and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="112400" lims:id="112400"><Label>(c)</Label><Text>enhance accountability for the use of public money in support of court administration while safeguarding the independence of the judiciary.</Text></Paragraph></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="112401" lims:id="112401" level="1"><TitleText>Courts Administration Service</TitleText></Heading><Section lims:inforce-start-date="2005-04-01" lims:lastAmendedDate="2005-04-01" lims:fid="112402" lims:id="112402"><MarginalNote lims:inforce-start-date="2005-04-01" lims:fid="112403" lims:id="112403">Establishment of Service</MarginalNote><Label>3</Label><Text>The Courts Administration Service (in this Act referred to as the “Service”), consisting of the Chief Administrator of the Service and employees of the Service, is hereby established as a portion of the federal public administration.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2005-04-01" lims:fid="112405" lims:id="112405">2002, c. 8, s. 3; 2003, c. 22, s. 156(E)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="112406" lims:id="112406"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="112407" lims:id="112407">Principal office</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="112408" lims:id="112408"><Label>(1)</Label><Text>The principal office of the Service shall be in the National Capital Region described in the schedule to the <XRefExternal reference-type="act" link="N-4">National Capital Act</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="112409" lims:id="112409"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="112410" lims:id="112410">Other offices</MarginalNote><Label>(2)</Label><Text>The Chief Administrator may, after consultation with the Chief Justices of the Federal Court of Appeal, the Federal Court, the Court Martial Appeal Court and the Tax Court of Canada, establish other offices of the Service elsewhere in Canada.</Text></Subsection></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="112411" lims:id="112411" level="1"><TitleText>Chief Administrator</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="112412" lims:id="112412"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="112413" lims:id="112413">Appointment</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="112414" lims:id="112414"><Label>(1)</Label><Text>The Governor in Council shall appoint the Chief Administrator to hold office during pleasure for a term of up to five years.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="112415" lims:id="112415"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="112416" lims:id="112416">Re-appointment</MarginalNote><Label>(2)</Label><Text>The Chief Administrator is eligible for re-appointment at the end of each term of office.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="112417" lims:id="112417"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="112418" lims:id="112418">Consultations</MarginalNote><Label>(3)</Label><Text>The Minister of Justice shall consult the Chief Justices of the Federal Court of Appeal, the Federal Court, the Court Martial Appeal Court and the Tax Court of Canada with respect to the appointment and re-appointment of the Chief Administrator and, if applicable, the termination of the Chief Administrator’s appointment.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="112419" lims:id="112419"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="112420" lims:id="112420">Status of Chief Administrator</MarginalNote><Label>(4)</Label><Text>The Chief Administrator shall have the rank and status of a deputy head of a department.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="112421" lims:id="112421"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="112422" lims:id="112422">Absence or incapacity</MarginalNote><Label>(5)</Label><Text>If the Chief Administrator is absent or incapacitated or the office of Chief Administrator is vacant, the Minister of Justice shall appoint another person to act as Chief Administrator. That person may not act as Chief Administrator for more than 90 days unless the Governor in Council, on the recommendation of the Minister of Justice after consultation by that Minister with the Chief Justices of the Federal Court of Appeal, the Federal Court, the Court Martial Appeal Court and the Tax Court of Canada, confirms that the person may continue to act as Chief Administrator.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="112423" lims:id="112423"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="112424" lims:id="112424">Powers, duties and functions</MarginalNote><Label>(6)</Label><Text>The person acting as Chief Administrator has all of the powers, duties and functions of the Chief Administrator under this Act or any other Act of Parliament.</Text></Subsection></Section><Section lims:inforce-start-date="2005-04-01" lims:lastAmendedDate="2005-04-01" lims:fid="112425" lims:id="112425"><MarginalNote lims:inforce-start-date="2005-04-01" lims:fid="112426" lims:id="112426">Salary and expenses</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2005-04-01" lims:fid="112427" lims:id="112427"><Label>(1)</Label><Text>The Chief Administrator shall receive the remuneration that may be fixed by the Governor in Council and is entitled to be paid reasonable travel and living expenses incurred in the performance of his or her duties and functions under this Act while absent from the Chief Administrator’s ordinary place of work.</Text></Subsection><Subsection lims:inforce-start-date="2005-04-01" lims:fid="112428" lims:id="112428"><MarginalNote lims:inforce-start-date="2005-04-01" lims:fid="112429" lims:id="112429">Compensation</MarginalNote><Label>(2)</Label><Text>The Chief Administrator is deemed to be a person employed in the public service for the purposes of the <XRefExternal reference-type="act" link="P-36">Public Service Superannuation Act</XRefExternal> and to be employed in the federal public administration for the purposes of the <XRefExternal reference-type="act" link="G-5">Government Employees Compensation Act</XRefExternal> and any regulations made under section 9 of the <XRefExternal reference-type="act" link="A-2">Aeronautics Act</XRefExternal>.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2005-04-01" lims:fid="112431" lims:id="112431">2002, c. 8, s. 6; 2003, c. 22, s. 157(E)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="112432" lims:id="112432" level="1"><TitleText>Powers, Duties and Functions of Chief Administrator</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="112433" lims:id="112433"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="112434" lims:id="112434">Chief Administrator</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="112435" lims:id="112435"><Label>(1)</Label><Text>The Chief Administrator is the chief executive officer of the Service and has supervision over and direction of its work and staff.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="112436" lims:id="112436"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="112437" lims:id="112437">Powers</MarginalNote><Label>(2)</Label><Text>The Chief Administrator has all the powers necessary for the overall effective and efficient management and administration of all court services, including court facilities and libraries and corporate services and staffing.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="112438" lims:id="112438"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="112439" lims:id="112439">Duties and functions</MarginalNote><Label>(3)</Label><Text>The Chief Administrator, in consultation with the Chief Justices of the Federal Court of Appeal, the Federal Court, the Court Martial Appeal Court and the Tax Court of Canada, shall establish and maintain the registry or registries for those courts in any organizational form or forms and prepare budgetary submissions for the requirements of those courts and for the related needs of the Service.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="112440" lims:id="112440"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="112441" lims:id="112441">Limitation</MarginalNote><Label>(4)</Label><Text>The powers of the Chief Administrator do not extend to any matter assigned by law to the judiciary.</Text></Subsection></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="112442" lims:id="112442" level="1"><TitleText>Chief Justices</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="112443" lims:id="112443"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="112444" lims:id="112444">Judicial functions</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="112445" lims:id="112445"><Label>(1)</Label><Text>The Chief Justices of the Federal Court of Appeal, the Federal Court, the Court Martial Appeal Court and the Tax Court of Canada are responsible for the judicial functions of their courts, including the direction and supervision over court sittings and the assignment of judicial duties.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="112446" lims:id="112446"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="112447" lims:id="112447">Included powers</MarginalNote><Label>(2)</Label><Text>The direction and supervision over court sittings and the assignment of judicial duties include, without restricting the generality of those terms, the power to</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="112448" lims:id="112448"><Label>(a)</Label><Text>determine the sittings of the court;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="112449" lims:id="112449"><Label>(b)</Label><Text>assign judges to sittings;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="112450" lims:id="112450"><Label>(c)</Label><Text>assign cases and other judicial duties to judges;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="112451" lims:id="112451"><Label>(d)</Label><Text>determine the sitting schedules and places of sittings for judges;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="112452" lims:id="112452"><Label>(e)</Label><Text>determine the total annual, monthly and weekly work load of judges; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="112453" lims:id="112453"><Label>(f)</Label><Text>prepare hearing lists and assign courtrooms.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="112454" lims:id="112454"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="112455" lims:id="112455">Directions by Chief Justice</MarginalNote><Label>(3)</Label><Text>Officers, clerks and employees of the Service shall act at the direction of a chief justice in matters that are assigned by law to the judiciary.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="112456" lims:id="112456"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="112457" lims:id="112457">Directions by judge</MarginalNote><Label>(4)</Label><Text>The persons referred to in subsection (3) who are assigned to or present in a courtroom shall act at the direction of the judge presiding over proceedings in the courtroom while the court is in session.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="112458" lims:id="112458"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="112459" lims:id="112459">Direction to Chief Administrator</MarginalNote><Label>9</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="112460" lims:id="112460"><Label>(1)</Label><Text>A chief justice may issue binding directions in writing to the Chief Administrator with respect to any matter within the Chief Administrator’s authority.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="112461" lims:id="112461"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="112462" lims:id="112462"><XRefExternal reference-type="act" link="S-22">Statutory Instruments Act</XRefExternal> not to specialized knowledge for the purposes of advising and assisting the Chief Administrator in the performance of his or her duties and functions in any matter.</Text></Section><Heading reference-type="regulation">Federal Court Rules, 1998</XRefExternal> that govern applications to the Federal Court of Appeal under section 28 of the <XRefExternal reference-type="act" link="F-7">Federal Courts Act</XRefExternal> apply to appeals to the Federal Court of Appeal under subsection 27(1.2) of that Act, with any modifications that the circumstances require, until other
