generate-in-text="no"><Text><DefinedTermEn>Agreement</DefinedTermEn> has the same meaning as in the <XRefExternal reference-type="act" link="W-6.7">Western Arctic (Inuvialuit) Claims Settlement Act</XRefExternal>; (<DefinedTermFr>Convention</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="566735" lims:id="566735" generate-in-text="no"><Text><DefinedTermEn>angling</DefinedTermEn> means fishing by the use of a rod, line and hook, or a line and hook other than a set line; (<DefinedTermFr>pêche à la ligne</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="566736" lims:id="566736" generate-in-text="no"><Text><DefinedTermEn>angling licence</DefinedTermEn> means a licence issued under these Regulations for the purposes of angling; (<DefinedTermFr>permis de pêche à la ligne</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="566737" lims:id="566737" generate-in-text="no"><Text><DefinedTermEn>artificial fly</DefinedTermEn> means a single hook that</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566738" lims:id="566738"><Label>(a)</Label><Text>is dressed only with fur, feathers, textiles or tinsel wire or any combination thereof, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566739" lims:id="566739"><Label>(b)</Label><Text>does not have a spinning device or any external weight attached to it; (<DefinedTermFr>mouche artificielle</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="566740" lims:id="566740" generate-in-text="no"><Text><DefinedTermEn>assistant licence</DefinedTermEn> means a licence issued under these Regulations that authorizes a person to engage in commercial or domestic fishing as a helper while in the presence and under the supervision of a person who holds a commercial fishing licence or a domestic fishing licence; (<DefinedTermFr>permis d’aide</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="566741" lims:id="566741" generate-in-text="no"><Text><DefinedTermEn>barbless hook</DefinedTermEn> includes a hook all the barbs of which have been compressed to be in complete contact with the shaft of the hook; (<DefinedTermFr>hameçon sans ardillon</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="566742" lims:id="566742" generate-in-text="no"><Text><DefinedTermEn>beneficiary</DefinedTermEn> means a person who is enrolled as a beneficiary under the Agreement; (<DefinedTermFr>bénéficiaire</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="566743" lims:id="566743" generate-in-text="no"><Text><DefinedTermEn>Canadian resident</DefinedTermEn> means a person who ordinarily resides in Canada and who is not a Yukon resident; (<DefinedTermFr>résident canadien</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="566744" lims:id="566744" generate-in-text="no"><Text><DefinedTermEn>commercial fishing</DefinedTermEn> means fishing for or catching fish all or any portion of which is intended to be sold, traded or bartered, but does not include fishing by a beneficiary within the Inuvialuit Settlement Region for subsistence usage; (<DefinedTermFr>pêche commerciale</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="566745" lims:id="566745" generate-in-text="no"><Text><DefinedTermEn>commercial fishing licence</DefinedTermEn> means a licence issued under these Regulations for the purposes of commercial fishing; (<DefinedTermFr>permis de pêche commerciale</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="566746" lims:id="566746" generate-in-text="no"><Text><DefinedTermEn>Department</DefinedTermEn> means the Department of Fisheries and Oceans; (<DefinedTermFr>ministère</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="566747" lims:id="566747" generate-in-text="no"><Text><DefinedTermEn>derby</DefinedTermEn> means any sport fishing competition in which 25 or more persons participate; (<DefinedTermFr>concours</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="566748" lims:id="566748" generate-in-text="no"><Text><DefinedTermEn>dip net</DefinedTermEn> means a net that is hung on a ring or frame and that has a closed bottom; (<DefinedTermFr>épuisette</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="566749" lims:id="566749" generate-in-text="no"><Text><DefinedTermEn>domestic fishing</DefinedTermEn> means fishing for or catching fish that is to be used solely for personal consumption by the person fishing for or catching the fish or by that person’s family but does not include</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566750" lims:id="566750"><Label>(a)</Label><Text>sport fishing,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566751" lims:id="566751"><Label>(b)</Label><Text><Repealed>[Repealed, SOR/93-339, s. 1]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566752" lims:id="566752"><Label>(c)</Label><Text>fishing by a beneficiary within the Inuvialuit Settlement Region for subsistence usage; (<DefinedTermFr>pêche à des fins domestiques</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="566753" lims:id="566753" generate-in-text="no"><Text><DefinedTermEn>domestic fishing licence</DefinedTermEn> means a licence issued under these Regulations for the purposes of domestic fishing; (<DefinedTermFr>permis de pêche à des fins domestiques</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="566754" lims:id="566754" generate-in-text="no"><Text><DefinedTermEn>downrigger</DefinedTermEn> means a line used in angling or to assist in angling that has a weight greater than 500 g attached to it; (<DefinedTermFr>lest automatique</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="566755" lims:id="566755" generate-in-text="no"><Text><DefinedTermEn>fillet</DefinedTermEn> means any piece of fish flesh; (<DefinedTermFr>filet</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="566756" lims:id="566756" generate-in-text="no"><Text><DefinedTermEn>fish farming</DefinedTermEn> means the natural or artificial propagation of fish in any water authorized to be set apart for that purpose by the Minister under section 57 of the <XRefExternal reference-type="act" link="F-14">Fisheries Act</XRefExternal>. (<DefinedTermFr>aquaculture</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="566757" lims:id="566757" generate-in-text="no"><Text><DefinedTermEn>fish wheel</DefinedTermEn> means a stationary apparatus that is set in a river or stream and is composed of a wheel designed to rotate by means of water power and to catch fish in a series of baskets mounted around the circumference of the wheel; (<DefinedTermFr>tourniquet</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="566758" lims:id="566758" generate-in-text="no"><Text><DefinedTermEn>fishing boundary sign</DefinedTermEn> means a white triangular marker that is comprised of three boards, each of which is at least 1.5 m in length and at least 12 cm in width; (<DefinedTermFr>borne de pêche</DefinedTermFr>)</Text></Definition><Definition maillant</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="566770" lims:id="566770" generate-in-text="no"><Text><DefinedTermEn>hook</DefinedTermEn> means a single-pointed or multiple-pointed hook on a common shaft and includes a hook on an artificial lure; (<DefinedTermFr>hameçon</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="566771" lims:id="566771" generate-in-text="no"><Text><DefinedTermEn>Indian</DefinedTermEn> has the same meaning as in the <XRefExternal reference-type="act" link="I-5">Indian Act</XRefExternal>; (<DefinedTermFr>Indien</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="566772" lims:id="566772" generate-in-text="no"><Text><DefinedTermEn>Indian food fish licence</DefinedTermEn><Repealed>[Repealed, SOR/93-339, s. 1]</Repealed></Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="566773" lims:id="566773" generate-in-text="no"><Text><DefinedTermEn>Inuk</DefinedTermEn> means a person who is a direct descendant of a person of the race of aborigines commonly known as Inuit; (<DefinedTermFr>Inuk</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="566774" lims:id="566774" generate-in-text="no"><Text><DefinedTermEn>Inuvialuit Settlement Region</DefinedTermEn> has the same meaning as in the Agreement; (<DefinedTermFr>région generate-in-text="no"><Text><DefinedTermEn>length</DefinedTermEn> means, for the purposes of measuring a fish, the distance between the furthest anterior point of the head of the fish and the furthest posterior point of the caudal fin of the fish; (<DefinedTermFr>longueur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="566776" lims:id="566776" generate-in-text="no"><Text><DefinedTermEn>mesh size</DefinedTermEn> means the size of a single mesh of net determined by measuring, without straining the twine, the inside diagonal distance between the knots after immersion in water for not less than ½ hour; (<DefinedTermFr>maillage</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="566777" lims:id="566777" generate-in-text="no"><Text><DefinedTermEn>Minister</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566778" lims:id="566778"><Label>(a)</Label><Text>with respect to the administration of freshwater fisheries, the Executive Council Member responsible for Renewable Resources for the Yukon Territory, or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566779" lims:id="566779"><Label>(b)</Label><Text>in any other case, the Minister of Fisheries and Oceans for Canada; (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="566780" lims:id="566780" generate-in-text="no"><Text><DefinedTermEn>monofilament</DefinedTermEn> means any single filament that has more than 50 deniers and weighs more than 50 g per 9 000 m of who</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566785" lims:id="566785"><Label>(a)</Label><Text>holds a valid Alaska resident sport fishing licence, or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566786" lims:id="566786"><Label>(b)</Label><Text>has held a valid Alaska resident sport fishing licence within 12 months before making an application for a sport fishing licence under these Regulations; (<DefinedTermFr>non-résident admissible</DefinedTermFr>)</Text></Paragraph></Definition><Definition generate-in-text="no"><Text><DefinedTermEn>snagging</DefinedTermEn> means attempting to catch or catching a fish with a hook in any manner other than inducing it to take the hook in its mouth; (<DefinedTermFr>casaquer</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="566791" lims:id="566791" generate-in-text="no"><Text><DefinedTermEn>spear</DefinedTermEn> includes a bow and arrow; (<DefinedTermFr>harpon</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="566792" lims:id="566792" generate-in-text="no"><Text><DefinedTermEn>sport fishing</DefinedTermEn> means fishing for recreational purposes by angling, using a dip net or using a set line; (<DefinedTermFr>pêche sportive</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="566793" lims:id="566793" generate-in-text="no"><Text><DefinedTermEn>sport fishing licence</DefinedTermEn> means a licence issued under these Regulations for the purpose of sport fishing; (<DefinedTermFr>permis de pêche resident</DefinedTermEn> means a person who ordinarily resides in the Yukon Territory; (<DefinedTermFr>résident du Yukon</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="566798" lims:id="566798" generate-in-text="no"><Text><DefinedTermEn>Yukon River salmon licence</DefinedTermEn> means a licence issued under these Regulations that authorizes a person to fish for salmon in the waters of the Yukon River. (<DefinedTermFr>permis de pêche du saumon du fleuve Regulations apply in respect of fishing in the Canadian fisheries waters off the Yukon Territory and in the waters of the Yukon Territory other than the waters of a National Park of Canada located in that Territory.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="566805" lims:id="566805"><Label>(2)</Label><Text>Except as otherwise provided in these Regulations, these Regulations, other than subsections (1) and 9(3) and — to the extent that they relate to a contravention of subsection 9(3) — sections 10 and 11, do not apply with respect to fishing and related activities carried out under the authority of a licence issued under the <XRefExternal reference-type="regulation" link="SOR-93-332">Aboriginal Communal Fishing Licences lims:inforce-start-date="2008-05-15" lims:fid="566810" lims:id="566810"><Label>(1)</Label><Text>Subject to subsection (3), section 4.1 and subsection 5.1(1), no person shall fish, engage in fish farming or hold a derby except under the authority of a licence issued under these Regulations, the <XRefExternal reference-type="regulation" link="SOR-93-53">Fishery (General) Regulations</XRefExternal> or the <XRefExternal reference-type="regulation" link="SOR-93-332">Aboriginal Communal Fishing Licences Regulations</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2008-05-15" lims:fid="566811" lims:id="566811"><Label>(2)</Label><Text>Subject to subsection 6(14.1), on receipt of an application for a licence and, where applicable, a Salmon Conservation Catch Card as set out in column I of an item of Schedule III, together with the applicable fee set out in column II of that item, the Minister may issue the licence or the Salmon Conservation Catch Card.</Text></Subsection><Subsection lims:inforce-start-date="2008-05-15" lims:fid="566812" lims:id="566812"><Label>(3)</Label><Text>A person under 16 years of age may engage in angling without a licence if the person</Text><Paragraph lims:inforce-start-date="2008-05-15" lims:fid="566813" lims:id="566813"><Label>(a)</Label><Text>is a Yukon resident; or</Text></Paragraph><Paragraph lims:inforce-start-date="2008-05-15" lims:fid="566814" lims:id="566814"><Label>(b)</Label><Text>is accompanied by a person who is the holder of an angling licence or a sport fishing licence issued under these Regulations.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2008-05-15" lims:fid="566815" lims:id="566815"><Label>(4)</Label><Text>All fish caught by a person under 16 years of age shall be counted as part of the catch of the licence holder referred to in paragraph 3(b).</Text></Subsection><Subsection lims:inforce-start-date="2008-05-15" lims:fid="566816" lims:id="566816"><Label>(5)</Label><Text>The person under 16 years of age referred to in subsection (3) shall, at the request of a fishery lims:inforce-start-date="2008-05-15" lims:fid="566821" lims:id="566821"><Label>(1)</Label><Text>A Yukon resident may engage in angling without a licence</Text><Paragraph lims:inforce-start-date="2008-05-15" lims:fid="566822" lims:id="566822"><Label>(a)</Label><Text>during the period that begins on the last Friday in June and ends at midnight on the Monday immediately following that Friday, if July 1 falls within that period; or</Text></Paragraph><Paragraph lims:inforce-start-date="2008-05-15" lims:fid="566823" lims:id="566823"><Label>(b)</Label><Text>during the period that begins on the first Friday in July and ends at midnight on the Monday immediately following that Friday, if July 1 does not fall within the period referred to in paragraph (a).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2008-05-15" lims:fid="566824" lims:id="566824"><Label>(2)</Label><Text>Subsection (1) does not apply to angling by a lims:id="566830"><Label>5.1</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="566831" lims:id="566831"><Label>(1)</Label><Text>Notwithstanding subsection 4(1), a beneficiary may fish for subsistence usage within the Inuvialuit Settlement Region without a licence.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="566832" lims:id="566832"><Label>(2)</Label><Text>Notwithstanding subsection 9(4) and subject to section 12 of the Agreement, a beneficiary may sell to or trade or barter with</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566833" lims:id="566833"><Label>(a)</Label><Text>another beneficiary, fish or any part thereof taken for subsistence usage from the Inuvialuit Settlement Region; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566834" lims:id="566834"><Label>(b)</Label><Text>any other person, the nonedible by-products of fish taken from lims:id="566835"><Label>(3)</Label><Text>No person, other than a beneficiary, shall possess any edible portions of fish taken for subsistence usage from the Inuvialuit Settlement these Regulations, each gang of nets shall be marked at each end during open water fishing by a buoy, and during winter fishing by a stake the top of which shall be at least 1.2 m above the surface of the ice.</Text></Subsection><Subsection lims:inforce-start-date="2023-06-23" lims:enacted-date="2023-06-23" lims:fid="1413521" lims:id="1413521"><Label>(7.1)</Label><Text>The Minister may specify a fishing for any species of fish, set or operate gill nets that have a mesh size of less than 100 mm;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566848" lims:id="566848"><Label>(b)</Label><Text><Repealed>[Repealed, SOR/87-439, s. 4]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566849" lims:id="566849"><Label>(c)</Label><Text>when fishing under the authority of a domestic fishing licence, set or operate</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="566850" lims:id="566850"><Label>(i)</Label><Text>more than one gill net, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="566851" lims:id="566851"><Label>(ii)</Label><Text>a gill net that exceeds 90 m in length.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="566852" lims:id="566852"><Label>(9)</Label><Text>Except with the permission of a fishery officer, no person shall leave a gill net in the water</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566853" lims:id="566853"><Label>(a)</Label><Text>between May 1st and November 30th, for more than 30 consecutive hours, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566854" lims:id="566854"><Label>(b)</Label><Text>between December 1st and April 30th, for more than 72 consecutive hours,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="566855" lims:id="566855"><Text>without withdrawing it from the water and removing any fish caught therein.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="566856" lims:id="566856"><Label>(10)</Label><Text>No person shall engage in fishing for salmon by means of fish wheels except in the Yukon River downstream from a fishing boundary sign located 800 m downstream from the confluence of Tatchun Creek and the Yukon River.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="566857" lims:id="566857"><Label>(11) and (12)</Label><Text><Repealed>[Repealed, SOR/94-269, s. 3]</Repealed></Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="566858" lims:id="566858"><Label>(13)</Label><Text>No person shall fish for salmon for commercial purposes in the Yukon River and its tributaries unless that person holds</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566859" lims:id="566859"><Label>(a)</Label><Text>a commercial fishing licence; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566860" lims:id="566860"><Label>(b)</Label><Text>a Yukon River salmon licence.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="566861" lims:id="566861"><Label>(13.1)</Label><Text><Repealed>[Repealed, SOR/87-439, s. 4]</Repealed></Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="566862" lims:id="566862"><Label>(14)</Label><Text>No person shall fish for salmon for domestic purposes in the Yukon River and its tributaries unless that person holds</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566863" lims:id="566863"><Label>(a)</Label><Text>a domestic fishing licence; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566864" lims:id="566864"><Label>(b)</Label><Text>a Yukon River salmon licence.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="566865" lims:id="566865"><Label>(14.1)</Label><Text>The Minister may issue a Yukon River salmon licence to a person who holds a commercial fishing licence or domestic fishing licence and who, on or before March 31 in the year for which the Yukon River salmon licence is to be valid, applies in writing to the District Supervisor of the Department for the Yukon Territory and, with the application, encloses the fee for the Yukon River salmon licence that is set out in Schedule III.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="566866" lims:id="566866"><Label>(15)</Label><Text>No person shall engage in commercial fishing or domestic fishing</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566867" lims:id="566867"><Label>(a)</Label><Text>in the Yukon River</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="566868" lims:id="566868"><Label>(i)</Label><Text>upstream from a fishing boundary sign located approximately 800 m downstream from the confluence of Tatchun Creek and the Yukon River; or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="566869" lims:id="566869"><Label>(ii)</Label><Text>between the fishing boundary signs located approximately 800 m upstream from the confluence of the Yukon and Klondike Rivers and approximately 1.6 km downstream from that confluence;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566870" lims:id="566870"><Label>(b)</Label><Text>in the Pelly River watershed upstream from the confluence of the Pelly and MacMillan Rivers;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566871" lims:id="566871"><Label>(c)</Label><Text>in the Porcupine River watershed upstream from a fishing boundary sign located approximately 8 km upstream from the village of Old Crow; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566872" lims:id="566872"><Label>(d)</Label><Text>in the Stewart River watershed</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="566873" lims:id="566873"><Label>(i)</Label><Text>upstream from the confluence of the Stewart and McQueston Rivers, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="566874" lims:id="566874"><Label>(ii)</Label><Text>downstream from the confluence of the Stewart and McQueston Rivers from September 30 to July 7.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="566875" lims:id="566875"><Label>(16)</Label><Text>No person shall engage in commercial fishing for salmon in the waters of the Yukon River and its tributaries during the close time beginning on October 30 in one year and ending on June 15 in the next year.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="566876" lims:id="566876"><Label>(16.1)</Label><Text>No person shall engage in domestic fishing for salmon for domestic purposes in the waters of the Yukon River and its tributaries during the close time beginning on October 30 in one year and ending on June 15 in the next year.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="566877" lims:id="566877"><Label>(17)</Label><Text>No person shall engage in commercial fishing in the Yukon River with</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566878" lims:id="566878"><Label>(a)</Label><Text>more than three fish wheels;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566879" lims:id="566879"><Label>(b)</Label><Text>more than</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="566880" lims:id="566880"><Label>(i)</Label><Text>two fish wheels, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="566881" lims:id="566881"><Label>(ii)</Label><Text>45 m of gill net consisting of a maximum of two nets;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566882" lims:id="566882"><Label>(c)</Label><Text>more than</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="566883" lims:id="566883"><Label>(i)</Label><Text>one fish wheel, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:inforce-start-date="2006-03-22" lims:fid="566892" lims:id="566892"><Label>(1)</Label><Text>No person shall engage in sport fishing in Tatlmain or Wellesley Lake unless the person holds</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566893" lims:id="566893"><Label>(a)</Label><Text>a sport fishing licence set out in any of paragraphs 5(a) to (i) of Schedule III; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566894" lims:id="566894"><Label>(b)</Label><Text>a sport fishing licence set out in paragraph 5(l) or (m), as the case may be, of that Schedule.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="566895" lims:id="566895"><Label>(2)</Label><Text>No person shall, by angling, catch and retain, in any one day, more fish of a species set out in Column I of an item of Schedule IV, from the waters set out in Column II of that item than the daily catch limit set out for that species of fish in Column III of that item.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="566896" lims:id="566896"><Label>(2.1)</Label><Text>Despite subsection (2), no person shall, in any one day, continue angling on Tatlmain Lake after they have caught and retained or caught and released five fish regardless of species.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="566897" lims:id="566897"><Label>(3)</Label><Text>No person shall possess, in respect of fish caught by angling, more fish of a species set out in column I of an item of Schedule IV from the waters set out in column II of that item than the possession limit set out in column IV of that item.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="566898" lims:id="566898"><Label>(3.1) and (3.2)</Label><Text><Repealed>[Repealed, SOR/99-98, s. 4]</Repealed></Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="566899" lims:id="566899"><Label>(4)</Label><Text>No person shall, by angling, catch and retain, or have in his possession a fish of a species set out in Column I of an item of Schedule IV that is less than the minimum length set out in Column V of that item.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="566900" lims:id="566900"><Label>(5)</Label><Text>Where a fish has been filletted, two fillets shall be deemed to be one fish, and unless the body of the fish is shown, every fillet shall be deemed to be from a game fish.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="566901" lims:id="566901"><Label>(6)</Label><Text>No person shall, while angling,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566902" lims:id="566902"><Label>(a)</Label><Text>use more than one line except when angling through the ice, in which case two lines may be used; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566903" lims:id="566903"><Label>(b)</Label><Text>use on a line any gear that is designed to catch more than one fish at a time except while fly fishing where two artificial flies may be used; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566904" lims:id="566904"><Label>(c)</Label><Text><Repealed>[Repealed, SOR/94-269, s. 5]</Repealed></Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="566905" lims:id="566905"><Label>(6.1)</Label><Text>A person who holds a sport fishing licence may use a dip net to catch lake whitefish or suckers (<Language xml:lang="la">Catastomous spp.</Language>) in accordance with the terms of that licence.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="566906" lims:id="566906"><Label>(7)</Label><Text>No person shall, while angling, leave fishing gear unattended in the water.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="566907" lims:id="566907"><Label>(8)</Label><Text>A person who holds a sport fishing licence may use a set line to catch burbot in accordance with the terms of that licence.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="566908" lims:id="566908"><Label>(9)</Label><Text>A person who holds a sport fishing licence may snag cisco from Tagish Bridge over the Tagish River (60°15′N, 134°17′W) and from Carcross Bridge over the Nares River (60°09′N, 134°37′W) in accordance with the terms of that licence.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="566909" lims:id="566909"><Label>(10)</Label><Text>Where a person is authorized under a sport fishing licence to use a set line, that person may leave that set line unattended for a period not exceeding 30 consecutive hours.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="566910" lims:id="566910"><Label>(11)</Label><Text><Repealed>[Repealed, SOR/93-60, s. 6]</Repealed></Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="566911" lims:id="566911"><Label>(12)</Label><Text>No person shall angle from June 1 until November 30, except with a single-pointed barbless hook with a distance between the point and the shank of no more than 20 mm, in any of the following waters:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566912" lims:id="566912"><Label>(a)</Label><Text>Klukshu River;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566913" fish;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566978" lims:id="566978"><Label>(d)</Label><Text>catch or attempt to catch fish by snagging or with snares or set lines;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566979" lims:id="566979"><Label>(e)</Label><Text>use firearms to kill or injure finfish;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566980" lims:id="566980"><Label>(f)</Label><Text><Repealed>[Repealed, SOR/93-60, s. 8]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566984" lims:id="566984"><Label>(j)</Label><Text>use a gill net that contains monofilament in its web while fishing.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="566985" lims:id="566985"><Label>(2)</Label><Text>Subject to subsection (2.1), no person shall, in any waters, catch and retain</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566986" lims:id="566986"><Label>(a)</Label><Text>whitefish, cisco, lake trout or inconnu from September 1st to October 31st in any year; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566987" lims:id="566987"><Label>(b)</Label><Text>grayling from May 1st to June 15th in any year.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="566988" lims:id="566988"><Label>(2.1)</Label><Text>Subsection (2) does not apply to a person who</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566989" lims:id="566989"><Label>(a)</Label><Text>holds an angling licence;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566990" lims:id="566990"><Label>(b)</Label><Text>is fishing under the authority of a licence issued under the <XRefExternal reference-type="regulation" link="SOR-93-332">Aboriginal Communal Fishing Licences Regulations</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566991" lims:id="566991"><Label>(c)</Label><Text>holds any other licence listed in subsection 4(3) if the licence specifies any fish referred to in subsection (2) that may be caught and retained during the applicable period set out in subsection (2); or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566992" lims:id="566992"><Label>(d)</Label><Text>is a beneficiary who is fishing for subsistence usage within the Inuvialuit Settlement Region.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="566993" lims:id="566993"><Label>(3)</Label><Text>No person shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566994" lims:id="566994"><Label>(a)</Label><Text>bring into the Yukon Territory for use as bait any live fish, salamander or other aquatic organism;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566995" lims:id="566995"><Label>(b)</Label><Text>release into any waters of the Yukon Territory any live fish unless that fish is released</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="566996" lims:id="566996"><Label>(i)</Label><Text>to the waters from which it was taken, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="566997" lims:id="566997"><Label>(ii)</Label><Text>in accordance with a licence issued pursuant to section 56 of the <XRefExternal reference-type="regulation" link="SOR-93-53">Fishery (General) Regulations</XRefExternal>;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566998" lims:id="566998"><Label>(c)</Label><Text>release into any waters of the Yukon Territory any live salamander or other live aquatic organism, that is not a fish, unless that salamander or other aquatic organism was taken from waters of the Yukon Territory;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="566999" lims:id="566999"><Label>(d)</Label><Text>possess any live fish for use as bait in the Yukon Territory;
