Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2018-05-23" lims:fid="60598" lims:id="60598" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2004-05-11" lims:lastAmendedDate="2004-05-11" lims:fid="60599" lims:id="60599"><MarginalNote lims:inforce-start-date="2004-05-11" lims:fid="60600" lims:id="60600">Definitions</MarginalNote><Label>2</Label><Text>The definitions in this section apply in this Act.</Text><Definition lims:inforce-start-date="2004-05-11" lims:fid="60601" lims:id="60601"><Text><DefinedTermEn>Authority</DefinedTermEn> means the Canadian Air Transport Security Authority established by subsection 5(1). (<DefinedTermFr>Administration</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2004-05-11" lims:fid="60602" lims:id="60602"><Text><DefinedTermEn>authorized aerodrome operator</DefinedTermEn> means an operator of an aerodrome designated by the regulations who is authorized by the Authority under section 7 to deliver screening. (<DefinedTermFr>exploitant d’aérodrome autorisé</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2004-05-11" lims:fid="60603" lims:id="60603"><Text><DefinedTermEn>board</DefinedTermEn> means the board of directors of the Authority established by section 10. (<DefinedTermFr>conseil</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2004-05-11" lims:fid="60604" lims:id="60604"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Transport. (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2004-05-11" lims:fid="60605" lims:id="60605"><Text><DefinedTermEn>screening</DefinedTermEn> means screening, including a search, performed in the manner and under the circumstances prescribed in aviation security regulations, security measures, emergency directions or interim orders made under the <XRefExternal reference-type="act" link="A-2">Aeronautics Act</XRefExternal>. (<DefinedTermFr>contrôle</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2004-05-11" lims:fid="60606" lims:id="60606"><Text><DefinedTermEn>screening contractor</DefinedTermEn> means a contractor retained by the Authority or an authorized aerodrome operator to deliver screening. (<DefinedTermFr>fournisseur de services de contrôle</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2004-05-11" lims:fid="60607" lims:id="60607"><Text><DefinedTermEn>screening officer</DefinedTermEn> means a screening officer who is employed by the Authority, an authorized aerodrome operator or a screening contractor to perform screening. (<DefinedTermFr>agent de contrôle</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2004-05-11" lims:fid="60608" lims:id="60608"><Text><DefinedTermEn>screening point</DefinedTermEn> means a point where screening is delivered, either directly or through a screening contractor, by the Authority or by an authorized aerodrome operator acting on behalf of the Authority, in order to meet the requirements of aviation security regulations, security measures, emergency directions or interim orders made under the <XRefExternal reference-type="act" link="A-2">Aeronautics lims:inforce-start-date="2003-01-01" lims:fid="60613" lims:id="60613"><Label>(1)</Label><Text>Unless the context otherwise requires, words and expressions used in this Act have the same meaning as in the <XRefExternal reference-type="act" link="A-2">Aeronautics Act</XRefExternal> and the aviation security regulations made under it.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60614" lims:id="60614"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60615" lims:id="60615">Air transport security</MarginalNote><Label>(2)</Label><Text>Unless specifically provided for, nothing in this Act affects air transport security responsibilities imposed under the <XRefExternal reference-type="act" link="A-2">Aeronautics Act</XRefExternal> on persons other than the Authority.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60616" lims:id="60616"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60617" lims:id="60617">Inconsistencies with other Acts</MarginalNote><Label>(3)</Label><Text>In the event of any inconsistency between the provisions of this Act and the provisions of Part X of the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>, the provisions of this Act prevail.</Text></Subsection></Section><Heading lims:inforce-start-date="2018-05-23" lims:fid="60618" lims:id="60618" level="1"><TitleText>Role of the Minister</TitleText></Heading><Section lims:inforce-start-date="2003-01-01" lims:lastAmendedDate="2003-01-01" lims:fid="60619" lims:id="60619"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60620" lims:id="60620">Minister responsible</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60621" lims:id="60621"><Label>(1)</Label><Text>The Minister is the appropriate minister for the Authority for the purposes of Part X of the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60622" lims:id="60622"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60623" lims:id="60623">Directions to the Authority</MarginalNote><Label>(2)</Label><Text>The Minister may issue a written direction to the Authority, addressed to the Chairperson, on any matter related to air transport security.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60624" lims:id="60624"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60625" lims:id="60625">Directions binding</MarginalNote><Label>(3)</Label><Text>The Authority and its directors, officers and employees of the Authority must comply with a direction issued under this section.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60626" lims:id="60626"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60627" lims:id="60627">Directions in Authority’s best interest</MarginalNote><Label>(4)</Label><Text>Compliance with the direction is deemed to be in the best interests of the Authority.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60628" lims:id="60628"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60629" lims:id="60629">Directions not statutory instruments</MarginalNote><Label>(5)</Label><Text>A direction is not a statutory instrument for the purposes of the <XRefExternal reference-type="act" link="S-22">Statutory Instruments Act</XRefExternal>.</Text></Subsection></Section><Heading lims:inforce-start-date="2018-05-23" lims:fid="60630" lims:id="60630" level="1"><TitleText>Establishment and Mandate of the Authority</TitleText></Heading><Section lims:inforce-start-date="2003-01-01" lims:lastAmendedDate="2003-01-01" lims:fid="60631" lims:id="60631"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60632" lims:id="60632">Establishment</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60633" lims:id="60633"><Label>(1)</Label><Text>There is hereby established a body corporate to be called the Canadian Air Transport Security Authority.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60634" lims:id="60634"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60635" lims:id="60635">Agent of Her Majesty</MarginalNote><Label>(2)</Label><Text>The Authority is for all purposes an agent of Her Majesty in right of Canada.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60636" lims:id="60636"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60637" lims:id="60637">Headquarters</MarginalNote><Label>(3)</Label><Text>The headquarters of the Authority must be at such place in Canada as may be designated by the Governor in Council.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60638" lims:id="60638"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60639" lims:id="60639">Financial year</MarginalNote><Label>(4)</Label><Text>The Authority’s financial year begins on April 1 of one year and ends on March 31 of the following year, unless the Governor in Council directs otherwise.</Text></Subsection></Section><Section lims:inforce-start-date="2018-05-23" lims:lastAmendedDate="2018-05-23" lims:fid="60640" lims:id="60640"><MarginalNote lims:inforce-start-date="2018-05-23" lims:fid="60641" lims:id="60641">Mandate</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2018-05-23" lims:fid="60642" lims:id="60642"><Label>(1)</Label><Text>The Authority’s mandate is to take actions, either directly or through a screening contractor, for the effective and efficient screening of persons who access aircraft or restricted areas through screening points, the property in their possession or control and the belongings or baggage that they give to an air carrier for transport.</Text></Subsection><Subsection lims:inforce-start-date="2018-05-23" lims:fid="60643" lims:id="60643"><MarginalNote lims:inforce-start-date="2018-05-23" lims:fid="60644" lims:id="60644">Restricted areas</MarginalNote><Label>(1.1)</Label><Text>For the purposes of subsection (1), a restricted area is an area designated as a restricted area under the <XRefExternal reference-type="act" link="A-2">Aeronautics Act</XRefExternal> at an aerodrome designated by the regulations or at any other place, including any other aerodrome, designated by the Minister.</Text></Subsection><Subsection lims:inforce-start-date="2018-05-23" lims:fid="60645" lims:id="60645"><MarginalNote lims:inforce-start-date="2018-05-23" lims:fid="60646" lims:id="60646">Other responsibilities</MarginalNote><Label>(2)</Label><Text>The Authority is responsible for ensuring consistency in the delivery of screening across Canada and for any other air transport security function provided for in this Act. It is also responsible for air transport security functions that the Minister may assign to it, subject to any terms and conditions that the Minister may establish.</Text></Subsection><Subsection lims:inforce-start-date="2018-05-23" lims:fid="60647" lims:id="60647"><MarginalNote lims:inforce-start-date="2018-05-23" lims:fid="60648" lims:id="60648">Carrying out mandate</MarginalNote><Label>(3)</Label><Text>The Authority must carry out its responsibilities under this section in the public interest, having due regard to the interest of the travelling public. Those responsibilities are a governmental function.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-05-23" lims:fid="60650" lims:id="60650">2002, c. 9, s. 2 “6”; 2018, c. 10, s. 68</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2003-01-01" lims:lastAmendedDate="2003-01-01" lims:fid="60651" lims:id="60651"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60652" lims:id="60652">Authorizing aerodrome operators to deliver screening</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60653" lims:id="60653"><Label>(1)</Label><Text>The Authority may authorize the operator of an aerodrome designated by the regulations to deliver screening on its behalf at that aerodrome, either directly or through a screening contractor, subject to any terms and conditions that the Authority may establish.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60654" lims:id="60654"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60655" lims:id="60655">Limitation</MarginalNote><Label>(2)</Label><Text>The Authority may not authorize the operator to deliver screening unless it is satisfied that the operator can meet the terms and conditions established by the Authority and deliver screening efficiently and effectively, having regard to the following factors:</Text><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="60656" lims:id="60656"><Label>(a)</Label><Text>the cost and service advantages;</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="60657" lims:id="60657"><Label>(b)</Label><Text>the operator’s capability to deliver screening; and</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="60658" lims:id="60658"><Label>(c)</Label><Text>how screening, if done by the operator, would be integrated with other security functions at the aerodrome.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60659" lims:id="60659"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60660" lims:id="60660">Payments</MarginalNote><Label>(3)</Label><Text>The Authority may, in the terms and conditions of an authorization, agree to make payments to the authorized aerodrome operator to compensate them for the reasonable costs incurred by them in delivering screening.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60661" lims:id="60661"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60662" lims:id="60662">Not an agent of Her Majesty</MarginalNote><Label>(4)</Label><Text>An authorized aerodrome operator does not become an agent of Her Majesty by reason only of delivering screening under an authorization.</Text></Subsection></Section><Section lims:inforce-start-date="2003-01-01" lims:lastAmendedDate="2003-01-01" lims:fid="60663" lims:id="60663"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60664" lims:id="60664">Criteria for screening contractors and officers</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60665" lims:id="60665"><Label>(1)</Label><Text>The Authority must establish criteria respecting the qualifications, training and performance of screening contractors and screening officers, that are as stringent as or more stringent than the standards established in the aviation security regulations made under the <XRefExternal reference-type="act" link="A-2">Aeronautics Act</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60666" lims:id="60666"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60667" lims:id="60667">Certification</MarginalNote><Label>(2)</Label><Text>The Authority must certify all screening contractors and officers against the criteria established under subsection (1).</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60668" lims:id="60668"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60669" lims:id="60669">Varying, suspending or cancelling certification</MarginalNote><Label>(3)</Label><Text>If the Authority determines that a screening contractor or officer no longer meets the criteria in respect of which they were certified, the Authority may vary, suspend or cancel their certification.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60670" lims:id="60670"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60671" lims:id="60671">Contracting</MarginalNote><Label>(4)</Label><Text>The Authority may establish contracting policies specifying minimum requirements respecting wages and terms and conditions of employment that persons must meet in order to be awarded a contract by or on behalf of the Authority for the delivery of screening. The Authority must establish such policies if required to do so by the Minister.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60672" lims:id="60672"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60673" lims:id="60673">Contracts for services or procurement</MarginalNote><Label>(5)</Label><Text>The Authority must establish policies and procedures for contracts for services and for procurement that ensure that the Authority’s operational requirements are always met and that promote transparency, openness, fairness and value for money in purchasing.</Text></Subsection></Section><Heading lims:inforce-start-date="2018-05-23" lims:fid="60674" lims:id="60674" level="1"><TitleText>Legal Powers of the Authority</TitleText></Heading><Section lims:inforce-start-date="2003-01-01" lims:lastAmendedDate="2003-01-01" lims:fid="60675" lims:id="60675"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60676" lims:id="60676">Legal powers</MarginalNote><Label>9</Label><Text>In carrying out its mandate, the Authority has, subject to this Act, the capacity, rights, powers and privileges of a natural person.</Text></Section><Heading lims:inforce-start-date="2018-05-23" lims:fid="60677" lims:id="60677" level="1"><TitleText>Structure of the Authority</TitleText></Heading><Heading lims:inforce-start-date="2018-05-23" lims:fid="60678" lims:id="60678" level="2"><TitleText>Board</TitleText></Heading><Section lims:inforce-start-date="2003-01-01" lims:lastAmendedDate="2003-01-01" lims:fid="60679" lims:id="60679"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60680" lims:id="60680">Establishment</MarginalNote><Label>10</Label><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60681" lims:id="60681"><Label>(1)</Label><Text>There shall be a board of directors of the Authority consisting of eleven directors, including the Chairperson, appointed by the Governor in Council on the recommendation of the Minister.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60682" lims:id="60682"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60683" lims:id="60683">Directors nominated by airline industry and aerodrome operators</MarginalNote><Label>(2)</Label><Text>Two of the directors must be nominees submitted by the representatives of the airline industry designated under section 11 whom the Minister considers suitable for appointment as directors, and two must be nominees submitted by the representatives of aerodrome operators designated under that section whom the Minister considers suitable for appointment as directors.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60684" lims:id="60684"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60685" lims:id="60685">Tenure of directors</MarginalNote><Label>(3)</Label><Text>Each director holds office during pleasure for any term of not more than five years that will ensure, as far as possible, the expiry in any one year of the terms of office of not more than one half of the directors.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60686" lims:id="60686"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60687" lims:id="60687">Vacancy on board</MarginalNote><Label>(4)</Label><Text>If the Governor in Council has not appointed all of the directors referred to in subsection (1) but the number appointed constitutes a quorum, the directors who have been appointed may exercise all the powers of the board.</Text></Subsection></Section><Section lims:inforce-start-date="2003-01-01" lims:lastAmendedDate="2003-01-01" lims:fid="60688" lims:id="60688"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60689" lims:id="60689">Designation</MarginalNote><Label>11</Label><Text>The Minister may designate representatives or classes of representatives of the airline industry and of aerodrome operators to propose nominees to the Minister for appointment to the board.</Text></Section><Section lims:inforce-start-date="2003-01-01" lims:lastAmendedDate="2003-01-01" lims:fid="60690" lims:id="60690"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60691" lims:id="60691">Qualifications of directors</MarginalNote><Label>12</Label><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60692" lims:id="60692"><Label>(1)</Label><Text>The directors must be persons who, in the opinion of the Governor in Council, have the experience and the capacity required for discharging their duties and functions.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60693" lims:id="60693"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60694" lims:id="60694">Persons not eligible for appointment</MarginalNote><Label>(2)</Label><Text>No person may be appointed or continue as a director of the Authority who</Text><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="60695" lims:id="60695"><Label>(a)</Label><Text>is not a Canadian citizen or a permanent resident under the <XRefExternal reference-type="act" link="I-2.5">Immigration and Refugee Protection Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="60696" lims:id="60696"><Label>(b)</Label><Text>is a member of the Senate or House of Commons or a member of a legislature;</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="60697" lims:id="60697"><Label>(c)</Label><Text>is employed on a full-time basis in the public service of Canada or of a province; or</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="60698" lims:id="60698"><Label>(d)</Label><Text>is a mayor, councillor, officer or employee of a municipality.</Text></Paragraph></Subsection></Section><Section agreement, such space at the aerodrome with services reasonably required by the Authority as the Minister determines to be necessary to enable the Authority to carry out its Authority may, with the Minister’s approval and subject to any terms and conditions that the Minister may establish, enter into an agreement respecting the delivery of screening referred to in subsection 6(1) with any person who requests the delivery of such screening.</Text></Subsection><Subsection lims:inforce-start-date="2018-05-23" lims:fid="60763" lims:id="60763"><MarginalNote lims:inforce-start-date="2018-05-23" lims:fid="60764" lims:id="60764">Mandate</MarginalNote><Label>(2)</Label><Text>For greater certainty, the Authority’s mandate under subsection 6(1) includes any powers</MarginalNote><Label>35</Label><Text>Despite any other provision of this Act, pending the initial appointment of the directors, the Chairperson and any directors who have been appointed have on such terms as the Governor in Council considers appropriate, good title in any or all screening equipment or other assets owned by the Corporation immediately before the coming into force of this section, free and clear of all liens and encumbrances, for such consideration as the Governor in Council may determine, having regard to the amount that the Corporation paid to acquire it as well as other relevant factors.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60795" lims:id="60795"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60796" lims:id="60796">Other transfers to Authority</MarginalNote><Label>(2)</Label><Text>The Governor in Council may require the Air Transport Security Corporation to transfer to the Authority, on such terms as the Governor in Council considers appropriate, any rights, titles, interests or obligations under any contract entered into by the Corporation that is specified by the Minister, despite any contractual restriction on the transfer of those rights, titles, interests or obligations.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60797" lims:id="60797"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60798" lims:id="60798">Transfer to Authority from air carriers</MarginalNote><Label>(3)</Label><Text>The Governor in Council may require air carriers to transfer to the Authority, on such terms as the Governor in Council considers appropriate, their rights, titles, interests or obligations under any contract respecting screening specified by the Minister, despite any contractual restriction on the transfer of those rights, titles, interests or obligations.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60799" lims:id="60799"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60800" lims:id="60800">Transfer of contracts</MarginalNote><Label>(4)</Label><Text>The transfer to the Authority of responsibility for any existing contracts under this section does not affect any rights, responsibilities or obligations acquired under the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal> by the contractors, their employees or any trade union certified to represent those employees.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60801" lims:id="60801"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60802" lims:id="60802">Transfer of screening equipment</MarginalNote><Label>(5)</Label><Text>The Governor in Council may transfer to the Authority any screening equipment owned by Her Majesty, including explosive detection equipment, on such terms and conditions as the Governor in Council considers appropriate.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60803" lims:id="60803"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60804" lims:id="60804">Transfer of Her Majesty’s rights, etc., under contract</MarginalNote><Label>(6)</Label><Text>The Governor in Council may transfer to the Authority, on such terms as the Governor in Council considers appropriate, Her Majesty’s rights, titles, interests or obligations under any contract entered into by the Minister before the coming into force of this section respecting a subject-matter that is within the mandate of the Authority.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60810" lims:id="60810">Agreements to continue delivering screening</MarginalNote><Label>38</Label><Text>The Authority may enter into an agreement with an air carrier in order to contribute to the costs of screening at an aerodrome designated by regulation, if the costs are incurred by the air carrier after the day on which this section comes into force and before the day on which the Authority is required under the <XRefExternal reference-type="act" link="A-2">Aeronautics Act</XRefExternal> to deliver that screening.</Text></Section><Section lims:inforce-start-date="2003-01-01" lims:lastAmendedDate="2003-01-01" lims:fid="60811" lims:id="60811"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60812" lims:id="60812">Financial documents</MarginalNote><Label>39</Label><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60813" lims:id="60813"><Label>(1)</Label><Text>Despite the period prescribed for submitting a corporate plan, an operating budget and a capital budget under the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>, the Authority must, within six months after the coming into force of this section, submit to the Minister in accordance with that Act a corporate plan, an operating budget and a capital budget for its first financial year.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="60814" lims:id="60814"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="60815"
