lims:id="499894"><Label>(1)</Label><Text>In these Regulations,</Text><Definition lims:inforce-start-date="2017-11-27" lims:fid="499895" lims:id="499895" generate-in-text="no"><Text><DefinedTermEn>Act</DefinedTermEn> means the Old Age Security Act; (<DefinedTermFr>Loi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-11-27" lims:fid="499896" lims:id="499896" generate-in-text="no"><Text><DefinedTermEn>appeal</DefinedTermEn> means an appeal referred to in subsection 28(1) of the Act or made in respect of a a federal institution or whose services are required by a federal institution, on a casual or temporary basis or under a student employment lims:inforce-start-date="2006-03-22" lims:fid="499918" lims:id="499918"><Label>(1)</Label><Text>Where required by the Minister, an application for a benefit shall be made on an application form.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="499919" lims:id="499919"><Label>(2)</Label><Text>Subject to subsections 5(2) and 11(3) of the Act, an application is deemed to have been made only when an application form completed by or on behalf of an applicant is received by the Minister.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem the Minister considers that a person is unable for a sufficient reason to make a request for a reconsideration or to make an appeal, an application, a statement or a notice, the request for reconsideration, appeal, application, statement or notice may be made on that person’s behalf by a responsible person or agency.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="499924" lims:id="499924"><Label>(2)</Label><Text>Where a person is or has been in receipt of assistance pursuant to the <XRefExternal reference-type="act" link="U-0.6">Unemployment Assistance Act</XRefExternal> or the <XRefExternal reference-type="act">Canada Assistance Plan</XRefExternal>, an application for a pension may be made on behalf of that person by the appropriate 3</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2017-11-27" lims:fid="499927" lims:id="499927" level="2"><TitleText>Approval of an Application for a Pension</TitleText></Heading><Section lims:inforce-start-date="2013-03-01" lims:lastAmendedDate="2013-03-01" lims:fid="499928" lims:id="499928"><Label>5</Label><Subsection lims:inforce-start-date="2013-03-01" lims:fid="499929" lims:id="499929"><Label>(1)</Label><Text>Subject to subsection (2), where the Minister</Text><Paragraph lims:inforce-start-date="2013-03-01" lims:fid="499930" lims:id="499930"><Label>(a)</Label><Text>is satisfied that an applicant is qualified for a pension in accordance with sections 3 to 5 of the Act, and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-03-01" lims:fid="499931" lims:id="499931"><Label>(b)</Label><Text>approves the application after the last day of the month in which it was received,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2013-03-01" lims:fid="499932" lims:id="499932"><Text>the Minister’s approval shall be effective on the latest of</Text></ContinuedSectionSubsection><Paragraph lims:inforce-start-date="2013-03-01" lims:fid="499933" lims:id="499933"><Label>(c)</Label><Text>the day on which the application was received,</Text></Paragraph><Paragraph lims:inforce-start-date="2013-03-01" lims:fid="499934" lims:id="499934"><Label>(d)</Label><Text>the day on which the applicant became qualified for a pension in accordance with sections 3 to 5 of the Act, and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-03-01" lims:fid="499935" lims:id="499935"><Label>(e)</Label><Text>the date specified in writing by the applicant.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-03-01" lims:fid="499936" lims:id="499936"><Label>(2)</Label><Text>Where the Minister is satisfied that an applicant mentioned in subsection (1) attained the age of 65 years before the day on which the application was received, the Minister’s approval of the application shall be effective as of the latest of</Text><Paragraph lims:inforce-start-date="2013-03-01" lims:fid="499937" lims:id="499937"><Label>(a)</Label><Text>the day that is one year before the day on which the application was received,</Text></Paragraph><Paragraph lims:inforce-start-date="2013-03-01" lims:fid="499938" lims:id="499938"><Label>(b)</Label><Text>the day on which the applicant attained the age of 65 years;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-03-01" lims:fid="499939" lims:id="499939"><Label>(c)</Label><Text>the day on which the applicant became qualified for a pension in accordance with sections 3 to 5 of the Act; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-03-01" lims:fid="499940" lims:id="499940"><Label>(d)</Label><Text>the month immediately before the date specified in writing by the applicant.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-03-01" lims:fid="499941" lims:id="499941"><Label>(3)</Label><Text>Where the Minister, under subsection 5(2) or 11(3) of the Act, deems an application to have been made and approved, the Minister’s approval shall be effective on the day on which the person attained the age of 65 years.</Text></Subsection><Subsection lims:inforce-start-date="2013-03-01" lims:fid="499942" lims:id="499942"><Label>(4)</Label><Text>If the Minister waives the requirement for an application in respect of a person under subsection 5(4) of the Act, the Minister’s approval is effective on the day on which the person attains the age of 65 lims:id="499946"><Label>6</Label><Text>Where a spouse, common-law partner or survivor is entitled under Part III of the Act to an allowance in an amount that does not exceed $2 monthly, an allowance level="2"><TitleText>Manner of Rounding Off Amount of Partial Monthly Pension</TitleText></Heading><Section lims:inforce-start-date="2013-07-01" lims:lastAmendedDate="2013-07-01" lims:fid="499950" lims:id="499950"><Label>7</Label><Text>Where the amount of a partial monthly pension referred to in subsection 3(3) of the Act, as increased under subsection 7.1(2) of the Act if applicable, contains a fraction of a dollar that is represented by three or more digits,</Text><Paragraph lims:inforce-start-date="2013-07-01" lims:fid="499951" lims:id="499951"><Label>(a)</Label><Text>if the third digit is less than 5, the third and subsequent digits shall be dropped; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-07-01" lims:fid="499952" lims:id="499952"><Label>(b)</Label><Text>if the third digit is 5 or greater than 5, the second digit shall be increased by 1 and the third and subsequent digits shall be dropped.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2017-11-27" lims:fid="499955" lims:id="499955" level="2"><TitleText>Manner of Quarterly Adjustment of Benefit</TitleText></Heading><Section lims:inforce-start-date="2013-07-01" lims:lastAmendedDate="2013-07-01" lims:fid="499956" lims:id="499956"><Label>8</Label><Subsection lims:inforce-start-date="2013-07-01" lims:fid="499957" lims:id="499957"><Label>(1)</Label><Text>Where the amount of a full monthly pension or supplement is adjusted quarterly pursuant to subsection 7(2) or 12(2) of the Act,</Text><Paragraph lims:inforce-start-date="2013-07-01" lims:fid="499958" lims:id="499958"><Label>(a)</Label><Text>there shall be an adjustment to the nearest cent, in accordance with subsection (2), of the product obtained</Text><Subparagraph lims:inforce-start-date="2013-07-01" lims:fid="499959" lims:id="499959"><Label>(i)</Label><Text>by multiplying the amount referred to in paragraph 7(2)(a) of the Act by the ratio referred to in paragraph 7(2)(b) of the Act, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-07-01" lims:fid="499960" lims:id="499960"><Label>(ii)</Label><Text>by multiplying the amount referred to in paragraph 12(2)(a) of the Act by the ratio referred to in paragraph 12(2)(b) of the Act; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2013-07-01" lims:fid="499961" lims:id="499961"><Label>(b)</Label><Text>the ratios referred to in paragraph (a) shall be expressed as decimal fractions in accordance with subsection (3).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-07-01" lims:fid="499962" lims:id="499962"><Label>(2)</Label><Text>Where the product referred to in subparagraph (1)(a)(i), as increased under subsection 7.1(1) of the Act if applicable, or the product referred to in subparagraph (1)(a)(ii), contains a fraction of a dollar that is represented by three or more digits,</Text><Paragraph lims:inforce-start-date="2013-07-01" lims:fid="499963" lims:id="499963"><Label>(a)</Label><Text>if the third digit is less than 5, the third and subsequent digits shall be dropped; and,</Text></Paragraph><Paragraph lims:inforce-start-date="2013-07-01" lims:fid="499964" lims:id="499964"><Label>(b)</Label><Text>if the third digit is 5 or greater than 5, the second digit shall be increased by 1 and the third and subsequent digits shall be dropped.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-07-01" lims:fid="499965" lims:id="499965"><Label>(3)</Label><Text>Where the ratios referred to in paragraph (1)(a) contain a fraction that is less than 1, that fraction shall be expressed as a decimal fraction of four digits after the decimal point, and</Text><Paragraph lims:inforce-start-date="2013-07-01" lims:fid="499966" lims:id="499966"><Label>(a)</Label><Text>where the fourth digit after the decimal point is less than 5, the fourth digit after the decimal point shall be dropped; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-07-01" lims:fid="499967" lims:id="499967"><Label>(b)</Label><Text>where the fourth digit after the decimal point is 5 or greater than 5, the third digit after the decimal point shall be increased by 1 and the fourth digit after the decimal point shall be dropped.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2013-07-01" lims:fid="499969" lims:id="499969">SOR/90-813, s. 5; SOR/2013-23, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2017-11-27" lims:fid="499970" lims:id="499970" level="2"><TitleText>Determination of Average Consumer Price Index for Period of Months</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="499971" lims:id="499971"><Label>9</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="499972" lims:id="499972"><Label>(1)</Label><Text>The average of the Consumer Price Index for Canada for a period of months shall be determined by dividing the aggregate of the Consumer Price Index for Canada, as published by Statistics Canada under the authority of the <XRefExternal reference-type="act" link="S-19">Statistics Act</XRefExternal>, for each month in that period by the number of months in that period.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="499973" lims:id="499973"><Label>(2)</Label><Text>Where the quotient obtained pursuant to subsection (1) contains a fraction that is less than 1, such fraction shall be expressed as a decimal fraction of two digits after the decimal point and</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="499974" lims:id="499974"><Label>(a)</Label><Text>the second digit after the decimal point shall be dropped if that digit is less than 5; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="499975" lims:id="499975"><Label>(b)</Label><Text>the first digit after the decimal point shall be increased by one and the second digit shall be dropped if the second digit is 5 or greater than 5.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2017-11-27" lims:fid="499976" lims:id="499976" level="2"><TitleText>Approval of Application for a Supplement</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="499977" lims:id="499977"><Label>10</Label><Text>Where the Minister is satisfied that a pensioner is eligible for a supplement under section 11 of the Act, the Minister shall approve an application for a supplement by that pensioner in accordance with that section.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="499979" lims:id="499980"><Label>10.1</Label><Text>If the Minister waives the requirement for an application for a supplement in respect of a person under subsection 11(3.1) of the Act, the Minister’s approval Allowance</TitleText><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2017-11-27" lims:fid="499985" lims:id="499985">SOR/2000-412, s. 2(E)</HistoricalNoteSubItem></HistoricalNote></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="499986" lims:id="499986"><Label>11</Label><Text>The Minister shall approve an application for an allowance for the spouse or common-law partner of a pensioner or for a survivor where the spouse, common-law partner or survivor is entitled to an lims:id="499989"><Label>12</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="499990" lims:id="499990"><Label>(1)</Label><Text>Subject to subsections (2) and (3), where the Minister approves an application for an allowance after the last day of the month in which the application was received, the Minister’s approval shall be effective as of the later of</Text><Paragraph section 19 or 21 of the Act.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="499993" lims:id="499993"><Label>(2)</Label><Text>Where the spouse or common-law partner of a pensioner attains the age of 60 years before the day on which the application for an allowance in respect of the spouse or common-law partner is received, the approval of the application by the Minister shall be effective as of the latest of</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="499994" lims:id="499994"><Label>(a)</Label><Text>the day that is one year before or common-law partner attained the age of 60 years, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="499996" lims:id="499996"><Label>(c)</Label><Text>the day on which the spouse or common-law partner became entitled to an allowance under section 19 of the Act.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="499997" lims:id="499997"><Label>(3)</Label><Text>Where a survivor is entitled to an allowance under section 21 of the Act before the day on which an application in respect of the survivor is received, the approval of the application by the Minister shall be effective as of the later of</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="499998" lims:id="499998"><Label>(a)</Label><Text>the day that is one year before the day on which the application was received, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="499999" lims:id="500006"><Label>(ii)</Label><Text>ceases to carry on a business shall be the month in which the last day on which he actively carries on that business falls; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="500007" lims:id="500007"><Label>(b)</Label><Text>the month in which an applicant or an applicant’s spouse or common-law partner suffers a loss of income due to termination or reduction of pension income shall be the month in which that termination or reduction actually maintenance payments;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="500014" lims:id="500014"><Label>(c)</Label><Text>employment insurance benefits;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="500015" lims:id="500015"><Label>(d)</Label><Text>disability benefits deriving from a private insurance plan;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="500016" lims:id="500016"><Label>(e)</Label><Text>any benefit, other than a death benefit, under the <XRefExternal reference-type="act" link="C-8">Canada Pension Plan</XRefExternal> or a provincial pension plan as defined in the <XRefExternal reference-type="act" link="C-8">Canada Pension Plan</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="500017" lims:id="500017"><Label>(f)</Label><Text>superannuation or pension payments, other than a benefit received pursuant to the Act or any similar payment received pursuant to a law of a provincial legislature;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="500018" lims:id="500018"><Label>(g)</Label><Text>compensation under a federal or provincial employee’s or worker’s compensation law in respect of an injury, disability or death;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="500019" lims:id="500019"><Label>(h)</Label><Text>income assistance benefits under an agreement referred to in subsection 33(1) of the <XRefExternal reference-type="act" link="H-5.8">Department of Human Resources Development Act</XRefExternal> by reason of a permanent reduction in the work force as described in that subsection; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="500020" lims:id="500020"><Label>(i)</Label><Text>income assistance benefits under the Plant Workers’ Adjustment Program, the Fisheries Early Retirement Program or the Northern Cod Adjustment and Recovery Program by reason of a permanent reduction in the work Minister may assign or cause to be assigned a Social Insurance Number to the applicant or beneficiary or to the spouse or common-law partner of the applicant or received information in support of an application for a benefit that is necessary to determine the relationship between the applicant and their spouse or common-law partner, the Minister may require that one of the following documents be submitted:</Text><Paragraph lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-21" lims:fid="1554606" lims:id="1554606"><Label>(a)</Label><Text>in the case of spouses, their certificate of marriage, a copy of that certificate or a copy of their act of marriage; or</Text></Paragraph><Paragraph lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-21" lims:fid="1554607" lims:id="1554607"><Label>(b)</Label><Text>in the case of common-law partners, a statutory declaration setting out information as to their relationship or, if applicable, any other evidence of the relationship.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-21" lims:fid="1554608" lims:id="1554608"><Label>(2)</Label><Text>If there are reasonable grounds to doubt the validity of the copy of a certificate or act of marriage referred to in paragraph (1)(a), the Minister may require that the original certificate of marriage or, if applicable, a copy of the act of marriage issued by the competent authority be submitted.</Text></Subsection><Subsection lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-21" lims:fid="1554609" lims:id="1554609"><Label>(3)</Label><Text>If there are reasonable grounds to believe that none of the documents referred to in paragraph (1)(a) are available, the Minister may determine the relationship between the applicant and their spouse on the basis of a statutory declaration setting out information as to requirement for an application for a supplement has been waived under subsection 11(3.1) of the Act, has a spouse or common-law partner, the Minister may use the tax return filed with the Minister of lims:fid="500045" lims:id="1554611"><Label>18</Label><Subsection lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-21" lims:fid="1554612" lims:id="1554612"><Label>(1)</Label><Text>Subject to subsections (2) to (4) and section 19, the Minister must determine an applicant’s age and identity for the purposes of the Act on the basis of</Text><Paragraph lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-21" lims:fid="1554613" lims:id="1554613"><Label>(a)</Label><Text>a birth certificate, a copy of one or a copy of an act of birth; or</Text></Paragraph><Paragraph lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-21" lims:fid="1554614" lims:id="1554614"><Label>(b)</Label><Text>any information made available to the Minister by the Canada Employment Insurance Commission under subsection 28.2(5) of the <XRefExternal reference-type="act" link="H-5.7">Department of Employment and Social Development Act</XRefExternal>.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-21" lims:fid="1554615" lims:id="1554615"><Label>(2)</Label><Text>If there are reasonable grounds to doubt the validity of the copy of a birth certificate or act of birth referred to in paragraph (1)(a), the Minister may require that the original birth certificate or, if applicable, a copy of the act of birth issued by the competent authority be submitted.</Text></Subsection><Subsection lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-21" lims:fid="1554616" lims:id="1554616"><Label>(3)</Label><Text>If there are reasonable grounds to believe that none of the documents referred to in paragraph (1)(a) are available, the Minister may determine the applicant’s age and identity on the basis of any other information or evidence respecting the applicant’s age and identity.</Text></Subsection><Subsection lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-21" lims:fid="1554617" lims:id="1554617"><Label>(4)</Label><Text>If the Minister is unable to determine the applicant’s age and identity under any of subsections (1) to (3), the Minister may, if possible, determine them on the basis of any information obtained from Statistics Canada under section 6 of the lims:lastAmendedDate="2026-01-01" lims:fid="1554618" lims:id="1554618"><Label>18.1</Label><Text>For the purposes of section 6 of the Act, the conditions are the following:</Text><Paragraph lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-21" lims:fid="1554619" lims:id="1554619"><Label>(a)</Label><Text>the request to Statistics Canada must</Text><Subparagraph lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-21" lims:fid="1554620" lims:id="1554620"><Label>(i)</Label><Text>be made in a form prescribed by the Chief Statistician of Canada,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-21" lims:fid="1554621" lims:id="1554621"><Label>(ii)</Label><Text>bear the signed consent of the person who is the subject of the request, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-21" lims:fid="1554622" lims:id="1554622"><Label>(iii)</Label><Text>include the specific information that is necessary for searching the census records; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-21" lims:fid="1554623" lims:id="1554623"><Label>(b)</Label><Text>any information supplied by Statistics Canada must be kept confidential and must not be used for a purpose other than determining the applicant’s age as required under the Act or the <XRefExternal reference-type="act" link="C-8">Canada Pension Plan</XRefExternal>, as the case may be.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2026-01-01" lims:enacted-date="2025-11-21" lims:fid="1554625" lims:id="1554625" level="2"><TitleText>Residence</TitleText></Heading><Section lims:inforce-start-date="2013-03-01" lims:lastAmendedDate="2013-03-01" lims:fid="500061" lims:id="500061"><Label>20</Label><Subsection lims:inforce-start-date="2013-03-01" lims:fid="500062" lims:id="500062"><Label>(1)</Label><Text>To enable the Minister to determine a person’s eligibility in respect of residence in Canada, the person or someone acting on the person’s behalf shall provide a statement giving full particulars of all periods of residence in Canada and of all absences from Canada that are relevant to that eligibility.</Text></Subsection><Subsection lims:inforce-start-date="2013-03-01" lims:fid="500063" lims:id="500063"><Label>(2)</Label><Text>Unless the Minister requires otherwise under the Act, a person is not required to provide a statement under subsection (1) in the circumstances set out in subsection 5(2) or (5), 11(3) or (4), 19(4.1) or 21(5) or (5.1) of the Act.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2013-03-01" lims:fid="500065" lims:id="500065">SOR/96-521, ss. 27, 29(F); SOR/2013-23, s. 5</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2016-11-01" lims:lastAmendedDate="2016-11-01" lims:fid="500066" lims:id="500066"><Label>21</Label><Subsection lims:inforce-start-date="2016-11-01" lims:fid="500067" lims:id="500067"><Label>(1)</Label><Text>For the purposes of the Act and these Regulations,</Text><Paragraph lims:inforce-start-date="2016-11-01" lims:fid="500068" lims:id="500068"><Label>(a)</Label><Text>a person resides in Canada if he makes his home and ordinarily lives in any part of Canada; and</Text></Paragraph><Paragraph lims:inforce-start-date="2016-11-01" lims:fid="500069" lims:id="500069"><Label>(b)</Label><Text>a person is present in Canada when he is physically present in any part of Canada.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2016-11-01" lims:fid="500070" lims:id="500070"><Label>(2)</Label><Text>A person who lives on a ship outside the territorial waters of Canada shall, while so living, be deemed not to be living in any part of Canada.</Text></Subsection><Subsection lims:inforce-start-date="2016-11-01" lims:fid="500071" lims:id="500071"><Label>(2.1)</Label><Text>Notwithstanding subsection (1), a person who is not a Canadian citizen or a permanent resident of Canada does not reside in Canada for the purposes of the Act and these Regulations during any period in which he is present in Canada</Text><Paragraph lims:inforce-start-date="2016-11-01" lims:fid="500072" lims:id="500072"><Label>(a)</Label><Text>for the purpose of carrying out his duties as a properly accredited diplomat, consular officer, representative or official of</Text><Subparagraph lims:inforce-start-date="2016-11-01" lims:fid="500073" lims:id="500073"><Label>(i)</Label><Text>a country other than Canada,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-11-01" lims:fid="500074" lims:id="500074"><Label>(ii)</Label><Text>the United Nations or any of its agencies, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-11-01" lims:fid="500075" lims:id="500075"><Label>(iii)</Label><Text>any intergovernmental organization in which Canada participates;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2016-11-01" lims:fid="500076" lims:id="500076"><Label>(b)</Label><Text>as a member of a military force present in Canada for training or for any other purpose in connection with the defence or security interests of Canada or under any treaty or agreement between Canada and another country;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-11-01" lims:fid="500077" lims:id="500077"><Label>(c)</Label><Text>as the spouse, common-law partner or dependant of a person referred to in paragraph (a) or (b) or the dependant of that person’s spouse or common-law partner; or</Text></Paragraph><Paragraph lims:inforce-start-date="2016-11-01" lims:fid="500078" lims:id="500078"><Label>(d)</Label><Text>as a member of the staff of or as a person otherwise accompanying a person referred to in paragraph (a), (b) or (c).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2016-11-01" lims:fid="500079" lims:id="500079"><Label>(3)</Label><Text>For the purposes of the Act and these Regulations, where a person becomes the spouse or common-law partner of a person residing in Canada while the person residing in Canada is absent from Canada in any of the circumstances specified in paragraph (5)(a) or (b), the period outside Canada of the spouse after their marriage or of the common-law partner after becoming such a partner is considered a period of residence and presence in Canada, if</Text><Paragraph lims:inforce-start-date="2016-11-01" lims:fid="500080" lims:id="500080"><Label>(a)</Label><Text>the spouse or common-law partner returns to Canada either before or within six months after the return of the person residing in Canada or within six months after that person’s death if that person dies while so absent from Canada; or</Text></Paragraph><Paragraph lims:inforce-start-date="2016-11-01" lims:fid="500081" lims:id="500081"><Label>(b)</Label><Text>the spouse or common-law partner attains, during that period outside Canada, an age at which the spouse or common-law partner is eligible to be paid a pension under the Act.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2016-11-01" lims:fid="500082" lims:id="500082"><Label>(4)</Label><Text>Any interval of absence from Canada of a person resident in Canada that is</Text><Paragraph lims:inforce-start-date="2016-11-01" lims:fid="500083" lims:id="500083"><Label>(a)</Label><Text>of a temporary nature and does not exceed one year,</Text></Paragraph><Paragraph lims:inforce-start-date="2016-11-01" lims:fid="500084" lims:id="500084"><Label>(b)</Label><Text>for the purpose of attending a school or university, or</Text></Paragraph><Paragraph lims:inforce-start-date="2016-11-01" lims:fid="500085" lims:id="500085"><Label>(c)</Label><Text>specified in subsection (5)</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2016-11-01" lims:fid="500086" lims:id="500086"><Text>shall be deemed not to have interrupted that person’s residence or presence in Canada.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2016-11-01" lims:fid="500087" lims:id="500087"><Label>(5)</Label><Text>The absences from Canada referred to in paragraph (4)(c) of a person residing in Canada are absences under the following circumstances:</Text><Paragraph lims:inforce-start-date="2016-11-01" lims:fid="500088" lims:id="500088"><Label>(a)</Label><Text>while that person was employed out of Canada</Text><Subparagraph lims:inforce-start-date="2016-11-01" lims:fid="500095" lims:id="500095"><Text>if during his employment out of Canada he</Text></ContinuedParagraph><Subparagraph lims:inforce-start-date="2016-11-01" lims:fid="500096" lims:id="500096"><Label>(vii)</Label><Text>had in Canada a permanent place of abode to which he intended to return, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-11-01" lims:fid="500097" lims:id="500097"><Label>(viii)</Label><Text>maintained in Canada a self-contained domestic establishment,</Text></Subparagraph><ContinuedParagraph lims:inforce-start-date="2016-11-01" lims:fid="500098" lims:id="500098"><Text>and he returned to Canada within six months after the end of his employment out of Canada or he attained, while employed out of Canada, an age at which he was eligible to be paid a pension under the Act;</Text></ContinuedParagraph></Paragraph><Paragraph lims:inforce-start-date="2016-11-01" lims:fid="500099" lims:id="500099"><Label>(b)</Label><Text>while that person was employed or engaged out of Canada</Text><Subparagraph lims:inforce-start-date="2016-11-01" lims:fid="500100" lims:id="500100"><Label>(i)</Label><Text>by the Government of Canada or of the government or a municipal corporation of any province,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-11-01" lims:fid="500101" lims:id="500101"><Label>(ii)</Label><Text>in the performance of services in another country under a development or assistance program that is sponsored or operated in that country by the Government of Canada or of a province or by a non-profit Canadian agency,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-11-01" lims:fid="500102" lims:id="500102"><Label>(iii)</Label><Text>as a member of the Canadian Forces, pursuant to and in connection with the requirements of his duties,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-11-01" lims:fid="500103" lims:id="500103"><Label>(iv)</Label><Text>in work for Canada connected with the prosecution of any war,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-11-01" lims:fid="500104" lims:id="500104"><Label>(v)</Label><Text>as a member of the armed forces of any ally of Canada during any war,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-11-01" lims:fid="500105" lims:id="500105"><Label>(vi)</Label><Text>as a missionary with any religious group or organization,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-11-01" lims:fid="500106" lims:id="500106"><Label>(vii)</Label><Text>as a worker in lumbering, harvesting, fishing or other seasonal employment,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-11-01" lims:fid="500107" lims:id="500107"><Label>(viii)</Label><Text>as a transport worker on trains, aircraft, ships or buses running between Canada and points outside Canada or other similar employment, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-11-01" lims:fid="500108" lims:id="500108"><Label>(ix)</Label><Text>as an employee, a member or an officer of an international charitable organization,</Text></Subparagraph><ContinuedParagraph lims:inforce-start-date="2016-11-01" lims:fid="500109" lims:id="500109"><Text>if he returned to Canada within six months of the end of his employment or engagement out of Canada or he attained, while employed or engaged out of Canada, an age at which he was eligible to be paid a pension under the Act;</Text></ContinuedParagraph></Paragraph><Paragraph lims:inforce-start-date="2016-11-01" lims:fid="500110" lims:id="500110"><Label>(c)</Label><Text>while that person was accompanying their spouse or common-law partner who was absent from Canada in any of the circumstances specified in paragraph (a) or (b) or for the purpose of attending school or university, if that person</Text><Subparagraph lims:inforce-start-date="2016-11-01" lims:fid="500111" lims:id="500111"><Label>(i)</Label><Text>returned to Canada either before or within six months after the return of their spouse or common-law partner or within six months after the death of their spouse or common-law partner, if their spouse or common-law partner died while so absent from Canada, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-11-01" lims:fid="500112" lims:id="500112"><Label>(ii)</Label><Text>while so absent from Canada, attained an age at which he was eligible to be paid a pension under the Act;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2016-11-01" lims:fid="500113" lims:id="500113"><Label>(d)</Label><Text>while that person was awaiting transportation to Canada during or immediately after World War II, if he</Text><Subparagraph lims:inforce-start-date="2016-11-01" lims:fid="500114" lims:id="500114"><Label>(i)</Label><Text>was unable to return to Canada owing to the dislocation of transportation facilities, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-11-01" lims:fid="500115" lims:id="500115"><Label>(ii)</Label><Text>returned to Canada when transportation became available;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2016-11-01" lims:fid="500116" lims:id="500116"><Label>(e)</Label><Text>while that person was accompanying his spouse who was resident in Canada and awaiting transportation to Canada during or immediately after World War II, if that person</Text><Subparagraph lims:inforce-start-date="2016-11-01" lims:fid="500117" lims:id="500117"><Label>(i)</Label><Text>was unable to return to Canada owing to the dislocation of transportation facilities, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-11-01" lims:fid="500118" lims:id="500118"><Label>(ii)</Label><Text>returned to Canada when transportation became available; or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2016-11-01" lims:fid="500119" lims:id="500119"><Label>(f)</Label><Text>while that person was a dependent person and was accompanying and residing outside Canada with the person on whom he was dependent, if the person on whom he was dependent resided in Canada and was absent from Canada in any of the circumstances specified in paragraph (a) or (b) and if the dependent person</Text><Subparagraph lims:inforce-start-date="2016-11-01" lims:fid="500120" lims:id="500120"><Label>(i)</Label><Text>returned to Canada before or within six months after the return of the person on whom he was dependent or within six months after that person’s death, if that person died while so absent from Canada, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-11-01" lims:fid="500121" lims:id="500121"><Label>(ii)</Label><Text>while so absent from Canada, attained an age at which he was eligible to be paid a pension under the Act.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2016-11-01" lims:fid="500122" lims:id="500122"><Label>(5.1)</Label><Text>Where, by virtue of an agreement entered into under subsection 40(1) of the Act, a person is subject to the Act while residing in a country other than Canada, the absence from Canada of that person, the person’s spouse or common-law partner and the dependants of the person or of the person’s spouse or common-law partner, if the spouse, common-law partner or dependants, as the case may be, reside with the person in that country, shall, for the purposes of an allowance, not be considered to have interrupted the residence or presence in Canada of the person, spouse, common-law partner or dependants.</Text></Subsection><Subsection lims:inforce-start-date="2016-11-01" lims:fid="500123" lims:id="500123"><Label>(5.2)</Label><Text>Where a person who is resident in Canada is subject to the legislation of a country other than Canada by virtue of an agreement entered into under subsection 40(1) of the Act, and the person’s spouse or common-law partner or the dependant of the person or of the person’s spouse or common-law partner engages in pensionable employment as defined in the <XRefExternal reference-type="act" link="C-8">Canada Pension Plan</XRefExternal> or in the plan of a province providing a comprehensive pension plan, any period in such pensionable employment shall, for the purposes of the Act and these Regulations, be considered to be a period of residence in Canada.</Text></Subsection><Subsection lims:inforce-start-date="2016-11-01" lims:fid="500124" lims:id="500124"><Label>(5.3)</Label><Text>Where, by virtue of an agreement entered into under subsection 40(1) of the Act, a person is subject to the legislation of a country other than Canada, that person shall, for the purposes of the Act and these Regulations, be deemed not to be resident in Canada.</Text></Subsection><Subsection lims:inforce-start-date="2016-11-01" lims:fid="500125" lims:id="500125"><Label>(6)</Label><Text>For the purposes of paragraph (5)(f), <DefinedTermEn>dependent person</DefinedTermEn> means, with respect to a person who was absent from Canada in any of the circumstances specified in paragraph (5)(a) or (b), that person’s father, mother, brother, sister, child or foster child or the father, mother, child or foster child of the person’s spouse or common-law partner.</Text></Subsection><Subsection lims:inforce-start-date="2016-11-01" lims:fid="500126" lims:id="500126"><Label>(7)</Label><Text><DefinedTermEn>Dependant</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2016-11-01" lims:fid="500127" lims:id="500127"><Label>(a)</Label><Text>with respect to a person who does not reside in Canada within the meaning of subsection (2.1),</Text></Paragraph><Paragraph lims:inforce-start-date="2016-11-01" lims:fid="500128" lims:id="500128"><Label>(b)</Label><Text>with respect to a person who is deemed to be resident in Canada within the meaning of subsection (5.1), or</Text></Paragraph><Paragraph lims:inforce-start-date="2016-11-01" lims:fid="500129" lims:id="500129"><Label>(c)</Label><Text>with respect to a person referred to in subsection (5.2) who, while resident in Canada is subject to the legislation of a country other than Canada,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2016-11-01" lims:fid="500130" lims:id="500130"><Text>that person’s father, mother, brother, sister, child or foster child or the father, mother, child or foster child of the person’s spouse or common-law partner.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2016-11-01" lims:fid="500131" lims:id="500131"><Label>(8)</Label><Text>For the purposes of section 4.1 of the Act as it relates to the requirement of subparagraph 3(1)(c)(iii) of the Act, the prescribed information is,</Text><Paragraph lims:inforce-start-date="2016-11-01" lims:fid="500132" lims:id="500132"><Label>(a)</Label><Text>in the case of a person who is in receipt of or has been approved for a retirement, disability or survivor’s pension under the <XRefExternal reference-type="act" link="C-8">Canada Pension Plan</XRefExternal> or a retirement, disability or surviving spouse’s pension under <XRefExternal reference-type="act">An Act respecting the Québec Pension Plan</XRefExternal>, CQLR, c. R-9, information indicating that the person, for at least 40 years, for all or part of each of those years,</Text><Subparagraph lims:inforce-start-date="2016-11-01" lims:fid="500133" lims:id="500133"><Label>(i)</Label><Text>had unadjusted pensionable earnings under the <XRefExternal reference-type="act" link="C-8">Canada Pension Plan</XRefExternal> that were above the person’s basic exemption for that year, or had unadjusted pensionable earnings under <XRefExternal reference-type="act">An Act respecting the Québec Pension Plan</XRefExternal> that were above the person’s personal exemption for that year,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-11-01" lims:fid="500134" lims:id="500134"><Label>(ii)</Label><Text>received a retirement pension or disability pension under either the <XRefExternal reference-type="act" link="C-8">Canada Pension Plan</XRefExternal> or <XRefExternal reference-type="act">An Act respecting the Québec Pension Plan</XRefExternal>, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-11-01" lims:fid="500135" lims:id="500135"><Label>(iii)</Label><Text>had time excluded from a contributory period under the <XRefExternal reference-type="act" link="C-8">Canada Pension Plan</XRefExternal> because the person was a family allowance recipient, or had time not included in a contributory period under <XRefExternal reference-type="act">An Act respecting the Québec Pension Plan</XRefExternal> because the person was a recipient of family benefits; or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2016-11-01" lims:fid="500136" lims:id="500136"><Label>(b)</Label><Text>in the case of a person who is not in receipt of and has not been approved for a retirement, disability or survivor’s pension under the <XRefExternal reference-type="act" link="C-8">Canada Pension Plan</XRefExternal> or a retirement, disability or surviving spouse’s pension under <XRefExternal reference-type="act">An Act respecting the Québec Pension Plan</XRefExternal>, CQLR, c. R-9, information indicating that the person,</Text><Subparagraph lims:inforce-start-date="2016-11-01" lims:fid="500137" lims:id="500137"><Label>(i)</Label><Text>for at least 40 years, for all or part of each of those years, met the requirements set out in subparagraph (a)(i), (ii) or (iii), and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-11-01" lims:fid="500138" lims:id="500138"><Label>(ii)</Label><Text>for the most recent calendar year for which the filing due date has passed and for at least 40 of the years referred to in subparagraph (i), other than for 1969, 1970 and 1971, filed an income tax return as a resident of Canada with the Minister of National Revenue.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2016-11-01" lims:fid="500139" lims:id="500139"><Label>(9)</Label><Text>For the purposes of subsection (8),</Text><Paragraph lims:inforce-start-date="2016-11-01" lims:fid="500140" lims:id="500140"><Label>(a)</Label><Text>in relation to the <XRefExternal reference-type="act" link="C-8">Canada Pension Plan</XRefExternal>, <DefinitionRef>basic exemption</DefinitionRef>, <DefinitionRef>contributory period</DefinitionRef> and <DefinitionRef>unadjusted pensionable earnings</DefinitionRef> have the same meaning as in subsection 2(1) of that Act and <DefinitionRef>family allowance recipient</DefinitionRef> has the same meaning as in subsection 42(1) of that Act; and</Text></Paragraph><Paragraph lims:inforce-start-date="2016-11-01" lims:fid="500141" lims:id="500141"><Label>(b)</Label><Text>in relation to <XRefExternal reference-type="act">An Act respecting the Québec Pension Plan</XRefExternal>, R.S.Q., c. R-9, <DefinitionRef>recipient of family benefits</DefinitionRef>, <DefinitionRef>personal exemption</DefinitionRef>, <DefinitionRef>unadjusted pensionable earnings</DefinitionRef> and <DefinitionRef>contributory period</DefinitionRef> have the same meaning as in paragraph 1(v) and sections 43, 98 and 101 of that Act respectively.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-11-01" lims:fid="500143" lims:id="500143">SOR/81-285, s. 5; SOR/83-84, ss. 2, 3; SOR/89-269, s. 6; SOR/96-521, s. 9; SOR/2000-412, s. 9; SOR/2013-23, s. 6; SOR/2016-274, s. 1</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2017-11-27" lims:fid="500144" lims:id="500144" level="2"><TitleText>Legal Residence</TitleText></Heading><Section lims:inforce-start-date="2016-11-01" lims:lastAmendedDate="2016-11-01" lims:fid="500145" lims:id="500145"><Label>22</Label><Subsection lims:inforce-start-date="2016-11-01" lims:fid="500146" lims:id="500146"><Label>(1)</Label><Text>For the purposes of subsections 4(1), 19(2) and 21(2) of the Act, <DefinitionRef>legal residence</DefinitionRef>, with respect to a person described in any of those subsections, means that, on the applicable day specified in paragraph (a) or (b) of those subsections, that person</Text><Paragraph lims:inforce-start-date="2016-11-01" lims:fid="500147" lims:id="500147"><Label>(a)</Label><Text>is or was lawfully in Canada pursuant to the immigration laws of Canada in force on that day;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-11-01" lims:fid="500148" lims:id="500148"><Label>(b)</Label><Text>is or was a resident of Canada and is or was absent from Canada, but</Text><Subparagraph lims:inforce-start-date="2016-11-01" lims:fid="500149" lims:id="500149"><Label>(i)</Label><Text>is deemed, pursuant to subsection 21(4) or (5) or under the terms of an agreement entered into under subsection 40(1) of the Act, not to have interrupted the person’s residence in Canada during that absence, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-11-01" lims:fid="500150" lims:id="500150"><Label>(ii)</Label><Text>was lawfully in Canada pursuant to the immigration laws of Canada immediately prior to the commencement of the absence; or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2016-11-01" lims:fid="500151" lims:id="500151"><Label>(c)</Label><Text>is not or was not resident of Canada but is deemed, pursuant to subsection 21(3) or under the terms of an agreement entered into under subsection 40(1) of the Act, to be or to have been resident in Canada.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2016-11-01" lims:fid="500152" lims:id="500152"><Label>(2)</Label><Text>For the purposes of section 4.1 of the Act as it relates to the requirement of paragraph 4(1)(a) of the Act, the prescribed information is both</Text><Paragraph lims:inforce-start-date="2016-11-01" lims:fid="500153" lims:id="500153"><Label>(a)</Label><Text>a current address in Canada; and</Text></Paragraph><Paragraph lims:inforce-start-date="2016-11-01" lims:fid="500154" lims:id="500154"><Label>(b)</Label><Text>the information that is referred to in</Text><Subparagraph lims:inforce-start-date="2016-11-01" lims:fid="500155" lims:id="500155"><Label>(i)</Label><Text>paragraph 21(8)(a), in the case of a person who is in receipt of or has been approved for a retirement, disability or survivor’s pension under the <XRefExternal reference-type="act" link="C-8">Canada Pension Plan</XRefExternal> or a retirement, disability or surviving spouse’s pension under <XRefExternal reference-type="act">An Act respecting the Québec Pension Plan</XRefExternal>, CQLR, c. and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="500169" lims:id="500169"><Label>(d)</Label><Text>the sentencing of the sponsor to a term of imprisonment of more than six months.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="500170" lims:id="500170"><Label>(2)</Label><Text>Subsection (1) applies to a sponsor</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="500171" lims:id="500171"><Label>(a)</Label><Text>whose undertaking in respect of a pensioner, the spouse or common-law partner of a pensioner, or a survivor, as the case may be, was in effect on or after March 7, 1996; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="500189" lims:id="500189"><Label>(b)</Label><Text>where the Minister is not satisfied that any person or agency is so authorized, to any person or agency that the Minister may appoint for such purpose and that has entered into an agreement with the Minister to administer and expend the benefit on behalf of that beneficiary in accordance with the terms of the agreement.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="500190" lims:id="500190"><Label>(2)</Label><Text>The Minister shall furnish to a person or agency appointed under subsection (1) to receive a benefit such directions regarding the administration and expenditure of the benefit as the Minister considers in the best interests of the beneficiary.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="500191" lims:id="500191"><Label>(3)</Label><Text>Any person or agency appointed under subsection (1) shall account for the benefit payments received and the disbursements made, the account to be in such form and to be made at such times as the Minister may require.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="500192" lims:id="500192"><Label>(4)</Label><Text>Where a benefit is paid to any person or agency to be administered and expended for and on behalf of a beneficiary, the notices required by section 25 shall be given by such person or agency.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="500193" lims:id="500193"><Label>(5)</Label><Text>A benefit payment may be made to the estate of a deceased beneficiary or, if there is no estate, to a person or agency designated by the Minister, where</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="500194" lims:id="500194"><Label>(a)</Label><Text>an amount is payable as a benefit to the deceased beneficiary; (<DefinedTermFr>taux d’escompte moyen</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-12" lims:fid="500310" lims:id="500310" generate-in-text="no"><Text><DefinedTermEn>bank rate</DefinedTermEn> means the rate of interest established weekly by the Bank of Canada as the minimum rate at which the Bank of Canada makes short-term advances to members of the Canadian Payments Association. (<DefinedTermFr>taux d’escompte</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-12" lims:fid="500311" lims:id="500311" generate-in-text="no"><Text><DefinedTermEn>debt</DefinedTermEn> means </Text><Paragraph lims:inforce-start-date="2013-12-12" lims:fid="500312" lims:id="500312"><Label>(a)</Label><Text>a debt due under subsection 37(2) of the Act in respect of which a penalty has been imposed under section 44.1 of the Act; or</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-12" lims:fid="500313" lims:id="500313"><Label>(b)</Label><Text>a debt due under subsection 37(2.02) of the Act. (<DefinedTermFr>créance</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2013-12-12" lims:fid="500314" lims:id="500314" generate-in-text="no"><Text><DefinedTermEn>demand for payment</DefinedTermEn> means a demand for payment in writing and includes a notification of a decision to impose a penalty under section 44.1 of the Act or of the amount of a penalty imposed under that section. (<DefinedTermFr>demande de paiement</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-12" lims:fid="500315" lims:id="500315" generate-in-text="no"><Text><DefinedTermEn>due date</DefinedTermEn> means, in respect of a debt,</Text><Paragraph lims:inforce-start-date="2013-12-12" lims:fid="500316" lims:id="500316"><Label>(a)</Label><Text>where a payment schedule has been established, any day on which a scheduled payment is to be made; or</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-12" lims:fid="500317" lims:id="500317"><Label>(b)</Label><Text>where no payment schedule has been established, the day that is 120 days after the day on which a demand for payment was issued. (<DefinedTermFr>date d’exigibilité</DefinedTermFr>)</Text></Paragraph></Definition></Subsection><Subsection lims:inforce-start-date="2013-12-12" lims:fid="500318" lims:id="500318"><Label>(2)</Label><Text>Interest is payable on all debts that are recoverable on or after the day on which this section comes into force.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-12" lims:fid="500319" lims:id="500319"><Label>(3)</Label><Text>The accrual of interest on a debt, at the rate set out in subsection (4), begins on the due date.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-12" lims:fid="500320" lims:id="500320"><Label>(4)</Label><Text>Interest accrues on a debt at a rate that is calculated daily and compounded monthly at the average bank rate plus three per cent.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-12" lims:fid="500321" lims:id="500321"><Label>(5)</Label><Text>Interest does not accrue on a debt during the period in which a reconsideration under subsection 27.1(2) of the Act, an appeal under subsection 28(1) of the Act or section 55 of the <XRefExternal reference-type="act" link="H-5.7">Department of Employment and Social Development Act</XRefExternal> or a judicial review under the <XRefExternal reference-type="act" link="F-7">Federal Courts Act</XRefExternal> is pending in respect of that debt.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-12" lims:fid="500322" lims:id="500322"><Label>(6)</Label><Text>The accrual of interest on a debt or on a portion of the debt, as applicable, ceases on</Text><Paragraph lims:inforce-start-date="2013-12-12" lims:fid="500323" lims:id="500323"><Label>(a)</Label><Text>the day before the day on which a scheduled payment in respect of the debt or a payment of the debt in full is received by Her Majesty;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-12" lims:fid="500324" lims:id="500324"><Label>(b)</Label><Text>the day on which the debt or the portion of the debt is remitted under subsection 37(4) of the Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-12" lims:fid="500325" lims:id="500325"><Label>(c)</Label><Text>the day on which the penalty that constitutes the debt is reduced or the decision imposing that penalty is rescinded under</Text><Subparagraph lims:inforce-start-date="2013-12-12" lims:fid="500326" lims:id="500326"><Label>(i)</Label><Text>subsection 44.1(4) of the Act, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-12-12" lims:fid="500327" lims:id="500327"><Label>(ii)</Label><Text>the latest of the following decisions in respect of a decision or determination of the Minister under section 44.1 of the Act:</Text><Clause lims:inforce-start-date="2013-12-12" lims:fid="500328" lims:id="500328"><Label>(A)</Label><Text>a decision of the Minister under subsection 27.1(2) of the Act, and</Text></Clause><Clause lims:inforce-start-date="2013-12-12" lims:fid="500329" lims:id="500329"><Label>(B)</Label><Text>a decision on an appeal under subsection 28(1) of the Act or section 55 of the <XRefExternal reference-type="act" link="H-5.7">Department of Employment and Social Development Act</XRefExternal> or a judicial review under the <XRefExternal reference-type="act" link="F-7">Federal Courts Act</XRefExternal>;</Text></Clause></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2013-12-12" lims:fid="500330" lims:id="500330"><Label>(d)</Label><Text>the day on which the accrued interest is remitted under subsection (7); or</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-12" lims:fid="500331" lims:id="500331"><Label>(e)</Label><Text>the day on which the debtor dies.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-12-12" lims:fid="500332" lims:id="500332"><Label>(7)</Label><Text>The conditions under which the Minister may remit in whole or in part the interest payable under this section are that</Text><Paragraph lims:inforce-start-date="2013-12-12" lims:fid="500333" lims:id="500333"><Label>(a)</Label><Text>the interest has ceased to accrue in accordance with paragraph (6)(c);</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-12" lims:fid="500334" lims:id="500334"><Label>(b)</Label><Text>the interest cannot be collected within the reasonably foreseeable future;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-12" lims:fid="500335" lims:id="500335"><Label>(c)</Label><Text>the administrative costs of collecting the interest would exceed the amount of that interest; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-12" lims:fid="500336" lims:id="500336"><Label>(d)</Label><Text>the payment of the interest would result in undue hardship to the
