lims:id="252451"><Text><DefinedTermEn>chemical name</DefinedTermEn> means a scientific designation of a material or substance that is made in accordance with the rules of nomenclature of either the Chemical Abstracts Service, a division of the American Chemical Society, or the International Union of Pure and Applied Chemistry, or a scientific designation of a material or substance that is subsection 15(1) of that Act; (<DefinedTermFr>étiquette</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-11" lims:fid="252459" lims:id="252459"><Text><DefinedTermEn>material safety data sheet</DefinedTermEn><Repealed>[Repealed, 2014, c. 20, s. 146]</Repealed></Text></Definition><Definition lims:inforce-start-date="2015-02-11" lims:fid="252460" lims:id="252460"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Health; (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition Act</XRefExternal></DefinedTermEn> means the provisions of Part II of that Act or the regulations made under that Part but does not include the provisions of any regulation made pursuant to paragraph 15(1)(j) of that Act.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-11" lims:fid="252472" lims:id="252472"><MarginalNote lims:inforce-start-date="2015-02-11" lims:fid="252473" lims:id="252473">Definition of <DefinitionRef>provisions of the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal></DefinitionRef></MarginalNote><Label>(3)</Label><Text>In this Act, <DefinedTermEn>provisions of the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal></DefinedTermEn> means the provisions of Part II of that Act or the regulations made under that Part but does not include the provisions of section 125.2 of that Act or any regulation made pursuant to section 157 of that Act for the purposes of section 125.2 of that Act.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-11" lims:fid="252474" lims:id="252474"><MarginalNote lims:inforce-start-date="2015-02-11" lims:fid="252475" lims:id="252475">Definition of <DefinitionRef>provisions of the Accord Act</DefinitionRef></MarginalNote><Label>(4)</Label><Text>In this Act, <DefinedTermEn>provisions of the Accord Act</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2025-06-02" lims:enacted-date="2024-10-03" lims:fid="252476" lims:id="1529214"><Label>(a)</Label><Text>the provisions of Part III.1 of the <XRefExternal reference-type="act" link="C-7.5">Canada–Newfoundland and Labrador Atlantic Accord Implementation and Offshore Renewable Energy Management Act</XRefExternal> or the regulations made under that Part, other than the provisions of section 205.023 of that Act or of any regulation made under section 205.124 of that Act for the purposes of section 205.023 of that Act; or</Text></Paragraph><Paragraph lims:inforce-start-date="2025-01-31" lims:enacted-date="2024-10-03" lims:fid="252477" lims:id="1508846"><Label>(b)</Label><Text>the provisions of Part III.1 of the <XRefExternal reference-type="act" link="C-7.8">Canada–Nova Scotia Offshore Petroleum Resources Accord Implementation and Offshore Renewable Energy Management Act</XRefExternal> or the regulations made under that Part, other than the provisions of section 210.023 of that Act or of any regulation made under section 210.126 of that Act for the purposes of section 210.023 of that lims:inforce-start-date="2015-02-11" lims:lastAmendedDate="2020-03-18" lims:fid="252481" lims:id="252481"><MarginalNote lims:inforce-start-date="2015-02-11" lims:fid="252482" lims:id="252482">Claim for exemption by supplier</MarginalNote><Label>11</Label><Subsection lims:inforce-start-date="2015-02-11" lims:fid="252483" lims:id="252483"><Label>(1)</Label><Text lims:inforce-start-date="2020-03-18" lims:enacted-date="2019-06-21" lims:fid="1159476" lims:id="1238737">Any supplier who is required, either directly or indirectly, because of the provisions of the <XRefExternal reference-type="act" link="H-3">Hazardous Products Act</XRefExternal>, to disclose any of the following information may, if the supplier considers it to be confidential business information, claim an exemption from the requirement to disclose that information by filing with the Minister a claim for exemption in accordance with this section:</Text><Paragraph lims:inforce-start-date="2015-02-11" lims:fid="252484" lims:id="252484"><Label>(a)</Label><Text>in the case of a material or substance that is a hazardous product,</Text><Subparagraph lims:inforce-start-date="2015-02-11" lims:fid="252485" lims:id="252485"><Label>(i)</Label><Text>the chemical name of the material or substance,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-11" lims:fid="252486" lims:id="252486"><Label>(ii)</Label><Text>the CAS registry number, or any other unique identifier, of the material or substance, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-11" lims:fid="252487" lims:id="252487"><Label>(iii)</Label><Text>the chemical name of any impurity, stabilizing solvent or stabilizing additive that is present in the material or substance, that is classified in a category or subcategory of a health hazard class under the <XRefExternal reference-type="act" link="H-3">Hazardous Products Act</XRefExternal> and that contributes to the classification of the material or substance in the health hazard class under that Act;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-02-11" lims:fid="252488" lims:id="252488"><Label>(b)</Label><Text>in the case of an ingredient that is in a mixture that is a hazardous product,</Text><Subparagraph lims:inforce-start-date="2015-02-11" lims:fid="252489" lims:id="252489"><Label>(i)</Label><Text>the chemical name of the ingredient,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-11" lims:fid="252490" lims:id="252490"><Label>(ii)</Label><Text>the CAS registry number, or any other unique identifier, of the ingredient, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-11" lims:fid="252491" lims:id="252491"><Label>(iii)</Label><Text>the concentration or concentration range of the ingredient; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-02-11" lims:fid="252492" lims:id="252492"><Label>(c)</Label><Text>in the case of a material, substance or mixture that is a hazardous product, the name of any toxicological study that identifies the material or substance or any ingredient in the mixture.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-02-11" lims:fid="252493" lims:id="252493"><MarginalNote lims:inforce-start-date="2015-02-11" lims:fid="252494" lims:id="252494">Claim for exemption by employer</MarginalNote><Label>(2)</Label><Text lims:inforce-start-date="2020-03-18" lims:enacted-date="2019-06-21" lims:fid="1159477" lims:id="1238738">Any employer who is required, either directly or indirectly, because of the provisions of the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal> or the provisions of the Accord Act, as the case may be, to disclose any of the following information may, if the employer considers it to be confidential business information, claim an exemption from the requirement to disclose it by filing with the Minister a claim for exemption in accordance with this section:</Text><Paragraph lims:inforce-start-date="2015-02-11" lims:fid="252495" lims:id="252495"><Label>(a)</Label><Text>in the case of a material or substance that is a hazardous product,</Text><Subparagraph lims:inforce-start-date="2015-02-11" lims:fid="252496" lims:id="252496"><Label>(i)</Label><Text>the chemical name of the material or substance,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-11" lims:fid="252497" lims:id="252497"><Label>(ii)</Label><Text>the CAS registry number, or any other unique identifier, of the material or substance, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-11" lims:fid="252498" lims:id="252498"><Label>(iii)</Label><Text>the chemical name of any impurity, stabilizing solvent or stabilizing additive that is present in the material or substance, that is classified in a category or subcategory of a health hazard class under the <XRefExternal reference-type="act" link="H-3">Hazardous Products Act</XRefExternal> and that contributes to the classification of the material or substance in the health hazard class under that Act;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-02-11" lims:fid="252499" lims:id="252499"><Label>(b)</Label><Text>in the case of an ingredient that is in a mixture that is a hazardous product,</Text><Subparagraph lims:inforce-start-date="2015-02-11" lims:fid="252500" lims:id="252500"><Label>(i)</Label><Text>the chemical name of the ingredient,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-11" lims:fid="252501" lims:id="252501"><Label>(ii)</Label><Text>the CAS registry number, or any other unique identifier, of the ingredient, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-11" lims:fid="252502" lims:id="252502"><Label>(iii)</Label><Text>the concentration or concentration range of the ingredient;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-02-11" lims:fid="252503" lims:id="252503"><Label>(c)</Label><Text>in the case of a material, substance or mixture that is a hazardous product, the name of any toxicological study that identifies the material or substance or any ingredient in the mixture;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-11" lims:fid="252504" lims:id="252504"><Label>(d)</Label><Text>the product identifier of a hazardous product, being its chemical name, common name, generic name, trade-name or brand name;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-11" lims:fid="252505" lims:id="252505"><Label>(e)</Label><Text>information about a hazardous product, other than the product identifier, that constitutes a means of identification; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-11" lims:fid="252506" lims:id="252506"><Label>(f)</Label><Text>information that could be used to identify a supplier of a hazardous product.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2020-03-18" lims:enacted-date="2019-06-21" lims:fid="252507" lims:id="1238739"><MarginalNote lims:inforce-start-date="2020-03-18" lims:enacted-date="2019-06-21" lims:fid="1238740" lims:id="1238740">Manner of filing claim and fee payable</MarginalNote><Label>(3)</Label><Text>A claim for exemption must be in the prescribed form, be filed in the prescribed manner and be accompanied by the prescribed fee or a fee calculated in the prescribed manner.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-11" lims:fid="252509" lims:id="252509"><MarginalNote lims:inforce-start-date="2015-02-11" lims:fid="252510" lims:id="252510">Contents of claim</MarginalNote><Label>(4)</Label><Text lims:inforce-start-date="2020-03-18" lims:enacted-date="2019-06-21" lims:fid="1159478" lims:id="1238741">A claim for exemption must be accompanied by the safety data sheet or label to which the claim relates and must contain</Text><Paragraph lims:inforce-start-date="2015-02-11" lims:fid="252511" lims:id="252511"><Label>(a)</Label><Text>the information in respect of which the exemption is claimed;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-11" lims:fid="252512" lims:id="252512"><Label>(b)</Label><Text>a declaration stating that the claimant believes that the information in respect of which the exemption is claimed is confidential business information that meets the criteria prescribed under paragraph 48(1)(a) and that information substantiating the claim — as specified in the regulations — is in the possession of, or is available to, the claimant and will be provided on request;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-11" lims:fid="252513" lims:id="252513"><Label>(c)</Label><Text>a summary of the information substantiating the claim; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-11" lims:fid="252514" lims:id="252514"><Label>(d)</Label><Text>any other prescribed information.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2020-03-18" lims:enacted-date="2019-06-21" lims:fid="252515" lims:id="1238742"><MarginalNote
