G-2, s. 7</HistoricalNoteSubItem><HistoricalNoteSubItem lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1172791" lims:id="1172791" lims:enactId="1152361">2019, c. 16, s. 86</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2019-06-21" lims:fid="247417" lims:id="247417"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="247418" lims:id="247418">Moneys bound by service of garnishee summons</MarginalNote><Label>8</Label><Text>For the purposes of garnishment proceedings permitted by this Division, service of a garnishee summons binds Her Majesty in respect of the following money to be paid by Her Majesty to the debtor named in the garnishee summons:</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="247419" lims:id="247419"><Label>(a)</Label><Text>in the case of a salary,</Text><Subparagraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="247420" lims:id="1172798"><Label>(i)</Label><Text>the salary to be paid, no later than the last day of the second pay period following the pay period in which Her Majesty is bound by the garnishee summons, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="247421" lims:id="247421"><Label>(ii)</Label><Text>where the garnishee summons has continuing effect under the law of the province, the salary to be paid on the last day of each subsequent pay period; or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="247422" lims:id="247422"><Label>(b)</Label><Text>in the case of remuneration described in paragraph 5(b),</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="247423" lims:id="247423"><Label>(i)</Label><Text>the remuneration payable, in respect of the department or Crown corporation named in the application referred to in section 6, on the fifteenth day following the day on which Her Majesty is bound by the garnishee summons, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="247424" lims:id="247424"><Label>(ii)</Label><Text>either</Text><Clause lims:inforce-start-date="2002-12-31" lims:fid="247425" lims:id="247425"><Label>(A)</Label><Text>any remuneration becoming payable in respect of that department or Crown corporation in the thirty days following the fifteenth day after the day on which Her Majesty is bound by the garnishee summons that is owing on that fifteenth day or that becomes owing in the fourteen days following that fifteenth day, or</Text></Clause><Clause lims:inforce-start-date="2002-12-31" lims:fid="247426" lims:id="247426"><Label>(B)</Label><Text>where the garnishee summons has continuing effect under the law of the province, any remuneration becoming payable in respect of that department or Crown corporation subsequent to the fifteenth day after the day on which Her Majesty is bound by the garnishee summons.</Text></Clause></Subparagraph></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="247428" lims:id="247428">R.S., 1985, c. benefit</DefinedTermEn> means a pension benefit minus the prescribed deductions; (<DefinedTermFr>prestation nette de pension</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="247589" lims:id="1172975"><Text><DefinedTermEn>pension benefit</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1172976" lims:id="1172976"><Label>(a)</Label><Text>any of the following benefits payable under an enactment that is listed in the schedule:</Text><Subparagraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1172977" lims:id="1172977"><Label>(i)</Label><Text>a pension,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1172978" lims:id="1172978"><Label>(ii)</Label><Text>an annual allowance,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1172979" lims:id="1172979"><Label>(iii)</Label><Text>an annuity,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1172980" lims:id="1172980"><Label>(iv)</Label><Text>a lump sum return of pension contributions, including interest, if any,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1172981" lims:fid="1172984" lims:id="1172984"><Label>(viii)</Label><Text>a transfer value, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1172985" lims:id="1172985"><Label>(ix)</Label><Text>a bridge benefit, and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1172986" lims:id="1172986"><Label>(b)</Label><Text>any benefit payable under the <XRefExternal reference-type="act" link="S-24">Supplementary Retirement Benefits Act</XRefExternal> or the <XRefExternal reference-type="act" link="P-33.6">Public Service Pension Adjustment Act</XRefExternal>, chapter P-33 of the Revised Statutes of Canada, 1970, in respect of a pension, annual allowance or annuity referred to in paragraph (a); (<DefinedTermFr>prestation de pension</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="247599" lims:id="247599"><Text><DefinedTermEn>prescribed</DefinedTermEn> means prescribed by regulation made under this Part; (<DefinedTermFr>prescrit</DefinedTermFr> ou Agreements Enforcement Assistance Act</XRefExternal>; (<DefinedTermFr>autorité provinciale</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="247600" lims:id="1172987"><Text><DefinedTermEn>recipient</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1172988" lims:id="1172988"><Label>(a)</Label><Text>in respect of a benefit referred to in any of subparagraphs (a)(i) to (vii) of the definition <DefinitionRef>pension benefit</DefinitionRef>, a child or other person to whom the benefit is immediately payable, but does not include a child or other person whose entitlement to the benefit is based on their status as a survivor of the person who was originally entitled to the benefit or would have been entitled to it had death not intervened, or</Text></Paragraph><Paragraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1172989" lims:id="1172989"><Label>(b)</Label><Text>in respect of a benefit referred to in subparagraph (a)(viii) or (ix) of the definition <DefinitionRef>pension benefit</DefinitionRef>, a person who is entitled to the benefit. (<DefinedTermFr>prestataire</DefinedTermFr>)</Text></Paragraph></Definition></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="247603" lims:id="247603"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="247604" lims:id="247604">Financial support order</MarginalNote><Label>(2)</Label><Text>For the purposes of this Part, the Minister shall disregard a component of a financial support order the dollar value of which cannot be readily ascertained from the financial support order itself or from the Minister’s records relating to the recipient’s pension benefit.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="247605" lims:id="247605"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="247606" lims:id="247606">Interpretation of the provincial law</MarginalNote><Label>(3)</Label><Text>With respect to the expression “the law of that province” in paragraphs 36(c) and (e), where the law of the province refers to the percentage or the maximum percentage of a pension that is to be or may be garnisheed, attached or diverted, the reference to “pension”, or equivalent expression, in the law of the province shall be construed, for the purpose of this Part, to mean “net pension benefit” as defined in this section.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="247607" lims:id="247607"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="247608" lims:id="247608">Interpretation of financial support orders</MarginalNote><Label>(4)</Label><Text>Where a financial support order is expressed in terms of a percentage of a recipient’s pension, the reference to “pension”, or equivalent expression, in the financial support order shall be construed, for the purpose of this Part, to mean “net pension benefit” as defined in this section.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem G-2, s. 32; R.S., 1985, c. 3 (2nd Supp.), s. 29; 1997, c. 1, s. 32; 2000, c. 12, s. 120</HistoricalNoteSubItem><HistoricalNoteSubItem lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1172990" lims:id="1172990" lims:enactId="1152455">2019, c. 16, s. 105</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2017-09-21" lims:fid="247611" lims:id="247611" level="2"><TitleText>Conditions for Diversion of Pension Benefits</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2020-12-23" lims:fid="247612" lims:id="247612"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="247613" lims:id="247613">Application for diversion</MarginalNote><Label>33</Label><Subsection lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="247614" lims:id="1172996"><Label>(1)</Label><Text>Subject to this Part and the regulations, a person named in a financial support order may make an application to the Minister for diversion of a pension benefit payable to a recipient if</Text><Paragraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1172997" lims:id="1172997"><Label>(a)</Label><Text>the order is valid and subsisting; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1172998" lims:id="1172998"><Label>(b)</Label><Text>the person against whom the order has been made is a recipient.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="247621" lims:id="1172999"><MarginalNote lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1173000" lims:id="1173000">Representation</MarginalNote><Label>(2)</Label><Text>The application may be made, in accordance with the regulations, on behalf of a person by any other person or by a provincial enforcement service.</Text></Subsection><Subsection lims:inforce-start-date="2020-12-23" lims:enacted-date="2019-06-21" lims:fid="1281136" lims:id="1281136"><MarginalNote lims:inforce-start-date="2020-12-23" lims:enacted-date="2019-06-21" lims:fid="1281137" lims:id="1281137">Contents of application</MarginalNote><Label>(2.1)</Label><Text>The application must contain the prescribed information and be accompanied by the prescribed documents.</Text></Subsection><Subsection lims:inforce-start-date="2020-12-23" lims:enacted-date="2019-06-21" lims:fid="1281138" lims:id="1281138"><MarginalNote lims:inforce-start-date="2020-12-23" lims:enacted-date="2019-06-21" lims:fid="1281139" lims:id="1281139">Arrears of maintenance, alimony or support</MarginalNote><Label>(2.2)</Label><Text>A provincial enforcement service may, in respect of an application referred to in subsection (1), submit a document to the Minister that sets out a recipient’s arrears of maintenance, alimony or support and any prescribed information.</Text></Subsection><Subsection lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="247623" lims:id="1173001"><MarginalNote lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1173002" lims:id="1173002">Diversion of pension benefits</MarginalNote><Label>(3)</Label><Text>The Minister shall, not later than the first day of the fourth month after the month in which the Minister receives the duly completed application, divert an amount or amounts computed in accordance with sections 36 to 40 and the regulations from any net pension benefit that is payable to the recipient named in the application, and any amount so diverted shall be paid, subject to subsection (4), to the applicant, to any other person designated for that purpose in the financial support order or to a provincial enforcement service if the law of the province permits payment to it.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="247625" lims:id="247625"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="247626" lims:id="247626">Where applicant under 18 years of age</MarginalNote><Label>(4)</Label><Text>Where, pursuant to this section, a diverted amount is to be paid to an applicant who is under eighteen years of age, payment thereof shall instead be made to the person having the custody and control of that applicant or, where there is no person having custody and control of that applicant, to such person as the Minister may direct.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="247628" lims:id="247628">R.S., 1985, c. link="P-36">Public Service Superannuation Act</XRefExternal> or is entitled to do so, and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="247647" lims:id="247647"><Label>(c)</Label><Text>has reached 50 years of age but has not yet reached 60 years of age, if the person has exercised an option under section 12 or 13 of the <XRefExternal reference-type="act" link="P-36">Public Service Superannuation Act</XRefExternal> or is entitled to do so, or has reached 55 years of age but has not yet reached 65 years of age, if the person has exercised an option under section 12.1 or 13.001 of that Act or is entitled to do so,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2013-01-01" lims:fid="247648" lims:id="247648"><Text>a person entitled to support under the financial support order may apply for an order under subsection (2) to any court in Canada that has jurisdiction to make a financial support order.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1173004" lims:id="1173004"><MarginalNote Forces</MarginalNote><Label>(1.1)</Label><Text>A person who is entitled to support under a valid and subsisting financial support order may apply for an order under subsection (2) to any court in Canada that has jurisdiction to make a financial support order if the person against whom the financial support order is made</Text><Paragraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1173006" lims:id="1173006"><Label>(a)</Label><Text>has ceased to be required to make contributions under section 5 of the <XRefExternal reference-type="act" link="C-17">Canadian Forces Superannuation Act</XRefExternal> or has ceased to be a participant under subsection 5(1) of the <XRefExternal reference-type="regulation" link="SOR-2007-32">Reserve Force Pension Plan Regulations</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1173007" lims:id="1173007"><Label>(b)</Label><Text>is not a recipient and is entitled to a deferred annuity under section 17 of the <XRefExternal reference-type="act" link="C-17">Canadian Forces Superannuation Act</XRefExternal> or subsection 44(1) of the <XRefExternal reference-type="regulation" link="SOR-2007-32">Reserve Force Pension Plan Regulations</XRefExternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1173008" lims:id="1173008"><Label>(c)</Label><Text>has reached 50 years of age but has not yet reached 60 years of age.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-01-01" lims:fid="247649" lims:id="247649"><MarginalNote lims:inforce-start-date="2013-01-01" lims:fid="247650" lims:id="247650">Order</MarginalNote><Label>(2)</Label><Text lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1159437" lims:id="1173009">A court to which an application is made under subsection (1) or (1.1) may make an order deeming the person against whom there is a valid and subsisting financial support order to have exercised an option under any of sections 12 to 13.001 of the <XRefExternal reference-type="act" link="P-36">Public Service Superannuation Act</XRefExternal>, section 18 of the <XRefExternal reference-type="act" link="C-17">Canadian Forces Superannuation Act</XRefExternal> or section 45 of the <XRefExternal reference-type="regulation" link="SOR-2007-32">Reserve Force Pension Plan Regulations</XRefExternal> in favour of an annual allowance payable as of the date of the making of the order under this subsection if the court is satisfied that</Text><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="247651" lims:id="247651"><Label>(a)</Label><Text>there is an extended pattern of non-payment of the financial support order; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="247652" lims:id="247652"><Label>(b)</Label><Text>the person making the application has taken reasonable steps to enforce the financial support order through other to be diverted from the recipient’s net pension benefit shall be governed by the following rules:</Text></ContinuedSectionSubsection><Paragraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="247673" lims:id="1173017"><Label>(c)</Label><Text>if the recipient is domiciled in Canada and habitually resident in a province in which there is in force a law of general application permitting garnishment, attachment or diversion of pensions for the enforcement of financial support orders, the amount to be diverted shall be determined in accordance with the law of that province in force at the time of the diversion payment,</Text></Paragraph><Paragraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="247674" lims:id="1173018"><Label>(d)</Label><Text>if the recipient is domiciled in Canada and habitually resident elsewhere than in a province described in paragraph (c), the amount to be diverted shall be the amount required to satisfy the financial support order, up to a maximum of 50% of the recipient’s net pension benefit,</Text></Paragraph><Paragraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="247675" lims:id="1173019"><Label>(e)</Label><Text>if the recipient is domiciled outside Canada and the applicant is habitually resident in a province described in paragraph (c), the amount to be diverted shall be determined in accordance with the law of that province in force at the time of the diversion payment,</Text></Paragraph><Paragraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="247676" lims:id="1173020"><Label>(f)</Label><Text>if the recipient is domiciled outside Canada and the applicant is habitually resident in a province other than one described in paragraph (c), the amount to be diverted shall be the amount required to satisfy the financial support order, up to a maximum of 50% of the recipient’s net pension benefit, or</Text></Paragraph><Paragraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="247677" lims:id="1173022"><Label>(g)</Label><Text>if the recipient and the applicant are domiciled outside Canada and are habitually resident outside Canada, the amount to be diverted shall be the amount required to satisfy the financial support order, G-2, s. 36; 1997, c. 1, s. 34</HistoricalNoteSubItem><HistoricalNoteSubItem lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1173024" lims:id="1173024" lims:enactId="1152484">2019, c. 16, s. 109(E)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2019-06-21" lims:fid="247680" lims:id="247680"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="247681" lims:id="247681">Lump sum financial support order vs. periodic pension benefit</MarginalNote><Label>37</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="247682" lims:id="247682"><Label>(1)</Label><Text>Where a financial support order provides only for a lump sum payment and the recipient’s pension benefit consists only of periodic payments, no diversion shall be made, except as provided in subsection (2).</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="247683" lims:id="247683"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="247684" lims:id="247684">Circumstances in which diversion shall be made</MarginalNote><Label>(2)</Label><Text>Where the Minister is of the opinion that it is impossible or impracticable for a financial support order described in subsection (1) to be varied to stipulate periodic payments and the Minister has so notified the applicant and the recipient, a diversion shall be made in the amount of fifty per cent of the recipient’s monthly net pension benefit, subject to subsection (3), until</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="247685" lims:id="247685"><Label>(a)</Label><Text>the financial support order has been satisfied in full by the diversion; or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="247686" lims:id="247686"><Label>(b)</Label><Text>the Minister is satisfied, on receipt of evidence submitted by the applicant or recipient, that the financial support order has been satisfied in full by other means or is no longer valid and subsisting.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="247687" lims:id="247687"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="247688" lims:id="247688">Filing of annual statement</MarginalNote><Label>(3)</Label><Text>Where a diversion described in subsection (2) is made, the applicant must file annually with the Minister, within the prescribed time, a written statement respecting the applicant’s continued entitlement to the diversion, containing the prescribed information, signed by the applicant and witnessed by a person of a prescribed category.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="247689" lims:id="247689"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="247690" lims:id="247690">Where subsection (3) not complied with</MarginalNote><Label>(4)</Label><Text>Where subsection (3) is not complied with, the diversion shall be terminated as of the first day of the month following the expiration of the time prescribed under subsection (3), without prejudice to the applicant’s right to re-apply under this Part.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="247692" lims:id="1173029" lims:enactId="1152488" type="original">R.S., 1985, c. G-2, s. 37</HistoricalNoteSubItem><HistoricalNoteSubItem lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1173030" lims:id="1173030" lims:enactId="1152488">2019, c. 16, s. 110(F)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="247693" lims:id="247693"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="247694" lims:id="247694">Financial support order providing for lump sum and periodic payments vs. periodic pension benefit</MarginalNote><Label>38</Label><Text>Where a financial support order provides for a lump sum payment and for periodic payments and the recipient’s pension benefit consists only of periodic payments, the two components of the financial support order shall be treated as follows:</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="247695" lims:id="247695"><Label>(a)</Label><Text>the periodic component of the financial support order shall be dealt with in accordance with the rules in paragraphs 36(c) to (g); and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="247696" lims:id="247696"><Label>(b)</Label><Text>where</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="247697" lims:id="247697"><Label>(i)</Label><Text>the amount diverted pursuant to paragraph (a) is less than fifty per cent of the recipient’s net pension benefit, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="247698" lims:id="247698"><Label>(ii)</Label><Text>the maximum that could be diverted pursuant to paragraph (a) as a result of the application of the rules in paragraphs 36(c) to (g) exceeds the amount actually diverted pursuant to paragraph (a),</Text></Subparagraph><ContinuedParagraph lims:inforce-start-date="2002-12-31" lims:fid="247699" lims:id="247699"><Text>then, in respect of the excess referred to in subparagraph (ii), section 37 applies, with such modifications as the circumstances require, to the lump sum component of the financial support order, but the application of that section may not raise the total diversion under this Part to more than fifty per cent of the recipient’s net pension benefit.</Text></ContinuedParagraph></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="247701" lims:id="247701">R.S., 1985, c. G-2, s. 38; 1997, c. 1, s. 35</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2020-12-23" lims:fid="247702" lims:id="247702"><MarginalNote lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="247703" lims:id="1173032">Periodic financial support order versus lump sum pension benefit</MarginalNote><Label>39</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="247704" lims:id="247704"><Label>(1)</Label><Text lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1159439" lims:id="1173033">If a financial support order provides only for periodic payments and the recipient’s pension benefit consists only of a lump sum, the Minister shall, immediately after receiving a duly completed application,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="247705" lims:id="247705"><Label>(a)</Label><Text>take all reasonable steps to cause payment to the recipient of any portion of the recipient’s pension benefit that could be subject to diversion as a result of the application of the rules in paragraphs 36(c) to (g) to be delayed, in accordance with this section; and</Text></Paragraph><Paragraph lims:inforce-start-date="2020-12-23" lims:enacted-date="2019-06-21" lims:fid="247706" lims:id="1281140"><Label>(b)</Label><Text>cause the applicant to be notified in accordance with the regulations that, unless the financial support order is varied in accordance with this section, it will be treated as a financial support order for a lump sum payment of an amount equal to one periodic payment under the original financial support order.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="247707" lims:id="247707"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="247708" lims:id="247708">Applicant must seek variation of financial support order</MarginalNote><Label>(2)</Label><Text>Where, within thirty days of receipt by the applicant of the notification referred to in paragraph (1)(b), the Minister is satisfied, on receipt of evidence submitted by the applicant, that the applicant has applied to court for variation of the financial support order to one providing in whole or in part for a lump sum payment, the Minister shall cause payment of the pension benefit to the recipient to be further delayed for a further period not exceeding ninety days.</Text></Subsection><Subsection lims:inforce-start-date="2020-12-23" lims:enacted-date="2019-06-21" lims:fid="247709" lims:id="1281141"><Label>(3)</Label><Text><Repealed>[Repealed, 2019, c. 16, s. 111]</Repealed></Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="247711" lims:id="247711"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="247712" lims:id="247712">Where condition not satisfied</MarginalNote><Label>(4)</Label><Text>Where the evidence referred to in subsection (2) is not received by the Minister within the period mentioned in that subsection, the Minister shall forthwith treat the application for diversion as an application based on a financial support order for the payment of a lump sum equal to the amount of one periodic payment under the original financial support order.</Text></Subsection><Subsection lims:inforce-start-date="2020-12-23" lims:enacted-date="2019-06-21" lims:fid="247713" lims:id="1281142"><MarginalNote lims:inforce-start-date="2020-12-23" lims:enacted-date="2019-06-21" lims:fid="1281143" lims:id="1281143">Applicant must submit varied financial support order to Minister</MarginalNote><Label>(5)</Label><Text>If, within 90 days after receiving the evidence referred to in subsection (2), the Minister receives a copy of a varied financial support order providing in whole or in part for a lump sum payment, the Minister shall proceed with the application for diversion in accordance with this Part.</Text></Subsection><Subsection lims:inforce-start-date="2020-12-23" lims:enacted-date="2019-06-21" lims:fid="247715" lims:id="1281144"><MarginalNote lims:inforce-start-date="2020-12-23" lims:enacted-date="2019-06-21" lims:fid="1281145" lims:id="1281145">If condition not satisfied</MarginalNote><Label>(6)</Label><Text>If a copy of the varied financial support order referred to in subsection (5) is not received by the Minister within the period mentioned in that subsection, the Minister shall treat the application for diversion as an application based on a financial support order for the payment of a lump sum equal to the amount of one periodic payment under the original financial support order.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="247718" lims:id="247718">R.S., 1985, c. lims:id="1281147"><Label>(a.2)</Label><Text>respecting the submission of the document referred to in subsection 33(2.2);</Text></Paragraph><Paragraph lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="247761" lims:id="1173058"><Label>(b)</Label><Text>respecting the amount or amounts to be diverted from a recipient’s net pension benefit, and respecting the procedure to be followed in any situation not dealt with in sections 36 to 40;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="247762" lims:id="247762"><Label>(b.1)</Label><Text>respecting the provision of information for the purposes of section 35.3;</Text></Paragraph><Paragraph lims:inforce-start-date="2020-12-23" lims:enacted-date="2019-06-21" lims:fid="1281148" lims:id="1281148"><Label>(b.2)</Label><Text>respecting methods of notification for the purpose of section 39 and providing for the day on which
