)</Label><Text>in terms of the quantity or concentration in which substances are contained in other substances; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253105" lims:id="253105" level="1"><TitleText>Control of Diseases and Toxic Substances</TitleText></Heading><Heading lims:inforce-start-date="2015-02-27" lims:fid="253106" lims:id="253106" level="2"><TitleText>Notification and Samples</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="253107" lims:id="253107"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="253108" lims:id="253108">Notification by owner, etc.</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="253109" lims:id="253109"><Label>(1)</Label><Text>A person who owns or has the possession, care or control of an animal shall notify the nearest veterinary inspector of the presence of a reportable disease or toxic substance, or any fact indicating its presence, in or around the animal, immediately after the person becomes aware of the presence or fact.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="253110" lims:id="253110"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="253111" lims:id="253111">Notification by veterinarian, etc.</MarginalNote><Label>(2)</Label><Text>Immediately after a person who is a veterinarian or who analyses animal specimens suspects that an animal is affected or contaminated by a reportable disease or toxic substance, the person shall so notify a veterinary inspector.</Text></Subsection></Section><Section lims:inforce-start-date="2015-02-27" lims:lastAmendedDate="2015-02-27" lims:fid="253112" lims:id="253112"><Label>6</Label><Text><Repealed>[Repealed, 2015, c. 2, s. 85]</Repealed></Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="253113" lims:id="253113"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="253114" lims:id="253114">Notice forbidding entry</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="253115" lims:id="253115"><Label>(1)</Label><Text>Where</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="253116" lims:id="253116"><Label>(a)</Label><Text>there exists in an area a disease or toxic substance that is capable of affecting animals, and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="253117" lims:id="253117"><Label>(b)</Label><Text>reasonable steps have been taken by the Minister to</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="253118" lims:id="253118"><Label>(i)</Label><Text>bring the existence of the disease or toxic substance to the attention of persons having the possession, care or control of animals in the area, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="253119" lims:id="253119"><Label>(ii)</Label><Text>make those persons aware of the requirements of this subsection,</Text></Subparagraph></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="253120" lims:id="253120"><Text>every person in that area who owns or has the possession, care or control of an animal shall affix at the entrance to the building or other enclosed place in which the animal is kept a notice forbidding entry without the person’s permission.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="253121" lims:id="253121"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="253122" lims:id="253122">Notice forbidding entry without permission</MarginalNote><Label>(2)</Label><Text>A person who owns or has the possession, care or control of an animal shall affix at the entrance to the building or other enclosed place in which the animal is kept a notice forbidding entry without the permission of an inspector or officer where there exists in the area a disease or toxic substance that is capable of affecting the animal and the inspector or officer requires such a notice to be so affixed.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="253123" lims:id="253123"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="253124" lims:id="253124">Prohibition</MarginalNote><Label>(3)</Label><Text>No person shall knowingly enter a building or other enclosed place in contravention of a notice affixed under this section, unless the person has a right of entry or way into the building or place or any part thereof or an inspector or officer has authorized the entry.</Text></Subsection></Section><Heading lims:inforce-start-date="2015-02-27" lims:fid="253125" lims:id="253125" level="2"><TitleText>Prohibitions</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="253126" lims:id="253126"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="253127" lims:id="253127">Concealment</MarginalNote><Label>8</Label><Text>No person shall conceal the existence of a reportable disease or toxic substance among animals.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="253128" lims:id="253128"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="253129" lims:id="253129">Keeping diseased animals</MarginalNote><Label>9</Label><Text>No person shall turn out, keep or graze on any undivided or unenclosed land any animal that the person knows is affected or contaminated by, or has been exposed to, any reportable disease or toxic substance.</Text></Section><Section lims:inforce-start-date="2015-02-26" lims:lastAmendedDate="2015-02-26" lims:fid="253130" lims:id="253130"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="253131" lims:id="253131">Bringing diseased animals to market</MarginalNote><Label>10</Label><Text>No person shall, without a licence issued by an inspector or officer, bring into any market, fair or other place any animal that is known by the person to be affected or contaminated by, or has been exposed to, any reportable disease or toxic substance.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-02-26" lims:fid="253133" lims:id="253133">1990, c. 21, s. 10; 2015, c. 3, s. excuse, dig up all or any part of the buried carcass of an animal that died or is suspected of having died as a result of being affected or contaminated by a disease or toxic substance, or that was destroyed because it was, or was suspected of being, affected or contaminated by a disease or toxic substance.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="253150" lims:id="253150"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="253151" lims:id="253151">Experimentation and examination</MarginalNote><Label>(2)</Label><Text>The Minister may</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="253152" lims:id="253152"><Label>(a)</Label><Text>reserve for experimentation an animal required to be destroyed under this Act or the carcass of an animal destroyed under this Act; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="253153" lims:id="253153"><Label>(b)</Label><Text>authorize an inspector or officer to perform a <Emphasis style="italic">post mortem</Emphasis> examination of the carcass of an animal that has died or is suspected of having died from a disease or toxic substance and, if the carcass is buried, to dig it up for the purpose of the examination.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2015-02-27" lims:fid="253154" lims:id="253154" level="2"><TitleText>Importation</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="253155" lims:id="253155"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="253156" lims:id="253156">Regulations prohibiting importation</MarginalNote><Label>14</Label><Text>The Minister may make regulations prohibiting the importation of any animal or other thing into Canada, any part of Canada or any Canadian port, either generally or from any place named in the regulations, for such period as the Minister considers necessary for the purpose of preventing a disease or toxic substance from being introduced into or spread within Canada.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="253157" lims:id="253157"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="253158" lims:id="253158">Prohibition of possession or disposition</MarginalNote><Label>15</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="253159" lims:id="253159"><Label>(1)</Label><Text>No person shall possess or dispose of an animal or thing that the person knows was imported in contravention of this Act or the regulations.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="253160" lims:id="253160"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="253161" lims:id="253161">Presumption</MarginalNote><Label>(2)</Label><Text>In any prosecution for an offence under subsection (1), an accused who is found to have been in possession of an animal or thing that was imported in contravention of this Act or the regulations shall be considered, in the absence of evidence to the contrary, to have known that the thing was so imported.</Text></Subsection></Section><Section lims:inforce-start-date="2015-02-27" lims:lastAmendedDate="2015-02-27" lims:fid="253162" lims:id="253162"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="253163" lims:id="253163">Importation into Canada</MarginalNote><Label>16</Label><Subsection lims:inforce-start-date="2015-02-27" lims:fid="253164" lims:id="253164"><Label>(1)</Label><Text>Where a person imports into Canada any animal, animal product, animal byproduct, animal food or veterinary biologic, or any other thing used in respect of animals or contaminated by a disease or toxic substance, the person shall, either before or at the time of importation, present the animal, animal product, animal by-product, animal food, veterinary biologic or other thing to an inspector, officer or customs officer who may inspect it or detain it until it has been inspected or otherwise dealt with by an inspector or officer.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:fid="253165" lims:id="253165"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="253166" lims:id="253166">Regulations</MarginalNote><Label>(2)</Label><Text>The Minister may make regulations for exempting animals or things from the application of this section and determines that an animal or thing has been imported — or an attempt has been made to import an animal or thing — in contravention of this Act or the regulations or that a requirement imposed by or under the regulations in respect of an imported animal or thing has not been met, it is forfeited to Her Majesty in right of Canada and may be disposed of as the Minister may lims:inforce-start-date="2015-02-27" lims:fid="253174" lims:id="253174">Removal or destruction of unlawful imports</MarginalNote><Label>18</Label><Subsection lims:inforce-start-date="2015-02-27" lims:fid="253175" lims:id="253175"><Label>(1)</Label><Text>An inspector or officer who has reasonable grounds to believe that an imported animal or thing has been imported in contravention of this Act or the regulations, is or could be affected or contaminated by a disease or toxic substance or is a vector or that a requirement imposed by or under the regulations in respect of an imported animal or thing has not been met may, by notice, whether the animal or thing is seized or not, order its owner or importer or the person having possession, care or control of it to remove it from Canada or, if removal is not possible, to dispose of it.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:fid="253176" lims:id="253176"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="253177" lims:id="253177">Notice</MarginalNote><Label>(2)</Label><Text>The notice must either be delivered personally to the owner or importer of the animal or thing or to the person having possession, care or control of it or be sent by registered mail to the owner’s, importer’s or person’s address in Canada.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:fid="253178" lims:id="253178"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="253179" lims:id="253179">Forfeiture</MarginalNote><Label>(3)</Label><Text>If the animal or thing is not removed from Canada, or disposed of, within the period specified in the notice — or, if no period was specified, within 90 days after the day on which the notice was delivered or sent — it is, despite subsection 45(1), forfeited to Her Majesty in right of Canada and may be disposed of as the Minister may direct.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:fid="253180" lims:id="253180"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="253181" lims:id="253181">Suspension of application of subsection (3)</MarginalNote><Label>(4)</Label><Text>An inspector or officer may, for a period that he or she specifies, suspend the application of subsection (3) if he or she is satisfied that</Text><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253182" lims:id="253182"><Label>(a)</Label><Text>harm to human or animal health or, in the case of a veterinary biologic, to the environment is unlikely to result;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253183" lims:id="253183"><Label>(b)</Label><Text>the animal or thing will not be sold within that period;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253184" lims:id="253184"><Label>(c)</Label><Text>the measures that should have been taken for the animal or thing not to have been imported in contravention of a provision of this Act or the regulations will be taken within that period; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253185" lims:id="253185"><Label>(d)</Label><Text>if the animal or thing does not meet the requirements of the regulations, it will be brought into compliance with the regulations within that period.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:fid="253186" lims:id="253186"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="253187" lims:id="253187">Cancellation</MarginalNote><Label>(5)</Label><Text>An inspector or officer may cancel the notice if he or she is satisfied that</Text><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253188" lims:id="253188"><Label>(a)</Label><Text>harm to human or animal health or, in the case of a veterinary biologic, to the environment is unlikely to result;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253189" lims:id="253189"><Label>(b)</Label><Text>the animal or thing has not been sold within the period referred to in subsection (6);</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253190" lims:id="253190"><Label>(c)</Label><Text>the measures referred to in paragraph (4)(c) were taken within that period; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253191" lims:id="253191"><Label>(d)</Label><Text>if the animal or thing did not meet the requirements of the regulations when it was imported, it was brought into compliance with the regulations within that period.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:fid="253192" lims:id="253192"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="253193" lims:id="253193">Period</MarginalNote><Label>(6)</Label><Text>The period for the purposes of subsection (5) is</Text><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253194" lims:id="253194"><Label>(a)</Label><Text>if the application of subsection (3) was suspended under subsection (4), the period of the suspension; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253195" lims:id="253195"><Label>(b)</Label><Text>if the application of subsection (3) was not suspended, the period specified in the notice or, if no period was specified, the period that ends 90 days after the day on which the notice was delivered or sent.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:inforce-start-date="2002-12-31" lims:fid="253202" lims:id="253202">Certificate required</MarginalNote><Label>19</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="253203" lims:id="253203"><Label>(1)</Label><Text>No person shall export an animal from Canada by vessel or aircraft unless</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="253204" lims:id="253204"><Label>(a)</Label><Text>prior notice of the export of the animal has been given to a customs officer in charge of the place where the animal is to board the vessel or aircraft and the animal has been presented to a veterinary inspector in accordance with subsection (2) at that place; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="253205" lims:id="253205"><Label>(b)</Label><Text>a certificate of the veterinary inspector has been received by the person certifying that all the prescribed requirements respecting the health, protection and transportation of the animal have been complied with.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="253206" lims:id="253206"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="253207" lims:id="253207">Presentation of animal</MarginalNote><Label>(2)</Label><Text>An animal that is required to be inspected shall be presented in such manner and under such conditions as the veterinary inspector considers necessary to carry out the inspection.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="253208" lims:id="253208"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="253209" lims:id="253209">Copy of certificate</MarginalNote><Label>(3)</Label><Text>A copy of the certificate referred to in paragraph (1)(b) shall be delivered to</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="253210" lims:id="253210"><Label>(a)</Label><Text>the master or agent of the vessel or the pilot in command or operator of the aircraft; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="253211" lims:id="253211"><Label>(b)</Label><Text>the chief officer of customs of the port or airport from which the vessel or aircraft is to depart.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="253212" lims:id="253212"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="253213" lims:id="253213">No departure without certificate</MarginalNote><Label>(4)</Label><Text>Where a vessel or aircraft that is to depart from Canada has an animal on board,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="253214" lims:id="253214"><Label>(a)</Label><Text>no person shall send the vessel to sea or the aircraft on its flight, and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="253215" lims:id="253215"><Label>(b)</Label><Text>no person in charge of the vessel or aircraft shall take the vessel to sea or the aircraft on its flight,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="253216" lims:id="253216"><Text>unless a copy of a certificate in respect of the animal has been delivered in accordance with subsection (3).</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="253217" lims:id="253217"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="253218" lims:id="253218">Detention</MarginalNote><Label>(5)</Label><Text>The chief officer of customs referred to in paragraph (3)(b) shall detain animals until a copy of the certificate referred to in paragraph (1)(b) has been delivered to that officer.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="253219" lims:id="253219"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="253220" lims:id="253220">Exemptions</MarginalNote><Label>(6)</Label><Text>The Minister may make regulations exempting animals or categories of animals and shipments and categories of shipments from the application of this section.</Text></Subsection></Section><Section lims:inforce-start-date="2007-07-01" lims:lastAmendedDate="2007-07-01" lims:fid="253232" lims:id="253232">Assistance</MarginalNote><Label>21</Label><Text>The Minister may provide assistance, both financial and technical, to any person or government outside Canada in controlling or eradicating a disease or toxic substance that affects or could affect persons or animals in Canada.</Text></Section><Heading lims:inforce-start-date="2015-02-27" lims:fid="253233" lims:id="253233" level="1"><TitleText>Infected Places and Control Zones</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="253234" lims:id="253234"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="253235" lims:id="253235">Declaration of infected place</MarginalNote><Label>22</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="253236" lims:id="253236"><Label>(1)</Label><Text>Where an inspector or officer suspects or determines that a disease or toxic substance exists in a place and is of the opinion that it could spread or that animals or things entering the place could become affected or contaminated by it, the inspector or officer may in writing declare that the place is infected and identify the disease or toxic substance that is believed to exist there, and such a declaration may subsequently be amended by the inspector or officer.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="253237" lims:id="253237"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="253238" lims:id="253238">Delivery of declaration</MarginalNote><Label>(2)</Label><Text>When the declaration is delivered to the occupier or owner of the place to which it relates, the place, together with all contiguous lands, buildings and other places occupied or owned by the occupier or owner, constitutes an infected place.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="253239" lims:id="253239"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="253240" lims:id="253240">Further declaration</MarginalNote><Label>23</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="253241" lims:id="253241"><Label>(1)</Label><Text>For the purpose of preventing the spread of a disease or toxic substance, an inspector or officer may in writing declare that any land, building or other place, any part of which lies within five kilometres of the limits of a place declared to be infected under section 22, is infected and identify the disease or toxic substance that could spread there.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="253242" lims:id="253242"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="253243" lims:id="253243">Delivery of declaration</MarginalNote><Label>(2)</Label><Text>When the declaration has been delivered to the occupier or owner of any land, building or other place mentioned in subsection (1), the land, building or other place, together with all contiguous lands, buildings and other places occupied or owned by the same occupier or owner, constitutes an infected place.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="253244" officer cannot, after the exercise of due diligence, find the occupier or owner of any land, building or other place, delivery of a declaration may be effected by posting it on the building or on any substance exists in an area, he or she may, by order, declare the area to be a primary control zone, in which case the Minister shall describe the zone and identify the disease or toxic lims:id="253276"><Label>(1)</Label><Text>If the Minister makes an order under subsection 27(1), he or she may — for the purpose of preventing the spread of the disease or toxic substance identified in the order or monitoring that disease or toxic substance — by order, declare any area that he or she considers necessary to be a secondary control zone, in which case the Minister shall describe the zone.</Text></Subsection><Subsection lims:inforce-start-date="2013-01-01" lims:fid="253277" lims:id="253277"><MarginalNote lims:inforce-start-date="2013-01-01" lims:fid="253278" lims:id="253278">Disease outside Canada</MarginalNote><Label>(2)</Label><Text>If the Minister believes that a disease or toxic substance exists in an area outside Canada, he or she may — for the purpose of preventing the spread of that disease or toxic substance into Canada or monitoring that disease or toxic substance — by order, declare any area in Canada that he or she considers necessary to be a secondary control zone, in which case the Minister shall describe the zone and identify that disease or toxic substance.</Text></Subsection><Subsection lims:inforce-start-date="2013-01-01" lims:fid="253279" lims:id="253279"><MarginalNote lims:inforce-start-date="2013-01-01" lims:fid="253280" lims:id="253280">Designated animal or thing</MarginalNote><Label>(3)</Label><Text>The Minister may, by order, designate any animal or thing that is capable of being affected or contaminated by the disease or toxic substance in respect of which the secondary control zone referred to in subsection (2) is declared.</Text></Subsection><Subsection lims:inforce-start-date="2013-01-01" lims:fid="253281" lims:id="253281"><MarginalNote lims:inforce-start-date="2013-01-01" lims:fid="253282" lims:id="253282">Conditions</MarginalNote><Label>(4)</Label><Text>The Minister may, by order, prohibit or impose conditions on — including requiring a permit for — removing from, moving within or animal or thing that is or has been in a primary or secondary control zone,</Text><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="253306" lims:id="253306"><Label>(a)</Label><Text>treat that animal or thing or require its owner or the person having the possession, care or control of it to treat it or to have it treated if the Minister considers that the treatment will be effective in eliminating the disease or toxic substance or preventing its spread; or</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="253307" lims:id="253307"><Label>(b)</Label><Text>dispose of that animal or thing or require its owner or the person having the possession, care or control of it to dispose of it.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-01-01" lims:fid="253308" lims:id="253308"><MarginalNote lims:inforce-start-date="2013-01-01" lims:fid="253309" lims:id="253309">Return animal or thing</MarginalNote><Label>(2)</Label><Text>If an inspector or officer believes on reasonable grounds that a designated animal or thing has been removed from, moved within or taken into a primary control zone in contravention of subsection 27(3) — or a secondary control zone in contravention of an order made under subsection 27.1(4) — the inspector or officer may, whether or not that animal or thing is seized, move it to any place or require its owner or the person having the possession, care or control of it to move it to any 2012, c. 19, s. 508</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2015-02-27" lims:fid="253321" lims:id="253321" level="1"><TitleText>Administration</TitleText></Heading><Heading lims:inforce-start-date="2015-02-27" lims:fid="253322" lims:id="253322" level="2"><TitleText>Facilities</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="253323" lims:id="253323"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="253324" lims:id="253324">Operation of services and facilities</MarginalNote><Label>29</Label><Text>The Minister may operate, provide or approve any diagnostic, research, laboratory or other services or facilities required for the purposes of this Act or any regulations.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="253325" lims:id="253325"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="253326" lims:id="253326">Designation of facilities</MarginalNote><Label>30</Label><Text>The Minister may designate areas, offices, laboratories or other facilities inside or outside Canada for a specified purpose or generally for the administration of this Act or the regulations and may at any time amend, cancel or reinstate any such designation.</Text></Section><Section lims:inforce-start-date="2015-02-26" lims:lastAmendedDate="2015-02-26" lims:fid="253327" lims:id="253327"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="253328" lims:id="253328">Definition of <DefinedTermEn>international transportation undertaking</DefinedTermEn></MarginalNote><Label>31</Label><Subsection lims:inforce-start-date="2015-02-26" lims:fid="253329" lims:id="253329"><Label>(1)</Label><Text>For the purposes of this section, <DefinedTermEn>international transportation undertaking</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="253330" lims:id="253330"><Label>(a)</Label><Text>an undertaking that transports persons or things internationally;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="253331" lims:id="253331"><Label>(b)</Label><Text>an international road, railway, bridge or tunnel;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="253332" lims:id="253332"><Label>(c)</Label><Text>an airport that receives any aircraft operating on an international flight;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="253333" lims:id="253333"><Label>(d)</Label><Text>a port that receives any ship sailing on an international voyage; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="253334" lims:id="253334"><Label>(e)</Label><Text>a warehouse or other facility that receives any international air, water, rail or road traffic.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="253335" lims:id="253335"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="253336" lims:id="253336">Required facilities</MarginalNote><Label>(2)</Label><Text>The owner or operator of an international transportation undertaking shall, where required in writing by the Minister, provide and maintain adequate areas, offices, laboratories and other facilities, including buildings, accommodation, equipment, furnishings and fixtures, for inspection or for any other purpose related to the administration of this Act or the regulations.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="253337" lims:id="253337"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="253338" lims:id="253338">Powers of Minister</MarginalNote><Label>(3)</Label><Text>The Minister may</Text><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="253339" lims:id="253339"><Label>(a)</Label><Text>cause to be made such improvements as the Minister considers desirable to any area, office, laboratory or other facility provided pursuant to subsection (2);</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="253340" lims:id="253340"><Label>(b)</Label><Text>post, on or about the area, office, laboratory or other facility, any signs that the Minister considers appropriate for its operation or safe use or for the administration of this Act or the regulations; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="253341" lims:id="253341"><Label>(c)</Label><Text>continue to use the area, office, laboratory or other facility for as long as the Minister requires it for the administration of this Act or the regulations.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="253342" lims:id="253342"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="253343" lims:id="253343">Construction and repairs</MarginalNote><Label>(4)</Label><Text>Where an area, office, laboratory or other facility that is provided by an owner or operator pursuant to subsection (2) is not adequate for the purposes mentioned in that subsection, the Minister may require the owner or operator to carry out any construction or repairs in order to render the area, office, laboratory or other facility adequate for those purposes, and if the owner or operator fails to do so, the Minister may cause the construction or repairs to be carried out and the owner or operator shall be liable for all reasonable costs incurred by the Minister and those costs may be recovered by Her Majesty in right of Canada.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="253344" lims:id="253344"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="253345" lims:id="253345">Notice</MarginalNote><Label>(5)</Label><Text>A requirement under subsection (4) shall be communicated by personal delivery of a notice to the owner or operator or by sending the notice to the owner or operator, and the notice may specify the period within which or the manner in which the construction or repairs are to be carried out.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="253346" lims:id="253346"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="253347" lims:id="253347">Arbitration</MarginalNote><Label>(6)</Label><Text>Subject to subsection (7) and any regulations made under subsection (8), a dispute over the adequacy of any area, office, laboratory or other facility may be resolved by arbitration in accordance with the <XRefExternal reference-type="act" link="C-34.6">Commercial Arbitration Act</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="253348" lims:id="253348"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="253349" lims:id="253349"><XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal></MarginalNote><Label>(7)</Label><Text>Any area, office, laboratory or other facility that fails to meet the applicable requirements of Part II of the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal> shall be deemed to be not adequate for the purposes mentioned in subsection (2).</Text></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="253350" lims:id="253350"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="253351" lims:id="253351">Regulations</MarginalNote><Label>(8)</Label><Text>The Governor in Council may make regulations for determining the adequacy of any area, office, laboratory or other facility for the purposes mentioned in subsection (2).</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-02-26" lims:fid="253353" lims:id="253353">1990, c. 21, s. 31; 2012, c. 19, s. 509</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="253371" lims:id="253371"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="253372" lims:id="253372">Agreements</MarginalNote><Label>34</Label><Text>For the purposes of this Act, the Minister may enter into an agreement with any qualified person to perform such duties or functions as the Minister may specify, on such terms and conditions as the Minister may specify.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="253373" lims:id="253373"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="253374" lims:id="253374">Impeding analyst, inspector or officer</MarginalNote><Label>35</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="253375" lims:id="253375"><Label>(1)</Label><Text>No person shall obstruct or hinder or make any false or misleading statement either orally or in writing to an analyst, inspector or officer who is performing duties or functions under this Act or the regulations.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="253376" lims:id="253376"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="253377" lims:id="253377">Assistance to inspectors and officers</MarginalNote><Label>(2)</Label><Text>The owner or the person in charge of a place entered by an inspector or officer under section 38 and every person found in the place shall</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="253378" lims:id="253378"><Label>(a)</Label><Text>give the inspector or officer all reasonable assistance in the owner’s or person’s power to enable the inspector or officer to perform duties and functions under this Act or the regulations; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="253379" lims:id="253379"><Label>(b)</Label><Text>furnish the inspector or officer with such information relevant to the administration of this Act or the regulations as the inspector or officer may reasonably require.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="253380" lims:id="253380"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="253381" lims:id="253381">Assistance of peace officer</MarginalNote><Label>(3)</Label><Text>A peace officer shall provide such assistance as an inspector or officer may request for the purpose of enforcing this Act or the regulations.</Text></Subsection></Section><Section lims:inforce-start-date="2015-02-27" lims:lastAmendedDate="2015-02-27" lims:fid="253382" lims:id="253382"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="253383" lims:id="253383">Provision of documents, information or samples</MarginalNote><Label>36</Label><Subsection lims:inforce-start-date="2015-02-27" lims:fid="253384" lims:id="253384"><Label>(1)</Label><Text>An inspector or officer may, for the purpose of detecting diseases or toxic substances or for a purpose related to verifying compliance or preventing non-compliance with this Act, order a person to provide, on the date, at the time and place and in the manner specified by the inspector or officer, any document, information or sample specified by the inspector or officer.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:fid="253385" lims:id="253385"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="253386" lims:id="253386">Duty to provide document, information or sample</MarginalNote><Label>(2)</Label><Text>A person who is ordered by an inspector or officer to provide a document, information or a sample has a duty to do so on the specified date, at the specified time and place and in the specified manner.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-02-27" lims:fid="253388" lims:id="253388">1990, c. 21, s. 36; 2015, c. 3, s. 103(F)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2015-02-27" lims:fid="253397" lims:id="253397" level="2"><TitleText>Inspection</TitleText></Heading><Section lims:inforce-start-date="2015-02-27" lims:lastAmendedDate="2015-02-27" lims:fid="253398" lims:id="253398"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="253399" lims:id="253399">Inspection</MarginalNote><Label>38</Label><Subsection lims:inforce-start-date="2015-02-27" lims:fid="253400" lims:id="253400"><Label>(1)</Label><Text>For the purpose of detecting diseases or toxic substances or for a purpose related to verifying compliance or preventing non-compliance with this Act, an inspector or officer may</Text><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253401" lims:id="253401"><Label>(a)</Label><Text>subject to section 39, at any reasonable time, enter and inspect any place, or stop any conveyance, in which the inspector or officer believes on reasonable grounds there is any animal or thing in respect of which this Act or the regulations apply;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253402" lims:id="253402"><Label>(b)</Label><Text>open any receptacle, baggage, package, cage or other thing that the inspector or officer believes on reasonable grounds contains any animal or thing in respect of which this Act or the regulations apply;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253403" lims:id="253403"><Label>(c)</Label><Text>require any person to present any animal or thing for inspection in such manner and under such conditions as the inspector considers necessary to carry out the inspection;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253404" lims:id="253404"><Label>(d)</Label><Text>examine any animal or thing in respect of which this Act or the regulations apply and take samples of it;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253405" lims:id="253405"><Label>(e)</Label><Text>require any person to produce for inspection or copying, in whole or in part, any record or document that the inspector or officer believes on reasonable grounds contains any information relevant to the administration of this Act or the regulations; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253406" lims:id="253406"><Label>(f)</Label><Text>conduct any tests or analyses or take any measurements.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:fid="253407" lims:id="253407"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="253408" lims:id="253408">Operation of data processing systems and copying equipment</MarginalNote><Label>(2)</Label><Text>In carrying out an inspection at any place under this section, an inspector or officer may</Text><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253409" lims:id="253409"><Label>(a)</Label><Text>use or cause to be used any data processing system at the place to examine any data contained in or available to the system;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253410" lims:id="253410"><Label>(b)</Label><Text>reproduce any record or cause it to be reproduced from the data in the form of a print-out or other intelligible output and take the print-out or other output for examination or copying; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="253455" lims:id="253455"><Label>(b)</Label><Text>require its owner or the person having the possession, care or control of it at the time of the seizure to remove it to any other place and to store it.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="253456" lims:id="253456"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="253457" lims:id="253457">Notice</MarginalNote><Label>(2)</Label><Text>A requirement under paragraph (1)(b) shall be communicated by personal delivery of a notice to the owner or person having the possession, care or control of the thing or by sending a notice to the owner or person, and the notice may specify the period within which and the manner in which the animal or thing is to be removed and stored.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="253458" lims:id="253458"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="253459" lims:id="253459">Proceeds</MarginalNote><Label>(3)</Label><Text>An inspector or officer who seizes and detains an animal or a perishable thing under this Act may dispose of it and any proceeds realized from its disposition shall be paid to the Receiver General.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-02-26" lims:fid="253461" lims:id="253461">1990, c. 21, s. 43; 2015, c. 3, s. 104(F)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="253462" lims:id="253462"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="253463" lims:id="253463">Interference with seized animals or things</MarginalNote><Label>44</Label><Text>Except as authorized in writing by an inspector or officer, no person shall remove, alter or interfere in any way with an animal or thing seized and detained under this Act.</Text></Section><Section lims:inforce-start-date="2015-02-27" lims:lastAmendedDate="2015-02-27" lims:fid="253464" lims:id="253464"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="253465" lims:id="253465">Release of seized animal or thing</MarginalNote><Label>45</Label><Subsection lims:inforce-start-date="2015-02-27" lims:fid="253466" lims:id="253466"><Label>(1)</Label><Text>If an inspector or officer is satisfied that the provisions of this Act and the regulations that apply with respect to an animal or thing seized under this Act have been complied with, the animal or thing must be released.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:fid="253467" lims:id="253467"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="253468" lims:id="253468">Application for return</MarginalNote><Label>(2)</Label><Text>If proceedings are instituted in relation to an animal or thing seized under this Act and it has not been disposed of or forfeited under this Act, the owner of the animal or thing or the person having the possession, care or control of it at the time of its seizure may apply for an order that it be returned. The application may be made, in the case of a violation, to the Tribunal or, in the case of an offence, to the court before which the proceedings are being held.</Text></Subsection><Subsection the Tribunal or court may impose to ensure that it is preserved for any purpose for which it may subsequently be required, where the Tribunal or court is satisfied that sufficient evidence exists or may reasonably be obtained without detaining the animal or thing and that it is not, or is not suspected of being, affected or contaminated by a disease or toxic court, as the case may be, may, on its own motion or at the request of any party to the proceedings, in addition to any penalty or punishment imposed, order that any animal or thing by means of or in relation to which the violation or offence was committed, or any proceeds realized from its disposition, be forfeited to Her Majesty in right of Canada.</Text></Subsection><Subsection lims:id="253500">Treatment</MarginalNote><Label>(2)</Label><Text>The Minister may treat any animal or thing described in subsection (1), or require its owner or the person having the possession, care or control of it to treat it or to have it treated, where the Minister considers that the treatment will be effective in eliminating or preventing the spread of the disease or toxic hearings</MarginalNote><Label>58</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="253576" lims:id="253576"><Label>(1)</Label><Text>The Assessor may sit and hear appeals at any place or places and shall arrange for sittings and hearings as may be required.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="253577" lims:id="253577"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="253578" lims:id="253578">Travel allowances</MarginalNote><Label>(2)</Label><Text>The Assessor is entitled to be paid such travel allowances as are payable for the attendances of a judge of the Federal Court under the <XRefExternal reference-type="act" link="J-1">Judges Act</XRefExternal>.</Text></Subsection></Section><Section Governor in Council, the Assessor may make rules respecting the conduct of appeals and the procedure for the bringing of appeals.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="253582" lims:id="253582"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="253583" lims:id="253583">Transitional</MarginalNote><Label>(2)</Label><Text>Subject to any rules made under subsection (1), all rules respecting the conduct of appeals and the procedure for bringing appeals to the Assessor made under section 18 of the <XRefExternal reference-type="act" link="P-10">Pesticide Residue Compensation Act</XRefExternal> that are in force at the time this section comes into force shall, to the extent that they are not inconsistent with sections 56 to 58, lims:id="253591"><Label>(1)</Label><Text>Her Majesty, and any person who has entered into an agreement with the Minister under section 34, may recover from any person referred to in subsection (2) any prescribed fees or charges and any costs incurred by Her Majesty or the other person, as the case may be, in relation to anything required or authorized under this Act or the regulations, including, without restricting the generality of the foregoing,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="253592" lims:id="253592"><Label>(a)</Label><Text>the inspection, treatment, segregation, quarantine, testing or analysis of a place, animal or thing, as the case may be, or the identification, storage, removal, disposal or return of an animal or thing, required or authorized under this Act or the regulations; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="253593" lims:id="253593"><Label>(b)</Label><Text>the forfeiture, disposal, seizure or detention of an animal or thing under this Act or the regulations.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="253594" lims:id="253594"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="253595" lims:id="253595">Persons liable</MarginalNote><Label>(2)</Label><Text>The fees, charges and costs are recoverable jointly and severally from the owner or occupier of the place or the owner of the animal or thing and from the person having the possession, care or control of it immediately before its inspection, treatment, segregation, detention, forfeiture, quarantine, testing, analysis, identification, storage, removal, return or disposal or, in the case of an animal or thing seized under this Act, immediately before its toxic substance to quarantine or requiring their destruction on importation into Canada and for requiring the disposal on importation into Canada of things that may transmit a disease or toxic substance;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253615" lims:id="253615"><Label>(c)</Label><Text>requiring proof of the fact that animals imported into or passing through Canada have not been brought from any place where there was, at the time of their embarkation, a disease or toxic substance;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253616" lims:id="253616"><Label>(d)</Label><Text>prohibiting or regulating the importation of garbage into Canada and regulating the handling and being, affected or contaminated by a disease or toxic substance,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-27" lims:fid="253620" lims:id="253620"><Label>(ii)</Label><Text>have been in contact with or in close proximity to animals or things that were, or are suspected of having been, affected or contaminated by a disease or toxic substance at the time of contact or close proximity, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-27" lims:fid="253621" lims:id="253621"><Label>(iii)</Label><Text>are, or are suspected of being, vectors, the causative agents of disease or toxic substances;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253622" lims:id="253622"><Label>(g)</Label><Text>for segregating and confining animals within certain limits, establishing areas of inspection or quarantine and establishing eradication areas where animals may be inspected, segregated and tested for any disease or toxic substance;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253623" lims:id="253623"><Label>(h)</Label><Text>prohibiting or regulating the movement in Canada of</Text><Subparagraph lims:inforce-start-date="2015-02-27" lims:fid="253624" lims:id="253624"><Label>(i)</Label><Text>animals, animal products, animal by-products, vectors, the causative agents of disease, animal food, hay, straw and fodder, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-27" lims:fid="253625" lims:id="253625"><Label>(ii)</Label><Text>things that are used in respect of animals and that may be affected or contaminated by a disease or toxic substance;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253626" lims:id="253626"><Label>(i)</Label><Text>for the humane treatment of animals and generally</Text><Subparagraph lims:inforce-start-date="2015-02-27" lims:fid="253627" lims:id="253627"><Label>(i)</Label><Text>governing the care, handling and disposition of animals,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-27" lims:fid="253628" lims:id="253628"><Label>(ii)</Label><Text>governing the manner in which animals are transported within, into or out of Canada, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-27" lims:fid="253629" lims:id="253629"><Label>(iii)</Label><Text>providing for the treatment or disposal of animals that are not cared for, handled or transported in a humane manner;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253630" lims:id="253630"><Label>(j)</Label><Text>for declaring as infected, and constituting as an infected place, any airport, market, pen, railway yard, stockyard, conveyance or wharf on or in which any animal, animal product, animal by-product, animal food, hay, straw or fodder, or any other thing used in respect of animals, is exposed for sale or is placed for the purpose of transit;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253631" lims:id="253631"><Label>(k)</Label><Text>prohibiting or regulating the movement of persons and conveyances within, into or out of infected places;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253632" lims:id="253632"><Label>(l)</Label><Text>for purifying any place or thing that is likely to contain a vector or be contaminated by any disease or toxic substance;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253633" lims:id="253633"><Label>(m)</Label><Text>for causing or requiring notice to be given of the appearance of any disease or toxic substance among animals;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253634" lims:id="253634"><Label>(n)</Label><Text>prohibiting or regulating the holding of markets, fairs, exhibitions or sales of animals;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253635" lims:id="253635"><Label>(o)</Label><Text>for exempting any disease or toxic substance from the operation of any of the provisions of this Act or any regulation, for the imposition of terms and conditions governing the exemption and for otherwise dealing with the disease or toxic substance;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253636" lims:id="253636"><Label>(o.1)</Label><Text>exempting, with or without conditions, any animal or thing, or a person or activity in respect of an animal or thing, from the application of this Act or the regulations or a provision of this Act or the regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253637" lims:id="253637"><Label>(p)</Label><Text>regulating the conduct and operation of zoos and game farms;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253638" lims:id="253638"><Label>(q)</Label><Text>prescribing sanitary and health measures for establishments in which animal semen and animal embryos are collected, stored, frozen or processed and generally regulating the manner in which they are collected, stored and distributed;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253639" lims:id="253639"><Label>(r)</Label><Text>prohibiting or regulating testing for diseases;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253640" lims:id="253640"><Label>(s)</Label><Text>prohibiting or regulating the importation, exportation, preparation, manufacturing, preserving, packaging, labelling, storing, testing, transportation, sale, conditions of sale, advertising for sale, use and disposal of veterinary biologics and regulating their purity, potency, efficacy and safety;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253641" lims:id="253641"><Label>(s.1)</Label><Text>respecting quality management programs, quality control programs, safety programs, preventive control plans or any other similar programs or plans to be implemented by persons who conduct any activity regulated under this Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253642" lims:id="253642"><Label>(t)</Label><Text>prohibiting or regulating the feeding to animals of any thing that could introduce or spread any disease or toxic substance to animals;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253643" lims:id="253643"><Label>(u)</Label><Text>regulating the construction, operation and maintenance of animal deadyards, rendering plants and animal food factories;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253644" lims:id="253644"><Label>(v)</Label><Text>regulating the importation, exportation, preparation, manufacturing, preserving, packaging, labelling, storing, distribution, sale, conditions of sale and advertising for sale of products of animal deadyards, rendering plants and animal food factories;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253645" lims:id="253645"><Label>(w)</Label><Text>governing the issue, renewal, amendment, suspension and revocation of licences, permits, approvals, certificates or other documents on such terms and conditions as may be required for the purposes of this Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253646" lims:id="253646"><Label>(w.1)</Label><Text>requiring persons to take or keep samples from any animal or thing and to provide the Minister or an inspector or officer with, or with access to, those samples, and respecting the manner in which those samples are to be taken or kept and the manner in which they are to be provided or access to them is to be provided;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253647" lims:id="253647"><Label>(x)</Label><Text>requiring animals and things to be marked or to have affixed to them tags, seals or other devices for the purposes of this Act, authorizing inspectors or officers to mark animals and things or to affix to them tags, seals or other devices for the purposes of this Act, and prohibiting the removal, breaking, tampering with or altering of those marks, tags, seals or other devices;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253648" lims:id="253648"><Label>(y)</Label><Text>establishing and governing a national identification system for animals that provides for standards and means of identification;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253649" lims:id="253649"><Label>(z)</Label><Text>requiring animals to be identified under the system established under paragraph (y) when the ownership or possession of them changes or when they are transported or otherwise dealt with;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253650" lims:id="253650"><Label>(z.1)</Label><Text>governing the manufacture, sale, distribution or use of any means of identification used in the system established under paragraph (y);</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253651" lims:id="253651"><Label>(z.2)</Label><Text>governing the collection of information and statistics, the publication of studies and the conduct of surveys on any matter related to this Act or the regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253652" lims:id="253652"><Label>(z.3)</Label><Text>requiring persons to prepare, keep or maintain documents and to provide the Minister or an inspector or officer with, or with access to, those documents, and lims:inforce-start-date="2015-02-27" lims:fid="253655" lims:id="253655"><Label>(iii)</Label><Text>the place where they are to be kept or maintained, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-27" lims:fid="253656" lims:id="253656"><Label>(iv)</Label><Text>the manner in which they are to be provided or access to them is to be provided;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253657" lims:id="253657"><Label>(z.31)</Label><Text>requiring persons to provide to the Minister or any other person authorized by the Minister, in the form and manner that the Minister or other person, as the case may be, directs, information in relation to animals or things to which this Act or the regulations apply, including information in respect of their movements, events in relation to them and places where they are or were located;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253658" lims:id="253658"><Label>(z.32)</Label><Text>governing the identification of places in respect of which information is to be provided under (1)(a) that regulate the importation of animals or things may regulate those animals or things after their importation.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:fid="253668" lims:id="253668"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="253669" lims:id="253669">Paragraph (1)(z.3)</MarginalNote><Label>(1.4)</Label><Text>Regulations made under paragraph (1)(z.3) may, among other things, require persons who conduct any activity regulated under this Act and who become aware that an animal by-product, an animal food, an animal product, a product of a rendering plant or a veterinary biologic presents a risk of harm to human or animal health or the environment or does not meet the requirements of the regulations to provide written notice to that effect to the Minister or an inspector or officer.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:fid="253670" lims:id="253670"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="253671" lims:id="253671">Regulations respecting birds</MarginalNote><Label>(2)</Label><Text>The Governor in Council may make regulations for the purposes of maintaining or improving the quality of bird stock and of controlling or eliminating diseases and toxic substances among birds, including regulations</Text><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253672" lims:id="253672"><Label>(a)</Label><Text>regulating the production, marketing and distribution of birds and hatching eggs;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253673" lims:id="253673"><Label>(b)</Label><Text>prohibiting or regulating the movement of birds and hatching eggs;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253674" lims:id="253674"><Label>(c)</Label><Text>requiring hatchery operators to register with the Minister annually the names and addresses of persons who act as agents in the marketing of birds produced at the operators’ hatcheries;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253675" lims:id="253675"><Label>(d)</Label><Text>prescribing the types, sizes, specifications and labelling of packages used by hatchery operators for the marketing of chicks; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="253676" lims:id="253676"><Label>(e)</Label><Text>governing sanitation in or about lims:id="253678">Interpretation</MarginalNote><Label>(3)</Label><Text>Subsection (2) shall not be construed so as to limit the application of subsection (1) in respect of Code</XRefExternal>,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="253730" lims:id="253730"><Label>(a)</Label><Text>an inspector or officer may lay an information and issue and serve a summons by completing a ticket in the prescribed form, affixing the inspector’s or officer’s signature thereto and delivering the ticket to the person alleged to have committed the offence specified therein at the time the offence is alleged to have been committed, or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="253731" lims:id="253731"><Label>(b)</Label><Text>the summons may be served on an accused by mailing the summons to the accused at the accused’s latest known address,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="253732" lims:id="253732"><Text>and any regulations made under this section shall establish a procedure for voluntarily entering a plea of guilty and paying a fine in respect of each offence to which the regulations relate and shall prescribe the amount of the fine to be paid in respect of each offence.</Text></ContinuedSectionSubsection></Section><Section of fines</MarginalNote><Label>70</Label><Text>Where a person is convicted of an offence under this Act and a fine that is imposed as punishment is not paid when required, the prosecutor may, by filing the conviction, enter as a judgment the amount of the fine and costs, if any, in the superior court of the province in which the trial was held, and the judgment is enforceable against the convicted person in the same manner as if it were a judgment obtained by Her Majesty in right of Canada against the person in that court in civil proceedings.</Text></Section><Section authorizes, assents to or acquiesces or participates in the commission of the offence is a party to the offence and is liable on conviction to the punishment provided for by this Act, even if the for a violation, or for an offence under this Act, a declaration, certificate, report or other document of the Minister or an analyst, inspector or officer, purporting to have been signed by the Minister or the analyst, inspector or officer, is admissible in evidence without proof of the signature or official character of the person appearing to have signed it and, in the absence of evidence to the contrary, is proof of the matters asserted in it.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="253752" lims:id="253752"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="253753" lims:id="253753">Copies of documents</MarginalNote><Label>(2)</Label><Text>In any proceedings for a violation, or for an offence under this Act, a copy of or an extract from any record or other document that is made by the Minister or an analyst, inspector or officer under this Act or the regulations and that appears to have been certified under the signature of the Minister or the analyst, inspector or officer as a true copy or extract is admissible in evidence without proof of the signature or official character of the person appearing to have signed it and, in the absence of evidence to the contrary, has the same probative force as the original would have if it were proved in the ordinary
