(<DefinedTermFr>Organisation</DefinedTermFr>)</Text></Definition><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="503312" lims:id="503312">SOR/87-63, s. 1</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="503313" lims:id="503313" level="1"><TitleText>Immunity</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="503314" lims:id="503314"><Label>3</Label><Text>The Organization shall have in Canada, to such extent as may be required for the performance of its functions, immunity from every form of legal process except in so far as in any particular case it has expressly waived its immunity.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="503315" lims:id="503315"><Label>3.1</Label><Text>The Commissioners and members of the staff of the Organization shall have immunity in Canada from every form of legal process in respect of words spoken or written and all acts performed by them in their official capacity, as set out in Article V of the Convention, except in so far as in any particular case they have expressly waived their immunity.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="503317" lims:id="503317">SOR/87-63, s. 2</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="503318" lims:id="503318"><Label>3.2</Label><Text>The experts performing missions for the Organization shall, to such extent as may be necessary for the independant exercise of their functions, have immunity in Canada from every form of legal process in respect of words spoken or written and all acts done by them in the course of performing their missions, as set out in Article VI of the Convention, except in so far as in any particular case they have expressly waived their immunity.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="503320" lims:id="503320">SOR/87-63, s. 2</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="503321" lims:id="503321"><Label>4</Label><Text>Nothing in this Order extends immunity to the Organization in respect of judicial proceeding commenced before the making of this Order.</Text></Section></Body></Regulation>
