diversity;</Text></Provision><Provision lims:inforce-start-date="2015-06-23" lims:fid="151983" lims:id="151983" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas the Government of Canada is committed to adopting the precautionary principle in the conservation and management of the marine environment so that, where there are threats of environmental damage, lack of scientific certainty is not used as a reason for postponing preventive measures;</Text></Provision><Provision lims:inforce-start-date="2015-06-23" lims:fid="151984" lims:id="151984" format-ref="indent-0-0" language-align="no" list-item="no"><Text>And whereas Parliament wishes to affirm the need to</Text></Provision><Provision lims:inforce-start-date="2015-06-23" lims:fid="151985" lims:id="151985" format-ref="indent-0-0" language-align="no" list-item="no"><Text>establish a system of marine conservation areas that are representative of the Atlantic, Arctic and Pacific Oceans and the Great Lakes and are of sufficient extent and such configuration as to maintain healthy marine ecosystems,</Text></Provision><Provision lims:inforce-start-date="2015-06-23" lims:fid="151986" lims:id="151986" format-ref="indent-0-0" language-align="no" list-item="no"><Text>ensure that Canada contributes to international efforts for the establishment of a worldwide network of representative marine protected areas,</Text></Provision><Provision lims:inforce-start-date="2015-06-23" lims:fid="151987" lims:id="151987" format-ref="indent-0-0" language-align="no" list-item="no"><Text>consider implications for ecosystems in the planning and management of marine conservation areas so established,</Text></Provision><Provision lims:inforce-start-date="2015-06-23" lims:fid="151988" lims:id="151988" format-ref="indent-0-0" language-align="no" list-item="no"><Text>provide opportunities for the people of Canada and of the world to appreciate and enjoy Canada’s natural and cultural marine heritage,</Text></Provision><Provision lims:inforce-start-date="2015-06-23" lims:fid="151989" lims:id="151989" format-ref="indent-0-0" language-align="no" list-item="no"><Text>recognize that the marine environment is fundamental to the social, cultural and economic well-being of people living in coastal communities,</Text></Provision><Provision lims:inforce-start-date="2015-06-23" lims:fid="151990" lims:id="151990" format-ref="indent-0-0" language-align="no" list-item="no"><Text>provide opportunities, through the zoning of marine conservation areas, for the ecologically sustainable use of marine resources for the lasting benefit of coastal communities,</Text></Provision><Provision lims:inforce-start-date="2015-06-23" lims:fid="151991" lims:id="151991" format-ref="indent-0-0" language-align="no" list-item="no"><Text>promote an understanding of the marine environment and provide opportunities for research and monitoring,</Text></Provision><Provision lims:inforce-start-date="2015-06-23" lims:fid="151992" lims:id="151992" format-ref="indent-0-0" language-align="no" list-item="no"><Text>consider traditional ecological knowledge in the planning and management of marine conservation areas, and</Text></Provision><Provision lims:inforce-start-date="2015-06-23" lims:fid="151993" lims:id="151993" format-ref="indent-0-0" language-align="no" list-item="no"><Text>involve federal and provincial ministers and agencies, affected coastal communities, aboriginal organizations, aboriginal governments, bodies established under land claims agreements and other appropriate persons and bodies in the effort to establish and maintain the representative system of marine conservation areas;</Text></Provision></Preamble><Enacts lims:inforce-start-date="2015-06-23" lims:fid="151994" lims:id="151994"><Provision lims:inforce-start-date="2015-06-23" lims:fid="151995" lims:id="151995" format-ref="indent-0-0" language-align="no" list-item="no"><Text>NOW, THEREFORE, Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:</Text></Provision></Enacts></Introduction><Body lims:inforce-start-date="2015-06-23" lims:fid="151996" lims:id="151996"><Heading lims:inforce-start-date="2015-06-23" lims:fid="151997" lims:id="151997" level="1"><TitleText>Short Title</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="151998" lims:id="151998"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="151999" lims:id="151999">Short title</MarginalNote><Label>1</Label><Text>This Act may be cited as the <XRefExternal reference-type="act" link="C-7.3">Canada National Marine Conservation Areas Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2015-06-23" lims:fid="152000" lims:id="152000" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2005-02-24" lims:lastAmendedDate="2024-11-27" lims:fid="152001" lims:id="152001"><MarginalNote lims:inforce-start-date="2005-02-24" lims:fid="152002" lims:id="152002">Definitions</MarginalNote><Label>2</Label><Subsection lims:inforce-start-date="2005-02-24" lims:fid="152003" lims:id="152003"><Label>(1)</Label><Text>The definitions in this subsection apply in this Act.</Text><Definition lims:inforce-start-date="2005-02-24" lims:fid="152004" lims:id="152004"><Text><DefinedTermEn>disposal</DefinedTermEn> has the same meaning as in section 122 of the <XRefExternal reference-type="act" link="C-15.31">Canadian Environmental Protection Act, 1999</XRefExternal>, read without reference to the sea. (<DefinedTermFr>immersion</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2005-02-24" lims:fid="152005" lims:id="152005"><Text><DefinedTermEn>ecosystem</DefinedTermEn> means a dynamic complex of animal, plant and microorganism communities and their non-living environment interacting as a functional unit. (<DefinedTermFr>écosystème</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2005-02-24" lims:fid="152006" lims:id="152006"><Text><DefinedTermEn>enforcement officer</DefinedTermEn> means a person designated under section 19 or belonging to a class of persons so designated. (<DefinedTermFr>agent de l’autorité</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2005-02-24" lims:fid="152007" lims:id="152007"><Text><DefinedTermEn>fishing</DefinedTermEn> has the meaning given to that expression in the <XRefExternal reference-type="act" link="F-14">Fisheries Act</XRefExternal>. (<DefinedTermFr>pêche</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2005-02-24" lims:fid="152008" lims:id="152008"><Text><DefinedTermEn>marine conservation area</DefinedTermEn> means a national marine conservation area of Canada named and described in Schedule 1. (<DefinedTermFr>aire marine de conservation</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2005-02-24" lims:fid="152009" lims:id="152009"><Text><DefinedTermEn>marine conservation area warden</DefinedTermEn> means a person designated under section 18. (<DefinedTermFr>garde d’aire marine de conservation</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2005-02-24" lims:fid="152010" lims:id="152010"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister responsible for the Parks Canada Agency. (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2005-02-24" lims:fid="152011" lims:id="152011"><Text><DefinedTermEn>public lands</DefinedTermEn> means lands, including submerged lands, that belong to Her Majesty in right of Canada or that the Government of Canada has the power to dispose of, whether or not subject to the terms of any agreement between the Government of Canada and the government of a province. (<DefinedTermFr>terres domaniales</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2005-02-24" lims:fid="152012" lims:id="152012"><Text><DefinedTermEn>reserve</DefinedTermEn> means a national marine conservation area reserve of Canada named and described in Schedule 2. (<DefinedTermFr>réserve</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2005-02-24" lims:fid="152013" lims:id="152013"><Text><DefinedTermEn>superintendent</DefinedTermEn> means a person appointed under the <XRefExternal reference-type="act" link="P-0.4">Parks Canada Agency Act</XRefExternal> who holds the office of superintendent of a marine conservation area, and includes any other person appointed under that Act who is authorized by that person to act on that person’s behalf. (<DefinedTermFr>directeur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2005-02-24" lims:fid="152014" lims:id="152014"><Text><DefinedTermEn>waste or other matter</DefinedTermEn> means waste or other matter listed in Schedule 5 to the <XRefExternal reference-type="act" link="C-15.31">Canadian Environmental Protection Act, 1999</XRefExternal>. (<DefinedTermFr>déchets ou autres matières</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2024-11-27" lims:enacted-date="2024-11-27" lims:fid="152015" lims:id="1497743"><Label>(2)</Label><Text><Repealed>[Repealed, 2024, c. 30, s. 23]</Repealed></Text></Subsection><Subsection lims:inforce-start-date="2005-02-24" lims:fid="152017" lims:id="152017"><MarginalNote lims:inforce-start-date="2005-02-24" lims:fid="152018" lims:id="152018">Exclusive economic zone</MarginalNote><Label>(3)</Label><Text>The establishment of a marine conservation area within the exclusive economic zone of Canada does not constitute a claim to any rights, jurisdiction or duties beyond those set out in section 14 of the <XRefExternal reference-type="act" link="O-2.4">Oceans Act</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2005-02-24" lims:fid="152019" lims:id="152019"><MarginalNote lims:inforce-start-date="2005-02-24" lims:fid="152020" lims:id="152020">Application of Act to reserves</MarginalNote><Label>(4)</Label><Text>This Act applies to a reserve as if it were a marine 23</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2015-06-23" lims:fid="152023" lims:id="152023" level="1"><TitleText>Her Majesty</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="152024" lims:id="152024"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152025" lims:id="152025">Binding on Her Majesty</MarginalNote><Label>3</Label><Text>This Act is binding on Her Majesty in right of Canada or of a province.</Text></Section><Heading lims:inforce-start-date="2015-06-23" lims:fid="152026" lims:id="152026" level="1"><TitleText>Marine Conservation Areas</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="152027" lims:id="152027"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152028" lims:id="152028">Purpose</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="152029" lims:id="152029"><Label>(1)</Label><Text>Marine conservation areas are established in accordance with this Act for the purpose of protecting and conserving representative marine areas for the benefit, education and enjoyment of the people of Canada and the world.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="152030" lims:id="152030"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152031" lims:id="152031">Purpose of reserves</MarginalNote><Label>(2)</Label><Text>Reserves are established in accordance with this Act for the purpose referred to in subsection (1) where an area or a portion of an area proposed for a marine conservation area is subject to a claim in respect of aboriginal rights that has been accepted for negotiation by the Government of Canada.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="152032" lims:id="152032"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152033" lims:id="152033">Management and use</MarginalNote><Label>(3)</Label><Text>Marine conservation areas shall be managed and used in a sustainable manner that meets the needs of present and future generations without compromising the structure and function of the ecosystems, including the submerged lands and water column, with which they are associated.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="152034" lims:id="152034"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152035" lims:id="152035">Zones</MarginalNote><Label>(4)</Label><Text>Each marine conservation area shall be divided into zones, which must include at least one zone that fosters and encourages ecologically sustainable use of marine resources and at least one zone that fully protects special features or sensitive elements of ecosystems, and may include other types of zones.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="152036" lims:id="152036"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152037" lims:id="152037">Establishment or enlargement</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="152038" lims:id="152038"><Label>(1)</Label><Text>Subject to section 7, for the purpose of establishing or enlarging a marine conservation area, consisting of submerged lands and waters within the internal waters, territorial sea or exclusive economic zone of Canada and any coastal lands or islands within Canada, the Governor in Council may, by order, amend Schedule 1 by adding the name and a description of the area or by altering the description of the area.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="152039" lims:id="152039"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152040" lims:id="152040">Title to lands</MarginalNote><Label>(2)</Label><Text>An amendment to Schedule 1 under this section or subsection 6(2) may be made only if</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="152041" lims:id="152041"><Label>(a)</Label><Text>the Governor in Council is satisfied that Her Majesty in right of Canada has clear title to or an unencumbered right of ownership in the lands to be included in the marine conservation area, other than such lands situated within the exclusive economic zone of Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="152042" lims:id="152042"><Label>(b)</Label><Text>in a case where Her Majesty in right of a province had the administration and control of any of the lands to be included in the marine conservation area, the government of the province agreed to the use of those lands as a marine conservation area and transferred their administration and control to Her Majesty in right of Canada for that purpose; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="152043" lims:id="152043"><Label>(c)</Label><Text>the requirements of any applicable land claim agreement respecting the establishment of the marine conservation area have been fulfilled.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="152044" lims:id="152044"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152045" lims:id="152045">Judicial finding as to title</MarginalNote><Label>(3)</Label><Text>If a court of competent jurisdiction finds that Her Majesty in right of Canada does not have clear title to or an unencumbered right of ownership in lands within a marine conservation area, the Governor in Council may, by order, amend Schedule 1 by removing the name and description of the area or by altering the description of the area.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="152046" lims:id="152046"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152047" lims:id="152047">No reduction of area</MarginalNote><Label>(4)</Label><Text>Except as provided by subsection (3), no amendment may be made by the Governor in Council to Schedule 1 for the purpose of removing any portion of a marine conservation area.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="152048" lims:id="152048"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152049" lims:id="152049">Establishment or enlargement of reserves</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="152050" lims:id="152050"><Label>(1)</Label><Text>Subject to section 7, for the purpose of establishing or enlarging a reserve, consisting of submerged lands and waters within the internal waters or territorial sea of Canada and any coastal lands or islands within Canada, the Governor in Council may, by order, amend Schedule 2 by adding the name and a description of the reserve or by altering the description of the reserve.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="152051" lims:id="152051"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152052" lims:id="152052">Reserve becoming marine conservation area</MarginalNote><Label>(2)</Label><Text>Where a claim described in subsection 4(2) is settled, the Governor in Council may, by order,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="152053" lims:id="152053"><Label>(a)</Label><Text>amend Schedule 2 by removing the name and description of the reserve or by altering the description of the reserve; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="152054" lims:id="152054"><Label>(b)</Label><Text>if the settlement provides that the reserve or part of it is to become a marine conservation area or part of one, amend Schedule 1 by adding the name and a description of the area or by altering the description of the area.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="152055" lims:id="152055"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152056" lims:id="152056">Judicial finding as to title</MarginalNote><Label>(3)</Label><Text>If a court of competent jurisdiction finds that Her Majesty in right of Canada does not have clear title to or an unencumbered right of ownership in lands within a reserve, the Governor in Council may, by order, amend Schedule 2 by removing the name and description of the reserve or by altering the description of the reserve.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="152057" lims:id="152057"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152058" lims:id="152058">No reduction of area</MarginalNote><Label>(4)</Label><Text>Except as provided by subsections (2) and (3), no amendment may be made by the Governor in Council to Schedule 2 for the purpose of removing any portion of a reserve.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="152059" lims:id="152059"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152060" lims:id="152060">Amendment to be tabled in Parliament</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="152061" lims:id="152061"><Label>(1)</Label><Text>Before an amendment is made to Schedule 1 or 2 for a purpose referred to in subsection 5(1) or 6(1), respectively, the proposed amendment shall be laid before each House of Parliament together with a report on the proposed marine conservation area or reserve, which report shall include</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="152062" lims:id="152062"><Label>(a)</Label><Text>information on consultations undertaken, including a list of the names of organizations and persons consulted, the dates of the consultation and a summary of their comments,</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="152063" lims:id="152063"><Label>(b)</Label><Text>any agreements reached respecting the establishment of the area or reserve,</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="152064" lims:id="152064"><Label>(c)</Label><Text>the results of any assessments of mineral and energy resources undertaken, and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="152065" lims:id="152065"><Label>(d)</Label><Text>an interim management plan that sets out management objectives and a zoning plan,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="152066" lims:id="152066"><Text>and an amendment so laid stands referred to the standing committee of each House that normally considers matters relating to marine conservation areas or to such other committee as that House may designate for the purposes of this section.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="152067" lims:id="152067"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152068" lims:id="152068">Disapproval by committee</MarginalNote><Label>(2)</Label><Text>The committee of each House may, within 30 sitting days after the amendment is tabled, report to the House that it disapproves the amendment, in which case a motion to concur in the report shall be put to the House in accordance with its procedures.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="152069" lims:id="152069"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152070" lims:id="152070">Amendment allowed</MarginalNote><Label>(3)</Label><Text>A proposed amendment to Schedule 1 or 2 may be made if 31 sitting days have elapsed after the tabling of the amendment in both Houses and no motion referred to in subsection (2) has been proposed in either House.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="152071" lims:id="152071"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152072" lims:id="152072">Amendment not allowed</MarginalNote><Label>(4)</Label><Text>A proposed amendment to Schedule 1 or 2 may not be made if either House passes a motion referred to in subsection (2).</Text></Subsection></Section><Heading lims:inforce-start-date="2015-06-23" lims:fid="152073" lims:id="152073" level="1"><TitleText>Marine lims:id="152076"><Label>(1)</Label><Text>The following definitions apply in this section.</Text><Definition lims:inforce-start-date="2015-06-23" lims:fid="152077" lims:id="152077"><Text><DefinedTermEn><XRefExternal reference-type="act">Ontario Water Resources Act</XRefExternal></DefinedTermEn> means the <XRefExternal reference-type="act">Ontario Water Resources Act</XRefExternal>, R.S.O. 1990, c. O.40, as amended from time to time. (<DefinedTermFr><XRefExternal reference-type="act">Loi sur les ressources en eau de l’Ontario</XRefExternal></DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-06-23" lims:fid="152078" lims:id="152078"><Text><DefinedTermEn>water taking</DefinedTermEn> means the taking of water within the meaning of the <XRefExternal reference-type="act">Ontario Water Resources Act</XRefExternal> or any regulations made under it, as those regulations are amended from time to time, however the reference to the taking of water is expressed grammatically in that Act or those regulations. (<DefinedTermFr>prélèvement d’eau</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-06-23" lims:fid="152079" lims:id="152079"><Text><DefinedTermEn>water transfer</DefinedTermEn> means the transfer of water within the meaning of the <XRefExternal reference-type="act">Ontario Water Resources Act</XRefExternal> or any regulations made under it, as those regulations are amended from time to time, however the reference to the transfer of water is expressed grammatically in that Act or those regulations. (<DefinedTermFr>transfert d’eau</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2015-06-23" lims:fid="152080" lims:id="152080"><MarginalNote lims:inforce-start-date="2015-06-23" lims:fid="152081" lims:id="152081">Marine conservation areas in Ontario</MarginalNote><Label>(2)</Label><Text>The provisions concerning water taking and water transfer of the laws of Ontario, as those provisions are amended from time to time, apply within a marine conservation area in Ontario.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-23" lims:fid="152082" lims:id="152082"><MarginalNote lims:inforce-start-date="2015-06-23" lims:fid="152083" lims:id="152083">Laws of Ontario</MarginalNote><Label>(3)</Label><Text>For greater certainty, the laws of Ontario whose provisions concerning water taking and water transfer apply within a marine conservation area in Ontario include the <XRefExternal reference-type="act">Ontario Water Resources Act</XRefExternal>, the <XRefExternal reference-type="act">Environmental Bill of Rights, 1993</XRefExternal>, S.O. 1993, c. 28, as amended from time to time, and any regulations made under either of them, as those regulations are amended from time to time.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-23" lims:fid="152084" lims:id="152084"><MarginalNote lims:inforce-start-date="2015-06-23" lims:fid="152085" lims:id="152085">Application</MarginalNote><Label>(4)</Label><Text>The provisions of the laws of Ontario that relate to the following matters, as those provisions are amended from time to time, apply within a marine conservation area in Ontario with regard to water taking and water transfer:</Text><Paragraph lims:inforce-start-date="2015-06-23" lims:fid="152086" lims:id="152086"><Label>(a)</Label><Text>the administration and enforcement of the laws referred to in subsections (2) and (3);</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-23" lims:fid="152087" lims:id="152087"><Label>(b)</Label><Text>orders by provincial officers, as defined in the <XRefExternal reference-type="act">Ontario Water Resources Act</XRefExternal>, and the review of those orders;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-23" lims:fid="152088" lims:id="152088"><Label>(c)</Label><Text>orders by Directors, as defined in the <XRefExternal reference-type="act">Ontario Water Resources Act</XRefExternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-23" lims:fid="152089" lims:id="152089"><Label>(d)</Label><Text>hearings held by the Environmental Review Tribunal, within the meaning assigned by the definition <DefinedTermEn>Tribunal</DefinedTermEn>” in the <XRefExternal reference-type="act">Ontario Water Resources Act</XRefExternal>, and appeals from its decisions.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-06-23" lims:fid="152090" lims:id="152090"><MarginalNote lims:inforce-start-date="2015-06-23" lims:fid="152091" lims:id="152091">Sections 18 and 19</MarginalNote><Label>(5)</Label><Text>Despite sections 18 and 19, the duties of marine conservation area wardens and enforcement officers do not include the administration or enforcement of the provisions of the laws of Ontario referred to in subsections (2) to (4).</Text></Subsection><Subsection lims:inforce-start-date="2015-06-23" lims:fid="152092" lims:id="152092"><MarginalNote lims:inforce-start-date="2015-06-23" lims:fid="152093" lims:id="152093">Administration and enforcement</MarginalNote><Label>(6)</Label><Text>Persons who are authorized under the laws of Ontario to administer and enforce the provisions of the laws of Ontario referred to in subsections (2) to (4) outside a marine conservation area in Ontario are authorized to administer and enforce those provisions within a marine conservation area in Ontario.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-23" lims:fid="152094" lims:id="152094"><MarginalNote lims:inforce-start-date="2015-06-23" lims:fid="152095" lims:id="152095">Ontario <XRefExternal reference-type="act">Provincial Offences Act</XRefExternal></MarginalNote><Label>(7)</Label><Text>The <XRefExternal reference-type="act">Provincial Offences Act</XRefExternal>, R.S.O. 1990, c. P.33, as amended from time to time, applies to contraventions of the provisions of the laws of Ontario referred to in subsections (2) to (4).</Text></Subsection><Subsection lims:inforce-start-date="2015-06-23" lims:fid="152096" lims:id="152096"><MarginalNote lims:inforce-start-date="2015-06-23" lims:fid="152097" lims:id="152097"><XRefExternal reference-type="act" link="S-22">Statutory Instruments Act</XRefExternal></MarginalNote><Label>(8)</Label><Text>The <XRefExternal reference-type="act" link="S-22">Statutory Instruments Act</XRefExternal> does not apply to any instrument that is made or issued under any of the provisions of the laws of Ontario referred to in subsections (2) to (4).</Text></Subsection><Subsection lims:inforce-start-date="2015-06-23" lims:fid="152098" lims:id="152098"><MarginalNote lims:inforce-start-date="2015-06-23" lims:fid="152099" lims:id="152099">Permits and authorizations</MarginalNote><Label>(9)</Label><Text>The superintendent of a marine conservation area in Ontario shall not issue a permit or other authorizing instrument relating to water taking or water transfer within the marine conservation area, or amend a permit or other authorizing instrument so as to allow water taking or water transfer within the area.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-23" lims:fid="152100" lims:id="152100"><MarginalNote lims:inforce-start-date="2015-06-23" lims:fid="152101" lims:id="152101">Section 12</MarginalNote><Label>(10)</Label><Text>Section 12 does not apply in respect of any activity that is carried out in conformity with a permit or other authorizing instrument relating to water taking or water transfer within a marine conservation area in Ontario that is made or issued under any of the laws of Ontario referred to in subsections (2) to (4).</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-06-23" lims:fid="152103" lims:id="152103">2015, c. 38, s. 2</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2015-06-23" lims:fid="152104" lims:id="152104" level="1"><TitleText>Administration</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="152105" lims:id="152105"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152106" lims:id="152106">Management by Minister</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="152107" lims:id="152107"><Label>(1)</Label><Text>The Minister is responsible for the administration, management and control of marine conservation areas in relation to matters not assigned by law to any other Minister of the Crown.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="152108" lims:id="152108"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152109" lims:id="152109">Administration of lands</MarginalNote><Label>(2)</Label><Text>The Minister has the administration of public lands in marine conservation areas.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="152110" lims:id="152110"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152111" lims:id="152111">Facilities and research</MarginalNote><Label>(3)</Label><Text>The Minister may maintain and operate facilities and carry out operations and activities to achieve the purposes of this Act, and may conduct scientific research and monitoring and carry out studies based on traditional ecological knowledge, including traditional aboriginal ecological knowledge, in relation to marine conservation areas.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="152112" lims:id="152112"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152113" lims:id="152113">Agreements</MarginalNote><Label>(4)</Label><Text>The Minister may enter into agreements with other federal and provincial ministers and agencies, local and aboriginal governments, bodies established under land claims agreements and other persons and organizations for carrying out the purposes of this Act.</Text></Subsection></Section><Section lims:inforce-start-date="2012-06-29" lims:lastAmendedDate="2012-06-29" lims:fid="152114" lims:id="152114"><MarginalNote lims:inforce-start-date="2012-06-29" lims:fid="152115" lims:id="152115">Management plans</MarginalNote><Label>9</Label><Subsection lims:inforce-start-date="2012-06-29" lims:fid="152116" lims:id="152116"><Label>(1)</Label><Text>The Minister shall, within five years after a marine conservation area is established, in consultation with relevant federal and provincial ministers and agencies, with affected coastal communities, aboriginal organizations, aboriginal governments and bodies established under land claims agreements, and with other persons and bodies that the Minister considers appropriate, prepare a management plan for the marine conservation area that includes a long-term ecological vision for the marine conservation area and provision for ecosystem protection, human use, zoning, public awareness and performance evaluation, which shall be tabled in each House of Parliament.</Text></Subsection><Subsection lims:inforce-start-date="2012-06-29" lims:fid="152117" lims:id="152117"><MarginalNote lims:inforce-start-date="2012-06-29" lims:fid="152118" lims:id="152118">Review of management plans by Minister</MarginalNote><Label>(2)</Label><Text>The Minister shall review the management plan for each marine conservation area at least every 10 years and shall cause any amendments to the plan to be tabled in each House of Parliament.</Text></Subsection><Subsection lims:inforce-start-date="2012-06-29" lims:fid="152119" lims:id="152119"><MarginalNote lims:inforce-start-date="2012-06-29" lims:fid="152120" lims:id="152120">Primary considerations</MarginalNote><Label>(3)</Label><Text>In order to protect marine ecosystems and maintain marine biodiversity, the primary considerations in the development and modification of management plans and interim management plans shall be principles of ecosystem management and the precautionary principle.</Text></Subsection><Subsection lims:inforce-start-date="2012-06-29" lims:fid="152121" lims:id="152121"><MarginalNote lims:inforce-start-date="2012-06-29" lims:fid="152122" lims:id="152122">Minister of Fisheries and Oceans</MarginalNote><Label>(4)</Label><Text>Provisions of a management plan or an interim management plan respecting fishing, aquaculture and fisheries management are subject to an agreement between the Minister and the Minister of Fisheries and Oceans.</Text></Subsection><Subsection lims:inforce-start-date="2012-06-29" lims:fid="152123" lims:id="152123"><MarginalNote lims:inforce-start-date="2012-06-29" lims:fid="152124" lims:id="152124">Minister of Transport and Minister of Fisheries and Oceans</MarginalNote><Label>(4.1)</Label><Text>Provisions of a management plan or an interim management plan respecting marine navigation and marine safety are subject to an agreement between the Minister, the Minister of Transport and the Minister of Fisheries and Oceans.</Text></Subsection><Subsection lims:inforce-start-date="2012-06-29" lims:fid="152125" lims:id="152125"><MarginalNote lims:inforce-start-date="2012-06-29" lims:fid="152126" lims:id="152126">Land claims agreements</MarginalNote><Label>(5)</Label><Text>If a marine conservation area includes an area that is the subject of a land claims agreement, the management plan or interim management plan for the marine conservation area and any amendments to it shall be prepared in a manner consistent with any applicable provisions of the agreement.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2012-06-29" lims:fid="152128" lims:id="152128">2002, c. 18, s. 9; 2005, c. 29, s. 34; 2012, c. 19, s. 325</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="152129" lims:id="152129"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152130" lims:id="152130">Consultation</MarginalNote><Label>10</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="152131" lims:id="152131"><Label>(1)</Label><Text>The Minister shall consult with relevant federal and provincial ministers and agencies, with affected coastal communities, aboriginal organizations, aboriginal governments and bodies established under land claims agreements, and with other persons and bodies that the Minister considers appropriate in the development of marine conservation area policy and regulations, the establishment of any proposed marine conservation area and the modification of any marine conservation area, and any other matters that the Minister considers appropriate.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="152132" lims:id="152132"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152133" lims:id="152133">Progress reports</MarginalNote><Label>(2)</Label><Text>At least every two years, the Minister shall cause to be tabled in each House of Parliament a report on the state of marine conservation areas and on progress towards completion of a representative system of marine conservation areas.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="152134" lims:id="152134"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152135" lims:id="152135">Area advisory committees</MarginalNote><Label>11</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="152136" lims:id="152136"><Label>(1)</Label><Text>The Minister shall, for each marine conservation area, establish a management advisory committee to advise the Minister on the formulation, review and implementation of the management plan for the area.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="152137" lims:id="152137"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152138" lims:id="152138">Other advisory committees</MarginalNote><Label>(2)</Label><Text>The Minister may establish other advisory committees to review and evaluate any aspect of marine conservation area policy or administration.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="152139" lims:id="152139"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152140" lims:id="152140">Composition</MarginalNote><Label>(3)</Label><Text>The Minister shall consult with relevant federal and provincial ministers and agencies, with affected coastal communities, aboriginal organizations, aboriginal governments and bodies established under land claims agreements, and with other persons and bodies that the Minister considers appropriate with respect to the composition of advisory committees.</Text></Subsection></Section><Heading lims:inforce-start-date="2015-06-23" lims:fid="152141" lims:id="152141" level="1"><TitleText>Prohibitions</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="152142" lims:id="152142"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152143" lims:id="152143">No disposition or use without authority</MarginalNote><Label>12</Label><Text>Except as permitted by this Act or the regulations,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="152144" lims:id="152144"><Label>(a)</Label><Text>no interest in public lands in a marine conservation area may be disposed of; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="152145" lims:id="152145"><Label>(b)</Label><Text>no person shall use or occupy public lands in a marine conservation area.</Text></Paragraph></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="152146" lims:id="152146"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152147" lims:id="152147">Exploration and exploitation</MarginalNote><Label>13</Label><Text>No person shall explore for or exploit hydrocarbons, minerals, aggregates or any other inorganic matter within a marine conservation area.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="152148" lims:id="152148"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152149" lims:id="152149">Disposal of substances</MarginalNote><Label>14</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="152150" lims:id="152150"><Label>(1)</Label><Text>No person shall dispose of any substance in waters within a marine conservation area except as authorized by a permit issued by a superintendent pursuant to this Act or, in the case of waters to which subsection 125(1) of the <XRefExternal reference-type="act" link="C-15.31">Canadian Environmental Protection Act, 1999</XRefExternal> applies, authorized by section 130 of that Act or by a permit issued by the Minister of the Environment pursuant to section 127 or 128 of that Act.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="152151" lims:id="152151"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152152" lims:id="152152">Permits under <Emphasis style="italic">CEPA, 1999</Emphasis></MarginalNote><Label>(2)</Label><Text>No permit may be issued under section 127 or 128 of the <XRefExternal reference-type="act" link="C-15.31">Canadian Environmental Protection Act, 1999</XRefExternal> for disposal in the waters of a marine conservation area except with the concurrence of the Minister.</Text></Subsection></Section><Section lims:inforce-start-date="2015-06-23" lims:lastAmendedDate="2015-06-23" lims:fid="152153" lims:id="152153"><MarginalNote lims:inforce-start-date="2015-06-23" lims:fid="152154" lims:id="152154">Permits and authorizations</MarginalNote><Label>15</Label><Subsection lims:inforce-start-date="2015-06-23" lims:fid="152155" lims:id="152155"><Label>(1)</Label><Text>Subject to section 7.1, the superintendent of a marine conservation area may, to the extent authorized by the regulations, issue, amend, suspend and revoke permits and other authorizing instruments for activities that are consistent with the management plan or interim management plan in the marine conservation area.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-23" lims:fid="152156" lims:id="152156"><MarginalNote lims:inforce-start-date="2015-06-23" lims:fid="152157" lims:id="152157">Fishing licences</MarginalNote><Label>(2)</Label><Text>A fishing licence issued under the <XRefExternal reference-type="act" link="F-14">Fisheries Act</XRefExternal> is deemed to be a permit issued under this Act to carry out the activities permitted by the licence, subject to regulations made under subsection 16(1) on the recommendation of the Minister and the Minister of Fisheries and Oceans.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-23" lims:fid="152158" lims:id="152158"><MarginalNote lims:inforce-start-date="2015-06-23" lims:fid="152159" lims:id="152159">Superintendent may not amend</MarginalNote><Label>(3)</Label><Text>For greater certainty, the superintendent of a marine conservation area may not amend, suspend or revoke a fishing licence issued under the <XRefExternal reference-type="act" link="F-14">Fisheries Act</XRefExternal>.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-06-23" lims:fid="152161" lims:id="152161">2002, c. 18, s. 15; 2015, c. 38, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2015-06-23" lims:fid="152162" lims:id="152162" level="1"><TitleText>Regulations</TitleText></Heading><Section lims:inforce-start-date="2014-04-01" lims:lastAmendedDate="2019-08-28" lims:fid="152163" lims:id="152163"><MarginalNote lims:inforce-start-date="2014-04-01" lims:fid="152164" lims:id="152164">Regulations</MarginalNote><Label>16</Label><Subsection lims:inforce-start-date="2014-04-01" lims:fid="152165" lims:id="152165"><Label>(1)</Label><Text>The Governor in Council may make regulations, consistent with international law, for the control and management of any or all marine conservation areas, including regulations</Text><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="152166" lims:id="152166"><Label>(a)</Label><Text>for the protection of ecosystems and the elements of ecosystems;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="152167" lims:id="152167"><Label>(b)</Label><Text>for the protection of cultural, historical and archaeological resources;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="152168" lims:id="152168"><Label>(c)</Label><Text>for the management and control of renewable resource harvesting activities;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="152169" lims:id="152169"><Label>(d)</Label><Text>respecting the delimitation of zones within marine conservation areas;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="152170" lims:id="152170"><Label>(e)</Label><Text>restricting or prohibiting activities or regulating the use of facilities in marine conservation areas or in any zones;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="152171" lims:id="152171"><Label>(f)</Label><Text>respecting the issuance, amendment, suspension and revocation of permits and other authorizing instruments pursuant to section 15, including the number of persons who may hold any class of permits or other instruments and the authority of superintendents to impose conditions on holders of permits or other instruments;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="152172" lims:id="152172"><Label>(g)</Label><Text>respecting the determination of fees, rates, rents and other charges for the use of resources, facilities and services and the issuance and amendment of permits and other authorizing instruments;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="152173" lims:id="152173"><Label>(h)</Label><Text>authorizing the granting, and the surrender or relinquishment, of leases, licences, easements or servitudes, of or over public lands in marine conservation areas for uses compatible with section 4;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="152174" lims:id="152174"><Label>(i)</Label><Text>respecting the safety of the public;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="152175" lims:id="152175"><Label>(j)</Label><Text>for the control of the flight of aircraft to prevent danger or disturbances to wildlife and wildlife habitat, and respecting the takeoff, landing and taxiing of aircraft;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="152176" lims:id="152176"><Label>(k)</Label><Text>for the control of scientific research activities;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-04-01" lims:fid="152177" lims:id="152177"><Label>(l)</Label><Text>authorizing the disposal of waste or other matter by persons holding permits for that purpose, in the manner and to the extent specified in the regulations, in waters of a marine conservation area to which subsection 125(1) of the <XRefExternal wardens</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="152199" lims:id="152199"><Label>(a)</Label><Text>for the enforcement of this Act and the regulations in any part of Canada or the exclusive economic zone of Canada, and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="152200" lims:id="152200"><Label>(b)</Label><Text>for the preservation and maintenance of the public peace in marine conservation areas, except in any portion of them situated within the exclusive economic zone of Canada,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="152201" lims:id="152201"><Text>and marine conservation area wardens are, for those purposes, peace officers within the meaning of the <XRefExternal Minister may designate persons or classes of persons employed in the public service of Canada or by a provincial, municipal or local authority or an aboriginal government, whose duties include law enforcement, to be enforcement officers for the purpose of the enforcement of specified provisions of this Act or the regulations in specified marine conservation areas, and for that purpose enforcement officers have the powers and are entitled to the protection provided by law to peace officers within the meaning of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>.</Text></Section><Section lims:inforce-start-date="2010-12-10" lims:lastAmendedDate="2010-12-10" lims:fid="152204" lims:id="152204"><MarginalNote lims:inforce-start-date="2010-12-10" lims:fid="152205" lims:id="152205"><XRefExternal reference-type="act" link="C-38.7">Contraventions Act</XRefExternal></MarginalNote><Label>19.1</Label><Subsection lims:inforce-start-date="2010-12-10" lims:fid="152206" lims:id="152206"><Label>(1)</Label><Text>The Minister may designate persons or classes of persons employed in the federal public administration or by a provincial, municipal or local authority or by an aboriginal government for the purpose of the enforcement of this Act or the regulations with respect to offences that have been designated as contraventions under the <XRefExternal reference-type="act" link="C-38.7">Contraventions Act</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2010-12-10" lims:fid="152207" lims:id="152234"><Label>(1)</Label><Text>A marine conservation area warden or enforcement officer may</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="152235" lims:id="152235"><Label>(a)</Label><Text>enter and search any place and open and examine any package or receptacle in accordance with a warrant issued under subsection (2) at any time during the day or, if so specified in the warrant, during the night; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="152236" lims:id="152236"><Label>(b)</Label><Text>seize any thing that the warden or officer believes on reasonable grounds is a thing described in subsection (2).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="152237" lims:id="152237"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152238" lims:id="152238">Authority to issue warrant</MarginalNote><Label>(2)</Label><Text>If a justice of the peace, on <Language xml:lang="la">ex parte</Language> application, is satisfied by information on oath that there are reasonable grounds to believe that there is in any place, including any building, boat or other conveyance, or in any package or receptacle,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="152239" lims:id="152239"><Label>(a)</Label><Text>any thing in relation to which there are reasonable grounds to believe an offence under this Act or the regulations has been committed, or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="152240" lims:id="152240"><Label>(b)</Label><Text>any thing that there are reasonable grounds to believe will afford evidence with respect to the commission of such an offence,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="152241" lims:id="152241"><Text>the justice of the peace may issue a warrant authorizing a marine conservation area warden or enforcement officer named in the warrant to enter and search the place or to open and examine the package or receptacle, subject to any conditions specified in the warrant.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="152242" lims:id="152242"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152243" lims:id="152243">Where warrant not necessary</MarginalNote><Label>(3)</Label><Text>A marine conservation area warden or enforcement officer may exercise any powers under subsection (1) without a warrant if the conditions for obtaining a warrant exist but by reason of exigent circumstances it would not be practical to obtain one.</Text></Subsection></Section><Section lims:inforce-start-date="2010-12-10" lims:lastAmendedDate="2010-12-10" lims:fid="152244" lims:id="152244"><MarginalNote lims:inforce-start-date="2010-12-10" lims:fid="152245" lims:id="152245">Custody of things seized</MarginalNote><Label>23</Label><Subsection lims:inforce-start-date="2010-12-10" lims:fid="152246" lims:id="152246"><Label>(1)</Label><Text>Subject to subsections (2) and (3) and sections 25 and 26, where a marine conservation area warden or enforcement officer seizes a thing under this Act or under a warrant issued pursuant to the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>,</Text><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152247" lims:id="152247"><Label>(a)</Label><Text>sections 489.1 and 490 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> apply; and</Text></Paragraph><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152248" lims:id="152248"><Label>(b)</Label><Text>the warden or officer, or any person that the warden or officer may designate, shall retain custody of the thing subject to any order made under section 490 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2010-12-10" lims:fid="152249" lims:id="152249"><MarginalNote lims:inforce-start-date="2010-12-10" lims:fid="152250" lims:id="152250">Forfeiture where ownership not ascertainable</MarginalNote><Label>(2)</Label><Text>If the lawful ownership of or entitlement to a seized thing cannot be ascertained within 30 days after its seizure, the thing, or any proceeds of its disposition, are forfeited to Her Majesty in right of Canada, if the thing was seized by a marine conservation area warden or enforcement officer employed in the public service of Canada, or to Her Majesty in right of a province, if the thing was seized by an enforcement officer employed by a provincial, municipal or local authority or an aboriginal government.</Text></Subsection><Subsection lims:inforce-start-date="2010-12-10" lims:fid="152251" lims:id="152251"><MarginalNote lims:inforce-start-date="2010-12-10" lims:fid="152252" lims:id="152252">Perishable things</MarginalNote><Label>(3)</Label><Text>Where a seized thing is perishable, the marine conservation area warden or enforcement officer may dispose of it or destroy it, and any proceeds of its disposition shall be paid to the lawful owner or person lawfully entitled to possession of the thing, unless proceedings under this Act are commenced within 90 days after its seizure, or shall be retained by the warden or officer pending the outcome of those proceedings.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2010-12-10" lims:fid="152254" lims:id="152254">2002, c. 18, s. 23; 2009, c. 14, s. lims:inforce-start-date="2010-12-10" lims:fid="152256" lims:id="152256">Liability for costs</MarginalNote><Label>23.1</Label><Text>If a thing is seized under this Act, the person who owned the thing at the time that it was seized, the person who had charge or control of the thing immediately before it was seized and the person who possessed it immediately before it was seized are jointly and severally, or solidarily, liable for all the costs of seizure, detention, maintenance and forfeiture, including any destruction or disposal costs, incurred by Her Majesty in right of Canada in lims:inforce-start-date="2010-12-10" lims:fid="152306" lims:id="152306">Continuing offences</MarginalNote><Label>(2)</Label><Text>If a contravention of this Act or the regulations is committed or continued on more than one day, it constitutes a separate offence for each day on which it is committed or continued.</Text></Subsection><Subsection lims:inforce-start-date="2010-12-10" lims:fid="152307" lims:id="152307"><MarginalNote lims:inforce-start-date="2010-12-10" lims:fid="152308" lims:id="152308">Offences involving more than one animal, plant or object</MarginalNote><Label>(2.1)</Label><Text>If an offence involves more than one animal, plant or object, the fine to be imposed in respect of that offence may, despite subsections (1) and (1.1), be the total of the fines that would have been imposed if each of the animals, plants or objects had been the subject of a separate information.</Text></Subsection><Subsection lims:inforce-start-date="2010-12-10" lims:fid="152309" lims:id="152309"><MarginalNote lims:inforce-start-date="2010-12-10" lims:fid="152310" lims:id="152310">Deeming — second and subsequent offence</MarginalNote><Label>(2.2)</Label><Text>For the purposes of this section, a conviction for a particular offence under this Act is deemed to be a conviction for a second or subsequent offence if the court is satisfied that the offender has been previously convicted — under any Act of Parliament, or any Act of the legislature of a province, that relates to environmental or wildlife protection or conservation, or the protection of cultural, historical or archaeological resources — of a substantially similar offence.</Text></Subsection><Subsection lims:inforce-start-date="2010-12-10" lims:fid="152311" lims:id="152311"><MarginalNote lims:inforce-start-date="2010-12-10" lims:fid="152312" lims:id="152312">Application</MarginalNote><Label>(2.3)</Label><Text>Subsection (2.2) applies only to previous convictions on indictment and to previous convictions on summary conviction, and to previous convictions under any similar procedure under any Act of the legislature of a province.</Text></Subsection><Subsection lims:inforce-start-date="2010-12-10" lims:fid="152313" lims:id="152313"><MarginalNote lims:inforce-start-date="2010-12-10" lims:fid="152314" lims:id="152314">Injunction</MarginalNote><Label>(3)</Label><Text>Whether or not proceedings have been commenced with respect to an offence under this Act, Her Majesty in right of Canada may undertake or continue proceedings to prevent conduct that constitutes such an may determine a corporation to be a small revenue corporation if the court is satisfied that the corporation’s gross revenues for the 12 months immediately before the day on which the subject matter of the proceedings arose — or, if it arose on more than one day, for the 12 months immediately before the first day on which the subject matter of the proceedings arose — were not more than that has shareholders is convicted of an offence under this Act, the court shall make an order directing the corporation to notify its shareholders, in the manner and within the time directed by the Act, any director, officer, agent or mandatary of the corporation who directed, authorized, assented to, acquiesced in or participated in the commission of the offence is a party to and guilty of the offence and is liable on conviction to the penalty provided for by this Act for an individual in respect of the offence committed by the corporation, whether or not the corporation has been prosecuted or convicted.</Text></Subsection><Subsection lims:inforce-start-date="2010-12-10" lims:fid="152336" lims:id="152336"><MarginalNote lims:inforce-start-date="2010-12-10" lims:fid="152337" lims:id="152337">Duties of directors and officers of corporations</MarginalNote><Label>(2)</Label><Text>Every director and officer of a corporation shall take all reasonable care to ensure that the corporation complies with</Text><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152338" lims:id="152338"><Label>(a)</Label><Text>this Act and the regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152339" lims:id="152339"><Label>(b)</Label><Text>orders made by a court, the Minister or the superintendent under this Act; and</Text></Paragraph><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152340" lims:id="152340"><Label>(c)</Label><Text>directions of the superintendent, a marine conservation area warden or under this Act is to contribute to respect for the law establishing and protecting marine conservation areas through the imposition of just sanctions that have as their objectives</Text><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152345" lims:id="152345"><Label>(a)</Label><Text>to deter the offender and any other person from committing offences under this Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152346" lims:id="152346"><Label>(b)</Label><Text>to denounce unlawful conduct that damages or creates a risk of damage to marine conservation areas; and</Text></Paragraph><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152347" lims:id="152347"><Label>(c)</Label><Text>to restore marine conservation area resources.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2010-12-10" lims:fid="152349" lims:id="152349">2009, c. 14, s. 25</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2010-12-10" lims:lastAmendedDate="2010-12-10" lims:fid="152350" lims:id="152350"><MarginalNote lims:inforce-start-date="2010-12-10" lims:fid="152351" lims:id="152351">Sentencing principles</MarginalNote><Label>24.7</Label><Subsection lims:inforce-start-date="2010-12-10" lims:fid="152352" lims:id="152352"><Label>(1)</Label><Text>In addition to the principles and factors that the court is otherwise required to consider, including those set out in sections 718.1 to 718.21 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, the court shall consider the following principles when sentencing a person who is convicted of an offence under this Act:</Text><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152353" lims:id="152353"><Label>(a)</Label><Text>the amount of the fine should be increased to account for every aggravating factor associated with the offence, including the aggravating factors set out in subsection (2); and</Text></Paragraph><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152354" lims:id="152354"><Label>(b)</Label><Text>the amount of the fine should reflect the gravity of each aggravating factor associated with the offence.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2010-12-10" lims:fid="152355" lims:id="152355"><MarginalNote lims:inforce-start-date="2010-12-10" lims:fid="152356" lims:id="152356">Aggravating factors</MarginalNote><Label>(2)</Label><Text>The aggravating factors are the following:</Text><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152357" lims:id="152357"><Label>(a)</Label><Text>the offence caused damage or risk of damage to any marine conservation area resources;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152358" lims:id="152358"><Label>(b)</Label><Text>the offence caused damage or risk of damage to any unique, rare, particularly important or vulnerable marine conservation area resources;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152359" lims:id="152359"><Label>(c)</Label><Text>the damage caused by the offence is extensive, persistent or irreparable;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152360" lims:id="152360"><Label>(d)</Label><Text>the offender committed the offence intentionally or recklessly;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152361" lims:id="152361"><Label>(e)</Label><Text>the offender failed to take reasonable steps to prevent the commission of the offence despite having the financial means to do so;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152362" lims:id="152362"><Label>(f)</Label><Text>by committing the offence or failing to take action to prevent its commission, the offender increased revenue or decreased costs or intended to increase revenue or decrease costs;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152363" lims:id="152363"><Label>(g)</Label><Text>the offender committed the offence despite having been warned by the superintendent, a marine conservation area warden or an enforcement officer of the circumstances that subsequently became the subject of the offence;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152364" lims:id="152364"><Label>(h)</Label><Text>the offender has a history of non-compliance with federal or provincial legislation that relates to environmental or wildlife protection or conservation or the protection of cultural, historical or archaeological resources; and</Text></Paragraph><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152365" lims:id="152365"><Label>(i)</Label><Text>after the commission of the offence, the offender</Text><Subparagraph lims:inforce-start-date="2010-12-10" lims:fid="152366" lims:id="152366"><Label>(i)</Label><Text>attempted to conceal its commission,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2010-12-10" lims:fid="152367" lims:id="152367"><Label>(ii)</Label><Text>failed to take prompt action to prevent, mitigate or remediate its effects, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2010-12-10" lims:fid="152368" lims:id="152368"><Label>(iii)</Label><Text>failed to take prompt action to reduce the risk of committing similar offences in the future.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2010-12-10" lims:fid="152369" lims:id="152369"><MarginalNote lims:inforce-start-date="2010-12-10" lims:fid="152370" lims:id="152370">Absence of aggravating factor</MarginalNote><Label>(3)</Label><Text>The absence of an aggravating factor set out in subsection (2) is not a mitigating factor.</Text></Subsection><Subsection lims:inforce-start-date="2010-12-10" lims:fid="152371" lims:id="152371"><MarginalNote lims:inforce-start-date="2010-12-10" lims:fid="152372" lims:id="152372">Meaning of <DefinitionRef>damage</DefinitionRef></MarginalNote><Label>(4)</Label><Text>For the purposes of paragraphs (2)(a) to (c), <DefinedTermEn>damage</DefinedTermEn> includes loss of use value and non-use value.</Text></Subsection><Subsection lims:inforce-start-date="2010-12-10" lims:fid="152373" lims:id="152373"><MarginalNote lims:inforce-start-date="2010-12-10" lims:fid="152374" lims:id="152374">Reasons</MarginalNote><Label>(5)</Label><Text>If the court is satisfied of the existence of one or more of the aggravating factors set out in subsection (2) but decides not to increase the amount of the fine because of that factor, the court shall give reasons for that decision.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem Act, the convicting court may, in addition to any punishment imposed, order that any seized thing by means of or in relation to which the offence was committed, or any proceeds of its disposition, be forfeited to Her Majesty in right of Canada.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="152380" lims:id="152380"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152381" lims:id="152381">Return where no forfeiture ordered</MarginalNote><Label>(2)</Label><Text>If the convicting court does not order the forfeiture, a seized thing or the proceeds of its disposition shall be returned to its lawful owner or the person lawfully entitled to it.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="152382" lims:id="152382"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152383" lims:id="152383">Retention or sale</MarginalNote><Label>(3)</Label><Text>If a fine is imposed on a person convicted of an offence under this Act, any seized thing or any proceeds of its disposition may be retained until the fine is paid or the thing may be sold in satisfaction of the fine and the proceeds applied, in whole or in part, in payment of the fine.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="152384" lims:id="152384"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="152385" lims:id="152385">Disposition by Minister</MarginalNote><Label>26</Label><Text>Any seized thing that has been forfeited under this Act to Her Majesty in right of Canada or abandoned by its owner may be dealt with and disposed of as the Minister may direct.</Text></Section><Section lims:inforce-start-date="2010-12-10" lims:lastAmendedDate="2010-12-10" lims:fid="152386" lims:id="152386"><MarginalNote lims:inforce-start-date="2010-12-10" lims:fid="152387" lims:id="152387">Application of fines</MarginalNote><Label>26.1</Label><Subsection lims:inforce-start-date="2010-12-10" lims:fid="152388" lims:id="152388"><Label>(1)</Label><Text>All fines received by the Receiver General in respect of the commission of an offence under this Act, other than fines collected under the <XRefExternal reference-type="act" link="C-38.7">Contraventions Act</XRefExternal>, are to be credited to the Environmental Damages Fund, an account in the accounts of Canada, and used for purposes related to protecting, conserving or restoring marine conservation areas or for administering that Fund.</Text></Subsection><Subsection lims:inforce-start-date="2010-12-10" lims:fid="152389" lims:id="152389"><MarginalNote lims:inforce-start-date="2010-12-10" lims:fid="152390" lims:id="152390">Recommendations of court</MarginalNote><Label>(2)</Label><Text>The court imposing the fine may recommend to the Minister that all or a portion of the fine credited to the Environmental Damages Fund be paid to a person or an organization specified by the court for a purpose referred to in subsection (1).</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2010-12-10" lims:fid="152392" lims:id="152392">2009, c. 14, s. 26</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2010-12-10" court</MarginalNote><Label>27</Label><Subsection lims:inforce-start-date="2010-12-10" lims:fid="152395" lims:id="152395"><Label>(1)</Label><Text>If a person is convicted of an offence under this Act, in addition to any punishment imposed, the court may, having regard to the nature of the offence and the circumstances surrounding its commission, make an order containing one or more of the following prohibitions, directions or requirements:</Text><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152396" lims:id="152396"><Label>(a)</Label><Text>prohibiting the person from doing any act or engaging in any activity that may, in the court’s opinion, result in the continuation or repetition of the offence;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152397" lims:id="152397"><Label>(b)</Label><Text>directing the person to take any action that the court considers appropriate to remedy or avoid any damage to any marine conservation area resources that resulted or may result from the commission of the offence;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152398" lims:id="152398"><Label>(c)</Label><Text>directing the person to post a bond, provide surety or pay into court an amount of money that the court considers appropriate for the purpose of ensuring compliance with any prohibition, direction or requirement mentioned in this section;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152399" lims:id="152399"><Label>(d)</Label><Text>directing the person to prepare and implement a pollution prevention plan or an environmental emergency plan;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152400" lims:id="152400"><Label>(e)</Label><Text>directing the person to carry out, in the manner established by the Minister, monitoring of the environmental effects of any activity or undertaking on the resources of a marine conservation area or directing the person to pay, in the manner specified by the court, an amount for that purpose;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152401" lims:id="152401"><Label>(f)</Label><Text>directing the person to implement an environmental management system approved by the Minister;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152402" lims:id="152402"><Label>(g)</Label><Text>directing the person to have an environmental audit conducted by a person of a class and at the times specified by the Minister and directing the person to remedy any deficiencies revealed during the audit;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152403" lims:id="152403"><Label>(h)</Label><Text>directing the person to pay to Her Majesty in right of Canada an amount of money that the court considers appropriate for the purpose of promoting the protection, conservation or restoration of marine conservation areas;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152404" lims:id="152404"><Label>(i)</Label><Text>directing the person to publish, in the manner specified by the court, the facts relating to the commission of the offence and the details of the punishment imposed, including any orders made under this subsection;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152405" lims:id="152405"><Label>(j)</Label><Text>directing the person to notify, at the person’s own cost and in the manner specified by the court, any person aggrieved or affected by the person’s conduct of the facts relating to the commission of the offence and of the details of the punishment imposed, including any orders made under this subsection;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152406" lims:id="152406"><Label>(k)</Label><Text>directing the person to submit to the Minister, when requested to do so by the Minister at any time within three years after the date of conviction, any information with respect to the person’s activities that the court considers appropriate in the circumstances;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152407" lims:id="152407"><Label>(l)</Label><Text>directing the person to compensate any person, monetarily or otherwise, in whole or in part, for the cost of any remedial or preventive action taken, caused to be taken or to be taken as a result of the act or omission that constituted the offence, including any costs of assessing appropriate remedial or preventive action;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152408" lims:id="152408"><Label>(m)</Label><Text>directing the person to perform community service, subject to any reasonable conditions that may be imposed in the order;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152409" lims:id="152409"><Label>(n)</Label><Text>directing the person to pay, in a manner specified by the court, an amount to enable research to be conducted into the protection, conservation or restoration of marine conservation areas;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152410" lims:id="152410"><Label>(o)</Label><Text>requiring the person to surrender to the Minister any permit or other authorizing instrument issued under this Act to the person;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152411" lims:id="152411"><Label>(p)</Label><Text>prohibiting the person from applying for any new permit or other authorizing instrument under this Act during any period that the court considers appropriate;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152412" lims:id="152412"><Label>(q)</Label><Text>directing the person to pay, in the manner prescribed by the court, an amount to environmental or other groups to assist in their work related to the marine pay, in the manner prescribed by the court, an amount to an educational institution including for scholarships for students enrolled in studies related to the environment; and</Text></Paragraph><Paragraph lims:inforce-start-date="2010-12-10" lims:fid="152414" lims:id="152414"><Label>(s)</Label><Text>requiring the person to comply with any other conditions that the court considers appropriate.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2010-12-10" lims:fid="152415" lims:id="152415"><MarginalNote lims:inforce-start-date="2010-12-10" lims:fid="152416" lims:id="152416">Publication</MarginalNote><Label>(1.1)</Label><Text>If a person fails to comply with an order made under paragraph (1)(i), the Minister may, in the manner that the court directed the person to do so, publish the facts relating to the commission of the offence and the details of the punishment imposed and recover the costs of publication from the person.</Text></Subsection><Subsection lims:inforce-start-date="2010-12-10" lims:fid="152417" lims:id="152417"><MarginalNote lims:inforce-start-date="2010-12-10" lims:fid="152418" lims:id="152418">Debt due to Her Majesty</MarginalNote><Label>(1.2)</Label><Text>If the court makes an order under paragraph (1)(h) or (l) directing a person to pay an amount to Her Majesty in right of Canada, or if the Minister incurs publication costs under subsection (1.1), the amount or the costs, as the case may be, constitute a debt due to Her Majesty in right of Canada and may be recovered in any court of competent jurisdiction.</Text></Subsection><Subsection lims:inforce-start-date="2010-12-10" lims:fid="152419" lims:id="152419"><MarginalNote lims:inforce-start-date="2010-12-10" lims:fid="152420" lims:id="152420">Enforcement</MarginalNote><Label>(1.3)</Label><Text>If the court makes an order under paragraph (1)(l) directing a person to pay an amount to another person, other than to Her Majesty in right of Canada, and the amount is not paid without delay, that other person may, by filing the order, enter as a judgment, in the superior court of the province in which the trial was held, the amount ordered to be paid, and that judgment is enforceable against the person who was directed to pay the amount in the same manner as if it were a judgment rendered against the offender in that court in civil proceedings.</Text></Subsection><Subsection lims:inforce-start-date="2010-12-10" lims:fid="152421" lims:id="152421"><MarginalNote lims:inforce-start-date="2010-12-10" lims:fid="152422" lims:id="152422">Cancellation or suspension of permit, etc.</MarginalNote><Label>(1.4)</Label><Text>If the court makes an order under paragraph (1)(o), any permit or other authorizing instrument to which the order relates is cancelled unless the court makes an order suspending it for any period that the court considers appropriate.</Text></Subsection><Subsection lims:inforce-start-date="2010-12-10" lims:fid="152423" lims:id="152423"><MarginalNote lims:inforce-start-date="2010-12-10" lims:fid="152424" lims:id="152424">Suspended sentence</MarginalNote><Label>(2)</Label><Text>Where a person is convicted of an offence under this Act and the court suspends the passing of sentence under paragraph 731(1)(a) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, the court may, in addition to any probation order made under that paragraph, make an order referred to in subsection (1).</Text></Subsection><Subsection lims:inforce-start-date="2010-12-10" lims:fid="152425" lims:id="152425"><MarginalNote lims:inforce-start-date="2010-12-10" lims:fid="152426" lims:id="152426">Imposition of sentence</MarginalNote><Label>(3)</Label><Text>If the person does not comply with the order or is convicted of another offence, the court may, within three years after the order was made, on the application of the prosecution, impose any sentence that could have been imposed if the passing of sentence had not been suspended.</Text></Subsection><Subsection lims:inforce-start-date="2010-12-10" lims:fid="152427" lims:id="152427"><MarginalNote lims:inforce-start-date="2010-12-10" lims:fid="152428" lims:id="152428">Coming into force and duration of order</MarginalNote><Label>(4)</Label><Text>An order made under subsection (1) comes into force on the day on which it is made or on any other day that the court may determine and shall not continue in force for more than three years after that day unless the court provides otherwise in the order.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2010-12-10" property</MarginalNote><Label>28</Label><Subsection lims:inforce-start-date="2010-12-10" lims:fid="152433" lims:id="152433"><Label>(1)</Label><Text>If a person has been convicted of an offence under this Act, the court may, at the time sentence is imposed and on the application of the person aggrieved, order the offender to pay to the aggrieved person an amount by way of satisfaction or compensation for loss of or damage to property suffered by that person as a result of the commission of the offence.</Text></Subsection><Subsection lims:inforce-start-date="2010-12-10" lims:fid="152434" lims:id="152434"><MarginalNote lims:inforce-start-date="2010-12-10" lims:fid="152435" lims:id="152435">Enforcement</MarginalNote><Label>(2)</Label><Text>If the amount ordered to be paid under subsection (1) is not paid without delay, the aggrieved person may, by filing the order, enter as a judgment, in the superior court of the province in which the trial was held, the amount ordered to be paid, and that judgment is enforceable against the offender in the same manner as if it were a judgment rendered against the offender in that court in civil lims:fid="152469" lims:id="152469">Pollution clean-up</MarginalNote><Label>29</Label><Subsection lims:inforce-start-date="2007-07-01" lims:fid="152470" lims:id="152470"><Label>(1)</Label><Text>Where a substance that is capable of degrading the environment or injuring any animal, fish or plant is discharged or deposited within a marine conservation area, any person who has charge, management or control of the substance or who causes or contributes to the discharge or deposit shall take reasonable measures to prevent or mitigate such degradation or injury.</Text></Subsection><Subsection lims:inforce-start-date="2007-07-01" lims:fid="152471" lims:id="152471"><MarginalNote lims:inforce-start-date="2007-07-01" lims:fid="152472" lims:id="152472">Powers of Minister</MarginalNote><Label>(2)</Label><Text>If the Minister is of the opinion that a person is not taking measures required by subsection (1), the Minister shall direct the person to take those measures and, if the person fails to do so, the Minister may direct those measures to be taken on behalf of Her Majesty in right of Canada.</Text></Subsection><Subsection lims:inforce-start-date="2007-07-01" lims:fid="152473" lims:id="152473"><MarginalNote lims:inforce-start-date="2007-07-01" lims:fid="152474" lims:id="152474">Expenses of clean-up</MarginalNote><Label>(3)</Label><Text>A person who fails to comply with a direction given by the Minister under subsection (2) is liable for the expenses reasonably incurred by Her Majesty in right of Canada in taking the measures directed and those expenses may be recovered from that person, with costs, in proceedings brought in the name of Her Majesty in any court of competent
