lims:id="86294"><Label>(1)</Label><Text>In this Act,</Text><Definition lims:inforce-start-date="2017-09-21" lims:fid="86295" lims:id="86295"><Text><DefinedTermEn>Agency</DefinedTermEn> means the Canadian Transportation Agency; (<DefinedTermFr>Office</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2021-04-01" lims:enacted-date="2021-03-17" lims:fid="1291101" lims:id="1291101"><Text><DefinedTermEn>British entity</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2021-04-01" lims:enacted-date="2021-03-17" lims:fid="1291102" lims:id="1291102"><Label>(a)</Label><Text>a corporation that is incorporated in the territory of the United Kingdom, or</Text></Paragraph><Paragraph lims:inforce-start-date="2021-04-01" lims:enacted-date="2021-03-17" lims:fid="1291103" lims:id="1291103"><Label>(b)</Label><Text>a trust, partnership, joint venture or other association that is formed in the territory of the United Kingdom; (<DefinedTermFr>entité britannique</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2017-09-21" lims:fid="86296" lims:id="86296"><Text><DefinedTermEn>Canadian entity</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2017-09-21" lims:fid="86297" lims:id="86297"><Label>(a)</Label><Text>a corporation that is incorporated in Canada, or</Text></Paragraph><Paragraph lims:inforce-start-date="2017-09-21" lims:fid="86298" lims:id="86298"><Label>(b)</Label><Text>a trust, partnership, joint venture or other association that is formed in Canada; (<DefinedTermFr>entité canadienne</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2017-09-21" lims:fid="86299" lims:id="86299"><Text><DefinedTermEn>Canadian ship</DefinedTermEn> means a Canadian vessel, as defined in section 2 of the <XRefExternal reference-type="act" link="C-10.15">Canada Shipping Act, 2001</XRefExternal>, in respect of which all duties and taxes imposed under the <XRefExternal reference-type="act" link="C-54.011">Customs Tariff</XRefExternal> and the <XRefExternal reference-type="act" link="E-15">Excise Tax Act</XRefExternal> have been paid; (<DefinedTermFr>navire canadien</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-09-21" lims:fid="86300" lims:id="86300"><Text><DefinedTermEn>Canadian waters</DefinedTermEn> means the inland waters within the meaning of section 2 of the <XRefExternal reference-type="act" link="C-52.6">Customs Act</XRefExternal>, the internal waters of Canada and the territorial sea of Canada; (<DefinedTermFr>eaux canadiennes</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-09-21" lims:fid="86301" lims:id="86301"><Text><DefinedTermEn>CETA</DefinedTermEn> has the same meaning as <DefinitionRef>Agreement</DefinitionRef> in section <XRefInternal>2</XRefInternal> of the <XRefExternal reference-type="act" link="C-4.8">Canada–European Union Comprehensive Economic and Trade Agreement Implementation Act</XRefExternal>; (<DefinedTermFr>AÉCG</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-09-21" lims:fid="86302" lims:id="86302"><Text><DefinedTermEn>coasting trade</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2017-09-21" lims:fid="86303" lims:id="86303"><Label>(a)</Label><Text>the carriage of goods by ship, or by ship and any other mode of transport, from one place in Canada or above the continental shelf of Canada to any other place in Canada or above the continental shelf of Canada, either directly or by way of a place outside Canada, but, with respect to waters above the continental shelf of Canada, includes the carriage of goods only in relation to the exploration, exploitation or transportation of the mineral or non-living natural resources of the continental shelf of Canada,</Text></Paragraph><Paragraph lims:inforce-start-date="2017-09-21" lims:fid="86304" lims:id="86304"><Label>(b)</Label><Text>subject to paragraph (c), the carriage of passengers by ship from any place in Canada situated on a lake or river to the same place, or to any other place in Canada, either directly or by way of a place outside Canada,</Text></Paragraph><Paragraph lims:inforce-start-date="2017-09-21" lims:fid="86305" lims:id="86305"><Label>(c)</Label><Text>the carriage of passengers by ship from any place situated on the St. Lawrence River northeast of the Saint Lambert lock or on the Fraser River west of the Mission Bridge</Text><Subparagraph lims:inforce-start-date="2017-09-21" lims:fid="86306" lims:id="86306"><Label>(i)</Label><Text>to the same place, without any call at any port outside Canada, other than one or more technical or emergency calls, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-09-21" lims:fid="86307" lims:id="86307"><Label>(ii)</Label><Text>to any other place in Canada, other than as an in-transit call, either directly or by way of a place outside Canada,</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2017-09-21" lims:fid="86308" lims:id="86308"><Label>(d)</Label><Text>the carriage of passengers by ship from any place in Canada other than from a place to which paragraph (b) or (c) applies</Text><Subparagraph lims:inforce-start-date="2017-09-21" lims:fid="86309" lims:id="86309"><Label>(i)</Label><Text>to the Canada,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-09-21" lims:fid="86313" lims:id="86313"><Label>(ii)</Label><Text>from any place above the continental shelf of Canada to any place in Canada, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-09-21" lims:fid="86314" lims:id="86314"><Label>(iii)</Label><Text>from any place above the continental shelf of Canada to the same place or to any other place above the continental shelf of Canada</Text></Subparagraph><ContinuedParagraph lims:inforce-start-date="2017-09-21" lims:fid="86315" lims:id="86315"><Text>where the carriage of the passengers is in relation to the exploration, exploitation or transportation of the mineral or non-living natural resources of the continental shelf of Canada, and</Text></ContinuedParagraph></Paragraph><Paragraph lims:inforce-start-date="2017-09-21" lims:fid="86316" lims:id="86316"><Label>(f)</Label><Text>the engaging, by ship, in any other marine activity of a commercial nature in Canadian waters and, with respect to waters above the continental shelf of Canada, in such other marine activities of a commercial nature that are in relation to the exploration, exploitation or transportation of the mineral or non-living natural resources of the continental shelf of Canada; (<DefinedTermFr>cabotage</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2017-09-21" lims:fid="86317" lims:id="86317"><Text><DefinedTermEn>continental shelf</DefinedTermEn><Repealed>[Repealed, 1996, c. 31, s. 66]</Repealed></Text></Definition><Definition lims:inforce-start-date="2021-04-01" lims:enacted-date="2021-03-17" lims:fid="1291276" lims:id="1291276"><Text><DefinedTermEn>CUKTCA</DefinedTermEn> has the meaning assigned by the definition <DefinitionRef>Agreement</DefinitionRef> in section 2 of the <XRefExternal reference-type="act" link="C-10.56">Canada–United Kingdom Trade Continuity Agreement Implementation Act</XRefExternal>; (<DefinedTermFr>ACCCRU</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-09-21" lims:fid="86318" lims:id="86318"><Text><DefinedTermEn>enforcement officer</DefinedTermEn> means a person designated pursuant to section 12 to be an enforcement officer for the purposes of this Act; (<DefinedTermFr>agent de l’autorité</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-09-21" lims:fid="86319" lims:id="86319"><Text><DefinedTermEn>EU entity</DefinedTermEn> means </Text><Paragraph lims:inforce-start-date="2017-09-21" lims:fid="86320" lims:id="86320"><Label>(a)</Label><Text>a corporation that is incorporated in the territory of the European Union, or</Text></Paragraph><Paragraph lims:inforce-start-date="2017-09-21" lims:fid="86321" lims:id="86321"><Label>(b)</Label><Text>a trust, partnership, joint venture or other association that is formed in the territory of the European Union; (<DefinedTermFr>entité de l’Union européenne</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2017-09-21" lims:fid="86322" lims:id="86322"><Text><DefinedTermEn>foreign ship</DefinedTermEn> means a ship other than a Canadian ship or a non-duty paid ship; (<DefinedTermFr>navire étranger</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-09-21" lims:fid="86323" lims:id="86323"><Text><DefinedTermEn>in-transit call</DefinedTermEn> means any call, other than an emergency or technical call, by a ship at any place where passengers go ashore temporarily but who re-board the vessel before the ship leaves that place or are transported by land to another location to re-board the same ship; (<DefinedTermFr>escale de transit</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-09-21" lims:fid="86324" lims:id="86324"><Text><DefinedTermEn>licence</DefinedTermEn> means a document, issued pursuant to this Act, authorizing a foreign ship or a non-duty paid ship to engage in the coasting trade while in Canadian waters or in waters above the continental shelf of Canada; (<DefinedTermFr>licence</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-09-21" lims:fid="86325" lims:id="86325"><Text><DefinedTermEn>master</DefinedTermEn>, in relation to a ship, has the same meaning as in section 2 of the <XRefExternal reference-type="act" link="C-10.15">Canada Shipping Act, 2001</XRefExternal>; (<DefinedTermFr>capitaine</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-09-21" lims:fid="86326" lims:id="86326"><Text><DefinedTermEn>non-duty paid ship</DefinedTermEn> means a ship registered in Canada in respect of which any duties and taxes under the <XRefExternal reference-type="act" link="C-54.011">Customs Tariff</XRefExternal> and the <XRefExternal reference-type="act" link="E-15">Excise Tax Act</XRefExternal> have not been paid; (<DefinedTermFr>navire non dédouané</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-09-21" lims:fid="86327" lims:id="86327"><Text><DefinedTermEn>owner</DefinedTermEn>, in relation to a ship, means the person having for the time being, either by law or by contract, the rights of the owner of the ship with respect to its possession and use; (<DefinedTermFr>propriétaire</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-09-21" lims:fid="86328" lims:id="86328"><Text><DefinedTermEn>resident in Canada</DefinedTermEn> has the meaning given to that expression by section 250 of the <XRefExternal reference-type="act" link="I-3.3">Income Tax Act</XRefExternal>; (<DefinedTermFr>résident du Canada</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-09-21" lims:fid="86329" lims:id="86329"><Text><DefinedTermEn>ship</DefinedTermEn> has the same meaning as <DefinitionRef>vessel</DefinitionRef> in section 2 of the <XRefExternal reference-type="act" link="C-10.15">Canada Shipping Act, 2001</XRefExternal>; (<DefinedTermFr>navire</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-09-21" lims:fid="86330" lims:id="86330"><Text><DefinedTermEn>technical call</DefinedTermEn> means any call, other than an emergency call or an in-transit call, that is for a purpose other than the embarking or disembarking of passengers; (<DefinedTermFr>escale technique</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2021-04-01" lims:enacted-date="2021-03-17" lims:fid="86331" lims:id="1291278"><Text><DefinedTermEn>territory of the European Union</DefinedTermEn> means the territory in which the Treaty on European Union, done at Maastricht on February 7, 1992, and the Treaty Establishing the European Economic Community, done at Rome on March 25, 1957 — renamed the Treaty on the Functioning of the European Union — as they are amended from time to time, are applicable, in accordance with the conditions specified in those treaties; (<DefinedTermFr>territoire de l’Union européenne</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2021-04-01" lims:enacted-date="2021-03-17" lims:fid="1291277" lims:id="1291277"><Text><DefinedTermEn>territory of the United Kingdom</DefinedTermEn> means a territory referred to in Article 1.3, subparagraph (b) of CETA as incorporated by reference in CUKTCA. (<DefinedTermFr>territoire du Royaume-Uni</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2017-09-21" lims:fid="86332" lims:id="86332"><MarginalNote lims:inforce-start-date="2017-09-21" lims:fid="86333" lims:id="86333">Meaning of <DefinitionRef>place</DefinitionRef></MarginalNote><Label>(2)</Label><Text>For the purpose of the definition <DefinitionRef>coasting trade</DefinitionRef> in subsection (1), a place above the continental shelf of Canada includes any ship, offshore drilling unit, production platform, artificial island, subsea installation, pumping station, living accommodation, storage structure, loading or landing platform, dredge, floating crane, pipelaying or other barge or pipeline and any anchor, anchor cable or rig pad used in connection therewith.</Text></Subsection><Subsection lims:inforce-start-date="2017-09-21" lims:fid="86334" lims:id="86334"><MarginalNote lims:inforce-start-date="2017-09-21" lims:fid="86335" lims:id="86335">Delegation</MarginalNote><Label>(3)</Label><Text>Any power, duty or function of the Minister of Public Safety and Emergency Preparedness or the Minister of Transport under this Act may be exercised or performed by any person authorized by that Minister, as the case may be, to do so and, if so exercised or performed, shall be deemed to have been exercised by that 31</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2017-09-21" lims:fid="86338" lims:id="86338" level="1"><TitleText>Regulation of Foreign Ships and Non-duty Paid Ships</TitleText></Heading><Section lims:inforce-start-date="2018-12-10" lims:lastAmendedDate="2021-04-01" lims:fid="86339" lims:id="86339"><MarginalNote lims:inforce-start-date="2018-12-10" lims:fid="86340" lims:id="86340">Prohibition</MarginalNote><Label>3</Label><Subsection lims:inforce-start-date="2018-12-10" lims:fid="86341" lims:id="86341"><Label>(1)</Label><Text>No foreign ship or non-duty paid ship shall, except in accordance with a licence, engage in the coasting trade.</Text></Subsection><Subsection lims:inforce-start-date="2018-12-10" lims:fid="86342" lims:id="86342"><MarginalNote lims:inforce-start-date="2018-12-10" lims:fid="86343" lims:id="86343">Application</MarginalNote><Label>(2)</Label><Text>Subsection (1) does not apply in respect of any foreign ship or non-duty paid ship that is</Text><Paragraph lims:inforce-start-date="2018-12-10" lims:fid="86344" lims:id="86344"><Label>(a)</Label><Text>used as a fishing vessel, as defined by the <XRefExternal reference-type="act" link="C-33">Coastal Fisheries Protection Act</XRefExternal>, in any activity governed by that Act and that does not carry any goods or passengers other than goods or passengers incidental to any activity governed by that Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-12-10" lims:fid="86345" lims:id="86345"><Label>(b)</Label><Text>engaged in any ocean research activity commissioned by the Department of Fisheries and Oceans;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-12-10" lims:fid="86346" lims:id="86346"><Label>(c)</Label><Text>operated or sponsored by a foreign government that has sought and received the consent of the Minister of Foreign Affairs to conduct marine scientific research;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-12-10" lims:fid="86347" lims:id="86347"><Label>(c.1)</Label><Text>engaged in seismic activities in waters above the continental shelf of Canada that are in relation to the exploration for mineral or non-living natural resources of the continental shelf of Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-12-10" lims:fid="86348" lims:id="86348"><Label>(d)</Label><Text>engaged in salvage operations, except where such operations are performed in Canadian waters; or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-12-10" lims:fid="86349" lims:id="86349"><Label>(e)</Label><Text>engaged, with the approval of a person designated as a pollution response officer under section 174.1 of the <XRefExternal reference-type="act" link="C-10.15">Canada Shipping Act, 2001</XRefExternal>, in activities related to a marine pollution emergency, or to a risk of a marine pollution emergency.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-12-10" lims:fid="86350" lims:id="86350"><MarginalNote lims:inforce-start-date="2018-12-10" lims:fid="86351" lims:id="86351">Repositioning of empty containers</MarginalNote><Label>(2.1)</Label><Text>Subsection (1) does not apply in respect of carriage between one place in Canada and another, without consideration, of empty containers that are owned or leased by the ship’s owner and of any ancillary equipment that is necessary to ensure the safety, security, containment and preservation of the goods that may be carried in those containers.</Text></Subsection><Subsection lims:inforce-start-date="2021-04-01" lims:enacted-date="2021-03-17" lims:fid="1291280" lims:id="1291280"><MarginalNote lims:inforce-start-date="2021-04-01" lims:enacted-date="2021-03-17" lims:fid="1291281" lims:id="1291281">Dredging activities</MarginalNote><Label>(2.11)</Label><Text>Subsection (1) does not apply in respect of dredging activities — other than dredging activities that are provided under an agreement with Her Majesty in right of Canada or with an entity that is listed either in Annex 19-1, as amended from time to time, of Chapter Nineteen of CETA or in Annex 19-1 of Chapter Nineteen of CETA as incorporated by reference in CUKTCA — carried out by</Text><Paragraph lims:inforce-start-date="2021-04-01" lims:enacted-date="2021-03-17" lims:fid="1291282" lims:id="1291282"><Label>(a)</Label><Text>a non-duty paid ship whose owner is a Canadian entity, an EU entity or a British entity; or</Text></Paragraph><Paragraph lims:inforce-start-date="2021-04-01" lims:enacted-date="2021-03-17" lims:fid="1291283" lims:id="1291283"><Label>(b)</Label><Text>a foreign ship whose owner is a Canadian entity, an EU entity or a British entity and that is registered in a register other than</Text><Subparagraph lims:inforce-start-date="2021-04-01" lims:enacted-date="2021-03-17" lims:fid="1291284" lims:id="1291284"><Label>(i)</Label><Text>the Canadian Register of Vessels, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2021-04-01" lims:enacted-date="2021-03-17" lims:fid="1291285" lims:id="1291285"><Label>(ii)</Label><Text>a register referred to in paragraph (2.2)(a) or (b) or (2.21)(a) or (b).</Text></Subparagraph></Paragraph></Subsection><Subsection lims:id="86362"><MarginalNote lims:inforce-start-date="2018-12-10" lims:fid="86363" lims:id="86363">Feeder services — single trip</MarginalNote><Label>(2.4)</Label><Text lims:inforce-start-date="2021-04-01" lims:enacted-date="2021-03-17" lims:fid="1288465" lims:id="1291295">Subject to subsection (2.5), subsection (1) does not apply in respect of the carriage, by a ship that is described in paragraph (2.2)(b) or (2.21)(b), of goods in a container from the port of Montreal to the port of Halifax, or vice versa, if</Text><Paragraph lims:inforce-start-date="2018-12-10" lims:fid="86364" lims:id="86364"><Label>(a)</Label><Text>that carriage is one leg of the importation of the goods into or exportation from Canada; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-12-10" lims:fid="86365" lims:id="86365"><Label>(b)</Label><Text>the container is at least 6.1 metres in length and has an internal volume of at least 14 cubic metres, is designed for carrying goods more than once and by one or more modes of transportation, and does not have wheels or is not otherwise built for being driven or drawn.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-12-10" lims:fid="86366" lims:id="86366"><MarginalNote lims:inforce-start-date="2018-12-10" lims:fid="86367" lims:id="86367">Subsequent coasting trade subject to subsection (1)</MarginalNote><Label>(2.5)</Label><Text>Once a ship has completed a carriage of goods as described in subsection (2.4), subsection (1) applies to the ship in respect of any such subsequent carriage of goods by the ship, until it departs from the exclusive economic zone of Canada or from the <DefinitionRef>inland waters</DefinitionRef>, as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="C-52.6">Customs Act</XRefExternal>, at a location where the inland waters are contiguous to the lims:enacted-date="2021-03-17" lims:fid="1291297" lims:id="1291297">Provision of information</MarginalNote><Label>(2.6)</Label><Text>Before a ship engages, without a licence, in any activities referred to in subsections (2.11) to (2.4) and for which the owner of the ship intends to rely on an exemption under any one of those subsections, the owner shall provide information to an enforcement officer, in the form and manner specified by the Minister, establishing that the ship meets the applicable conditions under any of subsections (2.11) to (2.21).</Text></Subsection><Subsection lims:inforce-start-date="2018-12-10" lims:fid="86370" lims:id="86370"><MarginalNote lims:inforce-start-date="2018-12-10" lims:fid="86371" lims:id="86371">Assistance in cases of distress</MarginalNote><Label>(3)</Label><Text>Nothing in this section precludes a foreign ship or a non-duty paid ship from rendering assistance to persons, ships or aircraft in danger or distress in resident in Canada acting on behalf of a foreign ship, the Minister of Public Safety and Emergency Preparedness shall issue a licence in respect of the foreign ship, where the Minister is satisfied that</Text><Paragraph lims:inforce-start-date="2005-12-12" lims:fid="86394" lims:id="86394"><Label>(a)</Label><Text>the Agency has determined that no Canadian ship or non-duty paid ship is suitable and available to provide the service or perform the activity described in the application;</Text></Paragraph><Paragraph lims:inforce-start-date="2005-12-12" lims:fid="86395" lims:id="86395"><Label>(b)</Label><Text>where the activity described in the application entails the carriage of passengers by ship, the Agency has determined that an identical or similar adequate marine service is not available from any person operating one or more Canadian ships;</Text></Paragraph><Paragraph lims:inforce-start-date="2005-12-12" lims:fid="86396" lims:id="86396"><Label>(c)</Label><Text>arrangements have been made for the payment of the duties and taxes under the <XRefExternal reference-type="act" link="C-54.011">Customs Tariff</XRefExternal> and the <XRefExternal reference-type="act" link="E-15">Excise Tax Act</XRefExternal> applicable to the foreign ship in relation to its temporary use in Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2005-12-12" lims:fid="86397" lims:id="86397"><Label>(d)</Label><Text>all certificates and documents relating to the foreign ship issued pursuant to shipping conventions to which Canada is a party are valid and in force; and</Text></Paragraph><Paragraph lims:inforce-start-date="2005-12-12" lims:fid="86398" lims:id="86398"><Label>(e)</Label><Text>the foreign ship meets all safety and pollution prevention requirements imposed by any law of Canada applicable to that foreign ship.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2005-12-12" lims:inforce-start-date="2018-12-10" lims:fid="86416" lims:id="86416">Total value of agreement</MarginalNote><Label>(2)</Label><Text>Subsection (1) applies only if the total value of the agreement of which the dredging activities form a part is equal to or greater than the threshold — the sum in Canadian dollars which the Minister for International Trade determines to be equivalent, for a period which he or she determines, to 5 million special drawing rights issued by the International Monetary Fund — that is applicable on the day of the issuance of the call or request for bids or tenders lims:id="86422"><Label>(a)</Label><Text>the service or activity that is to be performed by the foreign ship or non-duty paid ship to which the licence relates; and</Text></Paragraph><Paragraph lims:inforce-start-date="2005-12-12" lims:fid="86423" lims:id="86423"><Label>(b)</Label><Text>the place or places where the foreign ship or non-duty paid ship may perform that service or activity.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2005-12-12" lims:fid="86424" lims:id="86424"><MarginalNote lims:inforce-start-date="2005-12-12" lims:fid="86425" lims:id="86425">Effective period of licence</MarginalNote><Label>(2)</Label><Text>Every licence shall set out the period of time for which it is valid, which period may not exceed</Text><Paragraph lims:inforce-start-date="2005-12-12" lims:fid="86426" lims:id="86426"><Label>(a)</Label><Text>in the case of a foreign ship, the earlier of twelve months and the expiration of any certificate or document referred to in paragraph 4(1)(d); or</Text></Paragraph><Paragraph lims:inforce-start-date="2005-12-12" lims:fid="86427" lims:id="86427"><Label>(b)</Label><Text>in the case of a non-duty paid from the applicant for the licence to which the determination relates, and from the owner of any Canadian ship or non-duty ship to which the determination relates, such information and documentation lims:id="86452"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="86453" lims:id="86453">Unfair practices</MarginalNote><Label>11</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="86454" lims:id="86454"><Label>(1)</Label><Text>Where the Minister of Transport is of the opinion that a government of any country has engaged in unfair, discriminatory or restrictive practices with respect to the use of Canadian ships in commercial activities in waters of that country, the Minister of Transport and the Minister of Foreign Affairs shall seek elimination of those practices through consultations with the government of that country.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="86455" lims:id="86455"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="86456" lims:id="86456">Idem</MarginalNote><Label>(2)</Label><Text>Where the consultations referred to in subsection (1) fail to result in the elimination of the practices referred to in that subsection, the Governor in Council may, on the recommendation of the Minister of Transport and the Minister of Foreign Affairs, take such action as the Governor of Transport may designate any person or class of persons as enforcement officers and shall furnish every enforcement officer with a certificate of that designation.</Text></Subsection><Subsection designation</MarginalNote><Label>(2)</Label><Text>In carrying out the duties and functions of an enforcement officer under this Act, an enforcement officer shall, if so requested, produce the certificate of designation referred to in subsection (1) to the person appearing to be in charge of any ship in respect of which the enforcement officer is lims:id="86467">Offence</MarginalNote><Label>13</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="86468" lims:id="86468"><Label>(1)</Label><Text>Where a ship contravenes subsection 3(1), the ship is guilty of an offence and is liable on summary conviction to a fine not exceeding fifty thousand dollars.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="86469" lims:id="86469"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="86470" lims:id="86470">Deemed separate offence</MarginalNote><Label>(2)</Label><Text>Where an offence is committed by a ship under subsection (1) on more than one day or is continued by the ship for more than one day, it shall be deemed to be a separate offence for each day on which the offence is lims:id="86473"><Label>(1)</Label><Text>Where a ship is charged with an offence under section 13, any court in Canada that would have had jurisdiction in respect of the offence if that offence had been committed within the limits of the court’s ordinary jurisdiction has jurisdiction to try the offence as if it had been committed in the court’s jurisdiction.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="86474" lims:id="86474"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="86475" lims:id="86475">Service on ship and appearance at trial</MarginalNote><Label>(2)</Label><Text>Where a ship is charged with an offence under section 13, the summons in relation thereto may be served by leaving it with the master or any officer of the ship or by posting the summons on a conspicuous part of the ship, and the ship may appear by counsel or agent but, if it does not appear, a court may, on proof of service of the summons, proceed <Language xml:lang="la">ex parte</Language> to hold the trial.</Text></Subsection></Section><Heading lims:inforce-start-date="2017-09-21" lims:fid="86476" lims:id="86476" level="1"><TitleText>Searches</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="86477" lims:id="86477"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="86478" lims:id="86478">Powers of enforcement officer</MarginalNote><Label>15</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="86479" lims:id="86479"><Label>(1)</Label><Text>Where an enforcement officer believes on reasonable grounds that a ship has contravened this Act, the enforcement officer may stop and board the ship and, with a warrant, search the ship and seize anything found in or on the ship that the enforcement officer believes on reasonable grounds will afford evidence with respect to any contravention of this Act.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="86480" lims:id="86480"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="86481" lims:id="86481">Where warrant not necessary</MarginalNote><Label>(2)</Label><Text>An enforcement officer may carry out the powers under subsection (1) without a warrant if by reason of exigent circumstances it would not be practicable to obtain a warrant.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="86482" lims:id="86482"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="86483" lims:id="86483">Assistance</MarginalNote><Label>(3)</Label><Text>While carrying out any of the powers under this section, an enforcement officer may</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="86484" lims:id="86484"><Label>(a)</Label><Text>require the owner, master or any other person who may have possession of the official log book of the ship, or any other document or paper that may provide evidence of the contravention, to produce, for inspection or for the purposes of obtaining copies thereof or extracts therefrom, the log book or other document or paper; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="86485" lims:id="86485"><Label>(b)</Label><Text>require the master or any other person found on board the ship to give all reasonable assistance in the power of the master or other person, as the case may be, to enable the enforcement officer to carry out the enforcement officer’s duties and functions under this Act.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2017-09-21" lims:fid="86486" lims:id="86486" level="1"><TitleText>Detention of Ship</TitleText></Heading><Section lims:inforce-start-date="2015-02-26" lims:lastAmendedDate="2015-02-26" lims:fid="86487" lims:id="86487"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="86488" lims:id="86488">Detention of ships</MarginalNote><Label>16</Label><Subsection lims:inforce-start-date="2015-02-26" lims:fid="86489" lims:id="86489"><Label>(1)</Label><Text>Where an enforcement officer believes on reasonable grounds that an offence under this Act has been committed by or in respect of a ship, the enforcement officer may make a detention order in respect of the ship.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="86490" lims:id="86490"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="86491" lims:id="86491">Geographical application of section</MarginalNote><Label>(2)</Label><Text>The power to make a detention order under this section may be exercised in Canadian waters and in waters above the continental shelf of Canada.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="86492" lims:id="86492"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="86493" lims:id="86493">Order to be in writing</MarginalNote><Label>(3)</Label><Text>A detention order made under subsection (1) shall be in writing and addressed to all persons who, at the place where the ship to which the order relates is or will be, are empowered to give a clearance in respect of the ship.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="86494" lims:id="86494"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="86495" lims:id="86495">Notice of detention order to be served on master</MarginalNote><Label>(4)</Label><Text>Where a detention order under this section is made in respect of a ship, notice thereof shall be served on the master of the ship</Text><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="86496" lims:id="86496"><Label>(a)</Label><Text>by delivering a copy thereof personally to the master; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="86497" lims:id="86497"><Label>(b)</Label><Text>if service cannot reasonably be effected in the manner provided in paragraph (a),</Text><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="86498" lims:id="86498"><Label>(i)</Label><Text>by leaving a copy thereof for the master on board the ship with the person who is, or appears to be, in command or charge of the ship, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="86499" lims:id="86499"><Label>(ii)</Label><Text>by leaving a copy thereof with the owner or agent of the owner of the ship residing in Canada or, where no such owner or agent is known or can be found, by fixing a copy thereof to a prominent part of the ship.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="86500" lims:id="86500"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="86501" lims:id="86501">Ship under detention not to depart</MarginalNote><Label>(5)</Label><Text>Where notice of a detention order in respect of a ship is served under subsection (4) and, during the term of the detention order, the master or owner of the ship gives an order for the ship to depart from Canadian waters or from waters above the continental shelf of Canada, the master or owner, as the case may be, is guilty of an offence and liable on summary conviction to a fine not exceeding fifty thousand dollars.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="86502" lims:id="86502"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="86503" lims:id="86503">Duty of persons empowered to give clearance</MarginalNote><Label>(6)</Label><Text>Subject to subsection (7), no person to whom a detention order made under subsection (1) is addressed shall, after notice of the order is received by that person, give clearance in respect of the ship to which the order relates.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="86504" lims:id="86504"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="86505" lims:id="86505">When clearance shall be given</MarginalNote><Label>(7)</Label><Text>A person to whom a detention order made under subsection (1) is addressed and who has received notice of the order shall give clearance in respect of the ship to which the order relates where</Text><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="86506" lims:id="86506"><Label>(a)</Label><Text>security satisfactory to the Minister of Transport in the amount of fifty thousand dollars is given to Her Majesty in right of Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="86507" lims:id="86507"><Label>(b)</Label><Text>the ship has not been charged with an offence under this Act within thirty days after the making of the detention order; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="86508" lims:id="86508"><Label>(c)</Label><Text>the ship has been charged with an offence under this Act within the period referred to in paragraph (b) and</Text><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="86509" lims:id="86509"><Label>(i)</Label><Text>security satisfactory to the Minister of Transport for payment of the maximum fine that might be imposed as a result of a conviction of a ship charged with that offence, or in such lesser amount as may be approved by the Minister of Transport, is given to Her Majesty in right of Canada, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="86510" lims:id="86510"><Label>(ii)</Label><Text>proceedings in respect of the alleged offence that gave rise to the making of the detention order are discontinued.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="86511" lims:id="86511"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="86512" lims:id="86512">Sale of ship where no appearance and no security</MarginalNote><Label>(8)</Label><Text>Where a ship has been charged with an offence under this Act within thirty days after the making of a detention order in respect thereof and, within thirty days after the day on which the ship was charged with the offence,</Text><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="86513" lims:id="86513"><Label>(a)</Label><Text>no one has appeared on behalf of the ship to answer to the charge, and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="86514" lims:id="86514"><Label>(b)</Label><Text>security referred to in paragraph (7)(c) has not been given,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2015-02-26" lims:fid="86515" lims:id="86515"><Text>the Minister of Transport may apply to a court for an order authorizing the Minister of Transport to sell the ship.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="86516" lims:id="86516"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="86517" lims:id="86517">Sale of ship where appearance but no security</MarginalNote><Label>(9)</Label><Text>Where a ship has been charged with an offence under this Act within thirty days after the making of a detention order in respect thereof and</Text><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="86518" lims:id="86518"><Label>(a)</Label><Text>within thirty days after the day on which the ship was charged with the offence, someone has appeared on behalf of the ship to answer to the charge but security referred to in paragraph (7)(c) has not been given, and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="86519" lims:id="86519"><Label>(b)</Label><Text>the ship is convicted and a fine is imposed but not paid forthwith,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2015-02-26" lims:fid="86520" lims:id="86520"><Text>the Minister of Transport may apply to a court for an order authorizing the Minister of Transport to sell the ship.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="86521" lims:id="86521"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="86522" lims:id="86522">Notice</MarginalNote><Label>(10)</Label><Text>Forthwith on making an application under subsection (8) or (9), the Minister of Transport shall, by registered mail, give notice of the application to</Text><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="86523" lims:id="86523"><Label>(a)</Label><Text>the person responsible for maintaining any register in which the ship is registered, listed or recorded;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="86524" lims:id="86524"><Label>(b)</Label><Text>the holder of any mortgage against the ship that is registered on the register referred to in paragraph (a); and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="86525" lims:id="86525"><Label>(c)</Label><Text>the holder of any maritime lien against the ship to which the application relates, and the holder of any like interest, known to the Minister of Transport at the time of the making of the application.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="86526" lims:id="86526"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="86527" lims:id="86527">Day notice deemed to be given</MarginalNote><Label>(11)</Label><Text>A notice sent by registered mail under subsection (10) shall be deemed to have been given to the person to whom it was sent on the day on which an acknowledgement of receipt in respect thereof is received by the Minister of Transport.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="86528" lims:id="86528"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="86529" lims:id="86529">Court may relieve Minister of giving notice</MarginalNote><Label>(12)</Label><Text>Where the court seized of an application under subsection (8) or (9) is satisfied that it is appropriate to do so, the court may relieve the Minister of Transport of the obligation to give the notice referred to in subsection (10), or authorize the Minister of Transport to give the notice in such other manner as the court deems fit.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="86530" lims:id="86530"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="86531" lims:id="86531">Claiming interest</MarginalNote><Label>(13)</Label><Text>Where an application is made under subsection (8) or (9) in respect of a ship,</Text><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="86532" lims:id="86532"><Label>(a)</Label><Text>any person referred to in paragraph (10)(b) or (c) may, within sixty days after the notice is given to that person, and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="86533" lims:id="86533"><Label>(b)</Label><Text>any other person who claims an interest in the ship as mortgagee, or as the holder of a maritime lien or as the holder of any like interest, may, within sixty days after the application is made,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2015-02-26" lims:fid="86534" lims:id="86534"><Text>apply by notice in writing to the court seized of the application for an order referred to in subsection (14).</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="86535" lims:id="86535"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="86536" lims:id="86536">Order</MarginalNote><Label>(14)</Label><Text>Where, on the hearing of an application made under subsection (13), it is made to appear to the satisfaction of the court</Text><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="86537" lims:id="86537"><Label>(a)</Label><Text>that the applicant acquired the interest in respect of which the applicant is applying in good faith prior to the commission of the offence in respect of which the ship was detained, and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="86538" lims:id="86538"><Label>(b)</Label><Text>that the applicant is innocent of any complicity or collusion in respect of the offence in respect of which the ship was detained,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2015-02-26" lims:fid="86539" lims:id="86539"><Text>the court shall grant to the applicant an order declaring the nature and extent of the applicant’s interest at the time of the commission of the offence.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="86540" lims:id="86540"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="86541" lims:id="86541">Appeal</MarginalNote><Label>(15)</Label><Text>Any person who makes an application under subsection (13), and the Minister of Transport, may appeal to the court of appeal from an order referred to in subsection (14) and the appeal shall be asserted, heard and decided according to the ordinary procedure governing appeals to the court of appeal from orders or judgments of a court.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="86542" lims:id="86542"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="86543" lims:id="86543">Applications under subsection (13) to be heard first</MarginalNote><Label>(16)</Label><Text>A court shall not hear an application under subsection (8) or (9) until all applications under subsection (13) in relation thereto have been heard.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="86544" lims:id="86544"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="86545" lims:id="86545">Court may authorize sale</MarginalNote><Label>(17)</Label><Text>A court hearing an application under subsection (8) or (9) may authorize the Minister of Transport to sell the ship to which the application relates in such manner and subject to such terms and conditions as the court considers appropriate and, on application by the Minister of Transport, give directions to the Minister of Transport as to the rank of the interests of persons who have obtained an order referred to in subsection (14).</Text></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="86546" lims:id="86546"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="86547" lims:id="86547">Payment of proceeds</MarginalNote><Label>(18)</Label><Text>Where a ship is sold pursuant to this section, any surplus remaining from the proceeds of the sale after deducting</Text><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="86548" lims:id="86548"><Label>(a)</Label><Text>the amount of</Text><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="86549" lims:id="86549"><Label>(i)</Label><Text>the maximum fine that could have been imposed for the offence, where subsection (8) applies, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="86550" lims:id="86550"><Label>(ii)</Label><Text>the fine actually imposed, where subsection (9) applies, and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="86551" lims:id="86551"><Label>(b)</Label><Text>the cost of the detention and the sale</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2015-02-26" lims:fid="86552" lims:id="86552"><Text>shall, to the extent of the surplus, be paid in accordance with the interests of persons who have obtained an order referred to in subsection (14), and any surplus remaining thereafter shall be paid to the person registered as the owner of the ship or, in the absence of registration, to the person who owns the ship.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="86553" lims:id="86553"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="86554" lims:id="86554">Clear title</MarginalNote><Label>(19)</Label><Text>On selling a ship pursuant to this section, the Minister of Transport may, by bill of sale, give the purchaser a valid title to the ship free from any mortgage or other claim on the ship that is in existence at the time of the sale.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="86555" lims:id="86555"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="86556" lims:id="86556">Registrability not implied</MarginalNote><Label>(20)</Label><Text>Nothing in subsection (19) shall be construed as meaning that the ship may be registered in the name of the purchaser.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="86557" lims:id="86557"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="86558" lims:id="86558">Not duty paid</MarginalNote><Label>(21)</Label><Text>No ship sold pursuant to this section shall be deemed to have been duty paid under the <XRefExternal reference-type="act" link="C-54.011">Customs contravenes section 17 or 18 is guilty of an offence punishable on summary conviction and is liable to a fine of not more than fifteen thousand dollars or to imprisonment for a term not exceeding
