E-6, s. 4</HistoricalNoteSubItem><HistoricalNoteSubItem lims:inforce-start-date="2019-08-28" lims:enacted-date="2019-06-21" lims:fid="1198318" lims:id="1198318">2019, c. 28, s. 88</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="219384" lims:id="219384"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="219385" lims:id="219385">Charge on oil</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="219386" lims:id="219386"><Label>(1)</Label><Text>There shall be imposed, levied and collected on each cubic metre of oil exported in any month or part of a month a charge in such amount not exceeding three hundred and fifty dollars per cubic metre as may be prescribed in a tariff of charges for that month or part of a month made by order of the Governor in Council on the recommendation of the Minister and the Minister of Finance.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="219387" lims:id="219387"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="219388" lims:id="219388">Tariff of charges</MarginalNote><Label>(2)</Label><Text>A tariff of charges on oil may set out the charge applicable in respect of any or all of the various kinds or qualities of oil, oil from any source, any or all destinations for oil and such other factors or circumstances as are specified in the tariff.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="219389" lims:id="219389"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="219390" lims:id="219390">Tariff continues</MarginalNote><Label>(3)</Label><Text>Where a tariff of charges on oil is prescribed in respect of any month or part of a month under subsection (1), that tariff of charges shall continue in respect of each subsequent month until changed pursuant to subsection (1) by order of the Governor in Council in respect of a subsequent month or part of a month.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="219392" lims:id="219392">1974-75-76, c. 47, s. 7; 1980-81-82-83, c. 114, s. 5</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="219393" lims:id="219393"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="219394" lims:id="219394">By whom charge payable</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="219395" lims:id="219395"><Label>(1)</Label><Text>A charge imposed under this Part on the exportation of oil is payable to the Minister by the exporter under whose licence the oil is purported to be exported.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="219396" lims:id="219396"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="219397" lims:id="219397">Liability</MarginalNote><Label>(2)</Label><Text>A person who exports oil on which a charge is imposed under this Part in circumstances in which there is no exporter who is liable under this Part to pay that charge is liable to pay that charge.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="219399" lims:id="219399">1974-75-76, c. 47, s. 10</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2019-08-28" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-08-28" lims:fid="219400" lims:id="1198323"><MarginalNote lims:inforce-start-date="2019-08-28" lims:enacted-date="2019-06-21" lims:fid="1198324" lims:id="1198324">Chief Executive Officer of the Regulator</MarginalNote><Label>7</Label><Text>The Chief Executive Officer of the Regulator administers and enforces this Part on behalf of the Minister and collects the charges imposed under it and, on the request of the Minister, provides him or her with advice and information in respect of exemptions or reductions under subsection 8(1).</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2019-08-28" lims:enacted-date="2019-06-21" lims:fid="219403" lims:id="1198321">R.S., 1985, c. or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="219408" lims:id="219408"><Label>(b)</Label><Text>reduce any charge imposed in respect of any month or part of a month on the exportation of oil under this Part.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="219409" lims:id="219409"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="219410" lims:id="219410">Exemption and reduction to be reported in Public Accounts</MarginalNote><Label>(2)</Label><Text>A statement of each exemption or reduction of one thousand dollars or more ordered pursuant to this section shall be reported to the House of Commons in the Public Accounts.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="219412" lims:id="219412">1974-75-76, c. 47, s. 12; 1980-81-82-83, c. 114, s. 8</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2019-08-28" lims:fid="219413" lims:id="219413"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="219414" lims:id="219414">Monthly return of export sales</MarginalNote><Label>9</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="219415" lims:id="219415"><Label>(1)</Label><Text>Every person who is required by this Part to pay a charge shall make each month a true return of his exports of oil for the last preceding month in such form and containing such information as the regulations require.</Text></Subsection><Subsection lims:inforce-start-date="2019-08-28" lims:enacted-date="2019-06-21" lims:fid="219416" lims:id="1198348"><MarginalNote lims:inforce-start-date="2019-08-28" lims:enacted-date="2019-06-21" lims:fid="1198349" lims:id="1198349">Date of filing and payment</MarginalNote><Label>(2)</Label><Text>The return required by subsection (1) shall be filed with the Regulator and the charge payable shall be paid to it not later than the last day of the first month succeeding that in which the exports were made.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="219418" lims:id="219418"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="219419" lims:id="219419">Penalty on default</MarginalNote><Label>(3)</Label><Text>On default in payment of the charge or any portion thereof payable under this Part within the time prescribed by subsection (2), there shall be paid in addition to the amount of the default a penalty equal to the greater of</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="219420" lims:id="219420"><Label>(a)</Label><Text>one per cent of the amount of default, and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="219421" lims:id="219421"><Label>(b)</Label><Text>the percentage, if any, prescribed by regulations made under section 15, of the amount of default,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="219422" lims:id="219422"><Text>in respect of each month or part of a month during which the default continues.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="219423" lims:id="219423"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="219424" lims:id="219424">Extension of time</MarginalNote><Label>(4)</Label><Text lims:inforce-start-date="2019-08-28" lims:enacted-date="2019-06-21" lims:fid="1199485" lims:id="1199489">The Commission of the Regulator may, before or after the day prescribed by subsection (2), specify in writing a later day for the filing of a return or the payment of the charge or any portion thereof; and when the Commission of the Regulator has specified a later day</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="219425" lims:id="219425"><Label>(a)</Label><Text>no penalty shall accrue or shall be deemed to have accrued under subsection (3) prior to that later day in respect of default in payment of the charge or portion thereof for the payment of which the later day was specified; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="219426" lims:id="219426"><Label>(b)</Label><Text>failure to pay, on or before the later day, the charge or portion thereof for the payment of which a later day was specified constitutes a default for the purposes of subsection (3).</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2019-08-28" lims:enacted-date="2019-06-21" lims:fid="219428" lims:id="1198346">R.S., 1985, c. month or part of a month, in respect of which no charge has been imposed, levied and collected under Part I, a transportation fuel compensation recovery charge in such amount not exceeding three hundred and fifty dollars per cubic metre as may be prescribed in a tariff of charges for that month or part of a month made by order of the Governor in Council, on the recommendation of the Minister and the Minister of Finance.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="219500" lims:id="219500"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="219501" lims:id="219501">Tariff of charges</MarginalNote><Label>(2)</Label><Text>A tariff of charges on transportation fuel may set out the charge applicable in respect of any or all of the various kinds or qualities of transportation fuel, transportation fuel from any source, any or all destinations for transportation fuel and such other factors or circumstances as are specified in the such agreement is terminated by the declaration of the parties, or, in the opinion of the Governor in Council, is not effective or is not capable of being effective, the Governor in Council may, by regulation, establish maximum prices for the various qualities and kinds of crude oil to which this Part applies that are produced, extracted or recovered in that province.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="219567" lims:id="219567"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="219568" lims:id="219568">How prescribed price established</MarginalNote><Label>(2)</Label><Text>For the purposes of establishing maximum prices pursuant to subsection (1), the Governor in Council shall have regard to such matters as he deems requisite from time to time to achieve the purpose of this Part, including</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="219569" lims:id="219569"><Label>(a)</Label><Text>transportation and other costs applicable to the movement of crude oil;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="219570" lims:id="219570"><Label>(b)</Label><Text>the qualities and kinds of crude oil produced, extracted or recovered in the province of production;</Text></Paragraph><Paragraph and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="219572" lims:id="219572"><Label>(d)</Label><Text>the probable effect on the producers and consumers in Canada of extracted, recovered or manufactured in that province in a month are such that a significant quantity of that gas is normally available for use outside that province in each lims:fid="219646" lims:id="219646">Method of prescribing price</MarginalNote><Label>(2)</Label><Text>A regulation made by the Governor in Council that prescribes a price at which a kind of gas is to be sold on or for delivery may</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="219647" lims:id="219647"><Label>(a)</Label><Text>fix a price for that gas;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="219648" lims:id="219648"><Label>(b)</Label><Text>designate the prescribed price for that gas to be all the prices that are within a range of prices set out in the regulation;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="219649" lims:id="219649"><Label>(c)</Label><Text>designate the prescribed price for that gas to be all the prices that do not exceed a maximum price set out in the regulation;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="219650" lims:id="219650"><Label>(d)</Label><Text>designate the prescribed price for that gas to be a price that is determinable by reference to criteria or published information identified by the regulation; or</Text></Paragraph><Paragraph lims:inforce-start-date="2019-08-28" lims:enacted-date="2019-06-21" lims:fid="219651" lims:id="1198345"><Label>(e)</Label><Text>designate the prescribed price for that gas to be a price that is established or calculable under a contract for the sale of the gas referred to in the regulation and that is on file with the lims:id="219653">Effect of regulation prescribing price</MarginalNote><Label>(3)</Label><Text>A regulation referred to in subsection (2) may be conditional or unconditional, qualified or unqualified and may be general or restricted to a specific area, person, thing or kind or quantity of gas or to a group or class of persons, things, kinds or quantities.</Text></Subsection><Subsection 1980-81-82-83, c. 114, s. 31</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="219829" lims:id="219829"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="219830" lims:id="219830">Monthly return</MarginalNote><Label>59</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="219831" lims:id="219831"><Label>(1)</Label><Text>Every person required by this Part to pay a charge shall make each month a true return, in such form and containing such information as the regulations require, of his</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="219832" lims:id="219832"><Label>(a)</Label><Text>receipt of domestic petroleum for processing or consumption in Canada, or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="219833" lims:id="219833"><Label>(b)</Label><Text>importation of foreign petroleum and petroleum products,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="219834" lims:id="219834"><Text>or both, as the case may be, for the last preceding month.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="219835" lims:id="219835"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="219836" lims:id="219836">Date of filing and payment</MarginalNote><Label>(2)</Label><Text>The return required by this section shall be filed with the Minister and the charge payable shall be paid to him not later than the last day of the first month succeeding that in which</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="219837" lims:id="219837"><Label>(a)</Label><Text>the domestic petroleum was received for processing or consumption in Canada, or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="219838" lims:id="219838"><Label>(b)</Label><Text>the foreign petroleum or petroleum product was imported,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="219839" lims:id="219839"><Text>as the case may be.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="219840" lims:id="219840"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="219841" lims:id="219841">Penalty on default</MarginalNote><Label>(3)</Label><Text>On default in payment of the charge or any portion thereof payable under this Part within the time prescribed by subsection (2), there shall be paid in addition to the amount of the default a penalty equal to the greater of</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="219842" lims:id="219842"><Label>(a)</Label><Text>one per cent of the amount of default, and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="219843" lims:id="219843"><Label>(b)</Label><Text>the percentage, if any, prescribed by regulations made under section 64, of the amount of default,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="219844" lims:id="219844"><Text>in respect of each month or part of a month during which the default continues.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="219845" lims:id="219845"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="219846" lims:id="219846">Extension of time</MarginalNote><Label>(4)</Label><Text>The Minister may, before or after the day prescribed by subsection (2), specify in writing a later day for the filing of a return or the payment of the charge or any portion thereof and in that case,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="219847" lims:id="219847"><Label>(a)</Label><Text>no penalty shall accrue or shall be deemed to have accrued under subsection (3) prior to the later day in respect of default in payment of the charge or portion thereof for the payment of which the later day was specified; E-6, s. 60; 1994, c. 41, s. 21; 1999, c. 17, s. 137</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="219858" lims:id="219858"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="219859" lims:id="219859">Deductions and refunds</MarginalNote><Label>61</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="219860" lims:id="219860"><Label>(1)</Label><Text>A deduction from, or refund of, a charge or penalty imposed by this Part may be granted where an overpayment has been made or where the charge or penalty was paid in error.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="219861" lims:id="219861"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="219862" lims:id="219862">Payments</MarginalNote><Label>(2)</Label><Text>Where</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="219863" lims:id="219863"><Label>(a)</Label><Text>petroleum or a petroleum product in respect of which charges imposed by this Part have been paid, or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="219864" lims:id="219864"><Label>(b)</Label><Text>a petroleum product that is derived from petroleum in respect of which charges imposed by this Part have been paid,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="219865" lims:id="219865"><Text>is sent out of Canada by a person for use outside Canada, a payment may be made to that person in an amount not exceeding the charges paid.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="219866" lims:id="219866"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="219867" lims:id="219867">Application for deduction, etc.</MarginalNote><Label>(3)</Label><Text>No deduction from, refund of, or payment in respect of the charges imposed by this Part shall be granted or made unless application therefor is made in writing in accordance with regulations made under section 64 by the person entitled thereto within two years after the time when the deduction, refund or payment first became payable under this Part or any regulations made thereunder.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="219868" lims:id="219868"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="219869" lims:id="219869">Exemption or reduction</MarginalNote><Label>(4)</Label><Text>Where it is shown to the Governor in Council by the Minister that it is in the public interest to do so, the Governor in Council may, by order, conditionally or unconditionally, retroactively or prospectively, and either generally or in respect of a single transaction,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="219870" lims:id="219870"><Label>(a)</Label><Text>exempt any petroleum or petroleum product from the charge imposed thereon in respect of a month or part of a month under this Part; indebtedness issued pursuant to an investment referred to in paragraph (3)(b) shall be held in the name of the Minister to the credit of the account.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="220020" lims:id="220020"><Label>(d)</Label><Text>prescribing the method of determining the quantity of any quality or kind of petroleum in respect of with applications for compensation or required for the purposes of those applications and respecting the keeping of any of that information confidential;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="220022" lims:id="220022"><Label>(f)</Label><Text>prescribing the terms and conditions that shall be imposed or types of terms and conditions that may be lims:id="220023"><Label>(g)</Label><Text>prescribing the types and forms of undertakings required to be given by recipients of compensation;</Text></Paragraph><Paragraph accordance with the terms of the agreement, moneys to be used by the province to make payments in accordance with the terms of the agreement to persons in the province who are eligible to receive payments from the province in respect of qualities or kinds of petroleum, and in such case no compensation under this Division shall be paid to a person who is, under the agreement, eligible to and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="220039" lims:id="220039"><Label>(b)</Label><Text>the amounts payable pursuant to this Division as or on account of compensation or an agreement referred to in section 85.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="220040" lims:id="220040"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="220041" lims:id="220041">Idem</MarginalNote><Label>(2)</Label><Text>In addition to any amount appropriated by Parliament for any of the purposes mentioned in subsection (1), the Minister may spend, for the purposes mentioned in that subsection,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="220042" lims:id="220042"><Label>(a)</Label><Text>any amount received in respect of such portion of the oil export charge payable under Part I as may be designated by order of the Governor in Council to be for the purposes of paying compensation under this Part; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="220043" lims:id="220043"><Label>(b)</Label><Text>any amount received in respect of any charge payable under Part V.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="220044" lims:id="220044"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="220045" lims:id="220045">Appropriation</MarginalNote><Label>(3)</Label><Text>In addition to any amount appropriated by Parliament for the purposes mentioned in subsection (1), there is hereby appropriated for those purposes in respect of each fiscal year the sum of five hundred million dollars.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="220046" lims:id="220046"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="220047" lims:id="220047">Limit on expenditures</MarginalNote><Label>(4)</Label><Text>The aggregate of expenditures made in any fiscal year under this section shall not exceed the aggregate of</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="220048" lims:id="220048"><Label>(a)</Label><Text>amounts received in that fiscal year in respect of the portion of the oil export charge designated pursuant to paragraph (2)(a);</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="220049" lims:id="220049"><Label>(b)</Label><Text>amounts received in that fiscal year in respect of any charge payable under Part V;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="220050" lims:id="220050"><Label>(c)</Label><Text>the sum referred to in subsection (3); and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="220051" lims:id="220051"><Label>(d)</Label><Text>such additional amount, if any, as is appropriated by Parliament for any of the purposes mentioned in subsection (1) for that fiscal year.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="220052" lims:inforce-start-date="2002-12-31" lims:fid="220109" lims:id="220109">Returns of information</MarginalNote><Label>95</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="220110" lims:id="220110"><Label>(1)</Label><Text>For the purposes of this Act, the Minister may,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="220111" lims:id="220111"><Label>(a)</Label><Text>by notice in writing, require any person, and in the case of a corporation any officer thereof, to make to him, within a time stated in the notice, a written return, under oath if so required by the notice, showing in detail such information with respect to the affairs of the person named in the notice as is by the notice required and as is relevant for the purposes of this Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="220112" lims:id="220112"><Label>(b)</Label><Text>authorize any person designated to carry out investigations under this Act by the Minister to enter any premises in which that person has reason to believe that there may be evidence of a contravention of this Act, to examine anything on the premises and to examine and to copy or take away for further examination or copying any record, book, paper or other document found thereon that in his opinion may afford such evidence;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="220113" lims:id="220113"><Label>(c)</Label><Text>direct any person designated to carry out investigations under this Act by the Minister to inspect any record, book, paper or other document taken away for further examination under paragraph (b); and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="220114" lims:id="220114"><Label>(d)</Label><Text>have copies, pictures or other reproductions made of any record, book, paper or other document referred to in paragraph (c).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="220115" lims:id="220115"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="220116" lims:id="220116">Return of original or copy of documents</MarginalNote><Label>(2)</Label><Text>The original or a copy of any record, book, paper or other document taken away under paragraph (1)(b) shall be returned to the person from whose custody it was taken within twenty-one days after it was taken or within such longer period as is directed by a judge of a superior, county or district court for cause or agreed to by a person who is entitled to its return.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="220117" lims:id="220117"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="220118" lims:id="220118">Notice of application for extension of time</MarginalNote><Label>(3)</Label><Text>An application to a judge mentioned in subsection (2) for a direction under that subsection shall be made on notice to the person from whose custody the record, book, paper or other document was taken.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="220119" lims:id="220119"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="220120" lims:id="220120">Designation of persons</MarginalNote><Label>(4)</Label><Text>The Minister may designate any person to carry out investigations under this Act and shall furnish any person so designated with a certificate of his lims:inforce-start-date="2002-12-31" lims:fid="220124" lims:id="220124">Authority for entry on premises</MarginalNote><Label>96</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="220125" lims:id="220125"><Label>(1)</Label><Text>A person designated by the Minister to carry out investigations under this Act shall, before exercising the power conferred by paragraph 95(1)(b), produce to an occupant of the premises</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="220126" lims:id="220126"><Label>(a)</Label><Text>his certificate of designation; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="220127" lims:id="220127"><Label>(b)</Label><Text>a certificate from the Minister authorizing the exercise of that power.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="220128" lims:id="220128"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="220129" lims:id="220129">Duty of persons in control of premises</MarginalNote><Label>(2)</Label><Text>Every person who is in possession or control of any premises mentioned in paragraph 95(1)(b) shall, on compliance with subsection (1) by a person designated by the Minister to carry out investigations under this Act, permit the person so designated to enter the premises, to examine anything on the premises and to copy or take away any record, book, paper or other document found thereon.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="220130" lims:id="220130"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="220131" lims:id="220131">Application to court</MarginalNote><Label>(3)</Label><Text>Where a person acting under paragraph 95(1)(b) is refused admission or access to any premises or to anything thereon or where any such person has reasonable grounds to believe that admission or access will be refused, a judge of a superior, county or district court, on <Language xml:lang="la">ex parte</Language> application by that person, may by order direct a peace officer to take such steps as to the judge seem necessary to give that person such admission or access.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="220132" lims:id="220132"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="220133" lims:id="220133">Grounds on which judge may act</MarginalNote><Label>(4)</Label><Text>A judge mentioned in subsection (3) may act under that subsection where he is satisfied that there are reasonable grounds for entering the premises to which the application relates and that admission or access has been refused or that there are reasonable grounds for believing that admission lims:fid="220142" lims:id="220142"><Label>(1)</Label><Text>Subject to this section, all information with respect to a person or business obtained by any person in the course of the administration of this Act is privileged and no person shall knowingly, except as provided in this Act, communicate or allow to be communicated to any person not legally entitled thereto any such information or allow any person not legally entitled thereto to inspect or have access to any such information.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="220143" lims:id="220143"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="220144" lims:id="220144">Exception where request in writing</MarginalNote><Label>(2)</Label><Text>Any information with respect to a person or business obtained by any person in the course of the administration of this Act may, on request in writing to the Minister by or on behalf of the person to which it relates or by or on behalf of the person or group of persons carrying on the business to which it relates, be communicated to any person or authority named in the request on such terms and conditions and under such circumstances as are approved by the Minister.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="220145" lims:id="220145"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="220146" lims:id="220146">Evidence and production of documents</MarginalNote><Label>(3)</Label><Text>Notwithstanding any other Act or law, no person employed in the administration of this Act shall be required, in connection with any legal proceedings, to give evidence relating to any information that is privileged under subsection (1) or to produce any statement or other writing containing that information.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="220147" lims:id="220147"><MarginalNote           — R.S., 1985, c. 31 (2nd Supp.), s. 7</TitleText></Heading><Section><MarginalNote>Transitional: re Agreement</MarginalNote><Label>7</Label><Subsection><Label>(1)</Label><Text>For greater certainty, the Agreement dated as of November 1, 1985 entered into by the Minister of Energy, Mines and Resources on behalf of the Government of Canada to amend the November 25, 1981 Memorandum of Agreement between the Government of Canada and the Government of Alberta respecting Gas Pricing and Market Development Incentive Payments shall be deemed to be an agreement entered into by the Minister of Energy, Mines and Resources with the approval of the Governor in Council under the authority of section 39 of the <XRefExternal reference-type="act" link="E-6">Energy Administration Act</XRefExternal>.</Text></Subsection><Subsection><MarginalNote>Transitional: re regulations</MarginalNote><Label>(2)</Label><Text>A regulation of the Governor in Council made between November 1, 1985 and the coming into force of this section that specified or referred to an amount as being the prescribed price under section 40 or 42 of the <XRefExternal reference-type="act" link="E-6">Energy Administration Act</XRefExternal> at which gas referred to in the regulation is to be sold on or for delivery in any area or zone in Canada and outside its province of production or at any point of export from Canada shall be deemed to be a regulation validly made under that section that prescribes a price for that gas.</Text></Subsection><Subsection><MarginalNote>Transitional: re orders</MarginalNote><Label>(3)</Label><Text>A special or general order of the National Energy Board made between November 1, 1985 and the coming into force of this section that specified or referred to an amount as being an approved price for gas shall, for the purposes of subsection 43(1) of the <XRefExternal reference-type="act" link="E-6">Energy Administration Act</XRefExternal>, be deemed to be a validly made special or general order of the Board that approves a price for that gas.</Text></Subsection></Section></RelatedOrNotInForce></BillPiece></Schedule></Statute>
