or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114632" lims:id="114632"><Label>(b)</Label><Text>that is in force and the provisions of which Canada has agreed to accept and apply in an armed conflict in which it is involved. (<DefinedTermFr>droit international conventionnel</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="114633" lims:id="114633"><Text><DefinedTermEn>International Criminal Court</DefinedTermEn> means the International Criminal Court established by the Rome Statute. (<DefinedTermFr>Cour pénale internationale</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="114634" lims:id="114634"><Text><DefinedTermEn>official</DefinedTermEn>, in respect of the International Criminal Court, means the Prosecutor, Registrar, Deputy Prosecutor and Deputy Registrar, and the staff of the organs of the Court. (<DefinedTermFr>fonctionnaire</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="114635" lims:id="114635"><Text><DefinedTermEn>Rome Statute</DefinedTermEn> means the Rome Statute of the International Criminal Court adopted by the United Nations Diplomatic Conference of Plenipotentiaries on the Establishment of an International Criminal Court on July 17, 1998, as corrected by the <Emphasis style="italic"><Language xml:lang="fr">procès-verbaux</Language></Emphasis> of November 10, 1998, July 12, 1999, November 30, 1999 and May 8, 2000, portions of which are set out in the schedule. (<DefinedTermFr>Statut de Rome</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="114636" lims:id="114636"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114637" lims:id="114637">Words and Expressions</MarginalNote><Label>(2)</Label><Text>Unless otherwise provided, words and expressions used in this Act have the same meaning as in the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>.</Text></Subsection></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="114638" lims:id="114638" level="1"><TitleText>Her Majesty</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="114639" lims:id="114639"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114640" lims:id="114640">Binding on Her Majesty</MarginalNote><Label>3</Label><Text>This Act is binding on Her Majesty in right of Canada or a province.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="114641" lims:id="114641" level="1"><TitleText>Offences Within Canada</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="114642" lims:id="114642"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114643" lims:id="114643">Genocide, etc., committed in Canada</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="114644" lims:id="114644"><Label>(1)</Label><Text>Every person is guilty of an indictable offence who commits</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114645" lims:id="114645"><Label>(a)</Label><Text>genocide;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114646" lims:id="114646"><Label>(b)</Label><Text>a crime against humanity; or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114647" lims:id="114647"><Label>(c)</Label><Text>a war crime.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="114648" lims:id="114648"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114649" lims:id="114649">Conspiracy, attempt, etc.</MarginalNote><Label>(1.1)</Label><Text>Every person who conspires or attempts to commit, is an accessory after the fact in relation to, or counsels in relation to, an offence referred to in subsection (1) is guilty of an indictable offence.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="114650" lims:id="114650"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114651" lims:id="114651">Punishment</MarginalNote><Label>(2)</Label><Text>Every person who commits an offence under subsection (1) or (1.1)</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114652" lims:id="114652"><Label>(a)</Label><Text>shall be sentenced to imprisonment for life, if an intentional killing forms the basis of the offence; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114653" lims:id="114653"><Label>(b)</Label><Text>is liable to imprisonment for life, in any other case.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="114654" lims:id="114654"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114655" lims:id="114655">Definitions</MarginalNote><Label>(3)</Label><Text>The definitions in this subsection apply in this section.</Text><Definition lims:inforce-start-date="2002-12-31" lims:fid="114656" lims:id="114656"><Text><DefinedTermEn>crime against humanity</DefinedTermEn> means murder, extermination, enslavement, deportation, imprisonment, torture, sexual violence, persecution or any other inhumane act or omission that is committed against any civilian population or any identifiable group and that, at the time and in the place of its commission, constitutes a crime against humanity according to customary international law or conventional international law or by virtue of its being criminal according to the general principles of law recognized by the community of nations, whether or not it constitutes a contravention of the law in force at the time and in the place of its commission. (<DefinedTermFr>crime contre l’humanité</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="114657" lims:id="114657"><Text><DefinedTermEn>genocide</DefinedTermEn> means an act or omission committed with intent to destroy, in whole or in part, an identifiable group of persons, as such, that, at the time and in the place of its commission, constitutes genocide according to customary international law or conventional international law or by virtue of its being criminal according to the general principles of law recognized by the community of nations, whether or not it constitutes a contravention of the law in force at the time and in the place of its commission. (<DefinedTermFr>génocide</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="114658" lims:id="114658"><Text><DefinedTermEn>war crime</DefinedTermEn> means an act or omission committed during an armed conflict that, at the time and in the place of its commission, constitutes a war crime according to customary international law or conventional international law applicable to armed conflicts, whether or not it constitutes a contravention of the law in force at the time and in the place of its commission. (<DefinedTermFr>crime de guerre</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="114659" lims:id="114659"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114660" lims:id="114660">Interpretation — customary international law</MarginalNote><Label>(4)</Label><Text>For greater certainty, crimes described in Articles 6 and 7 and paragraph 2 of Article 8 of the Rome Statute are, as of July 17, 1998, crimes according to customary international law. This does not limit or prejudice in any way the application of existing or developing rules of international law.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="114661" lims:id="114661"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114662" lims:id="114662">Breach of responsibility by military commander</MarginalNote><Label><FootnoteRef idref="C-45.9_en_1">*</FootnoteRef>5</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="114663" lims:id="114663"><Label>(1)</Label><Text>A military commander commits an indictable offence if</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114664" lims:id="114664"><Label>(a)</Label><Text>the military commander</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="114665" lims:id="114665"><Label>(i)</Label><Text>fails to exercise control properly over a person under their effective command and control or effective authority and control, and as a result the person commits an offence under section 4, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="114666" lims:id="114666"><Label>(ii)</Label><Text>fails, after the coming into force of this section, to exercise control properly over a person under their effective command and control or effective authority and control, and as a result the person commits an offence under section 6;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114667" lims:id="114667"><Label>(b)</Label><Text>the military commander knows, or is criminally negligent in failing to know, that the person is about to commit or is committing such an offence; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114668" lims:id="114668"><Label>(c)</Label><Text>the military commander subsequently</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="114669" lims:id="114669"><Label>(i)</Label><Text>fails to take, as soon as practicable, all necessary and reasonable measures within their power to prevent or repress the commission of the offence, or the further commission of offences under section 4 or 6, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="114670" lims:id="114670"><Label>(ii)</Label><Text>fails to take, as soon as practicable, all necessary and reasonable measures within their power to submit the matter to the competent idref="C-45.9_en_2">*</FootnoteRef>(2)</Label><Text>A superior commits an indictable offence if</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114673" lims:id="114673"><Label>(a)</Label><Text>the superior</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="114674" lims:id="114674"><Label>(i)</Label><Text>fails to exercise control properly over a person under their effective authority and control, and as a result the person commits an offence under section 4, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="114675" lims:id="114675"><Label>(ii)</Label><Text>fails, after the coming into force of this section, to exercise control properly over a person under their effective authority and control, and as a result the person commits an offence under section 6;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114676" lims:id="114676"><Label>(b)</Label><Text>the superior knows that the person is about to commit or is committing such an offence, or consciously disregards information that clearly indicates that such an offence is about to be committed or is being committed by the person;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114677" lims:id="114677"><Label>(c)</Label><Text>the offence relates to activities for which the superior has effective authority and control; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114678" lims:id="114678"><Label>(d)</Label><Text>the superior subsequently</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="114679" lims:id="114679"><Label>(i)</Label><Text>fails to take, as soon as practicable, all necessary and reasonable measures within their power to prevent or repress the commission of the offence, or the further commission of offences under section 4 or 6, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="114680" lims:id="114680"><Label>(ii)</Label><Text>fails to lims:id="114688"><Text><DefinedTermEn>superior</DefinedTermEn> means a person in authority, other than a military level="1"><TitleText>Offences Outside Canada</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="114690" lims:id="114690"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114691" lims:id="114691">Genocide, etc., committed outside Canada</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="114692" lims:id="114692"><Label>(1)</Label><Text>Every person who, either before or after the coming into force of this section, commits outside Canada</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114693" lims:id="114693"><Label>(a)</Label><Text>genocide,</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114694" lims:id="114694"><Label>(b)</Label><Text>a crime against humanity, or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114695" lims:id="114695"><Label>(c)</Label><Text>a war crime,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="114696" lims:id="114696"><Text>is guilty of an indictable offence and may be prosecuted for that lims:fid="114709" lims:id="114709">Interpretation — customary international law</MarginalNote><Label>(4)</Label><Text>For greater certainty, crimes described in articles 6 and 7 and paragraph 2 of article 8 of the Rome Statute are, as of July 17, 1998, crimes according to customary international law, and may be crimes according to customary international law before that date. This does not limit or prejudice in any way the application of existing or developing rules of international law.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="114710" lims:id="114710"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114711" lims:id="114711">Interpretation — crimes against humanity</MarginalNote><Label>(5)</Label><Text>For greater certainty, the offence of crime against humanity was part of customary international law or was criminal according to the general principles of law recognized by the community of nations before the coming into force of either of the following:</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114712" lims:id="114712"><Label>(a)</Label><Text>the Agreement for the prosecution and punishment of the major war criminals of the European Axis, signed at London on August 8, 1945; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114713" lims:id="114713"><Label>(b)</Label><Text>the Proclamation by the Supreme Commander for the Allied Powers, dated January 19, 1946.</Text></Paragraph></Subsection></Section><Section commits an indictable offence if</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114717" lims:id="114717"><Label>(a)</Label><Text>the military commander, outside Canada,</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="114718" lims:id="114718"><Label>(i)</Label><Text>fails to exercise control properly over a person under their effective command and control or effective authority and control, and as a result the person commits an offence under section 4, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="114719" lims:id="114719"><Label>(ii)</Label><Text>fails, before or after the coming into force of this section, to exercise control properly over a person under their effective command and control or effective authority and control, and as a result the person commits an offence under section 6;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114720" lims:id="114720"><Label>(b)</Label><Text>the military commander knows, or is criminally negligent in failing to know, that the person is about to commit or is committing such an offence; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114721" lims:id="114721"><Label>(c)</Label><Text>the military commander subsequently</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="114722" lims:id="114722"><Label>(i)</Label><Text>fails to take, as soon as practicable, all necessary and reasonable measures within their power to prevent or repress the commission of the offence, or the further commission of offences under section 4 or 6, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="114723" lims:id="114723"><Label>(ii)</Label><Text>fails to take, as soon as practicable, all necessary and reasonable measures within their power to submit the matter to the competent authorities for investigation and prosecution.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="114724" lims:id="114724"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114725" lims:id="114725">Breach of responsibility by a superior</MarginalNote><Label>(2)</Label><Text>A superior commits an indictable offence if</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114726" lims:id="114726"><Label>(a)</Label><Text>the superior, outside Canada,</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="114727" lims:id="114727"><Label>(i)</Label><Text>fails to exercise control properly over a person under their effective authority and control, and as a result the person commits an offence under section 4, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="114728" lims:id="114728"><Label>(ii)</Label><Text>fails, before or after the coming into force of this section, to exercise control properly over a person under their effective authority and control, and as a result the person commits an offence under section 6;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114729" lims:id="114729"><Label>(b)</Label><Text>the superior knows that the person is about to commit or is committing such an offence, or consciously disregards information that clearly indicates that such an offence is about to be committed or is being committed by the person;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114730" lims:id="114730"><Label>(c)</Label><Text>the offence relates to activities for which the superior has effective authority and control; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114731" lims:id="114731"><Label>(d)</Label><Text>the superior subsequently</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="114732" lims:id="114732"><Label>(i)</Label><Text>fails to take, as soon as practicable, all necessary and reasonable measures within their power to prevent or repress the commission of the offence, or the further commission of offences under section 4 or 6, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="114733" lims:id="114733"><Label>(ii)</Label><Text>fails to take, as soon as practicable, all necessary and reasonable measures within their power to submit the matter to the competent authorities for investigation and prosecution.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="114734" lims:id="114734"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114735" lims:id="114735">Conspiracy, attempt, etc.</MarginalNote><Label>(2.1)</Label><Text>Every person who conspires or attempts to commit, is an accessory after the fact in relation to, or counsels in relation to, an offence referred to in subsection (1) or (2) is guilty of an indictable offence.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="114736" lims:id="114736"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114737" lims:id="114737">Jurisdiction</MarginalNote><Label>(3)</Label><Text>A person who is alleged to have committed an offence under subsection (1), (2) or (2.1) may be prosecuted for that offence in accordance with section 8.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="114738" lims:id="114738"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114739" lims:id="114739">Punishment</MarginalNote><Label>(4)</Label><Text>Every person who commits an offence under subsection (1), (2) or (2.1) is liable to imprisonment for omission constituted a contravention of customary international law or conventional international law or was criminal according to the general principles of law recognized by the community of nations, lims:id="114743">Definitions</MarginalNote><Label>(6)</Label><Text>The definitions in this subsection apply in this section.</Text><Definition lims:inforce-start-date="2002-12-31" lims:fid="114744" lims:id="114744"><Text><DefinedTermEn>military commander</DefinedTermEn> includes a person effectively acting as a military commander and a person who commands police with a degree of authority and control comparable to a military commander. (<DefinedTermFr>chef militaire</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="114745" lims:id="114745"><Text><DefinedTermEn>superior</DefinedTermEn> means a person in authority, other than a military commander. (<DefinedTermFr>supérieur</DefinedTermFr>)</Text></Definition></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="114746" lims:id="114746"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114747" lims:id="114747">Jurisdiction</MarginalNote><Label>8</Label><Text>A person who is alleged to have committed an offence under section 6 or 7 may be prosecuted for that offence if</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114748" lims:id="114748"><Label>(a)</Label><Text>at the time the offence is alleged to have been committed,</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="114749" lims:id="114749"><Label>(i)</Label><Text>the person was a Canadian citizen or was employed by Canada in a civilian or military capacity,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="114750" lims:id="114750"><Label>(ii)</Label><Text>the person was a citizen of a state that was engaged in an armed conflict against Canada, or was employed in a civilian or military capacity by such a state,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="114751" lims:id="114751"><Label>(iii)</Label><Text>the victim of the alleged offence was a Canadian citizen, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="114752" lims:id="114752"><Label>(iv)</Label><Text>the victim of the alleged offence was a citizen of a state that was allied with Canada in an armed conflict; or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114753" lims:id="114753"><Label>(b)</Label><Text>after the time the offence is alleged to have been committed, the person is present in Canada.</Text></Paragraph></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="114754" lims:id="114754" level="1"><TitleText>Procedure and Defences</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2024-07-20" lims:fid="114755" lims:id="114755"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114756" lims:id="114756">Place of trial</MarginalNote><Label>9</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="114757" lims:id="114757"><Label>(1)</Label><Text>Proceedings for an offence under this Act alleged to have been committed outside Canada for which a person may be prosecuted under this Act may, whether or not the person is in Canada, be commenced in any territorial division in Canada and the person may be tried and punished in respect of that offence in the same manner as if the offence had been committed in that territorial division.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="114758" lims:id="114758"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114759" lims:id="114759">Presence of accused at trial</MarginalNote><Label>(2)</Label><Text>For greater certainty, in a proceeding commenced in any territorial division under subsection (1), the provisions of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> relating to requirements that an accused appear at and be present during proceedings and any exceptions to those the laws of Canada or under international law at the time of the alleged offence or at the time of the proceedings.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="114770" lims:id="114770"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114771" lims:id="114771">When previously tried outside omission that is an offence under this Act, and the person has been tried and dealt with outside Canada in respect of the offence in such a manner that, had they been tried and dealt with in Canada, they would be able to plead <Emphasis style="italic"><Language xml:lang="fr">autrefois acquit</Language></Emphasis>, <Emphasis style="italic"><Language xml:lang="fr">autrefois convict</Language></Emphasis> or pardon, the person is deemed to have been so tried and dealt with in Canada.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="114773" lims:id="114773"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114774" lims:id="114774">Exception</MarginalNote><Label>(2)</Label><Text>Despite subsection (1), a person may not plead <Emphasis style="italic"><Language xml:lang="fr">autrefois acquit</Language></Emphasis>, <Emphasis style="italic"><Language xml:lang="fr">autrefois convict</Language></Emphasis> or pardon in respect of an offence under any of sections 4 to 7 if the person was tried in a court of a foreign state or territory and the proceedings in that court</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114775" lims:id="114775"><Label>(a)</Label><Text>were for the purpose of shielding the person from criminal responsibility; or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114776" lims:id="114776"><Label>(b)</Label><Text>were not otherwise conducted independently or impartially in accordance with the norms of due process recognized by international law, and were conducted in a manner that, in the circumstances, was inconsistent with an intent to bring the person to justice.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="114777" lims:id="114777"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114778" lims:id="114778">Conflict with internal law</MarginalNote><Label>13</Label><Text>Despite section 15 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, it is not a justification, excuse or defence with respect to an offence under any of sections 4 to 7 that the offence was committed in obedience to or in conformity with the law in force at the time and in the place of its commission.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="114779" lims:id="114779"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114780" lims:id="114780">Defence of superior orders</MarginalNote><Label>14</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="114781" lims:id="114781"><Label>(1)</Label><Text>In proceedings for an offence under any of sections 4 to 7, it is not a defence that the accused was ordered by a government or a superior — whether military or civilian — to perform the act or omission that forms the subject-matter of the offence, unless</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114782" lims:id="114782"><Label>(a)</Label><Text>the accused was under a legal obligation to obey orders of the government or superior;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114783" lims:id="114783"><Label>(b)</Label><Text>the accused did not know that the order was unlawful; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114784" lims:id="114784"><Label>(c)</Label><Text>the order was not manifestly unlawful.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="114785" lims:id="114785"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114786" lims:id="114786">Interpretation — manifestly unlawful</MarginalNote><Label>(2)</Label><Text>For the purpose of paragraph (1)(c), orders to commit genocide or crimes against humanity are manifestly unlawful.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="114787" lims:id="114787"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114788" lims:id="114788">Limitation — belief of accused</MarginalNote><Label>(3)</Label><Text>An accused cannot base their defence under subsection (1) on a belief that an order was lawful if the belief was based on information about a civilian population or an identifiable group of persons that encouraged, was likely to encourage or attempted to justify the commission of inhumane acts or omissions against the population or group.</Text></Subsection></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="114789" lims:id="114789" level="1"><TitleText>Parole Eligibility</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="114790" lims:id="114790"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114791" lims:id="114791">Parole eligibility</MarginalNote><Label>15</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="114792" lims:id="114792"><Label>(1)</Label><Text>The following sentence shall be pronounced against a person who is to be sentenced to imprisonment for life for an offence under section 4 or 6:</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114793" lims:id="114793"><Label>(a)</Label><Text>imprisonment for life without eligibility for parole until the person has served 25 years of the sentence, if a planned and deliberate killing forms the basis of the offence;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114794" lims:id="114794"><Label>(b)</Label><Text>imprisonment for life without eligibility for parole until the person has served 25 years of the sentence, if an intentional killing that is not planned and deliberate forms the basis of the offence, and</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="114795" lims:id="114795"><Label>(i)</Label><Text>the person has previously been convicted of an offence under section 4 or 6 that had, as its basis, an intentional killing, whether or not it was planned and deliberate, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="114796" lims:id="114796"><Label>(ii)</Label><Text>the person has previously been convicted of culpable homicide that is murder, however described in the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114797" lims:id="114797"><Label>(c)</Label><Text>imprisonment for life without eligibility for parole until the person has served at least 10 years of the sentence or any greater number of years, not being more than 25, that has been substituted for it under section 745.4 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, if an intentional killing that is not planned and deliberate forms the basis of the offence; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114798" lims:id="114798"><Label>(d)</Label><Text>imprisonment for life with normal eligibility for parole, in any other case.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="114799" lims:id="114799"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114800" lims:id="114800">Parole eligibility</MarginalNote><Label>(1.1)</Label><Text>The sentence pronounced against a person who is to be sentenced to imprisonment for life for an offence under section 5 or 7 shall be imprisonment for life with normal eligibility for parole.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="114801" lims:id="114801"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114802" lims:id="114802">Provisions of <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> apply</MarginalNote><Label>(2)</Label><Text>Sections 745.1 to 746.1 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> apply, with any modifications that the circumstances require, to a sentence of life imprisonment imposed under this Act, and, for the purpose of applying those provisions,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114803" lims:id="114803"><Label>(a)</Label><Text>a reference in sections 745.1, 745.3, 745.5 and 746.1 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> to first degree murder is deemed to be a reference to an offence under section 4 or 6 of this Act when a planned and deliberate killing forms the basis of the offence;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114804" lims:id="114804"><Label>(b)</Label><Text>a reference in sections 745.1 to 745.5 and 746.1 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> to second degree murder is deemed to be a reference to an offence under section 4 or 6 of this Act when an intentional killing that is not planned and deliberate forms the basis of the offence;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114805" lims:id="114805"><Label>(c)</Label><Text>a reference in sections 745.4 and 746 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> to section 745 of that Act is deemed to be a reference to subsection (1) or (1.1) of this section;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114806" lims:id="114806"><Label>(d)</Label><Text>a reference in section 745.6 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> to the province in which a conviction took place is deemed, in respect of a conviction that took place outside Canada, to be a reference to the province in which the offender is incarcerated when the offender makes an application under that section; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114807" lims:id="114807"><Label>(e)</Label><Text>a reference in section 745.6 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> to murder is deemed to be a reference to an offence under section 4 or 6 of this Act when an intentional killing forms the basis of the offence.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="114808" lims:id="114808"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114809" lims:id="114809">Minimum punishment</MarginalNote><Label>(3)</Label><Text>For the purpose of Part XXIII of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, the sentence of imprisonment for life prescribed by sections 4 and 6 is a minimum punishment when an intentional killing forms the basis of the offence.</Text></Subsection></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="114810" lims:id="114810" level="1"><TitleText>Offences Against the Administration of Justice</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="114811" lims:id="114811"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114812" lims:id="114812">Obstructing justice</MarginalNote><Label>16</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="114813" lims:id="114813"><Label>(1)</Label><Text>Every person who wilfully attempts in any manner to obstruct, pervert or defeat the course of justice of the International Criminal Court is guilty of an indictable offence and liable to imprisonment for a term of not more than 10 years.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="114814" lims:id="114814"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114815" lims:id="114815">When deemed to have obstructed justice</MarginalNote><Label>(2)</Label><Text>Without restricting the generality of subsection (1), every person is deemed wilfully to attempt to obstruct, pervert or defeat the course of justice who in an existing or proposed proceeding of the International Criminal Court</Text><Paragraph lims:inforce-start-date="2002-12-31" abstain from giving evidence.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="114818" lims:id="114818"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114819" lims:id="114819">Obstructing officials</MarginalNote><Label>17</Label><Text>Every person who resists or wilfully obstructs an official of the of judges and officials</MarginalNote><Label>18</Label><Text>Every person is guilty of an indictable offence and is liable to imprisonment for a term of not more than 14 years who</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114824" lims:id="114824"><Label>(a)</Label><Text>being a judge or an official of the International Criminal Court, corruptly accepts, obtains, agrees to an official of the International Criminal Court, any money, valuable consideration, office, place or employment</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="114828" lims:id="114828"><Label>(i)</Label><Text>in respect of anything done or omitted or to be done or omitted by them in their official capacity, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="114829" lims:id="114829"><Label>(ii)</Label><Text>with intent to interfere in any other way with the administration of justice of the International Criminal Court.</Text></Subparagraph></Paragraph></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="114830" lims:id="114830"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114831" lims:id="114831">Perjury</MarginalNote><Label>19</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="114832" lims:id="114832"><Label>(1)</Label><Text>Subject to subsection (5), every person commits perjury who, with intent to mislead, makes a false statement under oath or solemn affirmation, by affidavit, solemn declaration or deposition or orally, knowing that the statement is false, before a judge of the International Criminal Court or an official of that Court who is authorized by the Court to permit statements to be made before them.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="114833" lims:id="114833"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114834" lims:id="114834">Video links, etc.</MarginalNote><Label>(2)</Label><Text>Subject to subsection (5), every person who gives evidence under subsection 46(2) of the <XRefExternal reference-type="act" link="C-5">Canada Evidence Act</XRefExternal>, or gives evidence or a statement under an order made under section 22.2 of the <XRefExternal reference-type="act" link="M-13.6">Mutual Legal Assistance in Criminal Matters Act</XRefExternal>, commits perjury who, with intent to mislead, makes a false statement knowing that it is false, whether or not the false statement was made under oath or solemn affirmation in accordance with subsection (1), so long as the false statement was made in accordance with any formalities required by the law of the place outside Canada in which the person is virtually present or heard.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="114835" lims:id="114835"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="114836" lims:id="114836">Punishment</MarginalNote><Label>(3)</Label><Text>Every person who commits perjury is guilty of an indictable offence and liable evidence, and who, in giving evidence in either proceeding, intends to mislead, is guilty of an indictable offence and liable to imprisonment for a term of not more than 14 years, whether or not the mislead, fabricates anything with intent that it be used as evidence in an existing or proposed proceeding of the International Criminal Court, by any means other than perjury or incitement to perjury, is guilty of an indictable offence and liable to imprisonment for a term of not more than 14 years.</Text></Section><Section lims:inforce-start-date="2002-12-31" affidavits</MarginalNote><Label>22</Label><Text>Every person is guilty of an indictable offence and liable to imprisonment for a term of not more than two years who, in respect of an existing or proposed proceeding of the International Criminal Court,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114854" lims:id="114854"><Label>(a)</Label><Text>signs a writing that purports to be an affidavit or statutory declaration and to have been sworn or declared before them when the writing was not so sworn or declared or when they know that they have no authority to administer the oath or declaration;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114855" lims:id="114855"><Label>(b)</Label><Text>uses or offers for use any writing purporting to be an affidavit or statutory declaration that they know was not sworn or declared, as the case may be, by the affiant or declarant or before a person authorized to administer the oath or declaration; or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="114856" lims:id="114856"><Label>(c)</Label><Text>signs as affiant or declarant a writing that purports to be an affidavit or statutory declaration and to have been sworn or declared by them, as the case may be, when the writing was not so sworn or declared.</Text></Paragraph></Section><Section Against Humanity Fund, with or without a deduction for costs, to the International Criminal Court, the Trust Fund established under article 79 of the Rome Statute, victims of offences under this Act or of offences within the jurisdiction of the International Criminal Court, and to the families of those victims, or otherwise as the Attorney General of Canada sees group;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114909" lims:id="114909" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(b)</Label><Text>causing serious bodily or mental harm to members of the group;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114910" lims:id="114910" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(c)</Label><Text>deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114911" lims:id="114911" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(d)</Label><Text>imposing measures intended to prevent births within the group;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114912" lims:id="114912" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(e)</Label><Text>forcibly transferring children of the group to another group.</Text></Provision></Provision></Group><Group lims:inforce-start-date="2002-12-31" lims:fid="114913" lims:id="114913"><GroupHeading lims:inforce-start-date="2002-12-31" lims:fid="114914" lims:id="114914" format-ref="group1-part"><Label>ARTICLE 7</Label><TitleText>Crimes against humanity</TitleText></GroupHeading><Provision lims:inforce-start-date="2002-12-31" lims:fid="114915" lims:id="114915" format-ref="indent-0-0" language-align="yes" list-item="no"><Label>1</Label><Text>For the purpose of this Statute, <DefinedTermEn>crime against humanity</DefinedTermEn> means any of the following acts when committed as part of a widespread or systematic attack directed against any civilian population, with knowledge of the attack:</Text><Provision lims:inforce-start-date="2002-12-31" lims:fid="114916" lims:id="114916" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(a)</Label><Text>murder;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114917" lims:id="114917" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(b)</Label><Text>extermination;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114918" lims:id="114918" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(c)</Label><Text>enslavement;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114919" lims:id="114919" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(d)</Label><Text>deportation or forcible transfer of population;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114920" lims:id="114920" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(e)</Label><Text>imprisonment or other severe deprivation of physical liberty in violation of fundamental rules of international law;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114921" lims:id="114921" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(f)</Label><Text>torture;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114922" lims:id="114922" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(g)</Label><Text>rape, sexual slavery, enforced prostitution, forced pregnancy, enforced sterilization, or any other form of sexual violence of comparable gravity;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114923" lims:id="114923" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(h)</Label><Text>persecution against any identifiable group or collectivity on political, racial, national, ethnic, cultural, religious, gender as defined in paragraph 3, or other grounds that are universally recognized as impermissible under international law, in connection with any act referred to in this paragraph or any crime within the jurisdiction of the Court;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114924" lims:id="114924" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(i)</Label><Text>enforced disappearance of persons;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114925" lims:id="114925" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(j)</Label><Text>the crime of apartheid;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114926" lims:id="114926" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(k)</Label><Text>other inhumane acts of a similar character intentionally causing great suffering, or serious injury to body or to mental or physical health.</Text></Provision></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114927" lims:id="114927" format-ref="indent-0-0" language-align="yes" list-item="no"><Label>2</Label><Text>For the purpose of paragraph 1:</Text><Provision lims:inforce-start-date="2002-12-31" lims:fid="114928" lims:id="114928" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(a)</Label><Text><DefinedTermEn>attack directed against any civilian population</DefinedTermEn> means a course of conduct involving the multiple commission of acts referred to in paragraph 1 against any civilian population, pursuant to or in furtherance of a State or organizational policy to commit such attack;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114929" lims:id="114929" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(b)</Label><Text><DefinedTermEn>extermination</DefinedTermEn> includes the intentional infliction of conditions of life, <Language xml:lang="la">inter alia</Language> the deprivation of access to food and medicine, calculated to bring about the destruction of part of a population;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114930" lims:id="114930" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(c)</Label><Text><DefinedTermEn>enslavement</DefinedTermEn> means the exercise of any or all of the powers attaching to the right of ownership over a person and includes the exercise of such power in the course of trafficking in persons, in particular women and children;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114931" lims:id="114931" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(d)</Label><Text><DefinedTermEn>deportation or forcible transfer of population</DefinedTermEn> means forced displacement of the persons concerned by expulsion or other coercive acts from the area in which they are lawfully present, without grounds permitted under international law;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114932" lims:id="114932" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(e)</Label><Text><DefinedTermEn>torture</DefinedTermEn> means the intentional infliction of severe pain or suffering, whether physical or mental, upon a person in the custody or under the control of the accused; except that torture shall not include pain or suffering arising only from, inherent in or incidental to, lawful sanctions;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114933" lims:id="114933" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(f)</Label><Text><DefinedTermEn>forced pregnancy</DefinedTermEn> means the unlawful confinement of a woman forcibly made pregnant, with the intent of affecting the ethnic composition of any population or carrying out other grave violations of international law. This definition shall not in any way be interpreted as affecting national laws relating to pregnancy;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114934" lims:id="114934" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(g)</Label><Text><DefinedTermEn>persecution</DefinedTermEn> means the intentional and severe deprivation of fundamental rights contrary to international law by reason of the identity of the group or collectivity;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114935" lims:id="114935" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(h)</Label><Text><DefinedTermEn>the crime of apartheid</DefinedTermEn> means inhumane acts of a character similar to those referred to in paragraph 1, committed in the context of an institutionalized regime of systematic oppression and domination by one racial group over any other racial group or groups and committed with the intention of maintaining that regime;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114936" lims:id="114936" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(i)</Label><Text><DefinedTermEn>enforced disappearance of persons</DefinedTermEn> means the arrest, detention or abduction of persons by, or with the authorization, support or acquiescence of, a State or a political organization, followed by a refusal to acknowledge that deprivation of freedom or to give information on the fate or whereabouts of those persons, with the intention of removing them from the protection of the law for a prolonged period of time.</Text></Provision></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114937" lims:id="114937" format-ref="indent-0-0" language-align="yes" list-item="no"><Label>3</Label><Text>For the purpose of this Statute, it is understood that the term “gender” refers to the two sexes, male and female, within the context of society. The term “gender” does not indicate any meaning different from the above.</Text></Provision></Group><Group lims:inforce-start-date="2002-12-31" lims:fid="114938" lims:id="114938"><GroupHeading lims:inforce-start-date="2002-12-31" lims:fid="114939" lims:id="114939" format-ref="group1-part"><Label>PARAGRAPH 2 OF ARTICLE 8</Label><TitleText>War crimes</TitleText></GroupHeading><Provision lims:inforce-start-date="2002-12-31" lims:fid="114940" lims:id="114940" format-ref="indent-0-0" language-align="yes" list-item="no"><Label>2</Label><Text>For the purpose of this Statute, <DefinedTermEn>war crimes</DefinedTermEn> means:</Text><Provision lims:inforce-start-date="2002-12-31" lims:fid="114941" lims:id="114941" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(a)</Label><Text>grave breaches of the Geneva Conventions of 12 August 1949, namely, any of the following acts against persons or property protected under the provisions of the relevant Geneva Convention:</Text><Provision lims:inforce-start-date="2002-12-31" lims:fid="114942" lims:id="114942" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(i)</Label><Text>wilful killing;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114943" lims:id="114943" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(ii)</Label><Text>torture or inhuman treatment, including biological experiments;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114944" lims:id="114944" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(iii)</Label><Text>wilfully causing great suffering, or serious injury to body or health;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114945" lims:id="114945" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(iv)</Label><Text>extensive destruction and appropriation of property, not justified by military necessity and carried out unlawfully and wantonly;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114946" lims:id="114946" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(v)</Label><Text>compelling a prisoner of war or other protected person to serve in the forces of a hostile Power;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114947" lims:id="114947" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(vi)</Label><Text>wilfully depriving a prisoner of war or other protected person of the rights of fair and regular trial;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114948" lims:id="114948" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(vii)</Label><Text>unlawful deportation or transfer or unlawful confinement;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114949" lims:id="114949" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(viii)</Label><Text>taking of hostages.</Text></Provision></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114950" lims:id="114950" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(b)</Label><Text>other serious violations of the laws and customs applicable in international armed conflict, within the established framework of international law, namely, any of the following acts:</Text><Provision lims:inforce-start-date="2002-12-31" lims:fid="114951" lims:id="114951" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(i)</Label><Text>intentionally directing attacks against the civilian population as such or against individual civilians not taking direct part in hostilities;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114952" lims:id="114952" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(ii)</Label><Text>intentionally directing attacks against civilian objects, that is, objects which are not military objectives;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114953" lims:id="114953" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(iii)</Label><Text>intentionally directing attacks against personnel, installations, material, units or vehicles involved in a humanitarian assistance or peacekeeping mission in accordance with the Charter of the United Nations, as long as they are entitled to the protection given to civilians or civilian objects under the international law of armed conflict;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114954" lims:id="114954" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(iv)</Label><Text>intentionally launching an attack in the knowledge that such attack will cause incidental loss of life or injury to civilians or damage to civilian objects or widespread, long-term and severe damage to the natural environment which would be clearly excessive in relation to the concrete and direct overall military advantage anticipated;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114955" lims:id="114955" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(v)</Label><Text>attacking or bombarding, by whatever means, towns, villages, dwellings or buildings which are undefended and which are not military objectives;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114956" lims:id="114956" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(vi)</Label><Text>killing or wounding a combatant who, having laid down his arms or having no longer means of defence, has surrendered at discretion;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114957" lims:id="114957" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(vii)</Label><Text>making improper use of a flag of truce, of the flag or of the military insignia and uniform of the enemy or of the United Nations, as well as of the distinctive emblems of the Geneva Conventions, resulting in death or serious personal injury;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114958" lims:id="114958" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(viii)</Label><Text>the transfer, directly or indirectly, by the Occupying Power of parts of its own civilian population into the territory it occupies, or the deportation or transfer of all or parts of the population of the occupied territory within or outside this territory;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114959" lims:id="114959" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(ix)</Label><Text>intentionally directing attacks against buildings dedicated to religion, education, art, science or charitable purposes, historic monuments, hospitals and places where the sick and wounded are collected, provided they are not military objectives;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114960" lims:id="114960" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(x)</Label><Text>subjecting persons who are in the power of an adverse party to physical mutilation or to medical or scientific experiments of any kind which are neither justified by the medical, dental or hospital treatment of the person concerned nor carried out in his or her interest, and which cause death to or seriously endanger the health of such person or persons;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114961" lims:id="114961" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(xi)</Label><Text>killing or wounding treacherously individuals belonging to the hostile nation or army;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114962" lims:id="114962" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(xii)</Label><Text>declaring that no quarter will be given;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114963" lims:id="114963" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(xiii)</Label><Text>destroying or seizing the enemy’s property unless such destruction or seizure be imperatively demanded by the necessities of war;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114964" lims:id="114964" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(xiv)</Label><Text>declaring abolished, suspended or inadmissible in a court of law the rights and actions of the nationals of the hostile party;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114965" lims:id="114965" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(xv)</Label><Text>compelling the nationals of the hostile party to take part in the operations of war directed against their own country, even if they were in the belligerent’s service before the commencement of the war;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114966" lims:id="114966" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(xvi)</Label><Text>pillaging a town or place, even when taken by assault;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114967" lims:id="114967" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(xvii)</Label><Text>employing poison or poisoned weapons;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114968" lims:id="114968" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(xviii)</Label><Text>employing asphyxiating, poisonous or other gases, and all analogous liquids, materials or devices;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114969" lims:id="114969" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(xix)</Label><Text>employing bullets which expand or flatten easily in the human body, such as bullets with a hard envelope which does not entirely cover the core or is pierced with incisions;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114970" lims:id="114970" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(xx)</Label><Text>employing weapons, projectiles and material and methods of warfare which are of a nature to cause superfluous injury or unnecessary suffering or which are inherently indiscriminate in violation of the international law of armed conflict, provided that such weapons, projectiles and material and methods of warfare are the subject of a comprehensive prohibition and are included in an annex to this Statute, by an amendment in accordance with the relevant provisions set forth in articles 121 and 123;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114971" lims:id="114971" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(xxi)</Label><Text>committing outrages upon personal dignity, in particular humiliating and degrading treatment;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114972" lims:id="114972" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(xxii)</Label><Text>committing rape, sexual slavery, enforced prostitution, forced pregnancy, as defined in article 7, paragraph 2(f), enforced sterilization, or any other form of sexual violence also constituting a grave breach of the Geneva Conventions;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114973" lims:id="114973" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(xxiii)</Label><Text>utilizing the presence of a civilian or other protected person to render certain points, areas or military forces immune from military operations;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114974" lims:id="114974" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(xxiv)</Label><Text>intentionally directing attacks against buildings, material, medical units and transport, and personnel using the distinctive emblems of the Geneva Conventions in conformity with international law;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114975" lims:id="114975" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(xxv)</Label><Text>intentionally using starvation of civilians as a method of warfare by depriving them of objects indispensable to their survival, including wilfully impeding relief supplies as provided for under the Geneva Conventions;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114976" lims:id="114976" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(xxvi)</Label><Text>conscripting or enlisting children under the age of fifteen years into the national armed forces or using them to participate actively in hostilities.</Text></Provision></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114977" lims:id="114977" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(c)</Label><Text>in the case of an armed conflict not of an international character, serious violations of article 3 common to the four Geneva Conventions of 12 August 1949, namely, any of the following acts committed against persons taking no active part in the hostilities, including members of armed forces who have laid down their arms and those placed <Emphasis style="italic"><Language xml:lang="fr">hors de combat</Language></Emphasis> by sickness, wounds, detention or any other cause:</Text><Provision lims:inforce-start-date="2002-12-31" lims:fid="114978" lims:id="114978" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(i)</Label><Text>violence to life and person, in particular murder of all kinds, mutilation, cruel treatment and torture;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114979" lims:id="114979" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(ii)</Label><Text>committing outrages upon personal dignity, in particular humiliating and degrading treatment;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114980" lims:id="114980" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(iii)</Label><Text>taking of hostages;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114981" lims:id="114981" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(iv)</Label><Text>the passing of sentences and the carrying out of executions without previous judgement pronounced by a regularly constituted court, affording all judicial guarantees which are generally recognized as indispensable.</Text></Provision></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114982" lims:id="114982" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(d)</Label><Text>paragraph 2(c) applies to armed conflicts not of an international character and thus does not apply to situations of internal disturbances and tensions, such as riots, isolated and sporadic acts of violence or other acts of a similar nature.</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114983" lims:id="114983" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(e)</Label><Text>other serious violations of the laws and customs applicable in armed conflicts not of an international character, list-item="no"><Label>(ii)</Label><Text>intentionally directing attacks against buildings, material, medical units and transport, and personnel using the distinctive emblems of the Geneva Conventions in conformity with international law;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114986" lims:id="114986" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(iii)</Label><Text>intentionally directing attacks against personnel, installations, material, units or vehicles involved in a humanitarian assistance or peacekeeping mission in accordance with the Charter of the United Nations, as long as they are entitled to the protection given to civilians or civilian objects under the international law of armed conflict;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114987" lims:id="114987" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(iv)</Label><Text>intentionally directing attacks against buildings dedicated to religion, education, art, science or charitable purposes, historic monuments, hospitals and places where the sick and wounded are collected, provided they are not military objectives;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114988" lims:id="114988" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(v)</Label><Text>pillaging a town or place, even when taken by assault;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114989" lims:id="114989" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(vi)</Label><Text>committing rape, sexual slavery, enforced prostitution, forced pregnancy, as defined in article 7, paragraph 2(f), enforced sterilization, and any other form of sexual violence also constituting a serious violation of article 3 common to the four Geneva Conventions;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114990" lims:id="114990" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(vii)</Label><Text>conscripting or enlisting children under the age of fifteen years into armed forces or groups or using them to participate actively in hostilities;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114991" lims:id="114991" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(viii)</Label><Text>ordering the displacement of the civilian population for reasons related to the conflict, unless the security of the civilians involved or imperative military reasons so demand;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114992" lims:id="114992" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(ix)</Label><Text>killing or wounding treacherously a combatant adversary;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114993" lims:id="114993" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(x)</Label><Text>declaring that no quarter will be given;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114994" lims:id="114994" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(xi)</Label><Text>subjecting persons who are in the power of another party to the conflict to physical mutilation or to medical or scientific experiments of any kind which are neither justified by the medical, dental or hospital treatment of the person concerned nor carried out in his or her interest, and which cause death to or seriously endanger the health of such person or persons;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="114995" lims:id="114995" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(xii)</Label><Text>destroying or seizing the property of an adversary unless such destruction or seizure be imperatively demanded by riots, isolated and sporadic acts of violence or other acts of a similar nature.
