<XRefExternal reference-type="act" link="I-5">Indian Act</XRefExternal>,</Text></Paragraph><Paragraph lims:inforce-start-date="2022-06-23" lims:enacted-date="2022-06-23" lims:fid="233430" lims:id="1368003"><Label>(c)</Label><Text>the <DefinitionRef>Council</DefinitionRef>, as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="S-6.6">shíshálh Nation Self-Government Act</XRefExternal>, and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233431" lims:id="233431"><Label>(d)</Label><Text>a first nation named in Schedule II to the <XRefExternal reference-type="act" link="Y-2.6">Yukon First Nations Self-Government Act</XRefExternal>; (<DefinedTermFr>organisme</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="233432" lims:id="233432"><Text><DefinedTermEn>fishing or recreational harbour</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233433" lims:id="233433"><Label>(a)</Label><Text>any harbour, wharf, pier, breakwater, slipway, marina or part thereof, together with machinery, works, land and structures related or attached thereto, and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233434" lims:id="233434"><Label>(b)</Label><Text>any other facility, installation, works or part thereof located on or adjacent to water</Text></Paragraph><ContinuedDefinition lims:inforce-start-date="2002-12-31" lims:fid="233435" lims:id="233435"><Text>where accommodation or services are F-24, s. 3; 1998, c. 10, s. 181; 1999, c. 31, s. 125</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="233451" lims:id="233451" level="1"><TitleText>Powers of the Minister</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="233452" lims:id="233452"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="233453" lims:id="233453">Harbours under control of Minister</MarginalNote><Label>4</Label><Text>The use, management and maintenance of every scheduled harbour, the enforcement of regulations relating thereto and the collection of charges for the use of every scheduled harbour are under the control and administration of the Minister.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="233455" lims:id="233455">1977-78, c. 30, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="233456" lims:id="233456"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="233457" lims:id="233457">Minister may undertake projects</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="233458" lims:id="233458"><Label>(1)</Label><Text>The Minister may undertake projects for the acquisition, development, construction, improvement or repair of any scheduled harbour or any fishing or recreational harbour to which this Act applies.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="233459" lims:id="233459"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="233460" lims:id="233460">Agreements with provinces</MarginalNote><Label>(2)</Label><Text>The Minister may, subject to the regulations, enter into an agreement with any province to provide for</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233461" lims:id="233461"><Label>(a)</Label><Text>the undertaking jointly with the government of the province or any agency thereof of any project that the Minister is authorized to undertake under subsection (1); and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233462" lims:id="233462"><Label>(b)</Label><Text>the payment to the province of contributions or grants in respect of the cost or any part of the cost of any project that is undertaken by the government of the province or any agency thereof and that the Minister is authorized to undertake under subsection (1).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="233463" lims:id="233463"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="233464" lims:id="233464">Agreements with persons</MarginalNote><Label>(3)</Label><Text>The Minister may, subject to the regulations, enter into an agreement with any person to provide for</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233465" lims:id="233465"><Label>(a)</Label><Text>the undertaking jointly with that person of any project that the Minister is authorized to undertake under subsection (1); and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233466" lims:id="233466"><Label>(b)</Label><Text>the payment to that person of contributions or grants in respect of the cost or any part of the cost of any project that is undertaken by that person and that the Minister is authorized to undertake under subsection (1) and in respect of the cost of any planning studies and advisory services relating to any such project.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="233467" lims:id="233467"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="233468" lims:id="233468">Studies</MarginalNote><Label>(4)</Label><Text>For the purpose of assisting the formulation and assessment of projects undertaken under subsection (1), the Minister may, subject to the regulations, undertake economic or other studies alone or jointly with the government of any province or agency thereof or with any person or educational institution.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="233470" lims:id="233470">1977-78, c. 30, s. 5</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="233471" lims:id="233471"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="233472" lims:id="233472">Services of other departments</MarginalNote><Label>6</Label><Text>The Minister shall, in carrying out any project or study under this Act, make use, wherever possible, of the services and facilities of other departments, boards or agencies of the Government of Canada.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="233474" lims:id="233474">1977-78, c. 30, s. 6</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="233475" lims:id="233475"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="233476" lims:id="233476">Provisions to be included in agreements</MarginalNote><Label>7</Label><Text>Every agreement entered into pursuant to subsection 5(2) or (3) shall specify</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233477" lims:id="233477"><Label>(a)</Label><Text>the respective proportions of the cost of any project to which the agreement relates that shall be paid by the Minister and the province or person or the contributions or grants in respect of that project that shall be paid by the Minister, and the times at which those amounts to be paid by the Minister or the province or person shall be paid;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233478" lims:id="233478"><Label>(b)</Label><Text>the authority that shall be responsible for the undertaking, operation and maintenance of any project or any part thereof to which the agreement relates;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233479" lims:id="233479"><Label>(c)</Label><Text>the respective proportions of the revenues from any project to which the agreement relates that are to be paid to the Minister and the province or person; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233480" lims:id="233480"><Label>(d)</Label><Text>the terms and conditions respecting the operation and maintenance of any project to which the agreement relates and the charges, if any, to be charged to persons to whom any of the benefits of the project are made available.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="233482" lims:id="233482">1977-78, c. 30, s. 7</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="233483" lims:id="233483"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="233484" lims:id="233484">Leases, licences and agreements for use of scheduled harbours</MarginalNote><Label>8</Label><Text>The Minister may, subject to the regulations,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233485" lims:id="233485"><Label>(a)</Label><Text>lease any scheduled harbour or any part thereof to any person;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233486" lims:id="233486"><Label>(b)</Label><Text>grant a licence to any person for the use of any scheduled harbour or any part thereof; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233487" lims:id="233487"><Label>(c)</Label><Text>enter into an agreement with the government of any province or any agency thereof for the occupancy and use of any scheduled harbour or any part thereof.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="233489" lims:id="233489">1977-78, c. 30, s. 8</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="233490" lims:id="233490" level="1"><TitleText>Regulations</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="233491" lims:id="233491"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="233492" lims:id="233492">Regulations</MarginalNote><Label>9</Label><Text>The Governor in Council may make regulations</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233493" lims:id="233493"><Label>(a)</Label><Text>prescribing schedules naming and delimiting or describing the fishing or recreational harbours or portions thereof belonging to Her Majesty in right of Canada that are under the control and administration of the Minister for the purposes of this Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233494" lims:id="233494"><Label>(b)</Label><Text>for the maintenance of order and the safety of persons and property at any scheduled harbour;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233495" lims:id="233495"><Label>(c)</Label><Text>not inconsistent with any other Act of Parliament or regulations made thereunder, for the control of mooring, berthing, loading and discharging of vessels at any scheduled harbour;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233496" lims:id="233496"><Label>(d)</Label><Text>not inconsistent with any other Act of Parliament or regulations made thereunder, for the control of pollution at any scheduled harbour;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233497" lims:id="233497"><Label>(e)</Label><Text>prescribing standards for the accommodation and services provided or to be provided at any scheduled harbour;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233498" lims:id="233498"><Label>(f)</Label><Text>prescribing charges for the use of any scheduled harbour;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233499" lims:id="233499"><Label>(g)</Label><Text>prescribing the duties or functions of persons appointed or designated under this Act or any other Act of Parliament to supervise or manage any fishing or recreational harbour to which this Act applies;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233500" lims:id="233500"><Label>(h)</Label><Text>governing inquiries into accidents and incidents held under section 26;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233501" lims:id="233501"><Label>(i)</Label><Text>prescribing terms and conditions of agreements entered into pursuant to subsection 5(2) or (3);</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233502" lims:id="233502"><Label>(j)</Label><Text>prescribing the manner of undertaking economic or other studies pursuant to subsection 5(4);</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233503" lims:id="233503"><Label>(k)</Label><Text>prescribing terms and conditions of leases, licences and agreements entered into or granted pursuant to section 8;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233504" lims:id="233504"><Label>(l)</Label><Text>prescribing the form of the tickets that may be issued pursuant to paragraph 25(1)(a);</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233505" lims:id="233505"><Label>(m)</Label><Text>respecting the detention and safe-keeping of vessels and goods seized under this Act and the payment of any reasonable costs incidental thereto;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233506" lims:id="233506"><Label>(n)</Label><Text>prescribing the manner of disposing of anything forfeited under this Act; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233507" lims:id="233507"><Label>(o)</Label><Text>generally for carrying out the purposes and provisions of this Act.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="233509" lims:id="233509">1977-78, c. 30, s. 9; 1980-81-82-83, c. 47, s. 53(F); 1984, c. 40, s. 30</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="233510" lims:id="233510" level="1"><TitleText>Enforcement</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="233511" lims:id="233511"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="233512" lims:id="233512">Enforcement officers</MarginalNote><Label>10</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="233513" lims:id="233513"><Label>(1)</Label><Text>For the purposes of enforcing this Act and the regulations, the Minister may designate as an enforcement officer any person who is, in the opinion of the Minister, qualified to be so designated and furnish that person with a certificate of his designation.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="233514" lims:id="233514"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="233515" lims:id="233515">Production of certificate of designation</MarginalNote><Label>(2)</Label><Text>In carrying out the duties and functions of an enforcement officer under this Act, an enforcement officer shall, if so requested, produce the certificate of designation of the enforcement officer as such to the person appearing to be in charge of any vessel, vehicle, premises or goods in respect of which the officer is acting.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="233517" lims:id="233517">1977-78, c. 30, s. 10</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="233518" lims:id="233518"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="233519" lims:id="233519">Powers of enforcement officers</MarginalNote><Label>11</Label><Text>Where an enforcement officer believes on reasonable grounds that a provision of this Act or the regulations is not being complied with, the officer may</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233520" lims:id="233520"><Label>(a)</Label><Text>with a warrant issued under section 11.1, board any vessel or enter any vehicle or premises where or in respect of which the officer believes on reasonable grounds there may be evidence of the non-compliance and make any inspection the officer deems necessary;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233521" lims:id="233521"><Label>(b)</Label><Text>require the person appearing to be in charge of the vessel, vehicle or premises to produce for inspection, or for the purpose of making copies or extracts therefrom, any log book, document or paper that may, in the officer’s opinion, provide evidence of that non-compliance;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233522" lims:id="233522"><Label>(c)</Label><Text>require any person found on board any vessel or in any vehicle or premises to give all reasonable assistance to enable the officer to carry out his duties and functions under this Act; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233523" lims:id="233523"><Label>(d)</Label><Text>prohibit the use of any scheduled harbour by any person, vessel or vehicle that the officer believes on reasonable grounds to be involved in that non-compliance and direct the removal of that person, vessel or vehicle from the harbour.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="233525" lims:id="233525">R.S., 1985, c. under this Act and any proceeds of a sale or other disposition thereof made under section 17 shall be returned to the person from whom the vessel or goods were seized or to any other person entitled of any vessel or goods seized under this Act to the person from whom the vessel or goods were seized or to any other person entitled to the possession thereof after security by bond, with two sureties, in such amount and form as is satisfactory to the Minister, is given to Her Majesty in right of Canada or after security of a cash deposit, in an amount satisfactory to the Minister, is given to Her Majesty in right of Canada.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="233607" lims:id="233607"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="233608" lims:id="233608">Order of sale refused</MarginalNote><Label>(3)</Label><Text>Where, on the hearing of an application made under subsection (1), the court is not satisfied that the vessel or goods seized should be sold, it may order that the vessel or goods be returned or, if a sale or other disposition of the goods has been made pursuant to section 17, it may order that any proceeds thereof be remitted to the person from whom the vessel or goods were seized or to any other person entitled to the possession thereof.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="233609" lims:id="233609"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="233610" lims:id="233610">Order of sale granted</MarginalNote><Label>(4)</Label><Text>Where, on the hearing of an application made under subsection (1), the court is satisfied that the vessel or goods seized should be sold, it may order the sale thereof and thereupon the Minister may sell the vessel or goods in such manner and for such price as the court determines is reasonable in the circumstances.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="233611" lims:id="233611"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="233612" lims:id="233612">Proceeds of sale</MarginalNote><Label>(5)</Label><Text>Where the total amount realized from a sale made under subsection (4) or any other disposition made under section 17, or both, exceeds the amount payable for rates and charges under this Act together with all costs and reasonable expenses incurred in connection with the sale or other disposition and any removal, seizure or detention under this Act, the Minister shall remit the excess amount to the person then appearing to be entitled thereto.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="233613" lims:fid="233646" lims:id="233646">Regulations relating to offences</MarginalNote><Label>25</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="233647" lims:id="233647"><Label>(1)</Label><Text>The Governor in Council may by regulation designate any offence under this Act or the regulations as an offence with respect to which</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233648" lims:id="233648"><Label>(a)</Label><Text>notwithstanding the provisions of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, any person designated as an enforcement officer pursuant to section 10 may lay an information and issue and serve a summons by completing a ticket in the form prescribed by regulation, affixing that person’s signature thereto and delivering the ticket to the person alleged to have committed the offence specified therein at the time the offence is alleged to have been committed; or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="233649" lims:id="233649"><Label>(b)</Label><Text>the summons may be served on an accused by mailing the summons to the accused at the latest known address of the accused.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="233650" lims:id="233650"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="233651" lims:id="233651">Voluntary payment of fine</MarginalNote><Label>(2)</Label><Text>A regulation made under this section shall establish a procedure for voluntarily entering a plea of guilty and paying a fine in respect of each offence to which the regulation relates and shall fix the amount of the fine that may be so paid in respect of each such offence.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="233652" lims:id="233652"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="233653" lims:id="233653">Fixing of fines</MarginalNote><Label>(3)</Label><Text>A fine fixed in respect of an offence by a regulation made under this section may be lower for a first offence than for any lims:inforce-start-date="2002-12-31" lims:fid="233658" lims:id="233658">Minister may direct inquiry</MarginalNote><Label>26</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="233659" lims:id="233659"><Label>(1)</Label><Text>The Minister may direct an inquiry to be made, subject to the <XRefExternal reference-type="act" link="C-23.4">Canadian Transportation Accident Investigation and Safety Board Act</XRefExternal>, whenever an accident or incident that results or is likely to result in death or injury to any person, damage to property or danger to the health or safety of the public has occurred at any scheduled harbour and authorize any qualified persons to conduct the inquiry.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="233660" lims:id="233660"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="233661" lims:id="233661">Powers of persons conducting inquiries</MarginalNote><Label>(2)</Label><Text>Every person authorized by the Minister to conduct an inquiry under subsection (1) shall have all the powers of a commissioner appointed under Part I of the <XRefExternal reference-type="act" link="I-11">Inquiries
