(<DefinedTermFr>surface de transition</DefinedTermFr>)</Text></Definition><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="561336" lims:id="561336">SOR/93-401, s. 2</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="561337" lims:id="561337"><Label>3</Label><Text>For the purposes of these Regulations, the airport reference point is deemed to be 67 feet above sea level.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="561338" lims:id="561338" level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="561339" lims:id="561339"><Label>4</Label><Text>These Regulations apply to all the lands and lands under water, including public road allowances, adjacent to or in the vicinity of the airport, the outer limits of which are described in Part II of the schedule, other than such lands as from time to time form part of the airport.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="561340" lims:id="561340" level="1"><TitleText>General</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="561341" lims:id="561341"><Label>5</Label><Text>No person shall erect or construct, on any land or any land under water to which these Regulations apply, any building, structure or object or any addition to any existing building, structure or object, the highest point of which will exceed in elevation at the location of the highest point any of the surfaces hereinafter set out that project immediately over and above the surface of the land at that location, namely,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="561342" lims:id="561342"><Label>(a)</Label><Text>the approach surfaces;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="561343" lims:id="561343"><Label>(b)</Label><Text>the outer surface; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="561344" lims:id="561344"><Label>(c)</Label><Text>the transitional surfaces.</Text></Paragraph></Section></Body><Schedule lims:inforce-start-date="2006-03-22" lims:id="561346"><Label>SCHEDULE</Label><OriginatingRef>(Sections 2 and 4)</OriginatingRef></ScheduleFormHeading><Heading lims:inforce-start-date="2006-03-22" lims:fid="561347" lims:id="561347" level="1"><Label>PART I</Label><TitleText>Airport Reference Point</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="561348" lims:id="561348" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Premising that the bearings hereinafter mentioned are astronomical and are referred to the centre line of strip 10-28, Baie Comeau Airport, Baie Comeau, Province of Quebec, as North, seventy-nine degrees, forty-eight minutes, twenty seconds East (N. 79°48′20″ E.).</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="561349" lims:id="561349" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>BEGINNING at the intersection of the centre line of strip 10-28 with the centre line of the proposed strip 16-34; THENCE, North, 79°48′20″ East along the centre line of strip 10-28, a distance of two hundred eighty-one feet and one tenth (281.1) to a point; THENCE, at right angles in a general Northwesterly direction, a distance of five hundred (500) feet to the airport reference point; said airport reference point being also at two thousand five hundred forty-six feet and one tenth (2,546.1) measured along a line having bearing of South 27°05′ East from a point being the Northwesterly corner of Lot 16-1, Manicouagan Range, where there is an iron boundary post.</Text></Provision><Heading lims:inforce-start-date="2006-03-22" lims:fid="561350" lims:id="561350" level="1"><Label>PART II</Label><TitleText>Description of Outer Limits of Lands</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="561351" lims:id="561351" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>ALL AND SINGULAR those certain parcels or tracts of land and premises comprising part of the Township of Manicougan, Registration Division of Saguenay, County of Saguenay, Province of Quebec and being more particularly described as follows:</Text><Provision lims:inforce-start-date="2006-03-22" lims:fid="561352" lims:id="561352" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>COMMENCING at the intersection of the lot line between lots 11 and 12, Range IV, with the Southerly boundary of lot 51, Range IV; THENCE, following the Southerly boundary of lot 51, Range IV, in a general Easterly direction, to its intersection with a line running N. 50°02′09″ W. and being one of the limits of the approach surface of the proposed strip 16-34; THENCE, following the last mentioned line, N. 50°02′09″ W., to its intersection with a line running N. 48°29′41″ E. being at ten thousand (10,000) feet measured along the Northwesterly production of the centre line of the proposed strip 16-34 from the end of the said proposed strip; THENCE, following the last mentioned line, N. 48°29′41″ E., a distance of four thousand (4,000) feet to its intersection with a line running S. 32°58′29″ E. and being one of the limits of the approach surface of the proposed strip 16-34; THENCE, following the last mentioned line, S. 32°58′29″ E., to its intersection with a line running S. 40°55′56″ E. and being one of the limits of the transitional surface of the proposed strip 16-34; THENCE, following the last mentioned line S. 40°55′56″ E., to its intersection with the waters’ edge of Manicouagan River; THENCE, following the waters’ edge of Manicouagan River and St. Lawrence River, in general Easterly, Northeasterly and Southeasterly directions, to its intersection with a line running N. 79°13′57″ E. and being one of the limits of the transitional surface of strip 10-28; THENCE, following the last mentioned line, N. 79°13′57″ E., to its intersection with a line running N. 71°16′30″ E. and being one of the limits of the approach surface of strip 10-28; THENCE, following the last mentioned line, N. 71°16′30″ E., to its intersection with a line running S. 10°11′40″ E. being at ten thousand (10,000) feet measured along the Northeasterly production of the centre line of strip 10-28 from the end of the said strip; THENCE, following the last mentioned line, S. 10°11′40″ E., a distance of four thousand (4,000) feet to its intersection with a line running S. 88°20′10″ W. and being one of the limits of the approach surface of strip 10-28; THENCE, following the last mentioned line, S. 10°11′40″ E., to its intersection with a line running S. 80°22′43″ W., and being one of the limits of the transitional surface of strip 10-28; THENCE, following the last mentioned line, S. 80°22′43″ W., to its intersection with the waters’ edge of St. Lawrence River; THENCE, following the waters’ edge of St. Lawrence River, in a general Southerly direction, to its intersection with a line running S. 42°04′42″ E., and being one of the limits of the transitional surface of the proposed strip 16-34; THENCE, following the last mentioned line, S. 42°04′42″ E., to its intersection with a line running S. 50°02′09″ E. and being one of the limits of the approach surface of the proposed strip 16-34; THENCE, following the last mentioned line, S. 50°02′09″ E., to its intersection with a line running S. 48°29′41″ W. and being at ten thousand (10,000) feet measured along the Southeasterly production of the centre line of the proposed strip 16-34 from the end of the said strip; THENCE, following the last mentioned line, S. 48°29′41″ W., a distance of four thousand (4,000) feet to its intersection with a line running N. 32°58′29″ W. and being one of the limits of the approach surface of the proposed strip 16-34; THENCE, following the last mentioned line, N. 32°58′29″ W., to its intersection with a line running N. 40°55′56″ W. and being one of the limits of the transitional surface of the proposed strip 16-34; THENCE, following the last mentioned line, N. 40°55′56″ W., to its intersection with the waters’ edge of St. Lawrence River; THENCE, following the waters’ edge of St. Lawrence River, in general Southwesterly and Westerly directions to its intersection with the lot line between lot III and block A, Range I; THENCE, following the last mentioned lot line between lot III and block A, Range I, in a general Northerly direction to its intersection with the range line between Ranges I and II; THENCE, following the range line between Ranges I and II, in general Westerly, Northwesterly and Westerly directions, to the Northwesterly corner of lot 10, Range I; THENCE, following a line, in a general Northwesterly direction, to its intersection with a line running S. 71°16′30″ W. and being one of the limits of the approach surface of strip 10-28; THENCE, following the last mentioned line, S. 71°16′30″ W. to its intersection with a line running N. 10°11′40″ W., being at ten thousand (10,000) feet measured along the Southwesterly production of the centre line of strip 10-28 from the end of the said strip; THENCE, following the last mentioned line, N. 10°11′40″ W., a distance of four thousand (4,000) feet to its intersection with a line running N. 88°20′10″ E. and being one of the limits of the approach surface of strip 10-28; THENCE, following the last mentioned line, N. 88°20′10″ E., to its intersection with a line running N. 80°22′43″ E. and being one of the limits of the transitional surface of strip 10-28; THENCE, following a line, in a general Northeasterly direction, to the Southwesterly corner of Lot 11, Range IV; THENCE, following the lot line between lots 11 and 12, Range IV, in a general Northerly direction to the point of commencement, which lands and part of lims:id="561449" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The strips associated with existing runway 10-28 and proposed runway 16-39 are one thousand (1,000) feet in width, five hundred (500) feet being on each side of the centre line of the runway, and eight thousand four hundred (8,400) feet in length, and are shown on Department of Transport Plan No. M-3908, dated Surface</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="561451" lims:id="561451" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Being a surface consisting of an inclined plane rising at a ratio of one (1) foot measured vertically to seven (7) feet measured horizontally at right angles to the centre line and centre line production of each strip, and extending upward and outward from the lateral limits of each strip and its approach surfaces to an intersection with the outer surface or another transitional surface of an adjoining strip,
