lims:fid="215137" lims:id="215137">Purpose of Act</MarginalNote><Label>2</Label><Text>The purpose of this Act is to achieve equality in the workplace so that no person shall be denied employment opportunities or benefits for reasons unrelated to ability and, in the fulfilment of that goal, to correct the conditions of disadvantage in employment experienced by women, Aboriginal peoples, persons with disabilities and members of visible minorities by giving effect to the principle that employment equity means more than treating persons in the same way but also requires special measures lims:inforce-start-date="2017-12-12" lims:fid="215142" lims:id="215142">Definitions</MarginalNote><Label>3</Label><Text>In this Act,</Text><Definition lims:inforce-start-date="2017-12-12" lims:fid="215143" lims:id="215143"><Text><DefinedTermEn>Aboriginal peoples</DefinedTermEn> means persons who are Indians, Inuit or Métis; (<DefinedTermFr>autochtones</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-12-12" lims:fid="215144" lims:id="215144"><Text><DefinedTermEn>Canadian workforce</DefinedTermEn> means all persons in Canada of working age who are willing and able to work; (<DefinedTermFr>population apte au travail</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-12-12" lims:fid="215145" lims:id="215145"><Text><DefinedTermEn>Chairperson</DefinedTermEn> means the chairperson of the Canadian Human Rights Tribunal; (<DefinedTermFr>président</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-12-12" lims:fid="215146" lims:id="215146"><Text><DefinedTermEn>Commission</DefinedTermEn> means the Canadian Human Rights Commission established under section 26 of the <XRefExternal reference-type="act" link="H-6">Canadian Human Rights Act</XRefExternal>; (<DefinedTermFr>Commission</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-12-12" lims:fid="215147" lims:id="215147"><Text><DefinedTermEn>compliance officer</DefinedTermEn> means a person designated as an employment equity compliance review officer pursuant to subsection 22(3); (<DefinedTermFr>agent d’application</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-12-12" lims:fid="215148" lims:id="215148"><Text><DefinedTermEn>designated groups</DefinedTermEn> means women, Aboriginal peoples, persons with disabilities and members of visible minorities; (<DefinedTermFr>groupes désignés</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-12-12" lims:fid="215149" lims:id="215149"><Text><DefinedTermEn>members of visible minorities</DefinedTermEn> means persons, other than Aboriginal peoples, who are non-Caucasian in race or non-white in colour; (<DefinedTermFr>minorités visibles</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-12-12" lims:fid="215150" lims:id="215150"><Text><DefinedTermEn>Minister</DefinedTermEn> means such member of the Queen’s Privy Council for Canada as is designated by the Governor in Council as the Minister for the purposes of lims:id="215151"><Text><DefinedTermEn>Panel</DefinedTermEn><Repealed>[Repealed, 1998, c. 9, s. 37]</Repealed></Text></Definition><Definition lims:inforce-start-date="2017-12-12" lims:fid="215152" lims:id="215152"><Text><DefinedTermEn>persons with disabilities</DefinedTermEn> means persons who have a long-term or recurring physical, mental, sensory, psychiatric or learning impairment and who</Text><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="215153" lims:id="215153"><Label>(a)</Label><Text>consider themselves to be disadvantaged in employment by reason of that impairment, or</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="215154" lims:id="215154"><Label>(b)</Label><Text>believe that a employer or potential employer is likely to consider them to be disadvantaged in employment by reason of that impairment,</Text></Paragraph><ContinuedDefinition lims:inforce-start-date="2017-12-12" lims:fid="215155" lims:id="215155"><Text>and includes persons whose functional limitations owing to their impairment have been accommodated in their current job or workplace; (<DefinedTermFr>personnes lims:id="215156"><Text><DefinedTermEn>prescribed</DefinedTermEn> means prescribed by the regulations; (<DefinitionEnOnly>Version anglaise seulement</DefinitionEnOnly>)</Text></Definition><Definition lims:inforce-start-date="2017-12-12" lims:fid="215157" lims:id="215157"><Text><DefinedTermEn>private sector employer</DefinedTermEn> means any person who employs one hundred or more employees on or in connection with a federal work, undertaking or business as defined in section 2 of the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal> and includes any corporation established to perform any function or duty on behalf of the Government of Canada that employs one hundred or more employees, but does not include</Text><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="215158" lims:id="215158"><Label>(a)</Label><Text>a person who employs employees on or in connection with a work, undertaking or business of a local or private nature in Yukon, the Northwest Territories or Nunavut, or</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="215159" lims:id="215159"><Label>(b)</Label><Text>a departmental corporation as defined in section 2 of the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>; (<DefinedTermFr>employeur du secteur persons who have been designated by employees to act as their representatives, or</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="215162" lims:id="215162"><Label>(b)</Label><Text>bargaining agents, where bargaining agents represent the employees; (<DefinedTermFr>représentants</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2017-12-12" lims:fid="215163" lims:id="215163"><Text><DefinedTermEn>Tribunal</DefinedTermEn> means an Employment Equity Review Tribunal established by subsection lims:id="215167"><MarginalNote lims:inforce-start-date="2005-12-31" lims:fid="215168" lims:id="215168">Application</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2005-12-31" lims:fid="215169" lims:id="215169"><Label>(1)</Label><Text>This Act applies to</Text><Paragraph lims:inforce-start-date="2005-12-31" lims:fid="215170" lims:id="215170"><Label>(a)</Label><Text>private sector employers;</Text></Paragraph><Paragraph lims:inforce-start-date="2005-12-31" lims:fid="215171" lims:id="215171"><Label>(b)</Label><Text>the portions of the federal public administration set out in Schedule I or IV to the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2005-12-31" lims:fid="215172" lims:id="215172"><Label>(c)</Label><Text>the portions of the federal public administration set out in of Schedule V to the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal> that employ one hundred or more employees; and</Text></Paragraph><Paragraph lims:inforce-start-date="2005-12-31" lims:fid="215173" lims:id="215173"><Label>(d)</Label><Text>such other portion of the public sector employing one hundred or more employees, including the Canadian Forces and the Royal Canadian Mounted Police, as may be specified by order of the Governor in Council on the recommendation of the Treasury Board, in consultation with the minister responsible for the specified portion.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2005-12-31" lims:fid="215174" lims:id="215174"><MarginalNote lims:inforce-start-date="2005-12-31" lims:fid="215175" lims:id="215175">Royal Canadian Mounted Police</MarginalNote><Label>(2)</Label><Text>For the purposes of this Act,</Text><Paragraph lims:inforce-start-date="2005-12-31" lims:fid="215176" lims:id="215176"><Label>(a)</Label><Text>the Royal Canadian Mounted Police is deemed to consist only of its members within the meaning of subsection 2(1) of the <XRefExternal reference-type="act" link="R-10">Royal Canadian Mounted Police Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2005-12-31" lims:fid="215177" lims:id="215177"><Label>(b)</Label><Text>the Royal Canadian Mounted Police is deemed not to be included in Schedule IV to the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2005-12-31" lims:fid="215178" lims:id="215178"><Label>(c)</Label><Text>civilian employees appointed or employed in accordance with section 10 of the <XRefExternal reference-type="act" link="R-10">Royal Canadian Mounted Police Act</XRefExternal> are deemed to be included in Schedule IV to the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2005-12-31" lims:fid="215179" lims:id="215179"><MarginalNote lims:inforce-start-date="2005-12-31" lims:fid="215180" lims:id="215180">Canadian Forces and Royal Canadian Mounted Police</MarginalNote><Label>(3)</Label><Text>Members of the Canadian Forces and the Royal Canadian Mounted Police are deemed to be employees for the purposes of this Act.</Text></Subsection><Subsection lims:inforce-start-date="2005-12-31" lims:fid="215181" lims:id="215181"><MarginalNote lims:inforce-start-date="2005-12-31" lims:fid="215182" lims:id="215182">Responsibilities of Treasury Board and Public Service Commission</MarginalNote><Label>(4)</Label><Text>The Treasury Board and the Public Service Commission, each acting within the scope of its powers, duties and functions under the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal> and the <XRefExternal reference-type="act" link="P-33">Public Service Employment Act</XRefExternal>, are responsible for carrying out the obligations of an employer under this Act in relation to employees employed in those portions of the federal public administration referred to in paragraph (1)(b).</Text></Subsection><Subsection lims:inforce-start-date="2005-12-31" lims:fid="215183" lims:id="215183"><MarginalNote lims:inforce-start-date="2005-12-31" lims:fid="215184" lims:id="215184">Deemed employer</MarginalNote><Label>(5)</Label><Text>Every portion of the public sector referred to in paragraphs (1)(c) and (d) is deemed to be an employer for the purposes of this Act in relation to employees employed in that portion except that, with respect to any of those portions for which the Public Service Commission exercises any power or performs any function under the <XRefExternal reference-type="act" link="P-33">Public Service Employment Act</XRefExternal>, the Public Service Commission and that portion are responsible for carrying out the obligations of an employer under this Act.</Text></Subsection><Subsection lims:inforce-start-date="2005-12-31" lims:fid="215185" lims:id="215185"><MarginalNote lims:inforce-start-date="2005-12-31" lims:fid="215186" lims:id="215186">References to employer</MarginalNote><Label>(6)</Label><Text>In this Act, a reference to an employer is deemed, in relation to those portions of the public sector referred to in</Text><Paragraph lims:inforce-start-date="2005-12-31" lims:fid="215187" lims:id="215187"><Label>(a)</Label><Text>paragraph (1)(b), to be a reference to the Treasury Board and the Public Service Commission, each acting within the scope of its powers and functions under the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal> and the <XRefExternal reference-type="act" link="P-33">Public Service Employment Act</XRefExternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2005-12-31" lims:fid="215188" lims:id="215188"><Label>(b)</Label><Text>paragraphs (1)(c) and (d) for which the Public Service Commission exercises any power or performs any function under the <XRefExternal reference-type="act" link="P-33">Public Service Employment Act</XRefExternal>, to be a reference to the employer and the Public Service Commission.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2005-12-31" lims:fid="215189" lims:id="215189"><MarginalNote lims:inforce-start-date="2005-12-31" lims:fid="215190" lims:id="215190">Delegation by Treasury Board and Public Service Commission</MarginalNote><Label>(7)</Label><Text>The Treasury Board and the Public Service Commission may, for the purpose of carrying out their obligations under this Act in relation to a portion of the federal public administration or other portion of the public sector referred to in subsection (1), authorize the chief executive officer or deputy head concerned to exercise, in relation to that portion, any of the powers and perform any of the functions of the Treasury Board or the Public Service Commission, as the case may be, referred to in this section.</Text></Subsection><Subsection lims:inforce-start-date="2005-12-31" lims:fid="215191" lims:id="215191"><MarginalNote lims:inforce-start-date="2005-12-31" lims:fid="215192" lims:id="215192">Delegation by chief executive officer or deputy head</MarginalNote><Label>(8)</Label><Text>Any chief executive officer or deputy head authorized under subsection (7) to exercise any of the powers and perform any of the duties and functions of the Treasury Board or Public Service Commission may, subject to and in accordance with the authorization given to that officer or deputy head, authorize one or more persons to exercise any of those powers and perform any of those duties and Equity</TitleText></Heading><Heading lims:inforce-start-date="2002-12-31" lims:fid="215196" lims:id="215196" level="2"><TitleText>Employer Obligations</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="215197" lims:id="215197"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215198" lims:id="215198">Employer’s duty</MarginalNote><Label>5</Label><Text>Every employer shall implement employment equity by</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="215199" lims:id="215199"><Label>(a)</Label><Text>identifying and eliminating employment barriers against persons in designated groups that result from the employer’s employment systems, policies and practices that are not authorized by law; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="215200" lims:id="215200"><Label>(b)</Label><Text>instituting such positive policies and practices and making such reasonable accommodations as will ensure that persons in designated groups achieve a degree of representation in each occupational group in the employer’s workforce that reflects their representation in</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="215201" lims:id="215201"><Label>(i)</Label><Text>the Canadian workforce, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="215202" lims:id="215202"><Label>(ii)</Label><Text>those segments of the Canadian workforce that are identifiable by qualification, eligibility or geography and from which the employer may reasonably be expected to draw employees.</Text></Subparagraph></Paragraph></Section><Section lims:inforce-start-date="2005-12-31" lims:lastAmendedDate="2005-12-31" lims:fid="215203" lims:id="215203"><MarginalNote lims:inforce-start-date="2005-12-31" lims:fid="215204" lims:id="215204">Employer not required to take certain measures</MarginalNote><Label>6</Label><Text>The obligation to implement employment equity does not require an employer</Text><Paragraph lims:inforce-start-date="2005-12-31" lims:fid="215205" lims:id="215205"><Label>(a)</Label><Text>to take a particular measure to implement employment equity where the taking of that measure would cause undue hardship to the employer;</Text></Paragraph><Paragraph lims:inforce-start-date="2005-12-31" lims:fid="215206" lims:id="215206"><Label>(b)</Label><Text>to hire or promote persons who do not meet the essential qualifications for the work to be performed;</Text></Paragraph><Paragraph lims:inforce-start-date="2005-12-31" lims:fid="215207" lims:id="215207"><Label>(c)</Label><Text>with respect to the public sector, to hire or promote persons without basing the hiring or promotion on merit in cases where the <XRefExternal reference-type="act" link="P-33">Public Service Employment Act</XRefExternal> requires that hiring or promotion be based on merit; or</Text></Paragraph><Paragraph lims:inforce-start-date="2005-12-31" lims:fid="215208" lims:id="215208"><Label>(d)</Label><Text>to create new positions in its workforce.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2005-12-31" lims:fid="215210" lims:id="215210">1995, c. 44, s. 6; 2003, c. 22, s. 237</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2017-12-12" lims:lastAmendedDate="2017-12-12" lims:fid="215211" lims:id="215211"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="215212" lims:id="215212">Employment of Aboriginal peoples</MarginalNote><Label>7</Label><Text>Notwithstanding any other provision of this Act, where a private sector employer is engaged primarily in promoting or serving the interests of Aboriginal peoples, the employer may give preference in employment to Aboriginal peoples or employ only Aboriginal peoples, unless that preference or employment would constitute a discriminatory practice under the <XRefExternal reference-type="act" link="H-6">Canadian Human Rights Act</XRefExternal>.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2017-12-12" lims:fid="215214" lims:fid="215215" lims:id="215215"><MarginalNote lims:inforce-start-date="2005-04-01" lims:fid="215216" lims:id="215216">Certain rights not employment barriers</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2005-04-01" lims:fid="215217" lims:id="215217"><Label>(1)</Label><Text>Employee seniority rights with respect to a layoff or recall under a collective agreement or pursuant to the established practices of an employer are deemed not to be employment barriers within the meaning of this Act.</Text></Subsection><Subsection lims:inforce-start-date="2005-04-01" lims:fid="215218" lims:id="215218"><MarginalNote lims:inforce-start-date="2005-04-01" lims:fid="215219" lims:id="215219">Other seniority rights</MarginalNote><Label>(2)</Label><Text>Unless they are found to constitute a discriminatory practice under the <XRefExternal reference-type="act" link="H-6">Canadian Human Rights Act</XRefExternal>, employee seniority rights other than those referred to in subsection (1), including rights acquired under workforce adjustment policies implemented when an employer is downsizing or restructuring, under a collective agreement or pursuant to an established practice, are deemed not to be employment barriers within the meaning of this Act.</Text></Subsection><Subsection lims:inforce-start-date="2005-04-01" lims:fid="215220" lims:id="215220"><MarginalNote lims:inforce-start-date="2005-04-01" lims:fid="215221" lims:id="215221">Adverse impact on employment opportunities</MarginalNote><Label>(3)</Label><Text>Notwithstanding subsections (1) and (2), where, after a review under paragraph 9(1)(b), it appears that a right referred to in either of those subsections that is provided for under a collective agreement may have an adverse impact on the employment opportunities of persons in designated groups, the employer and its employees’ representatives shall consult with each other concerning measures that may be taken to minimize the adverse impact.</Text></Subsection><Subsection lims:inforce-start-date="2005-04-01" lims:fid="215222" lims:id="215222"><MarginalNote lims:inforce-start-date="2005-04-01" lims:fid="215223" lims:id="215223">Public sector</MarginalNote><Label>(4)</Label><Text>The following are not, in relation to the public sector, employment barriers within the meaning of the Act, namely,</Text><Paragraph lims:inforce-start-date="2005-04-01" lims:fid="215224" lims:id="215224"><Label>(a)</Label><Text>priorities for appointment under the <XRefExternal reference-type="act" link="P-33">Public Service Employment Act</XRefExternal> or regulations made by the Public Service Commission; and</Text></Paragraph><Paragraph lims:inforce-start-date="2005-04-01" lims:fid="215225" lims:id="215225"><Label>(b)</Label><Text>workforce adjustment measures established by the Treasury Board, including measures set out in agreements relating to workforce adjustment, or by the Public Service Commission or any other portion of the public sector referred to in paragraphs lims:id="215230"><Label>(1)</Label><Text>For the purpose of implementing employment equity, every employer shall</Text><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="215231" lims:id="215231"><Label>(a)</Label><Text>collect information and conduct an analysis of the employer’s workforce, in accordance with the regulations, in order to determine the degree of the underrepresentation of persons in designated groups in each occupational group in that workforce; and</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="215232" lims:id="215232"><Label>(b)</Label><Text>conduct a review of the employer’s employment systems, policies and practices, in accordance with the regulations, in order to identify employment barriers against persons in designated groups that result from those systems, policies and practices.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="215233" lims:id="215233"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="215234" lims:id="215234">Self-identification</MarginalNote><Label>(2)</Label><Text>Only those employees who identify themselves to an employer, or agree to be identified by an employer, as Aboriginal peoples, members of visible minorities or persons with disabilities are to be counted as members of those designated groups for the purposes of implementing employment equity.</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="215235" lims:id="215235"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="215236" lims:id="215236">Confidentiality of information</MarginalNote><Label>(3)</Label><Text>Information collected by an employer under paragraph (1)(a) is confidential and shall be used only for the purpose of implementing the employer’s obligations under this Act.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:id="215240">Employment equity plan</MarginalNote><Label>10</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="215241" lims:id="215241"><Label>(1)</Label><Text>The employer shall prepare an employment equity plan that</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="215242" lims:id="215242"><Label>(a)</Label><Text>specifies the positive policies and practices that are to be instituted by the employer in the short term for the hiring, training, promotion and retention of persons in designated groups and for the making of reasonable accommodations for those persons, to correct the underrepresentation of those persons identified by the analysis under paragraph 9(1)(a);</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="215243" lims:id="215243"><Label>(b)</Label><Text>specifies the measures to be taken by the employer in the short term for the elimination of any employment barriers identified by the review under paragraph 9(1)(b);</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="215244" lims:id="215244"><Label>(c)</Label><Text>establishes a timetable for the implementation of the matters referred to in paragraphs (a) and (b);</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="215245" lims:id="215245"><Label>(d)</Label><Text>where underrepresentation has been identified by the analysis, establishes short term numerical goals for the hiring and promotion of persons in designated groups in order to increase their representation in each occupational group in the workforce in which underrepresentation has been identified and sets out measures to be taken in each year to meet those goals;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="215246" lims:id="215246"><Label>(e)</Label><Text>sets out the employer’s longer term goals for increasing the representation of persons in designated groups in the employer’s workforce and the employer’s strategy for achieving those goals; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="215247" lims:id="215247"><Label>(f)</Label><Text>provides for any other matter that may be prescribed.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="215248" lims:id="215248"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215249" lims:id="215249">Establishment of numerical goals</MarginalNote><Label>(2)</Label><Text>In establishing the short term numerical goals referred to in paragraph (1)(d), every employer shall consider</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="215250" lims:id="215250"><Label>(a)</Label><Text>the degree of underrepresentation of persons in each designated group in each occupational group within the employer’s workforce;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="215251" lims:id="215251"><Label>(b)</Label><Text>the availability of qualified persons in designated groups within the employer’s workforce and in the Canadian workforce;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="215252" lims:id="215252"><Label>(c)</Label><Text>the anticipated growth or reduction of the employer’s workforce during the period in respect of which the numerical goals apply;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="215253" lims:id="215253"><Label>(d)</Label><Text>the anticipated turnover of employees within the employer’s workforce during the period in respect of which the numerical goals apply; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="215254" lims:id="215254"><Label>(e)</Label><Text>any other factor that may be prescribed.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="215255" lims:id="215255"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215256" lims:id="215256">Definitions</MarginalNote><Label>(3)</Label><Text>In this section, “short term” means a period of not less than one year and not more than three years, and “longer term” means a period of more than three years.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="215257" lims:id="215257"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215258" lims:id="215258">Reasonable progress</MarginalNote><Label>11</Label><Text>Every employer shall ensure that its employment equity plan would, if implemented, constitute reasonable progress toward implementing employment equity as required by this Act.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="215259" lims:id="215259"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215260" lims:id="215260">Implementation and monitoring of plan</MarginalNote><Label>12</Label><Text>Every employer shall</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="215261" lims:id="215261"><Label>(a)</Label><Text>make all reasonable efforts to implement its employment equity plan; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="215262" lims:id="215262"><Label>(b)</Label><Text>monitor implementation of its plan on a regular basis to assess whether reasonable progress toward implementing employment equity is being made.</Text></Paragraph></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="215263" lims:id="215263"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215264" lims:id="215264">Periodic review and revision of plan</MarginalNote><Label>13</Label><Text>Every employer shall, at least once during the period in respect of which the short term numerical goals referred to in paragraph 10(1)(d) are established, review its employment equity plan and revise it by</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="215265" lims:id="215265"><Label>(a)</Label><Text>updating the numerical goals, taking into account the factors referred to in subsection 10(2); and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="215266" lims:id="215266"><Label>(b)</Label><Text>making any other changes that are necessary as a result of an assessment made pursuant to paragraph 12(b) or as a result of changing circumstances.</Text></Paragraph></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="215267" lims:id="215267"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215268" lims:id="215268">Information about employment equity</MarginalNote><Label>14</Label><Text>Every employer shall provide information to its employees explaining the purpose of employment equity and shall keep its employees informed about measures the employer has undertaken or is planning to undertake to implement employment equity and the progress the employer has made in implementing employment equity.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="215269" lims:id="215269"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215270" lims:id="215270">Consultation with employee representatives</MarginalNote><Label>15</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="215271" lims:id="215271"><Label>(1)</Label><Text>Every employer shall consult with its employees’ representatives by inviting the representatives to provide their views concerning</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="215272" lims:id="215272"><Label>(a)</Label><Text>the assistance that the representatives could provide to the employer to facilitate the implementation of employment equity in its workplace and the communication to its employees of matters relating to employment equity; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="215273" lims:id="215273"><Label>(b)</Label><Text>the preparation, implementation and revision of the employer’s employment equity plan.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="215274" lims:id="215274"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215275" lims:id="215275">Where employees represented by bargaining agents</MarginalNote><Label>(2)</Label><Text>Where employees are represented by a bargaining agent, the bargaining agent shall participate in a consultation under subsection (1).</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="215276" lims:id="215276"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215277" lims:id="215277">Collaboration</MarginalNote><Label>(3)</Label><Text>Every employer and its employees’ representatives shall collaborate in the preparation, implementation and revision of the employer’s employment equity plan.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="215278" lims:id="215278"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215279" lims:id="215279">Rule of interpretation</MarginalNote><Label>(4)</Label><Text>Consultation under subsection (1) and collaboration under subsection (3) are not forms of co-management.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="215280" lims:id="215280"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215281" lims:id="215281">New employers</MarginalNote><Label>16</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="215282" lims:id="215282"><Label>(1)</Label><Text>A person who becomes an employer after the day on which this section comes into force shall, within eighteen months after becoming an employer, comply with sections 9 and 10.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="215283" lims:id="215283"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215284" lims:id="215284">Compliance audit</MarginalNote><Label>(2)</Label><Text>The Commission may not conduct a compliance audit of the discharge of the obligations of a person referred to in subsection (1) within two years after the day on which that person becomes an employer.</Text></Subsection></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="215285" lims:id="215285" level="2"><TitleText>Records and Reports</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="215286" lims:id="215286"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215287" lims:id="215287">Employment equity records</MarginalNote><Label>17</Label><Text>Every employer shall, in accordance with the regulations, establish and maintain employment equity records in respect of the employer’s workforce, the employer’s employment equity plan and the implementation of employment equity by the employer.</Text></Section><Section lims:inforce-start-date="2017-12-12" lims:lastAmendedDate="2021-01-01" lims:fid="215288" lims:id="215288"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="215289" lims:id="215289">Reports of private sector employers</MarginalNote><Label>18</Label><Subsection lims:inforce-start-date="2017-12-12" lims:fid="215290" lims:id="215290"><Label>(1)</Label><Text>Every private sector employer shall, on or before June 1 in each year, file with the Minister a report in respect of the immediately preceding calendar year containing information in accordance with prescribed instructions, indicating, in the prescribed manner and form,</Text><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="215291" lims:id="215291"><Label>(a)</Label><Text>the industrial sector in which its employees are employed, the location of the employer and its employees, the number of its employees and the number of those employees who are members of designated groups;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="215292" lims:id="215292"><Label>(b)</Label><Text>the occupational groups in which its employees are employed and the degree of representation of persons who are members of designated groups in each occupational group;</Text></Paragraph><Paragraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2019-06-21" lims:fid="215293" lims:id="1282652"><Label>(c)</Label><Text>the salary ranges of its employees and the degree of representation of persons who are members of designated groups in each range and in each prescribed subdivision of the range and any other information in relation to the salary of its employees that may be prescribed; and</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="215294" lims:id="215294"><Label>(d)</Label><Text>the number of its employees hired, promoted and terminated and the degree of representation in those numbers of persons who are members of designated groups.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="215295" lims:id="215295"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="215296" lims:id="215296">Interpretation</MarginalNote><Label>(2)</Label><Text>For the purposes of subsection (1), an employer is the person who or organization that was the employer on December 31 in the immediately preceding year.</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="215297" lims:id="215297"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="215298" lims:id="215298">Electronic filing</MarginalNote><Label>(3)</Label><Text>An employer may file a report using electronic media in a manner specified in writing by the Minister and, in such a case, the report is deemed to have been filed on the day that the Minister acknowledges receipt of it.</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="215299" lims:id="215299"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="215300" lims:id="215300">Self-identification</MarginalNote><Label>(4)</Label><Text>Only those employees who identify themselves to their employer, or agree to be identified by their employer, as  Aboriginal peoples, members of visible minorities and persons with disabilities are to be counted as members of those designated groups for the purposes of the report.</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="215301" lims:id="215301"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="215302" lims:id="215302">Certificate required</MarginalNote><Label>(5)</Label><Text>A report shall be certified, in the prescribed manner, as to the accuracy of the information contained in it and shall be signed by the employer or, where the employer is a corporation, by a prescribed person on behalf of the corporation.</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="215303" lims:id="215303"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="215304" lims:id="215304">Additional information</MarginalNote><Label>(6)</Label><Text>An employer shall include in a report a description of</Text><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="215305" lims:id="215305"><Label>(a)</Label><Text>the measures taken by the employer during the reporting period to implement employment equity and the results achieved; and</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="215306" lims:id="215306"><Label>(b)</Label><Text>the consultations between the employer and its employees’ representatives during the reporting period concerning the implementation of employment equity.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="215307" lims:id="215307"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="215308" lims:id="215308">Consolidated reports</MarginalNote><Label>(7)</Label><Text>Where, in the opinion of the Minister, associated or related federal works, undertakings or businesses are operated by two or more employers having common control or direction, the Minister may, on the application of the employers, authorize them to file a consolidated report with respect to employees employed by them on or in connection with those works, undertakings or businesses.</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="215309" lims:id="215309"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="215310" lims:id="215310">Exemption for private sector employers</MarginalNote><Label>(8)</Label><Text>The Minister may, on the application of an employer, exempt the employer from any or all of the requirements of this section for a period not exceeding one year if, in the opinion of the Minister, special circumstances warrant the exemption.</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="215311" lims:id="215311"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="215312" lims:id="215312">Copy to employees’ representatives</MarginalNote><Label>(9)</Label><Text>An employer shall, on filing a report with the Minister under this section, provide its employees’ representatives with a copy of the report.</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="215313" lims:id="215313"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="215314" lims:inforce-start-date="2002-12-31" lims:fid="215319" lims:id="215319"><Label>(1)</Label><Text>Subject to subsection (2), every report filed under subsection 18(1) shall be available for public inspection at such places as may be designated, and in such form as may be determined, by the Minister, and any person may, on payment of a prescribed fee, not to exceed the costs of furnishing a copy, obtain from the Minister a copy of any of the reports.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="215320" lims:id="215320"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215321" lims:id="215321">Withholding of report</MarginalNote><Label>(2)</Label><Text>The Minister may, on the application of an employer, withhold the employer’s report from public inspection for a period not exceeding one year if, in the opinion of the Minister, special circumstances warrant the withholding.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="215322" lims:id="215322"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215323" lims:id="215323">Consolidation to be tabled</MarginalNote><Label>20</Label><Text>The Minister shall in each year prepare a report consisting of a consolidation of the reports filed under subsection 18(1) together with an analysis of those reports and shall cause the report to be laid before each House of Parliament not later than the fifteenth sitting day that that House of Parliament is sitting after the report is completed.</Text></Section><Section lims:inforce-start-date="2005-04-01" lims:lastAmendedDate="2005-04-01" lims:fid="215324" lims:id="215324"><MarginalNote lims:inforce-start-date="2005-04-01" lims:fid="215325" lims:id="215325">Report of Treasury Board</MarginalNote><Label>21</Label><Subsection lims:inforce-start-date="2005-04-01" lims:fid="215326" lims:id="215326"><Label>(1)</Label><Text>The President of the Treasury Board shall, in each fiscal year, cause to be laid before each House of Parliament a report in respect of the state of employment equity in the portions of the federal public administration referred to in paragraph 4(1)(b) during the immediately preceding fiscal year.</Text></Subsection><Subsection lims:inforce-start-date="2005-04-01" lims:fid="215327" lims:id="215327"><MarginalNote lims:inforce-start-date="2005-04-01" lims:fid="215328" lims:id="215328">Contents of report</MarginalNote><Label>(2)</Label><Text>The report referred to in subsection (1) shall consist of</Text><Paragraph lims:inforce-start-date="2005-04-01" lims:fid="215329" lims:id="215329"><Label>(a)</Label><Text>a consolidation and analysis of</Text><Subparagraph lims:inforce-start-date="2005-04-01" lims:fid="215330" lims:id="215330"><Label>(i)</Label><Text>the number of employees employed in each portion of the federal public administration referred to in paragraph 4(1)(b) and the number of persons who are members of each designated group so employed,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2005-04-01" lims:fid="215331" lims:id="215331"><Label>(ii)</Label><Text>the total number of employees employed in all portions of the federal public administration referred to in paragraph 4(1)(b) in each province and in the National Capital Region and the number of persons who are members of each designated group so employed,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2005-04-01" lims:fid="215332" lims:id="215332"><Label>(iii)</Label><Text>the occupational groups of employees and the degree of representation of persons who are members of each designated group in each occupational group,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2005-04-01" lims:fid="215333" lims:id="215333"><Label>(iv)</Label><Text>the salary ranges of employees and the degree of representation of persons who are members of each designated group in each range and in any subdivision of the range, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2005-04-01" lims:fid="215334" lims:id="215334"><Label>(v)</Label><Text>the numbers of employees hired, promoted and terminated and the degree of representation, in those numbers, of persons who are members of each designated group;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2005-04-01" lims:fid="215335" lims:id="215335"><Label>(b)</Label><Text>a description of the principal measures taken by the Treasury Board during the reporting period to implement employment equity and the results achieved;</Text></Paragraph><Paragraph lims:inforce-start-date="2005-04-01" lims:fid="215336" lims:id="215336"><Label>(c)</Label><Text>a description of the consultations between the Treasury Board and its employees’ representatives during the reporting period concerning the implementation of employment equity; and</Text></Paragraph><Paragraph lims:inforce-start-date="2005-04-01" lims:fid="215337" lims:id="215337"><Label>(d)</Label><Text>any other information that the President of the Treasury Board considers relevant.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2005-04-01" lims:fid="215338" lims:id="215338"><MarginalNote lims:inforce-start-date="2005-04-01" lims:fid="215339" lims:id="215339">Requirement to provide information</MarginalNote><Label>(3)</Label><Text>Each portion of the public sector referred to in paragraphs 4(1)(c) and (d), other than the Canadian Security Intelligence Service, shall, within six months after the end of each fiscal year, provide to the President of the Treasury Board a report containing the information referred to in subsection (4) in relation to that portion during that fiscal year and the President shall cause the reports, together with the report referred to in subsection (1), to be laid before each House of Parliament.</Text></Subsection><Subsection lims:inforce-start-date="2005-04-01" lims:fid="215340" lims:id="215340"><MarginalNote lims:inforce-start-date="2005-04-01" lims:fid="215341" lims:id="215341">Contents of lims:id="215367"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215368" lims:id="215368">Compliance audits</MarginalNote><Label>22</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="215369" lims:id="215369"><Label>(1)</Label><Text>The Commission is responsible for the enforcement of the obligations imposed on employers by sections 5, 9 to 15 and 17.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="215370" lims:id="215370"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215371" lims:id="215371">Guiding policy</MarginalNote><Label>(2)</Label><Text>The Commission shall, in discharging its responsibility under subsection (1), be guided by the policy that, wherever possible, cases of non-compliance be resolved through persuasion and the negotiation of written undertakings pursuant to subsection 25(1) and that directions be issued under subsection 25(2) or (3) and applications for orders be made under subsection 27(2) only as a last resort.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="215372" lims:id="215372"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215373" lims:id="215373">Compliance officers designated</MarginalNote><Label>(3)</Label><Text>The Commission may designate any person or category of persons as employment equity compliance review officers for the purposes of conducting compliance audits of employers.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="215374" lims:id="215374"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215375" lims:id="215375">Where compliance officer may not act</MarginalNote><Label>(4)</Label><Text>No person who has been designated as an investigator under section 43 of the <XRefExternal reference-type="act" link="H-6">Canadian Human Rights Act</XRefExternal> to investigate a complaint under that Act in respect of an employer may, during the investigation, conduct a compliance audit of that employer.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="215376" lims:id="215376"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215377" lims:id="215377">Delegation by Commission</MarginalNote><Label>(5)</Label><Text>The Commission may authorize any officer or employee of the Commission whom the Commission considers appropriate to exercise any power and perform any duty or function of the Commission under this Act and any power so exercised and any duty or function so performed shall be deemed to have been exercised or performed by the Commission.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="215378" lims:id="215378"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215379" lims:id="215379">Powers of compliance officers</MarginalNote><Label>23</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="215380" lims:id="215380"><Label>(1)</Label><Text>For the purposes of ensuring compliance with the provisions referred to in subsection 22(1), a compliance officer may conduct a compliance audit of an employer and, for that purpose, may</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="215381" lims:id="215381"><Label>(a)</Label><Text>at any reasonable time, enter any place in which the officer believes on reasonable grounds there is any thing relevant to the enforcement of any of those provisions; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="215382" lims:id="215382"><Label>(b)</Label><Text>require any person to produce for examination or copying any record, book of account or other document that the officer believes on reasonable grounds contains information that is relevant to the enforcement of any of those provisions.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="215383" lims:id="215383"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215384" lims:id="215384">Data processing systems and copying equipment</MarginalNote><Label>(2)</Label><Text>In conducting a compliance audit, a compliance officer may</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="215385" lims:id="215385"><Label>(a)</Label><Text>reproduce or cause to be reproduced any record from a data processing system in the form of a print-out or other intelligible output and remove the print-out or other output for examination and copying; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="215386" lims:id="215386"><Label>(b)</Label><Text>use or cause to be used any copying equipment at the place to make copies of any record, book of account or other document.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="215387" lims:id="215387"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215388" lims:id="215388">Certificate to be produced</MarginalNote><Label>(3)</Label><Text>Compliance officers shall be furnished with certificates in a form established by the Commission certifying their designation as compliance officers and, on entering a place under paragraph (1)(a), a compliance officer shall show the certificate to the person in charge of the place if the person requests proof of the officer’s designation.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="215389" lims:id="215389"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215390" lims:id="215390">Assistance to compliance officers</MarginalNote><Label>(4)</Label><Text>The person in charge of a place entered pursuant to paragraph (1)(a) and every person found in the place shall</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="215391" lims:id="215391"><Label>(a)</Label><Text>give the compliance officer all reasonable assistance to enable the officer to exercise the powers conferred on compliance officers by this section; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="215392" lims:id="215392"><Label>(b)</Label><Text>provide the officer with any information relevant to the enforcement of this Act that the officer may reasonably require.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="215393" lims:id="215393"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215394" lims:id="215394">Security requirements</MarginalNote><Label>24</Label><Text>Every compliance officer or any other person acting on behalf of or under the direction of the Commission who receives or obtains information relating to a compliance audit under this Act shall, with respect to access to and use of that information by that compliance officer or person, satisfy any security requirements applicable to, and take any oath of secrecy required to be taken by, persons who normally have access to and use of that information.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="215395" lims:id="215395" level="2"><TitleText>Undertakings and Directions</TitleText></Heading><Section lims:inforce-start-date="2017-12-12" lims:lastAmendedDate="2017-12-12" lims:fid="215396" lims:id="215396"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="215397" lims:id="215397">Employer undertaking</MarginalNote><Label>25</Label><Subsection lims:inforce-start-date="2017-12-12" lims:fid="215398" lims:id="215398"><Label>(1)</Label><Text>Where a compliance officer is of the opinion that an employer</Text><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="215399" lims:id="215399"><Label>(a)</Label><Text>has not collected information or conducted an analysis referred to in paragraph 9(1)(a) or conducted a review referred to in paragraph 9(1)(b),</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="215400" lims:id="215400"><Label>(b)</Label><Text>has not prepared an employment equity plan referred to in section 10,</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="215401" lims:id="215401"><Label>(c)</Label><Text>has prepared an employment equity plan that does not meet the requirements of sections 10 and 11,</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="215402" lims:id="215402"><Label>(d)</Label><Text>has not made all reasonable efforts to implement its employment equity plan in accordance with section 12,</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="215403" lims:id="215403"><Label>(e)</Label><Text>has failed to review and revise its employment equity plan in accordance with section 13,</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="215404" lims:id="215404"><Label>(f)</Label><Text>has failed to provide information to its employees in accordance with section 14,</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="215405" lims:id="215405"><Label>(g)</Label><Text>has failed to consult with its employees’ representatives in accordance with section 15, or</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="215406" lims:id="215406"><Label>(h)</Label><Text>has failed to establish and maintain employment equity records as required by section 17,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2017-12-12" lims:fid="215407" lims:id="215407"><Text>the compliance officer shall inform the employer of the non-compliance and shall attempt to negotiate a written undertaking from the employer to take specified measures to remedy the non-compliance.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="215408" lims:id="215408"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="215409" lims:id="215409">Information re underrepresentation</MarginalNote><Label>(1.1)</Label><Text>Where</Text><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="215410" lims:id="215410"><Label>(a)</Label><Text>an employer has been informed of a non-compliance by a compliance officer under subsection (1) and the finding of non-compliance is based, in whole or in part, on the apparent underrepresentation of Aboriginal peoples, members of visible minorities or persons with disabilities in the employer’s work force, as reflected in the employer’s work force analysis conducted pursuant to paragraph 9(1)(a), and</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="215411" lims:id="215411"><Label>(b)</Label><Text>the employer believes that the apparent underrepresentation is attributable to the decision of employees who may be members of the designated groups concerned not to identify themselves as such or not to agree to be identified by the employer as such under subsection 9(2),</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2017-12-12" lims:fid="215412" lims:id="215412"><Text>the employer may inform the compliance officer of such belief.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="215413" lims:id="215413"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="215414" lims:id="215414">Reason for underrepresentation to be considered</MarginalNote><Label>(1.2)</Label><Text>Where the employer satisfies the compliance officer that the finding of non-compliance is attributable, in whole or in part, to the reason described in paragraph (1.1)(b) and that the employer has made all reasonable efforts to implement employment equity, the compliance officer shall take the reason into account in exercising any powers under this section.</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="215415" lims:id="215415"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="215416" lims:id="215416">No employer identification of individual employees</MarginalNote><Label>(1.3)</Label><Text>In satisfying the compliance officer under subsection (1.2) that the finding of non-compliance is attributable, in whole or in part, to the reason mentioned in paragraph (1.1)(b), the employer must do so by means other than the identification of individual employees in its work force that the employer believes are members of designated groups who have not identified themselves as such, or agreed to be identified by the employer as such, under subsection 9(2).</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="215417" lims:id="215417"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="215418" lims:id="215418">Direction</MarginalNote><Label>(2)</Label><Text>Where a compliance officer fails to obtain a written undertaking that, in the opinion of the compliance officer, would be sufficient to remedy the non-compliance, the compliance officer shall notify the Commission of the non-compliance and the Commission may issue and send, by registered mail, a direction to the employer</Text><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="215419" lims:id="215419"><Label>(a)</Label><Text>setting out the facts on which the officer’s finding of non-compliance is based; and</Text></Paragraph><Paragraph lims:inforce-start-date="2017-12-12" lims:fid="215420" lims:id="215420"><Label>(b)</Label><Text>requiring the employer to take such actions as are specified in the direction to remedy the non-compliance.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="215421" lims:id="215421"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="215422" lims:id="215422">Breach of undertaking</MarginalNote><Label>(3)</Label><Text>Where a compliance officer obtains a written undertaking and the compliance officer is of the opinion that the employer has breached the undertaking, the compliance officer shall notify the Commission of the non-compliance and the Commission may issue and send, by registered mail, a direction to the employer requiring the employer to take such actions as are specified in the direction to remedy the non-compliance.</Text></Subsection><Subsection lims:inforce-start-date="2017-12-12" lims:fid="215423" lims:id="215423"><MarginalNote lims:inforce-start-date="2017-12-12" lims:fid="215424" lims:id="215424">Amendment of direction</MarginalNote><Label>(4)</Label><Text>The Commission may rescind or amend a direction issued by the Commission pursuant to subsection (2) or (3) on the presentation of new facts or on being satisfied that the direction was issued without knowledge of, or was based on a mistake as to, a material fact.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem Canadian Human Rights Tribunal, but the Chairperson may appoint a Tribunal of three members if the Chairperson considers that the complexity or precedential significance of the request or application requirements</MarginalNote><Label>(10)</Label><Text>Every member or other person acting on behalf of or under the direction of a Tribunal who receives or obtains information relating to a request or application referred to in subsection (1) shall, with respect to access to and use of that information by that member or other person, satisfy any security requirements applicable to, and take any or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="215542" lims:id="215542"><Label>(c)</Label><Text>provides any information in the employment equity report that the employer knows to be false or misleading.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="215543" lims:id="215543"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215544" lims:id="215544">Continuing violations</MarginalNote><Label>(2)</Label><Text>A violation that is committed or continued on more than one day constitutes a separate violation for each day on which it is committed or continued.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="215545" lims:id="215545"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215546" lims:id="215546">Violations not offences</MarginalNote><Label>(3)</Label><Text>A violation is not an offence and accordingly the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> does not apply in respect of a violation.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="215547" lims:id="215547"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215548" lims:id="215548">Assessment of monetary penalty</MarginalNote><Label>36</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="215549" lims:id="215549"><Label>(1)</Label><Text>The Minister may, within two years after the day on which the Minister becomes aware of a violation, issue a notice of assessment of a monetary penalty in respect of the violation and send it by registered mail to the private sector employer.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="215550" lims:id="215550"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="215551" lims:id="215551">Limit</MarginalNote><Label>(2)</Label><Text>The amount of a monetary penalty shall not exceed</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="215552" lims:id="215552"><Label>(a)</Label><Text>$10,000 for a single violation; and</Text></Paragraph><Paragraph lims:inforce-start-date="2003-07-02" lims:fid="215579" lims:id="215579"><Label>(b)</Label><Text>in writing, advise the Minister who issued the notice of assessment of the time and place set out in the request.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2003-07-02" lims:fid="215580" lims:id="215580"><MarginalNote lims:inforce-start-date="2003-07-02" lims:fid="215581" lims:id="215581">Failure to appear before Tribunal</MarginalNote><Label>(2)</Label><Text>Where an employer to whom a request is sent fails to appear before a Tribunal at the time and place set out in the request, the Tribunal shall consider all the information that is presented to it by the Minister in relation to the alleged violation.</Text></Subsection><Subsection lims:inforce-start-date="2003-07-02" lims:fid="215582" lims:id="215582"><MarginalNote lims:inforce-start-date="2003-07-02" lims:fid="215583" lims:id="215583">Opportunity to make representations</MarginalNote><Label>(3)</Label><Text>In conducting its review, a Tribunal shall provide the Minister and the employer with a full opportunity consistent with procedural fairness and natural justice to present evidence and make representations to it with respect to the alleged violation.</Text></Subsection><Subsection lims:inforce-start-date="2003-07-02" lims:fid="215584" lims:id="215584"><MarginalNote lims:inforce-start-date="2003-07-02" lims:fid="215585" lims:id="215585">Determination of Tribunal</MarginalNote><Label>(4)</Label><Text>Where at the conclusion of its proceedings a Tribunal determines that the employer</Text><Paragraph lims:inforce-start-date="2003-07-02" lims:fid="215586" lims:id="215586"><Label>(a)</Label><Text>has not committed the alleged violation, the Tribunal shall immediately inform the employer and the Minister of its determination and no further proceedings shall be taken against the employer in respect of the alleged violation; or</Text></Paragraph><Paragraph lims:inforce-start-date="2003-07-02" lims:fid="215587" lims:id="215587"><Label>(b)</Label><Text>has committed the alleged violation, the Tribunal shall immediately</Text><Subparagraph lims:inforce-start-date="2003-07-02" lims:fid="215588" lims:id="215588"><Label>(i)</Label><Text>issue to the Minister a certificate, in the prescribed form, of its determination that sets out an amount, not exceeding the applicable amount set out in subsection 36(2), determined by the Tribunal to be payable by the employer in respect of the violation, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2003-07-02" lims:fid="215589" lims:id="215589"><Label>(ii)</Label><Text>send a copy of the certificate to the employer by registered mail.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2003-07-02" lims:fid="215590" lims:id="215590"><MarginalNote lims:inforce-start-date="2003-07-02" lims:fid="215591" lims:id="215591">Factors to be considered</MarginalNote><Label>(5)</Label><Text>In determining an amount under subparagraph (4)(b)(i), a Tribunal shall take into account the factors set out in subsection 36(3).</Text></Subsection><Subsection lims:inforce-start-date="2003-07-02" lims:fid="215592" lims:id="215592"><MarginalNote lims:inforce-start-date="2003-07-02" lims:fid="215593" lims:id="215593">Burden of proof</MarginalNote><Label>(6)</Label><Text>In proceedings under this section, the Minister has the burden of proving, on a balance of probabilities, that an employer has committed the alleged violation.</Text></Subsection><Subsection lims:inforce-start-date="2003-07-02" lims:fid="215594" lims:id="215594"><MarginalNote lims:inforce-start-date="2003-07-02" lims:fid="215595" lims:id="215595">Certificate</MarginalNote><Label>(7)</Label><Text>A certificate that purports to have been issued by a Tribunal under subparagraph (4)(b)(i) is evidence of the facts stated in the certificate, without proof of the signature or official character of the person appearing to have signed the certificate.</Text></Subsection><Subsection lims:inforce-start-date="2003-07-02" lims:fid="215596" lims:id="215596"><MarginalNote lims:inforce-start-date="2003-07-02" lims:fid="215597" lims:id="215597">Determinations are final</MarginalNote><Label>(8)</Label><Text>A determination of a Tribunal under this section is final and, except for judicial review under the <XRefExternal reference-type="act" link="F-7">Federal Courts Act</XRefExternal>, is not subject to appeal or review by any court.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2003-07-02" lims:fid="215599" lims:id="215599">1995, c. 44, s. 39; and</Text></Paragraph><Paragraph lims:inforce-start-date="2005-04-04" lims:fid="215615" lims:id="215615"><Label>(f)</Label><Text>generally, for carrying out the purposes and provisions of this Act.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2005-04-04" lims:fid="215616" lims:id="215616"><MarginalNote lims:inforce-start-date="2005-04-04" lims:fid="215617" lims:id="215617">Application</MarginalNote><Label>(2)</Label><Text>A regulation made pursuant to subsection (1) may be of general application or may apply to a particular employer or group of employers.</Text></Subsection><Subsection lims:inforce-start-date="2005-04-04" lims:fid="215618" lims:id="215618"><MarginalNote lims:inforce-start-date="2005-04-04" lims:fid="215619" lims:id="215619">Where regulations apply to public sector</MarginalNote><Label>(3)</Label><Text>No regulation may be made under subsection (1) that applies to the public sector without prior consultation with the Treasury Board.</Text></Subsection><Subsection lims:inforce-start-date="2005-04-04" lims:fid="215620" lims:id="215620"><MarginalNote lims:inforce-start-date="2005-04-04" lims:fid="215621" lims:id="215621">Inconsistent meanings</MarginalNote><Label>(4)</Label><Text>No expression defined pursuant to paragraph (1)(a) that applies to the public sector shall be given a meaning that is inconsistent with the meaning that that expression or any similar expression is given under the <XRefExternal reference-type="act" link="P-33">Public Service Employment Act</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2005-04-04" lims:fid="215622" lims:id="215622"><MarginalNote lims:inforce-start-date="2005-04-04" lims:fid="215623" lims:id="215623">Adaptation of Act to certain portions</MarginalNote><Label>(5)</Label><Text>The Governor in Council may, taking into account the operational effectiveness of the appropriate portion of the public sector referred to in paragraph (a) or (b), make any regulation that the Governor in Council considers necessary to adapt this Act or the regulations or any provision of this Act or the regulations to accommodate</Text><Paragraph lims:inforce-start-date="2005-04-04" lims:fid="215624" lims:id="215624"><Label>(a)</Label><Text>the Canadian Security Intelligence Service;           — 1998, c. 9, s. 33</TitleText></Heading><Section><MarginalNote>Definition of <DefinedTermEn>commencement day</DefinedTermEn></MarginalNote><Label>33</Label><Subsection><Label>(1)</Label><Text>In this section, <DefinedTermEn>commencement day</DefinedTermEn> means the day on which this section comes into force.</Text></Subsection><Subsection><MarginalNote>Members cease to hold office</MarginalNote><Label>(2)</Label><Text>Subject to subsections (3), (4) and (5), the members of the Human Rights Tribunal Panel cease to hold office on the commencement day.</Text></Subsection><Subsection><MarginalNote>Continuing jurisdiction of Human Rights Tribunal</MarginalNote><Label>(3)</Label><Text>The members of any Human Rights Tribunal appointed under the <XRefExternal reference-type="act" link="H-6">Canadian Human Rights Act</XRefExternal> before the commencement day have jurisdiction with respect to any inquiry into the complaint in respect of which the Human Rights Tribunal was appointed.</Text></Subsection><Subsection><MarginalNote>Continuing jurisdiction of Review Tribunal</MarginalNote><Label>(4)</Label><Text>The members of any Review Tribunal constituted under the <XRefExternal reference-type="act" link="H-6">Canadian Human Rights Act</XRefExternal> before the commencement day have jurisdiction with respect to any appeal against a decision or order of a Human Rights Tribunal.</Text></Subsection><Subsection><MarginalNote>Continuing jurisdiction of Employment Equity Review Tribunal</MarginalNote><Label>(5)</Label><Text>The members of any Employment Equity Review Tribunal established under section 28 or 39 of the <XRefExternal reference-type="act" link="E-5.401">Employment Equity Act</XRefExternal> before the commencement day have jurisdiction over any matter in respect of which the Tribunal was established.</Text></Subsection><Subsection><MarginalNote>Supervision by Chairperson of Canadian Human Rights Tribunal</MarginalNote><Label>(6)</Label><Text>The Chairperson of the Canadian Human Rights Tribunal has supervision over and direction of the work of any Human Rights Tribunal, Review Tribunal or Employment Equity Review Tribunal referred to in subsection (3), (4) or (5).</Text></Subsection><Subsection><MarginalNote>Remuneration</MarginalNote><Label>(7)</Label><Text>Each member of a Human Rights Tribunal, Review Tribunal or Employment Equity Review Tribunal referred to in subsection (3), (4) or (5), other than such a member who is appointed as a full-time member of the Canadian Human Rights Tribunal, shall be paid such remuneration as may be fixed by the Governor in Council.</Text></Subsection><Subsection><MarginalNote>Travel expenses</MarginalNote><Label>(8)</Label><Text>Each member of a Human Rights Tribunal, Review Tribunal or Employment Equity Review Tribunal referred to in subsection (3), (4) or (5) is entitled to be paid travel and living expenses incurred in carrying out duties as a member of that Tribunal while absent from their place of residence, but the expenses must not exceed the maximum limits authorized by Treasury Board directive for employees of the Government of Canada.</Text></Subsection></Section></RelatedOrNotInForce></BillPiece></Schedule><RecentAmendments><Amendment><Citation link="2019_29">2019, c. 29</Citation><Date>2021-01-01</Date></Amendment></RecentAmendments></Statute>
