language-align="no" list-item="no"><Text>Whereas it is important that victims’ rights be considered throughout the criminal justice system;</Text></Provision><Provision format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas consideration of the rights of victims of crime is in the interest of the proper administration of provincial and territorial governments share responsibility for criminal justice;</Text></Provision><Provision lims:inforce-start-date="2015-04-23" lims:fid="76025" lims:id="76025" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas, in 1988, the federal, provincial and territorial governments endorsed the <XRefExternal reference-type="other">Canadian Statement of Basic Principles of Justice for Victims of Crime</XRefExternal> and, in 2003, the <XRefExternal reference-type="other">Canadian Statement of Basic Principles of Justice for Victims of Crime, 2003</XRefExternal>;</Text></Provision></Preamble><Enacts lims:inforce-start-date="2015-04-23" lims:fid="76026" lims:id="76026"><Provision lims:inforce-start-date="2015-04-23" lims:fid="76027" lims:id="76027" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Now, therefore, Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts lims:inforce-start-date="2015-07-23" lims:fid="76031" lims:id="76031">Short title</MarginalNote><Label>1</Label><Text>This Act may be cited as the <XRefExternal reference-type="act" link="C-23.7">Canadian Victims Bill of Rights</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2015-04-23" lims:fid="76032" lims:id="76032" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2018-10-17" lims:lastAmendedDate="2018-10-17" lims:fid="76033" lims:id="76033"><MarginalNote lims:inforce-start-date="2018-10-17" lims:fid="76034" lims:id="76034">Definitions</MarginalNote><Label>2</Label><Text>The following definitions apply in this Act.</Text><Definition lims:inforce-start-date="2018-10-17" lims:fid="76035" lims:id="76035"><Text><DefinedTermEn>offence</DefinedTermEn> means an offence under the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, the <XRefExternal reference-type="act" link="Y-1.5">Youth Criminal Justice Act</XRefExternal> or the <XRefExternal reference-type="act" link="C-45.9">Crimes Against Humanity and War Crimes Act</XRefExternal>, a <DefinitionRef>designated substance offence</DefinitionRef> as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="C-38.8">Controlled Drugs and Substances Act</XRefExternal>, a <DefinitionRef>designated offence</DefinitionRef> as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="C-24.5">Cannabis Act</XRefExternal> or an offence under section 91 or Part 3 of the <XRefExternal reference-type="act" link="I-2.5">Immigration and Refugee Protection Act</XRefExternal>. (<DefinedTermFr>infraction</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-10-17" lims:fid="76036" lims:id="76036"><Text><DefinedTermEn>victim</DefinedTermEn> means an individual who has suffered physical or emotional harm, property damage or economic loss as the result of the commission or alleged commission of an offence. (<DefinedTermFr>victime</DefinedTermFr>)</Text></Definition><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-10-17" lims:fid="76038" lims:id="76038">2015, lims:id="76039"><MarginalNote lims:inforce-start-date="2015-07-23" lims:fid="76040" lims:id="76040">Acting on victim’s behalf</MarginalNote><Label>3</Label><Text>Any of the following individuals may exercise a victim’s rights under this Act if the victim is dead or incapable of acting on their own behalf:</Text><Paragraph lims:inforce-start-date="2015-07-23" lims:fid="76041" lims:id="76041"><Label>(a)</Label><Text>the victim’s spouse or the individual who was at the time of the victim’s death their spouse;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-23" lims:fid="76042" lims:id="76042"><Label>(b)</Label><Text>the individual who is or was at the time of the victim’s death, cohabiting with them in a conjugal relationship, having so cohabited for a period of at least one year;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-23" lims:fid="76043" lims:id="76043"><Label>(c)</Label><Text>a relative or dependant of the victim;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-23" lims:fid="76044" lims:id="76044"><Label>(d)</Label><Text>an individual who has in law or fact custody, or is responsible for the care or support, of the victim;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-23" lims:fid="76045" lims:id="76045"><Label>(e)</Label><Text>an individual who has in law or fact custody, or is responsible for the care or support, of a dependant of the victim.</Text></Paragraph></Section><Section lims:inforce-start-date="2015-07-23" lims:lastAmendedDate="2015-07-23" lims:fid="76046" lims:id="76046"><MarginalNote lims:inforce-start-date="2015-07-23" lims:fid="76047" lims:id="76047">Exception</MarginalNote><Label>4</Label><Text>An individual is not a victim in relation to an offence, or entitled to exercise a victim’s rights under this Act, if the individual is charged with the offence, found guilty of the offence or found not criminally responsible on account of mental disorder or unfit to stand trial in respect of the offence.</Text></Section><Section lims:inforce-start-date="2015-07-23" lims:lastAmendedDate="2015-07-23" lims:fid="76048" lims:id="76048"><MarginalNote lims:inforce-start-date="2015-07-23" lims:fid="76049" lims:id="76049">Criminal justice system</MarginalNote><Label>5</Label><Text>For the purpose of this Act, the criminal justice system consists of</Text><Paragraph lims:inforce-start-date="2015-07-23" lims:fid="76050" lims:id="76050"><Label>(a)</Label><Text>the investigation and prosecution of offences in Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-23" lims:fid="76051" lims:id="76051"><Label>(b)</Label><Text>the corrections process and the conditional release process in Canada; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-23" lims:fid="76052" lims:id="76052"><Label>(c)</Label><Text>the proceedings of courts and Review Boards, as those terms are defined in subsection 672.1(1) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, in respect of accused who are found not criminally responsible on account of mental disorder or unfit to stand trial.</Text></Paragraph></Section><Heading lims:inforce-start-date="2015-04-23" lims:fid="76053" lims:id="76053" level="1"><TitleText>Rights</TitleText></Heading><Heading lims:inforce-start-date="2015-04-23" lims:fid="76054" lims:id="76054" level="2"><TitleText>Information</TitleText></Heading><Section lims:inforce-start-date="2015-07-23" lims:lastAmendedDate="2015-07-23" lims:fid="76055" lims:id="76055"><MarginalNote lims:inforce-start-date="2015-07-23" lims:fid="76056" lims:id="76056">General information</MarginalNote><Label>6</Label><Text>Every victim has the right, on request, to information about</Text><Paragraph lims:inforce-start-date="2015-07-23" lims:fid="76057" lims:id="76057"><Label>(a)</Label><Text>the criminal justice system and the role of victims in it;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-23" lims:fid="76058" lims:id="76058"><Label>(b)</Label><Text>the services and programs available to them as a victim, including restorative justice programs; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-23" lims:fid="76059" lims:id="76059"><Label>(c)</Label><Text>their right to file a complaint for an infringement or denial of any of their rights under this Act.</Text></Paragraph></Section><Section lims:inforce-start-date="2015-07-23" lims:lastAmendedDate="2015-07-23" lims:fid="76060" lims:id="76060"><MarginalNote lims:inforce-start-date="2015-07-23" lims:fid="76061" lims:id="76061">Investigation and proceedings</MarginalNote><Label>7</Label><Text>Every victim has the right, on request, to information about</Text><Paragraph lims:inforce-start-date="2015-07-23" lims:fid="76062" lims:id="76062"><Label>(a)</Label><Text>the status and outcome of the investigation into the offence; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-23" lims:fid="76063" lims:id="76063"><Label>(b)</Label><Text>the location of proceedings in relation to the offence, when they will take place and their progress and outcome.</Text></Paragraph></Section><Section lims:inforce-start-date="2015-07-23" lims:lastAmendedDate="2015-07-23" lims:fid="76064" lims:id="76064"><MarginalNote lims:inforce-start-date="2015-07-23" lims:fid="76065" lims:id="76065">Information about offender or accused</MarginalNote><Label>8</Label><Text>Every victim has the right, on request, to information about</Text><Paragraph lims:inforce-start-date="2015-07-23" lims:fid="76066" lims:id="76066"><Label>(a)</Label><Text>reviews under the <XRefExternal reference-type="act" link="C-44.6">Corrections and Conditional Release Act</XRefExternal> relating to the offender’s conditional release and the timing and conditions of that release; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-23" lims:fid="76067" lims:id="76067"><Label>(b)</Label><Text>hearings held for the purpose of making dispositions, as defined in subsection 672.1(1) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, in relation to the accused, if the accused is found not criminally responsible on account of mental disorder or unfit to stand trial, and the dispositions made at those hearings.</Text></Paragraph></Section><Heading lims:inforce-start-date="2015-04-23" lims:fid="76068" lims:id="76068" level="2"><TitleText>Protection</TitleText></Heading><Section lims:inforce-start-date="2015-07-23" lims:lastAmendedDate="2015-07-23" lims:fid="76069" lims:id="76069"><MarginalNote lims:inforce-start-date="2015-07-23" lims:fid="76070" lims:id="76070">Security</MarginalNote><Label>9</Label><Text>Every victim has the right to have their security considered by the appropriate author- ities in the criminal justice system.</Text></Section><Section lims:inforce-start-date="2015-07-23" lims:lastAmendedDate="2015-07-23" lims:fid="76071" lims:id="76071"><MarginalNote lims:inforce-start-date="2015-07-23" lims:fid="76072" lims:id="76072">Protection from intimidation and retaliation</MarginalNote><Label>10</Label><Text>Every victim has the right to have reasonable and necessary measures taken by the appropriate authorities in the criminal justice system to protect the victim from intimidation and retaliation.</Text></Section><Section lims:inforce-start-date="2015-07-23" lims:lastAmendedDate="2015-07-23" lims:fid="76073" lims:id="76073"><MarginalNote lims:inforce-start-date="2015-07-23" lims:fid="76074" lims:id="76074">Privacy</MarginalNote><Label>11</Label><Text>Every victim has the right to have their privacy considered by the appropriate authorities in the criminal justice system.</Text></Section><Section lims:inforce-start-date="2015-07-23" lims:lastAmendedDate="2015-07-23" lims:fid="76075" lims:id="76075"><MarginalNote lims:inforce-start-date="2015-07-23" lims:fid="76076" lims:id="76076">Identity protection</MarginalNote><Label>12</Label><Text>Every victim has the right to request that their identity be protected if they are a complainant to the offence or a witness in proceedings relating to the offence.</Text></Section><Section lims:inforce-start-date="2015-07-23" lims:lastAmendedDate="2015-07-23" lims:fid="76077" lims:id="76077"><MarginalNote lims:inforce-start-date="2015-07-23" lims:fid="76078" lims:id="76078">Testimonial aids</MarginalNote><Label>13</Label><Text>Every victim has the right to request testimonial aids when appearing as a witness in proceedings relating to the offence.</Text></Section><Heading lims:inforce-start-date="2015-04-23" lims:fid="76079" lims:id="76079" level="2"><TitleText>Participation</TitleText></Heading><Section lims:inforce-start-date="2015-07-23" lims:lastAmendedDate="2015-07-23" lims:fid="76080" lims:id="76080"><MarginalNote lims:inforce-start-date="2015-07-23" lims:fid="76081" lims:id="76081">Views to be considered</MarginalNote><Label>14</Label><Text>Every victim has the right to convey their views about decisions to be made by appropriate authorities in the criminal justice system that affect the victim’s rights under this Act and to have those views considered.</Text></Section><Section lims:inforce-start-date="2015-07-23" lims:lastAmendedDate="2015-07-23" lims:fid="76082" lims:id="76082"><MarginalNote lims:inforce-start-date="2015-07-23" lims:fid="76083" lims:id="76083">Victim impact statement</MarginalNote><Label>15</Label><Text>Every victim has the right to present a victim impact statement to the appropriate authorities in the criminal justice system and to have it considered.</Text></Section><Heading lims:inforce-start-date="2015-04-23" lims:fid="76084" lims:id="76084" level="2"><TitleText>Restitution</TitleText></Heading><Section lims:inforce-start-date="2015-07-23" lims:lastAmendedDate="2015-07-23" lims:fid="76085" lims:id="76085"><MarginalNote lims:inforce-start-date="2015-07-23" lims:fid="76086" lims:id="76086">Restitution order</MarginalNote><Label>16</Label><Text>Every victim has the right to have the court consider making a restitution order against the offender.</Text></Section><Section lims:inforce-start-date="2015-07-23" lims:lastAmendedDate="2015-07-23" lims:fid="76087" lims:id="76087"><MarginalNote lims:inforce-start-date="2015-07-23" lims:fid="76088" lims:id="76088">Enforcement</MarginalNote><Label>17</Label><Text>Every victim in whose favour a restitution order is made has the right, if they are not paid, to have the order entered as a civil court judgment that is enforceable against the offender.</Text></Section><Heading lims:inforce-start-date="2015-04-23" lims:fid="76089" lims:id="76089" level="1"><TitleText>General Provisions</TitleText></Heading><Section lims:inforce-start-date="2015-07-23" lims:lastAmendedDate="2022-06-20" lims:fid="76090" lims:id="76090"><MarginalNote lims:inforce-start-date="2015-07-23" lims:fid="76091" lims:id="76091">Application</MarginalNote><Label>18</Label><Subsection lims:inforce-start-date="2015-07-23" lims:fid="76092" lims:id="76092"><Label>(1)</Label><Text>This Act applies in respect of a victim of an offence in their interactions with the criminal justice system</Text><Paragraph lims:inforce-start-date="2015-07-23" lims:fid="76093" lims:id="76093"><Label>(a)</Label><Text>while the offence is investigated or prosecuted;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-23" lims:fid="76094" lims:id="76094"><Label>(b)</Label><Text>while the offender is subject to the corrections process or the conditional release process in relation to the offence; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-23" lims:fid="76095" lims:id="76095"><Label>(c)</Label><Text>while the accused is, in relation to the offence, under the jurisdiction of a court or a Review Board, as those terms are defined in subsection 672.1(1) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, if they are found not criminally responsible on account of mental disorder or unfit to stand trial.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-07-23" lims:fid="76096" lims:id="76096"><MarginalNote lims:inforce-start-date="2015-07-23" lims:fid="76097" lims:id="76097">Reporting of offence</MarginalNote><Label>(2)</Label><Text>For the purpose of subsection (1), if an offence is reported to the appropriate authorities in the criminal justice system, the investigation of the offence is deemed to begin at the time of the reporting.</Text></Subsection><Subsection lims:inforce-start-date="2022-06-20" lims:enacted-date="2019-06-21" lims:fid="76098" lims:id="1352949"><MarginalNote lims:inforce-start-date="2022-06-20" lims:enacted-date="2019-06-21" lims:fid="1352950" lims:id="1352950"><XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal></MarginalNote><Label>(3)</Label><Text>Subject to subsection (4), this Act does not apply in respect of offences that are <DefinitionRef>service offences</DefinitionRef>, as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>, that are investigated or proceeded with under that Act.</Text></Subsection><Subsection lims:inforce-start-date="2022-06-20" lims:enacted-date="2019-06-21" lims:fid="1352947" lims:id="1352947"><MarginalNote lims:inforce-start-date="2022-06-20" <DefinitionRef>service offence</DefinitionRef>, as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal> and who is committed to a <DefinitionRef>penitentiary</DefinitionRef> or a <DefinitionRef>civil prison</DefinitionRef>, as those terms are defined in that subsection.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:id="76102"><Label>(1)</Label><Text>The rights of victims under this Act are to be exercised through the mechanisms provided by law.</Text></Subsection><Subsection lims:inforce-start-date="2015-07-23" lims:fid="76103" lims:id="76103"><MarginalNote lims:inforce-start-date="2015-07-23" lims:fid="76104" lims:id="76104">Connection to Canada</MarginalNote><Label>(2)</Label><Text>A victim is entitled to exercise their rights under this Act only if they are present in Canada or they are a Canadian citizen or a permanent resident within the meaning of subsection 2(1) of the <XRefExternal reference-type="act" link="I-2.5">Immigration and Refugee Protection Act</XRefExternal>.</Text></Subsection></Section><Section lims:inforce-start-date="2015-07-23" lims:lastAmendedDate="2015-07-23" lims:fid="76105" lims:id="76105"><MarginalNote lims:inforce-start-date="2015-07-23" lims:fid="76106" lims:id="76106">Interpretation of this Act</MarginalNote><Label>20</Label><Text>This Act is to be construed and applied in a manner that is reasonable in the circumstances, and in a manner that is not likely to</Text><Paragraph lims:inforce-start-date="2015-07-23" lims:fid="76107" lims:id="76107"><Label>(a)</Label><Text>interfere with the proper administration of justice, including</Text><Subparagraph lims:inforce-start-date="2015-07-23" lims:fid="76108" lims:id="76108"><Label>(i)</Label><Text>by causing interference with police discretion or causing excessive delay in, or compromising or hindering, the investigation of any offence, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-07-23" lims:fid="76109" lims:id="76109"><Label>(ii)</Label><Text>by causing interference with prosecutorial discretion or causing excessive delay in, or compromising or hindering, the prosecution of any offence;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-07-23" lims:fid="76110" lims:id="76110"><Label>(b)</Label><Text>interfere with ministerial discretion;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-23" lims:fid="76111" lims:id="76111"><Label>(c)</Label><Text>interfere with the discretion that may be exercised by any person or body authorized to release an offender into the community;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-23" lims:fid="76112" lims:id="76112"><Label>(d)</Label><Text>endanger the life or safety of any individual; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-23" lims:fid="76113" lims:id="76113"><Label>(e)</Label><Text>cause injury to international relations or national defence or national security.</Text></Paragraph></Section><Section lims:inforce-start-date="2015-07-23" lims:lastAmendedDate="2015-07-23" lims:fid="76114" lims:id="76114"><MarginalNote lims:inforce-start-date="2015-07-23" lims:fid="76115" lims:id="76115">Interpretation of other Acts, regulations, etc.</MarginalNote><Label>21</Label><Text>To the extent that it is possible to do so, every Act of Parliament enacted — and every order, rule or regulation made under such an Act — before, on or after the day on which this Act comes into force must be construed and applied in a manner that is compatible with the rights under this Act.</Text></Section><Section lims:inforce-start-date="2015-07-23" lims:lastAmendedDate="2022-06-20" lims:fid="76116" lims:id="76116"><MarginalNote lims:id="76118"><Label>(1)</Label><Text>If, after the application of sections <XRefInternal>20</XRefInternal> and <XRefInternal>21</XRefInternal>, there is any inconsistency between any provision of this Act and any provision of any Act, order, rule or regulation referred to in section <XRefInternal>21</XRefInternal>, the provision of this Act prevails to the extent of the reference-type="act" link="O-3.01">Official Languages Act</XRefExternal>, the <XRefExternal reference-type="act" link="A-1">Access to Information Act</XRefExternal> and the <XRefExternal reference-type="act" link="P-21">Privacy Act</XRefExternal> and in respect of orders, rules and regulations made under any of those Acts. or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-23" lims:fid="76127" lims:id="76127"><Label>(c)</Label><Text>delay any extradition proceedings or prevent the extradition of any person to or from Canada.</Text></Paragraph></Section><Heading lims:inforce-start-date="2015-04-23" lims:fid="76128" lims:id="76128" level="1"><TitleText>Remedies</TitleText></Heading><Section lims:inforce-start-date="2015-07-23" lims:lastAmendedDate="2015-07-23" lims:fid="76129" lims:id="76129"><MarginalNote lims:inforce-start-date="2015-07-23" lims:fid="76130" lims:id="76130">Complaint — federal entity</MarginalNote><Label>25</Label><Subsection lims:inforce-start-date="2015-07-23" lims:fid="76131" lims:id="76131"><Label>(1)</Label><Text>Every victim who is of the opinion that any of their rights under this Act have been infringed or denied by a federal department, agency or body has the right to file a complaint in accordance with its complaints mechanism.</Text></Subsection><Subsection lims:inforce-start-date="2015-07-23" lims:fid="76132" lims:id="76132"><MarginalNote lims:inforce-start-date="2015-07-23" lims:fid="76133" lims:id="76133">Complaint to authority</MarginalNote><Label>(2)</Label><Text>Every victim who has exhausted their recourse under the complaints mechanism and who is not satisfied with the response of the federal department, agency or body may file a complaint with any authority that has jurisdiction to review complaints in relation to that department, agency or body.</Text></Subsection><Subsection lims:inforce-start-date="2015-07-23" lims:fid="76134" lims:id="76134"><MarginalNote lims:inforce-start-date="2015-07-23" lims:fid="76135" lims:id="76135">Complaints mechanism</MarginalNote><Label>(3)</Label><Text>Every federal department, agency or body that is involved in the criminal justice system must have a complaints mechanism that provides for</Text><Paragraph lims:inforce-start-date="2015-07-23" lims:fid="76136" lims:id="76136"><Label>(a)</Label><Text>a review of complaints involving alleged infringements or denials of rights under this Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-23" lims:fid="76137" lims:id="76137"><Label>(b)</Label><Text>the power to make recommendations to remedy such infringements and denials;
