(<DefinedTermFr>trottoir</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="494932" lims:id="494932" generate-in-text="no"><Text><DefinedTermEn>Superintendent</DefinedTermEn><Repealed>[Repealed, SOR/90-79, s. 1]</Repealed></Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="494933" lims:id="494933" generate-in-text="no"><Text><DefinedTermEn>trailer</DefinedTermEn> means a vehicle that is designed to be drawn along a highway by a motor vehicle but does not include</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="494934" lims:id="494934"><Label>(a)</Label><Text>an implement of farm husbandry,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="494935" lims:id="494935"><Label>(b)</Label><Text>a side car attached to a motorcycle,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="494936" lims:id="494936"><Label>(c)</Label><Text>a disabled motor vehicle that is towed by a tow car, or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="494937" lims:id="494937"><Label>(d)</Label><Text>a trailer unit that is borne and rides directly on the wheels of a truck tractor towing unit. SOR/92-546, s. 4; SOR/96-169, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="494966" lims:id="494966" level="1"><TitleText>Provincial Laws</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="494967" lims:id="494967"><Label>11</Label><Text>No person shall operate a motor vehicle on a highway unless</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="494968" lims:id="494968"><Label>(a)</Label><Text>the person holds all licences, permits and certificates required to operate the motor vehicle by the laws of the province in which the highway is situated;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="494969" lims:id="494969"><Label>(b)</Label><Text>the motor vehicle is registered and equipped in accordance with the laws of the province in which the highway is situated; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="494970" lims:id="494970"><Label>(c)</Label><Text>the person wears the equipment required to operate the motor vehicle by the laws of the province in which the highway is situated.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="494972" lims:id="494972">SOR/90-79, s. 6; SOR/92-546, s. 5(F)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="494973" lims:id="494973"><Label>12</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="494974" lims:id="494974"><Label>(1)</Label><Text>No person shall operate a motor vehicle on a highway otherwise than in accordance with the laws of the province in which the highway is situated.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="494975" lims:id="494975"><Label>(2)</Label><Text>Notwithstanding subsection (1), in the event of any inconsistency between these Regulations and the laws of a province in which a highway is situated, these Regulations prevail to the extent of the inconsistency.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="494976" lims:id="494976"><Label>(3)</Label><Text>No passenger of a motor vehicle shall ride in or on a motor vehicle on a highway otherwise than in accordance with the laws of the province in which the highway is situated.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="494978" lims:id="494978">SOR/90-79, s. 7</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="494979" lims:id="494979" level="1"><TitleText>Dimensions of Motor Vehicles</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="494980" lims:id="494980"><Label>13</Label><Text>Subject to sections 14 and 16, no person shall operate a bus, truck tractor trailer combination, truck, or a passenger vehicle and house-trailer combination on any highway within a park unless the unit conforms with the dimensions and gross weights approved for the unit by the province in which the highway is situated.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="494981" lims:id="494981"><Label>14</Label><Text>The superintendent may issue a single trip permit for the operation of a motor vehicle having any dimensions or carrying any load, and a person in possession of that permit may operate that motor vehicle for the single trip authorized by the permit along such portion of the highway and under such conditions as the permit specifies.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="494983" lims:id="494983">SOR/90-79, s. 25(F); SOR/91-375, s. 3(E)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="494984" lims:id="494984" level="1"><TitleText>Disposal of Waste</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="494985" lims:id="494985"><Label>15</Label><Text>No person shall discharge or dispose of liquid or solid waste matter from a trailer or motor vehicle on a highway.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="494987" lims:id="494987">SOR/90-79, s. 8</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="494988" lims:id="494988" level="1"><TitleText>Traffic Signs and Devices</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="494989" lims:id="494989"><Label>16</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="494990" lims:id="494990"><Label>(1)</Label><Text>The superintendent may mark and erect on or along a highway a traffic sign or device that</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="494991" lims:id="494991"><Label>(a)</Label><Text>prescribes rates of speed;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="494992" lims:id="494992"><Label>(b)</Label><Text>regulates or prohibits the tethering of horses or the stopping or parking of motor vehicles or any class thereof;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="494993" lims:id="494993"><Label>(c)</Label><Text>prescribes load limits and dimensions for motor vehicles or any class thereof or prohibits the use of the highway by a motor vehicle carrying loads in excess of prescribed load limits;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="494994" lims:id="494994"><Label>(d)</Label><Text>designates the highway as a one-way highway;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="494995" lims:id="494995"><Label>(e)</Label><Text>requires motor vehicles to stop;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="494996" lims:id="494996"><Label>(f)</Label><Text>closes the highway to all motor vehicles or any class thereof;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="494997" lims:id="494997"><Label>(g)</Label><Text>limits the hours during which the highway may be used;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="494998" lims:id="494998"><Label>(h)</Label><Text>regulates pedestrian traffic;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="494999" lims:id="494999"><Label>(i)</Label><Text>limits the use of the highway by horses or by a specific class or specific classes of motor vehicles;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495000" lims:id="495000"><Label>(j)</Label><Text>designates a taxi or cab stand; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495001" lims:id="495001"><Label>(k)</Label><Text>regulates, directs or controls in any other manner the use of the highway by horses, motor vehicles or pedestrians.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495002" lims:id="495002"><Label>(2)</Label><Text>No person other than the superintendent shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495003" lims:id="495003"><Label>(a)</Label><Text>mark or erect any traffic sign or device on or along a highway; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495004" lims:id="495004"><Label>(b)</Label><Text>remove or deface any traffic sign or device on or along a highway.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495005" lims:id="495005"><Label>(3)</Label><Text>Every person using a highway shall obey the instructions on every traffic sign or device.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495006" lims:id="495006"><Label>(4)</Label><Text>Subsection (3) does not apply to</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495007" lims:id="495007"><Label>(a)</Label><Text>a person driving or operating a motor vehicle for the park fire protection service when proceeding to a fire; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495028" lims:id="495028"><Label>(b)</Label><Text>produce for inspection by the park warden, police constable or peace officer any licence, permit, pass or certificate that is required by these Regulations or by the laws of the province in which the park is situated to operate the motor vehicle in the park.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="495030" lims:id="495030">SOR/90-79, s. 11; SOR/92-546, s. 6(F)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="495031" lims:id="495031" level="1"><TitleText>Parking</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="495032" lims:id="495032"><Label>23</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495033" lims:id="495033"><Label>(1)</Label><Text>The superintendent may erect a sign that designates an area as</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495034" lims:id="495034"><Label>(a)</Label><Text>an area where parking is reserved for persons holding parking permits;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495035" lims:id="495035"><Label>(b)</Label><Text>an area where parking is permitted for a period of time; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495036" lims:id="495036"><Label>(c)</Label><Text>an area where parking is not permitted.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495037" lims:id="495037"><Label>(2)</Label><Text>No person shall park a motor vehicle in an area designated pursuant to paragraph (1)(a) unless he</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495038" lims:id="495038"><Label>(a)</Label><Text>holds a parking permit authorizing him to park in the area;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495039" lims:id="495039"><Label>(b)</Label><Text>attaches to and exposes on the motor vehicle the label furnished with the parking permit; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495040" lims:id="495040"><Label>(c)</Label><Text>parks in accordance with the terms of his parking permit.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495041" lims:id="495041"><Label>(3)</Label><Text>No person shall park a motor vehicle in an area designated pursuant to paragraph (1)(b) for any greater period of time than that designated by the sign.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495042" lims:id="495042"><Label>(4)</Label><Text>No person shall park a motor vehicle in an area designated pursuant to paragraph (1)(c).</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495043" lims:id="495043"><Label>(5)</Label><Text>No person shall park a motor vehicle or a trailer on a highway for purposes of overnight accommodation except in areas or at locations designated for that purpose by the superintendent.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="495045" lims:id="495045">SOR/90-79, ss. 12, 25(F); SOR/91-375, s. 3(E)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="495051" lims:id="495051"><Label>25</Label><Text>Where an area in a park is designated by a sign as an area where parking is reserved for a category of persons, no person shall park in the area unless he is included in that category.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="495052" lims:id="495052"><Label>26</Label><Text>No person shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495053" lims:id="495053"><Label>(a)</Label><Text>abandon a motor vehicle in a park; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495054" lims:id="495054"><Label>(b)</Label><Text>park a motor vehicle in an area that is not designated by a sign pursuant to subsection 23(1) and that is not an area in which parking is prohibited, for a greater period of time than 48 hours, unless he</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="495055" lims:id="495055"><Label>(i)</Label><Text>has obtained the prior permission of the superintendent to park in such area for a greater period than 48 hours,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="495056" lims:id="495056"><Label>(ii)</Label><Text>is the owner, lessee or licensee of the property, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="495057" lims:id="495057"><Label>(iii)</Label><Text>is authorized by the owner, lessee or licensee of the property to park the motor vehicle for a greater period than 48 hours.</Text></Subparagraph></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="495059" lims:id="495059">SOR/90-79, s. 25(F); or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495066" lims:id="495066"><Label>(b)</Label><Text>interfere with a motor vehicle that is being loaded or unloaded.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495067" lims:id="495067"><Label>(2)</Label><Text>No person shall park a motor vehicle on a sidewalk unless he is permitted to do so by the superintendent.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495068" lims:id="495068"><Label>(3)</Label><Text>No person shall, without permission from the superintendent, stop or park a motor vehicle on a highway otherwise than in the direction of the vehicular traffic on the side of the highway on which he proposes to stop or park, and parallel with, and no further distant than 1 foot from, the curb or edge of the highway.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495069" lims:id="495069"><Label>(4)</Label><Text>Where the superintendent has permitted the stopping or parking of a motor vehicle on a highway in a manner other than the manner described in subsection (3), every person stopping or parking a motor vehicle on that highway, shall comply with any order of the superintendent regarding the manner of stopping or parking the motor vehicle.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495070" lims:id="495070"><Label>(5)</Label><Text>Where the superintendent has designated parking spaces on a highway, no person shall park a motor vehicle on that highway except</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495071" lims:id="495071"><Label>(a)</Label><Text>in one of those parking spaces; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495072" lims:id="495072"><Label>(b)</Label><Text>if the motor vehicle exceeds the length of one parking space, in not more than two of those parking spaces.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495073" lims:id="495073"><Label>(6)</Label><Text>No person shall park a motor vehicle on a sloping highway without having set the vehicle’s parking brakes and, by turning the wheels of the motor vehicle or by other suitable means, ensure that in case of brake failure the motor vehicle will not run down the slope.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="495075" lims:id="495075">SOR/90-79, s. 25(F); SOR/91-375, s. 3(E)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="495076" lims:id="495076"><Label>29</Label><Text>No person shall stop or park a motor vehicle in any public lane except while engaged in loading or unloading chattels to or from the motor vehicle.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="495077" lims:id="495077"><Label>30</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495078" lims:id="495078"><Label>(1)</Label><Text>No person shall park a trailer within a park in a location other than a location designated by a sign erected by the superintendent.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495079" lims:id="495079"><Label>(2)</Label><Text>No person shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495080" lims:id="495080"><Label>(a)</Label><Text>abandon a trailer in a park; SOR/2009-322, s. 10</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="495093" lims:id="495093" level="1"><TitleText>Careless Driving Prohibited</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="495094" lims:id="495094"><Label>33</Label><Text>No person shall drive or ride any motor vehicle, bicycle, horse or other animal upon any highway without due care and attention or without reasonable consideration for other persons using the highway.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="495095" lims:id="495095" level="1"><TitleText>Bicycles</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="495096" lims:id="495096"><Label>34</Label><Text>Every person riding a bicycle on a highway shall ride as close as possible to the right-hand edge or curb of the highway and, when riding with other persons, shall not ride more than two abreast.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="495097" lims:id="495097"><Label>35</Label><Text>No person shall ride a bicycle on a sidewalk in a park.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="495099" lims:id="495099">SOR/90-79, s. 15</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="495100" lims:id="495100"><Label>36</Label><Text>No person shall ride a bicycle in a park unless the bicycle is equipped in accordance with the laws of the province in which the park is situated.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="495102" lims:id="495102">SOR/90-79, s. 15</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="495103" lims:id="495103" level="1"><TitleText>Sidewalks and Boulevards</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="495104" lims:id="495104"><Label>37</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495105" lims:id="495105"><Label>(1)</Label><Text>Where an access driveway to a lot within a townsite or subdivision within a park is not provided or conveniently located, and a person desires to ride or drive a horse or motor vehicle from the highway to the lot, he shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495106" lims:id="495106"><Label>(a)</Label><Text>construct across the drain, gutter or water course skirting the place where he intends to enter the lot a good and sufficient bridge of planks or other material satisfactory to the superintendent; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495107" lims:id="495107"><Label>(b)</Label><Text>construct over the sidewalk or boulevard to be crossed and of the full width thereof a temporary crossing of planks or other material satisfactory to the superintendent sufficient to prevent injury to the sidewalk or boulevard.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495108" lims:id="495108"><Label>(2)</Label><Text>The temporary crossing described in subsection (1) shall be removed forthwith after it has served its purpose.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="495110" lims:id="495110">SOR/90-79, s. 25(F); SOR/91-375, s. 3(E)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="495111" lims:id="495111"><Label>38</Label><Text>Except as authorized by these Regulations, no person shall ride, drive, lead or back any horse or motor vehicle across or along any sidewalk or boulevard within a park.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="495112" lims:id="495112" level="1"><TitleText>Taxi or Cab Stands</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="495113" lims:id="495113"><Label>39</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495114" lims:id="495114"><Label>(1)</Label><Text>No chauffeur shall park a motor vehicle for hire at any place within a park other than a place designated by the superintendent as a taxi or cab stand.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495115" lims:id="495115"><Label>(2)</Label><Text>A person who operates a motor vehicle for hire shall not solicit passengers on any highway or sidewalk other than a highway or sidewalk at or adjacent to a taxi or cab stand or his place of business.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="495117" lims:id="495117">SOR/90-79, s. 25(F); SOR/91-375, s. 3(E)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="495118" lims:id="495118" level="1"><TitleText>Snow Tires and Chains</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="495119" lims:id="495119"><Label>40</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495120" lims:id="495120"><Label>(1)</Label><Text>No person shall drive a motor vehicle</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495121" lims:id="495121"><Label>(a)</Label><Text>on any highway in Mount Revelstoke National Park, Glacier National Park or Yoho National Park,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495122" lims:id="495122"><Label>(b)</Label><Text>on the Icefield Parkway in Banff National Park and Jasper National Park,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495123" lims:id="495123"><Label>(c)</Label><Text>on the Banff-Windermere Highway in Banff National Park and Kootenay National Park, or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495124" lims:id="495124"><Label>(d)</Label><Text>on any other highway in Banff National Park, Jasper National Park or Kootenay National Park that has been designated by the superintendent by means of a notice prominently posted or displayed on any such highway</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="495125" lims:id="495125"><Text>during the period between November 1 to March 31 or any other period during which the highway is covered with snow or ice unless adequate snow tires or tire chains have been installed on the motor vehicle.</Text></ContinuedSectionSubsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="495127" lims:id="495127">SOR/90-79, ss. 16, 25(F); and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495136" lims:id="495136"><Label>(d)</Label><Text>that person and any passenger on the over-snow vehicle are wearing the equipment required to operate the over-snow vehicle by the laws of the province in which the park is situated.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495137" lims:id="495137"><Label>(2)</Label><Text>No person shall operate an all-terrain vehicle in a park except for purposes of administration of the park and with the permission of the superintendent.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495138" lims:id="495138"><Label>(3)</Label><Text><Repealed>[Repealed, SOR/90-79, s. 18]</Repealed></Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="495140" lims:id="495140">SOR/90-79, ss. 18, 25(F); SOR/91-375, s. 3(E)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="495146" lims:id="495146"><Label>44</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495147" lims:id="495147"><Label>(1)</Label><Text>Subject to subsection (2), no person shall, without the permission of the superintendent, haul any dead animal, offal, nightsoil or other offensive matter or thing on a highway in a park during the hours of daylight.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495148" lims:id="495148"><Label>(2)</Label><Text>The owner of any animal that dies or has been killed on any highway shall forthwith cause the carcass to be removed therefrom and suitably disposed of.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="495150" lims:id="495150">SOR/90-79, s. 25(F); SOR/91-375, s. 3(E)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="495151" lims:id="495151"><Label>45</Label><Text>When the load of a passenger vehicle, truck or trailer consists of loose material or of material that is likely to slip, swing out, sway, shift, spill, leak, blow off, fall off or otherwise escape in any direction while being conveyed, the load shall be placed inside a container or shall be secured and bound so as to prevent such escape.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="495152" lims:id="495152"><Label>46</Label><Text>No person shall place on or over any highway or sidewalk any material or commodity of any description that might cause personal or property damage or in any way interfere with traffic on the highway or sidewalk.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="495153" lims:id="495153"><Label>47</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495154" lims:id="495154"><Label>(1)</Label><Text>No person shall draw or tow by motor vehicle on a highway a sled, toboggan, ski, bicycle or any other conveyance on which a person is riding.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495155" lims:id="495155"><Label>(2)</Label><Text>No person shall skate, roller skate, roller blade, roller ski or ride a skateboard on any highway or sidewalk in a town, visitor centre or resort subdivision.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495156" lims:id="495156"><Label>(3)</Label><Text>Every person who roller blades or roller skis on a highway outside a town, visitor centre or resort subdivision shall travel as close as possible to the left-hand edge or curb of the highway and, when roller blading or roller skiing with other persons, shall travel in single file.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="495158" lims:id="495158">SOR/90-79, s. 19</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="495159" lims:id="495159"><Label>48</Label><Text>In every prosecution of an owner of a motor vehicle in respect of the use or operation of the vehicle in violation of any provision of these Regulations, the onus of proving that the motor vehicle was not in his possession or control at the time of the violation is on the accused.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="495160" lims:id="495160"><Label>49</Label><Text>In any violation of these Regulations where the owner of a motor vehicle is identified through provincial motor vehicle registration records, the court may accept as evidence of ownership of the motor vehicle a written statement of ownership of that motor vehicle that is duly completed in accordance with the laws of the province in which the park is situated.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="495162" lims:id="495162">SOR/90-79, s. 20</HistoricalNoteSubItem></HistoricalNote></Section></Body><Schedule lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="495163" lims:id="495163" bilingual="no" spanlanguages="no"><ScheduleFormHeading lims:inforce-start-date="2006-03-22" lims:fid="495164" lims:id="495164"><Label>SCHEDULES I AND II</Label></ScheduleFormHeading><Repealed lims:inforce-start-date="2006-03-22" lims:fid="495165" lims:id="495165">[Repealed, SOR/96-169, s. 6]</Repealed></Schedule></Regulation>
