title</MarginalNote><Label>1</Label><Text>This Act may be cited as the <XRefExternal reference-type="act" link="C-1.4">Canada Border Services Agency Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2005-12-12" lims:fid="42869" lims:id="42869" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2005-12-12" lims:lastAmendedDate="2022-09-01" lims:fid="42870" lims:id="42870"><MarginalNote lims:inforce-start-date="2005-12-12" lims:fid="42871" lims:id="42871">Definitions</MarginalNote><Label>2</Label><Text>The following definitions apply in this Act.</Text><Definition lims:inforce-start-date="2005-12-12" lims:fid="42872" lims:id="42872"><Text><DefinedTermEn>Agency</DefinedTermEn> means the Canada Border Services Agency established under subsection <XRefInternal>3</XRefInternal>(1). (<DefinedTermFr>Agence</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2005-12-12" lims:fid="42873" lims:id="42873"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Public Safety and Emergency Preparedness. (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2005-12-12" lims:fid="42874" lims:id="42874"><Text><DefinedTermEn>President</DefinedTermEn> means the President of the Agency appointed under subsection <XRefInternal>7</XRefInternal>(1). (<DefinedTermFr>président</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2005-12-12" lims:fid="42875" lims:id="42875"><Text><DefinedTermEn>program legislation</DefinedTermEn> means any other Act of Parliament or any instrument made under it, or any part of such an Act or instrument,</Text><Paragraph lims:inforce-start-date="2022-09-01" lims:enacted-date="2022-06-23" lims:fid="42876" lims:id="1374165"><Label>(a)</Label><Text>that the Governor in Council or Parliament authorizes the Minister, the Agency, the President or an employee of the Agency to administer and enforce, including the <XRefExternal reference-type="act" link="E-14">Excise Act</XRefExternal>, the <XRefExternal reference-type="act" link="S-15">Special Import Measures Act</XRefExternal>, the <XRefExternal reference-type="act" link="C-52.6">Customs Act</XRefExternal>, the <XRefExternal reference-type="act" link="C-54.011">Customs Tariff</XRefExternal>, the <XRefExternal reference-type="act" link="I-2.5">Immigration and Refugee Protection Act</XRefExternal>, the <XRefExternal reference-type="act" link="E-14.1">Excise Act, 2001</XRefExternal> and the <XRefExternal reference-type="act" link="S-8.35">Select Luxury Items Tax Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-15" lims:enacted-date="2012-11-22" lims:fid="42877" lims:id="1109931"><Label>(b)</Label><Text>that the Governor in Council or Parliament authorizes the Minister, the Agency, the President or an employee of the Agency to enforce, including the <XRefExternal reference-type="act" link="A-8.8">Agriculture and Agri-Food Administrative Monetary Penalties Act</XRefExternal>, the <XRefExternal reference-type="act" link="F-9">Feeds Act</XRefExternal>, the <XRefExternal reference-type="act" link="F-10">Fertilizers Act</XRefExternal>, the <XRefExternal reference-type="act" link="H-3.3">Health of Animals Act</XRefExternal>, the <XRefExternal reference-type="act" link="P-14.8">Plant Protection Act</XRefExternal>, the <XRefExternal reference-type="act" link="S-1.1">Safe Food for Canadians Act</XRefExternal> and the <XRefExternal reference-type="act" link="S-8">Seeds Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2005-12-12" lims:fid="42878" lims:id="42878"><Label>(c)</Label><Text>under which the Minister or another minister authorizes the Agency, the President or an employee of the Agency to administer a program or carry out an activity; or</Text></Paragraph><Paragraph lims:inforce-start-date="2005-12-12" lims:fid="42879" lims:id="42879"><Label>(d)</Label><Text>under which duties or taxes collected and paid pursuant to the <XRefExternal reference-type="act" link="C-52.6">Customs Act</XRefExternal> are imposed. (<DefinedTermFr>législation lims:fid="42884" lims:id="42884">Agency established</MarginalNote><Label>3</Label><Subsection lims:inforce-start-date="2005-12-12" lims:fid="42885" lims:id="42885"><Label>(1)</Label><Text>The Canada Border Services Agency is established as a body corporate.</Text></Subsection><Subsection lims:inforce-start-date="2005-12-12" lims:fid="42886" lims:id="42886"><MarginalNote lims:inforce-start-date="2005-12-12" lims:fid="42887" lims:id="42887">Agent of Her Majesty</MarginalNote><Label>(2)</Label><Text>The Agency is for all purposes an agent of Her Majesty in right of Canada.</Text></Subsection></Section><Section lims:inforce-start-date="2005-12-12" lims:lastAmendedDate="2005-12-12" lims:fid="42888" lims:id="42888"><MarginalNote lims:inforce-start-date="2005-12-12" lims:fid="42889" lims:id="42889">Head office</MarginalNote><Label>4</Label><Text>The head office of the Agency is to be in the National Capital Region described in the schedule to the <XRefExternal reference-type="act" link="N-4">National Capital Act</XRefExternal>.</Text></Section><Section lims:inforce-start-date="2005-12-12" lims:lastAmendedDate="2005-12-12" lims:fid="42890" lims:id="42890"><MarginalNote lims:inforce-start-date="2005-12-12" lims:fid="42891" lims:id="42891">Mandate of Agency</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2005-12-12" lims:fid="42892" lims:id="42892"><Label>(1)</Label><Text>The Agency is responsible for providing integrated border services that support national security and public safety priorities and facilitate the free flow of persons and goods, including animals and plants, that meet all requirements under the program legislation, by</Text><Paragraph lims:inforce-start-date="2005-12-12" lims:fid="42893" lims:id="42893"><Label>(a)</Label><Text>supporting the administration or enforcement, or both, as the case may be, of the program legislation;</Text></Paragraph><Paragraph lims:inforce-start-date="2005-12-12" lims:fid="42894" lims:id="42894"><Label>(b)</Label><Text>implementing agreements between the Government of Canada or the Agency and a foreign state or a public body performing a function of government in a foreign state to carry out an activity, provide a service or administer a tax or program;</Text></Paragraph><Paragraph lims:inforce-start-date="2005-12-12" lims:fid="42895" lims:id="42895"><Label>(c)</Label><Text>implementing agreements between the Government of Canada or the Agency and the government of a province or other public body performing a function of the Government in Canada to carry out an activity, provide a service or administer a tax or program;</Text></Paragraph><Paragraph lims:inforce-start-date="2005-12-12" lims:fid="42896" lims:id="42896"><Label>(d)</Label><Text>implementing agreements or arrangements between the Agency and departments or agencies of the Government of Canada to carry out an activity, provide a service or administer a program; and</Text></Paragraph><Paragraph lims:inforce-start-date="2005-12-12" lims:fid="42897" lims:id="42897"><Label>(e)</Label><Text>providing cooperation and support, including advice and information, to other departments and agencies of the Government of Canada to assist them in developing, evaluating and implementing policies and decisions in relation to program legislation for which they have responsibility.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2005-12-12" lims:fid="42898" lims:id="42898"><MarginalNote lims:inforce-start-date="2005-12-12" lims:fid="42899" lims:id="42899">Support</MarginalNote><Label>(2)</Label><Text>The Agency may provide support, through the provision of services, to departments and agencies for which the Minister is responsible, in accordance with agreements or arrangements entered into with those departments and agencies.</Text></Subsection></Section><Heading lims:inforce-start-date="2005-12-12" lims:fid="42900" lims:id="42900" level="1"><TitleText>Minister</TitleText></Heading><Section lims:inforce-start-date="2005-12-12" lims:lastAmendedDate="2005-12-12" lims:fid="42901" lims:id="42901"><MarginalNote lims:inforce-start-date="2005-12-12" lims:fid="42902" lims:id="42902">Minister responsible</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2005-12-12" lims:fid="42903" lims:id="42903"><Label>(1)</Label><Text>The Minister is responsible for the Agency.</Text></Subsection><Subsection lims:inforce-start-date="2005-12-12" lims:fid="42904" lims:id="42904"><MarginalNote lims:inforce-start-date="2005-12-12" lims:fid="42905" lims:id="42905">Delegation by Minister</MarginalNote><Label>(2)</Label><Text>The Minister may delegate to any person any power, duty or function conferred on the Minister under this Act or under the program legislation.</Text></Subsection><Subsection lims:inforce-start-date="2005-12-12" lims:fid="42906" lims:id="42906"><MarginalNote lims:inforce-start-date="2005-12-12" lims:fid="42907" lims:id="42907">Exception</MarginalNote><Label>(3)</Label><Text>Subsection (2) does not apply if an Act of Parliament other than this Act authorizes the Minister to delegate the power, duty or function to any person or authorizes any person to exercise or perform it.</Text></Subsection><Subsection lims:inforce-start-date="2005-12-12" lims:fid="42908" lims:id="42908"><MarginalNote lims:inforce-start-date="2005-12-12" lims:fid="42909" lims:id="42909">Limitation</MarginalNote><Label>(4)</Label><Text>Subsection (2) does not apply in respect of a power to make regulations.</Text></Subsection></Section><Heading lims:inforce-start-date="2005-12-12" lims:fid="42910" lims:id="42910" level="1"><TitleText>President and Executive Vice-president</TitleText></Heading><Section lims:inforce-start-date="2005-12-12" lims:lastAmendedDate="2005-12-12" lims:fid="42911" lims:id="42911"><MarginalNote lims:inforce-start-date="2005-12-12" lims:fid="42912" lims:id="42912">Appointment</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2005-12-12" lims:fid="42913" lims:id="42913"><Label>(1)</Label><Text>The Governor in Council shall appoint a President of the Agency to hold office during pleasure for a term of not more than five years, which term may be renewed for one or more further terms.</Text></Subsection><Subsection lims:inforce-start-date="2005-12-12" lims:fid="42914" lims:id="42914"><MarginalNote lims:inforce-start-date="2005-12-12" lims:fid="42915" lims:id="42915">Executive Vice-president</MarginalNote><Label>(2)</Label><Text>The Governor in Council may appoint an Executive Vice-president of the Agency to hold office during pleasure for a term of not more than five years, which term may be renewed for one or more further terms.</Text></Subsection></Section><Section lims:inforce-start-date="2005-12-12" lims:lastAmendedDate="2005-12-12" lims:fid="42916" lims:id="42916"><MarginalNote lims:inforce-start-date="2005-12-12" lims:fid="42917" lims:id="42917">Role of President</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2005-12-12" lims:fid="42918" lims:id="42918"><Label>(1)</Label><Text>The President, under the direction of the Minister, has the control and management of the Agency and all matters connected with it.</Text></Subsection><Subsection lims:inforce-start-date="2005-12-12" lims:fid="42919" lims:id="42919"><MarginalNote lims:inforce-start-date="2005-12-12" lims:fid="42920" lims:id="42920">Rank of deputy head</MarginalNote><Label>(2)</Label><Text>The President has the rank and all the powers of a deputy head of a department.</Text></Subsection><Subsection lims:inforce-start-date="2005-12-12" lims:fid="42921" lims:id="42921"><MarginalNote lims:inforce-start-date="2005-12-12" lims:fid="42922" lims:id="42922">Executive Vice-president’s powers</MarginalNote><Label>(3)</Label><Text>The Executive Vice-president shall exercise the powers and perform the duties and functions that the President may assign and shall act as President if that office is vacant or if the President is absent or incapacitated.</Text></Subsection></Section><Section lims:inforce-start-date="2005-12-12" lims:lastAmendedDate="2019-01-15" lims:fid="42923" lims:id="42923"><MarginalNote lims:inforce-start-date="2005-12-12" lims:fid="42924" lims:id="42924">Delegation by President</MarginalNote><Label>9</Label><Subsection lims:inforce-start-date="2005-12-12" lims:fid="42925" lims:id="42925"><Label>(1)</Label><Text>The President may delegate to any person any power, duty or function that the President is authorized to exercise or perform under this Act or any other enactment.</Text></Subsection><Subsection lims:inforce-start-date="2005-12-12" lims:fid="42926" lims:id="42926"><MarginalNote lims:inforce-start-date="2005-12-12" lims:fid="42927" lims:id="42927">Designation of officers</MarginalNote><Label>(2)</Label><Text>The President may designate any person, or person within a class of persons,</Text><Paragraph lims:inforce-start-date="2005-12-12" lims:fid="42928" lims:id="42928"><Label>(a)</Label><Text>as an officer as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="C-52.6">Customs Act</XRefExternal> to exercise any powers or perform any duties and functions of an officer under that Act that the President may specify; or</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-15" lims:enacted-date="2012-11-22" lims:fid="42929" lims:id="1109933"><Label>(b)</Label><Text>as an inspector or a veterinary inspector or other officer for the enforcement of any Act or instrument made under it, or any part of an Act or instrument, that the Governor in Council or Parliament authorizes the Minister, the Agency, the President or an employee of the Agency to enforce, including the <XRefExternal reference-type="act" link="A-8.8">Agriculture and Agri-Food Administrative Monetary Penalties Act</XRefExternal>, the <XRefExternal reference-type="act" link="F-9">Feeds Act</XRefExternal>, the <XRefExternal reference-type="act" link="F-10">Fertilizers Act</XRefExternal>, the <XRefExternal reference-type="act" any power that the Minister has to designate officers under subsection 6(1) of the <XRefExternal reference-type="act" link="I-2.5">Immigration and Refugee Protection lims:inforce-start-date="2005-12-12" lims:fid="42934" lims:id="42934"><Label>(1)</Label><Text>The President and the Executive Vice-president shall be paid the remuneration that is fixed by the Governor in Council.</Text></Subsection><Subsection lims:inforce-start-date="2005-12-12" lims:fid="42935" lims:id="42935"><MarginalNote lims:inforce-start-date="2005-12-12" lims:fid="42936" lims:id="42936">Expenses</MarginalNote><Label>(2)</Label><Text>The President and the Executive Vice-president are entitled to be paid reasonable travel and living expenses incurred by them in the course of performing their duties while absent from their ordinary place of work.</Text></Subsection><Subsection lims:inforce-start-date="2005-12-12" lims:fid="42937" lims:id="42937"><MarginalNote lims:inforce-start-date="2005-12-12" lims:fid="42938" lims:id="42938">Deemed employment</MarginalNote><Label>(3)</Label><Text>The President and the Executive Vice-president are deemed to be employed in the public service for the purposes of the <XRefExternal reference-type="act" link="P-36">Public Service Superannuation Act</XRefExternal> and to be employed in the federal public administration for the purposes of the <XRefExternal reference-type="act" link="G-5">Government Employees Compensation Act</XRefExternal> and any regulations made under section 9 of the <XRefExternal reference-type="act" link="A-2">Aeronautics Act</XRefExternal>.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2005-12-12" lims:fid="42940" lims:id="42940">2005, c. 38, ss. 10, 144(E)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2005-12-12" lims:fid="42941" lims:id="42941" level="1"><TitleText>Human Resources</TitleText></Heading><Section lims:inforce-start-date="2005-12-12" lims:lastAmendedDate="2005-12-12" lims:fid="42942" lims:id="42942"><MarginalNote lims:inforce-start-date="2005-12-12" lims:fid="42943" lims:id="42943">Officers and employees</MarginalNote><Label>11</Label><Text>Officers and employees necessary for the proper conduct of the work of the Agency shall be appointed in accordance with the <XRefExternal reference-type="act" link="P-33.01">Public Service Employment Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2005-12-12" lims:fid="42944" lims:id="42944" level="1"><TitleText>Powers of the Agency</TitleText></Heading><Section lims:inforce-start-date="2005-12-12" lims:lastAmendedDate="2005-12-12" lims:fid="42945" lims:id="42945"><MarginalNote lims:inforce-start-date="2005-12-12" lims:fid="42946" lims:id="42946">Exercise of powers conferred on Minister</MarginalNote><Label>12</Label><Subsection lims:inforce-start-date="2005-12-12" lims:fid="42947" lims:id="42947"><Label>(1)</Label><Text>Subject to any direction given by the Minister, the Agency may exercise the powers, and shall perform the duties and functions, that relate to the program legislation and that are conferred on, or delegated, assigned or transferred to, the Minister under any Act or regulation.</Text></Subsection><Subsection lims:inforce-start-date="2005-12-12" lims:fid="42948" lims:id="42948"><MarginalNote lims:inforce-start-date="2005-12-12" lims:fid="42949" lims:id="42949">Officers and employees</MarginalNote><Label>(2)</Label><Text>An officer or employee of the Agency may exercise any power or perform any duty or function referred to in subsection (1) if the officer or employee is appointed to serve in the Agency in a capacity appropriate to the exercise of the power or the performance of the duty or function, and, in so doing, shall comply with any general or special direction given by the Minister.</Text></Subsection><Subsection lims:inforce-start-date="2005-12-12" lims:fid="42950" lims:id="42950"><MarginalNote lims:inforce-start-date="2005-12-12" lims:fid="42951" lims:id="42951">Exception</MarginalNote><Label>(3)</Label><Text>Subsection (1) does not include</Text><Paragraph lims:inforce-start-date="2005-12-12" lims:fid="42952" lims:id="42952"><Label>(a)</Label><Text>any power, duty or function of the Minister under this Act; or</Text></Paragraph><Paragraph lims:inforce-start-date="2005-12-12" lims:fid="42953" lims:id="42953"><Label>(b)</Label><Text>a power to make regulations.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2005-12-12" lims:fid="42954" lims:id="42954"><MarginalNote lims:inforce-start-date="2005-12-12" lims:fid="42955" lims:id="42955">Non-application of <XRefExternal the <XRefExternal reference-type="act" link="P-24.501">Proceeds of Crime (Money Laundering) and Terrorist Financing Act</XRefExternal>, the Agency may, with the approval of the Governor in Council, on the recommendation of the Minister and the Minister of Foreign Affairs, enter into an agreement with a foreign state or an international organization, for the purposes of carrying out the mandate of lims:id="42972">Appropriation Acts</MarginalNote><Label>15</Label><Text>An appropriation Act may provide that the balance of money appropriated by Parliament for the use of the Agency that remains unexpended at the end of the fiscal year, after the adjustments referred to in section 37 of the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal> are made, lims:inforce-start-date="2005-12-12" lims:fid="43000" lims:id="43000">Transfer of powers, duties and functions</MarginalNote><Label>(2)</Label><Text>Wherever under any Act, order, rule or regulation, or any contract, lease, licence or other document, any power, duty or function is vested in or exercisable by the President of the former agency or an employee of the former agency, the power, duty or function is vested in and shall be exercised by the President of the new agency or an employee of the new agency unless the Governor in Council by order designates a deputy minister or an officer of           — 2024, c. 25, s. 111</TitleText></Heading><Section type="amending"><Label>111</Label><Text>The Act is amended by adding the following after section 14:</Text><AmendedText include-in-TableOfProvisions="no"><Heading level="1"><TitleText>Serious Incidents</TitleText></Heading><Section><MarginalNote>Definitions</MarginalNote><Label>14.1</Label><Subsection><Label>(1)</Label><Text>The following definitions apply in this section and sections 14.2 to 14.9.</Text><Definition><Text><DefinedTermEn>employee</DefinedTermEn>, in relation to the Agency, includes any person who assists the Agency in the exercise of any of its powers or the performance of any of its duties and functions under this Act. (<DefinedTermFr>employé</DefinedTermFr>)</Text></Definition><Definition><Text><DefinedTermEn>serious incident</DefinedTermEn> means an incident in which the actions of an officer or employee of the Agency in the exercise of its powers or the performance of its duties and functions under this Act</Text><Paragraph><Label>(a)</Label><Text>may have resulted in serious injury to or the death of any person; or</Text></Paragraph><Paragraph><Label>(b)</Label><Text>may have constituted an offence under federal or provincial law that the Minister or the President decides would be in the public interest to be investigated by the Agency. (<DefinedTermFr>incident grave</DefinedTermFr>)</Text></Paragraph></Definition><Definition><Text><DefinedTermEn>serious injury</DefinedTermEn> means a prescribed physical or psychological injury. (<DefinedTermFr>blessure grave</DefinedTermFr>)</Text></Definition></Subsection><Subsection><MarginalNote>Regulations</MarginalNote><Label>(2)</Label><Text>The Governor in Council may make regulations prescribing physical or psychological injuries for the purposes of the definition <DefinitionRef>serious injury</DefinitionRef> in subsection (1).</Text></Subsection></Section><Section><MarginalNote>Notification</MarginalNote><Label>14.2</Label><Text>As soon as feasible after becoming aware that a serious incident is alleged to have occurred, the President shall notify the police force that has jurisdiction at the location where it is alleged to have occurred and the Commission of the alleged serious incident.</Text></Section><Section><MarginalNote>Investigation</MarginalNote><Label>14.3</Label><Subsection><Label>(1)</Label><Text>Subject to subsection (2), as soon as feasible after the President becomes aware that a serious incident is alleged to have occurred, the Agency shall investigate the alleged serious incident.</Text></Subsection><Subsection><MarginalNote>Limit on investigation</MarginalNote><Label>(2)</Label><Text>If the alleged serious incident involves the actions of one or more persons, the Agency shall not, in the investigation, investigate the actions of any person who assists the Agency in the exercise of any of its powers or the performance of any of its duties and functions under this Act by reason only of an agreement or arrangement referred to in subsection 13(3).</Text></Subsection></Section><Section><MarginalNote>Copy of records</MarginalNote><Label>14.4</Label><Text>As soon as feasible after completing the investigation, the President shall provide the Commission with a copy of any records in its possession relating to the investigation. The President shall also provide the Commission with a copy of any record in respect of every other lawfully authorized investigation conducted into the alleged serious incident that the Agency receives after the completion of its own investigation.</Text></Section><Section><MarginalNote>Observer</MarginalNote><Label>14.5</Label><Subsection><Label>(1)</Label><Text>The Agency shall permit an observer appointed by the Commission under subsection (2) to assess the impartiality of the investigation.</Text></Subsection><Subsection><MarginalNote>Appointment of observer</MarginalNote><Label>(2)</Label><Text>The Commission may appoint an observer to assess the impartiality of the investigation.</Text></Subsection><Subsection><MarginalNote>Observers are compellable</MarginalNote><Label>(3)</Label><Text>Despite subsection 11(3) of the <XRefExternal reference-type="act" link="P-27.5">Public Complaints and Review Commission Act</XRefExternal>, but subject to section 14.8(1), every observer is a compellable witness in every criminal, civil or administrative action or proceeding, or inquiry, in respect of any matter coming to the knowledge of the observer as a result of exercising a power or performing a duty or function under this Part.</Text></Subsection><Subsection><MarginalNote>No observer appointed</MarginalNote><Label>(4)</Label><Text>If no observer is appointed to an investigation of a serious incident under subsection (2), the President shall provide the Chairperson of the Commission with a report that sets out all measures that have been or will be taken by the Agency to ensure the impartiality of the investigation.</Text></Subsection></Section><Section><MarginalNote>Recommendations</MarginalNote><Label>14.6</Label><Text>If the observer has concerns with the impartiality of the investigation, the observer may inform the Agency of their concerns and may make any recommendations to the Agency that they consider appropriate to address those concerns.</Text></Section><Section><MarginalNote>Report</MarginalNote><Label>14.7</Label><Subsection><Label>(1)</Label><Text>The observer shall, in accordance with the regulations, provide a report respecting the impartiality of the investigation of a serious incident to the Chairperson of the Commission and the President.</Text></Subsection><Subsection><MarginalNote>Response</MarginalNote><Label>(2)</Label><Text>If the observer’s report identifies concerns with respect to the impartiality of an investigation, the President shall provide to the Chairperson of the Commission a written response to the observer’s report that includes a description of what actions have or will be taken by the Agency to address those concerns.</Text></Subsection><Subsection><MarginalNote>Report on response</MarginalNote><Label>(3)</Label><Text>If the Chairperson of the Commission is not satisfied with the response of the President, the Chairperson shall issue a report to that effect to the Minister.</Text></Subsection></Section><Section><MarginalNote>Information subject to privilege</MarginalNote><Label>14.8</Label><Subsection><Label>(1)</Label><Text>Nothing in this Act authorizes a person to disclose to an observer <DefinitionRef>privileged information</DefinitionRef>, as defined in subsection 17(1) of the <XRefExternal reference-type="act" link="P-27.5">Public Complaints and Review Commission Act</XRefExternal>, and an observer shall not use or disclose that information if it is disclosed.</Text></Subsection><Subsection><MarginalNote>Offence to disclose certain information</MarginalNote><Label>(2)</Label><Text>Every person who contravenes subsection (1) is</Text><Paragraph><Label>(a)</Label><Text>guilty of an indictable offence and liable to imprisonment for a term of not more than five years;
