link="H-3.2">Department of Health Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2006-12-15" lims:fid="252896" lims:id="252896" level="1"><TitleText>Establishment of the Department</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="252897" lims:id="252897"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="252898" lims:id="252898">Department established</MarginalNote><Label>2</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="252899" lims:id="252899"><Label>(1)</Label><Text>There is hereby established a department of the Government of Canada, called the Department of Health, over which the Minister of Health, appointed by commission under the Great Seal, shall preside.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="252900" lims:id="252900"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="252901" lims:id="252901">Minister</MarginalNote><Label>(2)</Label><Text>The Minister holds office during pleasure and has the management and direction of the Department.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-12-15" lims:fid="252902" lims:id="252902" level="1"><TitleText>Deputy Head</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="252903" lims:id="252903"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="252904" lims:id="252904">Deputy head</MarginalNote><Label>3</Label><Text>The Governor in Council may appoint an officer, called the Deputy Minister of Health, to hold office during pleasure and to be the deputy head of the Department.</Text></Section><Heading lims:inforce-start-date="2006-12-15" lims:fid="252905" lims:id="252905" level="1"><TitleText>Powers, Duties and Functions of the Minister</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="252906" lims:id="252906"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="252907" lims:id="252907">Powers, duties and functions</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="252908" lims:id="252908"><Label>(1)</Label><Text>The powers, duties and functions of the Minister extend to and include all matters over which Parliament has jurisdiction relating to the promotion and preservation of the health of the people of Canada not by law assigned to any other department, board or agency of the Government of Canada.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="252909" lims:id="252909"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="252910" lims:id="252910">Particulars</MarginalNote><Label>(2)</Label><Text>Without restricting the generality of subsection (1), the Minister’s powers, duties and functions relating to health include the following matters:</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="252911" lims:id="252911"><Label>(a)</Label><Text>the administration of such Acts of Parliament and of orders or regulations of the Government of Canada as are not by law assigned to any other department of the Government of Canada or any minister of that Government relating in any way to the health of the people of Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="252912" lims:id="252912"><Label>(a.1)</Label><Text>the promotion and preservation of the physical, mental and social well-being of the people of Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="252913" lims:id="252913"><Label>(b)</Label><Text>the protection of the people of Canada against risks to health and the spreading of diseases;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="252914" lims:id="252914"><Label>(c)</Label><Text>investigation and research into public health, including the monitoring of diseases;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="252915" lims:id="252915"><Label>(d)</Label><Text>the establishment and control of safety standards and safety information requirements for consumer products and of safety information requirements for products intended for use in the workplace;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="252916" lims:id="252916"><Label>(e)</Label><Text>the protection of public health on railways, ships, aircraft and all other methods of transportation, and their ancillary services;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="252917" lims:id="252917"><Label>(f)</Label><Text>the promotion and preservation of the health of the public servants and other employees of the Government of Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="252918" lims:id="252918"><Label>(g)</Label><Text>the enforcement of any rules or regulations made by the International Joint Commission, promulgated pursuant to the treaty between the United States of America and His Majesty, King Edward VII, relating to boundary waters and questions arising between the United States and Canada, in so far as they relate to public health;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="252919" lims:id="252919"><Label>(h)</Label><Text>subject to the <XRefExternal reference-type="act" link="S-19">Statistics Act</XRefExternal>, the collection, analysis, interpretation, publication and distribution of information relating to public health; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="252920" lims:id="252920"><Label>(i)</Label><Text>cooperation with provincial authorities with a view to the coordination of efforts made or proposed for preserving and improving public health.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2006-12-15" lims:lastAmendedDate="2006-12-15" lims:fid="252921" lims:id="252921"><MarginalNote lims:inforce-start-date="2006-12-15" lims:fid="252922" lims:id="252922">Portfolio of the Minister — coordination and strategic priorities</MarginalNote><Label>4.1</Label><Text>The Minister shall coordinate the activities of, and establish strategic priorities for, any board or agency for which the Minister is responsible and may, subject to any terms and conditions that the Minister considers appropriate, delegate those powers, duties and functions to the Deputy Minister of lims:inforce-start-date="2006-12-15" lims:fid="252926" lims:id="252926">Services between the Department and boards or agencies</MarginalNote><Label>4.2</Label><Subsection lims:inforce-start-date="2006-12-15" lims:fid="252927" lims:id="252927"><Label>(1)</Label><Text>The Department may provide services to, and receive services from, any board or agency for which the Minister is responsible and any of those boards or agencies may also provide services to each other.</Text></Subsection><Subsection lims:inforce-start-date="2006-12-15" lims:fid="252928" lims:id="252928"><MarginalNote lims:inforce-start-date="2006-12-15" lims:fid="252929" lims:id="252929">Fees for services</MarginalNote><Label>(2)</Label><Text>The Minister may fix the fees to be paid for services provided by the Minister or the Department to any board or agency for which the Minister is responsible and any of those boards or agencies may fix the fees to be paid for services provided to the Minister, the Department or to each other, despite subsection 6(1).</Text></Subsection><Subsection lims:inforce-start-date="2006-12-15" lims:fid="252930" lims:id="252930"><MarginalNote lims:inforce-start-date="2006-12-15" lims:fid="252931" lims:id="252931">Amounts charged</MarginalNote><Label>(3)</Label><Text>The amounts to be recovered for services provided under subsection (1) and the manner of calculating the amounts are subject to the approval of the Treasury Board and the amount charged for a service may not exceed the cost of providing the service.</Text></Subsection><Subsection lims:inforce-start-date="2006-12-15" lims:fid="252932" lims:id="252932"><MarginalNote lims:inforce-start-date="2006-12-15" lims:fid="252933" lims:id="252933">Amounts received may be spent</MarginalNote><Label>(4)</Label><Text>Subject to any conditions imposed by the Treasury Board, any amounts received by the Department or a board or agency for services provided under subsection (1) may be expended, in the case of the Department, for any purpose of the Department, or, in the case of a board or agency, for any purpose of the board or agency.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-12-15" lims:fid="252935" lims:id="252935">2006, c. 5, s. 21</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="252936" lims:id="252936"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="252937" lims:id="252937">Inspectors and analysts</MarginalNote><Label>5</Label><Text>The Minister may designate any person to be an inspector or an analyst for the purposes of any Act for which the Minister has responsibility and sections 22 to 29 and 35 of the <XRefExternal reference-type="act" link="F-27">Food and Drugs Act</XRefExternal> apply, with such modifications as the circumstances require, to the persons designated pursuant to this section.</Text></Section><Heading lims:inforce-start-date="2006-12-15" lims:fid="252938" lims:id="252938" level="1"><TitleText>General Provisions</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="252939" lims:id="252939"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="252940" lims:id="252940">Fees for services or use of facilities</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="252941" lims:id="252941"><Label>(1)</Label><Text>The Minister may, subject to any regulations that the Treasury Board may make for the purposes of this section, fix the fees to be paid for a service or the use of a facility provided by the Minister, the Department or any board or agency of the Government of Canada for which the Minister has responsibility.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="252942" lims:id="252942"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="252943" lims:id="252943">Amount not to exceed cost</MarginalNote><Label>(2)</Label><Text>Fees for a service or the use of a facility that are fixed under subsection (1) may not exceed the cost to Her Majesty in right of Canada of providing the service or the use of the facility.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="252944" lims:id="252944"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="252945" lims:id="252945">Fees for products, rights and privileges</MarginalNote><Label>7</Label><Text>The Minister may, subject to any regulations that the Treasury Board may make for the purposes of this section, fix fees in respect of products, rights and privileges provided by the Minister, the Department or any board or agency of the Government of Canada for which the Minister has responsibility.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="252946" lims:id="252946"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="252947" lims:id="252947">Fees in respect of regulatory processes, etc.</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="252948" lims:id="252948"><Label>(1)</Label><Text>The Minister may, subject to any regulations that the Treasury Board may make for the purposes of this section, fix fees in respect of regulatory processes or approvals provided by the Minister, the Department or any board or agency of the Government of Canada for which the Minister has responsibility.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="252949" lims:id="252949"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="252950" lims:id="252950">Amount</MarginalNote><Label>(2)</Label><Text>Fees that are fixed under subsection (1) shall in the aggregate not exceed an amount sufficient to compensate Her Majesty in right of Canada for any reasonable outlays incurred by Her Majesty for the purpose of providing the regulatory processes or approvals.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="252951" lims:id="252951"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="252952" lims:id="252952">Consultation</MarginalNote><Label>9</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="252953" lims:id="252953"><Label>(1)</Label><Text>Before fixing a fee under section 6, 7 or 8, the Minister shall consult with such persons or organizations as the Minister considers to be interested in the matter.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="252954" lims:id="252954"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="252955" lims:id="252955">Publication</MarginalNote><Label>(2)</Label><Text>A fee that is fixed under section 6, 7 or 8 shall be published, within thirty days after it is fixed, in the <XRefExternal reference-type="other" link="gazette">Canada Gazette</XRefExternal> and by such appropriate electronic or other means that the Treasury Board may authorize by regulation.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="252956" lims:id="252956"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="252957" lims:id="252957">Reference to Scrutiny Committee</MarginalNote><Label>(3)</Label><Text>Any fee fixed under section 6, 7 or 8 shall stand referred to the Committee referred to in section 19 of the <XRefExternal reference-type="act" link="S-22">Statutory Instruments Act</XRefExternal> to be reviewed and scrutinized as if it were a statutory instrument.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="252958" lims:id="252958"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="252959" lims:id="252959">Power to make regulations</MarginalNote><Label>10</Label><Text>The Treasury Board may make regulations for the purposes of sections 6 to 9.</Text></Section><Heading lims:inforce-start-date="2006-12-15" lims:fid="252960" lims:id="252960" level="1"><TitleText>Regulations and Punishment</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="252961" lims:id="252961"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="252962" lims:id="252962">Regulations</MarginalNote><Label>11</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="252963" lims:id="252963"><Label>(1)</Label><Text>The Governor in Council may make regulations to give effect to and carry out the objects of this Act.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="252964" lims:id="252964"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="252965" lims:id="252965">Punishment</MarginalNote><Label>(2)</Label><Text>Every person who contravenes a regulation is guilty of an offence punishable on summary conviction.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-12-15" lims:fid="252966" lims:id="252966" level="1"><TitleText>Interim Orders</TitleText></Heading><Section lims:inforce-start-date="2004-10-13" lims:lastAmendedDate="2004-10-13" lims:fid="252967" lims:id="252967"><MarginalNote lims:inforce-start-date="2004-10-13" lims:fid="252968" lims:id="252968">Interim orders</MarginalNote><Label>11.1</Label><Subsection lims:inforce-start-date="2004-10-13" lims:fid="252969" lims:id="252969"><Label>(1)</Label><Text>The Minister may make an interim order that contains any provision that may be contained in a regulation made under section 11 if the Minister believes that immediate action is required to deal with a significant risk, direct or indirect, to health or safety.</Text></Subsection><Subsection lims:inforce-start-date="2004-10-13" lims:fid="252970" lims:id="252970"><MarginalNote lims:inforce-start-date="2004-10-13" lims:fid="252971" lims:id="252971">Cessation of effect</MarginalNote><Label>(2)</Label><Text>An interim order has effect from the time that it is made but ceases to have effect on the earliest of</Text><Paragraph lims:inforce-start-date="2004-10-13" lims:fid="252972" lims:id="252972"><Label>(a)</Label><Text>14 days after it is made, unless it is approved by the Governor in Council,</Text></Paragraph><Paragraph lims:inforce-start-date="2004-10-13" lims:fid="252973" lims:id="252973"><Label>(b)</Label><Text>the day on which it is repealed,</Text></Paragraph><Paragraph lims:inforce-start-date="2004-10-13" lims:fid="252974" lims:id="252974"><Label>(c)</Label><Text>the day on which a regulation made under section 11, that has the same effect as the interim order, comes into force, and</Text></Paragraph><Paragraph lims:inforce-start-date="2004-10-13" lims:fid="252975" lims:id="252975"><Label>(d)</Label><Text>one year after the interim order is made or any shorter period that may be specified in the interim order.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2004-10-13" lims:fid="252976" lims:id="252976"><MarginalNote lims:inforce-start-date="2004-10-13" lims:fid="252977" lims:id="252977">Contravention of unpublished order</MarginalNote><Label>(3)</Label><Text>No person shall be convicted of an offence consisting of a contravention of an interim order that, at the time of the alleged contravention, had not been published in the <XRefExternal reference-type="other" link="gazette">Canada Gazette</XRefExternal> unless it is proved that, at the time of the alleged contravention, the person had been notified of the interim order or reasonable steps had been taken to bring the purport of the interim order to the notice of those persons likely to be affected by it.</Text></Subsection><Subsection lims:inforce-start-date="2004-10-13" lims:fid="252978" lims:id="252978"><MarginalNote lims:inforce-start-date="2004-10-13" lims:fid="252979" lims:id="252979">Exemption from <XRefExternal reference-type="act" link="S-22">Statutory Instruments Act</XRefExternal></MarginalNote><Label>(4)</Label><Text>An interim order</Text><Paragraph lims:inforce-start-date="2004-10-13" lims:fid="252980" lims:id="252980"><Label>(a)</Label><Text>is exempt from the application of sections 3, 5 and 11 of the <XRefExternal reference-type="act" link="S-22">Statutory Instruments Act</XRefExternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2004-10-13" lims:fid="252981" lims:id="252981"><Label>(b)</Label><Text>shall be published in the <XRefExternal reference-type="other" link="gazette">Canada Gazette</XRefExternal> within 23 days after it is made.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2004-10-13" lims:fid="252982" lims:id="252982"><MarginalNote lims:inforce-start-date="2004-10-13" lims:fid="252983" lims:id="252983">Deeming</MarginalNote><Label>(5)</Label><Text>For the purpose of any provision of this Act other than this section, any reference to regulations made under this Act is deemed to include interim orders, and any reference to a regulation made under a specified provision of this Act is deemed to include a reference to the portion of an interim order containing any provision that may be contained in a regulation made under the specified provision.</Text></Subsection><Subsection lims:inforce-start-date="2004-10-13" lims:fid="252984" lims:id="252984"><MarginalNote lims:inforce-start-date="2004-10-13" lims:fid="252985" lims:id="252985">Tabling of order</MarginalNote><Label>(6)</Label><Text>A copy of each interim order must be tabled in each House of Parliament within 15 days after it is made.</Text></Subsection><Subsection lims:inforce-start-date="2004-10-13" lims:fid="252986" lims:id="252986"><MarginalNote lims:inforce-start-date="2004-10-13" lims:fid="252987" lims:id="252987">House not sitting</MarginalNote><Label>(7)</Label><Text>In order to comply with subsection (6), the interim order may be sent to the Clerk of the House if the House is not sitting.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2004-10-13" lims:fid="252989" lims:id="252989">2004, c. 15, s. 34</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-12-15" lims:fid="252990" lims:id="252990" level="1"><TitleText>Provincial Jurisdiction</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="252991" lims:id="252991"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="252992" lims:id="252992">Provincial or municipal boards not affected</MarginalNote><Label>12</Label><Text>Nothing in this Act or the regulations authorizes the Minister or any officer or employee of the Department to exercise any jurisdiction or control over any health authority operating under the laws of any province.</Text></Section><Heading lims:inforce-start-date="2006-12-15" lims:fid="252993" lims:id="252993" level="1"><TitleText>Transitional Provisions</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="252994" lims:id="252994"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="252995" lims:id="252995">Positions</MarginalNote><Label>13</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="252996" lims:id="252996"><Label>(1)</Label><Text>Nothing in this Act shall be construed as affecting the status of an employee who, immediately before the coming into force of this subsection, occupied</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="252997" lims:id="252997"><Label>(a)</Label><Text>a position in the public service of Canada in the Department of Health extend by virtue of this Act, that power, duty or function is vested in or may be exercised or performed by the Minister of Health, the Deputy Minister of Health or the appropriate officer of the Department of Health, as the case may be, unless the Governor in Council by order designates another Minister, Deputy Minister or officer of the public service of Canada to exercise that power or
