lims:id="502926"><Label>1</Label><Text>These Regulations may be cited as the <XRefExternal reference-type="regulation" link="C.R.C.,_c._1303">Precious Metals Marking Regulations</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="502927" lims:id="502927" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="502928" lims:id="502928"><Label>2</Label><Text>In these Regulations, <DefinedTermEn>Act</DefinedTermEn> means the <XRefExternal reference-type="act" link="P-19">Precious Metals Marking Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="502929" lims:id="502929" level="1"><TitleText>Exemption from Application of the Act</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="502930" lims:id="502930"><Label>3</Label><Text>Every article sold to a dealer who is outside Canada is exempt from the application of the Act.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="502931" lims:id="502931" level="1"><TitleText>Parts Exempt from Assay</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="502932" lims:id="502932"><Label>4</Label><Text>The parts of an article that are exempt from assay for the purposes of the Act and these Regulations are</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="502933" lims:id="502933"><Label>(a)</Label><Text>any mechanism, movement or works, where the article consists of a case or cover containing or incorporating the mechanism, movement or works;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="502934" lims:id="502934"><Label>(b)</Label><Text>brooch pins, brooch joints and brooch catches on</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="502935" lims:id="502935"><Label>(i)</Label><Text>gold or silver insignia pins, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="502936" lims:id="502936"><Label>(ii)</Label><Text>any article to which a quality mark specified in Column I of item 1, 2 or 4 of the table to section 7 may be applied;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="502937" lims:id="502937"><Label>(c)</Label><Text>where the article is an article to which a quality mark specified in Column I of item 1 or 2 of the tables to sections 6, 8 and 9 or in Column I of item 1, 2 or 4 of the table to section 7 may be applied, the following parts thereof:</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="502938" lims:id="502938"><Label>(i)</Label><Text>springs, winding bars, sleeves, crown cores, joint pins, screws, rivets, dust bands, movement rings and spring pins,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="502939" lims:id="502939"><Label>(ii)</Label><Text>hat pin stems and sockets,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="502940" lims:id="502940"><Label>(iii)</Label><Text>scarf pin, stick pin and collar tack clutchbacks,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="502941" lims:id="502941"><Label>(iv)</Label><Text>bracelet tongues,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="502942" lims:id="502942"><Label>(v)</Label><Text>locket bezels,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="502943" lims:id="502943"><Label>(vi)</Label><Text>knife skeletons and blades,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="502944" lims:id="502944"><Label>(vii)</Label><Text>lapel button backs and the posts to which they are attached,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="502945" lims:id="502945"><Label>(viii)</Label><Text>earring setting posts, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="502946" lims:id="502946"><Label>(ix)</Label><Text>tubes and posts for attachment to drilled stones together with any attached collet or claw setting; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="502947" lims:id="502947"><Label>(d)</Label><Text>where the article is a spectacle frame to which a quality mark specified in the table to section 10 may be applied, the following parts thereof:</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="502948" lims:id="502948"><Label>(i)</Label><Text>pad posts,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="502949" lims:id="502949"><Label>(ii)</Label><Text>cores and inner winding of comfort cable temples,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="502950" lims:id="502950"><Label>(iii)</Label><Text>any part permanently encased in a non-metallic covering, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="502951" lims:id="502951"><Label>(iv)</Label><Text>hinge lims:id="502956"><Label>(1)</Label><Text>Subject to subsections 10(1), 11(6) and 12(1), a quality mark may be applied to a precious metal article by any method.</Text></Subsection><Subsection lims:inforce-start-date="2019-06-17" lims:enacted-date="2014-06-19" lims:fid="502957" lims:id="1145755"><Label>(2)</Label><Text>Where a quality mark is stamped, branded, engraved or imprinted on a precious metal article, a trademark that is applied to that article pursuant to subsection 4(3) of the Act shall be applied by the same method as the quality mark.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="502958" lims:id="502958"><Label>(3)</Label><Text>Where only part of an article is composed of a precious metal plating of a quality specified in section 7, 8 or 9 and a quality mark is applied to the article, the name of the part to which the quality mark is applicable shall be applied immediately before or after the mark.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="502959" lims:id="502959"><Label>(4)</Label><Text>Where a statement of the thickness of the precious metal is expressed as a whole numeral and followed immediately by the word “micrometres”, or the symbol, “vm” the word “micron”, or the symbol “v” may be substituted Articles</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="502963" lims:id="502963"><Label>6</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="502964" lims:id="502964"><Label>(1)</Label><Text>A quality mark specified in Column I of an item of the table to this section may be applied to an article, other than a plated article, or part thereof, that</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="502965" lims:id="502965"><Label>(a)</Label><Text>is composed wholly or partly of a precious metal specified in Column II of that item; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="502966" lims:id="502966"><Label>(b)</Label><Text>meets the requirements specified in Column III of that item.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="502967" lims:id="502967"><Label>(2)</Label><Text>Where only part of an article, other than a plated article, is composed wholly or partly of a precious metal and the quality mark is applied to the article, the name of the part to which the quality mark is applicable shall be applied immediately before or after the mark.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="502968" lims:id="502968"><Label>(3)</Label><Text>Where a quality mark for gold is used, the word “gold”, “or”, the letter “G” or the abbreviation “Au” may be applied to the article in conjunction with the quality mark.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="502969" lims:id="502969"><Label>(4)</Label><Text>Where the quality of gold in an article is represented</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="502970" lims:id="502970"><Label>(a)</Label><Text>in karats, the number shown in conjunction with that representation shall be in the same proportion to the number 24 as the quality of the gold in the article is to pure gold; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="502971" lims:id="502971"><Label>(b)</Label><Text>in decimals, the number used shall be in the same proportion to the number 1 as the quality of the gold in the article is to pure gold.</Text><TableGroup article, other than a watch case, spectacle frame, or an article of flatware or hollow ware that</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="502981" lims:id="502981"><Label>(a)</Label><Text>is plated with the precious metal of a kind and quality specified in Column II of that item; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="502982" lims:id="502982"><Label>(b)</Label><Text>meets the requirements specified in Columns III and IV of that at least one micrometre, a statement of the thickness of the gold or silver expressed as a whole numeral and followed immediately by the word “micrometre”, or the symbol “vm” therefor, may be applied specified in Column I of item 4 of the table to this section is applied to an article, a fraction, in which all numerals are of equal size and not larger than the quality mark, showing the ratio of to it silver</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="503062" lims:id="503062"><Label>(a)</Label><Text>that is at least 925 parts by weight in every 1,000 parts pure silver;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="503063" lims:id="503063"><Label>(b)</Label><Text>as primary plating to a thickness equal to that of the primary plating on a teaspoon that is of the same pattern as such article, if the amount of silver used to uniformly plate a gross of such teaspoons is that prescribed in Column II of the table for that mark; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="503064" lims:id="503064"><Label>(c)</Label><Text>as an overlay at the point of greatest wear, where applicable, to a thickness equal to that of the primary plating and in an amount at least as great as that prescribed in Column III of the table for that mark.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="503065" lims:id="503065"><Label>(3)</Label><Text>A quality mark specified in Column I of item 3 of the table to section 7 may be applied to an article of flatware that is plated with gold that is at least 10 karats in quality.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="503066" lims:id="503066"><Label>(4)</Label><Text>Where a quality mark is applied to an article of flatware pursuant to subsection (3) and the article is plated with gold to a thickness of at least one micrometre, a statement of the thickness of the gold expressed as a whole numeral and followed immediately by the word “micrometre”, or the symbol “vm” therefor, may be applied to the frame in conjunction with the quality mark.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="503067" lims:id="503067"><Label>(5)</Label><Text>Where 10 percent or more by weight of the base metal in an article of flatware to which a quality mark specified in Column I of item 3 of the table to section 7 or in Column 1 of an item of the table to this section is applied is pure nickel, the expression “nickel-silver”, “nickel-argent” or “N.S.” may be applied to the article in conjunction with the quality mark.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="503068" lims:id="503068"><Label>(6)</Label><Text>Where less than 10 per cent by weight of the base metal in an article of gold-plated or silver-plated flatware is pure nickel, the name of the base metal shall be stamped on the article and the trademark shall be applied in conjunction therewith.</Text><TableGroup lims:inforce-start-date="2006-03-22" or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="503111" lims:id="503111"><Label>(b)</Label><Text>where no representation of the proportion and quality of the gold is made, in the case of Column I of item 1 of the table to section 7 or 10, at least 90 per cent of 0.0208 fineness.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="503112" lims:id="503112"><Label>(1.1)</Label><Text>Where a quality mark specified in Column I of item 1 or 2 of the table to section 7 is applied to a plated article that is engraved, brocaded or diamond faceted, the actual amount of pure gold in the plated article shall be</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="503113" lims:id="503113"><Label>(a)</Label><Text>where a representation of the proportion and quality of the gold is made, at least 80 per cent of the product obtained by multiplying the fraction referred to in paragraph 7(2)(a) by the quality of the gold represented; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="503114" lims:id="503114"><Label>(b)</Label><Text>where no representation of the proportion and quality of the gold is made, in the case of Column I of item 1 of the table to section 7, at least 80 per cent of 0.0208 fineness.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="503115" lims:id="503115"><Label>(2)</Label><Text>Where a quality mark specified in Column I of item 4 of the table to section 7 is applied to a plated article, the amount of pure silver in the plated article shall be</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="503116" lims:id="503116"><Label>(a)</Label><Text>where a representation of the proportion of the silver is made, at least 90 per cent of the product obtained by multiplying the fraction applied immediately preceding the quality mark pursuant to subsection 7(5) by 0.925; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="503117" lims:id="503117"><Label>(b)</Label><Text>where no representation of the proportion of the silver is made, at least 90 per cent of 0.0925 fineness.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="503118" lims:id="503118"><Label>(3)</Label><Text>Where a quality mark specified in Column I of item 4 of the table to section 7 is applied to a plated article that is engraved, brocaded or diamond faceted, the amount of pure silver in the plated article shall be</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="503119" lims:id="503119"><Label>(a)</Label><Text>where a representation of the proportion of the silver is made, at least 80 per cent of the product obtained by multiplying the fraction applied immediately preceding the quality mark pursuant to subsection 7(5) by 0.925;
